Rav Ḥasdai said, each single one of ten Israel who dwell in one house must cede his rights. Rebbi Yasa said, each single one of ten Gentiles who dwell in one house must rent out his rights. Rebbi Abba said, it happened that a Persian’s wife rented out her courtyard without informing her husband. The case came before Rebbi Samuel and he declared it legal. They wanted to say, even his servant and farm-hand. Practice: An Israel cedes and the Gentile rents out. Then why should the Gentile not cede? He might change his mind. Then even if he rented out he might change his mind! From then on he would use it in robbery.
When Rebbi Jacob bar Aḥa went to a hostelry, when it was possible for him to put it in order, he did it. Otherwise he would spread out his clothing. He would put his staff at one place, his sandals at another, his wallet at another. Rabbi Mattaniah said, this you are saying if the hostel keeper was a Gentile. But if the hostel keeper was an Israel, he is not suspected to carry.
Rebbi Abba asked, is it the same in the matter of partitions? How is this? If there were two and they established one eruv, and a Gentile came and added; the Sabbath already had started in prohibition. If there were three but they established two eruvim and a Gentile came and opened; the Sabbath already had started in permission. The strength of Rebbi Abba is from the following: Any Sabbath which started in permission is permitted, in prohibition is prohibited, except one who cedes rights; and he would say, except one who cedes or leases. May one lease rights from the owner of a hostelry? Rebbi Ḥinena and Rebbi Jonathan went to Ḥammat Gader. They said, we shall wait until the Elders of the South arrive here. There came Rebbi (Peres) {Nathan] the Southerner; they asked him and he permitted. Rebbi Simeon ben Laqish heard it and said, since the Gentile may remove us, we did not do anything. Simeon bar Abba said, Rebbi Joḥanan asked, then our houses are not ours? Rebbi Justus ben Rebbi Simon in the name of Rebbi Boethos: Our houses are not ours, to dwell with us; but they cannot force us to leave; but in a hostelry they remove us.

A house where they deposited the eruv. The mother of Rebbi Jacob bar Aḥa had died when Rebbi Yasa said to Rebbi Abbahu, state it, and he stated: The House of Shammai forbid and the House of Hillel permit. Rebbi Hamnuna said, the house in which the eruv is deposited does not need anything. Rebbi Ḥasdai said, he is made like a partner. Rebbi Hamnuna told him, the words of the rabbis do not let you, as they disagreed: An alley in which on one side dwelt a Gentile and on the other a Jew, Rav Ḥuna in the name of Rav: even if they made an eruv through doors the Gentile prohibits it for them. Abba bar Ḥuna in the name of Rebbi Joḥanan, even if they made the eruv through windows the Gentile does not prohibit for them. If you are saying that he is like a partner, he should forbid. Rebbi Jacob bar Aḥa, Rebbi Yasa in the name of Rebbi Joḥanan: If the people of the alley deposited the eruv in two places, if because the space was not enough, it is permitted, if in order to split the eruv it is forbidden.

Rav Ḥuna in the name of Rav: There is no rule of enclosure for a Gentile; there is no rule of stone partitions for a Gentile. There is no rule of enclosure for a Gentile; for if he dwelt on an upper floor you take him down to forbid. There is no rule of stone partitions for a Gentile for if he dwelt in the inner [courtyard] you would take him out to forbid. Rebbi La in the name of Rebbi Eleazar: There is a rule of enclosure for a Gentile, for if an Israel and a Gentile were dwelling in the inner [courtyard] he never forbids unless there be two Israel. Rebbi Abba in the name of Rav Jehudah: He who has a stone partition inside his house ten hand-breadths high, if an Israel he does not forbid, if a Gentile he forbids. The argument of Rebbi Abba seems inverted. There Rebbi Abba said, Rav Jehudah in the name of Samuel: If a wall was surrounded by ladders on both sides one makes two eruvin but not one eruv. Rebbi Yose ben Rebbi Abun said, there because of the ladders they have the status of doors, but here from the upper floors one is used to descend, from the lower one is not used to ascend.

MISHNAH: If somebody leaves his house to stay in an other town for the Sabbath, whether he be Gentile of Jewish, he forbids, the words of Rebbi Meïr. Rebbi Jehudah says, a Gentile forbids but a Jew does not forbid since it is not Jewish to come on the Sabbath. Rebbi Simeon says, even if he left his house and went to keep the Sabbath at his daughter’s in the same town he does not forbid since already he does not think of it any more.

