Rebbi Joḥanan said: “One silver obolus and two silver coins are words of the Torah.” Rebbi Yasa stated before Rebbi Joḥanan: The appearance is with anything; the Sages only said: “One silver obolus, two silver coins.” He said to him: Is there anything like that? Rebbi Jonah said, are not all measures determined by the Sages? They said: The volume of an olive from a corpse, the volume of an olive from a cadaver, the volume of a lentil from a dead reptile. The question here is only what Rebbi Hoshaia stated: They should not be seen before Me empty-handed, with anything; the Sages only said: “A silver obolus, two silver coins.” The difficulty is that this is support for the opinion that it is based on words of the Torah. He said that only the Sages instituted: “one silver obolus, two silver coins.” Rebbi Yose ben Rebbi Abun said: Rebbi Joḥanan follows his own opinion and Rebbi Hoshaia follows his own opinion. Rebbi Joḥanan follows his own opinion since Rebbi Joḥanan said that all measures are practice taught by Moses at Sinai; he says that “one obolus and two silver coins are the word of the Torah.” Rebbi Hoshaia follows his own opinion; Rebbi Hoshaia is the one who said: he who eats forbidden food in the present time has to study the quantities; maybe a new court will arise and change the measures for him; then he will know what measure he ate. Therefore he is the one who said, the appearance is with anything; the Sages only said: “one silver obolus, two silver coins.” They said, Rebbi Joḥanan changed his mind about this. Rebbis Jonah and Jonathan said, he did not change his mind; additionally, Rebbi La said in the name of Rebbi Ammi: Ḥizqiah and Rebbi Joḥanan disagreed. Ḥizqiah said, a man may split his obligation for two animals. Rebbi Joḥanan said, nobody may split his obligation for two animals, but for each one he has to have two silver coins in his hand. Rebbi Simeon ben Laqish in the name of Ḥizqiah: A person adjoins an animal to an animal but no person may adjoin money to money. Rebbi Joḥanan said, a person may adjoin money to money but no person may adjoin animals to an animal. What may be done? There were before him ten animals, he sacrificed five of them on the first holiday. May the remainder push aside the last holiday? Rebbi Crispus said, Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree. One said, they push; the other one said, they do not push. We do not know who said what. Rebbi Ze`ira said, we may explain the words of the rabbis by their own words. Rebbi Joḥanan said: a person may adjoin coins to coins but not animals to an animal; he must say, they push. But Rebbi Simeon ben Laqish said, a person adjoins an animal to an animal but no person may adjoin money to money; he must say, they do not push. Simeon bar Abba came in the name of Rebbi Joḥanan: He adds and pushes the holiday further until he says: I do not intend to add further.

There, we have stated: “Four kinds of vows did the Sages dissolve.” Do not the Sages permit all kinds of vows? It is written: Moses spoke to the heads of the tribes of the Children of Israel. He referred the paragraph to the heads of the tribes that they should dissolve their vows. Rav Jehudah in the name of Samuel: He shall not profane his word. He cannot profane his word; this implies that others can profane his words. Who is that? That is the Sage who dissolves the vow.

