Rebbi Yose and Rebbi Aḥa were sitting together. Rebbi Yose said to Rebbi Aḥa: Is it not reasonable that the end of the half a mil of Rebbi Neḥemiah is the moment (of Rebbi Yose)? He answered: I also am of that opinion. Rebbi Ḥizqiah does not say so but every single moment in the half a mil of Rebbi Neḥemiah is in doubt. Rebbi Mana said: I pointed out the difficulty before Rebbi Ḥizqiah from what we have taught (Zabim I,6): “He saw one emission during daytime and one at dusk or one at dusk and the next one the next day; if he knows that the emission at dusk was partially during daytime and partially during nighttime, he certainly is impure and needs a sacrifice but if it is questionable whether the emission occurred partially during daytime and partially during nighttime he certainly is impure but it is questionable whether he owes a sacrifice.” Rebbi Ḥiyya bar Josef asked before Rebbi Yoḥanan: Who is the Tanna who will split an emission into two? Rebbi Yose! I said to him: Here is your problem since you say that every single moment in the half a mil of Rebbi Neḥemiah is in doubt. What is his question good for? For the time when Elijah will come and say: that is dusk.

Rebbi Zeriqan and Rebbi Ammi in the name of Rebbi Simeon ben Laqish: The reason of Rebbi is (Ps. 119:62): “At midnight I get up to thank You for Your just laws.” And it is written (Ps. 119:148): “My eyes preceded night watches.” Rebbi Ḥizqiah said: Rebbi Zeriqan and Rebbi Abba, one explained the reason of Rebbi, the other the reason of Rebbi Nathan. He who explained the reason of Rebbi: “at midnight”. He who explained the reason of Rebbi Nathan (Jud. 7:19): “at the start of the middle watch.” How does Rebbi Nathan uphold the basis of Rebbi’s reason, “at midnight”? Sometimes “at midnight,” sometimes “my eyes preceded night watches.” How is that? When David had a state dinner, “at midnight.” When he ate by himself, “my eyes preceded night watches.” In no case did dawn come and found David asleep. That is what David said (Ps. 57:9): “Wake up, my honor, wake up, o harp and lute, I shall awake dawn.” My honor has to be awake because of the honor of my Creator. My honor counts for nothing before the honor of my Creator. I shall awake dawn, dawn will not awake me. His evil instinct was trying to seduce him and told him: David, usually dawn awakes kings and you say “I shall awake dawn!” Usually kings sleep until three hours into the day and you say “at midnight I get up!” But he answers, “for Your just laws.” What did David do? Rebbi Phineas in the name of Rebbi Eleazar ben Rebbi Menaḥem: He took a harp, put it on his headboard, got up at midnight and started playing on it so that his companions in the study of Torah should hear it. What were his companions in the study of Torah saying? When king David studies Torah, certainly we have to do it also! Rebbi Levi said: a lute was hanging in David’s window and in the night the North wind was blowing and moving it and it was playing by itself. This refers to what is written (2Kings 3:15): “It happened when the musical instrument was playing.” It does not say “when he played on the musical instrument” but “when the instrument was playing”; it was playing by itself.
These are the benedictions that one makes long: the benedictions for Rosh Hashanah and Yom Kippur, and the benedictions for a public fast day. From his benedictions one can tell whether someone is a scholar or is uneducated. These are the benedictions that one makes short: He who makes a benediction over a commandment and on fruits, the introductory paragraph of Grace, and the last benediction in Grace after the meal. Hence, all other benedictions one should make long. Ḥizqiah said: From what we have stated: He who makes it long is despicable, he who makes is short is praiseworthy, which means that this is not a principle. We have stated: One has to make long the benediction “Who saves Israel” on a fast day. Hence, the six additional benedictions he should not make long. Rebbi Yose said: You should not say: because this is part of Shemoneh Esreh one should not make it long, therefore it is necessary to say: One has to make long the benediction “Who saves Israel” on a fast day.
They asked before Rebbi Aḥiyya ben Rebbi Zeïra: How did your father do in practice, like the teachers here or the teachers there. Rebbi Ḥizqiah said, like the teachers here. Rebbi Yose said, like the teachers there. Rebbi Ḥanina said, it is reasonable like R. Yose, since R. Zeïra always chose the harder way and they chose the harder way, so he did what he was used to, like them.
Rebbi Joshua ben Levi said, his name is Ẓemaḥ. Rebbi Yudan, the son of Rebbi Aivu, said his name is Menaḥem. Ḥanina the son of Rebbi Abbahu said: they have no disagreement since the numerical value of one is the numerical value of the other: Ẓemaḥ is equal to Menaḥem. Since Rebbi Yudan the son of Rebbi Aivu said, it happened to a Jew who was plowing in the valley of Arbel that his ox was bellowing. An Arab passed by and heard the bellowing of the ox. He said to him: Jew, Jew, unharness your ox, unharness your plow because the Temple was destroyed. The ox bellowed a second time. He said: Jew, Jew, harness your ox, fix your plow because King Messiah has been born. He said to him: What is his name? Menaḥem. He said to him: What is his father’s name? Ḥizqiah. He said to him: Where is he? He said to him: At the king’s palace in Bethlehem in Judea. He went and sold his ox and plow and made himself a vendor of baby linens. He went to towns and left towns until he came to that town. All the women bought from him but the mother of Menaḥem did not buy. He heard the women say: Menaḥem’s mother, Menaḥem’s mother, come and buy for your son! She said: I would rather strangle him like a hater of Israel because he was born on the day the Temple was destroyed. He said to her: I like him, because for him it was destroyed and for him it will be rebuilt. She said to him, I have no money. He said to her, that does not bother me, come and buy for him! If you have nothing with you today, I shall return another day and I will take it then. After some time he went up to that town and said to her: How is your baby doing? She said to him: After you had seen me there came storms and raised him and tore him from my hands. Rebbi Abun said: We do not need to learn from that Arab, is it not a full verse (Is. 10:35): “The Lebanon will fall through a noble one”? And the next verse is (11:1) “A sprout will come from the stem of Jesse.”
Rebbi Ḥizqiah and Rebbi Jacob bar Aḥa were sitting at one place and Rebbi Jacob bar Aḥa had coins on him. There came the time for prayer, he unbound them and gave them to Rebbi Ḥizqiah. He bound them together little by little. They became untied and lost. He asked: What have you left?

