MISHNAH: A person should not sell his produce after it reached the period of tithing to anybody not trustworthy in matters of tithe, or in the Sabbatical year to anybody suspect in matters of the Sabbatical. If some were ripened early he takes the early ripe fruit and sells the remainder. A person should not sell his chaff or his oil cakes or his grape husks to somebody not trustworthy in matters of tithe if the latter wants to extract fluids from it. If he extracted, he is obligated for tithes but free from heave since everybody giving heave also thinks of broken grain, what is left on the sides, and what remains in the chaff. If somebody bought a vegetable field in Syria before it reached the time of tithes he is obligated, after it reached the time of tithes he is free and he can harvest continuously. Rebbi Jehudah says, he may even hire workers and harvest. Rabban Simeon ben Gamliel said, where has this been said? When he bought the field. But if he did not buy the field he is free even after it reached the time of tithes. Rebbi said, all according to computation.
The House of Shammai say, if it is certain 11 and for demay 10. Bar Qappara stated, both for demay and for certain 11. Rebbi Yudan ben Rebbi Shalom taught what Bar Qappara had stated. The House of Shammai follows Rebbi Eliezer, since Rebbi Eliezer said, he who is trustworthy for the Second is trustworthy for the First. Rebbi Yose said, everybody agrees, they made it like additions to First Fruits. Just as additions to First Fruits are eaten in purity and are free from demay, so this is eaten as Second Tithe and is free from the First. Rebbi Ḥananiah confirmed in the name of Rebbi Issi: it is Rebbi Eliezer’s.

Rebbi Ḥiyya bar Abba said, since you are strict with him for the easier rules he will be strict with himself with the weighty one. Rebbi Ḥaggai said, Rebbi Samuel bar Rav Isaac commanded his house, did you make an eruv, did you kindle the light? Why did he not say, did you give tithe? Because all he ate, he ate from the market.

MISHNAH: Surveys may only be made by professionals. If one extended the place and restricted it at another, one listens to him who extends. Even a slave or a slave woman are trustworthy to say up to here is the Sabbath domain since the Sages said in these matters not to restrict but to be lenient.
Everybody is trustworthy about elimination of leavened matter, even women, even slaves. Rebbi Jeremiah in the name of Rebbi Ze`ira: There is no “even” women. Women intrinsically are trustworthy; since they are slow they check everything very carefully. Samaritans any time when they prepare their mazzah with Jews are trustworthy about checking for leavened matter; if they do not prepare their mazzah with Jews they are not trustworthy about checking for leavened matter. Rebbi Yose said, this means in the houses, but they are suspect in courtyards since they explain that it should not be found in your houses, does not apply to your courtyards.

Rebbi Yose said, I found a child of the family Eutinos. I said to him, my son, from which family are you? he told me, from family X. I said to him, my son, because your forefathers intended to increase their prestige and to decrease Heaven’s prestige, therefore their prestige was diminished and Heaven’s prestige increased. Rebbi Aqiba said, Simeon ben Lagos told me, I was collecting herbs, I and a youth from the family Eutinos, when I saw him crying and laughing. I said to him, my son, why did you cry? He said to me, about the prestige of my family which is diminished. And why did you laugh? About the glory prepared for the Just in the future world; there is smoke-creating herb before me! I said to him, my son, show it to me. He answered me, I have a tradition from my ancestors not to show it to any creature.’ Rebbi Joḥanan ben Nuri said, I met an old man from the family Eutinos. He said to me, ‘Rabbi. In the past my family were humble, and transmitting this scroll one to the other. But now they are not trustworthy; here the scroll is yours and take care of it.’ When I came and repeated these words before Rebbi Aqiba, his tears flowed and he said, from now on we do not have to mention them for shame.”

