The Jerusalem Talmud

Jerusalem Talmud Beitzah 1:33

MISHNAH: The House of Shammai are saying, one may not bring ḥallah and priests’ parts to a Cohen on the holiday, whether they have been separated the day before or on the day itself, but the House of Hillel permit. The House of Shammai said to the House of Hillel, it is an equal cut. Ḥallah and priests’ parts are a gift to the Cohen, and heave is a gift to the Cohen. Just as one may not bring heave to the Cohen, so one may not bring these parts. The House of Hillel said to them, no. If you mention heave where he has no right to separate, what can you say about the gifts which he may separate?

Jerusalem Talmud Beitzah 1:34

HALAKHAH: It was stated: “Rebbi Jehudah said, the House of Shammai and the House of Hillel did not disagree that one may bring parts which were separated on the holiday, as well as parts which were separated before the start of the holiday with parts separated on the holiday. Where did they disagree? About parts which were separated before the start of the holiday by themselves, where the House of Shammai forbid and the House of Hillel permit.”

Jerusalem Talmud Beitzah 1:35

It is difficult for the House of Hillel, could he not have the right to separate heave? Think of it, if he made a stipulation! One because of the other. And why was ḥallah stated? Because of ḥallah which was separated on the holiday. As it was stated: “if one kneads dough on a holiday, he separates its ḥallah on the holiday. If he kneaded it before the holiday but forgot to take its ḥallah, it is forbidden to move it; it is unnecessary to say, to take ḥallah from it.” If he mixed water and flour? He only mentioned “kneaded”, so not when he mixed? Rebbi Samuel, brother of Rebbi Berekhiah, said: explain it if the dough was impure where he takes ḥallah only at the end. Rebbi Yose ben Rebbi Abun said, it should have been the rule that for pure dough one should take ḥallah only at the end. They instituted that one should take it at the start, lest the dough become impure. The Mishnah is about the holiday of Passover; therefore on Pentecost and Tabernacles it is permitted. Rebbi Yose ben Rebbi Abun, Rebbi Ḥuna in the name of Rebbi Aḥa, even on Pentecost and Tabernacles it is prohibited, because of no work shall be done on them.

Jerusalem Talmud Beitzah 1:36

MISHNAH: The House of Shammai say that spices are pounded in a wooden mortar, and salt in a container or with a cooking spoon. But the House of Hillel say that spices are pounded normally in a stone mortar and salt in a wooden mortar.

Jerusalem Talmud Beitzah 1:39

MISHNAH: If one selects out legumes on the holiday, the House of Shammai say he picks out the food and eats. But the House of Hillel say, he picks out normally into his chest or a basket, but not on a tablet, not with a fine sieve nor with a coarse sieve. Rabban Gamliel says, also he drenches and scoops off.

Jerusalem Talmud Beitzah 1:40

HALAKHAH: Rebbi Jonah asked, if he did this on the Sabbath, in the opinion of the House of Shammai would he be liable? Rebbi Yose said to him, why not? If he did it on the Sabbath would he not be liable according to the House of Hillel? And here he is liable. Rebbi Mana said, my father Rebbi Jonah said it correctly. It is a problem only for the House of Shammai. Why? Because the category of selecting was permitted on the holiday, nothing of the category of selecting was permitted on the Sabbath.

Jerusalem Talmud Beitzah 1:44

MISHNAH: The House of Shammai say, on a holiday one sends only portions, but the House of Hillel say one sends domestic animals, wild animals, and birds, whether alive or slaughtered. One sends wines, oils, and flour, and legumes, but no grains. Rebbi Simeon permits grains.

Jerusalem Talmud Beitzah 2:1

MISHNAH: If the holiday falls on a Friday a person may not cook on the holiday especially for the Sabbath but he may cook for the holiday and if he left over he left over; or he cooks a dish before the holiday and relies on it for the Sabbath. The House of Shammai say two dishes, but the House of Hillel say one dish. But they agree about a fish and the egg on it that they are two dishes. If he ate it or it was lost, he may not start cooking based on it, but if even a minute amount was left, he relies on it for the Sabbath.

Jerusalem Talmud Beitzah 2:6

“ It was stated: Rebbi Simeon ben Eleazar said, the House of Shammai and the House of Hillel agree that there are two dishes. Where do they disagree? About the fish and the egg on it, where the House of Shammai are saying it is one dish while the House of Hillel are saying they are two dishes. Everybody agrees that if he applied the egg on salted fish, or cut leeks under the fish, or cooked two kinds in a pot, that they are counted as two dishes.” And practice follows the student.

