Now Rebbi Meïr says, after noontime it is forbidden because of their words. The (sixth) [seventh] hour it is forbidden because of a fence. Why the (fifth) [sixth]? Because of a fence. Is there a fence around a fence? But the (fifth) [sixth] may be confounded with the seventh. Rebbi Jehudah’s argument seems inverted. There, he says that the fifth cannot be confounded with the seventh. But here, he says that the fifth can be confounded with the seventh. Rebbi Yose said, there the matter is given over to women who are lazy, here the matter is given over to the court who is careful. Rebbi Yose ben Rebbi Abun said, there it is a matter between the beginning of the fifth and the end of the seventh hour. Here it is between the end of the fifth and the start of the seventh. It also was stated thus: At the start of the fifth hour, the sun is in the East, and the end of the seventh the sun is in the West. The sun never starts setting before the end of the seventh hour.
Rabbi La said, why does one record the argument of him who argues for acquittal? Because of him who argues for conviction, maybe his memory will fail him. If he switches his argument, they could say to him, this you said, this you did not say. [Does this mean] that it needs two [groups of] witnesses? It would mean that the trial would be extended. Rebbi Yose ben Rebbi Abun said, because of him who argues for acquittal.
Rebbi Crispus in the name of Rebbi Joḥanan: The Mishnah speaks of a ba `aṣ wire. What is a ba `aṣ wire? The rabbis of Caesarea say, a mixture of lead and tin. Rebbi Yose ben Rebbi Abun said, this follows him who said, “one lights a wire and throws it into his mouth.” But for him, who says, “it enters his innards and chars his intestines,” the Mishnah speaks of a wick of Naphtha.
Rebbi Abun bar Ḥiyya said: Rebbi Ismael stated so: You shall not divine nor cast spells. Were not divination and spellbinding included in the general class but were mentioned separately to be treated differently from the general case? In general by extirpation, the separate cases for extirpation. A statement of Rebbi Joḥanan says, it is a case of general case and detail, as Rebbi Abbahu said in the name of Rebbi Joḥanan, for anybody who would perform any of these abominations will be extirpated, etc. Was not his sister included in the general class? Rebbi Eleazar objected: Was it not written, the nakedness of your mother’s sister and your father’s sister you shall not uncover? He told him, it was stated separately for a reason, to judge it by touching. But is it not written: A man who would lie with an unwellwoman, who uncovered her nakedness, he touched her source, and she uncovered the source of her blood? He told him, it was stated separately for a reason, to judge it by touching. That you should not say, since one is guilty about her already by the impurity of touching, we should not treat the one who touched equal to the one who had full intercourse. Therefore, it was necessary to say it. But is it not written: A man who would sleep with his aunt uncovered his uncle’s nakedness? He told him, it was stated separately for a reason, to judge it by destruction, as Rebbi Yudan said, at all places where they will be destroyed is mentioned, they will be childless; where they shall die destroyed is mentioned, they shall bury their children.
We have it stated here, we have it stated in Keritut. One understands in Keritut that he brings one sacrifice and then has to bring a second. What can you say in Sanhedrin? That he is stoned and then stoned again? Rebbi Yudan, Rebbi Mattaniah’s father, said: explain it for warnings. For if they warned him because of the father’s wife, he is hit, because of the mother, he is hit. Could they not also warn him because of a married woman? Rebbi Abun said, explain it if she was unmarried.
There, we have stated: Rebbi Jehudah says, if his mother was not fit for his father, he is liable only for one [sacrifice]. Therefore, if his mother was fit for his father, he is liable for two. Rebbi Abbahu in the name of Rebbi Joḥanan: There is no difference. Whether his mother was fit for his father or unfit for his father, he is liable only once. The reason of Rebbi Joḥanan: Your mother is she, you find him guilty because of his mother; this directs the entire chapter towards his mother. Rebbi Abun bar Ḥiyya asked before Rebbi Zeˋira: What caused Rebbi Joḥanan to concentrate on the mother and to leave the father’s wife aside? He told him, for he argues with Rebbi Ismael, as Rebbi Ismael explained: Your father’s wife’s nakedness; the verse refers to the male. Is not his father included in the category of the male? Only to make him liable twice, as we have stated: A person having sexual relations with his father is doubly liable about him. Then should we not state “thirty-seven extirpations in the Torah”? Rebbi Mana said, all denotations of males are one. Your father’s wife’s nakedness; the verse refers to the father’s wife. Your mother’s nakedness, that is his mother who is his father’s wife. From where his mother who is not his father’s wife? Your mother is she; do not uncover her nakedness. How does Rebbi Ismael treat this? He explains it to apply after [the father’s] death. Does Rebbi Aqiba not explain she is your father’s nakedness? There is no difference whether during lifetime or after death. Rebbi Aqiba explains: Your father’s wife’s nakedness, the verse refers to the father’s wife. Your mother’s nakedness, that is his mother who is his father’s wife. From where his mother who is not his father’s wife? Your mother is she; do not uncover her nakedness. How does Rebbi Ismael treat this? He explains it to apply after [the father’s] death. Does not Rebbi Aqiba treat your father’s nakedness, your mother’s nakedness? Since your father refers to your father in any capacity both for punishment and warning, so also your mother refers to one’s mother in any capacity both for punishment and warning. Is it not reasonable to explain that verse except following Rebbi Jehudah who because he does not accept “his mother who is his father’s wife” must explain that your father’s nakedness, your mother’s nakedness refers to your father in any capacity both for punishment and warning, so also your mother refers to your mother in any capacity both for punishment and warning. Rebbi Zeˋira said, this implies that one infers from parallel language even if it is free only from one side. Rebbi Yudan said to him, this is obvious for Rebbi Aqiba since Rebbi Aqiba infers from parallel language even if it is not free.
HALAKHAH: “A man who had sexual relations with a male.” From where the warning for a person having sexual relations with a male? With a male you shall not sleep in women’s ways. From where extirpation? For anybody who would commit any of these abominations will be extirpated, etc. Punishment from where? A man who would sleep with a male in women’s ways, an abomination did both of them commit; they shall be put to death; their blood be on them. You learn their blood be on them from their blood be on them. That is for the active one. For the passive one from where? With a male you shall not sleep in women’s ways, read: to be slept with. So far following Rebbi Aqiba. Following Rebbi Ismael? There shall be no qadeš among the sons of Israel. From where extirpation for the passive homosexual following Rebbi Ismael? Rebbi Jeremiah in the name of Rebbi Abbahu. It says here qadeš and it says there, also a qadeš was in the land. You learn qadeš from qadeš and qadeš from abomination. Rebbi Ḥiyya bar Ada in the name of Rebbi Ḥanina: Abomination from abomination. Rebbi Yose ben Rebbi Abun said, a baraita states this: Both committed an abomination. Both are stoned, both are subject to warning, both by extirpation.
Rebbi Abun bar Ḥiyya asked of Rebbi Zeˋira: For what reason did Rebbi Ismael and Rebbi Aqiba disagree about a male and an animal but did not disagree about any incest prohibition? He told him, because for all incest prohibitions it is written blood relative, and about these it is not written blood relative. They objected: About the menstruating woman it is not written blood relative; did they disagree about her? Rebbi Jeremiah in the name of Rebbi Abbahu: For it is written approach, approach; it is as if all were here and there. Rebbi Ḥiyya bar Aba in the name of Rebbi Ḥanina: To the wife in the separation of her impurity you shall not come near to uncover her nakedness. Rebbi Yose ben Rebbi Abun said, “not to come near” is “not to uncover.”
Rebbi Abun bar Ḥiyya asked before Rebbi Zeˋira: Do not worship them, a principle. Do not prostrate yourself before them, a detail. For you shall not prostrate yourself before another god; He again stated the principle. Principle, detail, and principle: is nothing covered but the detail? Rebbi Abun bar Cahana asked before Rebbi Hila: Do not do such, a principle. One who sacrifices to gods shall be banned, a detail. Only for the Eternal alone, He again stated the principle. Principle, detail, and principle; is not everything included? Does it not add one who embraces and one who kisses? He told him, why is prostrating mentioned? Not to infer from it that it is an action? He who embraces and he who (prostrates himself) do not exemplify actions.
From where about him who says, “you are my god”? Rav Abun in the name of the rabbis there: They prostrated themselves before it, and sacrificed to it, and said, these are your gods, Israel. Then he should not be guilty unless he sacrifice, burn incense, and declare. Rebbi Yose said, the verse is written only for the disgrace of Israel. They prostrated themselves before it, not before Heaven. And sacrificed to it, not to Heaven. And said, not to Heaven. What about this? Saying is mentioned here and saying is said about one who leads astray. Since for saying mentioned about one who leads astray, saying is equated with acting, also for the saying mentioned here, we have to equate saying with acting.
Rebbi Abun bar Ḥiyya asked before Rebbi Zeˋira: If he handed over but did not make to pass through, is that the disagreement between Ḥizqiah and Rebbi Joḥanan? Fore they disagreed: If he slaughtered but did not sell, Ḥizqiah said he is liable, but Rebbi Joḥanan said, he is not liable.
HALAKHAH: “One who desecrates the Sabbath,” etc. From where warning for the desecrator? Do not perform any work. From where extirpation? For any who would perform work on it would be extirpated. From where punishment? Its desecrator shall be made to die the death. Should we not state 37 kinds of extirpation in the Torah? Rebbi Yose ben Rebbi Abun said, because if he performs all of them, intentionally on the Sabbath and intentionally for the work, he is liable for each one singly.