You are finding that when Nebuchadnezzar campaigned here, he came and sat in Daphne of Antiochia. The Great Synhedrion went to him and said to him, did the time come that this House be destroyed? He said to them, give me the one which I made king over you and I will depart. They came and said to Jehoiachin, the king of Judea, Nebuchadnezzar wants you. When he heard this from them, he took the keys of the Temple and climbed to the roof of the Temple. He said before Him: Master of the world! In the past we were trustworthy for You and Your keys were handed to us. Now that we are not trustworthy for You, Your keys are handed to You. Two Amoraim, One said, he threw them upwards and they never returned. The other said, He saw that something like a hand came and took them from him. When all the freeholders of Jehudah heard this, they climbed to the tops of their roofs, fell down, and died. That is what is written, Saying about the valley of vision: Why are you doing this, that you climbed on all roofs, the noisy, full, humming city.

Of all double letters in the alphabet one writes the first form at the start of a word and in the middle of a word, but the last form at the end, and if one changed this he disqualified it. In the name of Rebbi Matthew ben Ḥarash they said, מנצפ״ך is a practice of Moses from Sinai. What is מנצפ״ך? Rebbi Jeremiah in the name of Rebbi Samuel bar Rav Isaac: what the seers instituted for you. Who are those seers? It happened on a day of rainstorm that the Sages did not come to the assembly hall, but the children entered. They said, come and let us form an assembly that it should not be cancelled. They said, what is that that it is written mem mem, nun nun, ṣade ṣade, peh feh, kaf khaf. From utterance to utterance, from trustworthy to trustworthy, from just to just, from mouth to mouth, from the hand of the Holy One, praise to Him, to the hand of Moses. The Sages identified them and they all grew to become important personalities. They said, Rebbi Eliezer and Rebbi Joshua were from these. Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba and Rebbi Simon both were saying, in earlier copies of the Torah neither he nor final mem were closed. Therefore samekh was closed.

MISHNAH: One is more restrictive for heave in that in Judea one is trustworthy about purity of wine and oil the entire year but about heave {only} at the time of grape and olive harvest. If the time of grape and olive harvest is passed and he brought him a barrel of heave wine he should not accept it but let it stay until the next grape harvest. Only if he said, I put into it a quartarius of sanctum he is trustworthy. One is trustworthy about wine and oil barrels used for heave at the time of grape and olive harvest and sixty days preceding the grape harvest.

But did we not state, “the second best is Regev in Transjordan”? Without this would not a strip of Samaritans interrupt? Rebbi Shammai said, explain it if he brings whole olives and pounds them there. And in Judea one is trustworthy about the wine but not about the flasks. MISHNAH: From Modiin and closer one is trustworthy about clay vessels, but from Modiin and outside one is not trustworthy. How is this? The potter who sells pots, if he is inside from Modiin then the potter, the pots, and the buyers, are trustworthy. If he left he is not trustworthy.

