MISHNAH: When does one start to read the Shema in the evening? From the time that the priests enter to eat their Terumah, until the end of the first night watch are the words of Rebbi Eliezer. But the Sages say until midnight. Rabban Gamliel says until the first sign of dawn. It happened that his (Rabban Gamliel’s) sons returned from a wedding feast and told him: We did not recite the Shema‘. He said to them: If dawn has not yet come then you are obligated to recite. Not only that, but everywhere the Sages said “until midnight”, the obligation is to the start of dawn. The obligation of burning fats and limbs on the altar [and eating of the Passover sacrifice] is until the start of dawn. All sacrifices that can be eaten during one full day only could be eaten until the first dawn. In that case, why did the Sages say, only until midnight? In order to remove people from sin.

New Section. “Rabban Gamliel says until the first sign of dawn.” The statement of Rabban Gamliel is parallel to that of Rebbi Simeon, as we have stated in the name of Rebbi Simeon: “Sometimes a person reads the Shema‘ [twice], once before dawn and once at dawn, and has fulfilled his obligation for day and night.” Hence Rabban Gamliel is like Rebbi Simeon for evening prayers, is he also like him in the morning? His position might be that expressed by Rebbi Zeïra the Tanna, the brother of Rav Ḥiyya bar Ashi, and of Rav Abba bar Ḥana: He who reads with the men of the Mishmar did not fulfill his duty because they were too early.

Rabban Gamliel disagrees with the Sages and acts upon his opinion? Did not Rebbi Meïr disagree with the Sages and not act upon his opinion, did not Rebbi Aqiba disagree with the Sages and not act upon his opinion?
And Rabban Gamliel disagreed with the Sages and did act on his own opinion! There is a difference here since the recitiation of the Shema‘ is for study. But then they could have read also after the start of dawn. Some want to say that in the other cases it was possible to uphold the words of the Sages. But here it was after midnight and they could no longer fulfill the precept of the Sages; so he told his sons to act according to his opinion.
It was stated: One may step to one side because of obstacles on the road. And when one sinks, even into a field full of saffron. Rebbi Abbahu said: It happened that Rabban Gamliel and Rebbi Joshua were on the road and stepped on the side because of obstacles on the road when they saw Rebbi Yehudah ben Pappos, who was sinking, coming towards them. Rabban Gamliël said to Rebbi Joshua: Who is this one who makes an exhibition of himself? He answered: This is Yehudah ben Pappos, all whose deeds are done for Heaven’s sake. He said to him: Did we not formulate “In anything that gives praise, not everyone who wants to distinguish himself may do so. A scholar does except if he has been appointed to a position of public authority.” He answered him: Did we not also formulate, “In anything that gives pain, everyone who wants to distinguish himself may do so. A scholar does and may blessing come to him.” Rebbi Zeïra said, but only if he does not shame others.
Clarification. Rebbi Miasha and Rebbi Samuel bar Rav Isaac were sitting and eating in one of the upper synagogues. There came the time of prayer and Rebbi Samuel bar Rav Isaac got up to pray. Rebbi Miasha said to him: Teacher, did you not teach us that once one started one does not interrupt. And Ḥizkiah stated: Every one who is free from an obligation and does it anyway is called uneducated. He answered him: Did we not state: “The bridegroom is free?” The bridegroom, if he wants. He answered him: Is that not from Rabban Gamliël? He said to him, I can free myself as Rabban Gamliel did; Rabban Gamliel said: I shall not listen to you to lift from me the Kingdom of Heaven.

When does one overturn the couches? From the moment when the dead left the gate of the courtyard, the words of Rebbi Eliezer. But Rebbi Joshua says, from when the cover plate was laid on the grave. And when Rabban Gamliel died, after he left the gate of the courtyard, Rebbi Eliezer said to his students: Overturn the couches. And when the cover plate was laid on the grave, Rebbi Joshua said: Overturn the couches. They said to him: We already did turn them over on the orders of the old man. Friday evening he rights his couch, at the end of Sabbat he overturns them.
All the time that his deceased in lying before him, he eats at his neighbor’s, and if he has no neighbor, he eats in another room. If he has no other room, he makes a wall of separation and eats. If he is unable to make a wall of separation, he turns his face towards the wall and eats. He does not eat reclining; he does neither eat nor drink his fill. He eats neither meat nor drinks wine. One does not allow him to participate in a group to say Grace. If he recited Grace, one does not answer “amen” after him. If others recited Grace, he does not anwer “amen”. That is meant on weekdays. But on the Sabbath, he does eat reclining; he eats meat and drinks wine, eats and drinks his fill. One lets him participate in a group to say Grace. If he recited Grace, one does answer “amen” after him. If others recited Grace, he answers “amen”. Rabban Simeon ben Gamliel said: Because I allowed all of these, oblige him for all other obligations of the Torah. If I permitted him temporary life, so much more eternal life. Rebbi Judah ben Pazi in the name of Rebbi Joshua ben Levi: Practice follows Rabban Simeon ben Gamliel.