It was stated: “The House of Shammai say, one does not burn pure meat with impure meat, but the House of Hillel permit.” In the opinion of Bar Qappara it is understandable. One burns what is disqualified by the Torah with what is disqualified as impure by the Torah. And it was necessary to let hear, impurity by their words with impurity by the Torah. In the opinion of Rebbi Joḥanan, if one burns disqualified by the Torah together with impurity by the Torah, so much more impurity by the Torah together with impurity by the Torah. Rebbi Ḥananiah, the executive officer of the Cohanim, did state it in the name of the House of Shammai and the House of Hillel. Rebbi Mana said before Rebbi Yose: The opinion of Rebbi Joḥanan is understandable, for Rebbi Joḥanan said, for six doubts one was permanently suspending, but in Usha they decided burning for them. Was Rebbi Ḥananiah, the executive officer of the Cohanim, not before Usha? Before Usha there was no burning for their words. He told him, explain it if it became impure in a glass vessel. He retorted, even if you are saying that it became impure in a glass vessel, did not Rebbi Zeˋira, Rebbi Abuna say in the name of Rebbi Jeremiah, Yose ben Yoˋezer from Sereda and Yose ben Joḥanan from Jerusalem decided impurity for Gentile land and glass ware. [Rebbi Jehuda said, Jehudah ben Tabbai and Simeon ben Šetah decided on metal vessels. Hillel and Shammai decided on purity of hands.] Rebbi Jeremiah was of the opinion that for Gentile land there is suspension and for glass ware there is suspension. Rebbi Yose was of the opinion that for Gentile lands there is suspension, for glassware burning. The following are the six doubts: “On the doubt of a bet happeras, on the doubt of Gentile land, on the doubt of clothing of the vulgar, on the doubt of spittle, on the doubt of human urine which is separate from animal urine, on certain touch which is a doubt of impurity on these one burns heave.

What is it during Passover? Rebbi Jeremiah said, it is permitted. Rebbi Yose said, it is forbidden. If the roof of a Gentile was adjacent to a Jew’s roof and leavened matter rolled from the Gentile’s roof to the Jew’s roof, he pushes it away with a stick. If it was Sabbath or holiday, Rav said, he covers it with a vessel.

“If a Jew and a Gentile were travelling by ship and leavened matter was in the Jew’s hand, he sells it to the Gentile or gives it to him as a gift; then he reverts and buys it from him after Passover, on condition that it was an unconditional gift. The Jew may say to the Gentile, instead of buying it for a mina, come and buy it for 200 [denar]. Instead that you buy from a Gentile, come and buy it from a Jew, maybe I shall have need, then I shall buy from you after Passover.”

“If a Gentile comes to a Jew with leavened matter in his hand, one does not need to eliminate. If he deposited with him, he has to eliminate. If he gave him a separate room he does not need to eliminate.” If he did not eliminate, what is its status after Passover? Rebbi Jonah said, it is permitted; Rebbi Yose said, it is forbidden. Rebbi Yose said, it is the Gentile’s leavened matter [but] the Jew acted wrongly and did not eliminate.

There, we have stated: “A slave whom his master gave as mortgage to others and then freed him [in strict law does not owe anything, but for the public good one forces the master to formally manumit him and he writes a bond for his own value. Rabban Simeon ben Gamliel says, only the one who manumits writes.] Who frees? Rav says, either his first or his second master. Rebbi Joḥanan says, only his first master alone is able to free. Rebbi Haggai objected before Rebbi Yose: Does not a baraita disagree with Rav? If a Jew gave a loan to a Gentile on the latter’s leavened matter, it is permitted after Passover. If you say that the Jew has property rights in it, it would be forbidden. What does Rav do with this? Rebbi Yudan said, manumission is made easy, as it was stated: If somebody gives his slave as mortgage, if he sold him, he is not sold; if he freed him, he is freed. The strength of Rebbi Joḥanan is from the following: Rabban Simeon ben Gamliel says, only the manumittor writes. If somebody mortgaged his field to another, then went and sold it, can the creditor not come and foreclose? Rebbi Abbahu said, in this matter Rebbi Joḥanan opened for us a door to illuminate. We do not find that a slave can again be enslaved after having been freed. If that is so, he should not have to write a bond for his value! Rebbi Ila said, it is better that a person say to him, give me the 200 zuz which you owe me than say to him, you are my slave! The rabbis of Caesarea say in Rebbi Nasaʹs name: Rabban Simeon ben Gamliel follows Rebbi Meïr. Just as Rebbi Meïr imposes a fine for words, so Rabban Simeon ben Gamliel imposes a fine for words. As it was stated: With a bond documenting both principal and interest one can collect neither principal nor interest, the words of Rebbi Meïr. But the Sages say, one collects the principal but not the interest.
One may sit on a Gentile’s bench on the Sabbath. It happened that Rabban Gamliel was sitting on a Gentile’s bench at Acco on a Sabbath. They said to him, it is not our usage to sit on a Gentile’s bench on a Sabbath. He did not want to tell them that it is permitted to do this but got up and went away.

