Jerusalem Talmud Sanhedrin 1:76

It was stated: “Temple dedications by three [appraisers].” That is, if one dedicated the body of a field. But if he said, I am vowing a mina for the Temple, let us hear from the following: “Appraisal of movables by three [appraisers].” Do there exist appraisals not of movables? Rebbi Jacob bar Aḥa, Rebbi Simeon bar Abba in the name of Rebbi Ḥanina: If somebody says, I am vowing my appraisal, and comes to settle his debt by real estate, one appraises it by ten [people], by movables by three. Is one who says, I am vowing my appraisal not like one who says, I am vowing my field’s value? But if he said, I am vowing a mina for the Temple, one appraises him by three [people]. Should he become rich, he will be judged by what he can afford.

Jerusalem Talmud Sanhedrin 1:77

It was stated: One does not make public tender for slaves, securities, and movables. [What is public tender?] Rebbi Jehudah ben Pazi said, announcement. Ulla bar Ismael said, slaves lest they flee, securities and movables lest they be stolen. Rebbi Abba bar Cohen asked before Rebbi Yose: Does this not imply that a slave be redeemed in front of three people? He answered him, yes. But did we not state: “Real estate nine and a Cohen. The same holds for humans”? He answered him, but the human here is a free person. Ḥanania bar Šelemiah in the name of Rav: A case came before Rebbi who wanted to act following the rabbis. Rebbi Eleazar ben Proteus, the grandson of Rebbi Eleazar ben Proteus, said to him: Rebbi, did you not teach us in your grandfather’s name, “except if he offered public tender”? He answered, yes, changed his mind, and acted following Rabban Gamliel.

Jerusalem Talmud Sanhedrin 1:87

“Abba Shaul says, two subdivisions were there, the lower and the upper, whose sanctification was not complete. The lower one was dedicated with a full ceremony, but the upper one only when they came from the diaspora, without a king and without Urim and Tummim. Therefore, in the lower one the vulgar eat family sacrifices and Second Tithe; Fellows eat there family sacrifices but not Second Tithe. In the upper one, the vulgar eat family sacrifices but not Second Tithe; Fellows eat there family sacrifices and Second Tithe. Why did they not sanctify it? Because it was the vulnerable spot of Jerusalem; it could be conquered from there.”

Jerusalem Talmud Sanhedrin 1:91

HALAKHAH: “The High Synhedrion,” etc. Rebbi Abba, Rebbi Yasa in the name of Rebbi Joḥanan: It says here “congregation”, and it says there “congregation”, how long the evil congregation. Since “congregation” there means ten, so here also ten. Rebbi Simon said, it is said here “amid”, and it is said there “amid”. Since “amid” there means ten, so here also ten. Rebbi Yose ben Rebbi Abun told him, if you want to infer from “amid”, there are too many. But it is said here “the sons of Israel”, and it is said there, “the sons of Israel”, the sons of Israel came to buy grain. Since “the sons of Israel” there were ten, so here also ten.

Jerusalem Talmud Sanhedrin 2:26

It is written: David turned. Who are the “empty ones”? Rebbi Abba bar Cahana said, the most empty one, that is the dancer. She told him, today the honor of my father’s house became obvious. One said about the family of Saul that one never saw a heel or a thumb of them. That is what is written: He came to the sheep fences. Rebbi Abun ben Rebbi Eleazar: That was a fence inside a fence. Saul came to spread his feet. He saw him how he lifted a little and covered a little. He said, one who would touch such modesty would be cursed. That is what he told him, behold, what your eyes saw today, etc. Is it not written “I had mercy on you” but it had mercy on you, your modesty had mercy on you. David told Michal, etc. With the servant girls you mentioned, with them I shall be honored, for they are not servant girls but mothers. How was she punished? Michal, Saul’s daughter, had no child, But is it not written: The sixth Yitreˋam, of his wife Calf. She mood like a calf and died.

Jerusalem Talmud Sanhedrin 2:31

It is written: David had a desire and said, who would give me to drink from the cistern of Bethlehem, etc. Rebbi Ḥiyya bar Abba said, he questioned practice. Three broke through. Why three? For no practice can be elucidated by less than three [opinions]. But David refused to drink. David did not want that the practice would be attached to his name. He poured it out for the Eternal, he fixed it as a tractate for all generations, “he breaches fences on his way.”

Jerusalem Talmud Sanhedrin 2:33

One verse says, he made a libation for the Eternal, but another verse says, he covered. He who says ויסך, supports Rebbi Ḥiyya bar Abba. He who says, he made a libation, supports Bar Qappara. Rebbi Huna in the name of Rebbi Yose: He had a problem with the rules of captives. Rebbi Simeon ben Rebbi said, he desired to build the Temple

Jerusalem Talmud Sanhedrin 3:10

“If one was obligated to swear to another,” etc. Rebbi Ḥiyya bar Abba said, if he told him, let your father tell it to me, then I shall have no claim on you. But if he told him: Let you father tell it, then I shall accept it; he seeks a pretext to confess to him. Rebbi Yose ben Ḥanina said, even if he told him, let you father tell it to me, then I shall accept it. We never find that testimony be accepted from the mouth of a relative.

Jerusalem Talmud Sanhedrin 3:16

“Rebbi Simeon says, earlier they were listing harvesters of sabbatical produce; but since the increase of oppressors they returned to list only dealers in sabbatical produce. Rebbi Jehudah said, when? If he has no profession but this; but if he has another profession, he is qualified.” How is this implemented? If he was sitting idle all the years of the sabbatical cycle but when the Sabbatical began he became active and traded in sabbatical produce. If at the same time he is engaged in another occupation, he is qualified; otherwise he is disqualified. But if he was working in his profession all the years of the sabbatical cycle and when the Sabbatical began he became active and traded in sabbatical produce, even if he has no other profession on the side he is qualified. Rebbi Abba bar Zavda, Rebbi Abbahu in the name of Rebbi Eleazar: Practice follows Rebbi Jehudah of our Mishnah. Rebbi Abba bar Zavda was praised for formulating the tradition in the name of a person younger than himself.

Rebbi Abba bar Zavda was praised for formulating the tradition in the name of a person younger than himself.

Jerusalem Talmud Sanhedrin 3:17

Rebbi Ḥiyya stated restrictively. How is this implemented? If he was working in his profession all the years of the sabbatical cycle but when the Sabbatical began he became active and traded in sabbatical produce. Even if he has another profession on the side he is disqualified. This is not what Rebbi Abba bar Zavda, Rebbi Abbahu said in the name of Rebbi Eleazar: Practice follows Rebbi Jehudah of our Mishnah. Rebbi Abba bar Zavda was praised for formulating the tradition in the name of a person younger than himself. Here also should it be so? Rebbi Yose ben Rebbi Abun said, there the government is not oppressive, here the government is oppressive.

Jerusalem Talmud Sanhedrin 3:22

Rebbi Abba bar Zemina was working as a tailor for somebody in Rome. He brought him carcass meat and told him to eat. He said to him, I will not eat. He said to him, eat! Otherwise I shall kill you. He said to him, if you have to kill, kill, for I shall not eat carcass meat. He said to him, certainly you should know that I would have killed you, had you eaten. Either one is a Jewish Jew or an Aramean Aramean. Rebbi Mana said, if Rebbi Abba bar Zemina had understood the words of the rabbis, he would have been gone.

Jerusalem Talmud Sanhedrin 3:44

Rebbi Berekhiah and Rebbi Ḥelbo, Rebbi Abba in the name of Rebbi Yannai: The claimant claims, the respondent responds, and the judge decides. Rebbi Simon said, the judge has to repeat their arguments, as it is said: The king said, this one says, my son is the living and yours is the dead one, etc.

Jerusalem Talmud Sanhedrin 3:54

Rebbi Abba said in the name of Rav Huna: The witnesses have to stand while testifying, for it is said: the two men shall stand. Rebbi Jeremiah in the name of Rebbi Abbahu: Also the parties have to stand at the moment the verdict is given, as it is said: who have the quarrel before the Eternal.

Jerusalem Talmud Sanhedrin 3:65

Should a relative be found guilty of a blurted oath? Does it follow what Rebbi Abba said (ben) [in the name of] Samuel: “An oath that X gave a mina to Y,” and it turns out that X had not given; since there is nothing in the future there is nothing in the past. Or the following: “One said to another, ˋwhere is my ox?’ He responded, ˋI do not know what you are referring to.’ It so happened that it had died, or was wounded, or captured, or lost. ˋI require you to swear;’ the other said ˋAmen’. He is not liable.” Rav said, he is not liable for a keeper’s oath but is liable because of a blurted oath. Rebbi Joḥanan said, since it is a religious duty to appease him, he is not liable because of a blurted oath. In Rav’s opinion, is there no religious duty to appease him? One appeases with truthful statements, not with lies.