It is stated: Ten cups one drinks in the house of a mourner: two before the meal, five during the meal, and three after the meal. These are the three after the meal: one for Grace, one for those who exercise charity, one for those who console mourners. And when Rabban (Simeon ben) Gamliel died, they added another three: One for the Ḥazzan of the community, one for the head of the community, and one for Rabban Gamliel. But when the Rabbinical authorities saw that they regularly got drunk they decreed and returned it to the original status.

It is stated: One must remove himself four cubits from a chamberpot, be it used for excrement or for urine. If it is before the bed, if he put some water in the pot he may recite, otherwise he may not recite. Rebbi Zakkai said, if he put a quartarius of water in, he may recite; otherwise, he may not recite. How many corresponding quartarii? One quartarius, corresponding to one quartarius, be the vessel small or large. Rabban Simeon ben Gamliel said, if it stands behind the bed he may recite, before the bed he may not recite. Rebbi Simeon ben Eleazar said, even in a dining hall large ten-by-ten he may not recite until he covers it up or until he puts it under the couch. Rebbi Jacob bar Aḥa in the name of Rebbi Ḥiyya bar Abba: Rebbi Ḥanina Tortayya ruled following Rebbi Simeon ben Eleazar.
Rebbi Jacob bar Abba said: There, they did state, what is the status of evening prayer? Rabban Gamliel said, it is obligatory. Rebbi Joshua said, it is voluntary. Rebbi Ḥanina said, this difference parallels the other difference: He who holds that evening prayer is obligatory, holds that Neïlah does not free one from evening prayers. He who holds that it is voluntary, holds that Neïlah frees one from evening prayers.
It happened that one student came and asked Rebbi Joshua: What is about evening prayer? He said to him: It is voluntary. He asked Rabban Gamliel: What is about evening prayer? He said to him: It is obligatory. He said to him: But Rebbi Joshua told me that it was voluntary. He said to him: Tomorrow, when I enter the assembly hall, stand up and ask me about this practice. The next day, this student stood up and asked Rabban Gamliel: What is about evening prayer? He said to him: It is obligatory. He said to him: But Rebbi Joshua told me that it was voluntary. Rabban Gamliel said to Rebbi Joshua: Are you the one who says it is voluntary? He answered him: No. He said to him: Stand up on your feet so that they may testify against you. Then Rabban Gamliel was sitting down and lecturing while Rebbi Joshua was standing up until the people started talking and said to Rebbi Ḥuẓpit the interpreter: Send the people home. They said to Rebbi Zenon the ḥazan: Start! He said: Start! All the people stood up and said to him (Nahum 3:19): “Certainly, on whom did your evil not pass always?” They went and appointed Rebbi Eleazar ben Azariah to the Yeshivah when he was 16 years old; his head became all white. Rebbi Aqiba sat and was sad; he said, not that he is a greater Torah scholar than I am, but he comes from a greater family than I do; hail to the man whose forefathers created merit for him, hail to the man who has a peg to hang on to. What was Rebbi Eleazar ben Azariah’s peg? He was the tenth generation after Ezra. How many seats were there? Rebbi Jacob ben Sisi said: Eighty seats were there of accomplished scholars, not to count those standing behind the railing. Rebbi Yose ben Rebbi Abun said 300 were there, not to count those standing behind the railing. As we have stated there (Mishnah Zebaḥim 1:3) “On the day Rebbi Eleazar ben Azariah was appointed to the Academy.” There (Mishnah Ketubot 4:6) we have stated: “This inference did Rebbi Eleazar ben Azariah present before the sages at the vineyard of Jabneh.” Was there a vineyard? It means that the scholars sat there in rows like vines in a vineyard. Rabban Gamliel went immediately to pacify each one in his house. He came to Rebbi Joshua and found him occupied with the making of needles. He asked him: This is how you earn your living? He answered him: Until now you did not know? Woe to the generation whose caretaker you are! He said to him: I humble myself before you. They sent a washerman to Rebbi Eleazar ben Azariah, but some say that it was Rebbi Aqiba. He told him: The sprinkler, son of a sprinkler, should sprinkle. Should anyone who is neither a sprinkler nor the son of a sprinkler say to the sprinkler: your water is water from a cave and your ashes are ashes from a fireplace? He said to him: You made your peace with him! I and you shall go in the morning to Rabban Gamliel’s door. Nevertheless they did not remove him from his dignity but made him head of the court.