Rebbi Nehemiah the son of Rebbi Ḥiyya bar Abba said: My father did not walk under the arch of Caesarea. Rebbi Ammi, Rebbi Ḥizqiah, Rebbi Cohen and Rebbi Jacob bar Aḥa went walking on those streets of Sepphoris. They came to the arch and Rebbi Cohen left. They reached a place of purity and he returned to them. He asked them: “What were you discussing?” Rebbi Ḥizqiah said to Rebbi Jacob bar Aḥa: “Do not tell him anything!” We do not know whether it was because he was angry that he left since one defiles oneself for words of Torah or whether it was because he was haughty.

Rebbi Yannai said: A Cohen defiles himself in order to see the king. When king Diocletian visited here, Rebbi Ḥiyya bar Abba was seen stepping over graves at Tyre in order to see him. Rebbi Samuel, Rebbi Abbahu, Rebbi Eleazar in the name of Rebbi Ḥanina: Rebbi did hang his tefillin on the headboard of his bed. Rebbi Ḥizqiah in the name of Rebbi Abbahu: But only that he should not do in the way of makers of palm leaf baskets but tefillin on top and the straps on the bottom.
Rebbi Abba in the name of Rav: Excrement until it is hardened like bone, urine all the time it makes moist. Ganiva said: All the time that its impression is visible. Samuel said: Until its surface is hardened. Simeon bar Abba in the name of Rebbi Yoḥanan: Until its surface is hardened. Rebbi Jeremiah, Rebbi Zeïra in the name of Rav: Excrement is forbidden even if it is hard like bone. Samuel said: Until its surface is hardened. Simeon bar Abba in the name of Rebbi Yoḥanan: Until its surface is hardened. Ḥizqiah said: Rebbi Abba is more restrictive for urine than for excrement? Rebbi Mana said to him: From that of Ganiva; he said to him: Even if it is hard like bone it is forbidden because its matter exists; urine’s matter no longer exists
Rebbi Ḥizqiah, Rebbi Jacob bar Aḥa, Rebbi Yasa in the name of Rebbi Yoḥanan: The following verse should never leave your lips: (Ps. 46:12) “The Eternal of hosts is with us, the God of Jacob is a refuge to us, Selah”. Rebbi Yose ben Rebbi Abin, Rebbi Abbahu in the name of Rebbi Yoḥanan and the colleagues: (Ps. 84:13) “O Eternal of hosts, hail to the man who trusts in You”.

HALAKHAH: It is written (Ps. 24:1): “The Eternal’s are the earth and what is in it, the dry land and its inhabitants.” He who profits from the world commits larceny until good deeds will permit him. Rebbi Abbahu said, it is written (Deut. 22:9) “Lest the fullness of the seed that you sow and the yield of the vineyard should be forbidden.” The entire world and its contents are like a vineyard. What is its redemption? The benediction. Rebbi Ḥizqiah, Rebbi Abun in the name of Rebbi Simeon ben Laqish: (Ps. 16:2) “Say to the Eternal, You are my Master, my good is only with You.” If you ate and recited the benedictions then it is as if you ate from your own. Another explanation: “My good is בל with you”, I am feeding My goodness to your body. Another explanation: “My good is בל with you”, all good things may be mixed together and come to you. Rebbi Aḥa said, what is “only with you?” I shall not bring any good things to the world without you. As it is said (Gen. 41:44) “Without you nobody may lift his hand.” Rebbi Ḥiyya stated: (Lev. 19:24) “Holy for praises”, this shows that it needs benediction before and after. From here did Rebbi Aqiba say that nobody should taste anything before he gives praise.
HALAKHAH: Rebbi Ḥizqiah in the name of Rebbi Jacob bar Aḥa: This is Rebbi Yehuda’s since Rebbi Yehudah makes trees like straws. Rebbi Yose said, it is everybody’s opinion since fruits of a tree are also fruits of the soil but fruits of the soil are not fruits of the tree. Rav Huna said, except for bread and wine. The Mishnah (6:1) says so: Except for wine because on wine one says “Creator of the fruit of the vine;” except for bread because on bread one says “He Who produces bread from the earth.”
Rebbi Ḥelbo, Rav Huna, Rav, in the name of the great Rebbi Ḥiyya: Bread that comes kisnīn needs a benediction before and after. Rebbi Ammi said that Rebbi Yoḥanan disagrees. Rebbi Mana asked Rebbi Ḥizqiah, in what does he disagree? When one ate from the same food during the meal? He said to him, even if one did not eat from the same kind during the meal. Rav Ḥaggai came in the name of Rebbi Zeïra: Even if one did not eat from the same kind during the meal.
“Nor over lamp and spices for the dead.” Rebbi Ḥizqiah and Rebbi Jacob bar Aḥa in the name of Rebbi Yose, son of Rebbi Ḥanina: That is, if they are put at the head of the bier. But if they are put in front of the bier one may recite the benediction; I say they are put there for the honor of the living.

Rebbi Ḥizqiah in the name of Rebbi Jeremiah: Rebbi Simeon bar Yoḥai used to say, “Valley, valley, get filled with gold denars,” and it got filled. Rebbi Ḥizqiah in the name of Rebbi Jeremiah: Rebbi Simeon bar Yoḥai used to say, I saw the people of the Future World and they are few. If they are three, I and my son are of them. If they are two, they are me and my son. Rebbi Ḥizqiah in the name of Rebbi Jeremiah: Rebbi Simeon bar Yoḥai used to say, Abraham should bring near from his back to my back; I shall bring near from my back to the end of all generations. Otherwise, Aḥiya from Shiloh should join me and I shall bring everybody near.

How much rain should fall that a man is required to recite a benediction? Rebbi Ḥiyya in the name of Rebbi Yoḥanan: At the start, that it should fertilize, at the end that the surface should be wet. Rebbi Yannai ben Ismael in the name of Rebbi Simeon ben Laqish: At the start, that it should fertilize, at the end that the seal of the amphora should be soaked. Is the seal ever soaked? But it is as if it were soaked. Rebbi Yose in the name of Rav Yehudah, Rebbi Jonah, Rav Yehudah in the name of Samuel: At the start, that it should fertilize, atthe end even a minimal amount. Rebbi Yose in the name of Rebbi Zeïra: It was said for fast days. Rebbi Ḥizqiah, Rebbi Naḥum, and Rav Ada bar Abimi were sitting. Rebbi Naḥum said to Rav Ada bar Abimi: Is it not reasonable that this was said for the benediction; he answered: Yes. Rebbi Ḥizqiah said to Rav Ada bar Abimi: Is it not reasonable that this was said for fast days; he answered: Yes. He said to him, why did you say “yes” here? He said to him, it is the argumentation of my teacher. Rebbi Mana asked Rebbi Ḥizqiah, who is his teacher? He said to him, Rebbi Zeïra. He said to him, but we say: Rebbi Yose in the name of Rebbi Zeïra: It was said for fast days.