“One who has sexual relations with a preliminarily married maiden.” Rebbi Yasa in the name of Rebbi Joḥanan, Rebbi Ḥiyya in the name of Rebbi Eleazar: This is Rebbi Meïr’s. But for the rabbis even if she is a minor. What is Rebbi Meïr’s reason? “Lad” is written defectively in the paragraph. How do the rabbis explain “a lad”? Rebbi Abbahu in the name of Rebbi Simeon ben Laqish: Once in the paragraph it is written a young woman; this teaches that in the entire paragraph she is an adult. Rebbi Meïr objected to the rabbis: In the matter of the calumniator, a lad is written and she is an adult since a minor is not stoned? What do the rabbis do with this? Rebbi Abin said, explain it that he came to her as a male. Rebbi Jacob bar Abba asked before Rav: What is the law of him who comes to a minor? He said to him, by stoning. What is the law of him who comes to an adult? He said to him, I am reading an adolescent, not an adult. Read an adolescent, not a minor! Do you not agree with me that she has the right to a fine? He answered, because he mistreated her, that includes a minor for a fine. Read because he mistreated her, that includes an adult for a fine! Rav said, even though Rebbi Jacob bar Abba won the logical argument, practice is that he who comes to a minor is [punished] by stoning but she is free. Rebbi Abun in the name of (Rebbi) Samuel. Why? He understood it from the following: The man who had lain with her alone shall die. Do we not know that the girl has not committed a capital crime? Why does the verse say, do not do anything to the girl; the girl has not committed a capital crime? That includes him who has sexual relations with a [preliminarily married] underage girl; he is stoned and she is free.
HALAKHAH: “If his father was willing,” etc. Rebbi Joḥanan said, even if his mother was not suitable for his father. But is not all of his mother’s property also his father’s? Rebbi Yose ben Abun said, explain it about one who took in lodgers, made repasts, and he stole from there.
The following is obvious: A murderer who broke vessels or otherwise caused damage is liable to pay. If he continued to break until he came to the town, Rebbi Zeˋira and Rebbi Hoshaia: One said, he pays, the other said, he does not pay. If the pursuer becomes the pursued, may one save the pursuer through the person of the pursued? An adult (who became) a minor, may one save the adult through the person of the minor? Rebbi Jeremiah objected, did we not state: “If his head and most of his body were born, one does not touch him, for one does not push aside one life for another.” Rebbi Yose ben Rebbi Abun said in the name of Rav Ḥisda: It is different there since you do not know who is killing whom.
Rebbi Yose ben Rebbi Abun said, one may even understand this from the warning: Do not desecrate your daughter to force her into prostitution.
Dissolute in sexual matters. For the woman of Shunem said to her husband: Lo, I know that he is a holy man of God. Rebbi Jonah said, he is holy, but his student is not holy. Rebbi Abun said, because he never looked at her. But the rabbis of Caesarea say, he never had an involuntary emission. The slave girl of Rebbi Samuel ben Rav Isaac said, I was washing my master’s garments. I never saw a bad thing on my master’s garments. It is written: Geḥazi drew near to push her away. What is לְהָדְפָהּ? Rebbi Yose ben Ḥanina said, he put his hand on her beauty spot, between her breasts.
It is understandable if it did not come to his knowledge. If it did come to his knowledge? Was it not stated: “From where that those obligated for purification sacrifices and certain reparation sacrifices for whom the Day of Atonement had passed, are obligated to bring them after the Day of Atonement, but those obligated for suspended reparation offerings are no longer liable?” Rebbi Abun bar Ḥiyya said, whether it was known to him on it, or not known to him on it, did not the Day of Atonement already atone? Rebbi Simeon in the name of Levi [Sokhia], the Mishnah speaks of one who rebels against the day of Atonement. Why did he not say, if it was not known to him on the Day of Atonement? His words imply that even if it was not known to him on the Day of Atonement, the Day of Atonement atones.
HALAKHAH: “Together Israel, Cohanim,” etc. But we did not state “the Anointed.” Why did we not state “the Anointed”? If you say that we are discussing things which do not imply the obligation of a sacrifice, it is correct not to state “Anointed”. If you say about things which imply the obligation of a sacrifice, why do we not state “Anointed”? It was found stated “also the Anointed Priest.” This implies that we are discussing things which do not imply the obligation of a sacrifice. Rebbi Yose ben Rebbi Abun said, even if you say, about things which imply the obligation of a sacrifice, if it was done intentionally. As you say, intentionally it needs atoning and the atoning of the Day of Atonement, here also it needs atoning and the atoning of the Day of Atonement.
HALAKHAH: “The kinds of awareness of impurity,” etc. Rebbi Jeremiah asked: It is obvious about the last awareness, until he knows that he is liable to bring a sacrifice for it. Is the same true for the first awareness? Let us hear from the following: Two paths, one impure and one pure. He walked on one of them, entered the Sanctuary, left, sprinkled repeatedly, immersed himself, walked on the second one, and entered the Sanctuary; he is liable and he knows that he is liable to bring a sacrifice for it. Rebbi Simeon ben Laqish said, this is Rebbi Ismael’s who said that he is liable for forgetting impurity and forgetting the Sanctuary. Rebbi Abun bar Ḥiyya said, we thought that one could say that Rebbi Simeon ben Laqish said this if he was certain that he was impure, he had forgotten the impurity and entered the Sanctuary. But not if it was in doubt whether he was impure or pure, he was oblivious of the Sanctuary and entered the Sanctuary. Since Rebbi Simeon ben Laqish said, this is Rebbi Ismael’s who said that he is liable for forgetting impurity and forgetting the Sanctuary: this implies even if it was in doubt whether he was impure or pure. Rebbi Joḥanan said, it is everybody’s opinion since a doubt of awareness is awareness. Since at a time when he does not know whether he was impure or pure you say it is certain knowledge, if he knows for certain that he is impure but does not know whether he is liable for a sacrifice then certainly this should be awareness.
One ate five times the volume of an olive; he separately realized a doubt about each one. Afterwards it became known to him as a certainty. Rebbi Simeon ben Laqish said, the knowledge about his doubt determines his kind of sacrifices. Rebbi Joḥanan said, the knowledge about his doubt does not determine his kind of sacrifices. Rebbi Yose bar Abun in the name of Rebbi Samuel bar Rav Isaac: Rebbi Simeon ben Laqish agrees that for the Anointed Priest the knowledge about his doubt does not determine his kind of purification sacrifice. What is the reason? Like purification offering, like reparation offering. The knowledge about his doubt determines the transgression for one who brings a suspended reparation offering. The knowledge about his doubt does not determine the transgression for one who does not bring a suspended reparation offering.
An androgynus who saw whitish [effluent] and entered the Sanctuary is not liable. If he saw red [effluent] and entered the Sanctuary, he is not liable. If he saw simultaneously whitish and red and entered the Sanctuary, he is liable. There is a Tanna who states: he is not liable. Rebbi Joḥanan said, this is Rebbi Simeon, as it was stated: “Two paths, one pure and one impure. He walked on one of them, entered the Sanctuary on the first one, sprinkled repeatedly, immersed himself, on the second one and entered; he is liable. Rebbi Simeon declares him not liable in this case. Rebbi Simeon ben Jehudah in the name of Rebbi Simeon declares him not liable in all cases.” One understands the androgynus, for whitish [effluent] you declare him to be a woman, for red [effluent] you declare him to be a man. But here there is no known impurity. Rebbi Samuel bar Sosartai said, explain it if he forgot the first. Rebbi Yose asked, where do we hold? If he forgot it forever, it is one path. If he forgot repeatedly, there are two paths. Rebbi Yose ben Rebbi Abun said, Rebbi Simeon parallels Rebbi Eliezer in the interpretation of Ḥizqiah. Just as Rebbi Eliezer said there, until he knows whether he did become impure by a crawling animal or a corpse, so Rebbi Simeon says here, until he knows whether he did become impure by red [effluent] or by whitish. One understands there since he said, a doubt of awareness is awareness. But here, since he saw whitish and red together, it is certain knowledge.
Rebbi Abun bar Ḥiyya asked: Why did he not say, “an oath that I shall eat of the slaughter of X”? Is there not fat? If he slaughters deer. Is there not the hip sinew? About fowl. Is there not blood?
From where a warning about an oath for a permitted purpose? Rebbi Yose ben Rebbi Abun said, he shall not profane his word, he shall not make his words profane.
Ḥizqiah said: he who swears that two are two is flogged for a vain oath. Rebbi Menahem in the name of Rebbi Simeon ben Laqish: He who saw rain falling and said Κύριε πόλυ βρέξον is flogged for a vain oath. Rebbi Onias, Rebbi Jacob ben Rebbi Abun in the name of Rebbi Samuel ben Naḥman: 24 city councils were in Judea and they all were destroyed because of true vain oaths, as it is written: For the vain did I hit your sons.
Rebbi Yose ben Rebbi Abun, Rebbi Huna in the name of Rebbi Yose. It is said here two and it is said there by the mouth of two witnesses. Since there it must be by the testimony of two witnesses, also here by the testimony of two witnesses. Then why does the verse say two? Lest one of them be standing while the other be sitting; one says everything he has to say, but to the other one says, make your statement short. With one he puts up, to the other he is unfriendly.