MISHNAH: Rabban Gamliel says: Every day one prays eighteen benedictions; Rebbi Joshua says, similar to eighteen benedictions. Rebbi Aqiba says, if he is fluent in his prayer then he prays eighteen benedictions, otherwise similar to eighteen benedictions.
There we have stated: Rabban Gamliel says, the reader frees the public from their obligation. The older Rebbi Huna from Sepphoris in the name of Rebbi Yoḥanan: Practice follows Rabban Gamliel for the prayer accompanying the blowing of the Shofar. Rebbi Zeïra and Rav Ḥisda were sitting there for the blowing of the Shofar. After they finished the prayer, Rav Ḥisda got up and prayed. Rebbi Zeïra said to him: Did we not pray just now? He said to him, I prayed and I am repeating the prayer, because Westerners came down and said in the name of Rebbi Yoḥanan: Practice follows Rabban Gamliel for the prayer accompanying the blowing of the Shofar, but I was inattentive. If I had been attentive, I would have fulfilled my duty. Rebbi Zeïra said, that is fine. All Tannaïm state it in the name of Rabban Gamliel, Rebbi Hoshaia states it in the name of the Sages. Rebbi Ada from Caesarea in the name of Rebbi Yoḥanan: This is only if he attended from the start. Rebbi Tanḥum said, the Mishnah expresses this: The order of benediction, one says “Forefathers”, “Greatness”, and “Sanctification of the Name”.

“Rebbi Eliezer says, in ‘thanksgiving’ ”. Rebbi Yoḥanan in the name of Rebbi: One is inclined toward Rebbi Eliezer’s opinion on a holiday that falls immediately after the Sabbath. The old Rebbi Isaac in the name of Rebbi: Practice follows Rebbi Eliezer on a holiday that falls after the Sabbath. Rebbi Isaac bar Naḥman in the name of Rebbi Ḥanina ben Gamliel: Practice follows Rebbi Eliezer at all times. Rebbi Abbahu in the name of Rebbi Eleazar: Practice follows Rebbi Eliezer at all times. Rebbi Jacob bar Aḥa, not because because there are two traditions, but because Rebbi Isaac bar Naḥman and Rebbi Eleazar both say in the name of Rebbi Ḥanina ben Gamliel: Practice follows Rebbi Eliezer at all times.

“If the one standing before the arc makes a mistake.” Rebbi Yose ben Ḥanina in the name of Rebbi Ḥananiah ben Gamliel: If one erred in one of the first three benedictions, he starts anew. Ada bar bar Ḥana, Ganiva in the name of Rav: If one erred in one of the last three benedictions, he returns to “Temple Service.” Rebbi Ḥelbo, Rav Huna in the name of Rav: If one erred in one of the first three benedictions, he starts anew; in one of the last three benedictions, he returns to “Temple Service”; if he erred and he cannot remember where he erred he returns to the place that is clear to him.
It happened that the son of Rabban Gamliel fell ill and he sent two scholars to Rebbi Ḥanina ben Dosa in the latter’s city. He said to them, wait until I go to the upper floor. He went to the upper floor, came back, and said to them: I am sure that Rabban Gamliel’s son will get respite from his sickness. They noted that at this hour he asked for food. Rebbi Samuel ben Rebbi Naḥmani said: If you were able to concentrate your attention on your prayer, you are told that your prayer was heard. What is the reason? (Ps. 10:17) “You prepare their hearts, You will listen with Your ears.” Rebbi Joshua ben Levi said: If a person’s lips bore fruit he is told that his prayer was heard. What is the reason? (Is. 57:19) “He Who created the fruit of lips: peace, peace to the far and the near said the Eternal, I shall heal him.”

The statement of Rebbi Simeon the pious turns out like that of Rebbi and both of them like Rabban Gamliel, as it was stated: “The following is the principle: Rebbi Yehudah said in the name of Rabban Gamliel that on everything that is of the Seven Kinds but is not flour, or flour but not baked as bread, Rabban Gamliel says that he recites afterwards three benedictions; but the Sages say, one benediction. On everything that is neither from the Seven Kinds nor a kind of flour, Rabban Gamliel says he recites benedictions before and after, but the sages say before, but not after.”

