HALAKHAH: What is the reason of the House of Shammai? The fluids on the back of the cup should not become impure from his hands and in their turn defile the cup.
HALAKHAH: The Mishnah deals with a table of marble or one of parts screwed together that cannot become impure. What is the reason of the House of Shammai? That the fluids on the towel should not become impure from the pillow and in turn defile his hands.
What is the reason of the House of Hillel? In case of doubt, fluids and hands are considered pure. Another explanation: “Hands” are not for profane food.
They said that Rebbi Joḥanan was putting in order everything he ate, even red meat, even an egg. His students said to him: Did our teacher not teach us (Deut. 14:22): “You shall certainly tithe all the yield of your field.” He was worried about the fluids in it.
HALAKHAH: In the opinion of this Tanna, they gave a measure for dry produce but not for fluids, they gave a value for fluids but not for dry produce. Rebbi Ḥiyya stated: “A hin is wholesale, less than a hin is retail. A nummus is retail, more than a nummus is wholesale.” In the opinion of that Tanna, they gave a measure for fluids but not for dry produce, they gave a value for dry produce but not for fluids.

What is a stipulation by the Court? That one should fix the First Tithe to the North, Second Tithe to the South, and the heave of the tithe at the extreme North. What is a stipulation by the Court? It is that if the Second Tithe is redeemed, that which is in excess is also redeemed. All this refers to dry produce; for fluids?
It was stated: “Rebbi Illaï says in the name of Rebbi Eliezer: For food in fluids, one gives heave from pure for impure. How is this? If somebody pickled olives in impurity and wants to give heave in purity, he brings a funnel whose opening is less than [the width of] an egg, fills it with eggs and puts it on top of the amphora; it turns out that he gives heave from what is earmarked.” Why does it have to be less than [the width of] an egg? Are these not single pieces? It is only that not many olives should become impure. “ They said to him, the only food fluid called fluid is wine and olive oil.” How is that? One beam for two pits or two beams for one pit. One understands one beam for two pits, but two beams for one pit? Is it not that if it is partially impure it is totally impure? Rebbi La in the name of Rebbi Eleazar: Explain it, if he had intended to process it in one batch, and he changed his mind to make it in two batches. Rebbi Yose ben Rebbi Abun said, this applies if it became impure after he syphoned off [the froth] and [the seeds] formed lumps. But if it became impure before he syphoned off and lumps were formed, it does not apply. Rebbi Tabi, Rebbi Joshia the son of Rebbi Yannai: Practice follows Rebbi Eliezer. Rebbi Isaac bar Naḥman in the name of Rebbi Hoshaia: Practice follows Rebbi Eliezer. Rebbi Ḥuna, Rebbi Ḥanania: Practice does not follow Rebbi Eliezer. Rebbi Yose ben Rebbi Abun in the name of Samuel: Practice does not follow Rebbi Eliezer. There came a case before Rebbi Immi and he did not decide; he said there are two against two. They said to him, but Rebbi Isaac bar Naḥman decided! Nevertheless, he gave no opinion.
MISHNAH: Heave wine that was left uncovered should be poured out, certainly if it was profane. Three kinds of fluids are forbidden when they were uncovered, water, wine, and milk. All other fluids are permitted. How long should they be left unattended to become forbidden? So that the crawling creature might come from a nearby place and drink. The measure of uncovered water, until the bitterness be lost in them. Rebbi Yose said, in vessels any amount and on the ground 40 seah. Pecked-at figs, grapes, green melons, water melons, gourds, and sweet melons, even large as a pitcher, large or small, separated from or connected to the ground which contain moisture are forbidden. What was bitten by a snake is forbidden because of mortal danger. The wine filter is forbidden when left unattended but Rebbi Neḥemiah permits it.

