Jerusalem Talmud Terumot 3:28

They stated before Rebbi Abbahu: “Heave does not interfere with First Fruits.” He said to them, this is from Abba Palaemon. Rebbi Yose asked, which [statement of] Abba Palaemon? Rebbi Mana said to him, I heard my father stating: “First fruits in his right hand, heave in his left hand.” Some Tannaїm state, “he transgresses,”, some Tannaїm state, “he does not transgress.” He who says he transgresses, the rabbis; he who says he does not transgress, Abba Palaemon.

Jerusalem Talmud Terumot 4:31

“ “White ones lift the black.” Rebbi Eleazar said, Rebbi Eliezer answered Rebbi Joshua thus: Do white ones lift the black? His words say, when it is known what fell in they lift one another. Cahana said, they do not lift. In the opinion of Cahana, what is the difference between Rebbi Joshua and Rebbi Aqiba? When he had known but forgot. In the opinion of Rebbi Joshua he lifts, in the opinion of Rebbi Aqiba he does not lift. Simeon bar Abba in the name of Rebbi Joḥanan: That is only if one black one fell into two white ones, that it may be disregarded in a plurality. Rebbi Zeïra asked before Rebbi Mana: Would it not be reasonable [to say] into three so that if one of them is lost there still will be two? He said to him, that is also my opinion.

Jerusalem Talmud Terumot 4:42

HALAKHAH: The reasoning of Rebbi Eliezer is inverted: There, he says that the lower ones help to lift the upper, and here he says “if the congealed contains”, therefore not the bottom ones. Rebbi Jeremiah, Rebbi Ḥiyya in the name of Rebbi Joḥanan, Simeon bar Abba in the name of Cahana: The words of Rebbi Eliezer [imply] that they consider this as if he had added intentionally. Rebbi Hila, Rebbi Assi in the name of Rebbi Joḥanan: The words of Rebbi Eliezer [imply] that they consider it as a seah lifted from 100. In the opinion of Rebbi Assi, one is permitted to add, in the opinion of Cahana it is forbidden. If it congealed and then congealed a second time, in the opinion of Rebbi Assi it is permitted, in the opinion of Cahana it is forbidden. In the opinion of Rebbi Assi, even if there is no remainder, in the opinion of Cahana only if he left a remainder.

Jerusalem Talmud Terumot 5:3

There, we have stated: “One makes a fire with bread and oil of heave.” Ḥizqiah said, they taught only bread and oil, therefore nothing else. Rebbi Joḥanan said, there is no difference between bread, oil, and any other thing. Rebbi Yudan from Kappadokia asked, are wheat grains like bread and olives like oil? Rebbi Samuel bar Naḥman said in the name of Rebbi Joḥanan, may the bones of him who uses bread and oil of heave to make a fire be burned. Rebbi Samuel bar Naḥman asked before Rebbi Joḥanan: May one make a fire? He said to him, make a fire! Anything given to your tribe was given to you, as Rebbi Abba bar Ḥiyya said in the name of Rebbi Joḥanan (Num. 18:8): “For excellence”. For excellence for greatness, for excellence for rubbing in, for excellence for lighting.

Jerusalem Talmud Terumot 5:13

Rebbi Abba bar Mamai asked: Does this not contradict Rebbi Yose bar Ḥanina? As Rebbi Yose bar Ḥanina said, a carcass can become insignificant in slaughtered [meat]; it becomes insignificant for touch, but for motion it cannot become insignificant for slaughtered [meat] can never become carcass [meat]. Rebbi Yose said, there it is impossible for slaughtered [meat] to become carcass [meat], but here profane produce may become heave. Rebbi Ḥizqiah said, Rebbi Simon raised the question and Rebbi Abba bar Mamai explained it.

Rebbi Eleazar said, just as it is forbidden to declare the impure as pure, so it is forbidden to declare the pure as impure. Rebbi Abba bar Jacob said in the name of Rebbi Joḥanan: If a practical case comes before you and you do not know whether to suspend or to burn, always try to burn rather than to suspend since there is nothing in the Torah more distinguished than burned bulls and burned rams, and they are burned. Rebbi Yose wondered, is it possible to infer from something whose commandment is in this for something whose commandment is not so?

Jerusalem Talmud Terumot 6:16

Rebbi Yannai said, the Mishnah is split. If there is the size of an olive but it is not worth a peruṭah, he pays to the Sanctuary. If it is worth a peruṭah but is not the size of an olive, he pays to the tribe. If it is the size of an olive and is worth a peruṭah, Simeon bar Abba in the name of Rebbi Joḥanan, he pays to the Sanctuary. Rebbi Joḥanan said, he pays to the tribe. Rebbi Zeïra said, it is a decision of the verse (Lev. 22:14): “If somebody should eat consecrated food in error,” where the principal goes, there the fifth has to go. Cahana said, he pays two fifths, one to the tribe and one to the Sanctuary.

Jerusalem Talmud Terumot 7:27

Rebbi Zeïra in the name of Rebbi Ḥiyya bar Abba: Only if he sowed the [contents of the] second [box] before he harvested from the first. If he sowed the [contents of the] second [box] before he harvested from the first then what is cut and what is standing does not all become subject to proof. Rebbi Ḥanina Eyntanaya in the name of Rebbi Yannai: An onion of heave that was uprooted and replanted becomes permitted as soon as the new growth is more [than what was planted]. Rebbi Zeïra objected: Did we not state: “If it is a kind whose seeds disappear, all is permitted, if they do not disappear, it is forbidden.” If it is a kind whose seeds disappear, [it is permitted] the moment the new growth is more [than the original amount]. Similarly, if they do not disappear, [it is forbidden] even if the new growth is more! Rebbi Zeïra follows his own opinion, as Rebbi Zeira said in the name of Rebbi Jonathan: An onion from kilaim in a vineyard that he removed from the soil and planted anew is forbidden even if it increases manifold, since growth of what is forbidden can never justify forbidden produce.

Jerusalem Talmud Terumot 8:16

Abba bar Rav Ḥuna in the name of Rebbi Joḥanan: He who slaughters an animal and found in it a pig may eat it. Rebbi Jonah said, it is forbidden to eat, what is the reason? Jerusalem Talmud Terumot 8:21

HALAKHAH: Rebbi Jacob bar Aḥa, Rebbi Simeon bar Abba in the name of Rebbi Ḥanina: Wine left uncovered must be poured out, even if it is heave. A dish cooked with water that was left uncovered must be thrown out, even if it is heave and certainly if it is profane. Rebbi Yose said, our Mishnah says so: “Heave wine that was left uncovered should be poured out, and certainly profane wine.” The colleagues in the name of Rebbi Joḥanan: It is forbidden to keep wine that was left uncovered; if it was kept and it turned into vinegar by itself it is forbidden. It is forbidden to keep figs and grapes that were pecked at; if they were kept and dried up by themselves they are permitted.