That is if it is his intention to eat bread. But if it is not his intention to eat bread, that does not apply. (Rabban) Gamliel the twin went to those of the house of Rebbi Yannai. He saw them eat an olive and recite the benediction before and afterwards. He said to them: Does one do that? Rebbi Zeïra sent and asked Rebbi Samuel bar Naḥman. Rebbi Cahana in the name of Rebbi Avina: Everybody agrees that if among them was one of the Seven Kinds, that is the one over which he recites the benediction. Rebbi Zeïra said, that must be correct, since we see the rabbis assembling for the proclamation of the New Moon and eat grapes but they do not recite a benediction afterwards. That is because it is his intention to eat bread.
MISHNAH: One who ate figs, grapes, or pomegranates recites for them three benedictions, the words of Rabban Gamliel; but the Sagessay, one benediction imitating three. Rebbi Aqiba says, even if one ate cooked food and that is his meal he recites for it three benedictions. He who drinks water for his thirst says “By Whose word everything was created.” Rebbi Tarphon said, “Creator of many living things”.
“If one ate demay.” This means that, if one ate produce which perhaps was tithed and perhaps was not tithed, one invites him. Rebbi Simeon, the brother of Rebbi Berekhiah: At the time when they were instituting demai, most of the unlearned brought the harvest into their houses. Which one says that? “One invites the Samaritan.” And is that Samaritan not doubtful? Rebbi Abba said, explain it following what is said: A Samaritan is like a Gentile, the words of Rebbi. Rabban Simeon ben Gamliel says, a Samaritan is like a Jew in all respects.
Rebbi Jeremiah asked: May he who ate vegetable recite Grace? Rebbi Jeremiah seems to contradict himself! It has been stated: 300 nezirim came in the days of Simeon ben Shetaḥ. For 150 of them he found an opening, for 150 of them he did not find an opening. He came to king Yannai and said to him: There are here 300 nezirim who need 900 sacrifices. You should give half of them from your side, I shall give half from my side. The king sent him 450 animals. An informer went around and said that the other one had not given anything from his own money. King Yannai heard about it and got angry. Simeon ben Shetaḥ feared and fled. After some time, important people from the Persian empire came to king Yannai. At the meal, they said to him: We remember that there was here an old man who gave us a rabbinic discourse. He told them what had happened. They said to him, send and bring him! He sent and gave him his word; he came and sat between king and queen. He said to him, why did you trick me? He said, I did not trick you; you with your money and I with my learning, as it is written (Eccl. 7:12) “In the shadow of wisdom, in the shadow of money.” He said to him, why did you disappear? He said to him, I heard that my lord was angry with me and I wanted to fulfill the verse (Is. 26:20) “Hide a little bit until the rage passes;” he used about himself (Eccl. 7:12): “Knowledge is an advantage, wisdom lets its possessor live.” He said to him, why did you sit between king and queen? He said to him, it is written in the book of Ben Sirach: “Esteem it and it will raise you and set you between princes.” He said, bring him a cup that he may recite Grace. He took the cup and said: “Let us give praise for the food that Yannai and his company ate.” He said to him, are you still obstinate as ever? He said to him, what should I say, “for the food that we did not eat?” He said, bring him something that he may eat. They brought, he ate and recited: “For the food that we ate.” Rebbi Yoḥanan said, his colleagues disagree with Simeon ben Shetaḥ. Rebbi Jeremiah said, about the first action; Rebbi Abba said, about the second action. Rebbi Jeremiah seems to contradict himself! There he wondered about it and here it is obvious for him! He wondered following the Sages; it is obvious for him following Rabban Simeon ben Gamliel. We have stated about this: If one was lying on a couch and ate with them, even if he did not eat grain the volume of an olive one ‘invites’ with him, the words of the Sages. Rebbi Jacob bar Aḥa in the name of Rebbi Yoḥanan: One never ‘invites’ anyone unless he had eaten grain the volume of an olive. But did we not formulate, “two bread and one vegetable, then one ‘invites’?” This baraita follows Rabban Simeon ben Gamliel.

Our Mishnah if it was uprooted from all places of the Land of Israel, but if it was uprooted only from one place, he says: “Praise to Him Who uprooted paganism from this place.” If it was uprooted from one place but established at another place, there where it was reestablished he says: “Praise to Him Who is patient.” Where it was uprooted from, he says: “Praise to Him Who uprooted paganism from this place. May it be Your pleasure, our God and God of our fathers, that just as You uprooted it from this place, so uproot it from all other places and turn the heart of its worshippers to worship You.” Does he not pray for pagan worshippers? It was stated: Rebbi Simeon ben Gamliel says, also outside of the Land he must say this.
He who sees beautiful trees or beautiful people says: Praise to Him Who created beautiful creatures in His world. It happened that Rabban Gamliel saw a beautiful Gentile woman and recited a benediction over her. Did not say Rebbi Zeïra in the name of Rebbi Yose bar Ḥanina in the name of Rebbi Yoḥanan (Deut. 7:2): “Do not favour them,” do not ascribe charm to them? He did not say “may there be no harm” but “Who created beautiful creatures in His world,” since even if one sees a beautiful horse or a beautiful donkey, one says: Praise to Him Who created beautiful creatures in His world. Does Rabban Gamliel usually look at women? It was a curved road, like a pwpsdws; he looked at her because he could not avoid her.