Jerusalem Talmud Beitzah 2:6

Jerusalem Talmud Beitzah 2:8

MISHNAH: If it falls after the Sabbath, the House of Shammai say that one immerses everything before the start of the Sabbath, but the House of Hillel say implements before the Sabbath and humans on the Sabbath.

Jerusalem Talmud Beitzah 2:15

MISHNAH: The House of Shammai say, one brings well-being offerings without leaning on them, but not elevation offerings; but the House of Hillel say one brings both well-being and elevation offerings and one leans on them.

Jerusalem Talmud Beitzah 2:16

HALAKHAH: The House of Shammai say, irregular leaning-on was permitted. But the House of Hillel say, irregular leaning-on was not permitted. What is irregular leaning-on? From the day before. Rebbi Ze`ira said, everybody agrees that he did not fulfill his obligation regarding the reparation offering of a sufferer from skin disease if he leaned on the day before; he fulfilled his obligation with voluntary well-being offerings for which he leaned on the day before. Where do they disagree? The festival well-being offerings. The House of Shammai treat them like voluntary well-being offerings; the House of Hillel treat them like the reparation offering of a sufferer from skin disease. Rebbi Yasa said, that what you are saying, he did not fulfill his obligation regarding the reparation offering of a sufferer from skin disease if he leaned on the day before, {only} on time. If its time has passed it becomes like voluntary well-being offerings.

Jerusalem Talmud Beitzah 2:17

“The House of Hillel said to the House of Shammai: Since at a time when I forbid to the private person I am permitting it for Heaven, when it is permitted for the private person is it not logical that it be permitted for Heaven? The House of Shammai said to them, vows and voluntary gifts are proof, since they are permitted to the private person but forbidden to Heaven. The House of Hillel said to them, no. If you are speaking about vows and voluntary gifts which have no fixed time, what does this imply for the festival offering which has a fixed time? The House of Shammai answered them, the festival offering has no fixed time since if he did not offer it on the first day, he may offer it on the second day, if he did not offer it on the second day, he may offer it on the third day. The House of Hillel told them, the festival offering has a fixed time, for if he did not offer it on the holiday of pilgrimage he may not offer it after the holiday. The House of Shammai said to them, is it not already said: only what can be eaten by any person this alone may be made for you? The House of Hillel answered them, is that a proof? For you it may not be made, [but] it is made for Heaven. Abba Shaul says it was based on another reason: Since when your stove is closed down, your Master’s stove is open, when your stove is open it only is logical that your Master’s stove should be open. Another explanation: It is not in order that your table should be full but the table of your Creator be empty.”

Jerusalem Talmud Beitzah 2:17

Jerusalem Talmud Beitzah 2:18

Rebbi Yose ben Rebbi Abun said, Rebbi Simeon ben Laqish was passing by the school when he heard them reciting the verse, they sacrificed animal sacrifices and brought elevation sacrifices the next day. He said, he who interrupts follows the House of Shammai; he who reads it as one sentence follows the House of Hillel. One understands elevation sacrifices the next day; but well-being sacrifices the next day? Are not well-being sacrifices brought following the House of Shammai? Rebbi Yose ben Rebbi Abun said, David died on Pentecost; all of Israel were deep mourners and they brought the next day.

Jerusalem Talmud Beitzah 2:19

“It happened that Hillel the Elder brought his elevation offering to the Temple courtyard and leaned on it. The students of Shammai ganged up on him. He started to wag its tail, said to them, look, it is a female and I brought it as well-being sacrifice, and kept them talking about other matters until they left. After some time the House of Shammai became strong and they wanted to fix practice following their words. There was there Bava ben Bitay from the students of the House of Shammai who realized that practice followed the House of Hillel. Once he entered the Temple courtyard and found it desolate. He said, the house of those who make our God’s House desolate shall be desolate. What did he do? He sent and brought 3’000 sheep from Qedar sheep, checked them for defects, and displayed them on the Temple Mount. He said to them, listen to me my brothers, the House of Israel. Anybody who wants to bring an elevation sacrifice may bring it and lean on it, to bring a well-being sacrifice may bring it and lean on it. At that moment, practice was fixed following the House of Hillel; and nobody said anything.” Rebbi Isaac ben Rebbi Eleazar said, (this implies) <this cup> for breakfast has to be full; the (poison) <worm> in the wood comes from itself; any coal which does not cause a burn at the start will not cause one. “Again it happened that a student of Hillel brought his elevation offering to the Temple courtyard and leaned on it. A student of Shammai saw him and said to him, what is this leaning-on? He said to him, what about being silent? He silenced him by a reprimand and he left.”