Jerusalem Talmud Sanhedrin 3:67

Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and the other says, I saw two hairs on his side. If one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his side. Two are saying, we saw one hair on his back; and two are saying, we saw one hair on his belly. Rav Yose and Rav Hoshaia ben Rav Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe they were rubbed off. One says, two hairs on his back; and one says, two on his belly. Rebbi Abba said, everybody agrees that this is valid. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Yose said, this is in disagreement. Rebbi [Yose] said to Rebbi Ḥaggai, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mama said, Rebbi Ḥaggai was correct. If a document was signed by four seals, if one person verified the signature of two [witnesses], and another those of the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single hair needs two witnesses. Rebbi Ḥinena learns it (because of) [from the years of] squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth, fifth, and sixth years, is that worth anything? Does not every single year need two witnesses? And here, every single hair needs two witnesses.

Jerusalem Talmud Sanhedrin 3:67

Jerusalem Talmud Sanhedrin 3:69

Rav Ḥisda asked: May one receive witnesses not in the presence of one of the parties? Rebbi Yose in the name of Rebbi Sabbatai: One may receive witnesses not in the presence of the parties and even issue a decision, but if [the absent party] appeals, their appeal must be heard. If a person was summoned by the court three times and did not appear, Rebbi Joshua ben Levi said that one may receive witnesses not in the presence of the parties and issue a decision. As the following: Cahana died and had willed his estate to Rebbi Joshia. Rebbi Eleazar heard witnesses not in the presence [of the heirs] and handed the estate to Rebbi Joshia. Not only that, but the estate contained Torah scrolls. Rebbi Eleazar wrote to his heirs: Scrolls won by the Land of Israel cannot be taken outside. Rebbi Nissai in the name of Rebbi Eleazar: If they were written for export, they can be exported. Rebbi Ḥiyya bar Abba asked before Rebbi Yasa: May one export? He asked him, do you ask me in a practical case? He answered, no. Rebbi Zeˋira was dissatisfied that he had not asked in a practical case, to know what he would have said.

Jerusalem Talmud Sanhedrin 4:2

HALAKHAH: “Both civil suits,” etc. Rebbi Joḥanan said, to protect Israel’s money they said, “tell why you know that this person owes the other.” Rebbi Ḥiyya bar Abba asked before Rebbi Yasa: What does one do in practice? He answered, following Rebbi Joḥanan, as Rebbi Joḥanan said, to protect Israel’s money they said, “tell why you know that this person owes the other.” Ze‘ir bar Ḥinena in the name of Rebbi Ḥanina and Rav Jehudah, one said: You shall cross-examine, investigate, and inquire well. The other said, equity, equity you shall pursue. How is that? If you see that the verdict will be the truth, investigate it; otherwise, act in equity.

Jerusalem Talmud Sanhedrin 4:28

HALAKHAH: “Three rows of students of the Sages,” etc. Rebbi Abba (bar) [Rebbi] Yasa in the name of Rebbi Joḥanan: It says here congregation, and it says there congregation. Rav brought it from a Mishnah; the Mishnah says “be a tail of lions and not a head of jackals.” The parable says, be a head of jackals but not a tail of lions. But we have stated: “If they needed to ordain, they ordained one from the first row.”

Jerusalem Talmud Sanhedrin 5:15

Rav said, if testimony was contradictory in its essence, the testimony is not void. Rebbi Joḥanan said, if testimony is contradictory in itself, the testimony is void. In the opinion of everybody, if testimony was contradictory in aspects that belong after the fact, the testimony is not void. The strength of Rebbi Joḥanan is consistent with what Rebbi Abba bar Ḥiyya said in the name of Rebbi Joḥanan, if it was agreed that he counted but one [witness] said, he counted from a wallet, and the other said, he counted from a bundle, that contradicts the essence of the testimony, and Rav will agree that the testimony be void. Where do they disagree? If there were two groups of witnesses, one says he counted from a wallet and the other says he counted from a bundle. That contradicts the essence of the testimony: the testimony is void, but according to Rav, the testimony is not void. One said, he counted into his bosom, but the other said, he counted into his money-belt: everybody agrees that this contradicts the essence of the testimony but the testimony is not void. If one [witness] said, he killed him with a sword, the other [witness] said, he killed him with a mace, that contradicts the essence of the testimony; Rav will agree that the testimony be void. Where do they disagree? If there were two groups of witnesses, one says he killed him with a sword and the other says, he killed him with a mace. That contradicts the essence of the testimony, the testimony is void, but according to Rav, the testimony is not void. One says, he turned to the North and one says, he ran away to the South, everybody agrees that the testimony was contradictory in aspects that belong after the fact, and the testimony is not void. The strength of Rav comes from what we have stated there: “Rebbi Jehudah and Rebbi Simeon say, since both agree that he is not alive they can be remarried.” He did not hear that Rebbi Eleazar said, Rebbi Jehudah and Rebbi Simeon concede in the case of witnesses. What is the difference between witnesses and the co-wife? They do not consider the co-wife’s words compared to those of her companion. Rebbi Joḥanan said, if Rebbi Eleazar said this, he said it because he had heard it from me. The Mishnah disagrees with Rav: “Both in investigations and cross-examinations, if they contradict one another their testimony is worthless.” What does Rav do with this? Rebbi Mana said, Rav will explain it as referring to single witness against single witness. Rebbi Abun said, even if you say groups and groups. There is a difference in criminal cases, as it is written: Justice, justice you shall pursue.

Jerusalem Talmud Sanhedrin 6:25

The king said, I shall give. The king took the two sons of Riṣpah bat Ayah. Michal, Saul’s daughter, did not have a child, and you say so? Say now that they were sons of Merab but Michal raised them, so they were named after her. The king gave them into the hand of the Gibeonites who hanged them on the mountain before the Eternal. All seven is written defective of one letter. That refers to Mephiboshet, for whom David prayed and whom the altar received. He told them, I let them pass by the altar and anyone whom the altar receives will be his, because of Mephiboshet who was great in Torah. He let him pass by the altar, which received him. Rebbi Avin said, I shall call to the Most High God, to the Power Who has the ultimate decision over me. For the Holy One, praise to Him, agreed with David. They were killed on the day of harvest …at the start of the barley harvest. Riṣpah bat Ayah took a garment and laid it out on the rock. What means on the rock? Rebbi Hoshaia said, she was reciting: The rock, perfect is His action. Rebbi Abba bar Zamina in the name of Rebbi Hoshaia: Sanctification of the Name is greater than desecration of the Name. Referring to sanctification of the Name it is written: Do not leave his corpse overnight. But referring to desecration of the Name it is written that they were left hanging until water was poured on them. This teaches that they were hanging from the sixteenth of Nisan to the seventeenth of Marḥeshwan. The passers-by were saying: How did these people sin that the rules of justice were changed for them? They were answered: Because these had attacked cursed proselytes. Is that not an argument de minore ad majus? Since even for those who did not convert for the sake of Heaven, the Eternal avenged their blood; if one would convert for the sake of Heaven not so much more? Many converts were converted at that time; that is what is written: Solomon counted all proselytes … and appointed from them 70’000 carriers, etc.

Jerusalem Talmud Sanhedrin 7:22

But Rebbi Joḥanan himself had a problem: from where does one prove it? Rebbi Abbahu in the name of Rebbi Eleazar in the name of Rebbi Hoshaia: Two prohibitions and one extirpation, the prohibitions split the extirpation. For example, it should not be used to be rubbed on anybody’s skin and in its proportions you shall not imitate it, and it is written, a person who would compound similarly, or who would put it on a stranger, will be extirpated from his people, that is two prohibitions and one extirpation. The prohibitions split the extirpation. Also from the following: Samuel bar Abba asked before Rebbi Ze`ura, should not well-being sacrifices, being treated separately, split all sancta regarding impurity? He told him, it was necessary that they be treated separately, to eliminate sancta destined for the upkeep of the Temple [regarding larceny], lest one be liable for them because of mushiness, leftovers, and impurity. But is that not a Mishnah? “All sancta destined for the altar combine with one another with respect to liability for mushiness, leftovers, and impurity,” in contrast to sancta destined for the upkeep of the Temple. Since they do not combine, they do (not) split. Rebbi Ḥanina said, what he really questioned, should they not split but combine ?