If food prepared in purity touched it, from Modiin and closer the fluid made the vessel impure. If it was filled with water, Rebbi Simeon ben Laqish said, he is trustworthy about the vessel but not trustworthy about the fluid. Rebbi Joḥanan said, he is trustworthy about both. HALAKHAH: “If somebody brings a bill of divorce from overseas and says”, etc. About what is he trustworthy? Samuel says, he is trusted to give a bill of divorce. Assi said, he is trusted to marry. Rav Huna said in the name of Rav: He is trusted to marry. Rebbi Joḥanan said, he is trusted to marry but one does not infer from this ruling anything for another case. What means, one does not infer from this ruling anything for another case? I sold one of my fields but I do not remember to whom I sold it. If someone comes and says, I bought it, he is not trusted in any way. In qiddushin, the same holds. “ I betrothed one of my daughters but I do not remember to whom I betrothed her. If someone comes and says, I gave her qiddushin,” he is not trusted in any way. The Mishnah disagrees with Rav: “If somebody brings a bill of divorce from overseas and says, it was written and signed in my presence, he shall not marry the wife.” There, she is considered by everybody to be a married woman. Here, she is considered to be a married woman only by two persons. One waits until these two come and say, this is the man who gave her qiddushin. The Mishnah disagrees with Rebbi Joḥanan: “ This one says, I gave her qiddushin, and that one says, I gave her qiddushin. Both of them give a bill of divorce, but if they agree, one gives a bill of divorce and the other one marries.” He explains this, if [the father] says, I did betroth her to one of these two but I do not remember which one it was. Rebbi Ze‘ira, Rebbi Yasa, in the name of Rebbi Joḥanan: If one of them jumped the gun and married her, one does remove her from him. That is, if this one says, I gave her qiddushin, and that one says. I gave her qiddushin and one of them jumped the gun and married her. But if he said, I gave her qiddushin and married her, and another one comes and says, I gave her qiddushin, he is not trusted in any way. It was stated thus: If after the marriage another man comes and says, I gave her qiddushin, he is not trusted in any way.
HALAKHAH: “A woman went with her husband,” etc. Just as you say, “if there are witnesses that she is a married woman and she says, I was divorced, she is not trustworthy;” would I say it is the same here? There is a difference for witnesses of death since if he comes he disproves [the testimony]. Then she should be trustworthy to say: “my levir died”! That is impossible since we have stated: “A woman is not trustworthy if she says ‘my levir died’ to remarry, or ‘my sister died’ to enter her house.” Rebbi Abba said, she is trustworthy for her husband whom she married out of her free will; she is not trustworthy about her levir on whom she was thrown against her will. Rebbi Hoshaia asked, think of it, then she should not be trustworthy if she was forced to marry him!

Is a single witness trustworthy in wartime? Let us hear from the following: A person was living in the times of Rebbi. They asked him about X; he said, he died. They asked him about Y; he said, he died. They asked him, are they all dead? He answered, if they were alive would they not have come? Rebbi Jeremiah in the name of Rebbi Ḥanina: The case came before Rebbi and he said, the ones married should stay married, the ones not married should not marry. Rebbi Ayvo bar Naggari said, it happened in wartime. That implies that a single witness is trustworthy in wartime.

HALAKHAH: “Everybody is accepted to be a witness for her,” etc. It was stated: “Just as they cannot be trusted for her, so she cannot be trusted about them.” Her mother-in-law’s son is like her mother-in-law’s daughter. Her husband’s son is like her husband’s daughter. Her co-wife, even if remarried. Her levir’s wife, even [if she is] her own sister. Rebbi Yose said, a Mishnah says that they did not treat the males as they treat the females, as we have stated there: “because a woman is not trusted if she says, my levir died, that she should be free to remarry, nor that her sister died, to enter her house.” Because she has no children. But if she has children, she is trustworthy.
HALAKHAH: She is suspected to cause trouble to herself in order to cause trouble to her co-wife. Then she should not be trustworthy even for herself! Since she knows that her word does not count for the other woman, she will be truthful. Then she should be trustworthy even for her co-wife! She is suspected to cause trouble to herself in order to cause trouble to her co-wife.