And Rebbi Levi said: The upper waters are male and the lower ones female. What is the reason? (Is. 45:8) “The earth shall open,” like a female who opens before a male; “they should bear fruit of help,” that is being fruitful and multiplying; “and justice shall sprout together,” that is rainfall; “I, the Eternal, did create it,” for that I created it, for the well-being of the world. Rebbi Aḥa stated it in the name of Rebbi Simeon ben Gamliel: Why is it called “fertilizing,” because it impregnates the earth.
“Works of kindness.” That means with his person. But with his money it has a measure. This parallels what Rebbi Simeon bar Laqish said in the name of Rebbi Jehudah ben Ḥanina: They voted at Usha that a person may give a fifth of his property for good deeds. How far down? Rebbi Gamliel bar Ininia and Rebbi Abba bar Cahana; one said corresponding to terumah and the terumah of the tithe, the other said (Prov. 3:9): “Honor the Eternal with your property and with the first of all your yield;” corresponding to the first of all your yield.
Rebbi Gamliel bar Ininia asked before Rebbi Mana: Does it mean one fifth every year? In five years he will have lost everything! He said to him: The first time from the capital, from there on from net gain.
It happened that Rebbi Yeshebab went and let his entire property be distributed to the poor. Rabban Gamliel sent to him: Did they not say one fifth of one’s property for good deeds? And was not Rabban Gamliel before Usha? Rebbi Yose ben Rebbi Abun, Rebbi Levi: That was the current practice, they forgot it, but the later ones got up and agreed to the opinion of the earlier ones, to teach you that everything the Court insists on will come to be in the end, just as Moses was told on Sinai; as Rebbi Mana said (Deut. 32:47): “For it is not an empty word, from you,” if it is empty it is from you because you do not exert yourself about it. “Because it is your life,” when is it your life? At the time that you exert yourself!

Rebbi Ḥanina said: Come and see, how hard is even a hint of calumny that the verses spoke untruth in order to make peace between Abraham and Sarah. (Gen. 18:12) “Sarah laughed to herself, saying: After having wilted I became dainty, but my master is old.” To Abraham He does not say so, but rather (Gen. 18:13): “Why now did Sarah laugh, saying how can I give birth, being old?” It is not written “my master is old” but “I am old”. Rabban Simeon ben Gamliel said: Come and see, how hard is even a hint of calumny that the verses spoke untruth in order to make peace between Joseph and his brothers. That is what is written (Gen.50:16–17): “They empowered [a messenger] to Joseph to say: Your father commanded before his death, saying: So you shall say to Joseph, please forgive etc.” We do not find that he (Jacob) commanded anything.
MISHNAH: Everything separates for seeds but only a fence separates for trees. But if hair was pressing down it does not separate and he gives one peah for all. : But for carob trees all that see one another. Rabban Gamliel said, in my father’s house they used to give one peah for the olive trees they had in every direction and for all carobs that saw one another. Rebbi Eleazar ben Rebbi Ẓadoq said in the former’s name: also for all carob trees they had in the entire town.
MISHNAH: He who sows one species on his field gives one peah even though he works at two different threshing floors. If he sows two species, he gives two peot even though he threshes them together. He who sows two different kinds of wheat on his field gives one peah if he processes them together, two peot if he threshes them separately. It happened that Rebbi Simeon from Miẓpah sowed before Rabban Gamliel; they ascended to the stone hall and asked. Naḥum the scribe said: I have the tradition from Rebbi Miasha, who received it from my father, who received it from the pairs, who received if from the prophets, a practice going back to Moses on Sinai, that he who sows two different kinds of wheat on his field gives one peah if he stores them together, two peot if he stores them separately.
MISHNAH: One does not harvest peah with sickles and one does not uproot it with axes so that they should not injure one another. Three investigation periods are there during the day, in the morning, at noontime, and in the evening. Rabban Gamliel says, they decreed this only to say that one may not do less. Rebbi Aqiba says, they decreed this only to say that one may not do more. In Bet Namer they insisted on collecting along a rope and were giving peah from every strip.
“Rabban Gamliel says, they decreed this only to say that one may not do less;” if he wants to add, he may add. “Rebbi Aqiba says, they decreed this only to say that one may not do more;” does this mean that if he wants to give less frequently he may not do so?
MISHNAH: For a grain stack under which gleanings were not collected, all ears that touch the ground are for the poor. If the wind dispersed any sheaves, one estimates what amount of gleanings that would have yielded, and he gives that to the poor. Rabban Simeon ben Gamliel says, he gives to the poor the average fall.
It was stated: The house of Rabban Gamliel intercalated immediately after the end of the Sabbatical year. Rebbi Avin said, from this you do not infer anything. (Deut. 16:1) “Watch the spring month.” Watch it that it should come in its renewal.
Rebbi Jehudah said, they argued before Rabban Gamliel: Because betrothed she is his wife and married she is his wife; just as the sale by the latter is void, the sale by the former also should be void. He said to them, we are ashamed of the new ones, now you want to roll old ones over us! The new ones, after nissuïn, the old ones before nissuïn, when she was married in the second ceremony.
MISHNAH: A sheaf containing two seah that was forgotten is not a “forgotten sheaf.” Two sheaves that together are two seah, Rabban Gamliel says, they are for the proprietor, but the Sages say, they are for the poor. Rabban Gamliel said to them: Does large size of the sheaves increase or decrease the power of the proprietor? They said to him, it increases it. He said to them: Since a sheaf containing two seah that was forgotten is not “forgotten sheaf,” it is only logical that two sheaves that together are two seah should not be “forgotten sheaf” either. They said to him, if they said that about one sheaf that is like a stack, do you want to say the same about two sheaves that are like bundles? Standing produce of two seah which was forgotten is not “forgotten sheaf.” If it does not have two seah but it might bring two seah, even if it were oats it is considered like barley grains.