Jerusalem Talmud Sanhedrin 7:23

If He stated a general principle as a positive commandment but the detail as a prohibition, the word of Rebbi Eleazar is that this is a general principle followed by a detail. Rebbi Eleazar said, one whips for ploughing in the Sabbatical year. Rebbi Joḥanan said, one does not whip for ploughing in the Sabbatical year. What is Rebbi Eleazar’s reason? The Land shall keep a Sabbath for the Eternal, a general principle. Your field you shall not sow, your vineyard you shall not prune, detail. The sower and the pruner were included in the general case; why were they mentioned separately? To include with them; since the sower and the pruner are particular in that they perform work on the ground or on a tree, I have only what is work on the ground or on a tree. How does Rebbi Joḥanan treat this? They are two different things, and two different details for one general principle do divide. In Rebbi Eleazar’s opinion they do not divide. But he holds that because they do not divide, they are for making inferences. In Rebbi Joḥanan’s opinion, they are not for making inferences. There is a difference here because He stated a general principle as a positive commandment but the detail as prohibitions. No positive commandment allows inferences for a prohibition and no prohibition allows inferences for a positive commandment. In Rebbi Eleazar’s opinion a positive commandment allows inferences for a prohibition but no prohibition allows inferences for a positive commandment. In Rebbi Joḥanan’s opinion it is obvious that one may dig cisterns, ditches, and caves during it. In Rebbi Eleazar’s opinion, may one dig cisterns, ditches, and caves during it? Just as one cannot make inferences for prohibitions, so one should not be able to make inferences for permissions. Rebbi Abba from Carthage said, Rebbi Joḥanan’s reason is six years you shall sow your field, not in the Sabbatical; and six years you shall prune your vineyard, not in the Sabbatical. Any prohibition inferred from a positive commandment is a positive commandment; one violates a positive commandment. Rebbi Jeremiah said, one violates a positive commandment. Rebbi Yose said, there is not even a positive commandment. But is it not written that the Land shall rest as a repose for the Eternal? That is for the prohibition implied by it.

Jerusalem Talmud Sanhedrin 7:38

Rebbi Abba bar Mamal asked: Think of it, if he erroneously has sexual relations with it. Should it be stoned because of him while he is not liable? Rebbi Simeon asked: Think of it, if he used it to plough on the Sabbath. Is he not being stoned while it is not liable? You have only, as Rebbi Samuel ben Rav Isaac explained: With their silver and gold they made idols for themselves; it is not written “that they be extirpated” but that he be extirpated. As if a person say: the bones of X be ground up for he led his son to evil ways.

Jerusalem Talmud Sanhedrin 7:46

Does one rend his garment nowadays? Rebbi Yose, Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba, Rebbi Ḥisqiah, Rebbi Jeremiah in the name of Rebbi Joḥanan: When blasphemers proliferated, they stopped rending. Does one rend for substitute names today? Let us hear from the following: Rebbi Simeon ben Laqish was travelling on the highway. He met a Samaritan who was repeatedly blaspheming, and he was rending. He dismounted from the donkey and gave him a blow on his heart saying to him: Samaritan! Does your mother have garments to supply me with? [His word] This implies that one rends for substitute names and rends his garments at the present time.

Jerusalem Talmud Sanhedrin 7:53

It is written: He went and worshipped other powers and prostrated himself before them, and to the sun, and to the moon. Rebbi Zeˋira said, it is not said to the sun but and to the sun. That is not principle and detail but addition. Rebbi Abba bar Zemina objected before Rebbi Ze`ura; is it not written any which have fins and scales, and any which do not have fins and scales? Then this is not principle and detail but additions since there is written and? Rebbi Joḥanan bar Marius said, anywhere I am encountering and, I am deleting it. Rebbi Samuel ben Eudaimon said, I would have said that anything in the oceans is forbidden, what is in barrels and vivaria should be permitted. The verse says, and anything which lives in water, an addition.

Jerusalem Talmud Sanhedrin 7:58

Rebbi Abba bar Ḥiyya in the name of Rebbi Joḥanan: Look at the expression which the Torah taught you, Moloch; anything that you make king over yourself, even a chip of wood, even a pebble. I shall extirpate him from amidst his people, to include all other foreign worship in extirpation. Rebbi Nasa in the name of Rebbi Eleazar: to include all other foreign worship relating to sons and daughters, as it was stated: He is guilty whether for the Moloch or any other foreign worship, whether he worshipped them with sons and daughters, or worshipped them with fathers and mothers. Rebbi Zeˋira said: if its worship did not prescribe this; but if its worship did prescribe it, he is free from prosecution. Rebbi Hila said, even if its worship did prescribe it, he is twice guilty. A baraita supports Rebbi Hila: The Moloch was included in all other foreign worships; it is mentioned separately to be lenient in this regard that he be guilty only for his descendants. Rebbi Tanḥum bar Jeremiah said, it follows that Rebbi Eleazar ben Rebbi Simeon follows the argument of his father Rebbi Simeon. Just as Rebbi Simeon said, the Moloch was included in all other foreign worships; it is mentioned separately to be lenient in this regard that he be guilty only for his descendants, so Rebbi Eleazar ben Rebbi Simeon said, the Moloch was included in all other foreign worships; it is mentioned separately to be lenient in this regard that he be guilty only for his descendants.

Jerusalem Talmud Sanhedrin 7:69

“One who has sexual relations with a preliminarily married maiden.” Rebbi Yasa in the name of Rebbi Joḥanan, Rebbi Ḥiyya in the name of Rebbi Eleazar: This is Rebbi Meïr’s. But for the rabbis even if she is a minor. What is Rebbi Meïr’s reason? “Lad” is written defectively in the paragraph. How do the rabbis explain “a lad”? Rebbi Abbahu in the name of Rebbi Simeon ben Laqish: Once in the paragraph it is written a young woman; this teaches that in the entire paragraph she is an adult. Rebbi Meïr objected to the rabbis: In the matter of the calumniator, a lad is written and she is an adult since a minor is not stoned? What do the rabbis do with this? Rebbi Abin said, explain it that he came to her as a male. Rebbi Jacob bar Abba asked before Rav: What is the law of him who comes to a minor? He said to him, by stoning. What is the law of him who comes to an adult? He said to him, I am reading an adolescent, not an adult. Read an adolescent, not a minor! Do you not agree with me that she has the right to a fine? He answered, because he mistreated her, that includes a minor for a fine. Read because he mistreated her, that includes an adult for a fine! Rav said, even though Rebbi Jacob bar Abba won the logical argument, practice is that he who comes to a minor is [punished] by stoning but she is free. Rebbi Abun in the name of (Rebbi) Samuel. Why? He understood it from the following: The man who had lain with her alone shall die. Do we not know that the girl has not committed a capital crime? Why does the verse say, do not do anything to the girl; the girl has not committed a capital crime? That includes him who has sexual relations with a [preliminarily married] underage girl; he is stoned and she is free.

Jerusalem Talmud Sanhedrin 7:69

Rebbi Abba, Rebbi Joḥanan in the name of Rav Hoshaia: he is guilty only if he steals money. Rebbi Zeˋira in the name of Rebbi Hoshaia: he is guilty only if he shows contempt for money. What means showing contempt for money? Where do we hold? If about him who says, here you have five and give me for three, he is an idiot. Here you have three and give me for five, he is a regular person. But we deal with one who says, here you have five and give me for five.

Jerusalem Talmud Sanhedrin 10:1

MISHNAH: All of Israel have a part in the World to Come. But the following have no part in the World to Come: One who says that the resurrection of the dead is not biblical, or that the Torah is not from Heaven, or the Epicurean. Rebbi Aqiba says, also one who reads outside books, or who whispers over a wound and says, any sickness that I put on Egypt I shall not put on you, for I am the Eternal, your Healer. Abba Shaul said, also one who pronounces the Name by its letters.

Jerusalem Talmud Sanhedrin 10:14

How far did the merit of the forefathers extend? Rebbi Tanḥuma said in the name of the Elder Rebbi Ḥiyya, (Bar) [Rebbi] Naḥman said it in the name of Rebbi Berekhiah, Rebbi Ḥelbo in the name of Rebbi Abba bar Zavda, up to Joaḥaz. The Eternal was compassionate about them and had mercy for them etc., up to now. Up to that moment, the merit of the forefathers existed. Samuel said, up to Hosea’s [time]. But now, I shall uncover her scandalous behavior before the eyes of her lovers, and no man may save her from My hand. Man can only mean Abraham, as you say, but now return theman’s wife, for he is a prophet. Man can only mean Isaac, as you say, who is this man coming in the field towards us? Man can only mean Jacob, as you say, but Jacob was a simple man. Rebbi Joshua ben Levi said, up to Elijah: It was when the time of the afternoon service came that Elijah the prophet approached and said, O Eternal, God of Abraham, Isaac, and Jacob, today it shall be proclaimed that You are God in Israel and I am Your servant etc. Rebbi Yudan said, up to Hezekias, to increase dominion and peace without end. Rebbi Aḥa said, the merit of the forefathers extends forever: For the Eternal is a Merciful Power, etc., up to and He shall not forget your forefather’s covenant. This teaches that the covenant was sealed with the tribes. Rebbi Yudan bar Ḥanan in the name of Rebbi Berekhiah: The Holy One, praise to Him, said to Israel: If you see that the merit of the fathers reels, and the merit of the mothers trembles, go and cling to grace. For mountains may reel, and hills tremble; for mountains may reel, this is the fathers’ merit, and hills tremble, this is the mothers’ merit. After that, but My Grace will not leave you and My Covenant of Peace will not reel, says the One Who has mercy on you, the Eternal.