Jerusalem Talmud Beitzah 2:20

MISHNAH: The House of Shammai are saying that a person may prepare hot water for his feet only if it is drinkable, but the House of Hillel permit. One may make a pyre and warm himself by it.

Jerusalem Talmud Beitzah 2:21

HALAKHAH: One explains this by two explanations: in the opinion of the House of Shammai if he drank from it; in the opinion of the House of Hillel if it is drinkable.

Jerusalem Talmud Beitzah 2:22

“One may make a pyre and warm himself by it.” This is everybody’s opinion on condition that there be a kettle by the pyre. One may explain it by another explanation: In the opinion of the House of Shammai, on condition that there be a kettle by the pyre. In the opinion of the House of Hillel, even if there is no kettle by the pyre.

Jerusalem Talmud Beitzah 4:9

It was stated: “Rebbi Eleazar ben Rebbi Simeon said, the Houses of Shammai and Hillel did not disagree that one brings wood from the field from what was collected, but from a corral even what was strewn about. Where did they disagree? About what is strewn about in a field, where the House of Shammai forbid but the House of Hillel permit.

Where did they disagree? About what is strewn about in a field, where the House of Shammai forbid but the House of Hillel permit.

Jerusalem Talmud Beitzah 4:10

Rebbi Nathan said, The House of Shammai agrees with the House of Hillel that one brings wood from the field from what was collected, and from a corral what was collected. Where did they disagree? About what is strewn about in a corral, where the House of Shammai forbid but the House of Hillel permit.” Rebbi Yose in the name of Rav Jeremiah, Rebbi Ḥaninah brings it in the name of Rav: practice follows the person who restricts, [including] what was strewn about in a corral. The opinion of Rebbi Jehudah seems inverted, as we have stated there, “[Rebbi Jehudah says], even if it only contains a cistern, or an irrigation ditch, or a cave, one carries in it..” And here he says so? Rebbi Mana said, Rebbi Jehudah treated it as a house.

Jerusalem Talmud Beitzah 4:16

“Neither with a hatchet.” In the House of Rebbi Yannai they are saying, one splits with a hatchet. Rebbi Hoshaia stated, one splits with a hatchet. Samuel said, practice follows him who said, one splits with a hatchet. It was stated: Rebbi Yose ben Kipper said in the name of Rebbi Eleazar ben Shamua, the House of Shammai forbid but the House of Hillel permit.

Jerusalem Talmud Beitzah 4:37

“In addition, Rebbi Eliezer says, a person stands by the Muqṣeh on a Sabbath eve in a sabbatical year and says, from here I shall eat tomorrow.” The argument of Rebbi Eliezer seems inverted, as we have stated there, “the House of Shammai say, one may not take unless one had moved when it was still daylight,” and is Rebbi Eliezer not a Shammaite? One is restrictive if living things are involved. “But the Sages say, only if he delineates and says, from here to here.” The argument of the Sages seems inverted, since we have stated there “the House of Hillel say, he may stand there and say, this and that I shall take,” and here they are saying so? Still they hold that one is restrictive if living things are involved.

Jerusalem Talmud Beitzah 5:18

“Nor dance.” Rebbi Jeremiah, Rebbi Ze`ira in the name of Rav Ḥuna: Jumping: one lifts both legs simultaneously. Dancing: one lifts one and keeps the other down. Rebbi Eleazar said, all sound making is forbidden on the Sabbath. Rebbi Samuel bar Rav Isaac was of the opinion to knock for a new synagogue. Rebbi Hillel son of Rabbi Vales would knock on a cup. Rabbi Ila stayed late at the great assembly. When he went home, he found them sleeping. He lay down on the stairs so as not to knock on the gate on the Sabbath. Rebbi Jeremiah explained Scripture with Rebbi Immi’s son. He went and wanted to wake him up in the morning of the Sabbath. He started knocking on the door. His father told him, who did permit this to you? Rebbi Abba bar Cahana asked before Rebbi Yasa, may one knock on a belly on the Sabbath? He said to him, who permitted that on a weekday? Rebbi Samuel ben Eudaimon said, the rabbis are accustomed on a weekday from the navel upwards, through his clothing from the navel downwards.