Our forefather Abraham turned the evil instincts into good ones. What is the reason? (Neh. 9:8): “You found his heart trustworthy before You.” Rebbi Aḥa said, he compromised, from “concluding a covenant with him.” But David could not stand it and killed it in his heart. What is the reason? (Ps. 109:22) “But my heart is slain in me.”
MISHNAH: If a single witness said “I saw her when she became impure”, she could not drink. Not only that, but even a slave or a slave-girl are believed to cause her to lose her ketubah. Her mother-in-law, the mother-in-law’s daughter, her co-wife, her sister-in-law, and her husband’s daughter are trustworthy. They said this not to make her lose her ketubah but that she could not drink.
Rebbi Jeremiah was of the opinion to follow the standard of Judea in Galilee. Rebbi Yose said to him, is the standard of Judea in Galilee a testimony by biblical standards? No, [one follows] the standard of Judea in Judea and the standard of Galilee in Galilee. If you say, it is not testimony by biblical standards, why appoint them? That the daughters of Israel should not become wanton in immorality. If it is that the daughters of Israel should not become wanton in immorality, even if one appoints, they should not be trustworthy! Rebbi Yose in the name of Rebbi Hila: A man would not go to all this expense in order to give his wife a bad reputation. If it is that a man would not go to all this expense in order to give his wife a bad reputation, even if one does not appoint, he should be believed. Rebbi Hila said, because of one suspicion, because of one immoral person. Where do we hold? If he investigated and found, he found! If he did not find but investigated, did he not investigate? But we deal with the case that he did not investigate and found. She says, it is blood of virginity. He says no, it is a bird’s blood. His case is damaged since he did not follow the procedures. That means, not to let her lose her ketubah. But he is not permitted to keep her because she might have been unfaithful. It follows what we statedthere: “A virgin and a widow, etc.” All these cases are based on what Rebbi Hila said in the name of Rebbi Eleazar, if he found the door open, he is forbidden to keep her because she might have been unfaithful.
MISHNAH: Rebbi Joshua agrees that if somebody says to another: “This field did belong to your father but I bought it from him,” that he is trustworthy since the mouth which forbade is the mouth which permits. But if there are witnesses that it did belong to [the second man’s] father and [the first] said, I bought it, he is not trustworthy.

“He is not trustworthy” if he did not eat the years of legal claim from it. But if he ate the years of legal claim from it, he is trustworthy if [the second person’s] father did not die in possession. But if [the second person’s] father died in possession, he is [not] trustworthy. As the following: Reuben ate from a field claiming that it was his. Simeon brought witnesses that his father died in possession. One removes [the field] from Reuben and hands the title to Simeon. Reuben came back and brought witnesses that [Simeon’s] father did not die in possession. Rebbi Naḥman ben Jacob said, I took it from Reuben, I am returning it to Reuben. That is what the rabbis here think. The rabbis there say, from the time it was removed, by clear testimony it was removed. So the rabbis here say, from the time she married, by clear testimony she married. Rebbi Yose said, the rabbis there agree that if during the first proceedings two [witnesses] say that his father died in possession and two say, he did not die in possession, Reuben’s claim is upheld.

MISHNAH: If witnesses said, this is our signature, but we were under duress, or underage, or disqualified, these are trustworthy. But if there are witnesses to identify their signatures, or their signatures are confirmed from another document, they are not trustworthy.
MISHNAH: If witnesses said, this is our signature, but we were under duress, or underage, or disqualified, these are trustworthy. But if there are witnesses to identify their signatures, or their signatures are confirmed from another document, they are not trustworthy.
HALAKHAH: “If witnesses said, this is our signature,” etc. It was stated: And similarly, the witnesses who testified whether to declare impure or pure, or to remove or include, or to forbid or permit, or to obligate or absolve, if they say we did invent this before their testimony was investigated by the court, they can be believed; after their testimony was investigated by the court, they are not trustworthy.” Rebbi Simeon ben Laqish said, they considered witnesses who signed a document as if their testimony had been investigated by the court. If they say, these are our signatures, and others say, these are their signatures, Rebbi Ḥiyya stated: Their [testimony] does not add and does not detract. Rebbi Yose said, our Mishnah says so, “if there are witnesses to identify their signatures, or if their signatures are confirmed from another document, they are not trustworthy.”

If each of them says, that ismy signature, each of them needs another with him, the words of Rebbi, but the Sages say, everybody is trustworthy to confirm his own signature.