Jerusalem Talmud Sanhedrin 10:22

And like planted nails. Why does he not say, “like fixed nails and planted trees”? They chose and selected the iron and improved the planting of iron rods. Another explanation, and like planted nails. Just as this nail, once it has been fixed, if you then remove it from its place, its place remains visible; so everybody against whom the rabbis stretched out their hand, even if afterwards they took him back, in the end he will take what is coming to him from their hands. Another explanation, and like planted nails; it is written watches. Since there are 24 watches, there should be 24 nails. How many nails should it have? Rebbi Joḥanan said five, corresponding to the five books of the Torah. Rebbi Ḥinena said seven, corresponding to your days are your steps. Rebbi Aḥa explained following Rebbi Ḥanina: nine. Rebbi put eleven on one [shoe] and thirteen on the other, for the number of watches. Rebbi Yose ben Ḥanina said, a crooked nail is not counted with the nails. Rebbi Abba bar Zavda asked before Rebbi Zeˋira: may one put all of them on one boot? He told him, it is permitted. May one put all of them on one sandal? He told him, it is permitted. It was stated: One does not scrape old boots or sandals but one may anoint them or dip them in water. Rebbi Crispus in the name of Rebbi Joḥanan: The students of the Elder Rebbi Ḥiyya say that those of first rank said, one may scrape, those of second rank said, one may not scrape. They asked Rebbi, who told them, one does not scrape. Rebbi Zeˋira said, here goes one of the students of the Elder Rebbi Ḥiyya. Rebbi Ḥiyya bar Ashi said, we used to sit before Rav and were anointing and rinsing, but not scraping. It was stated: A person should wear new boots and sandals only if he walked in them during daytime. How far should he walk? The people from the house of Bar Qappara said, from the House of Study of Bar Qappara to the House of Study of Rebbi Hoshaia. The Sepphoreans say, from the Babylonian synagogue to Rebbi Ḥama bar Ḥanina’s house. The Tiberians say, from the Academy to Rebbi Hoshaia’s store. It was stated: Nobody should anoint his foot in a shoe or sandal but he may anoint his foot and step into his shoe or his sandal. One may anoint himself and roll on a tarpaulin without worry. One should not put it on a marble slab to roll himself in it, but Rabban Gamliel permits it. Another explanation, and like planted nails. If words about Torah are spelled out clearly by their authors, they are sweet to their listeners like well-ordered saplings. But if they come out confused, they are as bitter for their listeners as nails.

Abba Shaul said, also one who pronounces the Name by its letters. Rebbi Mana said, for example, those swearing Samaritans. Rebbi Jacob bar Aḥa said, it is written as yod he but read as alef dalet.

Jerusalem Talmud Sanhedrin 10:46

Aḥitophel was a man great in Torah. It is written: David again assembled all young men in Israel, 30’000. Rebbi Berekhiah in the name of Rebbi Abba bar Cahana: Ninety thousand Elders did David ordain on one day, but he did not ordain Aḥitophel with them. That is what is written: David again assembled all young men in Israel, 30’000. He added, 30’000. Again, 30’000, and the simple sense of the verse, 30’000; together 90’000. You find that at the moment when David came to carry the Ark of the Eternal’s Covenant, he did not carry it following the Torah. They moved the Ark of God’s Covenant on a new car, etc. The Ark lifted the Cohanim up and tore them down to the ground; lifted the Cohanim up and tore them down to the ground. David sent and brought Aḥitophel. He told him, can you not tell me why the Ark lifted the Cohanim up and tore them down to the ground, lifted the Cohanim up and tore them down to the ground? He answered, send and ask all the wise men whom you ordained. David said, any man who knows how to put this in order but does not put it in order should end up strangled. He said something in front of it and it was steadied. That is what is written: It was when the carriers of the Eternal’s Ark took six steps that he sacrificed a bull and a fattened calf. Rebbi Ḥanina and Rebbi Mana, one said, for every step a bull and a fattened calf and at the end seven oxen and seven rams; but the other said, for every step seven oxen and seven rams and at the end a bull and a fattened calf. The Holy One, praise to Him, said to Aḥitophel: Something which the schoolchildren say every day in assembly you did not say to him: to the Bene Qehat he did not give; for the service of the holy [vessels] is on them, they should carry on the shoulder. But so you told him. Similarly you find that when David started to excavate the foundations of the Temple, he dug down fifteen hundred cubits and did not find the abyss. At the end he found a clay pot and wanted to lift it. It told him, you cannot lift me. We asked, why? It answered, because I am here suppressing the abyss. He asked it, since when are you here? It answered, from the Moment that the Merciful spoke on Sinai: I am the Eternal, your God, the earth trembled and sank down, and I was put here to suppress the abyss. Nevertheless, he did not listen to it; when he lifted it the abyss rose and threatened to flood the world. Aḥitophel was standing there. He said, now David will be strangled and I shall rule. David said, any Sage who knows how to put this in order but does not put it in order should end up strangled. He said what he said and it was steady. David started to sing a song of ascent, a song for a rise of 100 [cubits]. For each hundred cubits he composed a song. Nevertheless, he ended up strangled. Rebbi Yose said, that is what the proverb says, a person has to worry about the curse of a rabbi, even if it is for nothing. Rebbi Jeremiah in the name of Rebbi Samuel bar Rav Isaac: The scroll which Samuel handed over to David, Aḥitophel composed it by the Holy Spirit. What did Aḥitophel do? If anybody asked for his counsel in anything and he gave his advice, he said go and do such and such, and if you do not believe me ask the Urim and Tummim. He went, asked, and found it correct. That is what is written: The counsel of Aḥitophel which he gave in those days, etc. Man is read but not written; the verses could not call him “a man.”

HALAKHAH: “[Denial] about words of the Sopherim is more serious,” etc. Halakhah 6:“One executes him not,” etc. The colleagues in the name of Rebbi Joḥanan: The words of the Sopherim are related to the words of Scripture and are pleasant like the words of Scripture; your throat is like good wine. Simeon bar Abba in the name of Rebbi Joḥanan: The words of the Sopherim are related to the words of Scripture and are more pleasant than the words of Scripture, for your friendship is better than wine. Rebbi Abba bar Cohen in the name of Rebbi Judah bar Pazi: You may know that he words of the Sopherim are more pleasant than the words of Scripture, because if Rebbi Tarphon did not recite at all he would only have transgressed a positive commandment. But because he transgressed the words of the House of Hillel he should have suffered death since it says, if one breaches a wall he will be bitten by a snake.

The Torah said, four compartments for four paragraphs. If he made five compartments for four paragraphs, he is punishable. Rebbi Abba, Rebbi Joḥanan in the name of Rebbi Hoshaia: He is punishable only if he instructs in a matter whose root is from the Torah but whose explanation is from the words of the Sopherim; for example, the carcass; for example, the crawling animal, whose root is from the words of the Torah but whose explanation is from the words of the Sopherim. Rebbi Zeˋira said, he never is punishable unless he deny and instruct in a matter whose root is from the Torah but whose explanation is from the words of the Sopherim; for example, the carcass; for example, the crawling animal, whose root is from the words of the Torah but whose explanation is from the words of the Sopherim, on condition that he simultaneously deduct in a matter which permits subtraction and addition. The face of Rav Hoshaia lit up. He told him, do I need you that you enjoy it? I do not need you, I am adding to your statement. Thirteen years he went and came before his teacher even though he did not need him. Rebbi Samuel in the name of Rebbi Zeˋura: Was it not enough for him to have paid his respects to his teacher since anybody who pays his respects to his teacher is as if he paid his respects to the Divine Presence. Rebbi Berekhiah objected, did we not state, “the body of baheret is the square area of a split cilician bean”? Rebbi Abba Mari said, one who said it is pure. Rebbi Abba bar Mamal objected, did we not state, “two paragraphs in the mezuzzah”? He told him, phylacteries and mezuzah are the same. Rav Hamnuna objected, was it not stated: The ṣiṣit must be four finger lengths for four threads? He told him, in that he diminished but did not add. Rebbi Ḥaggai objected before Rebbi Yose, was it not stated, one third for the scalded, one third for round cakes, one third for flat cakes. If he used it in thirds, one third for the scalded, one third for round cakes, one third for flat cakes? He told him, he subtracts from the scalded and adds for round cakes and flat cakes.