HALAKHAH: “A judicial oath,” etc. The claim, the House of Shammai say, an obolos, but the House of Hillel say, two oboloi. The argument of the House of Shammai seems inverted. There, they say, “silver” is a denar, but here, they say that “silver” is an obolos. The argument of the House of Hillel seems inverted. There, they say that “money” is a peruṭah but here, they say that “money” is two oboloi. Rebbi Jacob bar Aḥa in the name of Rebbi Ḥanina: The House of Shammai learn from the initial sale of a Hebrew girl. Since her initial sale was by [at least] a denar, so her preliminary marriage is by [at least] a denar. The House of Hillel learn from the end of her diminution. Since the end of her diminution is a peruṭah, so her preliminary marriage is by a peruṭah. What is the reason of the House of Shammai? As it is said, she leaves gratis, without silver. Would we not know that it is without money? Why does the verse say, without silver? From there, that she is sold for more than silver. And what is more than silver? A denar. But maybe “silver” is a peruṭah, more than silver two peruṭot. The smallest silver coin is an obolos. So why is it not an obolos? Rebbi Abun in the name of Rebbi Judah bar Pazi: For if she wants to diminish, she diminishes every year by an obolos and leaves. Could she not diminish by a peruṭah? Rebbi Abun said, think of it. If she wanted to compute the diminution at the start of the sixth year, there would be a peruṭah left. But the start of the diminution must be an obolos, the end of the diminution a peruṭah. If there is only one peruṭah left, can she not pay the diminished amount and leave? Just as the last diminished amount is a peruṭah, so her preliminary marriage should be a peruṭah! What is the reason of the House of Hillel? Since her last diminished amount is a peruṭah, you know that her preliminary marriage is by a peruṭah. Think of it, if there is only one peruṭah’s worth left, can she not pay the diminished amount and leave? Just as the last diminished amount is a peruṭah, so her preliminary marriage is by a peruṭah.

HALAKHAH: “You are holding a mina for me;” etc. Rebbi Abun said, it is usual for people to give loans to others not in the presence of witnesses but to ask for repayment in the presence of witnesses.
Rebbi Marinus was guarantor for his daughter-in-law. They went to court before Rebbi Ḥama the father of Bat Qappara and Rebbi Hoshaia. After he had admitted he said to him, I gave. They asked the Elder Rebbi Ḥiyya; Rebbi Ḥiyya asked Rebbi: One who became liable in court cannot be trusted. What is the meaning of “he cannot be trusted”? Rebbi Abbahu in the name of Rebbi Joḥanan: If he pays on his own initiative, he is trusted when he says, I gave. But from the orders of others, he cannot be trusted. Rebbi Abun bar Cahana said, also for oaths it is the same. What is the meaning of “also for oaths it is the same”? Rebbi Abbahu in the name of Rebbi Joḥanan: If he swears on his own initiative, he is trusted when he says, I swore. But from the orders of others, he cannot be trusted.
HALAKHAH: “About the following one does not swear,” etc. If he transgressed and swore, Rebbi Joḥanan said he brings a sacrifice for the oath; Rebbi Eleazar says, he does not bring. Rebbi Abun bar Ḥiyya said, so does Rebbi Johanan answer Rebbi Eleazar. No. If you pronounced about an oath about testimony which may apply to slaves, documents, and real estate, what can you say about oaths concerning deposits which do not apply to slaves, documents, and real estate? But an oath for testimony is not in court. Would the court admit an oath of a suspect person? Only when he transgressed and swore, you say that he brings a sacrifice for his oath; here also if he transgressed and swore, you say that he brings a sacrifice for his oath.
Rebbi Abin said, since the householder has many occupations they instituted that the journeyman should swear and collect. [Rebbi Yose ben Rebbi Abun said, there they instituted that the journeyman should swear and collect;] similarly they instituted for the householder that if its deadline had elapsed, he cannot swear and collect. Rebbi Ḥiyya stated, if there are witnesses that he claimed it in time, he swears and collects even after a year. Rebbi Yose said, he has only that single day. Rebbi Jonah said, Rebbi Yose ben Rebbi Ḥanina and Rebbi Simeon ben Laqish disagreed. One said, if he claimed from him during daytime, he has only that day; if in the night he has only that night. But the other said, if he claimed from him and he said, I gave. But if he said, I shall give, the presumption is that he gave. We do not know who said what. Since Rebbi Ḥama bar Uqba said in the name of Rebbi Simeon ben Laqish: if he claimed from him during daytime, he has only that day; if in the night he has only that night, therefore Rebbi Yose ben Rebbi Ḥanina is the one who said, if he claimed from him and he said, I gave. But if he said, I shall give, the presumption is that he gave. Rebbi Mana said, sometimes he claims after its time and it is considered as in time. How is this? He claimed from him and he said to him, did I not say to you that I gave at that date? That date becomes as if it were yesterday; one gives him one measure.
“Similarly, the orphans can collect only by an oath;” etc. Rebbi Joḥanan in the name of Rebbi Yannai: One pays from an orphan’s property only if interest is due; Rebbi Nathan says, also a woman’s ketubah. Rebbi Mana said, because of her sustenance. Rebbi Mattania said, who is worried about sustenance? Rebbi Simeon! Since Rebbi Simeon said, all depends on the female. What about it? For attraction, that everybody should jump to marry her. Rebbi Nathan said, also for robbery and torts. Rebbi Yose said, we stated both of these. Robbery from the following: “If it was mortgageable, he has to pay.” For torts from the following: “One pays from minor orphans’ property only from the least valuable.” So is the Mishnah: One pays for torts from minor orphans’ property only from the least valuable. But was it not stated, the son shall stand in the father’s place; one estimates torts from the most valuable land, creditors from average quality, and a woman’s ketubah from the least valuable? Rebbi Yose ben Rebbi Abun said, explain it as everybody’s opinion about testamentary dispositions.
HALAKHAH: “There are four kinds of keepers,” etc. Rebbi Joḥanan said, there are four kinds of keepers and they become liable only through acquisition. Rebbi Jacob bar Aḥa in the name of Rebbi Eleazar: Also in matters of robbery they become liable only through acquisition. Rebbi Yose ben Rebbi Bun said, a baraita said so: “one who contracts with another for a field,” etc. Rebbi Ḥananiah said, Rebbi Abun, also in theft cases they become liable only through acquisition. Rebbi Ḥananiah in the name of Rebbi Phineas, our Mishnah said so: “If he was pulling it to lead it out but it died on the owner’s property, he is not liable. If he lifted it or had it led outside the owner’s property when it died, he is liable.” If he lifted it inside the owner’s property it is as if he had taken it out of the entire property of the owner. If he was pulling it and it left, only after it left the entire property of the owner. Rebbi Abbahu in the name of Rebbi Joḥanan: If it was standing at his feeding trough. Rebbi Abun bar Ḥiyya asked: If it was standing at his feeding trough then even if he did not pull it! But we must deal with the case that it was standing in the public domain. Does Rebbi Abun bar Ḥiyya follow the House of Shammai, since the House of Shammai say, “he shall be hit by less or more”? How do we hold? If it was standing in the public domain and he intended to rustle it when it died, according to everybody he became liable by that intention. If he did not start to pull it, according to everybody he is not liable. But we most hold that it was standing at a feeding trough on his property. As Rebbi Abun bar Ḥiyya said, following the House of Shammai. Rebbi Abun said, there he acquired without the knowledge of its owner; but here when he acquires with the knowledge of its owner.
Rav said, Adam, the first man, instituted Calendas. When he saw that the night was getting longer, he said, woe to me, maybe this is what is written for, he shall smite your head, you will sneak to his heel, maybe it will come to bite me. I said, but darkness will smite me. When he saw that days were getting longer, he said calendas, καλόνdies. This follows him who said that the world was created in Tishre. But following him who said that the world was created in Nisan, he would have known. Rebbi Yose ben Rebbi Abun said, who thinks that the world was created in Tishre? Rav! As we have stated in the composition for shofar blowing from the House of Rav: “This is the day of the beginning of Your works, a remembrance of the first day.” This implies that the world was created on New Year’s Day.
“Cratesis.” The day when Rome took hold of the Empire. Was this not stated already? Rebbi Yose ben Rebbi Abun said, for the second time. Rebbi Levi said, on the day when Solomon married the daughter of Pharao Necho, the king of Egypt, Michael descended and put a stick into the Sea which attracted debris and formed a forest; that is the great fortification in Rome. On the day when Jeroboam put up two golden calves, Remus and Romulus built two sheds in Rome. On the day Eliahu disappeared a king was installed at Rome; a king, there is no king appointed in Edom.