HALAKHAH: Is it permitted to raise them? Rebbi Abba said, for example Mahir which is sixteen by sixteen mil. They wanted to say, he who said it is permitted to sell [says] it is permitted to leave it alone. But he who says, it is forbidden to sell [says] it is forbidden to leave it alone. Rebbi Jonah, Rebbi Eleazar in the name of Rav: Even one who says it is permitted to sell it [says] it is forbidden to leave it alone. What is the difference between selling and leaving alone? There, because he intends to sell it to him it is like the Gentile’s animal. But here it is the Jew’s animal and he is suspected about it.
“Nowhere does one sell large animals to them.” What is the difference between large and small animals? For a large animal there might be an obligation for a purification offering; for a small animal there can be no obligation for a purification offering. But does he not shear, does he not milk? There he is liable; here would it be liable? But if it is sold, is it not the Gentile’s animal? The Babylonian Rebbi Immi in the name of the rabbis there: Sometimes he sells it on trial and returns it after three days, then it turns out that he did forbidden work with the Jew’s animal. Then on trial it should be forbidden, not on trial permitted. One is because of the other.
If he transgressed and sold one fines him. Just as one fines for practice so one fines for custom. From where that one fines for custom? A person sold his camel to an Aramean. The case came before Rebbi Simeon ben Laqish who fined him double to make him take back the camel. Rebbi Yose ben Rebbi Abun said, they fined the broker and called him son who brokers to an Aramean. Does Rebbi Simeon ben Laqish follow Rebbi Jehudah? As it was stated in the name of Rebbi Jehudah: “If somebody buys an animal from a Gentile and it gave birth to a firstling, he buys it up to its worth and gives half of its worth to a Cohen. If it was given to him as contractor, he has to pay for up to ten times its worth and gives all of its worth to the Cohen. But the Sages say, since the finger of the Gentile in involved it is no longer liable as firstling.” Rebbi Simeon ben Laqish follows Rebbi Jehudah and says more than Rebbi Jehudah. What Rebbi Jehudah said because of the practice of firstlings; but what Rebbi Simeon ben Laqish said because of practice regarding a large animal.

HALAKHAH: it is written: When retribution is retributed for Israel, when the people volunteered, praise the Eternal; the heads of the people volunteered. When the Holy One, praise to Him, does wonders for Israel, they should sing a song. They objected: There is the redemption from Egypt! That is something else since it was the beginning of their redemption. They objected. There is redemption of Mardocai and Esther! That is something else since they were outside the Land; some want to say that Mardocai and Esther were freed of their enemies, they were not freed from [Gentile] government.
MISHNAH: A person suffering from boulimy one feeds even impure food until his eyes light up. One does not feed the cover of a rabid dog’s liver to a person bitten by a rabid dog, but Rebbi Matthew ben Ḥarash permits it. In addition, Rebbi Matthew ben Ḥarash said, if somebody suffers from throat ache, one pours him medicine into it since it is an uncertainty of a danger to life, since any uncertainty of a danger to life pushes the Šabbath aside. If a wall collapsed over somebody, it is uncertain whether he is there or not, whether he is alive or dead, whether he is a Gentile or a Jew, one digs him out. If one finds him alive, one digs him out, if dead one shall leave him.
“One does not accept from the Non-Jew and the Samaritan.” Rebbi Abba said, explain it following him who said, a Samaritan is like a Gentile, as they disagreed: A Samaritan is like a Gentile, the words of Rebbi; Rabban Simeon ben Gamliel says, a Samaritan is like a Jew in all respects.