Jerusalem Talmud Beitzah 5:24

May one light an idle candle? Ḥizqiah said, it is forbidden. A baraita disagreed with Ḥizqiah: “Do not make fire in all of your dwelling places on Sabbath day. On the Sabbath you may not make fire, but you make fire on a holiday.” If you would say, we deal with cases connected with food, is there not written, only what can be eaten by any breathing being, that alone may be made by you. Therefore what we are dealing with an idle candle. Rebbi Avuna said, it was stated there, the House of Shammai forbid but the House of Hillel permit. Rebbi Naḥum the brother of Rebbi Ila asked before Rebbi Joḥanan. He said to him, do neither forbid nor permit.

Jerusalem Talmud Taanit 4:29

Rebbi Levi said, they found a genealogical scroll in Jerusalem and in it was written: Hillel from David, Ben Yaṣaf from Asaph, Ben Ṣiṣit Hakkeset from Abner, Ben Qubisin from Ahab, Ben Kalba Savua` from Kaleb, Rebbi Yannai from Eli, Men Yehudah from Sepphoris, the Elder Rebbi Ḥiyya from the sons of Shephatya ben Abutal, Rebbi Yose ben Rebbi Ḥalaphta from the sons of Yonadav ben Rekhav, Rebbi Neḥemiah from Nehemiah the governor.

Jerusalem Talmud Megillah 4:39

HALAKHAH: There, we have stated, “A blind person is not exiled, the words of Rebbi Jehudah; Rebbi Meïr says, he is exiled.” And both of them explained the same verse, without seeing. Rebbi Jehudah says, to include the blind person. Rebbi Meïr says, excluding the blind person. And here we have stated, “a person who never saw light does not spread out the Shema`.” Therefore if he saw he spreads. Rebbi Ḥaggai asked before Rebbi Yose, is the argument of Rebbi Jehudah inverted? There he says, excluding, but here he says, to include. Rebbi Ḥanania the son of Rebbi Hillel said, the Mishnah is about one sitting in a dark house. So we are saying, “one sitting in a dark house may not spread the Shema`.” But here, without seeing, to include the blind person.

Jerusalem Talmud Chagigah 1:1

MISHNAH: All are obligated to appear except the deaf-mute, the insane, and the child, and the sexless, and the hermaphrodite, women, and unemancipated slaves, the lame, and the blind, and the sick, and the child, and anybody who cannot ascend on his feet. Who is a child? Any who cannot ride on his father’s shoulder from Jerusalem to the Temple Mount, the words of the House of Shammai. But the House of Hillel say, any who cannot hold on to his father’s hand and climb from Jerusalem to the Temple Mount, as it is said, three walking occasions.

Jerusalem Talmud Chagigah 1:16

Rebbi Joḥanan in the name of Rebbi Yannai: The House of Shammai and the House of Hillel explain the same verse. The House of Shammai are saying, one verse says your males, and another verse says, walking occasions. Take in between them the one able to ride on his father’s shoulder. But even a {very} small one can ride on his father’s shoulder; must he fulfill his obligation? But one who sees his father’s shoulder and runs to him. The House of Hillel explain: one verse says your males, and another verse says, walking occasions. Take in between them the one able to grab his father’s hand. But in matters of purity you are saying, if he grabs his father’s hand, in matters of doubt he is treated as intelligent being. If his father grabs his hand, [in case of doubt] he is treated as deaf-and-dumb. But here in both cases he is liable.

Jerusalem Talmud Chagigah 1:16

Rebbi Joḥanan in the name of Rebbi Yannai: The House of Shammai and the House of Hillel explain the same verse. Jerusalem Talmud Chagigah 1:21

MISHNAH: The House of Shammai say, the sacrifice of appearance is two silver coins, and the festival sacrifice one obolus. But the House of Hillel say, the sacrifice of appearance is one silver obolus, and the festival sacrifice two silver coins.

Jerusalem Talmud Chagigah 1:22

HALAKHAH: The sacrifice of appearance is elevation offerings, but the festival sacrifice is well-being offerings. The House of Shammai are saying, one increases elevation offerings and diminishes well-being offerings. The House of Hillel are saying, one diminishes elevation offerings and increases well-being offerings. Rebbi Tanḥum bar Ilai in the name of Rebbi Yose ben Ḥanina: The House of Shammai infer from the sacrifices [of Pentecost; the House of Hillel infer from the sacrifices] of the princes. The House of Hillel said to the House of Shammai, is it not better to be instructed from a private offering about private offerings and not to be instructed from public offerings about a private offering? The House of Shammai said to them, it is better to be instructed by something applicable to the future; do not refer to the sacrifice of the princes which is not applicable to the future.