Jerusalem Talmud Terumot 8:27

He went and asked Rebbi Abba bar Mamai, who told him, it is permitted. Rebbi Jacob bar Aḥa, Rebbi Ammi, Rebbi Eleazar: If he was sleeping it is permitted. Rebbi Ḥanina and Rebbi Joshua ben Levi, one said, if he was sleeping it is permitted; the other said, it is forbidden. We do not know who said what. It is reasonable [to infer that] Rebbi Ḥanina said, if he was sleeping it is permitted, since Rebbi Eleazar everywhere relies on Rebbi Ḥanina.

Jerusalem Talmud Terumot 8:32

Two Amoraïm, one said if it can be taken up by its stopper, and the other said, so that the head of the weaver’s shuttle could not enter. Rebbi Abba said, he who wants to do it right, stoppers and covers it.

Jerusalem Talmud Terumot 8:41

Rebbi Jeremiah said, why is Gentile’s milk forbidden? Because of admixture from impure animals. As we have stated: “If the Gentile stands and milks the herd, if a Jew stands nearby there is no worry.” Rav Abba in the name of Rav Jehudah: Why is Gentiles’ milk forbidden? Because of the uncovering. Let him make cheese? Rebbi Samuel ben Rav Isaac said, because of the poison between the holes.

Jerusalem Talmud Terumot 8:46

What is the measure of a hole? Rebbi Jacob bar Aḥa in the name of Rebbi Ḥanina showed it thus: he said, the tip of my small finger. Rebbi Jacob bar Aḥa, Rebbi Simeon bar Abba in the name of Rebbi Joshua ben Levi, so that the tip of the small finger of a newborn cannot enter it. Even if [the hole] were smaller, it [the snake] could enter it but since it does not know how to leave again, it does not enter. A woven basket even if very tight is forbidden for it can enter at one place and leave at another. A knapsack is forbidden even if it hangs very high since it will let itself down.”

Jerusalem Talmud Terumot 8:51

It was stated: “If somebody saw a bird pecking at a fig or a rat nibbling at a watermelon, it is forbidden [to eat from them] for I say, they might have eaten from the place of a pecking hole.” Rebbi Abba said, that means that a snake spits out repeatedly. Rebbi Jonah said, who considers for us commandments for peckings? But for torn [animals], Rebbi Abba said in the name of the rabbis from there, “if it was slaughtered and the wolves took its innards, it is in order because intestines are presumed to be in order.” Should one not question whether they were pierced? Intestines are presumed to be in order. But here, you say so? It is worse if there is danger to life; for peckings they went all the way with Rabban Gamliel.

Jerusalem Talmud Terumot 8:60

Rebbi Ila and Rebbi Zeїra, both in the name of Rebbi Joḥanan: The first amphora follows Rebbi Yose, the second both Rebbi Meїr and Rebbi Yose. Rebbi Zeїra asked before Rebbi Mana: Does it not disagree with Rebbi Meїr? He said to him, we may say it follows neither Rebbi Meїr nor Rebbi Yose since we find that Rebbi Meїr burns suspended [heave] in all cases. Rebbi Mana said, I went to Caesarea and heard Rebbi Zeriqan in the name of Zeїri: Rebbi Meїr burns suspended [heave] in all cases. I said to him, because he considers suspended [heave] from the words of the Torah. He said to me, do I not explain that it became impure in Gentiles’ dwellings? For we have stated: “From Gentiles’ dwellings one suspends; Rebbi Yose ben Rebbi Jehudah says, one burns.” Rebbi Huna in the name of Rebbi Jeremiah: Rebbi Meїr burns suspended [heave] any day of the year, as we have stated: “Suspended heave and impure heave are burned on Sabbath eve when it gets dark, the words of Rebbi Meїr; but the Sages say, at its appointed time.” Should he not burn it during the morning hours? Explain it if he was lazy and did not burn it [then]. Know that this is so, for he did not state “during the morning hours.” Is that not because he was lazy and did not burn [then]? Rebbi Abba Mari, the brother of Rebbi Yose said, explain it if impurity was created at that time, and you cannot infer anything.

Jerusalem Talmud Terumot 8:62

There, we stated: “A firstling afflicted by blood, even if it is going to die, cannot be bled, the words of Rebbi Jehudah. But the Sages say, it should be bled even if this causes a blemish. If it did cause a blemish, it should not be slaughtered because of it. Rebbi Simeon says, he should bleed it even if he makes a blemish.” Rebbi Abbahu in the name of Rebbi Eleazar: Rebbi Jehudah parallels Rabban Gamliel, the Rabbis parallel Rebbi Eliezer, Rebbi Simeon parallels Rebbi Joshua. But we have stated: “Rebbi Simeon says, he should bleed it even if he knows he will cause a blemish.” This parallels the later opinion of Rebbi Joshua. Rebbi Abbahu in the name of Rebbi Simeon ben Laqish: The reason of Rebbi Jehudah (Deut. 12:24): “You shall not eat it; spill it onto the ground like water.” I permitted you its blood only to spill it. Rebbi Abba Mari, the brother of Rebbi Yose, objected: That is written about [blood of] invalid sacrifices: “You shall not eat it; spill it onto the ground like water.” Rebbi Ḥiyya bar Abba said, you get from it for preparation. Just as water prepares, so blood prepares. Rebbi Abbahu in the name of Rebbi Joḥanan: Both of them explained the same verse (Lev. 22:21): “Perfect it shall be for goodwill; any blemish shall not be on it.” Rebbi Simeon explains: As long as it is for goodwill, you may not induce a blemish. If it is no longer for goodwill, you may induce a blemish. But the Sages say, even if it is all blemishes, you may not add a blemish.

Jerusalem Talmud Terumot 9:14

Rebbi Abba bar Mamal said, our Mishnah after the lentils lost their sap; [then] the lentils shrink it that it will not give [any taste]. But if he gave it before the lentils gave their sap; it does not deal with that case. And just as you say, the lentils shrink it that it will not give, so the lentils shrink that it will not absorb. How is that? If he put a profane onion into lentils of heave, the lentils shrink it that it will not absorb. That means, if it is dry, but if it is moist it is forbidden. Onions and leeks are forbidden moist or dry, whole or cut up. If he removed the top it is as if cut up. If they are two or three they are as if cut up.