They said, Rebbi Joḥanan changed his mind about this. Rebbis Jonah and Yose said, he did not change his mind; additionally, Rebbi La said in the name of Rebbi Ammi: Ḥizqiah and Rebbi Joḥanan disagreed. Ḥizqiah said, a man may split his obligation for two animals. Rebbi Joḥanan said, nobody may split his obligation for two animals, but for each one he has to have two silver coins in his hand.

Rebbi Simeon ben Laqish in the name of Ḥizqiah: A person adjoins an animal to an animal but no person may adjoin money to money. What may be done? There were before him ten animals, he sacrificed five of them on the first holiday. May the remainder push aside the last holiday? Rebbi Crispus said, Rebbi Joḥanan and Rebbi Simeon ben Laqish have differing opinions. One said, they push; the other one said, they do not push. We do not know who said what. Rebbi Zeïra said, we may explain the words of the rabbis through the words of Rebbi Joḥanan, who said: A person may adjoin coins to coins but not animals to an animal. He must say, they push. But Rebbi Simeon ben Laqish said, a person adjoins an animal to an animal but no person may adjoin money to money. He must say, they do not push. Simeon bar Abba came in the name of Rebbi Joḥanan: He adds and pushes the holiday further until he says: I do not intend to add further.
“Honoring father and mother.” Rebbi Abbahu in the name of Rebbi Joḥanan: They asked Rebbi Eliezer, how far does honoring father and mother go? He said to them, you are asking me? Go and ask Dama ben Netinah. Dama ben Netinah was the head of the city council. Once his mother was slapping him in front of the entire council and a slipper fell from her hand, and he handed it back to her so that she should feel no inconvenience. Rebbi Ḥizqiah said: He was a Gentile from Ascalon and the head of the city council. He never sat on the stone on which his father used to sit and when his father died, he worshipped the stone. Once the jaspis of Benjamin was lost. They inquired, who would have one of similar quality? They were informed that Dama ben Netinah did. They went to him and and agreed on 100 denars. He went to the upper floor to bring it and found his father sleeping. Some say that the key to the chest was in his father’s fingers; some say his father’s foot was resting on the chest. He descended to them and told them: I could not bring it to you. They thought, maybe he wants more money, and raised the price to two hundred, then to a thousand. When his father woke up from his sleep, he went up and brought it to them. They wanted to give him according to the amount mentioned last, but he refused. He said: Do I sell my father’s honor for money? I will not have any advantage from honoring my father. What reward did the Holy One, praise to Him, give him? Rebbi Yose bar Abun said: The following night, his cow gave birth to a red heifer and Israel gave him its weight in gold and took it. Rebbi Sabbatai said (Job 37:23): “Justice and much charity He will not suppress.” The Holy One, praise to Him, will not wait to give the reward for good deeds to the Gentiles.
From where that non-guaranteed property may be acquired with guaranteed property, by money, document, or possession? Rebbi Yose in the name of Ḥizqiah; Rebbi Jonah, Rebbi Ḥanina Tortaya in the name of Ḥizqiah, it is written (2Chr. 21:3): “Their father gave them many gifts, silver and gold and delicacies, with fortified cities in Jehudah.” So far real estate and movables were at the same place. If real estate was at one place and movables elsewhere? Rebbi Abin bar Ḥiyya said, let us hear from the following: Rebbi Eliezer said to them, it happened that a man from Madon was in Jerusalem, rich in movables. He wanted to distribute them, to give them as gifts. They said to him, you cannot do that except if you acquire real estate. What did he do? He went and bought a rock near Jerusalem and said: The Northern part I give to X with a hundred amphoras of wine, the Southern part I give to Y with a hundred amphoras of oil. The matter came before the Sages and they upheld his words. Rebbi Ḥananiah said before Rebbi Mana: But was he not bedridden? For in general a person might give property rights only in writing, and here even orally. In general, a person might give only if real estate and movables are at the same place, but here the real estate even was at one place and the movables elsewhere. He said to him: But is there a difference for Rebbi Eliezer? The sick person for Rebbi Eliezer is like the healthy person for the rabbis.

Who is bedridden? Anyone who did not get sick suddenly. It is customary for the relatives to visit him immediately; unrelated persons visit him after three days. If he falls ill suddenly, everybody visits him immediately. A clarification: Rebbi Ḥuna, Rebbi Phineas, and Rebbi Ḥizqiah went to visit Rebbi Yose after three days. He said to them: Do you want to sustain the baraita in my case?
HALAKHAH: Rebbi Jehudah said it well, what is the reason of the Rabbis? Rebbi Yose in the name of Rav, Rebbi Ḥizqiah, Rav Jehudah in the name of Samuel: It is written (Deut. 24:19): “If you forget a sheaf on the field.” If you forget the standing grain. What applies to forgetting while it is standing also applies to forgetting sheaves, but what does not apply to forgetting while it is standing, does not apply to forgetting sheaves.
If a Jew and a Gentile were partners in the standing grain, the part of the Jew is obligated but the part of the Gentile is free. Rebbi Ḥizqiah in the name of Rav Jeremiah: If it was divided up.
Rebbi Ḥizqiah, Rebbi Jeremiah, in the name of Rebbi Joḥanan: According to him who says that a Gentile may acquire real estate in the Land of Israel to free it from tithes. But according to him who says that a Gentile may not acquire real estate in the Land of Israel to free it from tithes, even if he declared it abandoned property it is obligated. Rebbi Yose in the name of Rebbi Joḥanan: According to him who says that a Gentile may not acquire real estate in the Land of Israel to free it from tithes. But according to him who says that a Gentile may acquire real estate in the Land of Israel to free it from tithes, the Sages decreed special leniency for gleanings.
Rebbi Eleazar asked, does he not acquire movables? Not on the last statement this was asked, but on the following: Rebbi Ḥizqiah, Rebbi Jeremiah, in the name of Rebbi Joḥanan: According to him who says that a Gentile may acquire real estate in the Land of Israel to free it from tithes. But according to him who says that a Gentile may not acquire real estate in the Land of Israel to free it from tithes, on this Rebbi Eleazar asked, does he not acquire movables? Rebbi Ḥanina in the name of Rebbi Phineas, also on the preceding one, on that of Rebbi Yose he asked: Rebbi Yose in the name of Rebbi Joḥanan: According to him who says that a Gentile may not acquire real estate in the Land of Israel to free it from tithes. But according to him who says that a Gentile may acquire real estate in the Land of Israel to free it from tithes, on this Rebbi Eleazar asked, does he not acquire movables?