Rebbi Ḥiyya bar Abba sent to buy sandals for himself at the fair of Tyre. Rebbi Jacob bar Aḥa said to him, are you a buyer at fairs? He answered him, did you never buy a loaf of bread? He said to him, there is a difference, since Rebbi Joḥanan said, they did not forbid the necessities of life. Rebbi Simeon ben Joḥanan sent to ask Rebbi Simeon ben Josadaq, did you not check out the nature of the fair at Tyre? He told him, yes. He gave two pounds of peppers to an איסקרנדה. He went and found an inscription there, “I, King Diocletian, settled this fair at Tyre to the genius of my brother Heraklius, eight days.” Rebbi Isaac bar Naḥman asked Rebbi Ḥanina: What is the nature of the fair at Gaza? He said to him, did you ever go to Tyre and see a Jew and a Gentile sharing a pot, and he does not worry that the Gentile pour something into the pot? This is difficult. He asked him; what did he answer him? But since Rebbi Ḥanina never said something that he had not heard, for that reason when he asked him this he responded with that. Rebbi Yose ben Rebbi Abun came, Abba bar bar Ḥana in the name of Rebbi Joḥanan: They forbade only the fair at Botnah, as it was stated thus: There are three fairs, the fair at Gaza, the fair at Acco, the fair at Botnah. The clearest of them is the fair at Botnah.
We have stated, “a white cock.” Rebbi Ḥiyya stated unspecified “a cock.” Our Mishnah needs the baraita of Rebbi Ḥiyya and the baraita of Rebbi Ḥiyya needs our Mishnah. If we had stated but Rebbi Ḥiyya had not stated, we would have said, only a white cock but an unspecified cock would be permitted even alone. Therefore the baraita of Rebbi Ḥiyya is needed. Or if Rebbi Ḥiyya had stated but we had not stated, we would have said, this is only for an unspecified cock, but a white cock even among chickens is forbidden. Therefore our Mishnah is necessary and the baraita of Rebbi Ḥiyya is necessary. “A chicken to sell,” one may sell him a white cock. “A white cock to sell,” we say by itself it is forbidden, among chickens it is permitted. Rebbi Abun bar Ḥiyya asked: If one saw chickens grazing on a garbage heap and a white cock among them and said, whose is it? Is it as if he specified?
If he transgressed and sold one fines him. Just as one fines for practice so one fines for custom. From where that one fines for custom? A person sold his camel to an Aramean. The case came before Rebbi Simeon ben Laqish who fined him double to make him take back the camel. Rebbi Yose ben Rebbi Abun said, they fined the broker and called him son who brokers to Arameans. Does Rebbi Simeon ben Laqish follow Rebbi Jehudah? As it was stated in the name of Rebbi Jehuda: “If somebody buys an animal from a Gentile and it gave birth to a firstling, he buys it up to its worth and gives half of its worth to a Cohen. If it was given to him as contractor, he has to pay for up to ten times its worth and gives all of its worth to the Cohen. But the Sages say, since the finger of the Gentile in involved it is no longer liable as firstling.” Rebbi Simeon ben Laqish is more than Rebbi Jehudah. What Rebbi Jehudah said because of the practice of firstlings; but what Rebbi Simeon ben Laqish said because of practice regarding a large animal.
“Ben Bathyra permits horses.” Ben Bathyra said this only about a male horse because it kills its owner in war. Some say, because it runs after females, and some say, because it stands still to urinate. What is between them? A gelding. He who says because it runs after females, it does not run. He who says because it stands still to urinate, this one also stands still to urinate. [Rebbi Aḥa in the name of] Rebbi Tanḥum bar Ḥiyya: If it gets old he binds it to the grindstone. Rebbi Yose ben Rebbi Abun in the name of Rebbi Huna: Ben Bathyra and Rebbi Nathan both said the same, as it was stated: “If he carried out domestic animals, wild animals, or birds, whether alive or dead, he is liable. Rebbi Nathan says, dead he is liable, alive he is not liable.” The rabbis hold that he is liable for a purification sacrifice and they answer him so? They answer following his own argument. Following your argument, since you are saying because of rabbinic Sabbath prohibition, also we hold that if it gets old he binds it to the grindstone. Rebbi says, I am saying that it is forbidden for two reasons, as a weapon and as a large animal. It was stated so: A large wild animal is like a (small) [large] domestic animal. Who stated this? Rebbi. The words of the Sages: Rebbi Bisna, Rebbi Ḥanan bar Abba in the name of Rav: A wild animal is like a (large) [small] domestic animal.
HALAKHAH: “One does not sell to them anything connected to the ground,” etc. Rebbi Abun bar Ḥiyya asked: Is there also a disagreement about large cattle? May one sell for the purpose of slaughter? It was found stated: Also large cattle is in dispute; Rebbi Jehudah says, he may sell for the purpose of slaughtering.
HALAKHAH: “One does not lease houses to them,” etc. Rebbi Ze‘ira in the name of Rebbi Yose ben Ḥanina, Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan: לֹא תְחָנֵּֽם do credit them with charm; לֹא תְחָנֵּֽם do not give them free gifts; לֹא תְחָנֵּֽם do not give them encampment in the Land. But did we not state, “Rebbi Yose says, also in the Land of Israel one leases houses to them”? A house is not a source of blessing; a field is a source of blessing. Rebbi Yose ben Rebbi Abun instructed that it is forbidden to let them lease a grave in the Land of Israel because of “do not give them encampment in the Land.”
“A Jewish woman should not be a midwife for a Non-Jew, for she brings a son to pagan worship; but a Non-Jew may be a midwife for a Jewish woman.” It was stated so: From the outside but not the inside. She should not put her hand inside not to squish the fetus in her innards, and she should not give her a cup of root-extract to drink. If she was a medical doctor? This will come as what Rebbi Jacob bar Aḥa said in the name of Rebbi Joḥanan: If he was a professional healer it is permitted. And here, if she was a medical doctor it is permitted. [Rebbi Yose bar Abun, these questions … [doc]tor permitted.]
Rebbi Ḥanina said, (this means) [a baraita implies] that one does not heal through spilling blood, as we have stated there: “If most of his body was outside one does not touch him,” we suspect that he will live, “for one does not push aside one life before another life.” Not only if one would say, kill this person, but even if he tell him, injure that person. A Gentile against a Gentile, a Gentile against a Jew, is liable. A Jew against a Gentile is not liable. Rav Ḥisda asked, may one save the life of an adult with the life of a minor? Rebbi Jeremiah objected, did we not state, “If most of his body was outside one does not touch him, for one does not push aside one life before another life”? Rebbi Yose ben Rebbi Abun in the name of Rebbi Levi: There it is different for it is not known who is endangering whom.
A convert was a barber and astrologer. He saw in his astrology that Jews were spilling his blood. This only referred to his circumcision but when a Jew came to him to get a haircut, he killed him. How many did he kill? Rebbi Eleazar ben Rebbi Yose said eighty. Rebbi Yose ben Rebbi Abun said three hundred. At the end they prayed about him and he returned to his origin.
HALAKHAH: “The following Gentile properties are forbidden,” etc. Rebbi Isaac bar Naḥman in the name of Rebbi Joshua ben Levi: Bitter, sweet, and hot are not under the rules of being uncovered. Rebbi Simon in the name of Rebbi Joshua ben Levi: The hot, the bitter, and the sweet are not under the rules of being uncovered or under those of libation wine. Rebbi Simon explains: The hot, spice wine. The bitter, vermouth wine. And the sweet, cooked wine. Rebbi Joshua ben Zeidal had cooked wine which was left unsupervised in the custudy of a Gentile. He asked Rebbi Yannai ben Rebbi Ismael who said to him, so says Rebbi Simeon ben Laqish: The sweet is not under the rules of being uncovered or under those of libation wine. Rebbi Yannai ben Rebbi Ismael fell ill. Rebbi Ze`ira, Rebbi (Joshua) [Hoshaia], Rebbi Abun bar Cahana, and Rebbi Ḥanianiah the colleague of the rabbis, went to visit him. They saw Rebbi Joshua ben Zeidal sitting there. They said, there is the master of the decision and the person of the happening, let us ask him. He said to them, so says Rebbi Simeon ben Laqish, the sweet is not under the rules of being uncovered or under those of libation wine. One said to him, maybe that of Rebbi Simeon ben Laqish is for argument’s sake? He told them, it is for action and you can rely on it. When (they got up) [returned], Rebbi Ila was standing with Rebbi Abun bar Cahana and told him, if you did not prefer decisions, is this not a baraita? As Rebbi Ḥiyya stated, “why is cooked wine of Gentiles forbidden? Because it started out as wine.” Rebbi Yose said, the Mishnah says so, “wine and vinegar which originally was wine.”

Rebbi Ḥiyya bar Abba in the name of Rebbi Joḥanan: At first they were saying, one curdles neither with the stomach content of the carcass nor with the stomach contents of the Gentile. They changed to say, one curdles with the stomach content of the carcass but not with the stomach contents of the Gentile. Rebbi Abba bar Zavda, Rebbi Samuel bar Rav Isaac asked: Does this negate the declaration of Rebbi Eliezer, since Rebbi Eliezer said, the thoughts of the Non-Jew are about pagan worship? Rebbi (Assi) [Yasa] came in the name of Rebbi Joḥanan: Originally, they said, one does curdle [neither] with carcass stomach contents nor with Gentile’s stomach contents. They changed to say, one does curdle with carcass stomach contents and with Gentile’s stomach contents. The language of a baraita supports Rebbi Ḥiyya bar Abba: Stomach contents of a Gentile or a carcass is forbidden following the original teaching. (The stomach contents of a torn animal which suckled from a qualified one are permitted following the later teaching; the stomach contents of a qualified animal which suckled from a torn one are forbidden following the later teaching.) [The stomach contents of a qualified animal which suckled from a torn one are forbidden following the former teaching, and the stomach contents of a torn animal which suckled from a qualified one are permitted following the later teaching.] And even if the House of Shammai would argue like the House of Hillel in the first teaching, an egg is a growth of its body; the contents of the stomach come from the outside. It parallels what Rebbi Yose ben Rebbi Abun said in the name of Rebbi Joḥanan: It happened to the son[s] of (Rebbi) Jehudah ben Shamua that wolves tore more than 300 of their flock. The case came before the Sages who permitted their stomach contents. They said, an egg is a growth of its body; the contents of the stomach come from the outside.