Jerusalem Talmud Terumot 10:2

HALAKHAH: “An onion which one added to lentils,” etc. Rebbi Ḥizqiah, Rav Aḥa in the name of Rebbi Abba bar Mamal said, our Mishnah [in case] after the lentils lost their sap; [then] the lentils shrink it so it will not absorb [any taste]. (As you say, lentils shrink it so it will not absorb.) Similarly, lentils shrink it so it will not give.

Jerusalem Talmud Terumot 10:10

HALAKHAH: Rebbi Zeїra said, they asked before Rebbi Yannai: What [are the rules] if he put it on the plug of the amphora? He said to them (Job 36:33): “Its neighbor will inform about it.” What means, “its neighbor will inform about it”? Rebbi Yose said, that which we have stated there: “An amphora full of fruits added to fluids, or one full of fluids added to fruits.” As you say there, only if the fluids touch the amphora; so here only if the loaf touches the plug. Rebbi Mana said, from this it follows as you say there, only if the fluids touch the amphora itself; so here only if the loaf touches the plug itself. His opinion implies, even [if the pitta] is cold. Rebbi Abba said, the problem was about a cold one. But did we not state “hot”? Rav Ḥisda said, that one should not say since the vapor absorbs it should be permitted.

Rebbi Mana ben Rebbi Tanḥum asked: Following him who permits to laymen, why is muries of Gentiles forbidden? Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba, it is forbidden as being cooked by Gentiles. Rebbi Yose objected: Did we not state: “From a professional it is permitted, not from a professional it is forbidden.” From a professional it is permitted even if it is cooked; similarly, from a non-professional it is forbidden even if not cooked. Rebbi Joḥanan bar Maria said, even according to him who says from a professional it is permitted, only if he knows. This implies that usufruct of heave is permitted, usufruct of paganism is forbidden.

Jerusalem Talmud Terumot 11:27

Rebbi Ḥalaphta ben Shaul stated: A pot in which heave was cooked is cleansed three times with boiling water and that is enough. Rebbi Abba said, one does not learn from this for carcass meat. Rebbi Yose said, I objected before Rebbi Abba: Heave implies a deadly sin, carcass meat is a simple prohibition, and you say so? He said to me, it follows him who says, they accepted tithes voluntarily.

From where are tithes taken, from the house or from the field? Let us hear from the following: If a fellow died and in his estate was a chest full of grain, even if he filled it the same day it is supposed to be in order. Is it impossible that he should not have been of clouded mind at least for an hour? Rebbi Abun bar Ḥiyya said, explain it if he died with a clear mind. Rebbi Ḥananiah in the name of Rebbi Phineas understood it from the following: “One tenth which I shall separate in the future is given to Aqiba ben Joseph that he should distribute it to the poor.” That means, from the house. Rebbi Ḥiyya bar Abba understood it from the following: “If somebody’s produce was in a storage bin and he gave a seah to a Levite and a seah to a poor person;” that means, from the house. Rebbi Jeremiah asked before Rebbi Zeїra: If it was taken with a dwqny? Example: Rebbi Zeїra, Rebbi Abba bar Cahana, and Rebbi Levi were sitting together when Rebbi Zeїra was goading those of Agadah and called them books of sorcery. Rebbi Abba bar Cahana said to him, why are you goading us? Ask and they will answer you. He said to him, what means that which is written (Ps. 76:11): “For the rage of man brings thanks to You, the leftover rages You will gird?” He said to him, for the rage of man brings thanks to You in this world, the leftover rages You will gird in the future world. He said to him, why can we not say, for the rage of man brings thanks to You in the future world, the leftover rages You will gird in this world? Rebbi Levi said, when You awaken Your rage on the wicked, they will see what You are doing and they will bring thanks to Your name. Rebbi Zeїra said, the same turns and turns around and one does not understand anything from it. Jeremiah my son, go to Tyre, wrap your dwqny because it is better than anything.

Jerusalem Talmud Maasrot 4:26

Samuel said, capers are forbidden because of skins. It was stated so: (Lev. 19:23) “You shall treat as foreskin the foreskin of its fruit;” anything which envelopes the fruit. Rav commanded those of the House of Ati, Rav Hamnuna commanded the colleagues: Tell your wives that when they come to preserve capers to throw away the calix. Rebbi Abba said, Rebbi Zeїra explained to me that all skins grow with the fruit but there, the fruit is on top and the skins below.

Jerusalem Talmud Maasrot 5:5

According to Rebbi Simeon ben Laqish who said, ṭevel becomes voided by plurality, it is intelligible. According to Rebbi Joḥanan who said, ṭevel does not become voided by plurality, he should wait until it is fully grown and tithe for everything. Or might we say that Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree about ṭevel which has this status by a word of the Torah but for ṭevel which has this status by their word everybody agrees that ṭevel becomes voided by plurality. Rebbi Abba bar Cohen objected: Did we not state: “Similarly, olives for pressing which were mixed with picked olives, harvest grapes with grapes of gleanings”? Is that not ṭevel by their words? Rebbi Mana said, I upheld this: Oil from olives for pressing which was mixed with oil from picked olives.

Jerusalem Talmud Maasrot 5:23

If somebody made a heap [of somebody’s grain] without the latter’s knowledge: Rebbi Joḥanan and Rebbi Simeon ben Laqish. Rebbi Joḥanan said, it is ṭevel, Rebbi Simeon ben Laqish said, it is notṭevel. Rebbi Joḥanan objected to Rebbi Simeon ben Laqish, did we not state: “And similarly women who gave to a baker to make sour dough for them, if not one of them had the required amount it is free from ḥallah.” (But all of them had the required amount?) He said to him, because if somebody makes dough in order to distribute it, the dough is free from ḥallah. But we have stated: “A baker who made sour dough for distribution is obligated for ḥallah.” He said to him, do not answer back about a baker. For a baker, it does not depend on his opinion but on the opinions of his customers; maybe he will find a customer and it will become ṭevel immediately. He said to him, but was it not stated: “The holes of ants which were overnight near an obligated heap are obligated,” therefore, near an exempt heap they are exempt. Rebbi Jonah, Rebbi Abbahu in the name of Rebbi Joḥanan: Because of resignation. Samuel ben Abba said, only if they dragged tips of ears.