Jerusalem Talmud Shevuot 1:2

HALAKHAH: “There are two kinds of oaths which are four kinds,” etc. Two which are four for liability and two which are four for no liability, or four for liability and four for no liability? Let us hear from the following: “There are two kinds of oaths which are four kinds,” etc. Rebbi Yose said, the Mishnah says so, “there are two kinds of oaths which are four kinds,” not because of liability? And similarly, “there are two kinds of export on the Sabbath which are four kinds,” because there is liability. Rebbi Abba said, there all are about liability, but here we come to state both liability and no liability. This implies four of liability and four of no liability. But did we not state, the doors of the Temple hall were two which are four? Can you say, liability and no liability? Should we state twelve cases of no liability? We come to state cases of no liability which correspond to cases of no liability. Rebbi Ḥiyya bar Ada said, what is this “no liability” which we stated here? Permitted! Rebbi Yose said, the poor man and the rich man are one but the Sages counted them as two. Exporting or importing are two but the Sages counted them as one. Exporting on the Sabbath does not include importing; if one exports from a domain this does not include importing. If one who exports from one domain to the other, does this not include the one who imports? In addition, from what Rebbi Yasa said in the name if Rebbi Joḥanan: Somebody who imports half the size of a dried fig and exports half the size of a dried fig is liable. And from where that exporting is called work? Rebbi Samuel in the name of Rebbi Joḥanan: “Moses ordered, they made a public proclamation in the camp,” etc. The people refrained from taking objects out from their houses to give them to the collectors, who also did not take out anything from them to import into the office. Rebbi Ḥizqiah in the name of Rebbi Aḥa understood it from the following: “do not bring out any load from your houses on the Sabbath day, and perform no work.”

Jerusalem Talmud Shevuot 1:19

Rebbi Jacob bar Aḥa in the name of Rebbi Yasa: The one who stands before the Ark on New Year’s holiday does not have to mention the New Moon. Rebbi Aḥa bar Pappus said, it was stated thus: “The one who stands before the Ark on New Year’s holiday in the morning, the House of Shammai say, he prays eight [benedictions], but the House of Hillel say seven. For musaf, the House of Shammai say ten, but the House of Hillel say nine.” Should he not say eleven? Rebbi Yose said, where do they disagree? In a matter which needs a separate benediction. But here even on a weekday he simply includes it. So he should mention it in “Service”. Rebbi Yose asked, since the two he-goats of New Year’s day come because of the New Moon, why do you say that he does not have to mention the New Moon? Rebbi Yose ben Rebbi Bun said, does Rebbi Abba bar Mamal not ask correctly? As it was stated: “The two lambs of Pentecost and the two he-goats of New Year’s Day.” If the first atoned, what does the second atone for? For impurity that happened between them. Is that not Rebbi Simeon’s? And Rebbi Simeon splits atoning. But if both of them were for the New Moon? Rebbi Abba Mari said, you cannot do that, since it is written, in addition to the elevation offering of the month. In addition, from what we have stated, “twelve for the twelve months of the year.” A patrician stood before the Ark and did not mention the New Moon; they praised him. Rav Hoshaia asked: think of it, if they slaughtered both of them simultaneously? What impurity happened between them? Rebbi Bun said, if all of Israel are proper, would they not bring what the Torah prescribed for them?

Rebbi says, the Day of Atonement atones for all sins against the Torah except for him who tears away the yoke, or who breaks the Covenant, or who finds aspects in the Torah, where it atones if he repented but does not atone otherwise. Rebbi Zebida said: Rebbi Yasa asked: Does Rebbi think that the Day of Atonement atones without repentance? There came Rebbi Ashian, Rebbi Jonah, Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan: The Day of Atonement atones without repentance, and death cleanses without repentance. We have stated thus: The day of death equals repentance. Who stated this? Rebbi! Then what we stated, “death and the Day of Atonement atone with repentance,” does not follow Rebbi.

Jerusalem Talmud Shevuot 2:19

The measure of prostrating is ten cubits. How is this? If the lengthy path was twenty but the short one ten. He went five. If he went in this direction, five, if in the other, fifteen. Rebbi Yose said, he never becomes liable unless the lengthy path exceed the short one by (ten). How is that? If the lengthy path was thirty but the short one ten. He went five. If he went in this direction, five, if in the other, twenty-five. What is the duration of prostrating? Rebbi Simon in the name of Rebbi Joshua ben Levi: up to a greeting from one person to another. Abba bar Huna in the name of Rebbi Joḥanan: up to a greeting from a student to his teacher, “peace be with you, my teacher.”

Jerusalem Talmud Shevuot 3:2

HALAKHAH: “There are two kinds of oaths which are four kinds,” etc. One understands “that I shall eat, or that I shall not eat.” “That I ate, or that I did not eat”? Where do we stand? If it is known that he ate and he swore that he did not eat, it is a false oath. But if he was of the opinion that he ate and swore that he did not eat? Rebbi Abba, Rav Jehudah in the name of Rav: If he is inadvertent for its sacrifice or intentional for its sacrifice. But “I was of the opinion that this is not an oath” is permitted. But it must be that he was intentional in the deed but in error about the sacrifice. Did not Rebbi Abbahu say in the name of Rebbi Joḥanan: Intentional about fat and in error about the sacrifice, one warns him, he is flogged and has to bring a sacrifice. This is impossible, as Rebbi La said in the name of Rebbi Eleazar: So did Rebbi Ismael answer Rebbi Aqiba: Do we find a situation where one is liable if intentional because of a false oath and in oblivion because of blurting? Should not Rebbi Aqiba retort, we find a situation where one is liable if intentional because of a false oath and he brings a sacrifice? But we deal here with the case that he was sure that he ate, and he swore, and it turned out that he had not eaten. Not about him who said that this is not an oath? There, if he says this is not an oath; but here if he knows that this is an oath but he errs because of something else.

Jerusalem Talmud Shevuot 3:4

Does not the blasphemer have to bring a sacrifice? The colleagues in the name of Rebbi Simeon ben Laqish: They answered him according to his argument. Following your argument, since you say that the blasphemer does not act, where do we find that somebody talks and brings a sacrifice that this one talks and brings a sacrifice? Rebbi Abba from Carthage asked, is not Rebbi Simeon ben Laqish’s argument inverted? There he said, for Rebbi Aqiba the blasphemer does not act. But here he says, the blasphemer is acting in the opinion of Rebbi Aqiba. Rebbi La in the name of Rebbi Simeon ben Laqish: Two Tannaïm following the opinion of Rebbi Aqiba. One said, the blasphemer does not act, and the other said, the blasphemer does act.

Jerusalem Talmud Shevuot 3:9

Rebbi Abba understood all this from the following: “If he ate and drank in one forgetting he is liable only once.”

Jerusalem Talmud Shevuot 3:16

Rebbi Abba bar Mamal asked: According to Rebbi Joḥanan, who said that comprehensive oaths fall on prohibitions, should we not state “an oath that I shall not eat; when he ate”? Rebbi Ze`ira said, in the whole lifetime of Rebbi Abba bar Mamal we did not find an answer; after he had died, we found an answer. Where do we stand? If one said, an oath that I shall not eat meat, including Passover; that I shall not eat during these ten days, including the Day of Atonement, then the oath falls on prohibitions. Rebbi Yose said, one may infer from here if in front of him were olive-sized pieces of slaughtered [meat] and one of carcass meat and he said, [an oath] that I shall eat these ten olive-sized pieces, since he is not liable for the carcass meat, he neither is liable for the remainder.

HALAKHAH: He wants to teach himself a pretext. “Whether matters of himself,” etc. Rebbi Abba in the name of Samuel: “An oath that X gave a mina to Y,” and it turns out that he did not give, since it was not in his power for the future, it is not in his power for the past. Rebbi Yose objected, about phylacteries there is nothing about the future but there is about the past! He told him, phylacteries came from another source. To cause evil or cause good; just as doing good is optional so doing bad is optional; this excludes anything involving a prohibition or anything involving a permission. Anything which one will blurt out, excluding a minor. A person in an oath, excluding a person not acting at his own will. And it will be forgotten by him, he will be oblivious of the oath. Or could I think that the object was forgotten by him? The verse says, in an oath and it was forgotten by him; he is liable for forgetting the oath; he is not liable for forgetting the object. Could one not add forgetting the object to forgetting the oath so that he should be liable? What is the difference between this and forgetting impurity and forgetting the Sanctuary so that he should be liable twice following Rebbi Ismael, who said forgetting impurity and forgetting the Sanctuary? There it is written it was forgotten by him, it was forgotten by him twice. Here it is written it was forgotten by him once. I could think that one who swears to the detriment of others should be liable: the verse says, to cause evil or cause good; just as doing good is optional so doing bad is optional. I shall exclude one who swears to the detriment of another that he should not be liable. For example, if one swears that he will not provide food for another. He saw him in convulsions and gave to him.