Rebbi Joḥanan said, at the start one accepts from them neither definite objects nor non-definite objects, and at the end one accepts from them definite objects but not non-definite objects. Rebbi Simeon ben Laqish said, both at the beginning and at the end one accepts from them neither definite objects nor non-definite objects. A baraita disagrees with Rebbi Joḥanan: “One does not accept from them voluntary gifts for Temple property for the upkeep of the Temple.” He explains it, both at the start and at the end, if it is for non-definite objects. A Mishnah disagrees with Rebbi Simeon ben Laqish: Everybody agrees that they make vows and are objects of vows. He explains it for elevation offerings. One understands that he makes a vow to bring an elevation offering. Can he be the object of a vow for an elevation offering? No, if an Israel says, I undertake to bring an elevation offering, when a Gentile hears him and says, I am undertaking what he says. Does he not bring libations with it? Is not the excess money given for libations used for vessels of Service? Then it turns out that he brought {money for} a definite object! Rebbi Yose ben Rebbi Abun objected, did we not state that they may offer their value? Are offerings of one’s value not for the upkeep of the Temple? It is as you are saying there, his intent was for Heaven; automatically it will be used for the upkeep of the Temple; so here you are saying, his intent was for Heaven; automatically it will be used for vessels of Service. How does Rebbi Simeon ben Laqish treat this? He explains, it is not upon you and us to build our God’s House. Rebbi Ḥilkiah said, Rebbi Simon asked: Does this imply that one does not accept from them for an aqueduct, or the city walls, or its towers, because of you have no part, nor rightful claim, nor memorial, in Jerusalem.
Rebbi Joḥanan said, what is in the hand of a Gentile is as found on a thoroughfare. Rebbi Eleazar ben Rebbi Ḥaggai was supporting Rebbi Mana. He saw an Aramean cutting from his horse and feeding his son. He said to him, that is what Rebbi Joḥanan said, what is in the hand of a Gentile is as found on a thoroughfare. He answered him, so said the great Rebbi Yose: Only if they saw him leaving a Jewish butcher shop. A man in Sepphoris went and wanted to buy red meat from a butcher, but he did not give to him. He told a Roman, who brought him. He said to him, did I not buy against your will? He retorted, did I not give carrion to him? Rebbi Jeremiah in the name of Rebbi Ḥanina: A case came before Rebbi who said, it is not believable to forbid the butcher shop of Sepphoris.

A roast kid goat was found in the main street of Gufta. They permitted it because of two things, as a find, and because of the majority of passers-by. As a find, as it was stated: If one saves from before a lion, from before an army, from a surge of the sea, or the surge of a river, from a wide road, or a wide plaza, it belongs to him, since the owners give up on them. Because of the majority of passers-by, because of a Gentile’s slaughter. It turned out that it was from the House of Rebbi.
A wheel of cheese was found in the hostelry of Levi. They permitted it because of two things, as a find, and because of the majority of passers-by. MISHNAH: If it was found in the countryside, limbs are carrion, cuts are permitted. On holidays, when meat is abundant, even limbs are permitted. Rebbi Simeon said, the Court stipulated seven things, and this was one of them: If a Gentile sent his elevation offering from overseas also sent its libations, they are brought from his property; otherwise they are brought from public money. Similarly, if a proselyte died and the estate includes well-being offerings; if he also has flour offerings they are brought from his property; otherwise they are brought from public money. It is a stipulation of the Court that the flour offering of a deceased High Priest be brought from public money; Rebbi Jehudah says, from his heirs, and it was brought whole. About salt and wood that the Cohanim may use them, and about the Cow that one does not commit larceny with its ashes. And about disqualified nests that they be charged to the public; Rebbi Yose says, he who provides the nests provides the disqualified ones.
HALAKHAH: “All spittle,” etc. Rebbi Abbin in the name of Rebbi Joshua ben Levi: A Gentile fortification was there. Rebbi Ḥanina said, they were stabbing wild donkeys in Jerusalem and the feet of the pilgrims were immersed in blood up to their knee joints. [They came before the Sages who did not tell them anything.] Rebbi Simeon bar Abba in the name of Rebbi Ḥanina: A Gentile fortification was there.