Jerusalem Talmud Maasrot 5:30

Menaḥem ben Maximus the brother of Jonathan Caiphas in the name of Rebbi Ammi: Flax may be bought from everybody during the Sabbatical. That is, if you do not know whether he is suspect or not. Therefore, if it is clear that he is suspect, it is forbidden. Zeugos, the relative of Rebbi Abba bar Zavda, in the name of Rebbi Abbahu: Vetch may be bought from anybody during the Sabbatical. Rebbi Yose said: Does our Mishnah say so? “The upper seed of arum, the seeds of leeks, seeds of egg plants, seeds of turnips and radishes, and other garden seeds which are not eaten.” We have stated on this: Seeds of indigo, seeds of madder, and seeds of vetch. That implies, not vetch itself. Maybe if you do not know whether he is suspect or not. Therefore, if it is clear that he is suspect, it is forbidden.

Jerusalem Talmud Maasrot 5:31

So is the Mishnah: The seeds on the stem of arum. Some woman had heave purslain on a block. They fell into a garden and sprouted. The case came before Rebbi Joḥanan who permitted. Rebbi Ḥiyya bar Abba said to him, is this not the Mishnah: “And these may be eaten if their father was heave?” He said to him, Babylonian, when you cleared a potsherd for yourself, you found a pearl! You said, is that not the Mishnah!

Jerusalem Talmud Maaser Sheni 1:6

Or it may follow this: “One does not plant, sink, or graft in the year preceding a Sabbatical year later than thirty days before the New Year; if he planted, grafted, or sank he has to uproot it.” If one did not uproot, what is with its yield? Rebbi Abba [and] Rebbi Immi were sitting in Tyre when a case came before them. Rebbi La taught that the fruits should be thrown away. Rebbi Abba said, I was not counted with them on the upper floor. They said, let us go out and study. They went out and heard Rebbi Jonah and Rebbi Isaac bar Tevele in the name of Rebbi Eleazar: One does not make a new restriction. Rebbi Yose, Rebbi Isaac bar Tevele in the name of Rebbi Eleazar: One does not add to an established practice.

Jerusalem Talmud Maaser Sheni 1:6

Jerusalem Talmud Maaser Sheni 1:12

Rebbi Abba bar Jacob in the name of Rebbi Joḥanan: It is said here (Lev. 27:33): “It may not be redeemed.” It has been said about Cohanim‘s bans (Lev. 27:28) “It may not be sold or redeemed.” Since “it may not be redeemed” for Cohanim’s bans includes sale, so “it may not be redeemed” here includes sale. Rebbi Jacob the Southerner asked before Rebbi Yose: Is it not written about a firstling (Num. 18:17) “it should not be redeemed?” About a blemished animal. For animal tithe, the Torah made no difference between living and slaughtered, unblemished and blemished.

Jerusalem Talmud Maaser Sheni 1:15

Rebbi Zeïra in the name of Rebbi Abba bar Mamal: If someone steals someone else’s animal tithe, if it still exists he returns it as is, if he ate it, he ate what he ate. Rebbi Eleazar in the name of Rebbi Mana: He cannot ask him to give anything; if it is worth less than a peruṭah one cannot say that he should give. Rebbi Ḥinena said, that is, if it was worth less than a peruṭah from the start. But if it was worth a peruṭah from the start, one tells him to pay.

Jerusalem Talmud Maaser Sheni 2:6

Rebbi Ḥinena understood it from the following: “If he ate and drank in one forgetting he is guilty only once.” Rebbi Abba Mari understood it from here (Deut. 26:14): “I did not eat from it in my mourning”, but I drank?

Jerusalem Talmud Maaser Sheni 2:8

Some want to understand it from this (Deut. 12:17): “You may not eat in your gates the tithe of your grain, your cider, and your shining oil.” ‘Your cider’, that is the wine. ‘And your shining oil’ refers to anointing and the Torah called it ‘eating’. But this is not clear. If it were clear one should be whipped because of it outside the walls! Rebbi Yose ben Ḥanina said, one is whipped outside the walls only for pure Second Tithe which entered Jerusalem and left. From where that it is not clear? From what was stated: “On the Sabbath, both anointing for pleasure and anointing not for pleasure are permitted. On the Day of Atonement, both anointing for pleasure and anointing not for pleasure are forbidden. On the Ninth of Ab and public fasts anointing for pleasure is forbidden but anointing not for pleasure is permitted.” Did we not state: “Anointing is equal to drinking for prohibition and replacement but not for punishment, on the Day of Atonement for prohibition but not for punishment”? Did we not state (Lev. 22:15): “They should not desecrate,” to include him who anoints and him who drinks. Rebbi Joḥanan said, there is no ‘anoints’ here. Rebbi Abba Mari said, if there is no ‘anoints’ here then there is no ‘drinks’ for otherwise something that comes from two different prohibitions would be added together!

Jerusalem Talmud Maaser Sheni 2:13

Simeon bar Abba in the name of Rebbi Ḥanina: He who whispers puts oil on his head and whispers on condition that he use neither hand nor vessel. Rebbi Jacob bar Idi, Rebbi Joḥanan in the name of Rebbi Yannai: with hand or vessel. In what do they differ? Whether it is repulsive. For him who says with hand or vessel, it is repulsive. For him who says neither hand nor vessel, it is not repulsive. Rebbi Jonah said, they differ about Second Tithe. For him who says with hand or vessel, Second Tithe is forbidden. For him who says neither hand nor vessel, Second Tithe is permitted. Rebbi Yose said, is all that is permitted on the Sabbath permitted with Second Tithe and all that is forbidden on the Sabbath forbidden with Second Tithe? Did we not state: A woman may douse her son with wine because of sweat, but this is forbidden with heave? Heave and Second Tithe are the same! How is that? Only that he not do it in the way he is used to do it on weekdays.

Jerusalem Talmud Maaser Sheni 2:16

A Mishnah disagrees with Rebbi Joḥanan: “Spices, water, or salt a woman borrowed from a friend for her dough, goes after both their feet.” Rebbi Abba said, for eruv they went according to the logical rule. You should know that this is so since they say there in the name of Rav Ḥisda, but we know not whether from a tradition or a Mishnah, “even logs!” Did we want to say that logs have no credible importance? A baraita disagrees with Rebbi Simeon ben Laqish: “If a tithe dish is prepared with profane spices, the increase belongs to Second Tithe.” Explain it if the improvement cannot be tasted. But was it not stated: “If a profane dish is prepared with Second Tithe spices, the tithe cannot escape redemption”? According to Rebbi Joḥanan, if the volume was increased. According to Rebbi Simeon ber Laqish if the improvement was clearly recognizable.