Jerusalem Talmud Shevuot 3:42

A vain oath, if one swears to change what is known to men; a false oath if he swears to substitute. Rebbi Jacob bar Aḥa in the name of Rebbi Joḥanan: anything known to two persons is a (vain) oath, to three it is (false). Rebbi La in the name of Rebbi Eleazar: If it is known to two persons and another one at the end of the world, it is a vain oath. What is the difference between them? If he was untrue before two [persons], threw it into the sea, and they had warned him because of a vain oath; in the opinion of R. Joḥanan he is not flogged, in the opinion of Rebbi Eleazar he is flogged. If they had warned him because of a false oath, in the opinion of Rebbi Eleazar he is flogged, in the opinion of Rebbi Joḥanan he is not flogged. Rebbi Abba in the name of Rebbi Jehudah, even an egg and a pearl. What means “even”? But, for example, an egg and a pearl.

Jerusalem Talmud Shevuot 3:46

HALAKHAH: “A blurted oath,” etc. “ ‘An oath that I shall not eat this loaf, an oath that I shall not eat it’, he is liable only once”. Something which would be forbidden for vows and is permitted for oaths. Not on this was it said but on the following: “Whether matters of himself, or matters of others,” as Rebbi Abba said in the name of Samuel: ‘An oath that X gave a mina to Y.’ If it turns out that he had not given, since it is not in his hand for the future it is not in his hand for the past. It was found stated on both cases: This is more stringent for the past than for the future: If he says “I shall not eat, I shall not eat,” he is liable only once. “I did not eat, I did not eat,” he is liable for each single time.

Jerusalem Talmud Shevuot 4:9

Rebbi Abba said in the name of Rav Huna: The witnesses have to stand while testifying. What is the reason? The two men shall stand. Rebbi Jeremiah in the name of Rebbi Abbahu: Also the parties have to stand at the moment the verdict is given. What is the reason?: Who have the quarrel before the Eternal.

Jerusalem Talmud Shevuot 4:21

Should a relative be found guilty of a blurted oath? Does it follow what Rebbi Abba said in the name of Samuel: “An oath that X gave to Y,” and it turns out that X had not given; since there is nothing in the future there is nothing in the past. Or the following: “Where is my ox?” He responded, “I do not know what you are referring to.” Rebbi declares him not liable for a keeper’s oath but liable because of a blurted oath. Rebbi Joḥanan said, since it is a religious duty to appease him, he is not liable because of a blurted oath. In the rabbis’ opinion, is there no religious duty to appease him? One appeases with truthful statements, not with lies.

Jerusalem Talmud Shevuot 4:23

Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah, Rebbi Samuel ben Rav Isaac in the name of Rav Isaac who said in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his back. Two are saying, we saw one hair on his back; and one is saying, I saw one hair on his belly. Rebbi Yose ben Rebbi Bun and Rebbi Hoshaia ben Rebbi Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe it was rubbed off. One says, I saw two hairs on his back; and one says, I saw two on his belly. Rebbi Abba said, everybody agrees that this is valid. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Yose says, this is in disagreement. Rebbi Yudan said, this is in disagreement. Rebbi Yose said to Rebbi Ḥaggai, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mana said, Rebbi Ḥaggai was correct. If a document was signed by four seals, if one person (permitted) two, and another (questioned) the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single sign needs two witnesses. Rebbi Ḥanina learns it from the years of squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth and fifth years, is that worth anything? Does not every single year need two witnesses? And here, every single sign needs two witnesses.

Jerusalem Talmud Shevuot 4:29

Rebbi Abba, Rav Jehudah in the name of Rav: in error, a sacrifice; intentional, a sacrifice. But if he said, I was of the opinion that this oath does not exist, he is free. Ḥizqiah stated: At any place where the Torah mentions sin without attribute you include intentional equally with unintentional unless Scripture inform you that it is unintentional.

Jerusalem Talmud Shevuot 5:19

HALAKHAH: “Give me the deposit, the loan,” etc. Rebbi Joḥanan said, Rebbi Simeon implies that if it turns out that he had no wheat, he is not liable for the rest. Rebbi Abba said, even Rebbi (Yasa) will agree with this. If it turns out that he had no wheat, does [the oath] refer to the other kinds? The colleagues said, it does not. Rebbi Ze`ira said, it does. Rebbi Jacob bar Aḥa said, a baraita supports what the colleagues said. “A woman made a vow as a nazir and her friend heard it and said, ‘so am I’; the first woman’s husband heard it and dissolved [the vow] for her; the first one is permitted and the second forbidden. If she said, ‘my intention was only to be like her,’ both are permitted.” Because she said, “to be like her, in her state”. Therefore, if she did not say “to be like her, in her state”, the first is permitted and the second forbidden. Since there, where the essence is not an oath, you say it applies, here, where there was an original oath, not so much more? What Rebbi Joḥanan said, Rebbi Simeon implies if it turns out that he had no wheat, he is not liable for the rest, if he connects: If he says, [my obligation for] barley shall be like that for wheat; [my obligation for] spelt shall be like that for wheat.

Jerusalem Talmud Shevuot 6:4

Rebbi Abba, Rav Jehudah in the name of Samuel: In any case where two [witnesses] make him liable to pay money, a single witness sets him up for an oath. But do not two [witnesses] make him liable for real estate? It is a difference since one does not swear about real estate. But do not two [witnesses] make him liable for a fine? There is a difference since one does not swear about a fine. But do not two [witnesses] make him liable for a peruṭah? Is it so? Have we not stated: “A judicial oath is about a claim of two silver coins and the acknowledgment of one peruṭah.” Our Mishnah, when he swears by his own formulation. What (Rebbi) Samuel said, when he swears by the formulation of others. Rav Ḥisda and his group disagree. “A judicial oath”, any judicial oath. There is no difference whether he swears by his own formulation or he swears by the formulation of others, he cannot be liable except for a claim.

Jerusalem Talmud Shevuot 6:11

“You are holding a mina for me;” he said “yes.” “Return it to me only in the presence of X and Y.” The next day he said, “return it to me,” “I returned it to you;” he is liable since he is required to return it in the presence of witnesses. Think of it, if he said, I returned it in the presence of witnesses. Bar Kappara stated: “when X and Y are standing there.” Think of it, if he said, “when X were Y are standing there.” Rebbi Abba, Rav Hamnuna, Rebbi Ada bar Ahava in the name of Rav: A case came before Rebbi, and he said, let X and Y come.

Jerusalem Talmud Shevuot 6:20

HALAKHAH: “One does not swear on the claim of a deaf-and-dumb person, an insane person, or a minor,” etc. It is written: If a man give to his neighbor, to exclude the minor. So far if a minor gave to him and the minor requested from him. If he gave it as a minor and requested it as an adult? The verse says, his neighbor; only if giving and requesting are equal. Rebbi Abba bar Mamal said, is that not obvious by what Rebbi Joḥanan said, one who claims a claim of theft in respect of his neighbor’s lost object is liable? “Where is my lost object?” He told him, it was stolen. Rebbi Abba said, explain it if he told him, you already asked me when you were underage and I was freed from swearing for you. An oath of the Eternal shall be between both of them, to exclude the heir. Rebbi Illa in the name of Rebbi Yasa: The baraita is about the heir.

HALAKHAH: Rebbi Ḥanina said, One says, a large candelabra, but the other says, a small candelabra; he is liable since we have stated: “One swears only on matters of measure, or weight, or count.” Rebbi Abba bar Mamal said, explain it if it was a candelabra composed of sections. One says, a large belt; the other says, a small belt. Rebbi Ḥiyya stated something but we do not know what he stated. If you say “liable”, a Mishnah disagrees, as we have stated: “One swears only on matters of measure, or weight, or count.” If you say “not liable”, a Mishnah disagrees, as we have stated: “If one says the adult one and the other says the underage one, let the seller swear that he sold the underage one. If both say that they do not know, they shall split.”

Jerusalem Talmud Shevuot 6:33

Samuel says, the oath does not move away from between them. If the lender swears, he swears and takes. But if the borrower swears, the other will present the pledge. “Who has to swear? The one who holds the pledge.” Rav and Rebbi Simeon ben Laqish say, about the first part: “ ‘You loaned me a tetradrachma on it but it was worth two,’ and the other says ‘no, but I loaned you a tetradrachma and it was worth a tetradrachma;’ he is not liable. ‘You loaned me a tetradrachma on it,’ ” etc. “And the other says, ‘I do not know’.” Rebbi Abba, Rav Huna in the name of Rav: You do not know, the other knows. Rebbi Joshua [the Southerner] asked before Rebbi Jonah: There you say, you do not know, the other knows; but here you say so? There is desecration of an oath, here there is no desecration of an oath.