“Five fluids are not endangered by being uncovered: Fish oil, muries, vinegar, olive oil, and honey. Rebbi Simeon forbids honey. The Sages agree with Rebbi Simeon if it was seen pecking.” Rebbi Ḥinena bar Pappos had an uncovered flask of honey in his hand. Before he could ask, it broke apart.
HALAKHAH: Rebbi Zeїra said, they asked before Rebbi Yannai: What [are the rules] if he put it on the plug of the amphora? He said to them (Job 36:33): “Its neighbor will inform about it.” What means, “its neighbor will inform about it”? Rebbi Yose said, that which we have stated there: “An amphora full of fruits added to fluids, or one full of fluids added to fruits.” As you say there, only if the fluids touch the amphora; so here only if the loaf touches the plug. Rebbi Mana said, from this it follows as you say there, only if the fluids touch the amphora itself; so here only if the loaf touches the plug itself. His opinion implies, even [if the pitta] is cold. Rebbi Abba said, the problem was about a cold one. But did we not state “hot”? Rav Ḥisda said, that one should not say since the vapor absorbs it should be permitted.

Following Rebbi Simeon ben Laqish, water acts on fruits, [other] fluids do not act on fruits, against Rebbi Jehudah! But Rebbi Simeon ben Laqish says, water acts on fruits and loses fluid volume, [other] fluids act on fruits and do not lose volume. Rebbi Jehudah says, [other] fluids do not act on fruits at all.

MISHNAH: Date honey, apple wine, vinegar from winter grapes, and any other fruit juices from heave, Rebbi Eliezer subjects to [repayment of] value and fifth, but Rebbi Joshua frees [from payment]. Rebbi Eliezer declares them impure as drinks. Rebbi Joshua said, the Sages did not enumerate seven fluids as one counts raw materials for perfumes but they said, seven fluids are impure, all other fluids are pure.

Rebbi Zeïra said: It is written (Deut 14:22): “You shall certainly tithe all your seed-yield.” Anything which will grow when sown; this excludes seeds less than one-third ripe which will not grow when sown. Rebbi Ḥinena in the name of Rebbi: The fluids from grapes or olives which are not one-third ripe will not prepare [for impurity].
MISHNAH: A person should not sell his produce after it reached the period of tithing to anybody not trustworthy in matters of tithe, or in the Sabbatical year to anybody suspect in matters of the Sabbatical. If some were ripened early he takes the early ripe fruit and sells the remainder. A person should not sell his chaff or his oil cakes or his grape husks to somebody not trustworthy in matters of tithe if the latter wants to extract fluids from it. If he extracted, he is obligated for tithes but free from heave since everybody giving heave also thinks of broken grain, what is left on the sides, and what remains in the chaff. If somebody bought a vegetable field in Syria before it reached the time of tithes he is obligated, after it reached the time of tithes he is free and he can harvest continuously. Rebbi Jehudah says, he may even hire workers and harvest. Rabban Simeon ben Gamliel said, where has this been said? When he bought the field. But if he did not buy the field he is free even after it reached the time of tithes. Rebbi said, all according to computation.
Rebbi Ḥanania in the name of Rebbi Phineas understood it from the following: “[I swear] an oath that I shall not eat, when he ate inedible food and drank undrinkable fluids he is free from punishment.” Therefore, if he drank drinkable fluids he is guilty. That is correct following “an oath that I shall not eat,” and in our Mishnah they teach “an oath that I shall not eat.” But for those rabbis who teach “an oath that I shall not eat and I shall not drink”?

Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joshua ben Levi: Nothing is clear except the seven fluids. Rebbi Yose asked: Was this said for ḥallah or for impurity? If you say for ḥallah, so much more for impurity. If you say for impurity, then not for ḥallah. It is obvious for Rebbi Jonah that it had been said for ḥallah, so much more for impurity. Rebbi Jonah sticks to his opinion, for Rebbi Jonah stated from Rebbi Simeon ben Ioḥai; Rebbi Joshua ben Levi stated in Rebbi Simeon ben Ioḥai’s name, as Rebbi Simeon ben Ioḥai stated: Rebbi Ṭarphon said, it is stated here ḥallah, and it is stated there, a ḥallah of oil cake. Since the ḥallah mentioned there is prepared with oil, so the ḥallah prepared here must be prepared with oil. And oil is one of the seven fluids.