Jerusalem Talmud Maaser Sheni 2:31

Rebbi Ḥaggai said before Rebbi Zeïra, Menaḥem in the name of Rebbi Joḥanan: In all cases where they said about demay that it can be exchanged, for certain produce one may exchange it in an emergency. But did we not state: “One exchanges bronze for silver in an emergency”, therefore not silver for silver! Rebbi Abba bar Cohen said before Rebbi Jonah, Rebbi Aḥa in the name of Rebbi Joḥanan: In all cases where they said about demay that it should be exchanged, if he transgressed and exchanged for certain produce it is exchanged. Rebbi Jehudah ben Pazi, Rebbi Simeon bar Abba in the name of Rebbi Joḥanan: In all cases where they said about demay that it should be exchanged, if he transgressed and exchanged for certain produce they are exchanged.

Jerusalem Talmud Maaser Sheni 2:31

Jerusalem Talmud Maaser Sheni 3:11

Rebbi Huna said, the reason of Rebbi Simeon is that he says the pesaḥ sacrifice cannot be substituted; if he substituted a second time it still is a pesaḥ. If he substituted, it is a well-being sacrifice! Rebbi Mana said to him, did my teacher not compare the following? Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan, if well-being sacrifices bought with tithe money developed a blemish and he redeemed them, it does not return to its original status to make it a second. Rebbi Zeïra, Rebbi Hila, both in the name of Rebbi Yose ben Ḥanina, one said if well-being sacrifices were bought with tithe money, the holiness of tithe broke away from them. If heave was bought with tithe money, the holiness of tithe did not break away from it. The Mishnah breaks: Can you object from a case in which the holiness of tithe broke away to a case in which the holiness of tithe did not break away? The other one said, this does not mean one objects from a case in which its holiness broke away to a case in which its holiness did not break away; he says to him, it is one immersion.

Jerusalem Talmud Maaser Sheni 4:4

It was stated: “Abba Ḥilfai the small-town man said, when has this been said? For certain [produce], but for demay whether it was expensive and became cheap or was cheap and became expensive, he may sell it cheaply.” Why? Is it because it always may be sold cheaply or because it may not be returned to its place? What is the difference? If later it rose in price again at its place. If you say, because it may not be returned to its place, did it not increase in value? If you say, because it always may be sold cheaply also in this case it can be sold cheaply. Like this: Rebbi Ḥiyya bar Abba was in Rome and he saw them redeem there Nicolaos dates from here at the price here. He said, who taught them? Ḥilfai the small-town man taught them.

Jerusalem Talmud Maaser Sheni 4:4

Jerusalem Talmud Maaser Sheni 4:15

“A tetradrachma and an as is preferred since he adds to the capital”. Rebbi Jacob bar Idi in the name of Rebbi Simai: One does not add a fifth for any Second Tithe which itself is not worth a peruṭa. Rebbi Yose ben Rebbi Simon in the name of Rebbi Joḥanan: One does not add a fifth for any Second Tithe for which the fifth is not worth a peruṭa. Rebbi Abba bar Mamai objected: Did we not state “there are five peruṭot”, should one not state “six” according to Rebbi Simai, “Second Tithe which is worth a peruṭa!” And “seven” according to Rebbi Joḥanan, “the fifth of Second Tithe worth a peruṭa.” In addition, from what Rebbi Yose said in the name of Rebbi Mana bar Tanḥum, Abbahu in the name of Rebbi Joḥanan: Real estate cannot be acquired for less than a peruṭa. In addition, from the following: If the value of Second Tithe is not known, it is enough that one say: it and its fifth shall be exchanged for this tetradrachma. Rebbi Yose in the name of Rebbi Crispus, Rebbi Jonah in the name of Rebbi Zeïra: this baraita deals with a tetradrachma of tithe money where it is impossible that it not contain some profane.

Jerusalem Talmud Maaser Sheni 4:32

Rebbi Zeïra, Ḥiyya bar Abun, Abba bar Taḥlifa, in the name of Rebbi Hoshaia, when do they differ? If they thought about other things but if they still were on the same subject, it is a bill of divorce.

Jerusalem Talmud Maaser Sheni 4:33

Rebbi Ḥaggai asked before Rebbi Yose: Rebbi follows Rebbi Yose and Rebbi Nathan Rebbi Jehudah, as we have stated there: “I cannot accept that you accept it for her, but here you have it and give it to her, if he wants to take it back, he may take it back.” The Mishnah is Rebbi’s, as it was stated: “If she said, bring me my bill of divorce, but he said to him, your wife said, accept my bill of divorce for me. ‘Bring it to her, give it to her, acquire it for her, receive it for her’, if he wants to take it back, he may not take it back, the words of Rebbi. Rebbi Nathan says, ‘bring it to her, give it to her,’ if he wants to take it back, he may take it back; ‘acquire it for her, receive it for her’, if he wants to take it back, he may not take it back.” Rebbi says, in any of these cases he may not take it back except if he says, “I cannot accept that you accept it for her, but give it to her.” It is difficult for Rebbi, “here you have it from my word”, if he wants to take it back, he may not take it back. It is difficult for Rebbi Nathan, “here you have it from her word”, if he wants to take it back, he may not take it back. Rebbi Ḥuna said, he becomes his and her agent. Assi said, everywhere we have stated “his and her agent”, she is divorced and not divorced. He said to him, what do you have in your hand, did not Rebbi Zeïra, Ḥiyya bar Abun, Abba bar Taḥlifa, say in the name of Rebbi Hoshaia, when do they differ? If they thought about other things but if they still were at the same theme, it is a bill of divorce.

Jerusalem Talmud Maaser Sheni 4:43

Were these exchanged? We have stated there: “If he prepared black ones and found white, white and found black, two and found three, they are forbidden, three and found two they are permitted.” Rebbi Jacob bar Aḥa in the name of Rebbi Assi, this is Rebbi’s, as we have stated: “Two hundred and he found a talent, a talent was taken, the word of Rebbi, but the Sages say, it is profane.” He turned around and said, this is everybody’s opinion since pigeon chicks usually start to fly. But did not Rebbi Ḥalaphta ben Shaul state: The same rule applies to pigeon chicks and to eggs. Therefore, it is Rebbi’s. There, he put it there and he found, here, his father put it there, did his father find it? Rebbi Abun bar Cohen said before Rebbi Yose in the name of Rebbi Aḥa: Rebbi Abba bar Zavda taught according to Rebbi for Second Tithe.