Rebbi Meïr was sitting and preaching in the House of Study of Tiberias when his teacher Elisha passed by riding on a horse on the Sabbath. They came and told him, your teacher is outside. He stopped his sermon and went out to him. He asked him, what did you preach today? He told him, and the Eternal blessed the end etc. He asked him, what did you explain about this? He answered him, and the Eternal added double all that Job had owned; that he doubled his money. He said, woe for those who are lost and not found, your teacher Aqiba did not preach this but, the Eternal blessed the end of Job from his beginning, by the merit of commandments and good works which were in his hand from his beginning. He asked him, and what did you preach further? He told him, the end of a matter is better than the beginning. He asked him, what did you explain about this? For example, a man who had children in his youth but they died, and in his old age they lived; that is the end of a matter is better than the beginning. For example, a man who traded in his youth and lost, and in his old age and gained; that is the end of a matter is better than the beginning. For example, a man who studied Torah in his youth and forgot, in his old age he remembered; that is the end of a matter is better than the beginning. He said, woe for those who are lost and not found, your teacher Aqiba did not preach this but, the end of a matter is good from the beginning, in case it is good from the start, and this applies to me. My father Abuya was one of the leading Jerusalemites. On the day he came to circumcise me he invited all the leading Jerusalemites and sat them in one room, and Rebbi Eliezer and Rebbi Joshua in another room. After they ate and drank they started to clap with their hands and dance. Rebbi Eliezer and Rebbi Joshua said, while they are occupied in theirs let us be occupied with ours. They sat occupied with words of the Torah, from the Torah to Prophets, from Prophets to Hagiographs. Fire descended from Heaven and surrounded them. Abuya told them, my teachers! Why do you come to burn down my house? They told him, Heaven forbid! But we were sitting reviewing the words of the Torah, from the Torah to Prophets, from Prophets to Hagiographs, and the words were joyful as at their giving on Sinai. And was the main giving on Sinai not in fire? And the Mountain burns in the fire up to the heart of Heaven. My father Abuya told them, my teachers! If that is the power of Torah, if this son of mine survives I dedicate him to Torah. Because his intent was not for Heaven, it did not succeed with this man. He asked him, and what did you preach further? He told him, it cannot be valued by gold or glass. He asked him, what did you explain about this? He told him, the words of the Torah are as difficult to acquire as golden vessels, and as easy to lose as glass vessels. And like golden and glass vessels when they are broken he can make them vessels as before, also the student of the Sages who forgot his learning can learn it anew. He said to him, this is enough, Meïr, up to here is the Sabbath domain. He asked him, how do you know? He told him, from the horse’s hooves which I continuously counted for 2’000 cubits. He said to him, all that wisdom is in you and you do not repent? He told him, I cannot. He asked him, why? He told him, once I was passing by the Holiest of Holies riding on a horse on the Day of Atonement which fell on a Sabbath and I heard an unembodied voice coming from the Holiest of Holies, saying, return, erring children, except for Elisha ben Abuya who knew My power and rebelled against Me. And all that came to him because he was sitting memorizing in the valley of Genezareth and saw a man climbing to the top of a date palm taking the mother with the chicks and descending safely. The next day he saw another man climbing to the top of a date palm, taking the chicks and sending away the mother. When climbing down he was bitten by a snake, and he died. He said, it is written, sending away you shall send the mother, but the chicks you may take for yourself, so it will be good for you and prolong your days. Where is the good for this one? Where is the prolongation of days of this one? He did not know that Rebbi Jacob had explained it preceding him, so it will be good for you in the future world which is all good, and prolong your days, in the future which is all long. But some are saying, because he saw the tongue of Rebbi Jehudah the baker in the mouth of a dog, oozing blood. He said, is this the Torah and this is its reward? This is the tongue which was delivering the words of the Torah correctly; this is the tongue which occupied itself with Torah all its days; [is this the Torah and this is its reward?] It appears that there is no reward and no resurrection of the dead. But some are saying, when his mother was pregnant with him she passed by pagan temples and smelled of this kind. And this smell was bubbling in her body like the poison of a viper. Later Elisha fell sick. They came and informed Rebbi Meïr, your teacher is sick. He went to visit him and found him sick. He asked him, are you not repenting? He asked, and if one repents, is one accepted? He told him, is it not written, man shall repent up to extinction, one receives up to the extinction of the breath. At that moment Elisha cried, passed away, and died. Rebbi Meïr was happy internally and said, it seems that my teacher passed away repentant. After they buried him, fire descended from Heaven and burned his grave. They came and informed Rebbi Meïr, your teacher’s grave is on fire. He went to visit it and found it burning. What did he do? He took his kaftan and spread it over it. He said, stay for the night, etc. Stay for this world which compares to the night, and it will be in the morning, this is the Future World which is all morning, if the Good One will redeem, this is the Holy One, praise to Him, who is Good, as it is written, the Eternal is good to all, and His mercies are on all His creatures. And if He does not want to redeem you I shall redeem you, living is the Eternal, and it was extinguished. They asked Rebbi Meïr, if they ask you in that World, whom do you want to visit, your father or your teacher? He told them, I shall visit my teacher first and afterwards my father. They said, will they listen to you? He told them, did we not state, “one saves the case of a scroll with the scroll, and the case of phylacteries with the phylacteries”? One saves Elisha Aher by the merit of his Torah. Later his daughters went to take charity from Rebbi. Rebbi decided and said, nobody shall show him grace nor be friendly to his orphans. They told him, Rebbi. Do not look at his deeds, do look at his Torah. At this moment Rebbi cried and decided for them that they be provided for. He said, if this one who toiled in Torah not for Heaven’s sake, see what he produced; one who toils in the Torah for itself not so much more?
The House of Shammai are saying, heaven was created first and afterwards earth. But the House of Hillel are saying, earth was created first and afterwards heaven. These are bringing proof for their assertion, and those are bringing proof for their assertion. What is the reason of the House of Shammai? In the Beginning God created heaven and earth. {A parable} of a king who made a chair. After he had made it he made its footstool: the Heavens are My throne and the Earth My footstool. What is the reason of the House of Hillel? On the day of the Eternal’s, God’s, making of earth and heaven {A parable} of a king who made a palace. After he built the foundations he built the upper structure: also My left hand founded the Earth and My right hand tended the Heavens. Rebbi Jehudah bar Pazi said, also the following supports the House of Hillel: in earlier times You founded the Earth, and the Heavens are the work of Your hands. Rebbi Ḥanina said, from the place from where the House of Shammai prove their assertion, from there the House of Hillel remove them. What is the reason of the House of Shammai? In the Beginning God created heaven and earth. From there the House of Hillel remove them: and the earth was, it already was. Rebbi Joḥanan in the name of the Sages: As for creation, the heaven preceded. As for perfecting, the earth preceded. As for creation, the heaven preceded, in the Beginning God created. As for perfecting, the earth preceded, on the day of the Eternal’s, God’s, making of earth and heaven. According to the House of Shammai, the heaven after the First waited three days, First, Second, Third, to have offspring. On the Fourth, there shall be lights. According to the House of Shammai, the sea after the Second waited three days, Second, Third, Fourth, to have offspring. On the Fifth, the waters shall teem. According to the House of Shammai, the earth after the Third waited three days, Third, Fourth, Fifth, to have offspring. On the Sixth, the earth shall produce. According to the House of Hillel, the earth after the First waited two days, First and Second, to have offspring. On the Third, the earth shall be covered with grass. According to the House of Hillel, the sea after the Third waited two days, Third and Fourth, to have offspring. On the Fifth, the waters shall teem. Rebbi Simeon ben Yohai said, I am wondering how the fathers of the world could disagree about the creation of the world. Heaven and earth were only created like a pan and its cover. What is the reason? Also My left hand founded the Earth and My right hand tended the Heavens. Rebbi Eleazar ben Rebbi Simeon said, following this, my father’s opinion, sometimes heaven precedes earth, sometimes earth precedes heaven, which teaches that they are equivalent one to another.
“Hillel and Menaḥem did not disagree. Menaḥem left and Shammai entered.” Where did he leave to? Some are saying, from behavior he left to behavior. But some are saying, he left against his face, he and eighty pairs of students of the Sages, wearing golden tirqe, whose faces became black like the rim of a pot when they were told, write on a bull’s horn that you have no part in the God of Israel.
HALAKHAH: Is hand-washing required for profane food? But it must follow Rebbi Simeon ben Eleazar, since Rebbi Simeon ben Eleazar says, hand-washing is required for profane food. It is everybody’s opinion, so he should separate from heave. Rebbi Simeon ben Eleazar stated in the name of Rebbi Meïr, hands are first degree impure for profane food and second degree impure for heave. Does Rebbi Simeon ben Eleazar follow Rebbi Aqiba, as we have stated there, “if somebody puts his hands into a leprous house, his hands are impure in the first degree, the words of Rebbi Aqiba, but the Sages are saying, his hands are impure in the second degree”? There, it follows the rabbis; what is their reason here? Since you tell him that his hands are impure in the second degree, he will separate from heave. But did they not decide about them because of fluids; then they should be impure in the first degree? It is an argument de minore ad majus. Since the Tevul Yom, which is a word from the Torah, only disqualifies, impure hands, which are from their words, not so much more? Another explanation: Did they not decide about hands only that he should separate from heave? Since you tell him that his hands are impure in the second degree, he will separate from heave.
There, we have stated: [“For heave and First Fruits one incurs the penalty of death or a fine of a fifth; they are forbidden to lay persons, are property of the Cohen, may be lifted by one in 100, need washing of the hands and sundown.] This applies to heave and First Fruits but not to tithe.” There, you are saying tithe does not need washing, but here, you are saying that tithe needs washing. When you are saying that tithe needs washing, following the rabbis; but when you are saying that tithe does not need washing, following Rebbi Meïr. As we have stated there, “anything which requires immersion by the words of the Sopherim makes sancta impure and disqualifies heave but is permitted for profane food and tithe, the words of Rebbi Meïr. But the Sages forbid for tithe.” He did not understand that Rebbi Samuel said in the name of Rebbi Ze`ira: What means, “but the Sages forbid for tithe”? His body became disqualified from consuming tithe. How it that? If you are saying, tithe needs washing, [for one who intends to eat. If you are saying, tithe does not need washing,] if he intends to touch. But does not one who wants to eat also want to touch? Only because of [handwashing as discipline. But did we not state “heave”? For heave is there] handwashing as discipline? Therefore about profane food prepared in the purity of sancta. But is profane food prepared in the purity of sancta not profane food? Explain either following Rebbi Simeon ben Eleazar or Rebbi Eleazar ben Rebbi Ṣadoq. Either following Rebbi Simeon ben Eleazar, as it was stated, Rebbi Simeon ben Eleazar says in the name of Rebbi Meïr, hands are first degree impure for profane food and second degree impure for heave. Or Rebbi Eleazar ben Rebbi Ṣadoq, as we have stated there: “profane food prepared in the purity of sancta is profane food. Rebbi Eleazar ben Rebbi Ṣadoq says, it is like heave, to be impure in two stages and disqualified in the third.”
Rebbi Eleazar ben Rebbi Ṣadoq says, it is like heave, to be impure in two stages and disqualified in the third.”
There, we have stated: “A staff which is full of impure fluids, when it touched the miqweh it is pure, the words of Rebbi Joshua. But the Sages are saying, only if he immerses it completely.” Rebbi Simeon ben Laqish said, where do they disagree? For easy impurity; but for severe impurity even Rebbi Joshua agrees. Rebbi Joḥanan said, they even disagree for severe impurity. A baraita disagrees with Rebbi Simeon ben Laqish: “As long as his feet are in the water, he may consider himself pure for any stage he chooses.” Explain it about one who ate impure food and drank impure drinks. Did not Rebbi Jacob bar Zavdi, Rebbi Abbahu say in the name of Rebbi Simeon ben Laqish, the body of one who ate impure food and drank impure drinks is pure without special intention? From the moment he intended elevated purity he (needs) [does not need] intention. A Mishnah disagrees with Rebbi Simeon ben Laqish: “A miqweh containing exactly 40 seah into two persons descended, [both are pure]. One after the other, the first one is pure, the second impure. Rebbi Jehudah says, if the feet of the first touched the water, the second one also is pure.” Still this is about one who ate impure food and drank impure drinks. A baraita disagrees with Rebbi Simeon ben Laqish: A woman in her period may rinse a radish in a cave and it is pure. If she lifted it in any way out of the water it is impure. And we have stated thereto: Rebbi Jehudah declares it pure in the name of Rebbi Joshua. And represents a menstruating woman not a severe impurity? This disagrees with Rebbi Simeon ben Laqish and it has no standing.
HALAKHAH: “Sancta are more stringent than heave,” etc. Rebbi Ḥiyya in the name of Rebbi Joḥanan, because eaters of heave are vigilant but eaters of sancta are not vigilant. Rebbi Ḥanania said before Rebbi Mana, is that eminence? If it were a thing equal for both but impure for one and pure for the other, that would be eminence. He said to him, explain it if it is connected to sancta. Rebbi La in the name of Rebbi Joḥanan, if the impure was [heavy] a lb. one does not immerse it. Abba Shaul said, also for heave one immerses only a basked or a willow-basket. Rebbi Joḥanan said, Abba Shaul and Rebbi Simeon said the same, as we have stated there, “if one holds a human or vessels and immerses them, they are impure, but if he had rinsed his hands in water they are pure. Rebbi Simeon said, he should hold them loosely so the water may come into them.” Rebbi Joḥanan said, it is reasonable that Rebbi Joḥanan would agree with Abba Shaul but Abba Shaul not with Rebbi Simeon. The rabbis of Caesarea in the name of Rebbi Joḥanan: Practice follows Abba Shaul. It was stated thus: Practice follows his words. Rebbi Jonah said, the Mishnah is Rebbi Meïr’s, but the words of the Sages are that one acts thus even for sancta, since finger-holes are no interior; for vessels of sancta all is interior.
HALAKHAH: It was stated: “It happened that a woman was weaving cloth in purity and came to Rebbi Ismael to ask him about it. She told him, I am sure that it did not become impure, only I did not concentrate to watch it. While he was interrogating her, she said to him, a menstruating woman came and helped me stretching the rope. At that moment Rebbi Ismael said, great are the words of the Sages who said, ‘implements manufactured in purity need immersion for sancta but not for heave.’ Another happening: a woman was weaving a shawl in purity and came to Rebbi Ismael to ask him about it. She told him, I am sure that it did not become impure, only I did not concentrate to watch it. While he was interrogating him, she said to him, a thread broke and I tied it with my mouth. At that moment Rebbi Ismael said, great are the words of the Sages who said, ‘implements manufactured in purity need immersion for sancta but not for heave.’ ”