It was stated, eighteen things they decided, in eighteen they were a majority and in eighteen they were divided. The following they decided: About Gentiles’ bread, and about their cheeses, and about their oil, and about their daughters, and about their semen, and about their urine, and about the rules of a person with an emission, and about the rules of the land of Gentiles. There we have stated: “The following make heave unusable. One who eats food impure in the first degree, and one who eats food impure in the second degree, and one who drinks impure drinks, and one who comes with his head and most of his body in drawn water, and a pure person on whose head and most of his body fell three log drawn water, and a scroll, and hands, and the Ṭevul yom, and food and vessels which became impure by fluids.”
MISHNAH: One who brings out wine to mix a cup, milk for a sip, honey to put on a sore spot, oil to anoint a small limb, water to mix eye salve, and all other fluids by a quartarius, and all waste water by a quartarius. Rebbi Simeon says, all are by a quartarius; these measures were said only for those who store them.
“And all other fluids by a quartarius, and all waste water by a quartarius.” Rebbi Abba in the name of Rav Ḥisda: The Mishnah speaks of one who moves from house to house.
Rebbi Simon in the name of Rebbi Joshua ben Levi: The olive-sized piece of mazzah with which a person fulfills his obligation on Passover must be without fluid. Rebbi Jeremiah said, this was said for a meritorious deed. Rebbi Abba said, this was said for a meritorious deed. Rebbi Jehudah bar Pazi said, this was said as a necessary condition. The word of Rebbi Abun bar Ḥiyya implies that this was said as a necessary condition. Rebbi Abun bar Ḥiyya objected, did we not state: “flat cakes for a thanksgiving offering”? Are there flat cakes for a thanksgiving offering without fluids? Rebbi Yose said, there it is a quartarius; one quartarius splits into many kinds. But what implies this? “One might think and a person could satisfy his obligation with pancake, the verse says, guard the mazzot, a mazzah which needs guarding, excluding this one which does not need guarding.” Because it does not need guarding; therefore if it would need guarding one would satisfy his obligation with it. And so we stated: “One fulfills his obligation with spiced mazzah, even if it does not taste of grain, on condition that it be mostly grain”. They thought to say, spiced by fluids. We may say, spiced by sesame, spiced by nuts. But the following says it: One might think that a person only could satisfy his obligation on Passover with (roasted) [whole grain] bread? From where even with Solomon’s mazzah? The verse says, you shall eat mazzot, it included. If it is so, why does it say bread of affliction? To exclude sursīn, and pancake, and cake.

It is written: or cooking cooked in water. I not only have water, from where other fluids? The verse says, cooking cooked, in any way. So far following Rebbi Aqiba; following Rebbi Ismael? An argument de minore ad majus. Since for water which does not mask its taste you are saying it is forbidden, other fluids which mask its taste not so much more?

“One does not knead mazzah with fluids but one may rub it with them. Rebbi Aqiba said, I was with Rebbi Eliezer and Rebbi Joshua on a ship and kneaded their mazzah with fluids. One may not knead mazzah with boiling water since it parboils, nor with lukewarm water because this makes leavened, but one kneads with cold water.” But did we not state: “All flour offerings are kneaded with lukewarm water and one guards them lest they become leavened”? Rebbi Immi in the name of Rebbi Simeon ben Laqish: There the matter is in the hands of the Cohanim and Cohanim are quick; here it is in the hands of women and women are slow. Then it is a problem about Cohanim themselves, may they knead their mazzah with lukewarm water? It should be parallel to what Rebbi Zachariah the son-in-law of Rebbi Levi stated: A menstruating woman washes her hair and combs. A priestly woman does not wash her hair and combs. A menstruating priestly woman washes her hair and combs, not to differentiate between one menstruating woman and another. So also here, not to differentiate between mazzah and mazzah.

HALAKHAH: Why? Drinking is subsumed under eating but eating is not subsumed under drinking. From where that drinking is subsumed under eating? Rebbi Jonah understood if from the following: Therefore, I told the Children of Israel, none of you shall eat blood. Where do we hold? If about congealed blood, was it not stated that congealed blood is neither food nor drink? But we hold, as it is. And the Torah called it eating. And was it not stated: If one liquefied fat and drank it, or congealed blood and ate it, [if there is the volume of an olive] he is liable. What does Rebbi Jonah do with this? It is not food to become impure in the impurity of food, or fluid to become impure in the impurity of fluids. Rebbi Jonah changed and understood if from the following:: You shall spend the money for anything you desire. Where do we hold? If about one who gives the taste of wine into a cooked dish, is that not spoiling the taste of the wine? [But we hold as it is and the Torah called it “eating.”] The rabbis of Caesarea said, explain if about orzaraya and gomnany, since anything that is ancillary to food is like food.
Rebbi Ḥanania in the name of Rebbi Phineas understood it from the following: “An oath that I shall not eat; when he ate inedible food and drank undrinkable fluids, he is not liable.” Because he ate inedible food and drank undrinkable fluids. Therefore if [he ate edible food,] drank drinkable fluids he is liable. Did he not say, an oath that I shall not eat? That is understandable following our Mishnah, where we are saying, “an oath that I shall not eat.” But for Rebbi who said, an oath that I shall not eat and shall not drink?

