Jerusalem Talmud Pesachim 3:28

It and its young fell into a cistern. Rebbi Eliezer said, he should lift the first one for the purpose of slaughtering it and slaughter it. The second one has to be provided for so it should not die. Rebbi Joshua says, he should lift the first one for the purpose of slaughtering it and not slaughter it, and be cunning and lift the second one. Even though he had no intention of slaughtering either of them, he is permitted. Rebbi Abun bar Ḥiyya asked: Is the argument of Rebbi Eliezer not inverted? There he says, one is prohibited from cunning but here he says, one is permitted to be cunning. Here it is because “not to be seen nor found”; there, what do you have? Is the argument of Rebbi Joshua not inverted? There he says, one is permitted to be cunning, but here, he says, one is prohibited from cunning. Rebbi Idi said, there it is a rabbinic Sabbath prohibition, but here liability for a purification offering. Rebbi Yose ben Rebbi Bun said, there it is to protect Jews’ money; here what do you have?

Jerusalem Talmud Pesachim 3:29

Rebbi Isaac and Rebbi Joshia, one like one of them, the other like the other. Rebbi Berekhiah preached following Ben Bathyra, the Mishnah says so: “she shall beat it and wet it with cold water.” The words of the rabbis disagree, but Rebbi Ḥizqiah, Rebbi Abbahu said in the name of Rebbi Eleazar: In every instance where Rebbi formulated a disagreement and later formulated it anonymously, practice follows the anonymous statement.

Jerusalem Talmud Pesachim 3:30

MISHNAH: Rabban Gamliel says, three women knead dough simultaneously and bake in one oven one after the other, but the Sages say, three women are occupied with dough; one is kneading, one is forming, and one is baking. Rebbi Aqiba says, neither all women nor all wood nor all ovens are equal. This is the principle, she shall beat it and wet it with cold water.

Jerusalem Talmud Pesachim 3:33

“Rabban Gamliel says, three women knead dough simultaneously and bake in one oven one after the other, but the Sages say, three women are occupied with dough; one is kneading, one is forming, and one is baking.” Rebbi Hoshaia stated: And another one comes and kneads in their stead. There are Tannaim who state: Three qab wheat or four qab barley. There are Tannaim who state: Four qab wheat or three qab barley. He who said, three qab wheat, if they have fat, or four qab barley, if they have no fat. He who said, four qab wheat, if they are soft, or three qab barley, if they are hard.

MISHNAH: Sour dough is to be burned but a person who eats it is not liable; cracked dough is to be burned and a person who eats it is liable for extirpation. What is sour dough? Like locusts’ antlers; cracked if its fissures joined one another, the words of Rebbi Jehudah, but the Sages say, in both cases one who eats it is liable. What is sour dough? Any which is pale like a man whose hair is standing up.

Jerusalem Talmud Pesachim 3:38

It was stated: “Rebbi Jehudah said, the House of Shammai and the House of Hillel did not disagree about pure heave that it is forbidden to burn it, and about impure heave that one is permitted to burn it; about what did they disagree? About the suspended one, about which the House of Shammai say, one may not burn it, but the House of Hillel say, one burns it. The House of Shammai said to the House of Hillel: Do you not say that the pure one may not be burned because I am saying that maybe a Cohen was keeping the Sabbath within the domain and he might come and eat in on the Sabbath, so also the suspended one may not be burned because I am saying that maybe Elijah was keeping the Sabbath on Mount Carmel and he might come and testify on the Sabbath that it is pure. The House of Hillel told them, we are sure that Elijah will come neither on a Sabbath nor on a holiday.”

His son’s circumcision and the slaughter of his Passover sacrifice. what has precedence? Rebbi Phineas said, since it is written, all his males have to be circumcided, then he will be admitted to nake it, this implies that his sons’ circumcisions has priority over the slaughter of his Passover sacrifice.

Jerusalem Talmud Pesachim 3:45

Rebbi Abbahu sent his son Rebbi Ḥanina to acquire merit in Tiberias. They came and said to him, he does works of charity. He sent to tell him, are there no graves in Caesarea that I sent you to Tiberias? For they already voted and decided in the upper floor of the house of Arius in Lydda that study precedes action. The rabbis of Caesaria say, that is, if there is somebody there who will do it. But if nobody is there who will do it, the action has precedence. Example. Rebbi Ḥiyya, Rebbi Yasa, Rebbi Immi, were late in coming to Rebbi Eleazar. He asked them, where have you been? They told him, performing an act of charity. He asked them, where there no others? They answered him, it was a neighbor.

MISHNAH: Similarly, somebody who left Jerusalem and remembers that he has with him sacrificial meat, if he passed Mount Scopus he burns it on the spot, otherwise he returns and burns it before the citadel on altar wood. Up to what do they return? Rebbi Meïr says, in both cases the size of an olive; Rebbi Jehudah says, in both cases the size of an egg. As having become impure outside or having become impure inside? Rebbi Yose said, since it is disqualified because of its place it becomes as if having become impure outside. Rebbi Yose ben Rebbi Abun said, it is pure by the words of the Torah. You have decided that it be impure. It is not enough that you decided that it be impure, but you also want to make it as if having become impure outside? It [only] is like having become impure inside.

Some Tannaim state it switched. Rebbi Jacob bar Aḥa in the name of Rebbi Yasa following our Mishnah. Rebbi Yudan said, an indication is that of Berakhot: “What is the minimum to ‘invite’? Down to the size of an olive, Rebbi Jehudah says to the size of an egg.” Less than that one does not importune him to return. What is the difference between one and the other? One can be declared insignificant, the other cannot be declared insignificant. So far sacrificial meat; leavened matter from where? Rebbi Yose ben Rabbi Abun said, from what we have stated, “similarly, somebody who left Jerusalem”, this implies that what is incident to one is incident to the other.