Jerusalem Talmud Maaser Sheni 5:26

Samuel bar Abba asked: Since the House of Shammai said that they learned the rules of the vineyard of the fourth year only from Second Tithe; since you say that there is no Second Tithe in the Sabbatical year, there is no fourth-year orchard in the Sabbatical year. Similarly, in the third and sixth years of the Sabbatical cycle, since there is no Second Tithe, there should not be any fourth-year orchard. Rebbi Yose said, even though there is no Second Tithe in the third and sixth years, there are the tithes. In the Sabbatical year, there are no tithes at all.

Jerusalem Talmud Maaser Sheni 5:31

Rebbi Abba, Rebbi Ḥiyya, in the name of Rebbi Joḥanan: A dough of Second Tithe in Jerusalem, following Rebbi Meïr, is free from ḥallah, following Rebbi Jehudah it is subject to ḥallah. Rebbi Jonah said, they said this only for Jerusalem, but not for the countryside.

Jerusalem Talmud Maaser Sheni 5:32

Rebbi Abba bar Cohen asked before Rebbi Yose: Does he who declares it obligated for single berries also declare it obligated for ḥallah? He said to him, is that not Rebbi Jehudah? And it is our opinion that in all this practice, Rebbi Jehudah follows the House of Shammai.

Jerusalem Talmud Maaser Sheni 5:39

Rebbi Jonah gave his tithes to Rebbi Aḥa bar Ulla, not because he was a Cohen but because he studied Torah. What is the reason? (2Chr. 31:4) “He said to the people, the inhabitants of Jerusalem, to give the part of the Cohanim and the Levites, so they should be strong in the Torah of the Eternal.” Rebbi Huna did not take tithe, Rebbi Aḥa did not take tithe. Rebbi Ḥiyya bar Abba instructed himself to go outside the Land, not to take tithe. A person asked Rebbi Samuel bar Naḥman who asked Rebbi Jonathan, may one take? He said to him, take, what fell to your tribe fell to you.

Jerusalem Talmud Maaser Sheni 5:41

Rebbi Abbahu said, Rebbi Joshua ben Ḥananiah and Rebbi Eleazar ben Azariah disagreed. Rebbi Joshua ben Ḥananiah said, one does not give tithe to Cohanim but Rebbi Eleazar ben Azariah said, one gives tithe to Cohanim. Rebbi Joshua ben Ḥananiah objected to Rebbi Eleazar ben Azariah: Is it not written (Num. 18:31): “You shall eat it everywhere”, come and eat it by a grave! He said to him, what means “everywhere”? In the courtyard of the Temple. He retorted, but is it not written (Num. 18:31): “You and your house”? Does a woman enter the courtyard of the Temple? Rebbi Abba understood it from the following occasion: Rebbi Eleazar ben Azariah was used to take tithes from a certain garden. That garden had two exits, one to a place of impurity and one open to a place of purity. Rebbi Aqiba went to him and said, open this one and lock the other one. If he will come, tell him to come by that way. He also said, if he sends a student, tell him “you” is written. Rebbi Eleazar ben Azariah heard this and said, that is Aqiba ben Joseph’s whip. At that moment, Rebbi Eleazar ben Azariah returned all tithes he had taken. Rebbi Isaac bar Eleazar said, for dinner one has to fill up completely with wood fibers; any coal which does not cause a burn at the beginning will not cause one.

Jerusalem Talmud Maaser Sheni 5:68

“The hitters.” Those who were hitting the calf between its horns. Joḥanan the High Priest said to them, how long will you feed torn animals to the altar? He went and made them rings. Rebbi Abba in the name of Rebbi Jehudah: He made rings for them, rings wide below and narrow at the top.

Jerusalem Talmud Challah 1:29

HALAKHAH: Rebbi Jacob bar Zavdi said, this means that one whips because of their ḥallah as a word of the Torah. Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba, explain it if it contains the volume of an olive of any one of them. Rebbi Yose said, you might even say one volume of an olive of all of them. It is different since the category of “leavened” applies to all of them. The argument of Rebbi Yose seems inverted. There, he says two kinds are more than the third and cancel it; here, he says so! Rebbi Yose ben Rebbi Abun said, so is the Mishnah: “Either the volume of an olive from this one or from another.”

Jerusalem Talmud Challah 1:42

It is obvious: For the rabbis, that “less than a third” is not dragged in concerning the matter of tithes. Rebbi Ḥiyya bar Josef asked: According to Rebbi Eleazar, is it dragged in in the matter of ḥallah like a rice dough? Samuel bar Abba asked: How does one treat old and new for ḥallah? Two fields, one one-third ripe, one less than one-third ripe, are one for ḥallah and two for tithes. One less than one-third ripe and one of grasses are two for ḥallah and one for tithes. One one-third ripe and one of grasses are two both for ḥallah and tithes.

Jerusalem Talmud Challah 1:51

“Similarly, qenubqa’ot are obligated”. Rebbi Joshua ben Levi said, Zwieback. Rebbi Ḥananiah ben Agul in the name of Ḥizqiah said boqrlṭa. That you should not say that because in the end it will be turned into a kind of farina it should be free from ḥallah. Rebbi Abba bar Zavda said, dough for the sick is obligated for ḥallah, that you should not say that because in the end it will be turned into a kind of farina it should be free from ḥallah.

Jerusalem Talmud Challah 1:59

HALAKHAH: If somebody made a heap [of somebody’s grain] without the latter’s knowledge: Rebbi Joḥanan and Rebbi Simeon ben Laqish. Rebbi Joḥanan said, it is ṭevel, Rebbi Simeon ben Laqish said, it is not ṭevel. Rebbi Joḥanan objected to Rebbi Simeon ben Laqish, did we not state: “And similarly women who gave to a baker to make sour dough for them, if none of them had the required amount it is free from ḥallah.” (But what if all of them had the required amount?) He said to him, because if somebody makes dough in order to distribute it, the dough is exempt from ḥallah. But we have stated: “A baker who made sour dough for distribution is obligated for ḥallah.” He said to him, do not answer back about a baker. For a baker, it does not depend on his opinion but on the opinions of his customers; maybe he will find a customer and will make bread dough for him. He said to him, but was it not stated: “The holes of ants which were overnight near an obligated heap are obligated,” therefore, near an exempt heap they are exempt. Rebbi Jonah said, Rebbi Yose, Rebbi Abbahu in the name of Rebbi Joḥanan: Because of resignation. Samuel ben Abba said, only [if they dragged tips of] ears.

Jerusalem Talmud Challah 1:63

The Mishnah said: “if the shepherds eat from it.” Maybe sometimes the shepherds will not eat from it. Rebbi Joḥanan said, any he made into cracknels. We also have stated so: “Any he made into cracknels is obligated; if he made it connected it is free.” Rebbi Abba in the name of Samuel, Rebbi Ammi in the name of the elder Rebbi Ḥiyya, even if he formed it as rolls. But did we not state, “if the shepherds do not eat from it?” Explain it if he made it from the start [thinking] that the shepherds should not eat from it.