It is all Rebbi Ismael’s. Rebbi Ḥiyya bar Joseph explains the Mishnah: The leftover of produce is the gain of the Temple; the leftover of libations is the fourth seah. Rebbi Joḥanan explains the Mishnah, The leftover of produce is the fourth seah; the leftover of libations is the overflow. Does Rebbi Ḥiyya bar Joseph not have overflow? Rebbi Ḥizqiah said, what is counted for the fourth seah is overflow. The opinion of Rebbi Ḥiyya bar Joseph is understandable. “one does not gain neither for the Temple nor funds for the poor,” therefore “neither of them did agree about produce.” The opinion of Rebbi Joḥanan is difficult. We have stated: “if the going rate was three, he has to deliver for four” and we have stated, “neither of them did agree about produce.” They did not agree about produce to adorn the altar; they did agree for Service vessels. So far overflow of public {sacrifices}. Even overflow for private {sacrifices}. Would then not Service vessels come from private donations? It is as it was stated, “a woman who made a coat for her son has to surrender it to the public.” So far the overflow of fluids; even the overflow of dry goods; as that which we stated, “in case libations were sanctified in a vessel when the sacrifice was found disqualified, if there is another sacrifice they should be brought with it; otherwise they will become disqualified by staying overnight.”
HALAKHAH: Is hand-washing required for profane food? But it must follow Rebbi Simeon ben Eleazar, since Rebbi Simeon ben Eleazar says, hand-washing is required for profane food. It is everybody’s opinion, so he should separate from heave. Rebbi Simeon ben Eleazar stated in the name of Rebbi Meïr, hands are first degree impure for profane food and second degree impure for heave. Does Rebbi Simeon ben Eleazar follow Rebbi Aqiba, as we have stated there, “if somebody puts his hands into a leprous house, his hands are impure in the first degree, the words of Rebbi Aqiba, but the Sages are saying, his hands are impure in the second degree”? There, it follows the rabbis; what is their reason here? Since you tell him that his hands are impure in the second degree, he will separate from heave. But did they not decide about them because of fluids; then they should be impure in the first degree? It is an argument de minore ad majus. Since the Tevul Yom, which is a word from the Torah, only disqualifies, impure hands, which are from their words, not so much more? Another explanation: Did they not decide about hands only that he should separate from heave? Since you tell him that his hands are impure in the second degree, he will separate from heave.
There, we have stated: “A staff which is full of impure fluids, when it touched the miqweh it is pure, the words of Rebbi Joshua. But the Sages are saying, only if he immerses it completely.” Rebbi Simeon ben Laqish said, where do they disagree? For easy impurity; but for severe impurity even Rebbi Joshua agrees. Rebbi Joḥanan said, they even disagree for severe impurity. A baraita disagrees with Rebbi Simeon ben Laqish: “As long as his feet are in the water, he may consider himself pure for any stage he chooses.” Explain it about one who ate impure food and drank impure drinks. Did not Rebbi Jacob bar Zavdi, Rebbi Abbahu say in the name of Rebbi Simeon ben Laqish, the body of one who ate impure food and drank impure drinks is pure without special intention? From the moment he intended elevated purity he (needs) [does not need] intention. A Mishnah disagrees with Rebbi Simeon ben Laqish: “A miqweh containing exactly 40 seah into two persons descended, [both are pure]. One after the other, the first one is pure, the second impure. Rebbi Jehudah says, if the feet of the first touched the water, the second one also is pure.” Still this is about one who ate impure food and drank impure drinks. A baraita disagrees with Rebbi Simeon ben Laqish: A woman in her period may rinse a radish in a cave and it is pure. If she lifted it in any way out of the water it is impure. And we have stated thereto: Rebbi Jehudah declares it pure in the name of Rebbi Joshua. And represents a menstruating woman not a severe impurity? This disagrees with Rebbi Simeon ben Laqish and it has no standing.
Rebbi Joḥanan said, the finger-holes which they mentioned, whether inside or outside, in the manner in which cleanly people hold it. Rebbi Ze`ira said, “it is impossible to say, about one which is wiped dry, for hands are not made impure by anything wiped dry. In truth it is impossible to say, if it is full of fluid, for in the moment he touched it he made it impure. But we must hold that [it was dirtied] by fluid.” Rebbi Joḥanan in the name of Rebbi Banaiah: They treated fluid in a finger-hole like fluid at the slaughtering place. As you are saying there that fluids of the slaughtering place are pure at their proper place but impure at any other place, [so here, fluids in a finger-hole are pure at their proper place but impure at any other place.] Rebbi Simon in the name of Rebbi Joshua ben Levi: fluids of the slaughtering place which came outside {the Temple courtyards} become impure. But did we not state, fluids of the slaughtering place which came outside continue in their sanctity? Rebbi Yose said, Rebbi Simon explained it. Rebbi Ḥinena, Rebbi Simon in the name of Rebbi Joshua ben Levi. If they came out and returned. If the upper fluid became impure and flowed down, Rebbi Abba and Rebbi Abun bar Ḥiyya. One said, at its place it is pure, if it flows down it is impure. The other one said, since it comes from purity it is pure.