They said before the Elder Rebbi Ḥiyya: Rebbi Simeon ben Ioḥai stated thus: Food you shall buy from them with money and eat, etc. As water is not changed from its natural state, so anything which was not changed from its natural state. They objected: Are there not their dry beans, פנקריסין and קובטיות, roasted grain, and hot water permitted? One understands all of these because they can be soaked and return to their former state. But roasted grain? Rebbi Yose ben Rebbi Abun in the name of Rav: Any food which can be eaten alone raw is not in the category of Gentile cooking. (With bread it is in the category of Gentile cooking.) How does Rebbi Ḥiyya explain food you shall buy from them? You shall buy with food. If you fed him you bought him. If he causes you trouble buy him with food or otherwise trade (ply him) with him money. They said, that is what Rebbi Jonathan did. When a superior came to [his] town, he sent him an honor gift, that if a suit involving an orphan or a widow came he would have a way to mollify him.
Their roasted egg, Bar Qappara permitted, Ḥizqiah forbade. So far if it was roasted intentionally. If it was roasted unintentionally? Let us hear from the following: There was a fire in an under-growth of reeds and a swamp of date palms where there were locusts which were roasted. The case came before Rebbi Mana, who forbade them. Rebbi Abbahu said, because of admixture of impure locusts. Rebbi Yose ben Rebbi Abun said, and this is of the stringencies of Rav. Rav returned there and saw them taking things lightly and was restrictive with them. A man was carrying meat while walking on the market. There came a vulture, seized it from his hand, and it dropped off under him. He went and wanted to sell it. Rav told him, it is forbidden to you, for I am saying that it was carrying carcass meat, dropped it and took the other instead. A man went to wash a piece of meat in the river. He forgot it and left. Then he went and wanted to sell it. Rav told him, it is forbidden to you, for I am saying the other one was carried away by the river and it brought another piece of carcass meat in its place.
What is the status of their lupines? Rebbi forbids, Ganiba permits. Rebbi said, I am an Elder and he is an Elder. It came to my mind to forbid; it was his opinion to permit. Rebbi Mana bar Tanḥum went to Tyre and permitted their lupines. Rebbi Ḥiyya bar Abba went to Tyre and found that Rebbi Mana had permitted their lupines. He returned to Rebbi Joḥanan who asked him, what case came to your hands? He told him, I found that Rebbi Mana had permitted their lupines. He asked him, did you not hit him? He answered, he is an important personality and knows how to sweeten the waters of the Great Sea. He told him, no, my son. He knows how to compute the waters; when the waters come together to acclaim their Creator they sweeten themselves. Rebbi Isaac bar Eleazar said, he starts to speak his disgrace and tells his praise! Rebbi Yose ben Rebbi Abun said, it is a difficult computation; Rebbi Zakkai of Alexandria knows it. He said, if you want, you may learn it from him.
Ḥawarnas is not forbidden because of Gentile cooking and one may use it for eruv tavšilin. Martisa is not forbidden because of Gentile cooking and one may use it for eruv tavšilin. Rebbi Yose ben Rebbi Abun in the name of Rav: Any food which can be eaten alone raw is not in the category of Gentile cooking and one may use it for eruv tavšilin.
What is alec? Rav said, soltanit. Rebbi Joḥanan said, alec and cut-up triton follow the same rules. Rebbi Ze`ira, Cahana bar Taḥlifa, Ḥanan bar Abba in the name of Rav: Its mucus is forbidden because of admixture from prohibited fish. Rebbi Abba in the name of Rav Jehudah: This you say at a place were water is not running. But in running water no impure fish associates with pure fish. The Sea of Genezareth is similar to running water. Rebbi Yose ben Rebbi Abun said, only at times when the fish bites. Samuel said, ḥafitha one judges according to its shell. If it produces mucus it is permitted, otherwise forbidden.
Where do we hold? If it is certain that they are worshipped, even the contemptible ones are forbidden. If it is certain that they are not worshipped, even the honored ones are permitted. But we must deal with the indeterminate case. Rebbi Crispus said, those cups belong to the contemptible category, for Rebbi Ḥiyya bar Abba had a pitcher and the (worth) [fortune] of Rome was pictured on it. He came to ask Rebbi Joḥanan who told him, since water swims on top of it, it is a contemptible one. A drinking cup is contemptible since one immerses it in water. In the days of Rebbi Joḥanan they started painting on walls and he did not protest against it. [In the days of Rebbi Abun they started depicting by mosaics and he did not protest against it.]
Rebbi Abun bar Ḥiyya said, even his fine flour becomes forbidden and another person’s is permitted. Is this following him who said, whether it was his or another person’s, it is forbidden; did he say that they do not disagree about something which is not alive and Rebbi Abun bar Ḥiyya comes to tell you that the baraita refers to living things? If they disagree about something which is not alive; therefore a living thing is forbidden. Then something which is not alive should be forbidden a fortiori. This is that you should not say as you say there, anything living while it cannot become forbidden for a private person it becomes forbidden for Heaven, so similarly anything which is not yours even though it cannot become forbidden for a private person it becomes forbidden for Heaven

HALAKHAH: “If one’s house was connected to a house of pagan worship,” etc. There is written abomination about the menstruating women, abomination about vermin, abomination about idolatry. About the menstruating woman, for anybody who would commit any of these abominations. About vermin, do not eat any abomination. About idolatry, and do not bring any abomination into your house. But I do not know for which purpose it was compared. Rebbi Aqiba says, it was compared to abomination regarding the menstruating woman. As the menstruating woman imparts impurity by load, also idolatry imparts impurity by load. Or since the menstruating woman imparts impurity through a cover stone, does idolatry impart impurity through a cover stone? Rebbi Zeriqa in the name of Rebbi Ḥanina, but some say in the name of Rav Ḥisda: Rebbi Aqiba agrees with the Sages that idolatry does not impart impurity through a cover stone. But the rabbis say it was compared to abominations of vermin. As vermin imparts impurity by motion, so also idolatry imparts impurity by motion. Or as vermin in the size of a lentil imparts impurity does also idolatry in the size of a lentil impart impurity? Rebbi Zeˋira, Rebbi Isaac bar Naḥman, Rebbi Eleazar, Rebbi Abbahu in the name of Rebbi Joḥanan: They were yoked to Baal Peor and ate sacrifices to the dead. As the dead in the size of an olive impart impurity so idolatry in the size of an olive imparts impurity. Or since a corpse imparts impurity once a person puts his finger tips in, could I think that idolatry imparts once a person puts his finger tips in? Tearing down, tearing down one infers from the leprous house. Since in a leprous house when he entered with his head and most of his body, so idolatry when he entered with his head and most of his body. Rebbi Ḥanina said, this means that the impurity of idolatry is not consistent. For otherwise, why does one compare if for the facile [impurity] and does not compare for the strict? Rebbi Mana said, it is consistent. Why was it compared to a corpse and to vermin? To inform in both cases about the facile [impurity] attached to it. This is for a broken idol. But an entire one even in the most minute size, as Rebbi Yose hen Rebbi Abun said, Rav Ḥama bar Gorion in the name of Rav: Baal was the penis gland in the form of a bean. What is the reason? They selected the Baal of circumcision as god.
Rebbi Joḥanan said to Bar Drosai, go down and break all those statues in the public baths. He went down and broke them all except one. Why this? Rebbi Yose ben Rebbi Abun said, because another Jew was suspected of burning incense for it.
It is written, do not make idols for yourselves, statue and stele you shall not erect for yourselves. Is not making the same as erecting? Rebbi Hila said, making is from new; erecting, if it falls down one shall not re-erect it. It is written, you shall tear down their altars and break their steles. From where to apply one to the other? Rebbi Abun bar Ḥiyya said, it was said to refer to both sides; either breaking, or cutting down, or tearing down for each of them.
HALAKHAH: “One may buy a used wine-press,” etc. Rebbi Ḥanin stated: Only if the Jew did not turn his eyes away from him. But if he turned his eyes away from him, not then. So far if he was taking juice and grapes together to put on the heap. If he gave these and those separately, (even from what was left in the fissures, what is under the bunches is forbidden, on the sides is permitted.) Rebbi Yose ben Rebbi Abun in the name of Rebbi Joḥanan: Itself it becomes libation wine.
As we have stated. “Everything that can be smelled is forbidden, whether it improves or spoils, the words of Rebbi Meїr. But the Sages say, if it improves it is forbidden, if it spoils it is permitted,” as for example vinegar which fell into broken beans. Rebbi Yasa in the name of Rebbi Joḥanan: It is Rebbi Meïr’s, as we have stated there: “If barley grains fell into a cistern of water, even though they made it stink, [the water] is permitted.” About this Mishnah, Rebbi Meïr says it is in dispute, Rebbi Joḥanan and Rebbi Simeon ben Laqish: everybody’s opinion. Rebbi Yose ben Rebbi Abun said this tradition so: In the opinion of Rebbi Meïr it is in dispute, in the opinions of Rebbi Joḥanan and Rebbi Simeon ben Laqish it is everybody’s opinion.