HALAKHAH: It was stated: A quarter of rice, an ukla of spices, a pound of vegetables, three qab carob, half a log of wine, a quarter of a log of olive oil, ten nuts, five peaches, two pomegranates, one etrog. What is the reason? (Deut. 26:12) “They shall eat in your gates and be satiated,” give him to satisfy him. Ḥizqiah asked his father: From where do we get all these amounts? He said to them, a pebble supports a tower. Rebbi Ḥananiah was sitting before Rebbi Ilaï, the latter was giving a reason and the former destroyed it, the latter was giving a reason and the former destroyed it, until he said to him, is it not depraved to destroy instead of building up?
HALAKHAH: Rebbi Jonah refers the Mishnah to the case when he has more than the measure: If he wanted to save, he takes away half and gives half, but if he has only the measure, he puts it before them and they divide it up among themselves. Rebbi Ḥizqiah refers the Mishnah to the case when he has the exact measure: If he wants to save, he takes away one half and gives one half; since if he takes away one half and gives one half it becomes less, he puts it before them and they divide it up among themselves.
It was stated: “All of these, if he gave a name to their heave of the tithe or Second Tithe, what he did is done.” Rebbi Eleazar said, with the exception of the remainders of flour sacrifices. Rebbi Jeremiah said, the rest is in dispute. Rebbi Yose asked, what dispute? Where are we standing, if according to Rebbi Meïr, both for tithes and for the remainders of flour sacrifices, he did not do anything. If according to Rebbi Jehudah, what he did is done. Rebbi Mana said, I went to Caesarea and heard Rebbi Ḥizqiah who was sitting there, stating: “If a priest marries by means of his share in the holiest sacrifices or simple holy sacrifices, the marriage is not valid.” Rebbi Eleazar said, that is everybody’s opinion. Rebbi Joḥanan said, it is in dispute. I said to him, from whom did the rabbi hear this, and he said, from Rebbi Jeremiah. I said, this explains the matter! Rebbi Jeremiah, who heard that Rebbi Eleazar said, it is everybody’s opinion, he says it is in dispute. Rebbi Yose, who did not hear that, asked which dispute? If according to Rebbi Meïr, both for Second Tithe and for the remainders of flour sacrifices, he did not do anything, if according to Rebbi Jehudah, what he did is done.
Ḥizqiah said, nothing is missing for the owners but the credit by counting.
HALAKHAH: Rebbi Yose in the name of Rebbi Pedaiah, Rebbi Jonah in the name of Ḥizqiah, there is no mixing except for wine and oil. Rebbi Joḥanan says, they can be mixed up to the size of olives. Our Mishnah disagrees with Rebbi Joḥanan: “But he mixes together dates and dried figs and then gives.” He explains it up to olive-sized bits.
They asked before Rebbi Zeïra, in that situation, a Cohen to an Israel, what is the rule? At Rebbi Yose’s they said that he did not answer. Rebbi Ḥizqiah in the name of Rebbi Aḥa said, so he said to them: In the opinion of Rebbi Yose ben Rebbi Ḥanina, why is a Cohen to an Israel forbidden, not because it looks badly? Also Rebbi Joḥanan holds that from an Israel to an Israel it is forbidden because it looks badly. Rebbi Yose ben Rebbi Abun said, there is desecration of sacrifices and you said because it looks badly? Because of the following, as it was stated: “Cohanim and Levites who help at the threshing floor have no right either to heave or to tithe, and if the farmer gave, it is desecrated, as it is said (Lev. 22:15): ‘They should not desecrate the sanctified things of the Children of Israel,’ but they desecrate them! In addition, they said that their heave is no heave, their tithes are no tithes, their dedications are no dedications, and about them the verse says (Micha 3:11): ‘Their heads judge for bribes and their priests come for a price.’ The Omnipresent brings over them three catastrophies; that is what is written (Micha 3:12): ‘Therefore, because of you Zion will be ploughed over as a field, etc.’”
It was stated: “They agree that one does not sell a wheat stack, a grape vat, or an olive vat to anybody but a ḥaver or to somebody who is known to process in purity.” Is the grape vat not from the Torah? This does not disagree with Rebbi Joḥanan; just as Rebbi Joḥanan said, the little one is a restriction, so “vat of olives” is a restriction. Rebbi Ḥizqiah said to Rebbi Jonah in the name of Rebbi Jeremiah: They disagree about connections. Because everywhere “biting” is a connection, squeezing is not a connection. But here even squeezing is a connection; hence from the Torah they are enabled. Rebbi Jonah met Rebbi Jeremiah and asked him, did you say that? He said, that is not from me, even their enablings are restrictions. Did we not state: “They agree that one does not sell a wheat stack, a grape vat, or an olive vat to anybody but a ḥaver or to somebody who is known to process in purity?” Is the grape vat not from the Torah? Then the olive vat should be from the Torah! What about this? Explain it following Rebbi Meïr, since Rebbi Meïr said, sap is counted as a fluid.
HALAKHAH: Ḥizqiah said, they stated only turnips and radishes, nothing else. Rebbi Joḥanan said, there is no difference whether turnips, radishes, or any other plants. What are we talking about? If because of the rules of vegetables and trees, why do I need vine and radishes, even any other plants? If because he does not want them to take root, why turnips and radishes, even any other species also? From what Rebbi Ḥiyya stated, “for example bunches of turnips and bunches of radishes,” it follows that the reason is only because he does not want them to take root.
Does Rebbi Judah say that in this case it is not kilaim? Rebbi Zeïra said, Rebbi Jehudah follows his own opinion, since Rebbi Jehudah said, in the case of a vegetable field one hand-breadth. Rebbi Yose said, he who wants to question this statement of Rebbi Zeïra might deduce the opinion of Rebbi Jehudah from that of the rabbis. Just as the rabbis say, in the case of the prohibition of bet rova‘ one needs six-by-six to whip, so Rebbi Judah said in the case of the prohibition of six-by-six that one needs a hand-breadth to whip. But did we not state, Rebbi Judah permits it? Then it is difficult: what is the reason of Rebbi Simeon ben Laqish? Since he threw it out from his hand as seed, he is guilty. But did we not state that “Rebbi Jehudah says, it is not kilaim?” Explain it, until the moment that it comes to rest. But was it not stated that Rebbi Judah permits it? Even if it came to rest, Rebbi Jehudah permits it. Rebbi Illaï said, Rebbi Simeon ben Laqish follows his own opinion, since Rebbi Simeon ben Laqish said in the name of Ḥizqiah: A vertex from a dry spot is permitted. Then it also should be thus in the case of two wheat grains and one of barley? That is correct. But did we not state, “unless there are two wheat kernels and one barley kernel, or one wheat kernel and two barley kernels, or one each of wheat, barley, and spelt?” Explain it if there is a grain of wheat on each side, a fence on each side, and the grain of barley caught in the middle. Rebbi Mattaniah said, that is only if there is no dry spot, but if there is a dry spot there, it is permitted.