There, we have stated: “All vessels have back and interior, and they have finger-holes. Rebbi Tarphon says, concerning a large wooden trough. Rebbi Aqiba says, concerning cups. Rebbi Meïr says, concerning impure and pure hands. Rebbi Yose says, they referred only to pure hands.” Following Rebbi Meïr, if his hands were impure and the back of the cup pure, fluid outside on the cup and he touches it in his finger-hole, it is obvious that the fluid does not become impure from his hands to make the cup impure. Just as the fluid does not become impure from his hands to make the cup impure, will the fluid not become impure from his hands to make a loaf impure at another place? Let us hear from the following. Pure fluids are on the ground. If an impure loaf touched them, it made them impure. In which respect did it make impure? Not to make a loaf impure at another place? Because they are on the ground; therefore not on a cup. But maybe fluid is on the hand and he holds at finger-holes, even so does the fluid become impure from the cup to make the hand impure? HALAKHAH: Do vessels need immersion? Rebbi Abba said, I am saying that possibly one of the vessels there was not sprinkled upon. Then should we not suspect all of them? Rebbi Abun bar Ḥiyya said, I am saying that there was one of the Cohanim who left to speak with a woman about her nest and a drop of spittle fell on his clothing from her mouth and made him impure. Then should we not suspect all of them? Explain it if it became impure by fluids of uncertain status. There we have stated: “Fluids of uncertain status, to become impure they are impure, to make impure they are pure.” There about heave, here about sancta. One is restrictive for sancta.