HALAKHAH: “If somebody sold his wine to a Non-Jew,” etc. Rebbi Abba, Rav Huna in the name of Rav: One who handles a wine-skin and it splits in his hand is not responsible for it. Rebbi Yose ben Rebbi Abun said, it is necessary even if he takes it in the store when he has no other intention than that no other person should take it. Can he take possession at a minimal rate? Rebbi Ḥaggai said before Rebbi Yose, a Mishnah says that it cannot become his possession at a minimal rate, as we have stated there: “If somebody sells his wine to a Non-Jew, in case he fixed the price before that one measured, the proceeds are permitted; if that one measured before he fixed the price, the proceeds are forbidden.” If you say that it can come into his possession at a minimal price, even if he measured before he fixed the price should be as if he fixed the price before he measured and the proceeds would be permitted.
Ḥizqiah said, if somebody mixed a cup from forbidden and from permitted [wine], if the forbidden fell in [last] it makes it forbidden, permitted [last] makes it permitted. Rebbi Samuel [bar Rav Isaac] said, this follows Rebbi Eliezer, as Rebbi Eliezer said, I am going after the last one. Rebbi Jeremiah said, this is a stringency about libation wine. Rebbi Yose asked, if it were a stringency about libation wine, even if the permitted fell in last it should be forbidden! Rebbi Assi in the name of Rebbi Joḥanan: if somebody mixed a cup from forbidden and from permitted [wine], one considers the permitted as nonexistent; if the forbidden does impart taste it is forbidden, otherwise permitted. Rebbi Hoshaia said, only if the permitted fell in last. Rebbi Immi in the name of Rebbi Joḥanan, it does not make any difference whether the forbidden fell in first and the permitted last or the permitted first and the forbidden last, even water and wine, even if it was mixed perfectly from permitted, one considers the permitted as nonexistent; if the forbidden does impart taste it is forbidden, otherwise permitted. Rebbi Ze`ira said, this has been said about the preceding; how can it be? Rebbi Yose ben Rebbi Abun, Rebbi Abbahu in the name of Rebbi Joḥanan, if a flask of libation wine fell into an amphora of (water) and then it fell into a water cistern, one considers the permitted as nonexistent; if the forbidden does impart taste it is forbidden, otherwise permitted.
Why did we not state carcasses with them? Rebbi Yose ben Rebbi Abun said, it did state only things forbidden for usufruct. Carcass meat is permitted for usufruct. They objected, is there not leavened matter on Passover? Leavened matter makes liable to extirpation, but for these there is no extirpation.
HALAKHAH: “A wine press of stone which a Gentile had pitched,” etc. Our Mishnah is Rebbi’s. “One of wood, Rebbi said he shall wipe it dry but the Sages say he must remove the pitch.” For pottery it is not following Rebbi, as it was stated: A Gentile’s wine-press, bucket, and funnel, Rebbi permits but the Sa (say). Rebbi agrees that pitchers are forbidden. Why are these forbidden and those permitted? These one fills with it, the others one does not fill with it. Rebbi Yose in the name of Rebbi Joḥanan: practice follows Rebbi. If a Gentile pitched a papyrus vessel. Rebbi Yose ben Rebbi Abun in the name of Samuel, practice follows Rebbi. It is the disagreement of Rebbi and the Sages, as we have stated: “If somebody’s wine-press was impure and he wants to purify it, the brooms, the planks, and the lentil one rubs dry and they are pure. The wicker-work of wood splinters, or of hemp, or of wood, or of bark, of threads, of bast, one lets age a full twelve months; Rabban Simeon ben Gamliel said, from one olive pressing to the next, from one wine pressing to the next. Rabban Simeon ben Gamliel said, if he wants to purify it immediately, he puts it for a period in a pipe where water streams, or in a brook whose water flows. Just as one wipes dry for purity so one wipes dry for libation wine.” How much is a period? Rebbi Yose in the name of Rebbi Joḥanan, half a day or half a night. Rebbi Ḥiyya stated, either a day or a night. Do they disagree? But one when day and night are equal, the other when day and night are unequal.
Rebbi Yose ben Rebbi Abun in the name of Rav: If somebody gives a loan to a person on condition that the Sabbatical not remit it, the Sabbatical does not remit it, as we have stated: “to return them after ten years instead of returning them after thirty days”. Are there ten years without a Sabbatical? Rebbi Huna said, Rav Naḥman and Rav Sheshet disagreed. One of them said, if the loan was given on a pledge; but the other said, if he writes him a prozbul.
HALAKHAH: “Witnesses become plotters,” etc. Rebbi Abba bar Mamal: Only if he was killed. But not if he was not killed. That is what we have stated: “Only the first group is executed.” Rebbi Abun bar Ḥiyya asked before Rebbi Zeˋira: If they were standing, testifying that he killed a person in Lydda. Others came and told them, how can you testify since you were with us in Caesarea on the fifth of the month? Then others came and told them, how can you testify since you were with us in Sepphoris on the tenth of the month? The murderer cannot be executed since possibly they are plotting witnesses. The witnesses cannot be executed since possibly they are telling the truth.
“Whose sentence was passed,” etc. If somebody wrote all his property over to two persons in one document and the testimony of the witnesses was valid for one but invalid for the other. Rebbi Hila said, Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed; one said, since it is invalid for one it is invalid for the other, but the other said, it is valid for one and invalid for the other. Rebbi Mana did not specify; Rebbi Abun specified: Rebbi Joḥanan said, since it is invalid for one it is invalid for the other; but Rebbi Simeon ben Laqish said, it is valid for one and invalid for the other. Rebbi Eleazar said, the Mishnah supports Rebbi Joḥanan: “Since the testimony of two [witnesses] is invalid if one of them is found to be a relative or a disqualified person, the same holds for three if one of them is found to be a relative or a disqualified person. From where even for a hundred? The verse says, witnesses.” Rebbi Jacob bar Aḥa said, Rebbi Ḥanina the colleague of the rabbis and the rabbis disagree. One says, the argument of Rebbi Eleazar is correct, but the other says, the argument of Rebbi Eleazar is not correct. For him who says, the argument of Rebbi Eleazar is correct, it is a single testimony and a single warning, and any testimony which is partially disqualified is totally disqualified. For him who says, the argument of Rebbi Eleazar is not correct, it is as if two groups of witnesses came, valid for one and invalid for the other.
HALAKHAH: “If one threw a stone,” etc. Rebbi Eliezer ben Jacob stated, it found. That he should have been there at the moment he killed him. But is there permission to throw the stone into the public domain? Rebbi Yose ben Abun said, explain it if his wall was inclined.
[“If sentence had been passed when the High Priest died, he is not exiled.”] It was stated: “Rebbi Eliezer ben Jacob says, ‘refuge, refuge’ was written at crossroads, so that the homicide might see what was written and continue.” Rebbi Abun said, a sign-post was directing them. Rebbi Phineas said, good and straightforward. Why is He good? Because He is straightforward. And why is He straightforward? Because He is good. Therefore, He teaches the way to the sinners. He instructs in the way of repentance. They asked Wisdom, what is the punishment of the sinner? She told them, evil will pursue sinners. They asked Prophecy, what is the punishment of the sinner? She told them, the sinning soul is the one which will die. They asked the Holy One, praise to Him, what is the punishment of the sinner? He said to them, let him repent and it will be atoned for him. That is what is written, therefore, He teaches the way to the sinners, the way to repentance. It is written: Like a bird to move, like a swallow to fly, so is a man moving from his place.
If somebody had selected his purification sacrifice when he became a deaf-mute, or insane, or an apostate, or the Court rules that fat may be eaten, Rebbi Joḥanan said, his sacrifice of purification is pushed aside, Rebbi Simeon ben Laqish said, his sacrifice of purification is not pushed aside. Rebbi Yose ben Rebbi Abun said, Rebbi Aḥa switches traditions, to avoid that a word of Rebbi Joḥanan contradict his own word. For Rebbi Simeon bar Abba said in the name of Rebbi Joḥanan: One sprinkles the blood of a purification sacrifice or a reparation sacrifice for a person [terminally ill]. The Rebbi of Caesarea said, Rebbi Ḥiyya and [Rebbi] Immi, [one] switches and one says like [this] Tanna.
In Rebbi Aqiba’s opinion it remains a doubt. Rebbi Abun bar Ḥiyya said, if he stands between two domains, between two domains of the Land of Israel and domains of the Land of Israel.
Rebbi Immi in the name of Rebbi Simeon ben Laqish. For instructions they considered the settlement of the Land of Israel. For impurity they considered the majority of those coming to the Temple precinct. How? Do they estimate every group or only the first group? Rebbi Yose ben Rebbi Abun said, when they are still outside they estimate themselves. Rebbi Joshua ben Levi: For appearance they consider from Levo- Ḥamat to the brook of Egypt. Rebbi Tanḥuma in the name of Rebbi Ḥuna: The reason of Rebbi Joshua ben Levi is, at that time Solomon celebrated the holiday, and all of Israel, etc.