HALAKHAH: “If one says, this is my signature,” etc. Why was this necessary? For Rebbi. Even though Rebbi says, each of them needs another with him, here he agrees that they are trustworthy.
MISHNAH: If a woman said, I was married but I am divorced, she is to be trusted, since the mouth which forbade is the mouth which permits. But if there are witnesses that she is married and she says, I am divorced, she is not trustworthy.
MISHNAH: 6: If a woman said, I was kidnapped but I am pure, she is to be trusted, since the mouth which forbade is the mouth which permits. But if there are witnesses that she was kidnapped and she says, I am pure, she is not trustworthy. If the witnesses came after she was married, she should not leave.
MISHNAH: Two women who were kidnapped and each one of them says I am pure, are not trustworthy. But if they testify one for the other they can be trusted. Similarly, if of two men each one says that he is a Cohen, the cannot be trusted. But if they testify for one another, they can be trusted.
Rebbi Ismael ben Rebbi Yose said, I never testified except once, when I raised a slave to priestly status. Rebbi Isaac Ḥaqula and Rebbi Simeon ben Rebbi, one raised a brother on the testimony of his brother, the other a son on the testimony of his father; one to the priesthood, the other to levitic status. A person came before Rebbi Hila; he said to him, this is my son and he is a Cohen. He answered him, he is your son but he is no Cohen. Rebbi Ḥiyya the elder said to him, if you believe him that he is his son, believe him that he is a Cohen. If you do not believe him that he is his son, do not believe him that he is a Cohen. He answered, he is his son but I say that he is the son of a divorcee or one who had performed ḥalîṣah. Rebbi Abin said, so he said to him: If you believe him that he is his son, believe him that he is a Cohen. If you do not believe him that he is a Cohen, do not believe him that he is his son. In that case, he would be unrelated and trustworthy in his testimony! He answered, he is his son but I say that he is the son of a divorcee or one who had performed ḥalîṣah. Did they not say, Rebbi Isaac Ḥaqula and Rebbi Simeon ben Rebbi, one raised a brother on the testimony of his brother, the other a son on the testimony of his father? Let us say that Rebbi elevated a brother on the testimony of his brother. You may even say, a son on the testimony of his father, to levitic status.
MISHNAH: A woman who was jailed by Gentiles, if because of money matters, she is permitted to her husband; if because of criminal matters, she is prohibited to her husband. If a city was conquered after a siege, all wives of priests in it are disqualified; but if they have witnesses, even a slave, even a slave girl, those are trustworthy; but nobody is trustworthy about himself. Rebbi Zachariah, the son of the butcher, said, by the Temple! Her hand did not leave my hand from the moment the Gentiles entered Jerusalem until they left! They said to him, nobody testifies on his own behalf.

MISHNAH: In the following cases, one is trustworthy to testify as an adult about what one saw in one’s minority. A man is trustworthy to say, this is my father’s handwriting, my teacher’s handwriting, my brother’s handwriting; I remember that this person went out in hinuma and uncovered hair, or that this man left school to immerse himself to eat heave, or that he took his part with us on the threshing floor, or that this place is bet happeras, or this far we went on the Sabbath. But a person is not trustworthy to say that X had a right of way at this place, or that X had a space for eulogies at this place.

Would they be trustworthy to say, we went out to collect unripe figs in the sabbatical year and heard X talking about his wife Y, or woman Z talking about her children?
“In the following cases, one is trustworthy to testify as an adult about what he saw in his minority,” etc. They are only trustworthy as adults about what they saw as minors; therefore, not as minors! There, we have stated: “A woman or a minor are trustworthy when they said, from there a swarm of bees left. He then can enter another’s field and take his swarm.” And here, you say so? Rebbi Aḥa, Rebbi Ḥananiah in the name of Rebbi Joḥanan: Rebbi Joḥanan ben Beroqa said this only about a swarm of bees because taking it is not robbery by biblical standards. Rav Oshaiah stated, only if it is swarming. But not if it clings to a branch. Rebbi Ze‘ira asked before Rebbi Mana: Is that not reasonable only when it happens, but not after some time? He said to him, I agree. And we have stated: When is this said? When they testified to what they said. But if they left and came back, I am saying that they speak out of fear or were seduced.