Rebbi Jonathan in the name of Rebbi: If somebody eats food which is third degree impure for heave, his body is disqualified from eating heave. Rebbi Samuel bar Rav Isaac asked, how? Rebbi follows Rebbi Eliezer? As we have stated there, “He who eats food impure in the first degree is impure in the first degree. He who eats food impure in the second degree is impure in the second degree. He who eats food impure in the third degree is impure in the third degree.” It is everybody’s opinion, so he should stay away from heave. And similarly, if somebody eats food which is second degree impure for tithe, is his body disqualified from eating tithe? Let us hear from the following: “But the Sages forbid for tithe.” They had not heard that Rebbi Samuel said in the name of Rebbi Ze`ira, what means “but the Sages forbid for tithe”? His body is disqualified from eating tithe. And similarly, if somebody eats food which is fourth degree impure for sancta, is his body disqualified from eating sancta? Let us hear from the following, as Rebbi Jeremiah said in the name of Rebbi Abba bar Mamal, they made him like one eating fourth degree impure food for sancta. This implies, if somebody eats food which is fourth degree impure for sancta, his body is disqualified from eating sancta. So far in Temple sancta which were sanctified. Or also for profane food prepared in the standards of sancta? Let us hear from the following, [as we stated there]: “If somebody slaughters domestic animals, wild animals, or birds, and no blood came out from them, they are qualified and may be eaten with unclean hands, since they were not prepared by blood. Rebbi Simeon says, they were prepared by slaughter.” Rebbi Eleazar in the name of Rebbi Hoshaia: The Mishnah is about profane food prepared in the standards of sancta following Rebbi Joshua. Rebbi Ze`ira, Rebbi Yasa, Rebbi Joḥanan, Rebbi Yannai in the name of Rebbi: If somebody eats food which is third degree impure for heave, his body is disqualified from eating heave. Is that not a Mishnah that third degree impurity is second degree impurity for sancta? The Mishnah is about Temple sancta which were sanctified. He tells you in addition, even for profane food prepared in the standards of sancta. Rebbi Abun bar Ḥiyya said before Rebbi Ze`ira: The Mishnah says so, “loaves of sancta bread; the water in their cavities is sanctified.” Does it displease you that it comes to tell you that he makes fluid by your pronouncement like sanctified fluid? Rebbi Ze`ira said, as you are saying there, one made one pure for the ashes of the Red Cow equal to the water for the ashes of the Red Cow and to the ashes of the Red Cow, and here one made fluid by your pronouncement like sanctified fluid. Rebbi Ze`ira, Rebbi Yasa, Rebbi Joḥanan, Rebbi Yannai, and it is unknown whether this is in the name of Rebbi: There is a Mishnah which is both confirmation and disproof. From it confirmation: “For third degree impurity is second degree impurity for sancta, but not second degree impurity for heave, if it was prepared by the standards of heave.” But if it was prepared in the standards of sancta, his body is second degree impure for sancta. From it disproof: For third degree impurity is second degree impurity for sancta, but not second degree impurity for heave, if it was prepared by the standards of sancta. But if it was prepared in the standards of heave, his body is second degree impure for heave and a fortiori for sancta.

MISHNAH: If one opens a barrel, or one starts to sell his dough, on the holiday, Rebbi Jehudah says, he may finish, but the Sages say, he may not finish. After the holiday one proclaims the purity of the courtyard. If the holiday was over on a Friday one did not go over it because of the honor of the Sabbath. Rebbi Jehudah says, also not if the holiday was over on Thursday since the priests are not free.
MISHNAH: How does one proclaim the purity of the courtyard? One immerses all vessels in the Temple. There were seconds and thirds, that in case the first ones became impure one would bring the seconds in their place. All vessels in the Temple need immersion except the golden altar and the copper altar since they are like soil, the words of Rebbi Eliezer, but the Sages are saying, because they are plated.
It was stated: “If the table became impure one immerses it at its time, even on the Sabbath, the words of Rebbi Meïr. But the Sages are saying, immediately.” You find to say, in Rebbi Meïr’s opinion it makes two breads impure; in the rabbis’ opinion it only makes one bread impure. Rebbi Jacob bar Sosai said before Rebbi Yose, even according to Rebbi Meïr it makes only one bread impure. Explain it if it became impure by fluids of questionable status. “Once they immersed the candelabrum. The Sadducees said, look the Pharisees immerse the ball of the sun.”
Rebbi Shiloh from Kefar-Tamarta in the name of Rebbi Joḥanan: The reason of Rebbi Eliezer: And you shall cover it with pure gold, etc. The Torah called it real estate. So far the golden altar. From where the altar of the elevation sacrifices? It is a logical argument. Since the golden altar which is one cubit square is called real estate, the altar of elevation sacrifices which is five cubits square not so much more? Some want to say, square, square. Since here it is real estate, also there it is real estate. Rebbi Hila said, the reason of the rabbis, the altar is of wood, three cubits its height, etc. The Torah called it movable. So far the altar of the elevation sacrifices. From where the golden altar? It is a logical argument. Since the the altar of the elevation sacrifices which is five cubit square is called soil, the golden altar which is one cubit square not so much more? Some want to say, square, square. Since here it is movable, also there it is movable. “But the Sages say, because they are covered.” But is it not cover which stands because of it? Did not Rebbi Simeon ben Laqish say in the name of Rebbi Hoshaia: Its thickness was that of a Gordian denar Rebbi La said, for its purpose it does not stand because of it. This parallels what Rebbi Simeon ben Laqish said, you shall make an altar for incense smoke is not written here but burning incense; the altar was burning the incense. But is it not like a table made to be moved and deposited? Does not Rebbi Immi say in the name of Rebbi Simeon ben Laqish: why is the table impure? Not because one was removing it and showing it to the pilgrims? But this one remains in its place. It also served as a vessel in the Sanctuary. Then it should be pure, why is it impure? Rebbi Mana said, as what we have stated there, “there are three baskets”. Rebbi Ze`ira said, because one uses it for its bales; so also here one uses it for its bales.
HALAKHAH: “One waters irrigated plots,” etc. One understands a well which does not flow newly. A well which flows newly? Is that not requiring effort? But it follows Rebbi Meïr, as Rebbi Meïr says, one uses it to irrigate even a field depending on rain water. Rebbi Yose said, it is the opinion of everybody if it was one and became two or its waters were few and it was blessed. We have stated thus: “From a well which flowed newly one irrigates even a field depending on rain water, the words of Rebbi Meïr; but the Sages are saying one uses it to irrigate only an irrigated plot which dried up.” In the opinion of Rebbi Meïr one irrigates from it something not in danger of loss and something requiring effort. In the opinion of the rabbis one irrigates from it only something in danger of loss and only if not requiring effort. What do the rabbis say if there is danger of loss but it requires effort? Let us hear from the following: Anything which is continuously losing value is an irrigated plot. When it stopped weakening it is a field depending on rain water; the disagreement between Rebbi Meïr and the Sages. How long does it have to be irrigated to become an irrigated field? Only if was irrigated two, three days before the holiday? Let us hear from the following: The Qabray dried up three days before the holiday, and it came back on the holiday. The case came before Rav Ḥuna who said, those weakened shall be irrigated, those not weakened may not be irrigated. Rebbi Jonah and Rebbi Yose instructed about that cool shadowy place which was sown with barley that it should be cut on the holiday to avoid their cracking and being lost.