Jerusalem Talmud Challah 2:3

How does Rebbi Eliezer explain the reason of Rebbi Aqiba, (Num. 15:17) “To the Land into which I am bringing you?” The colleagues in the name of Rebbi Eleazar, Rebbi Abba in the name of Rebbi Eleazar, Rebbi Hila in the name of Rebbi Simeon ben Laqish: So did Rebbi Aqiba object to Rebbi Eliezer: Do you not agree that when Israel entered the Land and found there coarse and fine flour that this was subject to ḥallah? Did it not grow while exempt? He accepted that. Rebbi Yose said, I am wondering how could Rebbi Aqiba object to Rebbi Eliezer and how could the latter accept it? There, before they entered they had inherited it retroactively, as Rebbi Huna said in the name of Rebbi Samuel ben Naḥman: It is not written “to your posterity I shall give” but (Gen. 15:18): “to your posterity I gave”, I already gave it.

Jerusalem Talmud Challah 2:12

Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joshua ben Levi: Nothing is clear except the seven fluids. Rebbi Yose asked: Was this said for ḥallah or for impurity? If you say for ḥallah, so much more for impurity. If you say for impurity, then not for ḥallah. It is obvious for Rebbi Jonah that it had been said for ḥallah, so much more for impurity. Rebbi Jonah sticks to his opinion, for Rebbi Jonah stated from Rebbi Simeon ben Ioḥai; Rebbi Joshua ben Levi stated in Rebbi Simeon ben Ioḥai’s name, as Rebbi Simeon ben Ioḥai stated: Rebbi Ṭarphon said, it is stated here ḥallah, and it is stated there, a ḥallah of oil cake. Since the ḥallah mentioned there is prepared with oil, so the ḥallah prepared here must be prepared with oil. And oil is one of the seven fluids.

Jerusalem Talmud Challah 2:20

HALAKHAH: How is this? Less that four mil he should make it in purity, four mil he sould make single qabim, or four mil he should make it in purity, more than four mil he sould make single qabim? Let us hear from the following, since Rebbi Ḥiyya bar Abba said, for example Caesarea. Is Caesarea not four mil? That means, four mil he should make it in purity, more than four mil he sould make single qabim. Rebbi Ammi instructed in Kefar Sammai to make a large dough in impurity. Is that not less than four mil? Since a brook interrupts it is as if there were four mil. This teaching follows Rebbi Aqiba since Rebbi Aqiba says, he should make it in impurity and not make it single qabim. It was a large dough and it would have been easier for him to walk a distance than to make it single qabim.

Jerusalem Talmud Challah 3:13

HALAKHAH: And why is it stated twice? Rebbi Huna, Rebbi Ḥiyya, Rebbi Joshua ben Levi in the name of Rebbi Pedaiah: One for smoothing, one for one third. Rebbi Yose said, Rebbi Abba and the colleagues. The colleagues say, one for smoothing, one for one third. Rebbi Abba explains: At Ḥallah for smoothing, at Peah for one third.

Jerusalem Talmud Challah 3:19

There, we have stated: “If a proselyte became Jewish while he had a cow, if she was slaughtered before he became Jewish he is free, after he had become Jewish he is obligated. In case of doubt he is free because the burden of proof is on the claimant.” There you say in doubt he is free, here you say in doubt he is obligated. Rebbi Abba said, this was challenged before Rebbi Ammi and he said, who would tell me that he takes its value from the tribe! Rebbi Jacob bar Zavdi, Rebbi Ḥiyya in the name of Rebbi Eleazar, he takes its value from the tribe. Why can he not put aside there and take its value from the tribe? Rebbi Yose said, ḥallah which is ṭevel and a deadly sin he puts aside and does not take its value from the tribe since the burden of proof is on the claimant.

Jerusalem Talmud Challah 3:29

This means that biting is biblical. Rebbi Immi said, Rebbi Joḥanan and Rebbi Simeon ben Laqish differ. Rebbi Joḥanan said, biting is biblical. Rebbi Simeon ben Laqish said, biting is not biblical. Rebbi Ḥiyya bar Abba switches the traditions. They asked before Rebbi Yose, what did you hear about Rebbi Joḥanan? He said, I did not hear anything but let us explain the words of the rabbis from their own words, as we have stated there: “If somebody collects loaves in order to separate [ḥallah] and they bit, the House of Shammai say it is a connection for a ṭevul yom but the House of Hillel say it is not a connection.” Rebbi Simeon ben Laqish said, since we stated it is no connection, that means that nobody can become guilty under the heading “impure person eating pure [food]”. Rebbi Joḥanan said to him, that is different for a ṭevul yom because for him is written both pure and impure; pure for profane food during daytime hours and for heave after dark. That identifies Rebbi Joḥanan as the one who said that what is not a connection for the ṭevul yom is biblical. Therefore, he says biting is biblical. And Rebbi Simeon ben Laqish is he who says it is not biblical since he says biting is not biblical. But did we not state: “Otherwise, he brings four quarters and makes it bite?” Rebbi Hoshaia said, explain that it was part of the dough which was bitten.

Jerusalem Talmud Challah 3:30

Rebbi Zeïra asked: Do Rebbi Joḥanan and Rebbi Simeon ben Laqish differ if it bites by itself but if he made it bite with his hand everybody agrees that biting is biblical? Even if you say that the disagreement arises if he made it bite with his hand, Rebbi Simeon ben Laqish sticks with his opinion since Rebbi Simeon ben Laqish said in the name of Ḥizqiah: ṭevel disappears in a plurality. Rebbi Yose ben Rebbi Nahorai said, ṭevel disappears in a plurality. Rebbi Joḥanan said, ṭevel does not disappear in a plurality. Rebbi Abba bar Mamal and Rebbi Hila brought a case before Rebbi Assi; they wanted to say that two form a majority against one. They had not heard that Rebbi Simon said in the name of Rebbi Joshua ben Levi that ṭevel does not disappear in a plurality. But did we not state: “Otherwise, he takes from one for all”? Rebbi Yose said, everybody agrees that he separates. Where do they differ? To worry about a second taking. For him who says ṭevel disappears in a plurality, if one lifted it out but if fell into another place, he does not worry to take it out a second time. For him who says ṭevel does not disappear in a plurality, if one lifted it out but if fell into another place, he worries to take it out a second time.