Did not Rebbi Abbahu say in the name of Rebbi Yose ben Ḥanina, they did not decide about spittle in Jerusalem? [Was it not said] about this, Rebbi Abbin in the name of Rebbi Joshua ben Levi: A Gentile fortification was there? In the remainder of the days of a year the impure ones are walking on the path and the pure ones are walking on the shoulder. The pure ones walk without saying anything, the impure ones tell them, keep apart. During a holiday the pure ones are walking on the path and the impure ones are walking on the shoulder. The impure ones walk without saying anything, the pure ones tell them, keep apart.
Rebbi Hoshaya stated: One answers Amen even if he did not eat, but he may not say: “Let us praise Him, of Whose bounty we ate,” except if he did eat. It is stated: “One answers neither an orphan Amen, nor a plucked Amen. What is an orphan Amen? Rebbi Huna said, that is one who is obligated to recite a blessing, he answers Amen, and is not conscious for what he answered Amen. It is stated: One answers Amen after a Gentile who recited a benediction for the Eternal, but if he recited a benediction with the Name one does not answer. Rebbi Tanḥuma said, if a Gentile blesses you, answer after him Amen since it is written You shall be blessed by all peoples. A Gentile met Rebbi Ismael and blessed him. He answered: The word about you has already been said. He met a second one who cursed him; he answered: The word about you has already been said. His students said to him: Rebbi, did you say to the one what you said to the other? He said to them, so it is written Those who curse you are cursed, but those who bless you are blessed.

How for vegetables? If a Jew collected on the eve of New Year’s day before it became dark, and a Gentile after dark, he gives tithe for each by itself.
Rebbi Ḥiyya in the name of Rebbi Joḥanan: At first they were saying, one curdles neither with the stomach content of the carcass nor with the stomach contents of the Gentile. They changed to say, one curdles with the stomach content of the carcass but not with the stomach contents of the Gentile. The stomach contents of a qualified animal which suckled from a ṭerefa are forbidden following the former teaching, and the stomach contents of a ṭerefa which suckled from a qualified one are permitted following the later teaching. And even if the House of Shammai would argue like the House of Hillel in the first teaching, an egg is a growth of its body; the contents of the stomach come from the outside. It parallels what Rebbi Yose ben Rebbi Abun said in the name of Rebbi Joḥanan: It happened to the sons of Jehudah ben Shamuai that wolves tore more than 300 of their flock. MISHNAH: One may not take from traps for wild animals, or fowl, or fish which he set before the holiday unless it was known that they were caught before nightfall. It happened that a Gentile brought fish to Rabban Gamliel who said they are permitted, but I do not want to accept from him.
The Elder Rebbi Ḥiyya and Rebbi Simeon ben Rebbi, one said a Gentile needs preparation, the other said, a Gentile does not need preparation. We did not know who said this and who said that. A student of Rebbi Simai went to Antipatris; they brought him Morocco-plums and he ate. A student of Rebbi Joshua ben Levi went there; they brought him Morocco-plums and he did not eat. He who translates and do not give of your offspring to be burned for Moloch as “do not allow your semen to impregnate a Gentile woman”: one silences him with rebuke.
Do not give of your offspring to be burned for Moloch, “do not allow your semen to impregnate a Gentile woman”. Rebbi Ismael stated, he who marries a Gentile woman and has children from her raises enemies of the Omnipresent.

He who dwells outside the Land or dwells in a hostelry in the Land of Israel for thirty days need not put up a mezuzzah. Longer than that he has to put up a mezuzzah. He who dwells in a rural tower for thirty days has to put up a mezuzzah. He who rents a house from a Jew has to put up a mezuzzah. He who rents a house from a Gentile has to put up a mezuzzah, and when he leaves he removes it, but from a Jew it is forbidden to act in this way. Rebbi Jacob bar Aḥa in the name of Rebbi Josias, because of what happened. It happened that a person removed and was burying his children. Rebbi Ze`ira in the name of Rebbi Eleazar: I wrote down for him most of My teaching. But was most of the Torah written down? Rather, more things are derived from what is written than what is derived from oral tradition. Is that so? But things derived from what is supported by a verse are preferred over those supported by oral tradition. Rebbi Judah ben Pazi said: I wrote down for him most of My teaching, these are the admonitions. Nevertheless, is it not that they were considered foreign? Rebbi Abun said: If I had written down for you most of my teaching, would it not be considered Gentile? What would be the difference between us and the Gentiles? These produce their books and those produce their books. These produce their parchments and those produce their parchments.
HALAKHAH: “If tax collectors entered a house, the house is impure. If they are accompanied by a Gentile they are trustworthy to say, we entered but we did not touch.” One may explain this by two explanations. They are trustworthy to say, we entered but we did not touch if witnesses know of it. And in Jerusalem they are trustworthy about sancta even if witnesses know of it. One may explain by another explanation: They are trustworthy to say, we entered but we did not touch. This is necessary {to be stated} even if witnesses know of it. And in Jerusalem they are trustworthy about sancta even if witnesses know of it.
Rebbi Joshua ben Levi asked Rebbi Simeon ben Laqish: may one buy houses from a Gentile? He said to him, about when does the Rabbi ask? On the Sabbath. It was stated: On the Sabbath it is permitted. How does one do it He shows him wallets full of denars and the Gentile signs and files it with the Archives. Since so we find that Jericho was only conquered on the Sabbath, as it is written, so you shall do during six days. And it is written, and on the Seventh Day you shall circle the city seven times. And it is written, until it is conquered, even on the Sabbath.