Rabban Simeon ben Gamliel stated: Just as standing produce saves the sheaf, so the sheaf saves the standing produce. This is logical: If standing produce, on which the power of the poor is enhanced, saves if any of it was forgotten, it is only logical that the sheaf should save, since on it the power of the poor is reduced. Rebbi answered him: If standing produce, on which the power of the poor is enhanced, saves if any of it was forgotten, is it logical that the sheaf, on which the power of the poor is reduced, if any of it was forgotten should save? From the words of both of them we infer that sheaf is saved by sheaf, but standing produce is not saved by standing produce.
Hence, if all is cut it is for the proprietor. Our Mishnah follows Rabban Gamliel.
Rabban Simeon ben Gamliel stated: Both in the Sabbatical year and in the rest of the years of the sabbatical cycle, the House of Shammai say, there is no fifth and no removal. According to that Tanna, they did not at all learn the rules of the fourth year after planting from the Second Tithe. But then should there be no holiness in it? Its holiness comes from the verse (Lev. 19:24): “Holy for praises;” it has the status of those holy fruits over which praises are said. And should it be permitted to the fresh mourner? It is stated: This implies that it is forbidden to the fresh mourner. And should it be subject to removal? Since Rebbi Simeon frees it from removal. And should it be redeemed while still connected to the ground?
In the house of Assi they cooked vegetables but had forgotten to put them in order. Gamliel the twin came and fixed them in the pot.
Rebbi Jonah in the name of Rebbi Simeon ben Zachariah: The kinds forbidden in Paneas: Walnuts, rice, sesame, and Egyption beans. Gamliel the twin says, early ripening atriplex. Rebbi Jonah said, that means, higher than the Rooster of Caesarea. But below the Rooster of Caesarea it has the status of the Land of Israel. Rebbi Jonah asked: If his field was sown with vegetables and he came and found it full of rice, is the vegetable permitted and the rice forbidden? If the rice is high and the vegetable low, is the vegetable permitted and the rice forbidden? In fact, most of these fields produce these species! Even if you say that most of these fields produce these species, most of these kinds only come from forbidden areas.
A load of raisins came up to Tiberias. Gamliel the twin asked Rebbi Abba bar Kahana. He said to him: All of the Land of Israel does not produce a load of raisins. Does all of the Land of Israel not produce a load of raisins? But so he said to him: No single place in the land of Israel produces a load of raisins.
MISHNAH: One lets the poor and the stranger eat demay. Rabban Gamliel let his laborers eat demay. The House of Shammai say, the administrators of charity give the tithed food to those who do not tithe, and the untithed food to those who tithe, so that it turns out that everybody eats produce that is in order. But the Sages say, one collects without asking and one distributes without asking, and he who wants to put in order should put in order.
This is a baraita: “Rebbi Yose says, baskets of figs, baskets of grapes, and boxes of vegetables, as long as they are sold en bloc, are free. Rabban Simeon ben Gamliel said, the great Rebbi Yose sent me an etrog and said to me: this came into my hand from Caesarea. I understood from this three things: That it was certain, could become impure, and he did not have another one. That it was certain, because the fruits of Caesarea are certain. That it could become impure, because they sprinkle water on it. That he did not have another one, because if he had, he would have tithed from one on the other.” Why could he not have tithed from itself on itself? Because he was mindful of the saying of Bar Kappara, for Bar Kappara said that people do not send things that are defective to their friends. But is that not our Mishnah? “Rebbi Yose permits certain produce on condition that he inform him.” This tells you that, even though he disagreed with the rabbis, he did not act according to his own opinion.
Rebbi Zeïra asked before Rebbi Yasa: It this not from the fruits that are exempt at Caesarea? He said to him, did not Rebbi permit fruits at Caesarea? But Rabban Simeon ben Gamliel preceded Rebbi!
Rebbi Taypha the Red in the name of Rebbi Abbahu: Samaritans can be trusted with deposits. Is that not the Mishnah: “With a Samaritan”? Our Mishnah before they became suspect, he comes to tell us even after they became suspect. How is it, should he be trusted to say, I took it and replaced it by other deposits that were put in order? If you believe him in that he took it, you should believe him in what he gave. If you do not believe that he took, do not believe that he gave. You believe a Samaritan that he gave and you do not believe that he took. Rebbi Jonah asked: What are we talking about? If he says, they are my own, even an am haäreẓ should not be trusted. If he says, X took tithes for me, even the Samaritan should be believed. Rebbi Abba said, explain it according to him who says that a Samaritan is like a Gentile. As they disagreed: A Samaritan is like a Gentile, the words of Rebbi. Rabban Simeon ben Gamliel said, a Samaritan is like a Jew in every respect.
HALAKHAH: Both Rebbi Yose and Rabban Simeon ben Gamliel said the same thing. Just as Rebbi Yose said, we are not responsible for the dishonest, so Rabban Simeon ben Gamliel said, we are not responsible for the dishonest. It is reasonable that Rebbi Yose will agree with Rabban Simeon ben Gamliel, but Rabban Simeon ben Gamliel will not agree with Rebbi Yose. Rebbi Yose will agree with Rabban Simeon ben Gamliel that we are not responsible for the dishonest. But Rabban Simeon ben Gamliel will not agree with Rebbi Yose, because it is not fitting for a ḥaver that anything not in order should leave his house.