HALAKHAH: Rebbi Zeïra, Rebbi Eleazar, in the name of Rebbi Ḥiyya the Elder: He makes it two by two cubits, but decreases continuously to an arbitrarily small distance. Rebbi Jonah said, that is, if it is subdivided into garden beds, but if all is one bed, it does not apply. This parallels what Rebbi Yannai said: I may sow my field with fifty kinds, twenty-five here and twenty-five there; this is in two rows. If that is so, would it be permitted even between himself and his neighbor? Or in a dry spot? Then it parallels what Rebbi Simeon ben Laqish said in the name of Ḥizqiah: A vertex from a dry spot is permitted! Rebbi said, he starts with an area of bet rova‘ and narrows it down to three furrows of the ploughshare. Does Rebbi not accept that between grains one needs a bet rova‘? That is for a square field, here for a garden bed. Do the rabbis not recognize garden beds? Rebbi Yudan said, the minimal distance for Rebbi is the maximal distance for the rabbis.
HALAKHAH: Rebbi Simeon ben Laqish in the name of Ḥizqiah: A vertex from a dry spot is permitted! Rebbi Joḥanan said, they stated only: “A vertex of wheat;” hence, a vertex that comes from a dry spot is forbidden.
Ḥizqiah said, if somebody has slightly more than a bet rova‘, then in that excess he may sow anything he likes. Rebbi Joḥanan said, he may sow in it only one kind. Rebbi Zeïra said, Rebbi Joḥanan agrees that if he had a bet rova‘ and a half, he may sow half a bet rova‘ from either side and the last half bet rova‘ is valid for both sides. A baraita disagrees with Rebbi Joḥanan: “ If he had fields, one sown with wheat and the other sown with barley, he may bring straw in between and sow one side with wheat and the other with barley because the wheat looks like the end of the wheat field, and the barley like the end of the barley field.” What does Rebbi Joḥanan do with that? He explains it following Rebbi Eliezer ben Jacob, for Rebbi Eliezer ben Jacob said: “Even if wheat after wheat comes close to barley, barley after barley comes close to wheat, it is permitted.” For wheat after wheat only comes close to barley (wheat), barley after barley comes close to (barley) [wheat], but if only one wheat stalk is absorbed into the barley, or one stalk of barley is absorbed into the wheat, then that is forbidden.
HALAKHAH: Rebbi Ḥizqiah, Rebbi Yasa, in the name of Rebbi Joḥanan: For the first part, Rebbi Meïr says, even jailed, even adjacent, but the rabbis say, on condition that they were neither jailed nor adjacent. How is that done? 3,2,1,2,l.
HALAKHAH: “If one plants two rows”, etc. Ḥizqiah said, there is disagreement. He who says there 12 [cubits], here also 12 [cubits]. He who says there eight, here also eight. Rebbi Joḥanan said, this Mishnah is according to everybody. A strip of melon is good enough among strips of melons to be saved by eight.
How long does it have to be to jail? Rebbi Zeïra said, let us infer it from a vineyard. Just as you say in regard to a vineyard that there is no difference between length and separation, so here also there is no difference between length and separation. That is fine according to the opinion of Ḥizqiah; there eight and here also eight. According to Rebbi Joḥanan, with how much will it jail? If you say with eight, is there an argument a fortiori that a strip of melons among onions will jail only with twelve? But a melon strip, which you empowered among melon strips to save by a mere eight, will be jailed by eight, melon strips among onions, which you weakened to save only by twelve, certainly will be jailed only by eight. If you say that a melon strip among onions will be jailed only by twelve, then an argument a fortiori shows that a melon strip among melons should be jailed only by twelve.
Rebbi Judan asked: What if he made a fence inside a fence? He said, if there are three hand-breadths one may sow there, otherwise one may not sow there. Rebbi Jacob bar Idi in the name of Rebbi Simeon ben Laqish: If there was a place of twelve cubits there, the circumference would be eliminated. Rebbi Ḥizqiah said, only if it is twelve by twelve. Rebbi Mana said, even if it continuously narrows.
HALAKHAH: Ḥizqiah said, the Mishnah speaks about distances from three to four hand-breadths. Less than three is close up, up to four one has to complete, four is easy for it. How far? Rebbi Jacob bar Idi in the name of Rebbi Simeon ben Laqish, up to four cubits. Rebbi Aḥa, Rebbi Ḥinena in the name of Rebbi Simeon ben Laqish, up to six cubits. Rebbi Mana said: I went to Caesarea and heard Rebbi Hoshiah bar Shammai in the name of Rebbi Isaac ben Eleazar: If there were two papyri, it is permitted. Rebbi Ḥinena said, a statement disagrees: If he usually oversteps, it is forbidden. It was stated thus: Rebbi Simeon ben Eleazar says, if he usually oversteps between lattices, it is treated as a single lattice.
Rebbi commanded three things on his death-bed: My widow should not move from my house; do not eulogize me in small towns; and he who served me during my lifetime should serve me in my death. “My widow should not move from my house,” is that not a Mishnah? “The widow who said, I cannot possibly move from my husband’s house …” Rebbi Dositheos said, that they should not say, this is the house of the patriarchate and must serve the patriarchate. Rebbi Eleazar bar Yose said, as we have stated: “She lives in the houses just as she lived while her husband was overseas, she uses silver and golden vessels just as she used to while her husband was overseas, she is fed just as she was fed while her husband was overseas.” “Do not eulogize me in small towns” because of the quarrels. “He who served me during my lifetime should serve me in my death;” Rebbi Ḥananiah from Sepphoris said, for example Yose Ephrati and Joseph from Haifa. Rebbi Ḥizqiah added, do not use many shrouds on me and let my coffin have holes at the bottom. These words say that Rebbi was buried in a single shroud since Rebbi said, not as a man left, he will come. But the rabbis say, just as a man left, he will come. It was stated in the name of Rebbi Nathan: The garment that went with a person to the grave will come back with him. What is the reason? (Job 38:14) “The seal turns itself around like clay, they appear in dress.” Antoninus asked Rebbi, what is the meaning of “The seal turns itself around like clay?” He said to him, He Who brings the generation clothes it.