MISHNAH: Rebbi Eleazar ben Azariah says, one does not make new water canals on the holiday or in the Sabbatical year but the Sages are saying that one makes new water canals in the Sabbatical year and one fixes the broken ones on the holiday and one repairs all defects in the public water system and cleans it. Also one repairs the roads, and the streets, and water pools, and one looks after all public needs, and marks the graves, and also goes to inspect for kilaim.
MISHNAH: Rebbi Eliezer ben Jacob says, one draws water from tree to tree, but he should not water the entire orchard. Produce which was not irrigated before the holiday he may not irrigate during the holiday. However, the Sages permit in both cases.
“However, the Sages permit in both cases.” What means “in both cases”? Whether it was irrigated before the holiday or was not irrigated before the holiday? But both for tree and for vegetable.
MISHNAH: Rebbi Meïr says, one inspects skin-disease to alleviate but not to restrict; but the Sages say, neither to alleviate nor to restrict. Rebbi Meïr also said, a person may collect his father’s or mother’s bones because it is an occasion of joy. Rebbi Yose says, it is an occasion of mourning. Thirty days before the holiday one should neither memorialize nor eulogize his deceased.
HALAKHAH: There, we have stated: “A white spot in the size of a grit and it spread in the size of a grit [and in the spread appeared a healthy spot or a white hair] but the original disappeared. Rebbi Aqiba declares him impure, but the Sages are saying, it should be seen as a new case.” Therefore, Rebbi Aqiba declares him impure absolutely. But the rabbis are saying, it should be seen as a new case as absolutely {impure}. What is the difference between them? Rebbi Joḥanan said, holiday eve is between them. Rebbi Aqiba says that this is the former case and you do not deal with him neither to alleviate nor to restrict. But the rabbis are saying that this is a new case and you free him from the first one. And this is “not to restrict” that you should not deal with the second case neither to alleviate nor to restrict. Rebbi Yose in the name of Rebbi Aḥa, it turns out that the single opinion here parallels the anonymous opinion there and the single opinion there parallels the anonymous opinion here. The single opinion here parallels the anonymous opinion there: Rebbi Aqiba says that this is the former case and you do not deal with him neither to alleviate nor to restrict. And the single opinion there parallels the anonymous opinion here: The rabbis are saying that this is a new case and you free him from the first one. And we have stated here, “Rebbi Meïr says, one inspects skin-disease to alleviate but not to restrict” Rebbi Yose ben Rebbi Abun in the name of Rebbi Aḥa: Either following the single opinion here or the rabbis here the rabbis there agree to alleviate but not to restrict. There, if the original disappeared, but here, if the indications {of impurity} disappeared and the original remains. “Rebbi said, the opinion of Rebbi Yose is reasonable for one in quarantine and the opinion of Rebbi Meïr if he is absolutely {impure}.” Rebbi Ze`ira said, they disagree about the holiday itself. Rebbi Aqiba says that this is the former case; could he enter the Temple courtyard? But the rabbis are saying, this is a new case; could he not enter the Temple courtyard? Therefore, Rebbi Aqiba declares him impure absolutely. But the rabbis are saying, it should be seen as a new case to become absolute. What is between them? (It will be sweet for him to hear a temporary release from the mouth of the Cohen.) Samuel said, they disagree about expansion. Rebbi Aqiba says that this is the former case and the expansion of impurity is pure. But the rabbis are saying that this is a new case and the expansion of purity is impure. One said in Samuel’s name, expansion and treatment-resistant scabies is between them. Rebbi Aqiba says that this is the former case and the expansion of impurity is pure. But the rabbis are saying that this is a new case and the expansion of purity is impure. Because it is another case. Therefore otherwise it would be pure. It parallels what Rebbi Simeon ben Laqish said when they differed, if it developed treatment-resistant scabies, Rebbi Joḥanan said pure, Rebbi Simeon ben Laqish said impure.
Rebbi Jehudah bar Pazi in the name of Rebbi Joḥanan: Just as they differ here they differ in the rules of mourning. As it was stated: The following things one does for the mourner in his mourning period. One presses his vat, and stirs his wine, and plugs his amphoras, and his repeatedly turned olives one grinds as usual, and one waters his irrigated fields if it is time for them to be irrigated, and one sows his field flax at the start of the rainy season, the words of Rebbi Jehudah. They told him, if it is not sown with flax it can be sown with another kind; if it was not sown in this week it can be sown in another week. Who is “they told him”? Rebbi Yose. The argument of Rebbi Jehudah seems inverted. There he said, small amounts may be lost so large amounts not be lost, and here he says so? There is a difference since there he is wont to be tricky. So much more the argument of Rebbi Jehudah seems inverted, since there where he is wont to be tricky he says it is permitted, here where he is not wont to be tricky, not so much more? Rebbi Ḥinnena said, who is “they told him”? The Sages following Rebbi Jehudah’s argument for the holiday.
MISHNAH: And the following shave on the holiday: He who comes from overseas, or from being kidnapped, or leaves jail, and one whose excommunication was lifted by the Sages, and also who asked the Sages and was permitted, and the nazir, and the sufferer from skin disease between his impurity and his purity.
It was stated in the name of Rebbi Jehudah: Shaving is forbidden to someone who comes from overseas. Rebbi Jehudah follows his own opinion since Rebbi Jehudah said, it is forbidden to sail on the ocean. Then a Cohen who left for outside the Land and left against the will of the Sages should be forbidden to shave. A Cohen came to Rebbi Ḥanina. He said to him, may one leave for Tyre for as religious obligation, to give ḥaliṣah or to enter levirate marriage? He answered him, this man’s brother left; praised be the Omnipresent Who smote him. And you want to do what he did. Some want to say, so he spoke to him: This man’s brother disdained his mother’s bosom and embraced another’s bosom, and you want to do what he did. Simeon bar Abba came to Rebbi Ḥanina and asked him to write a letter of recommendation so he could leave for his sustenance outside the Land. He said to him, tomorrow I shall go to your forefathers; they would say to me, one desirable plant we had in the Land of Israel and you permitted it to leave the Land.
“And one whose excommunication was lifted by the Sages.” Where are we holding? If they lifted it before the holiday, he should have shaved. If they did not lift it before the holiday, he may not shave. But we hold that they lifted it before the holiday and his thirtieth day fell during the holiday, since no excommunication is less than thirty days and no rebuke is less than seven days. No excommunication is less than thirty days, up to a month of days, until it will come out of your noses. And no rebuke is less than seven days, let her be locked away for seven days. Rebbi honored Ben Elasa. Bar Qappara said to him, everybody is asking Rebbi, only you are not asking Rebbi. He asked him, what to ask? He said to him, ask: “From Heaven she looks down, she is busy in her house; boys see her and hide, old men rise and stand. The one who flees says, ho, ho, and the one caught is caught in his sin.” Rebbi turned around and saw him laughing. Rebbi said, I do not know you, old man. He understood that he would not be ordained during his lifetime.
They wanted to excommunicate Rebbi Eliezer. They said, who will go and inform him? Rebbi Aqiba said, I shall go and inform him. He went to him and said to him, my teacher, my teacher, your colleagues are excommunicating you. He took him outside, saying: Carob tree, carob tree, if practice has to follow their words, be uprooted. It was not uprooted. If practice has to follow my words, be uprooted. It was uprooted. If practice has to follow their words, turn back. It did not turn back. If practice has to follow my words, turn back. It turned back. All these extraordinary happenings and practice do not follow Rebbi Eliezer. Rebbi Ḥanina said, when it was given, it also was given to follow the majority opinion. [Did Rebbi Eliezer not know that practice has to follow the majority opinion?] He was offended only because they burned his food prepared in purity in his presence. There we have stated: “If it was cut into strips and sand was placed between any two strips, Rebbi Eliezer declares pure but the Sages declare impure. This is the Ḥakhinai oven.” Rebbi Jeremiah said, a big itching was happening on that day: Everything on which Rebbi Eliezer gazed was burned. Not only that, but a grain of wheat might have been half burned and half not burned, and the walls of the house of assembly were weakened. Rebbi Joshua said to them, if colleagues are fighting, what does this concern you? There came an unembodied voice and said, practice follows My son Eliezer. Rebbi Joshua said, it is not in Heaven. Rebbi Crispus, Rebbi Joḥanan in the name of Rebbi: If a person would say to me, that is how Rebbi Eliezer stated, I am stating following his words since the Tannaïm switch. Once he was walking in public and he saw a woman when sweeping her house throwing it out, it fell on his head. He said, it seems that today my colleagues are befriending me, for it is written: He lifts the downtrodden from the dung heap.
It was stated: Rebbi Yose said, Theudas of Rome led the people of Rome to eat helmeted kid-goat in the Passover nights. the Sages sent and said to him, if you were not Theudas, would we not put you in the ban? Who was Theudas? Rebbi Ḥananiah said, because he was providing for the rabbis. Are you not causing the public to eat sancta outside the Temple? And anybody causing the public to eat sancta outside the Temple has to be put in the ban.
“And also who asked the Sages and was permitted.” Where do we hold? If he asked before the holiday he should shave; if he did not ask before the holiday he should not shave. But we hold in case that he asked before the holiday and they found an opening only on the holiday. As the following: They did not find an opening for Rebbi Simeon ben Rebbi until one of the Sages of Galilee came; some say, he was Rebbi Simeon ben Eleazar. He took him from one place and put him in another, he took him from one place and put him in another until finally he put him into the sun and told him to check his garments for fleas. They said to him, if you had known that this old man would treat you in such a way, would you have made the vow? He said, No. They permitted him. They asked, from where do you have this? He said to them, I was Meïr’s servant when he fled the second time, but some say that Rebbi Meïr’s staff was in his hand and it taught him knowledge.
“And also who asked the Sages and was permitted.” Where do we hold? If he asked before the holiday he should shave; if he did not ask before the holiday he should not shave. MISHNAH: And the following may wash on the holiday: He who comes from overseas, or from being kidnapped, or leaves jail, and one whose excommunication was lifted by the Sages, and also who asked the Sages and was permitted. Hand towels, and barber’s cloths, and body towels, and all who ascend from impurity to purity are permitted to wash, but anybody else is forbidden.

Hand towels, and barber’s cloths, and body towels, and all who ascend from impurity to purity are permitted to wash, but anybody else is forbidden.
It was stated: These are the words of Abba Shaul. Rav Jehudah in the name of Samuel, Rebbi Abbahu in the name of Rebbi Joḥanan: Practice follows Abba Shaul. Rebbi Abba in the name of Rav: The word of Abba Shaul: both days and decrees are cancelled. But the words of the Sages: the days are cancelled but the decrees are not cancelled. What is the difference between them? Rav Ḥuna said, the eve of a holiday is between them. If he shaved before the holiday he may shave after the holiday. If he did not shave before the holiday he may not shave after the holiday. Rebbi Joḥanan said, even if he did not shave before the holiday he may shave after the holiday. Rebbi Eleazar instructed Rebbi Simeon bar Abba to shave after the holiday, but we do not know whether following Abba Shaul or following the consensus of the rabbis.
MISHNAH: Rebbi Eliezer says, since the Temple was destroyed Pentecost is like Sabbath. Rabban Gamliel says, New Year’s Day and the Day of Atonement are like holidays. But the Sages are saying not like the words of either one but Pentecost is like holidays, New Year’s Day and the Day of Atonement are like Sabbath.
For his father, and for his mother, and for his teacher who taught him wisdom, from where? And Elisa saw, and he cried ‘my father, my father, chariot of Israel and its charioteers’. Rebbi Mattun asked before Rebbi Joḥanan: May one infer instruction from Elisa? He said to him Mattun, Mattun, just as a dead person from the moment he is deceased cannot see him, so also from the moment he disappeared he did not see him. In the same way one tears for the Sages so one tears for their students. Who is a student of the Sages? Ḥizqiah said, any who has studied practices up to the Torah. Rebbi Yose said to him, that you are saying for earlier ones. But today only practices. Rebbi Abbahu in the name of Rebbi Joḥanan: Any who neglects his business for his learning. It was stated: Any whom one asks and he answers. Rebbi Hoshaia said, for example, we, since our instructors supervise us and we answer them. Rebbi Abba bar Mamal said, any who can explain his Mishnah. But as relates to us, even our teachers are not wise to explain our Mishnah.