It was stated: “He who enters a town and does not know anybody there, or stands by a threshing floor and does not know anybody there, may ask either a ḥaver or an am haäreẓ, the words of Rabban Simeon ben Gamliel. Rebbi says, about heave one only may ask a ḥaver.” It turns out that Rebbi follows Rebbi Meïr and Rabban Simeon ben Gamliel follows his own reasoning. As we have stated there: “About any bodily defects that may be caused by humans, laymen shepherds are trustworthy, Cohen shepherds are not. Rabban Simeon ben Gamliel said, he is trustworthy about another’s flock but not his own. Rebbi Meïr said, whoever is suspect in a matter may neither judge nor testify about it.” Rebbi Jonah said, they disagree only if it is a matter of taking, but in distributing even Rabban Simeon ben Gamliel agrees. What is the difference between taking and distributing? A distribution is public knowledge.

HALAKHAH: Rebbi Joḥanan said, these are the words of Rabban Simeon ben Gamliel. But the words of the Sages are: From a Jew, he splits; from a Gentile, he gives heave. We have stated: “He who leases a field from a Gentile separates heave and then gives to him. Rabban Simeon ben Gamliel said: If the Gentile does not wish to give heave, I have no right to it, but he distributes and puts it before him.”

Rebbi Zeïra, Rebbi Joḥanan in the name of Rebbi Yannai (Num. 18:28): “You, also you,” to include your plenipotentiary. Just as you are in the covenant, so your plenipotentiary must be in the covenant. You appoint a plenipotentiary, the Gentile may not. Rebbi Yasa wanted to say that the Gentile cannot appoint as plenipotentiary another Gentile, but he can appoint a Jew. Rebbi Zeïra said, from the baraita itself: You appoint a plenipotentiary, does that not mean Jews? Similarly, the Gentile cannot appoint a plenipotentiary, not even a Jew. Rav Hoshaia objects: Does the baraita support Rebbi Joḥanan? “Rabban Simeon ben Gamliel said: If the Gentile does not wish to give heave from his produce, he cannot give heave” Rebbi Abba said, if he confirms it after him.
“If he received a field to harvest for early ears, grapes to harvest for baskets of grapes, olives to harvest for baskets of olives, he delivers as is.” That means, if (he is paid) in the same kind; but from another field, or from that field but not from the same kind, he must tithe before he delivers. Rebbi Ḥiyya stated: “From the same field, whether it be the same kind or another kind, he separates heave and delivers. From another field, whether it be the same kind or another kind, he tithes and delivers.” The Mishnah follows Rabban Simeon ben Gamliel; what Rebbi Ḥiyya stated follows the Sages, and they disagree. We also may come and state that the Mishnah deals with some place where barley usually does not yield twice as much as wheat; what Rebbi Ḥiyya stated refers to a place where barley usually yields twice as much as wheat.
HALAKHAH: It was stated: “If a Jew and a Gentile bought a field in Syria, it is as if ṭevel and tithed produce were mixed together, the words of Rebbi. Rebbi Simeon ben Gamliel says, the Jew’s part is obligated, the Gentile’s part is free.” Rebbi Yasa in the name of Rebbi Ḥanina: When do they disagree? If they split the field while the grain was standing. But if they split grain stacks, even Rabban Simeon ben Gamliel will agree with Rebbi that every single stalk belongs to the partnership. Rebbi Jonah said, Rebbi Yose in the name of Rebbi Joḥanan: When do they disagree? If they split the field while the grain was standing. But if they split sheaves, even Rabban Simeon ben Gamliel will agree with Rebbi that every single stalk belongs to the partnership. According to Rebbi Jonah, what is the difference between stacks and sheaves? If he harvests a small amount and shares with his partner. Rebbi Hoshaia said, that is, if they bought with the idea that they would not split. But if they bought with the idea that they always would split, Rebbi will agree with Rabban Simeon ben Gamliel that his part already belonged to him from the first moment. Rebbi Yose said, the words of the rabbis disagree since Rebbi Abbahu in the name of Rebbi Joḥanan said that partners are the subject of the disagreement between Rebbi and Rabban Simeon ben Gamliel. Are brothers who split not like these partners?