When Rav Huna, the Head of the Diaspora, died they brought him here. They said, where shall we put him? They said, let us put him next to Rebbi Ḥiyya the elder for he is one of them. They said, who might want to bring him there? Rebbi Ḥaggai said, I shall go up to put him there. They said to him, you are looking for a pretext, for you are an old man and you want to go to rest there yourself. He said to them, put some string on my feet and when I shall be weak you pull. He went in and found the three arguing. “Jehudah my son, after you, and no more. Ḥizqiah my son, after you, and no more. Joseph ben Israel, after you, and no more.” He [R. Ḥaggai] lifted his eyes to look, it was said to him turn around, turn around. He heard the voice of Rebbi Ḥiyya the elder who said to his son Rav Jehudah, make space for Rav Ḥuna that he may rest there. But [Rav Ḥuna] did not accept this. They said, since he did not accept that one made space for him, so his descendants will never end. He [R. Ḥaggai] exited from there and his years were doubled.
Rebbi Ḥiyya bar Abba asked, are these standards like those standards? Rebbi Ḥizqiah, Rebbi Jacob bar Aḥa in the name of Rebbi Yose ben Ḥanina: These standards are like those standards. Here you say “the measure of a stone wall is ten hand-breadths, less than that is a quarry;” and there you say so? Where do we stand? If there were two rows of stones, one should state “eight hand-breadths”; if there were three one should state “twelve hand-breadths!” Rebbi Yose said, deduct half a hand-breadth for hewing top and bottom and so for the next row, one finds three rows of ten hand-breadths. Less than that is neither a stone wall nor a quarry.
What are the rules if somebody improved today? Rebbi Jeremiah wanted to say, it is permitted. Rebbi Yose said, did Rebbi Jeremiah not hear that he would be whipped? Did he not hear that he would be unacceptable for testimony? He turned around and said, certainly he had heard! But he is like someone who hears a statement and questiones it. Rebbi Ḥizqiah said, it was objected before Rebbi Jeremiah, there seems not to have been a court which disestablished! The force of Rebbi Jeremiah is from the following: “An Israel woman who comes to a priestly woman to get fire dips the wick into oil to burn and lights.” Rebbi Ḥuna in the name of the house of Rebbi Yannai: It was a time of wolf packs; there was no court which disestablished. As you say there, there was no court which disestablished, so here there was no court which disestablished!
Rebbi Ḥizqiah explains the Mishnah as referring to the eve of New Year’s Day of the Sabbatical. If he planted on the eve of New Year’s Day of the Sabbatical, it grew a bulb at the start of the Sabbatical; then he pressed [the leaves] down during the Sabbatical and tore them out after the Sabbatical. If you say that pressing down is like tearing out, everything belongs to the farmer. If you say that pressing down is not like tearing out, not everything belongs to the farmer; therefore, the poor have no settlement with the farmer.
“If it was in the ground three years, he gives one quarter to the poor. Two years, he gives one half to the poor.” Rebbi Yose explains the baraita before New Year’s Day of the Sabbatical, Rebbi Ḥizqiah explains the Mishnah [as dealing with] the eve of New Year’s Day of the Sabbatical.
“ Rebbi Meïr said to them: I am more restrictive with the proceeds than with the main [produce]. For one may light with Sabbatical oil but if one sold it and bought oil with it he may not light with it.” Rebbi Ammi in the name of Rebbi Joḥanan: If one exchanged oil for oil, both of them are forbidden. What can he do? Rebbi Ḥizqiah in the name of Rebbi Jeremiah: He barters both for profane [oil]. If he exchanged wine for oil; just as you say that he may not anoint with wine so he may not light with oil. If he exchanged leaves for sprouts, just as you say that leaves are subject to removal so sprouts are subject to removal. If he exchanged human food for animal feed, just as one may not make a wound dressing from human food so he may not make a wound dressing from animal feed. We also have stated: “One may sell human food and animal feed to buy human food with the proceeds, animal feed to buy animal feed and certainly human food (to buy animal feed).”
“The Sabbatical admits the additional leniency that its [oil] may be used for lighting”; that means it is permitted” May heave not be used for lighting? Impure heave may be used for lighting; even pure Sabbatical oil may be used for lighting. Rebbi Ḥizqiah went to the bath. He gave a flask to Zosimos the bath attendant; he said to him: bring that to the inner room for me. He said to him, is that not forbidden? He went to ask Rebbi Jeremiah. He said to him, he came and said to him, you yourself taught us, and we stated so: One does not rub in Sabbatical oil in the bath house but he may rub it in outside and enter.
Rebbi Ḥizqiah in the name of Rebbi Abba bar Mamal: If somebody measures with a box in which he made a sign two or three times, he may no longer use it for measuring. Rebbi Hoshaiah said, it is forbidden to say, give me your finger’s length.
Rebbi Joḥanan drank wine and then gave money. That goes for Rebbi Joḥanan who is trustworthy; what about other people who are not so trustworthy? Rebbi Jacob bar Aḥa in the name of Rebbi Avina: He shows him with one [hand] and takes with the other [hand]. Rebbi Ḥizqiah used to say, “give me for this before you”. Since he said, give me that before you, he is one who does not give Sabbatical money.
What does Rebbi Eliezer say about him who oiled leather? Rebbi Yose said, that man’s bones should be burned. Rebbi Ḥizqiah in the name of Rebbi Aḥa: It is permitted.
“They also said before him.” Rebbi Yose said, this implies that a fellow is forbidden to marry the daughter of a vulgar. Rebbi Ḥizqiah in the name of Rebbi Aḥa: Rebbi Eliezer used to permit the leavened matter of a Samaritan immediately after Passover.
Ḥizqiah said, once he started with his storage it is as if removed. A case came before Rebbi Assi and he instructed following Ḥizqiah, not that I am agreeing with him but since we see that the rabbis do act following him. Rebbi Isaac bar Redifah had a case, he came before Rebbi Jeremiah who said to him, there are lions before you, why do you ask foxes? He went and asked Rebbi Joshia who said to him, look for three people who love you and declare it abandoned before them. The Kappadokians of Sepphoris asked Rebbi Ammi: Since we have nobody who loves us or even greets us, what should we do? He said to them, when you see that [the market is] clear from steps, bring it out to the market, declare it abandoned, and acquire it again.

Rebbi Ḥaggai distributed it pitcher by pitcher. Rebbi Eleazar distributed it pitcher by pitcher. Rebbi Ḥizqiah came to Rebbi Jeremiah and said to him, let me acquire that storage. He said to him, bind these coins together; then he said to him, for these the place is rented to me. He said to him, did you not take it out? Go back and acquire it!
Rebbi Vivian said, Rebbi Assi instructed regarding qwndsy’ that their proceeds should be thrown into the Dead Sea. Rebbi Mana asked Rebbi Ḥizqiah, may one eat kafan-dates of Ascalon? He said, it is forbidden. Rebbi Ḥizqiah stood in the market place of Caesarea when he saw a person carrying forbidden produce. He turned away his face in order not to see him and stated: take down! Why all that? That his place should be one of rebuke. Rebbi Jacob bar Aḥa heard and said, the mother of this one gave birth to a son!