But would you not have eliminated the entire notion of one who watches a day for the next day? If they said, the night is permitted but the day is forbidden. Would you not have eliminated the entire notion of bending? Samuel bar Abba said, if they said, one cubit is permitted but two are forbidden. Would you not have eliminated the entire notion of prostrating? If they said, it is permitted to prostrate oneself but forbidden to sink down. Would you not have eliminated the entire notion of taking out? Rebbi Samuel ben Rav Isaac said, if they said, one dried fig is permitted but two dried figs are forbidden. This follows him who said that bringing in and taking out are the same. But for him who said that bringing in and taking out are two notions, would you not have eliminated the entire notion of bringing in? Rebbi Yose said, not that they said that it was permitted to eat fat; they knew that it is forbidden to eat fat, but the Torah gave permission to the Court to instruct. Rebbi Abun bar Ḥiyya asked, the [amount of] an olive today and of two olives tomorrow? What about a prophet and seducer? I could think that if they said to you, do not put on phylacteries today, put them on tomorrow, that you should listen to them. The verse says, to walk in them, in all of them, not only in part of them; you would have eliminated the notion of that entire day. You can say that this is not elimination of the entire subject. And here it is not elimination of the entire subject. Rebbi Mana understood it from the following; Samuel bar Abba said, if they said, one cubit is permitted but two are forbidden. You can say that this is not elimination of the entire subject. And here it is not elimination of the entire subject.
HALAKHAH: “If the Court ruled and all the public acted,” etc. Who stated “a majority”? Rebbi Meïr, as it was stated: Either half of the tribes or half of each tribe, if only it be a majority. Rebbi Jehudah says, half of each tribe, but only a majority of entire tribes. One tribe drags all tribes. Rebbi Meïr says, all tribes are called “the public”. Rebbi Jehudah says, each single tribe is called “public”. And Rebbi Simeon follows Rebbi Jehudah. Just as Rebbi Jehudah said, each single tribe is called “public”, so Rebbi Simeon says, each single tribe is called “public”. What is between them? Dragging. Rebbi Jehudah says, one tribe drags all tribes. Rebbi Simeon says, one tribe does not drag all tribes. [Even though Rebbi Jehudah says, one tribe drags all tribes,] he agrees that only if the ruling came from the ashlar hall. Rebbi Yose said, the reason of that Tanna: From this place which the Eternal will choose. Rebbi Abun in the name of Rebbi Bejamin ben Levi: The verse supports him who said that each tribe is called “public”, as it is written: A people and a public of peoples will come from you, and Benjamin was not yet born. Rebbi Ḥiyya bar Abba said, just as they differ here, so they differ about impurity, as we have stated: If the public was half pure and half impure; pure [people] celebrate the first [Passover] and impure the second. Rebbi Jehudah said, the pure ones celebrate for themselves, and the impure ones celebrate for themselves. They told him, there is no split Passover; either all celebrate in impurity or all celebrate in purity. Who is “they told him”? Following Rebbi Jehudah? As it was stated: “If one of the loaves or one of the (leftovers) [orders] became impure, Rebbi Jehudah said, both have to be brought to be burned for a public offering cannot be split. But the Sages say, the impure in its impurity, and the pure shall be eaten.” Rebbi Yose ben Rebbi Abun said in the name of Rebbi Joḥanan, who is “they told him”? The Sages who argue like Rebbi Jehudah.

The Sages who argue like Rebbi Jehudah.
HALAKHAH: “If the Court ruled and seven tribes acted,” etc. It was stated: Rebbi Simeon ben Eleazar says in his name, if six sinned and they are a majority. Therefore seven even though they do not form a majority are liable. Rebbi Eleazar said, he only said “six and they are a majority”. Therefore for five, even though they are a majority, they are not liable. Rebbi Yose ben Rebbi Abun said, a baraita said so: Half of the tribes on condition that they be most of the population. And similarly, half of the population on condition that they be most of the tribes. Rebbi Yose ben Rebbi Abun said, the question of the Anointed Priest, is it as from the High Court or a lower court?
HALAKHAH: “If the Court ruled and seven tribes acted,” etc. It was stated: Rebbi Simeon ben Eleazar says in his name, if six sinned and they are a majority. And similarly, half of the population on condition that they be most of the tribes. Rebbi Yose ben Rebbi Abun said, the question of the Anointed Priest, is it as from the High Court or a lower court?
Rebbi Zeˋira in the name of Rav Ḥisdai. There, it was stated: “If the Court ruled, and they themselves acted, and they realized what they ruled about. If they erred in what they ruled, would they be liable? The verse says, if the sin became known, not that the sinners became known.” Anyway you take it, if about fat [ they ruled they are liable, if about Sabbath they ruled they are liable. Rebbi Abun bar Ḥiyya said, this follows Rebbi Eliezer; it does not follow Rebbi Joshua. Rebbi Yose said, but] it follows Rebbi Joshua if they ruled and they did not know whether about idolatry or about any other commandment. If about idolatry by a bull, if about any other commandment a goat. Since it is in doubt whether a bull or [a bull and] a goat, it is a difference in sacrifice and he is not liable.
It is written: His bow was sitting immobile. Rebbi Samuel bar Naḥman: his bow was spanned and relaxed. Rebbi Abun said, his semen spread out and came out from under his fingernails, the arms of his hands were excited. Rav Ḥuna in the name of Rav Mattanah, he lifted his eyes, saw the picture of his father, and cooled down immediately, from the hands of the noble Jacob. Rebbi Abin said, he also saw the picture of Rachel, from there the shepherd, the rock of Israel.
So is the Mishnah: “but the Anointed is not liable for the impurity of the Temple and its sancta, everybody’s opinion, and neither is the Prince for hearing a sound, the words of Rebbi Simeon.” Rebbi Joḥanan said, and the Sanctuary he shall not leave, nor desecrate. Therefore, if he left, he would not desecrate. Rebbi Ashian, Rebbi Jonah: Rebbi Abun bar Cahana found a difficulty. Is it not written, a widow, or a divorcee, or a desecrated, a harlot, these he shall not marry, therefore if he married he would not desecrate? What about it? Ḥizqiah said, this person would be extirpated from the community. One whose sacrifice is identical to that of the community. This excludes the Anointed whose sacrifice is not equal to that of the community. They objected, is not also the Prince’s sacrifice not equal to that of the community? It is equal on the day of Atonement. But his brothers the priests are not equal on the day of Atonement! They are equal on the other days of the year. Rebbi Yudan bar Shalom said, they are equal in that the blood is given outside.
HALAKHAH: “An Anointed Priest who sinned,” etc. Halakhah 2:“An Anointed Priest who was removed from his anointed status,” etc. Rebbi Eleazar said, if a High Priest sinned, one whips him but does not remove him from his elevated status. Rebbi Mana said, it is written: For the crown of his God’s ointment is on him, I am the Eternal; if one could compare it, just as I am in My Greatness, so Aaron is in his greatness. Rebbi Abun said, it is written: Holy shall he be for you; if one could compare it, I am in My Sanctity, so Aaron is in his sanctity. Rebbi Ḥanina the scribe, Rebbi Aḥa in the name of Rebbi Simeon ben Laqish: if an Anointed Priest sinned, one whips him in a court of three [judges]. If you would say in a court of 23, his elevation would be his degradation. Rebbi Simeon ben Laqish said, if a patriarch sinned, one whips him in a court of three [judges]. Does one return him? Rebbi Ḥaggai said, better if one did return him, he would kill them. Rebbi Jehudah the Prince heard this and became angry. He sent Goths to catch Rebbi Simeon ben Laqish. He fled to Magdala, some say to Kefar Ḥiţţim. Rebbi Joḥanan went to the assembly hall; Rebbi Jehudah the Prince also went to the assembly hall. He said to him, why is the master not telling us words of instruction? He started clapping with one hand. He asked, does one clap with one? He answered him, no, but without ben Laqish there is nothing. He said, no. He told him, I shall free him. He said to him, in Magdala. He told him, I and you will go out to meet him. Rebbi Joḥanan sent to Rebbi Simeon ben Laqish, prepare for yourself some words of instruction since the Patriarch will go out to meet you. He went out to meet them and said, your example is similar to that of your Creator. For when the Merciful went to liberate Israel from Egypt, He sent neither messenger nor angel but He went Himself, as is written: I shall pass through the Land of Egypt in that night, not only He but all His Court. It is not written in this context “when Power went” but when Powers went. They asked him, why did you say these things? He told them, what are you thinking? That for fear of you I would refrain from the teachings of the Merciful? As Rebbi Samuel ben Rav Isaac said, No my sons, because the reputation is not good, etc., you remove the Eternal’s people, one removes him.
One ate five times the volume of an olive; he separately realized a doubt about each one. Afterwards it became known to him (in court) [as a certainty.] Rebbi Simeon ben Laqish said, the knowledge about his doubt determines his kind of transgression. Rebbi Joḥanan said, the knowledge about his doubt does not determine his kind of transgression. Rebbi Yose bar Abun in the name of Rebbi Samuel bar Rav Isaac: Rebbi Simeon ben Laqish agrees that for the Anointed Priest the knowledge about his doubt does not determine his kind of transgression. What is the reason? Like purification offering, like reparation offering. The knowledge about his doubt determines his kind of transgression for one who brings a suspended reparation offering. The knowledge about his doubt does not determine his kind of transgression for one who does not bring a suspended reparation offering.