Jerusalem Talmud Shevuot 7:6

Rebbi Abba from Carthage asked: “You worked for me one day and I paid you.” But the other says, “I worked for you for two days and you did not give anything to me.” It is obvious that he takes for the first day without oath. The second is the disagreement between Rebbi Joḥanan and Rebbi Eleazar. “I hired you for a tetradrachma and gave it to you.” But the other says, “you hired me for two tetradrachmas and did not give me anything.” It is obvious that he takes the first tetradrachma without an oath. The second is the disagreement between Rebbi Joḥanan and Rebbi Eleazar.

Jerusalem Talmud Shevuot 7:13

May one claim extraordinary things? One may, following what Rebbi Joḥanan said, a person may be rich on the market place and poor in his house; rich in his house and poor in the market place. There is one who poses as richand has nothing, poses as poor and has great wealth. Rebbi Abba told: Bar Ziza’s sharecropper deposited a pound of gold with somebody. Bar Ziza and Bar Ziza’s sharecropper died; the case came before Rebbi Ismael ben Rebbi Yose. Would one not say that all that Bar Ziza’s sharecropper had was Bar Ziza’s property? It should be given to Bar Ziza’s sons. Bar Ziza’s sons came. He said, the adult ones should take half and when the underage grow up they should take half. Rebbi Ismael ben Rebbi Yose died; the case came before the Elder Rebbi Ḥiyya who said, that argument means nothing since there are people who do not advertise themselves. It should be given to the sharecropper’s sons. The trustee told him, I already disbursed half of it. He told him, what you gave, you gave by court order and what you will give, you will give by court order. May the sharecropper’s sons say to Bar Ziza’s sons, give us what you took? They can tell them, what was done was done by court order. May the underage ones say to the adult, let us share with you? May they tell them, we found a find? Rebbi Isaac said, the case between the adult and underage ones is only comparable to a gift given to them.

Jerusalem Talmud Avodah Zarah 1:3

How does Rebbi Yose uphold this verse, bring your sacrifices in the morning, etc? The verse speaks about Jeroboam’s kingdom. When Jeroboam became king over Israel he started seducing Israel and said to them come, let us worship pagan worship. Pagan worship is lenient. This is what is written, let us go against Jehudah, cut it down, break it up, and appoint a king in it, the man from Ṭabeal. Rebbi Abba said, we checked all of Scripture but did not find a place named Ṭabeal. But it treats its worshippers well. The Torah said, selected him from all of the tribes of Israel to be a priest for Me. Pagan worship says, he made priests from the fringes of the people. Rebbi La said, from the thorns of the people, the rubbish of the people. The Torah said, the fat of My sacrifice shall not remain until the morning; but pagan worship said, bring your sacrifices in the morning. The Torah said, it should be eaten on the day of its slaughter and the next day; but pagan worship said, on the third day your tithes. The Torah said, do not sacrifice the blood of My sacrifice on leavened matter; but pagan worship said, and burn your thanksgiving offer of leavened matter. The Torah said, if you are vowing a vow to the Eternal, your God, do not tarry to fulfill it, but pagan worship said, pledge gifts, publicize them. Rebbi Yudan, Rebbi Mattaniah’s father, said, the verse only serves to mention the shame of Israel. The day of our king, the princes are sick from wine’s heat, he draws the mockers by his hand. On the day when Jeroboam became king over Israel, all of Israel came to him late in the evening and told him, come and worship pagan worship. He told them, it is late in the evening; I am drunk and not drunk. Everybody is drinking; but if you wish, go and come in the morning. That is what is written, for their heart is like an oven while they are lying in ambush; all night long their baker is sleeping. All night long their baker did not sleep. In the morning he is burning like fire of a conflagration. In the morning they came to him. He told them, I do understand what you want but I am afraid of your Synhedrion lest they kill me. They told him, we shall kill them; this is what is written, that all are glowing like an oven and eat their judges. Rebbi Levi said, they killed them, as is written, if a corpse is found. Rebbi La said, they deposed them; The day of our king, the princes are profaned from wine’s heat; the day when princes were profaned. From wine’s heat, they were addicted to wine. He draws the mockers by his hand: When he saw a serious person he placed two scoffers next to him who asked him, which generation was preferred over all generations? He told them, the generation of the Exodus. But did they not practice pagan worship? He answered them, because they were beloved they were not punished. But they told him, be quiet for the king wants to do the same. Not only that, but they made one and this one made two. He put the one up at Bethel; the other he gave to Dan.

Jerusalem Talmud Avodah Zarah 1:8

One understands “to lend;” “to borrow” from them? Because he increases his reputation. One understands “to give them loans;” “to ask them for loans”? Because he increases his reputation. One understands “to pay debts to them;” “to accept payment from them”? That he should not say, his pagan worship had helped him. Rebbi Abba bar Tevelai in the name of Rav: If it was a loan in danger of being lost it is permitted. It was stated thus: A loan in danger of being lost, by witnesses. A loan not in danger of being lost, by document. Even a loan by document is in danger of being lost, for not at all times does a person succeed in liquidating his debt. How is this? A loan not in danger of being lost, by pledge. A loan in danger of being lost, not by pledge. It was found following the former [opinion]: A loan in danger of being lost, by witnesses. A loan not in danger of being lost, by document.

Jerusalem Talmud Avodah Zarah 1:11

The colleagues say, the reason of Rebbi Ismael is because of the holiday’s son. Rebbi Abba said, because he knows that it is forbidden to you to trade with him, he reduces the enjoyment of his holiday. What is the difference between them? To sell them things which do not keep. In the opinion of the colleagues it is forbidden. In the opinion of Rebbi Abba it is allowed. Rebbi Yudan said, a verse supports what the colleagues said. On the twenty-fourth day of the seventh month the sons of Israel assembled in fasting, and crying, and in sackcloth, and dirt on them. Why does it not say, on the twenty-third? Because of the holiday’s son. If you want to say because that was on a Sabbath, you cannot do this, because then the Great Fast would have been on a Sunday. And what about this? Does not Rebbi Onias make light of him who would move it from its place? Rebbi Joḥanan ben Madia said, I computed it and it was not on a Sabbath.

Rebbi Huna in the name of Rab Naḥman bar Jacob: New Year’s Day is on the second of March in Persia, on the 20th of March in Media.

It was stated: In a town where Gentiles and Jews live together, if the Gentiles contribute the overseers of charity collect from them and from Jews, and provide for Gentile and Jewish poor, visit Gentile and Jewish sick, console Gentile and Jewish mourners, and bury Gentile and Jewish dead. Also one takes in vessels from Gentiles and Jews for the sake of peaceful coexistence. The weavers asked Rebbi Immi, what about a Gentile wedding feast? He wanted to permit it to them from this: “for the sake of peaceful coexistence.” Rebbi Abba told him, did not Rebbi Ḥiyya state that a Gentile wedding feast is forbidden? Rebbi Immi said, if it had not been for Rebbi Abba we would have come to permit their pagan worship; praise be the Omnipresent Who distanced us from them.

HALAKHAH: “Outside a town with pagan worship,” etc. Therefore inside it is forbidden. Because in it there is one statue all of it should be forbidden? Rebbi Simeon ben Laqish says, they taught this about a fair. What is the difference between inside and the surroundings? Inside where it profits from the toll it is forbidden. Outside it is permitted because it does not profit from the toll, but if outside it also profits from the toll it is forbidden. But was it not stated: “One goes to fairs and buys there slaves, slave girls, and animals.” Rebbi Simeon ben Laqish said, not only Jewish slaves but even Gentiles, because he brings them under the wings of the Shekhina. But was it not stated: If he bought there a garment, it should be burned, an animal should be castrated, coins should be brought to the Dead Sea? One understands that a garment should be burned, coins should be brought to the Dead Sea. An animal should be castrated? Rebbi Ze‘ira asked: at a fair it is forbidden, in a hostelry it is permitted? Maybe Rebbi Joḥanan said this about merchandise. Rebbi Abba the son of Rebbi Ḥiyya bar Abba came in the name of Rebbi Joḥanan: If it was a hostelry, merchandise is permitted, said Rebbi Joḥanan.

But from Gentiles it is permitted whether they are going or coming. Rebbi Abba the son of Rebbi Ḥiyya bar Abba in the name of Rebbi Joḥanan: If it was a hostelry it is permitted.

Jerusalem Talmud Avodah Zarah 1:29

Rebbi Ḥiyya bar Abba sent to buy sandals for himself at the fair of Tyre. Rebbi Jacob bar Aḥa said to him, are you a buyer at fairs? He answered him, did you never buy a loaf of bread? He said to him, there is a difference, since Rebbi Joḥanan said, they did not forbid the necessities of life. Rebbi Simeon ben Joḥanan sent to ask Rebbi Simeon ben Josadaq, did you not check out the nature of the fair at Tyre? He told him, yes. He gave two pounds of peppers to an איסקרנדה. He went and found an inscription there, “I, King Diocletian, settled this fair at Tyre to the genius of my brother Heraklius, eight days.” Rebbi Isaac bar Naḥman asked Rebbi Ḥanina: What is the nature of the fair at Gaza? He said to him, did you ever go to Tyre and see a Jew and a Gentile sharing a pot, and he does not worry that the Gentile pour something into the pot? This is difficult. He asked him; what did he answer him? But since Rebbi Ḥanina never said something that he had not heard, for that reason when he asked him this he responded with that. Rebbi Yose ben Rebbi Abun came, Abba bar bar Ḥana in the name of Rebbi Joḥanan: They forbade only the fair at Botnah, as it was stated thus: There are three fairs, the fair at Gaza, the fair at Acco, the fair at Botnah. The clearest of them is the fair at Botnah.