Jerusalem Talmud Challah 3:31

Rebbi Abba said: Rebbi Joḥanan and Rebbi Simeon ben Laqish differ about ṭevel by biblical standards. But for ṭevel which is ṭevel only by rabbinic decree, everybody agrees that ṭevel disappears in a plurality. Rebbi Abba bar Cahana objected before Rebbi Yose: Did we not state: “Similarly, if harvested olives were mixed with plucked olives, or harvested grapes with gleanings,” is that not ṭevel only by rabbinic standards? Rebbi Mana said, I confirmed it: If oil from harvested olives was mixed with oil from plucked olives!

“If somebody harvested a pumpkin to use to give now and in the future, any time he harvests he has to come and note, up to here is heave, up to here is heave, the words of Rebbi. Rabban Simeon ben Gamliel says, he harvests and computes as is usual for him.” They wanted to say, for him who says up to here is heave, up to here is heave, ṭevel disappears in a plurality but for him who says he harvests and computes as is usual for him, ṭevel does not disappear in a plurality. Rebbi Abba said, between them is the duty to immediately give it to the tribe.

Jerusalem Talmud Challah 4:2

HALAKHAH: “Two women who each made,” etc. Rebbi Joḥanan said, usually for women, one does not mind, two do mind. They gave to one woman who minds the status of two women, to two women who do not mind the status of one woman. If she does not mind, why does she make it at two different places? Rebbi Jonah said, because she has not enough space to knead. The word of Rebbi Jonah implies that if she had enough space to knead but she makes it in two portions, she does mind. Clean and coarse [flour], she does mind. Rebbi Lazar said, they gave two different habits the status of two women. Samuel bar Abba asked, even if they come to agree?

Jerusalem Talmud Challah 4:30

Rebbi Joḥanan said, our teachers in the Diaspora used to separate heave and tithes until the youngsters came and dissuaded them. Who are the youngsters? The interpreters. Rebbi Zeïra, Rav Jehudah in the name of Samuel: For ḥallah from outside the Land and heave from outside the Land one may eat before one separates. Rebbi Abba in the name of Samuel: They only worried about heave of grain, cider, and oil. Rebbi Hila in the name of Samuel: They only worried about heave, but for vegetables they did not worry even about the Great Heave, as it was stated: Issi ben Aqabiah says that tithes for vegetables are rabbinical.

Jerusalem Talmud Challah 4:39

HALAKHAH: Rebbi Ḥiyya stated: They decided about these and turned them back to their places of origin. Rebbi Abba bar Zavda said, this is impossible. One may not eat it lest people say we saw impure heave being eaten. One may not burn it lest people say we saw pure heave being burned. One may not return it to its place of origin lest people say we saw heave being exported from the Land. What to do? He lets it lie until Passover eve and burns it.

Jerusalem Talmud Challah 4:42

“The people of Alexandria brought their ḥallot from Alexandria but they did not accept from them.” Rebbi Abba Mari said, is that not also from Rebbi Ḥiyya the elder? He holds that they decided about these and ordered them to be returned.

Jerusalem Talmud Orlah 1:6

It was stated in the name of Rebbi Simeon: The only kinds admitting an intention of exemption are three: [buckthorn], sycamore, and caper bush. Are these obligated for tithes? This is a dispute between Rebbi Abba bar Mamal and Rebbi Hila. They differed: If somebody kept his fruit trees for wood, Rebbi Abba bar Mamal said he is obligated, Rebbi Hila said he is exempted. Rebbi Abba bar Mamal said he is obligated, from the following: (Deut. 14:29) “The Levite shall come, because he has neither part nor inheritance with you.” You are obliged to give him from what you have but he has not. This excludes abandoned property for which your and his hands are equal. Gleanings, forgotten sheaves, peah, and abandoned property are all equal.

If he planted as a fence for three years, afterwards thought to use it for food, and it grew more? Rebbi Jeremiah said the addition is exempt, Rebbi Abba said the addition is obligated. Rebbi Yose said, the opinion of Rebbi Jeremiah seems to be difficult but it is only reasonable, as we have stated: “If a field became one-third ripe in the possession of a Gentile and a Jew bought it, Rebbi Aqiba says the addition is exempt. But the Sages say, the addition is obligated.” In our case the stem is exempt and its addition should be obligated?

Jerusalem Talmud Orlah 1:24

HALAKHAH: (Lev. 19:21) “When you plant,” this excludes what Gentiles planted before Israel came to the Land. Rebbi Huna in the name of Rebbi Abba, this implies that an exempt root exempts.

Jerusalem Talmud Orlah 1:30

It was stated: “If a Gentile grafted a food-tree on a futile tree, even though a Jew is not permitted to do this, it is obligated for ‘orlah.” From when does one count ‘orlah? From the moment it is planted. Rebbi Simeon ben Laqish said, only those for which intent is important; for example carob trees from Ẓalmon or Gidud; but on a willow it is as if planted in the earth. Rebbi Joḥanan said, even on a willow. But did we not state: “One does not plant, sink, or graft in the year preceding a Sabbatical year later than thirty days before the New Year; if he planted, sank, or grafted it should be uprooted.” According to Rebbi Simeon ben Laqish who will explain it by grafting on a willow it is understandable. According to Rebbi Joḥanan who said even on a willow, why should it be uprooted? There is a difference because they unite in the Sabbatical year. And that is what has been said, “If somebody planted, sank, or grafted 30 days before the New Year, it counts for him as a full year and he is permitted to keep it in the Sabbatical year. Less than 30 days before the New Year, it does not count for him as a full year and he is not permitted to keep it in the Sabbatical year. Truly, they said, the fruits from this planting are forbidden until the fifteenth of Shevaṭ.” Rebbi Joshua from Ono stated: There is no “grafted” here. Rebbi Abba Mari said, even for Rebbi Simeon ben Laqish there is no “grafted” here; for the past, certainly not to start out with.

Rebbi Zeïra, Rebbi Assi in the name of Rebbi Ḥanina; Rebbi Abba, Rebbi Ḥiyya, Rebbi Eleazar, Rebbi Ḥananiah in the name of Rebbi Ḥanina ben Gamliel: If a young tree was attached to an old one, the young one was cleansed. Rebbi Ḥiyya bar Abba said, the Mishnah says so: “Attachment of vines, attachment after attachment, even if he sank them into the earth, are permitted.” Should we not say that maybe the young tree formed roots before it was well connected to the old one? Rebbi Ḥananiah the son of Rebbi Hillel: This follows Rebbi Jehudah, since Rebbi Jehudah says it connects well more quickly than it forms roots.