It was stated: “A Gentile who was calling out, ‘come and buy fruits from me, they are from an orlah tree, they are from a vineyard in its fourth year,’ cannot be believed. If he says, ‘I brought them from a certain Gentile,’ he may be trusted for restrictions, the words of Rebbi. The Sages say, the words of a Gentile are irrelevant.” Rebbi Judan asked, what if he calls out when he is uninformed? Rebbi Judan asked, what if one holds that a Samaritan is like a Gentile, since they disagreed: “A Samaritan is like a Gentile, the words of Rebbi. Rabban Simeon ben Gamliel says, a Samaritan is like a Jew in all respects”?
It was stated: “Rabban Simeon ben Gamliel says, if he exchanged the coin he has to tithe.” Rebbi Yose said, this means that if somebody gives coins to another person to exchange them, when they are lost the recipient is answerable for their alienation.
MISHNAH: A worker who does not believe his employer takes one dried fig and says: This one and the next nine shall be tithe for ninety that I shall eat. This one is made heave of the tithe for them. The Second Tithe is at the end and it is redeemed by a coin. He saves one fig. Rabban Simeon ben Gamliel says, he should not save because he reduces the work he will be able to do for his employer. But Rebbi Yose said, he should not save because that is a stipulation of the Court.
What is the reason of the rabbis? Because he intended to plough, even if it is not covering. It was stated: Abba Shaul said, “one does not oblige him to plough finely, only like the furrows of the rainy season. Rabban Simeon ben Gamliel says, it used to be called ‘horse tail,’ so that the end of dust of any one furrow touch that of the next one.” What is the reason of Abba Shaul? Since he started, it is enough up to a quarter. Does Abba Shaul hold with Rebbi Yose? He is with the rabbis, for the rabbis said, because he intended to plough, even if it is not covering. Abba Shaul says, because he started intentionally to plough, it is enough up to a quarter. Rebbi Yose said, he must finish that entire quarter.
So is the Mishnah: “One does not surround,” hence one may sow close up. Our Mishnah is Rebbi Jehudah’s, as it was stated: “One may surround by mustard or saffron only bulbous vegetables, the words of Rebbi Meïr. Rebbi Jehudah said, any field one may surround by mustard or saffron except a grain field. Rebbi Simeon said, any field one may surround by mustard or saffron. Rabban Simeon ben Gamliel said, one may surround small vegetable beds by mustard or saffron.”
Rebbi Yose said, Rebbi Gamliel, the son of Rebbi, went to the market. They came and asked him whether the roofing they mentioned referred to touching. He went and asked his father, who told him that the roofing they mentioned referred to touching. Rebbi Jonah said, Rebbi Hillel ben Rebbi Vales went to the market. They came and asked him whether the roofing they mentioned referred to touching. He went and asked his father, who told him that the roofing they mentioned referred to touching.
“Raw silk and silk noil”. Raw silk is μέταξα. Kalak silk is imperial ‘gbyn. Rabban Simeon ben Gamliel said, I went around among all sea-faring men and they told me that it was called kalka.
If it is so, why was it said: One ploughs until the New Year? Rebbi Crispus in the name of Rebbi Joḥanan: Rabban Gamliel and his court abolished the prohibition of the first two terms. Rebbi Joḥanan asked: Did we not state: No court may annul the words of another court unless it is greater in wisdom and numbers? Rebbi Crispus in the name of Rebbi Joḥanan: If they wanted to plough, they may plough. Then it should have been eliminated from the Mishnah! Rebbi Crispus in the name of Rebbi Joḥanan: If they wanted to re-establish it, they may do so.
MISHNAH: Three trees belonging to three different owners are counted together and one may plough the entire bet seah for them. How much space must be between them? Rabban Simeon ben Gamliel says, so that the ox and its harness can pass.
MISHNAH: Saplings and gourds go together in a bet seah. Rabban Gamliel says, if there are ten gourds in a bet seah, one ploughs the entire bet seah until New Year’s Day. How long are they called saplings? Rebbi Eleazar ben Azariah said, until they become profane. Rebbi Joshua said, seven years. Rebbi Aqiba said, tree saplings when they are called so. A tree which was cut down and grows anew, if it was cut lower than one hand-breadth it is like a sapling, higher than a hand-breadth it is a tree, the words of Rebbi Simeon.
HALAKHAH: “Saplings and gourds, etc.” That is only if there are more saplings than gourds. Rebbi Ḥananiah ben Rebbi Hillel asked, is that not reasonable only for Greek gourd? Rebbi Mana objected, did we not state: “Three green melons, three gourds, and four saplings go together and one ploughs the entire bet seah because of them.” It fits only for the last sentence: Rabban Gamliel says, if there are ten gourds in a bet seah, one ploughs the entire bet seah until New Year’s Day. Rebbi Ḥananiah ben Rebbi Hillel asked, is that not reasonable only for Greek gourd?