Rebbi Jacob bar Idi in the name of Rebbi Joshua ben Levi: It happened that the Sages visited Rebbi Dosa ben Hyrkanos to ask him about the daughter’s co-wife. They said to him, are you the one who permits co-wives? He said to them, what did you hear? Dosa ben Hyrkanos? They said to him, ben Hyrkanos. He said to them, my brother Jonathan is exceedingly sharpminded and of the students of the House of Shammai. Be careful with him, he has three hundred arguments about the daughter’s co-wife. They went to him. He sent and wrote to him, be careful because the Sages of Israel will visit you. They came and he placed them before him. He lectured but they did not understand, repeatedly. They started to get drowsy. He said to them, why are you getting drowsy? He started pelting them with pebbles. But some people said, they entered in one door and left in three. He sent to say to him, why did you send to me, the people want to learn and you said to me, these are the Sages of Israel? They came to him and said to him, what do you say in the matter? He said, on this stone sat the prophet Ḥaggai and testified to three things: On the daughter’s co-wife that she can be married into priesthood, on Ammon and Moab that they tithe for the poor in a Sabbatical year, and on proselytes of Palmyra that they are acceptable to marry into the congregation. He said, lift my eyelids so I can see the Sages of Israel. He saw Rebbi Joshua and said to him: “To whom will one teach knowledge?” I remember that his mother brought his crib to the Synagogue that his ears should cling to the words of the Torah. [He saw] Rebbi Aqiba, and said to him: “Lion cubs will be poor and hungry.” I know of him that he is a man strong in Torah. He saw Rebbi Eleazar ben Azariah and said to him: “I was a youth but became an elder.” I know of him that he is the tenth generation from Ezra and their eyes are similar. Rebbi Ḥanina from Sepphoris said, Rebbi Tarphon also was with them and he addressed him as he did Rebbi Eleazar ben Azariah.

“We killed him,” she should be married to others but not to him. “They said before Rebbi Jehudah, it happened that a robber was caught in Kappadokian Caesarea. When he went out to be executed, he said to them, go and tell the wife of Simeon ben Cahana that I killed him when he was coming into Lydda. The case came before the Sages and they confirmed his words. Rebbi Jehudah said to them: Is that a proof? He only said, we killed him.”
There, we have stated: “If a brother gave qiddushin to the sister of a woman waiting for the levir, they said in the name of Rebbi Jehudah ben Bathyra: One says to him, wait until your brother has acted. If [one of the] brothers performed ḥalîṣah or married her, he may marry his wife. If the sister-in-law died, he may marry his wife. If the levir died, he has to send away his wife by a bill of divorce and his brother’s widow by ḥalîṣah.” It says only: If the sister-in-law died, his wife is permitted to him. But if his wife died, his sister-in-law is forbidden to him. Rebbi Joḥanan said, these are the words of Rebbi Eliezer. But the Sages say, if his sister-in-law died, his wife is permitted to him, if his wife died, his sister-in-law is permitted to him. Rebbi Joḥanan said, the Sages hold that for anything induced by a cause, if the cause is removed the prohibition is removed. But for Rebbi Eliezer, if the cause is removed the prohibition remains.

What if there is a co-wife? Rebbi Hila in the name of Rebbi Avina: It is an inference de minore ad majus. If the Sages gave a co-wife to the sister of a woman with whom one performed ḥalîṣah, which is rabbinic, here, where there is the prohibition of sisters, not so much more? It is obvious that the rule of co-wives applies to his daughter. Rebbi Abun in the name of Rebbi Avina: One has stated there, “if the co-wives performed ḥalîṣah, the sisters were freed; if the sisters performed ḥalîṣah, the co-wives were not freed.” But as you say, if the co-wives performed ḥalîṣah, the sisters were freed, so it should be that even if the sisters performed ḥalîṣah, the co-wives should be freed. But it must follow Rebbi Joḥanan ben Nuri, since Rebbi Joḥanan ben Nuri said, come and let us institute that the co-wife perform ḥalîṣah without being admitted to levirate. Did they institute that? Was it not stated: They did not manage to institute this before the time became unsuitable. But it must follow the House of Shammai since the House of Shammai permit the co-wives to the brothers. Rebbi Phineas said to Rebbi Yose: If it follows the House of Shammai, even if the co-wives performed ḥalîṣah, the sistersshould not be freed! But we have stated: Rebbi Eliezer said, the House of Shammai say, they shall keep them, but the House of Hillel say, they have to divorce. There are two Tannaïm interpreting the House of Shammai, one said if the co-wives performed ḥalîṣah, the sisters were freed, the other one said if the co-wives performed ḥalîṣah, the sisters were not freed.
So is the Mishnah: “The relative of a co-wife of a person who had ḥalîṣah with him is permitted to him, but the co-wife of a relative of a person who had ḥalîṣah with him is forbidden”. Rebbi Hila in the name of Rebbi Avina: It is an inference de minore ad majus. Rebbi Mana asked before Rebbi Yudan: There Rebbi Ḥizqiah, Rebbi Abbahu, said in the name of Rebbi Eleazar: Every place where Rebbi taught a disagreement and afterwards taught it anonymously, practice follows the anonymous Mishnah. And here, you say so? He said to him, if not Rebbi, maybe somebody else said it? Since when Rebbi taught a disagreement and afterwards taught it anonymously, practice follows the anonymous [text]. It must be that Rebbi did not find a disagreement in the Mishnah; but if others taught it in disagreement and Rebbi taught it anonymously, certainly practice follows the anonymous [text]. There come Rebbi Ḥizqiah, Rebbi Jacob bar Abba and Rebbi Simeon bar Abba, in the name of Rebbi Eleazar: Even if others taught a disagreement but Rebbi taught it anonymously, practice follows the anonymous [text]. Why does he agree here with a dissenting opinion? Rebbi Samuel ben Inaya in the name of Rebbi Aḥa. That means, if no diagreement is stated together with the anonymous [text], but if a disagreement is stated together with the anonymous [text], practice does not follow the anonymous [opinion]. Rebbi Yose ben Rebbi Abun in the name of Rebbi Aḥa. That is, if individual disagrees with individual. But if an individual disagrees next to the [anonymous] Sages, practice does not follow the anonymous [text].
MISHNAH: He who takes back his divorcee, or marries the woman with whom he performed ḥalîṣah, or marries a relative of the woman with whom he performed ḥalîṣah, has to divorce her and any child is a bastard, the words of Rebbi Aqiba. But the Sages say, it is not a bastard. But they agree that the child of one who marries a relative of his divorcee is a bastard.
MISHNAH: Rabban Gamliel says, there is no bill of divorce after a bill of divorce, no “bespeaking” after “bespeaking”, no copulation after copulation, and no ḥalîṣah after ḥalîṣah. But the Sages say, there is a bill of divorce after a bill of divorce and “bespeaking” after “bespeaking”, but nothing after copulation or after ḥalîṣah.
Does Rabban Gamliel follow Rebbi Simeon to say that “bespeaking” either acquires or does not acquire? And here, against Rebbi Simeon that a bill of divorce frees or does not free? Let us hear from the following: “Rabban Gamliel agrees with the Sages that there may be a bill of divorce after ‘bespeaking’ and ‘bespeaking’ after a bill of divorce, a bill of divorce after intercourse and ‘bespeaking’, and ‘bespeaking’ after intercourse and a bill of divorce.” How can there be a bill of divorce after intercourse and “bespeaking”? There were three sisters-in-law. He “bespoke” one, had intercourse with another, and gave a bill of divorce to the third. This implies that “bespeaking” acquires partially. If you would say that “bespeaking” either acquires or does not acquire then, as you take it, if “bespeaking” acquired, there can be nothing after that. If “bespeaking” did not acquire, intercourse should acquire and there should be nothing after that. This implies that “bespeaking” acquires partially. How can there be “bespeaking” after intercourse and a bill of divorce? If there were three sisters-in-law. He gave a bill of divorce to one, had intercourse with another, and “bespoke” the third. This implies that a bill of divorce frees partially. If you would say that a bill of divorce either frees or does not free then, as you take it, if a bill of divorce frees, there can be nothing after that. If a bill of divorce does not free, intercourse should acquire and there should be nothing after that. This implies that a bill of divorce frees partially. Does Rabban Gamliel follow Rebbi Simeon? There is no “bespeaking” after “bespeaking” a sister-in-law following Rebbi Simeon. But the argument of one is different from the argument of the other. The argument of Rabban Gamliel: any part which a “bespeaking” of the the second could acquire in the future, the first already had acquired. Any part which a bill of divorce from the second [brother] could free in the future, the bill of divorce of the first already had freed. The reasoning of Rebbi Simeon: If the first [brother] acquired, so did the second. If the first [brother] did not acquire, neither did the second. If the first [bill of divorce] did not free, neither did the second.
In the opinion of Rabban Gamliel, can there be invalid intercourse after invalid intercourse, or the intercourse of a nine-years-old after the intercourse of [another] nine-years-old, or invalid intercourse after the intercourse of a nine-years-old, or intercourse of a nine-years-old after invalid intercourse? Do the Sages agree with Rabban Gamliel that there cannot be “bespeaking” after “bespeaking” for one sister-in-law? How is that? If he “bespoke” his sister-in-law, gave her a bill of divorce, and “bespoke” her again. If you say, there can be “bespeaking” after “bespeaking”, she did not become free by that bill of divorce. If you say, there cannot be “bespeaking” after “bespeaking”, she was freed by that bill of divorce.
“If he gave a bill of divorce, and ḥalîṣah, nothing is valid after ḥalîṣah,” etc. Did we not state already “there is nothing after ḥalîṣah”? Because we stated after that, “whether there is one sister-in-law or two sisters-in-law”. If somebody gave qiddushin to the one with whom he performed ḥalîṣah, would they not lay hold on her? Explain it either following Rebbi if he did not intend it or according to everybody if he intended to acquire as “bespeaking” of a sister-in-law but she was not his sister-in-law. Rebbi Abba said, this was stated: “ ‘Bespeaking’ acquires whether intentional or not intentional, the words of Rebbi. But the Sages say, it acquires only with intention. Rebbi agrees that qiddushin acquire only with intention.” What is Rebbi’s reason? Intercourse acquires, “bespeaking” acquires. Just as intercourse acquires whether intentional or not intentional, so “bespeaking” acquires whether intentional or not intentional. And just as Rebbi says, “bespeaking” acquires whether intentional or not intentional, so he says the bill of divorce frees whether intentional or not intentional. And why does Rebbi say that “bespeaking” acquires whether intentional or not intentional? Since intercourse of an adult acquires whether intentional or not intentional. Even if the bill of divorce would free even if not intentional, ḥalîṣah can free only if it is intentional.
A sister injured by a piece of wood, Rebbi Meїr and Rebbi Simeon say, he shall not defile himself for her, but the Sages say, he must defile himself for her. Rebbi Meїr and Rebbi Simeon follow well what they have stated, but the argument of Sages seems inverted. There, they say “a girl”, not an adult, “a virgin”, not one injured by a piece of wood; and here, they say so? Rebbi Hila said, every interpretation follows its context. There, “and for his virgin sister”, that excludes the raped and the seduced one. Or maybe I should exclude the one injured by a piece of wood? The verse says, “who had not been a man’s.” Who became [deflowered] through the action of a man, not one who became it through something else. “The close one”, to include the betrothed one. “To him”, to include the adult. The argument of Sages seems inverted. There, they say “the close one”, to exclude the betrothed one, “to him”, to exclude the divorcee. And here, they say so? Rebbi Hila said, every interpretation follows its context. “His sister” is always inside [the family] until she leaves; his betrothed is always outside until she enters.