Jerusalem Talmud Pesachim 4:3

Rebbi Jonah said, these daily sacrifices are the offerings of all of Israel. Could all of Israel ascend to Jerusalem? Is it not written, three times a year all your males shall be seen? If all of Israel would sit there and do nothing, is there not written, you shall harvest your grain? Who would harvest their grain? But the early prophets instituted 24 watches; from each watch there were [Cohanim, Levites, and Israel] present in Jerusalem. It was stated, twenty-four thousand. A stand-by group from Jerusalem, and half a stand-by group from Jericho. Jericho also could have produced a full stand-by group, but to give precedence to Jerusalem it only produced half a stand-by group. The Cohanim for service, the Levites for the podium, and the Israel as proof that they are the agents for all of Israel.

Jerusalem Talmud Pesachim 4:4

It was stated: “Rebbi Simeon ben Eleazar said, Cohanim, Levites, Israel, and song invalidate the sacrifice.” Rebbi Abbin in the name of Rebbi Eleazar, the reason of Rebbi Simeon ben Eleazar: The entire congregationwere bowing down, these are Israel, and the song was sung, these are the Levites, and the trumpets were trumpeting, these are the Cohanim, everything up to the end of the elevation offering, all are indispensable for the sacrifice. Rebbi Tanḥuma in the name of Rebbi Eleazar understood it from here: And I gave the Levites to Aaron and his sons from the midst of the Children of Israel, these are the Levites, to work the service of the Children of Israel in the Tent of Meeting, these are the Cohanim, and to atone for the Children of Israel, that is the song, so there shall be no plague when the Children of Israel approach the Sanctuary, these are Israel.

Jerusalem Talmud Pesachim 4:6

Is not Pesaḥ a sacrifice of all of Israel and they made it dependent on usage? Rebbi Abbahu said, there is a difference, since the Pesaḥ cannot be offered before noontime. Rebbi Abbahu asked, if one said, I have the obligation to bring an elevation offering in the afternoon, is he permitted to work in the morning? Everything they made dependent on usage. If women use not to work after the end of the Sabbath, it is no [{legitimate} usage]; until the end of the seder it is [{legitimate} usage]. On Monday and Thursday, it is no [{legitimate} usage], to the end of the fast-day prayers it is [legitimate] usage. On the day of the willow twigs it is not {legitimate} usage, after afternoon prayers it is {legitimate} usage. On the day of the New Moon it is {legitimate} usage. Rebbi Zeˋira said, if women use not to weave from the start of Av it is {legitimate} usage, for the šetiah stone stopped to exist. What is the reason? For the woofs will be torn down.

Jerusalem Talmud Pesachim 4:8

Rebbi Ḥinena said, everything they made dependent on usage. There were acacia trees in Migdal Sevaya. They came and asked Rebbi Ḥanania, the colleague of the rabbis, may one use them for work? He told them, since your ancestors used to treat them as forbidden, do not change the usage of your deceased ancestors. Rebbi Eleazar in the name of Rebbi Abbin. In any case which is permitted but in error he treats it as forbidden, if he asks they will permit him. But in any case where he knows that it is permitted but he has the usage to treat it as forbidden, if he asks they will not permit him.

Not only the Pesaḥ but also usage. The net-fishermen of Tiberias, and the farina millers of Sepphoris, and the grain splitters of Acco, accepted not to work on the intermediate days of a holiday. One understands the farina millers of Sepphoris, and the grain splitters of Acco. The net-fishers of Tiberias, do they not diminish the enjoyment of the holiday? He may fish with a hook; he may fish with a stationary net. Even so, do they not diminish the enjoyment of the holiday? Rebbi Immi cursed them because they diminish the enjoyment of the holiday.

Jerusalem Talmud Pesachim 4:12

If they were exiled from one place to another and wanted to change their ways? Would it be as Rebbi Abba said, the people of Mesha took it upon themselves not to travel on the ocean. They came, asked Rebbi, and said to him, our forefathers used not to travel by sea; what is our situation? He said to them, since your forefathers treated it as a prohibition, do not change the usage of your deceased ancestors. May a person not ask about his vow? There he asks when he made the vow, but here their ancestors made the vow. Then they should be permitted a fortiori. Rebbi Ḥanania said, it is not because of this but because of the following. Rebbi was the student of Rebbi Jehudah, and Rebbi Jehudah said, one is forbidden to travel by sea.

Rebbi Simeon ben Laqish asked Rebbi Joḥanan: Is it not forbidden because of “do not split into sects”? He said to him, in case these follow the House of Shammai and those the House of Hillel. But between the House of Shammai and the House of Hillel does practice not follow the House of Hillel? He said to him, in case these follow Rebbi Meïr and those follow Rebbi Yose. He said to him, is there not New Year’s Day and the Day of Atonement, where in Judea one used to follow Rebbi Aqiba and in Galilee Rebbi Joḥanan ben Nuri. He told him, there is a difference since if he changed and in Judea acted as in Galilee or in Galilee as in Judea he discharged his obligation. But is there not Purim, where these read on the fourteenth and those on the fifteenth? He told him, he who edited the Mishnah based it on Scripture: Family and family, country and country, and town and town.

Rebbi Yose says, also on what is guarded.” He says to him, I brought it from what is guarded; if you do not believe me, there is field x guarded before you, go and bring for yourself.