Jerusalem Talmud Chagigah 1:22

The House of Shammai are saying, one increases elevation offerings and diminishes well-being offerings.

MISHNAH: Elevation sacrifices on a holiday come from profane money and well-being offerings from tithe money. On the first day of any holiday, the House of Shammai are saying from profane money but the House of Hillel are saying from tithe money.

Jerusalem Talmud Chagigah 1:26

HALAKHAH: Rebbi Tanhum bar Ilai in the name of Rebbi Yose ben Ḥanina: So answer the House of Shammai to the House of Hillel: May any obligatory sacrifice come from tithe? They said to them, if it were a weekday, could he not bring one from profane money and add the tithe money? And here he brings one from profane money and adds tithe money. From where that one may add [tithe money]? Rebbi Yose ben Ḥanina said, it is said here measure, and it is said there, for you cannot carry it. Since carrying mentioned there refers to tithe, so also here tithe. Rebbi Eleazar said, it mentions joy here and it mentions joy there. Since joy mentioned there refers to tithe, so also joy mentioned here refers to tithe. Could not all of them be brought from tithe money? Ulla bar Ismael said, it is said here measure and it is said there, the gift for Benjamin exceeded. Since gift which is mentioned there refers to one as principal and the remainder addition, so also here one is principal and the remainder addition. Rebbi Yose ben Rebbi Abun said, are not the voluntary well-being offerings like the well-being offerings of the holiday? Why does he add those verses? To tell you that for them one pushes aside the holiday.

The House of Shammai are saying, heaven was created first and afterwards earth. But the House of Hillel are saying, earth was created first and afterwards heaven. These are bringing proof for their assertion, and those are bringing proof for their assertion. What is the reason of the House of Shammai? In the Beginning God created heaven and earth. {A parable} of a king who made a chair. After he had made it he made its footstool: the Heavens are My throne and the Earth My footstool. What is the reason of the House of Hillel? On the day of the Eternal’s, God’s, making of earth and heaven {A parable} of a king who made a palace. After he built the foundations he built the upper structure: also My left hand founded the Earth and My right hand tended the Heavens. Rebbi Jehudah bar Pazi said, also the following supports the House of Hillel: in earlier times You founded the Earth, and the Heavens are the work of Your hands. Rebbi Ḥanina said, from the place from where the House of Shammai prove their assertion, from there the House of Hillel remove them. What is the reason of the House of Shammai? As for perfecting, the earth preceded, on the day of the Eternal’s, God’s, making of earth and heaven. According to the House of Shammai, the heaven after the First waited three days, First, Second, Third, to have offspring. On the Fourth, there shall be lights. After the students of the House of Shammai and students of the House of Hillel increased who did not sufficiently serve their teachers, disagreements increased in Israel and they were split into two sects; these declare impure and those declare pure, and the prior state will not be reconstituted until the arrival of David’s son.

“Hillel and Menaḥem did not disagree. Menaḥem left and Shammai entered.” Where did he leave to? Some are saying, from behavior he left to behavior. But some are saying, he left against his face, he and eighty pairs of students of the Sages, wearing golden tirqe, whose faces became black like the rim of a pot when they were told, write on a bull’s horn that you have no part in the God of Israel.

The House of Shammai treat them like voluntary well-being offerings; the House of Hillel treat them like the reparation offering of a sufferer from skin disease. For you it may not be made, [but] it is made for Heaven. Abba Shaul says it was based on another reason: Since when your stove is closed down, your Master’s stove is open, when your stove is open it only is logical that your Master’s stove should be open. Another explanation: It is not in order that your table should be full but the table of your (Master) [Creator] be empty.”