MISHNAH: A private priest should not marry a she-ram unless he has a wife and children. Rebbi Jehudah says, even one who has a wife and children should not marry a she-ram since she is the harlot mentioned in the Torah. But the Sages say, a harlot is only a convert, a freedwoman, and one who copulated in harlotry.
“If they are unable to marry in Israel they disable.” These are: “A child of nine years and one day, an Ammonite, Moabite, or Egyptian proselyte, or a bastard, desecrated, Gibeonite, Samaritan, and Gentile who had intercourse with the daughter of an Israel, a Cohen, or a Levite, disqualified her for the priesthood. Rebbi Yose said, everybody’s intercourse disqualifies whose descendant would be disqualified; his intercourse does not disqualify those whose descendant would not be disqualified. Rabban Simeon ben Gamliel says, in all cases, if his daughter is permitted to you, so is his widow; if his daughter is not permitted to you, neither is his widow.” In what do they differ? Rebbi Joḥanan says, an Ammonite or Moabite proselyte is between them. For him who says, everybody’s intercourse disqualifies whose descendant would be disqualified, here since his descendant would be disqualified, his intercourse disqualifies. For him who says, if you may marry his daughter you may marry his widow, here since you may marry his daughter you may marry his widow. The words of the Sages? Rebbi Jeremiah in the name of [the rabbis], Rebbi Abba, both say: Regarding the daughter of an Ammonite or Moabite proselyte or the daughter of a second-generation Egyptian, even though his daughter is permitted to you, his widow is forbidden to you. Rebbi Zakkai: Rebbi Alexander sent to ask [about] the daughter of an Ammonite proselyte and the daughter of a second-generation Egyptian. Rebbi Yose said to him, did you not hear that Rebbi Jeremiah in the name of the rabbis, Rebbi Abba, both say: Regarding the daughter of an Ammonite proselyte or the daughter of a second-generation Egyptian, even though his daughter is permitted to you, his widow is forbidden to you. And everybody’s intercourse disqualifies whose descendant would be disqualified. Do we not need it when her mother was from Israel? That you should not say that since her mother was desecrated so her daughter was desecrated. In addition, Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed, the daughter of an Ammonite proselyte or the daughter of a second-generation Egyptian, Rebbi Joḥanan said, they are acceptable, Rebbi Simeon ben Laqish said, they are disqualified. Rebbi Yose ben Abun said, they disagree about the old women: Rebbi Joḥanan said, they are acceptable, Rebbi Simeon ben Laqish said, they are disqualified.
HALAKHAH: “A slave disables because of intercourse,” etc. From where that the intercourse with a slave disables? Rebbi Joḥanan said in the name of Rebbi Ismael: “If a Cohen’s daughter becomes a widow or a divorcee without issue,” from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. Rebbi Jeremiah objected: But if a widow whored she has no widowhood or divorce and she returns! Rebbi Yose did not say so, but [he held] that the argument of Rebbi Joḥanan is reversed. In Giṭṭin he says, why are Samaritans disqualified? Rebbi Joḥanan in the name of Rebbi Ismael: Because if a Gentile or a slave has intercourse with a Jewish woman, the child is a bastard. In Qiddushin one says, Rebbi Joḥanan and Rebbi Simeon ben Laqish both say, the child is a bastard. Here he says it in his own name but there he says it in the name of Rebbi Ismael! For also according to the words of the Sages the child is a bastard. Rebbi Ḥizqiah did not say so, but: the argument of Rebbi Joḥanan is reversed. In Giṭṭin he says, why are Samaritans disqualified? Rebbi Joḥanan in the name of Rebbi Ismael: Because if a Gentile or slave has intercourse with a Jewish woman, the child is a bastard. In Qiddushin one says, Rebbi Joḥanan and Rebbi Simeon ben Laqish both say, the child is a bastard. Here he says, from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. Rebbi Mattaniah said, I went to Seḥora and heard: Rebbi Joḥanan and Rebbi Ismael the sons of Jesua: “If a Cohen’s daughter becomes a widow or a divorcee without issue,” from [a man] with whom she has widowhood or divorce she returns, from [a man] with whom she has no relation of widowhood or divorce she does not return. And I said, that is correct, there is no bastard, following Rebbi Joshua, for a bastard is only from a woman which is for him under an incest prohibition and for whom one is punished by divine extirpation.
Rav Jehudah in the name of Rav: Practice follows Rebbi Eliezer. The words of the Sages? Rebbi Jeremiah in the name of Rebbi Samuel bar Rav Isaac, it is written: “No bastard shall marry into the Eternal’s congregation”. He cannot marry into a congregation which is certain. He may marry if the membership in the congregation is questionable.
Rebbi Joḥanan said, one does not investigate a family in which a family disqualification has disappeared. Rebbi Simeon ben Laqish said, a Mishnah says so: “There was a family in Bet Ṣerifa in Transjordan who was forcibly distanced by Ben Ṣion. Another [family] was there who was forcibly integrated by Ben Ṣion.” Nevertheless, the Sages did not want to make their names public. But the Sages transmit them to their sons and students two times in a Week. Rebbi Joḥanan said, by the Temple service, I know them and the leading personalities of the generation have disappeared in them. Rebbi Joshua ben Levi said, Pashḥur ben Immer the priest had 5000 slaves, and their traces have disappeared in the high priesthood. These are the insolent in the priesthood. Rebbi Eleazar said, their main training: “Your people is like quarrelsome priests.” Rebbi Abbahu said, Samaritans disappeared in thirteen villages in the times of persecution. They said, the village of Moshhan is one of them.