Rebbi Ḥizqiah in the name of Rebbi Jeremiah: Even if they are in Rome.
Ḥizqiah said, they mentioned only olives for oil and grapes for wine, hence not for any other produce. Rebbi Joḥanan said, not only olives for oil and grapes for wine but also any other produce. The colleagues in the name of Rebbi Joḥanan: Even immediately.
Gleanings, forgotten sheaves, peah, and ownerless property all have the same rule. Did one not already state everything? Thus you have to understand the Mishnah: [One may] not [give] from produce one third ripe for produce not yet one third ripe, and when he gave heave, it is not heave. For Ḥizqiah it is a point of contention, for Rebbi Joḥanan it is everybody’s opinion.
Abba bar Rav Huna said, one who drank [wine] should not pray but if he did pray, his prayer is a supplication. A drunk should not pray but if he did pray, his prayer is blasphemy. What is one who drank [wine]? Someone who drank a quartarius; a drunk is one who drank more. There, it is said if he cannot speak before a king. Rebbi Zeïra asked before Rebbi Assi: May a drunk recite Grace? He said to him (Deut. 11:15): “When you will eat and be satiated, then you must praise”, even if you are sleepy. The question is only, may he recite the Shema‘? Abba bar Avin said, a pious person asked Elijah, may he be remembered for the good, may a naked person recite the Shema‘? He said to him (Deut. 23:15): “He should not see in you a thing of turpitude,” a word of turpitude. Ḥizqiah stated: both for reciting [Grace] and reading [the Shema‘].
Everything teaches for itself and for others, the heave of the tithes teaches for others what it does not teach for itself. The heave of the tithe teaches for Great Heave that it should not be taken from pure produce for impure but itself can be taken from pure produce for impure. From where? Rebbi Yose in the name of Ḥizqiah, Rebbi Jonah in the name of Rebbi Yannai (Num. 18:28): “You shall give from it the Eternal’s heave to Aharon the priest;” it should be given to Aharon in his status as priest. Cahana said (Num. 18:29): “From its best, the sanctified part from it;” take from its sanctifiable part. The heave of the tithe teaches for Great Heave that it should be taken from earmarked produce but itself may be taken from non-earmarked. From where that heave of the tithe may be taken from non-earmarked produce? (Num. 18:28) “From all of your tithes,” one in Judea and one in Galilee. The heave of the tithe teaches for Great Heave that it should be taken only from finished produce, itself also should be taken from finished produce.
That is, if most of the heap was put in order. If most of the heap was not put in order, there is disagreement between Ḥizqiah and Rebbi Joḥanan. As Rebbi Simeon ben Laqish said in the name of Ḥizqiah, ṭevel becomes voided by plurality, but Rebbi Joḥanan said, ṭevel does not become voided by plurality. Since it was his intention to give, each single grain of wheat was labelled at its place. Some want to explain following Rebbi Eliezer ben Jacob, as Rebbi Eliezer ben Jacob stated, that he cannot separate either for itself or for another place. This parallels the following: If there were before him two heaps and from each of them he took part of heave or tithes, may he take heave or tithe from one for the other? The students of the elder Rebbi Ḥiyya asked the elder Rebbi Ḥiyya and he said to them (Eccl. 4:5): “The fool folds his hands and eats his own flesh.” Rebbi Eleazar in the name of the elder Rebbi Ḥiyya: He may not give heave or tithe from one for the other.

In the opinion of Rebbi Joḥanan, it is simple. One tenth in it is holy as heave, of the remainder one tenth is heave and the rest is ṭevel for tithes. Therefore, he must declare: “The excess he should make heave of the tithe for another place.” In the opinion of Ḥizqiah, it is difficult. One tenth in it is holy as heave, of the remainder one tenth is heave and the rest is ṭevel for everything. But we have stated: “The excess he should treat as heave of the tithe,” he should make it heave of the tithe for another place. Hizkiah holds with what Rebbi Ḥiyya stated, as Rebbi Ḥiyya stated: “The excess he should treat as heave of the tithe for another place.”
There, we have stated: “One makes a fire with bread and oil of heave.” Ḥizqiah said, they taught only bread and oil, therefore nothing else. Rebbi Joḥanan said, there is no difference between bread, oil, and any other thing. Rebbi Yudan from Kappadokia asked, are wheat grains like bread and olives like oil? Rebbi Samuel bar Naḥman said in the name of Rebbi Joḥanan, may the bones of him who uses bread and oil of heave to make a fire be burned. Rebbi Samuel bar Naḥman asked before Rebbi Joḥanan: May one make a fire? He said to him, make a fire! Anything given to your tribe was given to you, as Rebbi Abba bar Ḥiyya said in the name of Rebbi Joḥanan (Num. 18:8): “For excellence”. For excellence for greatness, for excellence for rubbing in, for excellence for lighting.
We understand that when pure it must be left to rot, but when impure to rot? In the opinion of Ḥizqiah, this is correct. In the opinion of Rebbi Joḥanan, should it not be burned? Rebbi Joḥanan is of the opinion of Rebbi Yose ben Ḥanina, maybe it is possible to find for them something to lift; but only if it is not usually mixed [with other food]. But if it usually is mixed, maybe something untoward will happen.
This means, pure [fell into] pure, but pure into impure? That is what we have stated: “If it was impure and profane.” According to Rebbi Yose, it is appropriate, as Rebbi Yose said in the name of Ḥizqiah, Rebbi Jonah in the name of Rebbi Yannai (Num. 18:28): “You shall give from it the Eternal’s heave to Aharon the priest;” it should be given to Aharon in his status as priest. In the opinion of Cahana who said, take from its sanctifiable part, also here one should take from the sanctifiable part. Even though Cahana says there, take from its sanctifiable part, he agrees only in what he is required to give to the Cohen.
Ḥizqiah said, even the profane food there should be eaten only as dry crackers because of their ḥallah. His word says that the prohibition of the outsider becomes insignificant but the prohibition of impurity does not become insignificant. The arguments of Ḥizqiah seem inverted. There, he says: How much can be in a dough that he should be able to make it in purity? Ḥizqiah said one sixth of four qab in four qab. And here he says so! Rebbi Yose said, there, when he kneaded the dough and then separated, but here when he separated and then kneaded.