Jerusalem Talmud Chagigah 2:29

“It happened that Hillel the Elder brought his elevation offering to the Temple courtyard and leaned on it. The students of the House of Shammai ganged up on him. He started to wag its tail, said to them, look, it is a female and I brought it as well-being sacrifice, and kept them talking about other matters until they left. After some time the House of Shammai became strong and they wanted to fix practice following their words. There was there Bava ben Buta from the students of the House of Shammai who realized that practice followed the House of Hillel. Once he entered the Temple courtyard and found it desolate. He said, the house of those who make our God’s House desolate shall be desolate. What did he do? He sent and brought 3’000 young lambs from Qedar sheep, checked them for defects, and displayed them on the Temple Mount. He said to them, listen to me my brothers, the House of Israel. Anybody who wants to bring an elevation sacrifice may bring it and lean on it, to bring a well-being sacrifice may bring it and lean on it. At that moment, practice was fixed following the House of Hillel; and nobody said anything.” Rebbi Isaac ben Rebbi Eleazar said, this cup for breakfast has to be full; the worm in the wood comes from itself; any coal which does not cause a burn at the start will not cause one. “Again it happened that a student of Hillel brought his elevation offering to the Temple courtyard and leaned on it. A student of Shammai saw him and said to him, what is this leaning-on? He said to him, what about being silent? He silenced him by a reprimand and he left.”

MISHNAH: If Pentecost falls on a Friday, the House of Shammai are saying that its slaughter-day is after the Sabbath, but the House of Hillel are saying that it has no slaughter-day. They agree that if it falls on the Sabbath that its slaughter-day is after the Sabbath; the High Priest does not wear his garments, and one is permitted eulogies and fasting, in order not to support the words of those who are saying that Pentecost is on Sunday.

Jerusalem Talmud Chagigah 2:31

HALAKHAH: “If Pentecost falls on a Friday, the House of Shammai are saying that its slaughter-day is after the Sabbath, but the House of Hillel are saying that it has no slaughter-day.” But its day is its slaughter-day. Here the House of Shammai are saying, its slaughter-day is after the Sabbath, and the High Priest (wears) [does not wear] his garments (?)[.] It is an argument de minore ad majus. Since in a time where there are well-being and elevation offerings following the House of Hillel the High Priest does not wear his garments, in a time when there are no well-being and elevation offerings following the House of Shammai, not so much more?

“They agree that if it falls on the Sabbath that its slaughter-day is after the Sabbath.” So the House of Hillel are saying, its slaughter-day is after the Sabbath. Whose are the hides? Rebbi Tabi in the name of Rebbi Joshia: Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree. Rebbi Joḥanan said, of all watches. Rebbi Simeon ben Laqish said, of this watch. And you are saying, its slaughter-day is after the Sabbath; whose are the hides? The disagreement between Rebbi Joḥanan and Rebbi Simeon ben Laqish? Rebbi Joḥanan said, Pentecost has all of seven days as make-up. Rav Hoshaia objected: was it not stated, just as the New Moon is one day after its count, to Pentecost is one day after its count? Rebbi La said, if he did not bring his holiday sacrifice on the first day, he may bring it all seven days.

Jerusalem Talmud Chagigah 2:38

“But for sancta one immerses.” Anywhere we state “immerses” it means in 40 seah. But did we not state, “he who washes his hands in the Temple needs a quartarius”? Rebbi Eleazar said, here for impure hands, there fore pure hands. [Rebbi Ḥanina ben Rebbi Hillel said, even if you are saying here and there for pure hands, here and there for impure hands.] Here for dedicated Temple sancta, there for profane food prepared in the purity of sancta.

Jerusalem Talmud Chagigah 3:22

There we have stated: “The deep mourner touches but may not sacrifice nor take his part of meat in the evening.” There you are saying, he may touch. But here you are saying, he is forbidden to touch. Rebbi Yannai said, here when he put his mind to other things, but there if he did not put his mind to other things. Rebbi Yose asked, if he put his mind to other things should he not also be forbidden heave? How is this? As Rebbi Jeremiah said in the name of Rebbi Abba bar Mamal: They treated him like one who ate food which was of fourth degree for sancta. This implies that one who ate food which was of fourth degree for sancta is forbidden to eat but permitted to touch. And here he is forbidden to eat but permitted to touch. There we have stated: “For the House of Shammai are saying, she needs immersion at the end, but the House of Hillel are saying, she does not need immersion at the end.” Where do we hold? If about eating heave it is difficult for the House of Shammai; if about eating sancta it is difficult for the House of Hillel. Does she not lack expiation? Do people lacking expiation not need immersion for sancta? If you are saying that there one holds about heave, regarding what we have stated here the first part is everybody’s opinion and the second part in dispute. If you are saying that here one holds about heave, regarding what we have stated there the first part is everybody’s opinion and the second part in dispute. Rebbi Samuel bar Eudaimon said before Rebbi Mana, we are dealing with heave. There the reason of the House of Shammai is because of the unlearned, that they should not say, we saw a woman losing blood and eating heave.