Rebbi Ḥiyya in the name of Rebbi Joḥanan: These are the words of Rebbi Eliezer, Rebbi Aqiba, and Rebbi Joshua. But the words of the Sages are that neither the castrate by human action nor the congenital castrate is able to perform ḥalîṣah nor does one perform ḥalîṣah for his wife. He cannot perform levirate, nor does one marry his wife in levirate. That is the Mishnah: “The castrate who performed ḥalîṣah for his sister-in-law did not disable her; if he copulated with her, he disabled her because it is incestuous.” The hermaphrodite who performed ḥalîṣah for his sister-in-law did not disable her; if he copulated with her, he disabled her because it is incestuous. “Similarly, if the brothers performed ḥalîṣah for a she-ram, they did not disable her; if they copulated with her, they disabled her because it is incestuous.”
HALAKHAH: “They came and told her, your son died,” etc. If she should not have married but entered levirate, this is the case of a sister-in-law who married without ḥalîṣah. Rebbi Jeremiah said, this man performs ḥalīṣah, the other one keeps her. Rebbi Jehudah ben Pazi in the name of Rebbi Joḥanan: She must leave. Rebbi Yose in the name of Rebbi Hila: She must leave. Rebbi Yose asked Rebbi Phineas, how does the rabbi hold? He said, with Rebbi Jeremiah. He said to him, change your mind, for otherwise I shall publicly call you a rebellious Elder. Rebbi Zevidah said, a baraita supports Rebbi Joḥanan: “She must leave both of them and the thirteen items apply to her, following Rebbi Meïr who said it in the name of his teacher Rebbi Aqibah. But the Sages say, there is no bastard from a sister-in-law.” They only said, “there is no bastard from a sister-in-law,” therefore she must leave. And we have stated, “she must leave”. And Rebbi Joḥanan said, she must leave.
Rav said, the essence of ḥalîṣah is the untying of the shoelace. Did not Rebbi Abba say in the name of Rav Jehudah, Rebbi Zeriqan turns to it in the name of Rav: The words of the Sages: If she slips off but did not spit, or spat but did not take off, nothing was done unless she slips off and spits. Even though Rav said “unless she slips off and spits” he agrees that the essence of slipping off is untying the shoelaces.
“A wooden sandal.” The colleagues in the name of Rav: If only the edges are wooden. Rebbi Abba in the name of Rav: If only the bottom of the sole is wooden. There, they say in the name of Rav: If only the loops are wooden. Rebbi Hila in the name of Rebbi Joḥanan: Even if it is entirely of wood it is valid. A baraita supports Rebbi Joḥanan: “ A straw sandal becomes impure by being stepped on and a woman may use it for ḥalîṣah, the words of Rebbi Aqiba, but the Sages do not agree about impurity by being stepped on.”
HALAKHAH: “If she stripped off and spat,” etc. Samuel said, if she stripped but did not spit, she shall spit. This follows Rebbi Eliezer. Rebbi Hila in the name of Rebbi Eleazar: If she stripped but did not recite nor spit, her ḥalîṣah is invalid. Still that is Rebbi Eliezer’s. The words of the Sages? Rebbi Abba in the name of Rav Jehudah, Zeriqan turned to it in the name of Rav: If she stripped but did not spit, or spat but did not strip, she did not do anything until she strips and spits. Rebbi Abba asked before Rebbi Immi: If she spat before she stripped? He said, it is as if in the correct order. If he made a betrothal with a cluster of end-of-harvest [figs]? He said to him, with the figs hanging there he made the betrothal. May one open an Egyptian window into a common backyard higher than four cubits? He said to him, so we are saying: He comes simply for the air. Rebbi Nasa said, that is what he said: If somebody wants to build his house in the form of a dovecot, does one not listen to him?
There, we have stated: “Everybody is obligated for appearance except the deaf-mute, the insane, and the minor.” The colleagues in the name of Rebbi Eleazar (Deut. 31:12): “So they should hear and learn.” So far one who speaks but cannot hear; what about one who hears but cannot speak? Rebbi La in the name of Rebbi Eleazar (Deut. 31:12): “So they should learn,” so they should teach. Rebbi Jonah said, this means that the principles of Rebbi are no principles, since we have stated: “A ḥereš who speaks but cannot hear should not give heave,” and we thought that one who speaks but does not hear is ḥereš, one who hears but does not speak isḥereš. But we have stated: “Ḥalîṣah is invalid if performed for a ḥereš man, or by a ḥereš woman, or for an underage male.” And Rebbi Joḥanan said, because they cannot say (Deut. 25:8): “he shall say”, (Deut. 25:7,9) “she shall say.” We also have stated: “A ḥereš mentioned anywhere by the Sages is a deaf-mute.” This supports Rebbi Jonah, for Rebbi Jonah said that the principles of Rebbi are no principles.
“ The House of Hillel said to the House of Shammai: It happened with the wife of the cameldriver Pison that the Sages repudiated for her in her absence. The House of Shammai said to them, is that a proof? Since he measured crookedly, the Sages measured crookedly for him.” This is difficult. Because a man behaves incorrectly, does one permit his incest prohibition? Rab Ḥisda said, that means that, if she transgresses and repudiated after marriage, the House of Shammai recognize her act of repudiation.

Rebbi Abba in the name of Rav Ḥiyya bar Ashi: It happened that a girl went to wash at the river when they said to her, your betrothed is passing by. She said, let my mother go and marry him! When the case came before the Sages, they said that there is no repudiation stronger than that. Rebbi Ḥanina said, It happened that a girl went to buy flax from the flax dealer when they said to her, your betrothed is passing by. She said, let my mother go and marry him! When the case came before the Sages, they said that there is no repudiation stronger than that. It was stated in the name of Rebbi Jehudah: “Even if she went to buy something at the store and said, I cannot endure my husband X, there is no repudiation stronger than this.

Rebbi Eliezer says, the actions of an underage girl have no legal standing. He has no right to what she finds or earns, nor may he dissolve her vows; she is as if not his wife in any respect except that she needs repudiation from him. Rebbi Joshua said, he owns what she finds or earns, he may he dissolve her vows; she is his wife in all respects except that she needs a bill of divorce from him. Rebbi Ismael said, I looked around at all logical systems of Sages and did not find anybody who was consistent in the matter of an underage girl except Rebbi Eliezer, only that he requires repudiation from him.
MISHNAH: If somebody divorced his wife and later took her back, she is permitted to the levir but Rebbi Eliezer forbids her. Similarly, if somebody divorced an orphan girl and took her back, she is permitted to the levir but Rebbi Eliezer forbids her. If an underage girl who was married off by her father was divorced, she is like an orphan during her father’s lifetime. If she was taken back, she is prohibited to the levir. The Sages agree with Rebbi Eliezer in case he divorced her as a minor and took her back as a minor, since her divorce is a total divorce but her return was not complete. But if he divorced her as a minor and took her back as an adult or she became an adult while married to him, she is permitted to the levir.
HALAKHAH: “The Sages agree,” etc. What is Rebbi Eliezer’s reason? That she was forbidden to him for an hour. The Sages agree with Rebbi Eliezer about the underage girl who was married off by her father and divorced, that she is like an orphan during her father’s lifetime. Her betrothal and divorce were by biblical standards; her remarriage was not by biblical standards.

HALAKHAH: “If an underage levir,” etc. It was stated: A claim of non-virginity may be brought within thirty days, the words of Rebbi Meїr. But the Sages say, immediately. Where do we hold? If he copulated, immediately. If he did not copulate, even after a longer delay. But we must hold if it was not spelled out. Rebbi Meїr said, it is credible that a man may hold himself back for thirty days. But the Sages say, a man does not hold himself back even for one day. Rebbi Jeremiah asked: According to Rebbi Meїr, would a man be believed to assert that he held himself back for thirty days in order to make the child fatherless? Let us hear from the following: “If the sister-in-law claims within thirty days that she was not copulated with, one forces him to perform ḥalîṣah with her. After thirty days, one asks him to perform ḥalîṣah with her.” (After thirty days.) And Rebbi Eleazar said, this is Rebbi Meїr’s. And Rebbi Eleazar said, that refers only to her, but not to her co-wife. As you say there, she is not believed to damage her co-wife, so here, he is not believed to damage his son.