It was stated: “If the table became impure one immerses it at its time, even on the Sabbath, the words of Rebbi Meïr. But the Sages are saying, immediately.” You find to say, in Rebbi Meïr’s opinion it makes two breads impure; in the rabbis’ opinion it only makes one bread impure. Rebbi Jacob bar Sosai said before Rebbi Yose, even according to Rebbi Meïr it makes only one bread impure. Explain it if it became impure by fluids of questionable status. “Once they immersed the candelabrum. The Sadducees said, look the Pharisees immerse the ball of the sun.”
Rebbi Abbahu in the name of Rebbi Mana: Why did they say that secondarily impure profane food defiles profane fluids? Because of the hands. Since hands, [whose impurity] is rabbinical, defile profane fluids, secondarily impure food, [whose impurity] is biblical, not so much more? Also, since hands, in a case of doubt whether they defiled, impart impurity, so also secondarily impure fluids, in a case of doubt whether they defiled, impart impurity. Rebbi Ḥanina objected before Rebbi Mana: Look, if somebody eats secondarily impure food and drinks secondarily impure fluids, in a case of doubt whether they defiled, they impart impurity. Rebbi [Yose] said to the colleagues: You should know that Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree: If somebody split a limb from a living animal and ate it, everybody agrees that he is free from prosecution. Where do they disagree? If he split it in his mouth before he ate it. Rebbi Joḥanan considers his mouth as inside, Rebbi Simeon ben Laqish considers his mouth as outside. They asked him, what do you say? He answered them, I informed you that mighty mountains disagree, and you ask this? If it is so, even if he split it outside and then ate, he should be guilty! Why? That is how one eats. If somebody split an ant in his mouth and ate it, that is the disagreement of Rebbi Joḥanan and Rebbi Simeon ben Laqish. Rebbi Maisha asked Rebbi Ze‘ira: If he split a grape in his mouth and ate it, is that the disagreement of Rebbi Joḥanan and Rebbi Simeon ben Laqish? He answered, there it is something for which there is a prohibition and impurity. In a circumstance in which its impurity disappeard, its prohibition disappeared. But here is a prohibition and no impurity. Rebbi Abba ben Rebbi Mamal asked: If he split an olive-sized bit of mazzah in his mouth and ate it, is that the disagreement of Rebbi Joḥanan and Rebbi Simeon ben Laqish? Rebbi Yose ben Rebbi Abun said, in the other cases, his palate did not enjoy an olive sized bit. The rabbis of Caesarea said that Rebbi Nisa asked: If he split in his mouth pomegranate berries which are ‘orlah and ate them, is that the disagreement of Rebbi Joḥanan and Rebbi Simeon ben Laqish? Where do we hold? If because of fluids, we already did state: “Nothing makes impure as a drink except what comes from olives and grapes.” The rabbis of Caesarea said, explain it if he swallowed them.
MISHNAH: Somebody sent his son to a grocer who measured him oil for an assarius and he gave him the assarius; if he broke the flask and lost the assarius, the grocer is liable. Rebbi Jehudah holds him not liable since for that he sent him. The Sages agree with Rebbi Jehudah that if the flask was in the child’s hand and the grocer measured into the flask, the grocer is not liable. The wolesaler cleans his measuring vessels once every thirty days, the householder every twelve months. Rabban Simeon ben Gamliel says, it is the other way around. The retail grocer cleans his measuring vessels twice a week, wipes his weights clean once a week, and cleans his scales after each weighing. Rabban Simeon ben Gamliel said, when has this been said? For fluids, but for dry matter it is not necessary; he has to let [the scales] bend down a handbreadth. If he weighed strictly by eyesight he has to give him surplus, one tenth for fluids and one twentieth for dry products. At a place where one is used to small measures he should not use large ones, to large measures he should not use small ones, to level one must not heap, to heap one must not level.

HALAKHAH: “An oath that I shall not eat; when he ate,” etc. Drinking is subsumed under eating but eating is not subsumed under drinking. Rebbi Jonah understood all this from: Therefore, I told the Children of Israel, none of you shall eat blood. Where do we hold? If about congealed blood, was it not stated that congealed blood is neither food nor drink? (But we hold, about minute amounts. Are minute amounts eating? Explain it following Rebbi Aqiba who said that a minute amount is eating.) And was it not stated: If one liquefied the blood and swallowed it, or froze fat and ate it, if there is the volume of an olive he is liable. What does Rebbi Jonah do with this? It is not food to become impure in the impurity of food, or fluid to become impure in the impurity of fluids. Rebbi Jonah changed and explained the Mishnah: You shall spend the money for anything you desire. Where do we hold? If about one who gives the taste of wine into a cooked dish, is that not spoiling the taste? But we hold with everything and the Merciful called it “eating.” The rabbis of Caesarea said, explain if about gomraya and orzaraya, since anything that is auxiliary to food is like food.
Rebbi Ḥanina in the name of Rebbi Phineas understood all this from the following: “An oath that I shall not eat; when he ate inedible food and drank undrinkable fluids, he is not liable.” Therefore if he ate edible food and drank drinkable fluid he is liable.
MISHNAH: An oath that I shall not eat; when he ate inedible food and drank undrinkable fluids, he is not liable. An oath that I shall not eat; when he ate carcass or torn meat, abominations or crawling animals, he is liable; Rebbi Simeon declares him not liable. If he said, a qonam that my wife may not benefit from me if I had eaten today, if he had eaten carcass or torn meat, abominations or crawling animals, his wife is forbidden benefits.