HALAKHAH: “The decree of seven”, sandal and soap. “The decree of thirty,” mending, and pressing, and shaving. What is pressing? New pressed woolen garments, and pressed white linen garments. Rebbi Ḥelbo, Rav Ḥuna in the name of Rav: If his eighth day fell on a Sabbath, he shaves on Friday. How is this possible? Explain it if he had been dragged away by a wild animal and they gave up hope to look after him. It was stated thus: When do you start to count for somebody who was dragged away by a wild animal? When they gave up hope to look after him. If they found separate limbs of him one counts when his head and most of his body had been found. Rebbi Jehudah says, spine and skull form the majority. Rebbi Abun said, explain it that the cover plate was laid Friday evening at the start of darkness. How is this possible? Rebbi Aḥa said, explain it if it was closed by a Gentile. Some wanted to say that he received a current notice on the Sabbath.
For blasphemy, from where? When king Hezekias heard the words of Rab Šake, he rent his garment. Does one have to rent for a Gentile’s blasphemy? According to him who said that Rab Šake was a Gentile, one rends. According to him who said that Rab Šake was a Jew, one does not rend. Rebbi Hoshaia stated: Both one who heard blasphemy from an Israel or one who heard blasphemy from a Gentile have to rent their garment. What is the reason? Since I am the Eternal, God over all [flesh], should anything be extraordinary to me?

HALAKHAH: “Any person who has a child anywhere”, etc. Rebbi Avin asked: “His child in every respect”, even for being fruitful and multiplying? Is there no difference between a Gentile who came to a Jewish woman and she gave birth and a Jew who came to a Gentile woman and she gave birth? “When she became Jewish and gave birth it is a first-born for inheritance but not a first-born for the Cohen.”

A Gentile came to a Gentile woman and she gave birth. Rebbi Joḥanan said, Gentiles have family relationships. Rebbi Simeon ben Laqish said, Gentiles have no family relationships. But is it not written: “At that time, Merodakh-Baladan, son of Baladan, king of Babylon, sent letters and a gift to Ḥizqiah.” Since he honored his elder, he was honored with a family relationship. But is it not written: “At that time, king Asa sent to Ben-Hadad, son of Tabrimon, son of Ḥezayon, king of Damascus, as follows.” Destroyer son of a destroyer. As you say: “For Haman ben Hamedata was”. Was he the son of Hamedata? That means, oppressor son of an oppressor. So here also, destroyer son of a destroyer. Rebbi Tanḥuma said, so did Rebbi Simeon ben Laqish answer Rebbi Joḥanan, but is there not written: “Ṣiba had sixteen sons and twenty slaves.” Do slaves have family relationships? It is to enumerate those who served Mephiboshet together.

A slave woman: “The woman and her children shall belong to her owner.” A Gentile woman. Rebbi Joḥanan said in the name of Rebbi Sineon ben Ioḥai, it is written: “You shall not conclude marriage with them”. And it is written: “For he will divert your son from after Me.” Your son from a Jewish woman is called your son; but your son from a Gentile woman is not called your son but her son.