The statement of Ḥizqiah says, on condition that no impurity the volume of an egg touch the indentation. A statement of Rebbi Joḥanan says, on condition that no impurity the volume of an egg touch the dough. Rebbi Yose said to Rebbi Jeremiah: Is it not reasonable that Ḥizqiah spoke to the past and Rebbi Joḥanan spoke to the future? He said, that is my opinion also. What is an indentation in the opinion of Rebbi Joḥanan? Rebbi Yose ben Rebbi Abun in the name of Rebbi Jonah: Explain it that he made a dough with one in seventeen and it came to a dough of two seah.

Rebbi Abba bar Mamai asked: Does this not contradict Rebbi Yose bar Ḥanina? As Rebbi Yose bar Ḥanina said, a carcass can become insignificant in slaughtered [meat]; it becomes insignificant for touch, but for motion it cannot become insignificant for slaughtered [meat] can never become carcass [meat]. Rebbi Yose said, there it is impossible for slaughtered [meat] to become carcass [meat], but here profane produce may become heave. Rebbi Ḥizqiah said, Rebbi Simon raised the question and Rebbi Abba bar Mamai explained it.
HALAKHAH: Rebbi Yudan bar Pazi and Rebbi Ayvo bar Naggari were sitting and saying: We did state “after they conceded”; who conceded to whom? The House of Shammai to the House of Hillel or the House of Hillel to the House of Shammai? They said, let us go out and study. The went out and heard Rebbi Ḥizqiah, Rebbi Aḥa in the name of Rebbi Jehudah bar Ḥanina: We never find the House of Shammai conceding to the House of Hillel except in this matter. Rebbi Jonah in the name of Rebbi Abbai understood it from the following: “If someone pours from vessel to vessel and a ṭevul yom touches it, it should be lifted by 101.” If you say that the House of Hillel conceded to the House of Shammai that it cannot be lifted, who is the Tanna here, neither the House of Shammai nor the House of Hillel! Rebbi Ḥanina the son of Rebbi Hillel said, we might say that the House of Hillel stated that before they conceded. Rebbi Yose said, the Mishnah said so: “After they conceded, Rebbi Eliezer said it should be lifted and burned”, and is Rebbi Eliezer not a follower of Shammai? Rebbi Ḥinena said, the Mishnah said so, after they conceded one to another, the House of Shammai recused themselves and the others teach us. Rebbi Abin says, there is another answer, following what Rebbi Hoshaia stated: Since pure [heave], which for outsiders is forbidden as deadly sin, can be lifted, certainly also impure [heave] which is [prohibited] as positive commandment for Cohanim.
It was stated: Rebbi Eliezer said, one may eat figs and grapes in the night without worry, since it is said (Ps. 116:6) “the Eternal watches over the simple-minded.” Rebbi Jonah in the name of Rav: A fish with pecking marks is forbidden. Rebbi Ḥizqiah, Rebbi Tabi in the name of Rav: A living fish with pecking marks is forbidden. If it is salted, through the salt it trembles. Dead, one cuts out the place of the pecking.
HALAKHAH: “An onion which one added to lentils,” etc. Rebbi Ḥizqiah, Rav Aḥa in the name of Rebbi Abba bar Mamal said, our Mishnah [in case] after the lentils lost their sap; [then] the lentils shrink it so it will not absorb [any taste]. (As you say, lentils shrink it so it will not absorb.) Similarly, lentils shrink it so it will not give.
HALAKHAH: From where that a cow of a Cohen which was appraised at an Israel’s cannot be fed vetch? The verse says (Lev. 22:11): “If a Cohen buys a living being with his money, etc.” I could think, he may not feed it vetch, the verse says, “they”. Some Tannaïm state: I could think, he may not feed it vetch or fenugreek. Rebbi Ḥizqiah, Rebbi Jeremiah, Rebbi Ḥiyya, in the name of Rebbi Joḥanan: The word of the Torah is that here, there is no “fenugreek”. Did we not state: From where that a Cohen who bought a slave in partnership with an Israel, even if the latter has only a one percent interest, cannot feed him heave? The verse says, “If a Cohen buys.” Bar Qappara stated: Neither one of them may eat heave.
HALAKHAH: There, we have stated: If somebody buys a vegetable field in Syria, if this was before the start of the season of tithes, he is obligated. But if it was after the start of the season of tithes, he is free. And here, you say so? Ḥizqiah said, the Mishnah speaks of a field of green melons or pumpkins. Rebbi Zeïra said, even if you hold this about a general field of vegetables, there still is a limit, only after if grew three twisted leaves.
HALAKHAH: Ḥizqiah said, if he collected two or three modii from it, it comes under the category of vegetable. Also for seeds it is so: If he withheld from it two or three morbiot, it comes under the category of seeds. If one sowed it for seeds it is tithed for the past; if he sowed it as vegetable it is tithed for the future. If he sowed it for both seeds and vegetable, or if he sowed for seeds and then wanted it as vegetable, one may tithe from its seed on vegetable and from vegetable on seeds, on condition that it was collected before the New Year; but if some of it was collected after the New Year, its seed is tithed for the past and its vegetable is tithed at the moment of its being harvested if it was one-third ripe before the New Year. But if it was only ripe one-third after the New Year, both seed and vegetable are tithed for the future.
“ How does one not take it as a pledge? He who enters another’s house to take a pledge should not take his debtor’s Second Tithe as pledge.” It was stated: “One does not give it as a deposit and he should not give it to a grocer to receive food in its value.” If one transgressed and took as pledge, trangressed and gave as deposit? It shall be as the following: “If somebody eats his Second Tithe, whether in error or intentionally, he shall cry out to Heaven, the words of Rabban Simeon ben Gamliel. Rebbi says, in error he shall cry out to Heaven, intentionally the money’s worth shall be restituted. If it was money, in error he shall cry out to Heaven, intentionally the money’s worth shall be restituted, the words of Rabban Simeon ben Gamliel. Rebbi says, whether in error or intentionally, the money’s worth shall be restituted.” Rebbi Zeriqa in the name of Ḥizqiah: Practice follows Rebbi for money and Rabban Simeon ben Gamliel for produce. Rebbi Ila said, there was a case about money and they instructed following Rebbi.
Rebbi Yose in the name of Rebbi Pedaiah, Rebbi Jonah in the name of Ḥizqiah, there is no mixing except for wine and oil. Rebbi Joḥanan says, it can be mixed up to the size of olives. Our Mishnah disagrees with Rebbi Joḥanan: “If he mixed them together and took out fists full, it is by proportion.” He explains it, up to the size of olives. “What is picked out is for Second Tithe and what is mixed together in proportion.” Rebbi Yose ben Rebbi Abun in the name of Rebbi Huna: The Mishnah comes up so: What is mixed and what is taken out in fists full in proprtion.