MISHNAH: The House of Hillel say, we heard only about one who came from the grain harvest. The House of Shammai said to them, it makes no difference whether she comes from the grain harvest, or from the olive harvest, or from overseas. The Sages spoke about the grain harvest only because of what happened. The House of Hillel reversed themselves and taught following the House of Shammai.
The House of Shammai insist on interpretation of the ketubah. As the House of Shammai explain, we can infer that from the text of her ketubah document in which he writes: “If you would be married to another man you shall take the amount I wrote for you.” The House of Hillel reversed themselves and taught following the House of Shammai. The House of Hillel insist on interpretation of the ketubah. Hillel the Elder explained it, using the vernacular. In Alexandria they were writing that a man there became betrothed to a woman. Another man abducted her from a public place. When this came before the Sages, they intended to declare [the children] as bastards. Hillel the Elder told them, bring your mothers’ ketubah. They brough their mothers’ ketubah. They found written there: “When you enter my house you shall be my wife according to the laws of Moses and the Jews.”
“If one witness says,” etc. “If one witness says that he died and she remarried, then another comes and says that he is not dead, she shall not leave.” Because he said that after she had remarried. Therefore if [the second witness came] before she remarried, if she remarried she has to leave. Rebbi Joḥanan said, these are the words of Rebbi Menaḥem ben Rebbi Yose. But the words of the Sages [are], whether he testified after she remarried or before she remarried, she should not remarry, but if she remarried she shall not leave. Rav Naḥman bar Jacob said in the name of Rav, if she was married by the testimony of two witnesses, even if he returns, one says to him, “you are not he.” Rebbi Samuel ben Rav Isaac asked, think of it, if he is a famous person like Immi? Rebbi Yose ben Rebbi Abun said, is there nobody who would look like Rebbi Immi? There came a case before the rabbis there. They said to him, “you are not he.” Abba bar Abba got up and whispered in his ear saying, by your life, give her a bill of divorce because of the doubt. Rav’s students got up and beat him. Somebody said, the whip is burning and the footstool is burning. Samuel said, I was there, no whip was burning and no footstool was burning, but my father was hit and got up. There came a case before Rebbi Immi. He said to him, yes, it is sure that she is permitted to you but you should know that the child of this man is a bastard before Heaven. Rebbi Ze‘ira was praising him because he made the situation clear.
MISHNAH: If he fell into water, both enclosed and open, his wife is forbidden. Rebbi Meїr said, if happened that someone fell into a large cistern and came up after three days. Rebbi Yose said, it happened with a blind man who went to immerse himself in a cave, and his guide went after him, they stayed there the time to die [from drowning] and they permitted their wives to remarry. It also happened in Assos that one lowered a person into the sea and only his leg was recovered. The Sages said, if from the knee and higher, she can remarry, from lower than the knee she cannot remarry.
HALAKHAH: “If he fell into water, both enclosed and open, his wife is forbidden, the words of Rebbi Meĩr. But the Sages say, in open waters his wife is forbidden, in enclosed waters, his wife is permitted.” Rebbi Meїr said, it happened that someone fell into a large cistern and came up after three days. They said to him, one does not mention wonders. Rebbi said, it happened that two went to put fish nets into the Jordan in the evening. One of them saw a fish cave and entered it. When he wanted to leave, he was unable to find the cave’s entrance. His colleague waited at the entrance of the cave so long that he would be dead; he returned and reported to his house. Next morning when the sun shone, the man recognized the entrance of the cave, left, and found his house in mourning. Rebbi Aqiba said, It happened that I was traveling on the ocean that I saw a ship sinking. I was sorry for a student Sage who was on that ship. When I came to Kappadocian Mazaga he greated me and asked me questions. I said to him, my son, how did you escape? He told me, Rabbi, one wave tore me to another, and another to another, until it vomited me onto dry land. Then I said, how great are the words of the Sages who said, in open waters his wife is forbidden, in enclosed waters, his wife is permitted.

There, we have stated: “The seducer is a common person, the seduced is a common person.” Therefore, not a Sage? (Since he is seduced, he is not a Sage.) Since he seduces, he is not a Sage. Since he is seduced, he is not a Sage. What does one do to be sly about him? One hides two witnesses, people, in an inner room and puts him into the outer room, lights a candle near him so they can see him and hear his voice. That is what they did to Ben Satra in Lod, where they hid two Sages, brought him to court, and stoned him. And here, you say so? It is different because he said, “I am”. Here also, “I am”? That he should not flee, go away, and continue to seduce others with him.
If she was seen going to a secluded place by one witness in the morning and by one witness in the evening, it is to be treated like the following: “If she was together alone with him by the testimony of two witnesses, she needs a second bill of divorce from him; if there was a single witness she does not need a second bill of divorce from him. With one witness in the morning and one witness in the evening, such a case happened and Rebbi Eleazar ben Thaddeus asked the Sages, who told him that this is not being together alone.” If he declared his jealousy before one witness in the morning and before one witness in the evening; since he is a man and she is a woman, his declaration is nothing. Or is it to be treated like the following: “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥah says, even if they saw it one after the other.” Rebbi Jeremiah, Rebbi Samuel bar [Rav] Isaac in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥah with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah. The same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and the other says, I saw two hairs on his back. If one says, I saw one hair on her back and the other says, I saw one hair on her back, that is nothing; similarly on his back and on his back. If two say, we saw one hair on his back and two others say, we saw one hair on his belly? Rebbi Yose ben Rebbi Abun and Rebbi Hoshaia the son of Rebbi Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe they were rubbed off. Two say, we saw one hair on his back and two others say, we saw one hair on his belly. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Abba said, everybody agrees that this is valid. Rebbi Yudan said, this is in disagreement; Rebbi Yose said, this is in disagreement. Rebbi Yose said, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mana said, Rebbi Ḥaggai was correct. If a document was signed by four witnesses and it was disputed, if one person verified the signature of two [witnesses] and another that of the other two, is that worth anything? Does not every single signature need two witnesses? And here, every single hair needs two witnesses. Rebbi Ḥanania learns it from the years of squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another [witness] testified that he ate from it the fourth, fifth, and sixth, is that worth anything? Does not every single year need two witnesses? And here, ever single hair needs two witnesses.

“And they mention in front of her things that neither she nor any of her paternal family should hear,” etc. For example, what happened between Reuben and Bilhah, or what happened between Jehudah and Tamar. “If Sages tell,” these are Reuben and Jehudah, “they do not hide before their fathers.” What rewards did they take for this, “to them alone the Land was given; no stranger passes in their midst.” When Moses came to bless them, “Reuben may live and not die,” “and that for Jehudah”.
HALAKHAH: “He brought a bowl,” etc. It was stated: “A new one.” Our Mishnah follows Rebbi Eliezer, as we have stated there: “He brought a new earthenware bowl.” Who stated “a new one”? Rebbi Eliezer! Since he explains: “Into an earthenware vessel on fresh water.” Just as the water had no prior use, so the earthenware vessel should not have had any prior use. It is understandable there because he explains: “Into an earthenware vessel on fresh water;” but what may one say here? Rebbi Joḥanan said, because he agrees with Rebbi Ismael. It was stated: From the wash basin. Rebbi Ismael says, water from a fountain. But the Sages approve of all kinds of water. Therefore, Rebbi Eliezer holds with Rebbi Ismael about the water and Rebbi Ismael with Rebbi Eliezer about the earthenware vessel. It was found stated: Rebbi Ismael says, into a new earthenware vessel. Some Tannaїm state: Into an earthenware vessel but not into a maqqēdah. Some Tannaїm state: Even into a maqqēdah. They wanted to say, he who says, into an earthenware vessel but not into a maqqēdah, is Rebbi Eliezer but those who say, even into a maqqēdah, are the rabbis. It all is the rabbis’. He who says, into an earthenware vessel but not into a maqqēdah, if most of it was removed but a small part was left; he who says, even into a maqqēdah, if a small part was removed but most of it was left.
“Water”, I could think it should look like water. The verse says, “dust”. Or “dust”, I could think it should look like ink. The verse says, “water”. How is that? The looks of water and the looks of dust. The Sages estimated half a log of water from the wash basin. But did we not state: “Rebbi Jehudah says, a quarter [log]”. Rebbi Jehudah follows his particular way, as we have stated: “Just as he shortens the writing so he decreases the amount of water.”
Three things have to be executed in the name [of the woman]. “He shall write for her.” “He shall execute for her.” “Or manumission was not given to her.” Three things have to be seen: The ashes of the cow, the dust of the suspected wife, and the spittle of the sister-in-law. Rebbi Ismael stated: Also the blood of the bird for the sufferer from skin disease. Rebbi Ze‘ira said, the Sages estimated that the blood of a small bird becomes negligible in a quarter [log] and the blood of a large bird does not render a quarter [log of water] negligible. As it was stated: “In the blood”, should that be only blood? The verse says, “fresh water”. If fresh water, should that be all fresh water? The verse says, “in the blood”. How is this? Fresh water in which the bird’s blood is recognizable. The Sages estimated, a quarter [log]. Rebbi Pedat in the name of Rebbi Joḥanan: The water of a suspected wife becomes disqualified by staying overnight. Rebbi Aḥa in the name of Rebbi Abina: Nothing of which the altar has no part becomes disqualified by staying overnight.

“The teaching about jealousies”. This is a teaching of the Temple. A woman does not drink and repeat. Rebbi Jehudah said, Neḥemiah the ditch-digger testified before Rebbi Aqiba that a woman drinks and repeats. Rebbi Aqiba said, I shall explain. From one husband a woman does not drink and repeat, from two husbands a woman drinks and repeats. But the Sages say she drinks and repeats whether from one husband or from two husbands. Korkemit shall prove it, who drank and repeated and did it a third time from one husband before Shemaia and Abtalyon.
There, we have stated: “One does not make the proselyte drink, etc. But the Sages say, one makes her drink.” Where do we hold? If about an Israel who married a proselyte, it already is written: “The sons of Israel” (not proselytes). If about a proselyte who married a Jewish girl, it already is written: “The man has to bring his wife to the Cohen.” But we must hold about a proselyte who married a proselyte. What is the reason of Rebbi Aqiba? “The children of Israel”, not proselytes. What is the reason of the Sages? “You shall say to them”, to add everything written in that paragraph. What is written in that paragraph? “A man slept with her”. His lying with her makes her forbidden, then her husband declares his jealousy and makes her drink.