Jacob from Kefar Naboraia went to Tyre. They came to ask him, may one circumcise the son of a Gentile woman on the Sabbath? He wanted to permit it from the verse: “They determined their genealogies for their families according to their fathers’ houses.” Rebbi Ḥaggai heard it and said, he shall come. They brought him in order to be whipped. He said to him, for what reason do you whip me? He said, from what is written: “Now we shall make a covenant for our God”. He said, you want to whip me based on tradition? He said, “and it should be done according to the Torah.” He said to him, from which teaching? He said, from that which Rebbi Joḥanan said in the name of Rebbi Simeon ben Ioḥai, it is written: “You shall not conclude marriage with them”. MISHNAH: The obligation of levirate is on the oldest [brother] but if a younger one got the start on him, he acquired. If somebody is accused in matters of a slave woman and she was manumitted, or of a Gentile and she converted, he should not marry her but if he married her one does not remove her from him. If somebody is accused in matters of a married woman and she was forcibly divorced from [her husband], even if he married her he must divorce her.
“If somebody is accused in matters of a slave woman and she was manumitted, or of a Gentile and she converted, he should not marry her but if he married her one does not remove her from him.” If he agreed lawfully not to marry her and [nevertheless] married her, she is forcibly removed from him. If he divorced her, may he take her back? If you would say that, would you not defame her children? “If somebody is accused in matters of a married woman,” Rav said, that is, he was accused by witnesses. Rebbi Yose asked, if he was accused by witnesses, is that what was stated: If he divorced her, even if he married her, he must divorce her? If somebody else divorced her, he can keep her! If he was accused by witnesses, even if somebody else divorced her, he must divorce her! But that is what we deal with: If he was accused not by witnesses, if somebody else divorced her, he may keep her.
Rebbi Meїr is suspicious about bills of divorce. Rebbi Jehudah is suspicious about a child. Rebbi Yose is suspicious about bills of divorce and a child. Could you say that Rebbi Meїr is not suspicious about bills of divorce, as we have stated: “Those that had received qiddushin can be married.” Rebbi Ze‘ira in the name of Rebbi Gedula: The one who repudiates does not have to wait three months; the one who leaves by a bill of divorce needs to wait three months. This supports Rebbi Me‘ir since Rebbi Meїr is suspicious about bills of divorce. Rebbi Abba in the name of Rebbi Abba bar Jeremiah: A woman who has been raped does not have to wait three months. This supports Rebbi Yose, since Rebbi Yose is suspicious about bills of divorce and a child. It was stated: The proselyte, the captive, and the slave woman who were redeemed, or converted, or freed, have to wait three months, the words of Rebbi Judah. Rebbi Yose says, they do not have to wait. Their blood, Rebbi Jehudah says, makes impure 24 hours retroactively; Rebbi Yose says, from its moment onwards. Rebbi said, the words of Rebbi Judah are reasonable for the blood, and the words of Rebbi Yose for the child. Rebbi Ḥanina ben Rebbi Abbahu said, my father had a case and he asked Rebbi Ḥiyya, Rebbi Yasa, and Rebbi Immi, and they instructed him following Rebbi Yose for the child. For if it were not so, what could we say? Between Rebbi Jehudah and Rebbi Yose, practice does not follow Rebbi Yose? But because Rebbi said, “they are reasonable”. Did not Rebbi Abba say in the name of Rebbi Ze‘ira, every time Rebbi taught “they are reasonable”, the disagreement is unresolved except in the case of the fig cake where each party to the controversy accepts the opposition’s argument. Rebbi Yose said, I stated a difficulty before Rebbi Ḥanina ben Rebbi Abbahu: Even if it is certain that they had sex? He said to him, is a normal Gentile not like one who had sex? Simeon bar Abba said, there came a case before Rebbi Joḥanan and he instructed following Rebbi Yose. Rebbi Eleazar was sorry about this; he said, one disregards the anonymous [Mishnah] and follows an isolated opinion! He found that Rebbi Ḥiyya stated it in the name of Rebbi Meїr. He understood that following Rebbi Simeon, he found that Rebbi Ḥiyya stated it in the name of Rebbi Meїr. He said, the old man certainly understands the chapters about bills of divorce.
Even though Rebbi Joshua said, the child of him who sleeps with his sister is acceptable, he agrees that if the child was female that she is blemished for the priesthood. Even though Rebbi Simeon ben Jehudah [says] in the name of Rebbi Simeon: If a Gentile or a slave came to a daughter of Israel, the child is acceptable, they agree that if she was female, she is blemished for the priesthood. A man came to Rav and said, since the children of this man’s mother are from an Aramean? He said, acceptable. Rav Ḥama bar Guria said to him, let your feet carry you away before Samuel comes and declares you blemished. Even though Rav said, if a Gentile or a slave came to a daughter of Israel, the child is acceptable, he agrees that if she was female, she is blemished for the priesthood.