Rebbi Isaac asked: Is it the same with the eating of half loaves? Rebbi Yose said, this question of Rebbi Isaac is nothing. (Is it written) [Does] the matter depend on eating half loaves? If one ate the volume of half an olive during the time allotted for this half loaf and another volume of half an olive during the time allotted for that half loaf, is that anything? If one ate the volume of several olives during times allotted for several half-loaves in one oblivion, he is liable only for one [sacrifice]. The rabbis of Caesarea say, instead of comparing it to kinds of fat, why not compare it to [the laws of] Sabbath? If he wove a single thread for one cloth and a single thread for another cloth, is that anything? If he wove several threads for several pieces of cloth in one oblivion, he is liable only for one [sacrifice]. Was there not an obligation for a sacrifice in the meantime, and you say that they are counted together? Rebbi Abun said, there it is about the obligation of a sacrifice; but here [a change] of sacrifice.
If he ate a full olive sized piece but there is doubt whether he ate it on the Day of Atonement or before the Day of Atonement. The atonement atones for the doubt. Whether he ate it on the Day of Atonement or after the Day of Atonement. The colleagues say, atonement atones for the doubt. Rebbi Mattaniah said, the atonement atones only for doubt of the kinds of blood. A Mishnah supports the colleagues: “Sabbath and the Day of Atonement and he worked in twilight.” As you take it, if it was the Day of Atonement, it atoned. If it was weekday, it is permitted. But did we not state “he ate”? Rebbi Yose ben Rebbi Abun said, eating permitted [food].
Does Rebbi Joḥanan agree that if the first one was still in existence it is pushed aside? What should be done with it? Rebbi Yasa said, it is suspended for atonement. Therefore Rebbi Yose ben Rebbi Abun discussed it. If he ate five times the volume of an olive; the first became known to him and he brought a sacrifice. The second, and he brought a sacrifice. The third, and he offered a sacrifice. The fourth, and he offered a sacrifice. The fifth, and he offered a sacrifice. Rebbi Joḥanan said, his sin is atoned for by the first which precedes the eating of all of them; the remainder shall fall to voluntary offerings. Rebbi Simeon ben Laqish said, his sin is atoned for by the last which follows the eating of all of them; the others shall be set aside. Rav Ḥisda and Rav Hamnuna. Rav Ḥisda like Rebbi Joḥanan; Rav Hamnuna like Rebbi Simeon ben Laqish. Rav Ḥisda remarked to Rav Hamnuna, there is a Mishnah which seems to support you and disagrees with me: “If there was awareness in between, just as he brings a purification sacrifice for each single one, so he brings a suspended reparation sacrifice for each single one.” If he had stated the reparation sacrifice and stopped! Rebbi Ḥinena said, even so, for all eventualities you may say so.
A king of Israel and a king of Jehudah are both equal, neither of them is greater than the other. What is the reason? The king of Israel and [Josaphat] the king of Jehudah [were sitting] in the threshing floor. As in a threshing floor. Rebbi Yose ben Rebbi Abun said, but only up to Jehu ben Nimshi. What is the reason? Your descendants in the fourth generation will sit on the throne of Israel. After that they were taking it by robbery.
“The High Priest sacrifices while in deep sorrow but does not eat, the words of Rebbi Meïr; Rebbi Jehudah says, the entire day. Rebbi Simeon says, he completely finishes the service he is engaged in and then leaves.” Between Rebbi Meïr and Rebbi Simeon there is one [difference], between Rebbi Jehudah and Rebbi Simeon there is one [difference]. Between Rebbi Meïr and Rebbi Jehudah is entering. Rebbi Jacob ben Dositheos: interruption is between them. Rebbi Meïr says, if he was inside, he leaves; if he was outside, he does not enter. Rebbi Jehudah says, if he was inside, he (leaves); if he was outside, he does not enter. Rebbi Simeon says, he completely finishes the service he is engaged in and then leaves. Rebbi Yose ben Rebbi Abun in the name of Rav Huna: a baraita is from Rebbi Simeon: “The Sanctuary he shall not leave, he may not leave with them, but he may leave after them. (But they enter and he leaves). If they are unseen he can be seen; he leaves with them up to the city gate, the words of Rebbi Meïr; Rebbi Jehudah said, he does not leave the Temple since it is said: The Sanctuary he shall not leave. If he left, he may not return.”
Rebbi Abbahu in the name of Rebbi Eleazar: “Deep sorrow” is only for the dead, for it is written: Its gates are in deep sorrow and mourning. Rebbi Ḥiyya bar Ada objected: Is it not written: the fishermen are in deep sorrow, mourning are all who throw a fish-hook into the Nile? Rebbi Ḥanina said, so is the baraita: there is no deep sorrow in impurity except for the dead. It was stated: “What is deep sorrow? From the moment of death until the moment of burial, the word of Rebbi. But the Sages say, the entire day.” It turns out that one describes leniencies and stringencies following Rebbi, leniencies and stringencies following the rabbis. What is the difference between them? If someone died and was buried within the hour. Following the rabbis, he is forbidden the entire day; following Rebbi he is forbidden only that hour. If the person died and was buried after three days. Following the rabbis, he is forbidden the entire day; following Rebbi he is forbidden up to three days. There came Rebbi Abbahu in the name of Rebbi Joḥanan, and Rav Ḥisda, both of whom said that Rebbi agrees with the Sages that he is forbidden only during the first day, as it was stated: Rebbi said, you know that deep mourning in the night is not biblical, since they said, “the deep mourner immerses himself and eats his Passover sacrifice in the evening.” But they said, deep mourning during daytime is biblical. Rebbi Yose ben Rebbi Abun in the name of Rebbi Huna: Explain it that the person was buried close to sundown and one cannot infer anything.
What does it help? Rebbi Yose ben Rebbi Abun said, if half of his learning was from one and half of his learning from the other. His father’s lost property if half of his learning was from him and his mother’s lost property if she was divorced from his father, which has precedence? Does his father’s have precedence or only if all his learning was from him? His teacher’s lost property if half of his learning was from him and his mother’s lost property if she was divorced from his father, which has precedence? Does his teacher’s have precedence or only if all his learning was from him? His lost property, and his father’s lost property, and his mother’s lost property, and his teacher’s lost property. His own precedes his father’s, his father’s his mother’s, and his mother’s his teacher’s. Is that not a Mishnah, “the man precedes the woman to be kept alive and to return his lost property”? They wanted to say, if his teacher was not there. He comes to tell you, even if his teacher was there. He, and his mother, and his teacher, and his father, were in captivity. He precedes his mother, his mother his teacher, and his teacher his father. Is that not a Mishnah, “but the woman precedes the man for clothing and to be freed from captivity”? They wanted to say, if his teacher was not there. He comes to tell you, even if his teacher was there.
Who is the teacher who taught him wisdom? The one who taught him first, the words of Rebbi Meïr. Rebbi Jehudah said, the one from whom he received most of his instruction. Rebbi Yose said, anyone who explained a Mishnah to him.” Rebbi Abbahu came in the name of Rebbi Joḥanan: Practice follows him who said, the one from whom he received most of his instruction. Why did he not explain that this follows Rebbi Jehudah? There are Tannaïm who state it switched. Rebbi Eleazar tore his garment for his first teacher. Samuel took off [his phylacteries] for one who had explained a Mishnah to him. What Mishnah did he explain to him? Rebbi Yose ben Rebbi Abun said, “for one key he has to go down to his arm-pit and one opens straight.” What means “for one he has to gown to his arm-pit,” he had to lower his hand under his arm-pit until it could be opened. Rebbi Ḥanania was leaning on Rebbi Ḥiyya bar Abba in Sepphoris, when he saw everybody running. He asked him, why is everybody running? He answered, Rebbi Joḥanan is sitting preaching in Rebbi Banaia’s house of study and everybody is running to hear him. He said, praised be the Merciful Who showed me fruits while I am alive. In Agadah I explained him everything except Proverbs and Ecclesiastes.
“A prophet has precedence over the Anointed for War, the Anointed for War has precedence over the head of the watch, the head of the watch has precedence over the head of a clan, the head of a clan has precedence over the executive officer, the executive officer has precedence over the treasurer, the treasurer has precedence over a common priest, a common priest has precedence over a Levite, a Levite over an Israel (an Israel over a bastard).” Is not the Levite equal [to an Israel]? Rebbi Abun said, this was taught in the days of the podium. Rebbi Abun said, a proselyte and an apostate, the apostate has preference because of what had happened. “Why does everybody run after a proselyte woman, but not after a freedwoman? For the proselyte is presumed to have been guarding herself but the freedwoman is presumed to be irresponsible.” And why does everybody (run after a rat) [inquire after a slave]? Because his dealings are bad for people. Rebbi Joḥanan said, do not believe a slave up to sixteen generations. Ismael ben Netaniah ben Elishama of royal descent came and slew Gedaliahu at Miṣpah.

Rebbi Samuel, son of Rebbi Yose ben Rebbi Abun, preached: A rich man is wise in his own eyes, but an understanding poor man will think little of him. A rich man is wise in his own eyes, this is the master of Talmud. But an understanding poor man will think little of him, that is the master of homiletics. A parable of two people who entered a city, in the hand of one are gold bars, in the other’s hand small change. The holder of the gold bars cannot spend them and survive; the holder of small change can spend it to survive.