Jerusalem Talmud Moed Katan 1:25

It was stated: If a person transports a casket from place to place the rules of collecting bones do not apply. Rebbi Aḥa said, that only is about a stone sarcophagus. But to a wooden casket the rules of collecting bones do apply. Rebbi Yose said, even to a wooden casket the rules of collecting bones do not apply. When is there collecting bones? If one transports them in a striped garment from place to place. And it was stated thus: In collecting bones one collects them bone by bone after the flesh has decomposed. Rebbi Ḥaggai in the name of Rebbi Ze`ira: Collecting bones {is} what it means. It was stated: There is no information about collecting bones. Rebbi Ḥaggai said, that is if he was informed the next day. But on the day itself there is information about collecting bones. Is there a minimum for collecting bones? Nikomachos stated before Rebbi Ze`ira: There is no minimum about collecting bones. About this, Rebbi Mana instructed Rebbi Hillel from Kifra to tear and mourn following Rebbi Aḥa but not to defile himself following Rebbi Yose. It was stated: When collecting bones one does not recite lamentations and dirges; one recites neither the blessings for mourners nor the consolations for mourners. These are blessings for mourners: <what is recited in the synagogue. These are consolations of mourners,> what is said in the row. It was stated: But one says words. What are words? The rabbis <of Caesarea> are saying, eulogies.

In case one carries him from place to place, as those who bury in Bet-Shearim. There are Tannaim who state, those here count from when the deceased left; those there count from when the cover plate was laid. There are Tannim who state, these and those count from when the cover plate was laid. Rebbi Simon in the name of Rebbi Joshua ben Levi: Everything goes after the head of the family. Rebbi Jacon bar Aḥa in the name of Rebbi Assi: As restriction. What means “as restriction”? If the head of the family was here, those here count from when the deceased left; those there count from when the cover plate was laid. If the head of the family is there, these and those count from when the cover plate was laid. As the following: The sister of Gamaliel the twin died. His brother Hillel came down to him. Rebbi Mana said to him, since you are the head of the family, when you come down to your brother take off your shoes.

Rebbi Joḥanan ben Nuri said, look how this practice is widespread in Israel! If one upholds the words of the House of Shammai, the child is a bastard following the words of the House of Hillel. If one upholds the words of the House of Hillel, the child is a bastard following the words of the House of Shammai. Rebbi Eleazar said, even though the House of Hillel and the House of Shammai disagreed about co-wives, they agree that the child is not a bastard, since a bastard is only from a woman which is forbidden to [a man] by an incest prohibition and one is subject to extirpation for [sinning with] her. Rebbi Tarphon said, I would love to have a daughter’s co-wife to marry her into priesthood. They asked Rebbi Joshua, what are children of a daughter’s co-wife? He said to them, you bring my head between two large mountains, between the words of the House of Shammai and those of the House of Hillel, that they should smash my brain. “Even though the House of Shammai and the House of Hillel disagreed about co-wives, and sisters, and an old bill of divorce, and a woman doubtfully married, and one who gives qiddushin in the value of a peruṭa, i. e., he who divorces his wife and spends the night with her in a hostelry, and that a woman receives qiddushin for at least a denar or the value of a denar, the House of Shammai did not refrain from marrying women from the House of Hillel or the House of Hillel from the House of Shammai but they behave truthfully and in peace, as it is said: ‘Love truth and peace.’ ” Bastardy is between them and you say so? In this matter, it was stated: “About anybody who wants to take upon himself the stringencies both of the House of Shammai and the House of Hillel it was said: ‘The silly one walks in darkness’. The leniencies of both of them, he is called wicked. Only either following the words of the House of Shammai in their leniencies and stringencies, or following the words of the House of Hillel in their leniencies and stringencies.” That is, before there came the disembodied voice. But after the disembodied voice was heard, “practice follows the House of Hillel forever.” And any who transgresses the words of the House of Hillel is deserving of death. It was stated: There came the disembodied voice and said: Both of them are the words of the Living God, but practice follows the House of Hillel forever. Where was the disembodied voice heard? Rav Bebai in the name of Rebbi Joḥanan: The disembodied voice was heard at Yabneh.