There, we have stated: “If somebody receives [a flock] under mortmain conditions from a Gentile, the young are free, the young’s young are obligated.” Rebbi Jeremiah asked: There you say, the young are for the first, and here you say, the young are for the second! Rebbi Yosa said, there, because the property rights are with the first, the young belong to the first. But here, because the property rights are with the second, the young belong to the second.
“If they are unable to marry in Israel they disable.” These are: “A child of nine years and one day, an Ammonite, Moabite, or Egyptian proselyte, or a bastard, desecrated, Gibeonite, Samaritan, and Gentile who had intercourse with the daughter of an Israel, a Cohen, or a Levite, disqualified her for the priesthood. Rebbi Yose said, everybody’s intercourse disqualifies whose descendant would be disqualified; his intercourse does not disqualify those whose descendant would not be disqualified. Rabban Simeon ben Gamliel says, in all cases, if his daughter is permitted to you, so is his widow; if his daughter is not permitted to you, neither is his widow.” In what do they differ? Rebbi Joḥanan says, an Ammonite or Moabite proselyte is between them. For him who says, everybody’s intercourse disqualifies whose descendant would be disqualified, here since his descendant would be disqualified, his intercourse disqualifies. For him who says, if you may marry his daughter you may marry his widow, here since you may marry his daughter you may marry his widow. The words of the Sages? Rebbi Jeremiah in the name of [the rabbis], Rebbi Abba, both say: Regarding the daughter of an Ammonite or Moabite proselyte or the daughter of a second-generation Egyptian, even though his daughter is permitted to you, his widow is forbidden to you. Rebbi Zakkai: Rebbi Alexander sent to ask [about] the daughter of an Ammonite proselyte and the daughter of a second-generation Egyptian. Rebbi Yose said to him, did you not hear that Rebbi Jeremiah in the name of the rabbis, Rebbi Abba, both say: Regarding the daughter of an Ammonite proselyte or the daughter of a second-generation Egyptian, even though his daughter is permitted to you, his widow is forbidden to you. And everybody’s intercourse disqualifies whose descendant would be disqualified. Do we not need it when her mother was from Israel? That you should not say that since her mother was desecrated so her daughter was desecrated. In addition, Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed, the daughter of an Ammonite proselyte or the daughter of a second-generation Egyptian, Rebbi Joḥanan said, they are acceptable, Rebbi Simeon ben Laqish said, they are disqualified. Rebbi Yose ben Abun said, they disagree about the old women: Rebbi Joḥanan said, they are acceptable, Rebbi Simeon ben Laqish said, they are disqualified.
HALAKHAH: “A slave disables because of intercourse,” etc. From where that the intercourse with a slave disables? Rebbi Joḥanan said in the name of Rebbi Ismael: “If a Cohen’s daughter becomes a widow or a divorcee without issue,” from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. Rebbi Jeremiah objected: But if a widow whored she has no widowhood or divorce and she returns! Rebbi Yose did not say so, but [he held] that the argument of Rebbi Joḥanan is reversed. In Giṭṭin he says, why are Samaritans disqualified? Rebbi Joḥanan in the name of Rebbi Ismael: Because if a Gentile or a slave has intercourse with a Jewish woman, the child is a bastard. In Qiddushin one says, Rebbi Joḥanan and Rebbi Simeon ben Laqish both say, the child is a bastard. Here he says it in his own name but there he says it in the name of Rebbi Ismael! For also according to the words of the Sages the child is a bastard. Rebbi Ḥizqiah did not say so, but: the argument of Rebbi Joḥanan is reversed. In Giṭṭin he says, why are Samaritans disqualified? Rebbi Joḥanan in the name of Rebbi Ismael: Because if a Gentile or slave has intercourse with a Jewish woman, the child is a bastard. In Qiddushin one says, Rebbi Joḥanan and Rebbi Simeon ben Laqish both say, the child is a bastard. Here he says, from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. Rebbi Mattaniah said, I went to Seḥora and heard: Rebbi Joḥanan and Rebbi Ismael the sons of Jesua: “If a Cohen’s daughter becomes a widow or a divorcee without issue,” from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. And I said, that is correct, there is no bastard, following Rebbi Joshua, for a bastard is only from a woman which is for him under an incest prohibition and for whom one is punished by divine extirpation.