Jerusalem Talmud Avodah Zarah 1:33

HALAKHAH: “The following are forbidden.” Simeon bar Abba in the name of Rebbi Joḥanan: White figs with their stalks and pine cones with their attachments.

Jerusalem Talmud Avodah Zarah 1:39

HALAKHAH: “At a place where they used to sell small cattle,” etc. But is it permitted to raise them? Rebbi Abba said, for example Mahir which is sixteen by sixteen mil. They wanted to say, he who said it is permitted to sell [says] it is permitted to raise. But he who says, it is forbidden to sell [says] it is forbidden to leave it alone. Rebbi Jonah, Rebbi Eleazar in the name of Rav: Even one who says it is permitted to sell it [says] it is forbidden to leave it alone. What is the difference between selling and leaving alone? When he sells it to him it becomes the Gentile’s animal. If he lets it be alone with him, it is the Jew’s animal and he is suspected about it.

Jerusalem Talmud Avodah Zarah 1:44

“Ben Bathyra permits horses.” Ben Bathyra said this only about a male horse because it kills its owner in war. Some say, because it runs after females, and some say, because it stands still to urinate. What is between them? A gelding. He who says because it runs after females, it does not run. He who says because it stands still to urinate, this one also stands still to urinate. [Rebbi Aḥa in the name of] Rebbi Tanḥum bar Ḥiyya: If it gets old he binds it to the grindstone. Rebbi Yose ben Rebbi Abun in the name of Rebbi Huna: Ben Bathyra and Rebbi Nathan both said the same, as it was stated: “If he carried out domestic animals, wild animals, or birds, whether alive or dead, he is liable. Rebbi Nathan says, dead he is liable, alive he is not liable.” The rabbis hold that he is liable for a purification sacrifice and they answer him so? They answer following his own argument. Following your argument, since you are saying because of rabbinic Sabbath prohibition, also we hold that if it gets old he binds it to the grindstone. Rebbi says, I am saying that it is forbidden for two reasons, as a weapon and as a large animal. It was stated so: A large wild animal is like a (small) [large] domestic animal. Who stated this? Rebbi. The words of the Sages: Rebbi Bisna, Rebbi Ḥanan bar Abba in the name of Rav: A wild animal is like a (large) [small] domestic animal.

Jerusalem Talmud Avodah Zarah 1:51

HALAKHAH: “One does not lease houses to them,” etc. Rebbi Ze‘ira in the name of Rebbi Yose ben Ḥanina, Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan: לֹא תְחָנֵּֽם do credit them with charm; לֹא תְחָנֵּֽם do not give them free gifts; לֹא תְחָנֵּֽם do not give them encampment in the Land. But did we not state, “Rebbi Yose says, also in the Land of Israel one leases houses to them”? A house is not a source of blessing; a field is a source of blessing. Rebbi Yose ben Rebbi Abun instructed that it is forbidden to let them lease a grave in the Land of Israel because of “do not give them encampment in the Land.”

Jerusalem Talmud Avodah Zarah 1:54

לֹא תְחָנֵּֽם do not credit them with charm. But was it not stated: It happened that Rabban Gamliel while walking on the Temple Mount saw a beautiful Gentile woman and recited a blessing over her. Does Rabban Gamliel usually look at women? It was a curved road, like a pswros, he looked at her because he could not avoid her. But did not Rebbi Ze‘ura in the name of Rebbi Yose ben Ḥanina, Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan say: לֹא תְחָנֵּֽם do not credit them with charm? What did he say? He did not say ἀβάσκαντα but “praised be He Who has beautiful creatures in His world,” because even if one saw a beautiful donkey, a beautiful camel, a beautiful horse, one says “praised be He Who has such beautiful creatures in His world.”

Jerusalem Talmud Avodah Zarah 2:2

HALAKHAH: “One does not put up animals in hostelries of Gentiles,” etc. Rebbi Ze‘ira, Rebbi Abbahu in the name of Rebbi Yose ben Rebbi Ḥanina; Rebbi Abba, Rebbi Jonah: explain it following Rebbi Eliezer, since Rebbi Eliezer said “it may not be bought from Gentiles.” Rebbi Jonah asked, why do we not explain it according to everybody, following what Rebbi Eleazar said in the name of Rav: Even one who says it is permitted to sell [says] it is forbidden to leave alone. If he transgressed and left it alone by everybody’s opinion. Rebbi Jeremiah said, let us hear from the following: “A woman who was jailed by Gentiles.” Rebbi Yose said, it is different for a woman because she usually cries. Think of it if she was mute! She uses sign language. What about it? Explain it following Rebbi Eliezer, since Rebbi Eliezer said “it may not be bought from Gentiles.” They wanted to say, where do Rebbi Eliezer and the rabbis disagree? About the cow, because of “eminence was given to the cow, an adornment was made for the cow.” But since the rabbis answer to Rebbi Eliezer all sheep of Qedar will be assembled for you, this says that Rebbi Eliezer disagrees about everything. Rebbi Hoshaia asked, does one reply with an argument about the future against one about the past? Rebbi Abin asked, does one reply with an argument when evil inclinations will have disappeared against one when evil inclinations exist?

Jerusalem Talmud Avodah Zarah 2:13

HALAKHAH: “One may be healed from the healing of property,” etc. Rebbi Jacob bar Zavdi in the name of Rebbi Abbahu: “healing of property,” his animal. “Healing of persons,” his body. Rebbi Abba in the name of Rav Jehudah: If it was scratched it is forbidden. As in the following case: Rebbi Immi went with Rebbi Jehudah the Prince to the hot springs of Gader. He hurt his finger and put a bandage on it. He saw it penetrate and cut it off. Did he not hear what Rebbi Jacob bar Aḥa said in the name of Rebbi Joḥanan: If he was a professional healer it is permitted? This is not comparable. There if it was scratched it is permitted, but here it was scratched and is forbidden.

Jerusalem Talmud Avodah Zarah 2:14

May one have one’s eyelids painted by them? Rav said, anybody who wants to be blinded may be blinded. Levi said, anybody who wants to die may die. Rav never had his eye painted; Levi had his eye painted. Rebbi Abba said, but do we not see that they taste this collyrium? We may say that they taste it if it is good. If it is no good it keeps and blinds. Opium is dangerous. Treacle, Rebbi Simon says it is forbidden; Rebbi Joḥanan says it is permitted.

Jerusalem Talmud Avodah Zarah 2:15

The colleagues in the name of Rebbi Abba bar Zavda: Anything inside of the lips one heals on the Sabbath. Rebbi Ze‘ira objected, did we not state: “A person having a tooth ache should not suck vinegar with them”? Is this not inside from the lips? Rebbi Ze‘ira did not say so, but Rebbi Ze‘ira in the name of Rebbi Abba bar Zavda: Anything inside a body cavity one heals on the Sabbath. Rebbi Ze‘ira, Rebbi Abba bar Zuṭra, Rebbi Ḥanina in the name of Rebbi: One treats the bone of the skull on the Sabbath. Rebbi Abbahu in the name of Rebbi Joḥanan: Red color is dangerous. Rebbi Abin said, one removes the sting of a scorpion on the Sabbath. Rav said, wine for exterior treatment of the eye is permitted, inside the eye it is forbidden. Samuel said, tasteless spit is forbidden for the eye on the Sabbath From this you infer for lichen. The rabbis of Caesarea said, ranula is dangerous. Rebbi Ḥizqiah (said) [from Acco] in the name of the rabbis of Caesarea: spider sickness is dangerous. Rebbi Samuel bar Rav Isaac: gangrene is dangerous. Rebbi Jeremiah said, one can put sour dough on it on Passover. A boil is permitted. Rebbi Yose said, the Mishnah says this: “A small needle to remove a thorn.” Otherwise, what is the difference between a thorn and a boil? Darkening of the eye, they asked Rebbi Jeremiah. He told them, is not Rebbi Abba available for you? They asked Rebbi Abba who permitted it to them. He told them, also I am permitting it.

(Rebbi Jacob bar Aḥa, Rebbi Immi, in the name of Rebbi Eleazar.) The barrel of Ben Neṭoza became uncovered. He went and asked Rebbi Abba bar Mamal, who told him, it is permitted.