What is a wife and what is a concubine? Rebbi Meïr says, a wife has a ketubah, a concubine has no ketubah. Rebbi Jehudah says, both have a ketubah. A wife has a ketubah and the ketubah stipulations; a concubine has a ketubah but no ketubah stipulations. Rav Jehudah in the name of Rav: These are the opinions of Rebbi Meïr and Rebbi Jehudah. But the words of the Sages: “A man may marry a woman and stipulate with her not to feed her and not to provide for her. Not only that, but that she should feed and provide for him and teach him Torah. It happened that Rebbi Joshua, son of Rebbi Aqiba, married a woman and stipulated with her not to feed her and not to provide for her. Not only that, but that she should feed and provide for him and teach him Torah. But when years of famine came and they distributed the properties among themselves, she started complaining about him to the Sages of Israel. He said to them, for me she is trustworthy more than anybody. She told them, it is true that thus I stipulated with him. [They said to her], nothing comes after acquisition.”
HALAKHAH: “From encumbered property, how is that?” Rebbi Ḥiyya in the name of Rebbi Joḥanan: If somebody disputes a court document, he is not trustworthy. Rebbi Ḥiyya bar Abba said to him: Is that not the Mishnah? “If she produced her bill of divorce without a ketubah, she collects her ketubah”! Rebbi Joḥanan said to him: Babylonian, after I removed the clay from the pearl, you say to me: Is that not the Mishnah? Rav said, at a place where one does not write a ketubah. But at a place where one writes a ketubah, what she produces she collects. He changed his mind and said, she collects even at a place where one writes a ketubah; let anyone powerful object to this! Rebbi Yose objected: Was it not stated: She might collect on her divorce document, hide her ketubah, and collect a second time? If those died. Are there not witnesses? Bring them! They went overseas. Is there not an agreement? Is there no registrar of agreements? There is a registrar of agreements; as you say, if a document is lost, one writes a replacement. This is what one says, if the ketubah was lost, one writes a new one. Rebbi Abba objected: Was it not stated, she might collect on her divorce document, hide her ketubah, wait until he dies, and collect a second time? Rebbi Yose bar Abun said to him: Would she not have to prove that she lived with him until he died?
MISHNAH: Even women who cannot be believed if they say that [a woman’s] husband died are trustworthy to bring her bill of divorce: Her mother-in-law, her mother-in-law’s daughter, her co-wife, her sister-in-law, and her husband’s daughter. What is the difference between divorce and death? The writing is the proof. A woman may herself bring her own bill of divorce, but she still is required to say that it was written and signed before her.
A guardian appointed by the orphans’ father shall be made to swear, for usually he is not checked out. If he was appointed by the court he shall not be made to swear for usually he was checked out. Abba Shaul says, it is the other way around; a guardian appointed by the orphans’ father shall be made to swear, for he is like one who is paid; if he was appointed by the court he shall not be made to swear for for he can say to him, I am doing this as a favor to you. It turns out that Rebbi Joḥanan follows the rabbis and Rebbi Yose ben Ḥanina Abba Shaul. Does Rebbi Joḥanan follow the rabbis? Even if he holds with Abba Shaul, a person acts as a trustee in order to be declared trustworthy. Does Rebbi Yose ben Ḥanina [follow] Abba Shaul? Even if he holds with the rabbis, a person is apt to slip away from an oath but not from payments.
HALAKHAH: : “If a woman says, accept my bill of divorce,” etc. What is the reason of Rebbi Eleazar? I say that he found it behind the door. There, we have stated: “If someone tells a person who is not trustworthy, buy for me from somebody who is trustworthy, or from somebody who tithes, he is not trustworthy. It was stated: “Rebbi Yose said, even if he specified, from X, he is not trustworthy unless he said, you buy and I will pay.” What is the reason of Rebbi Yose? “Whether he died from the original sickness.” Are male or female slaves trustworthy? The witnesses know that at the time she was alone with him a male or female slave was present. “If she was alone with him with the knowledge of two witnesses, she needs a second bill of divorce from him. One witness, she does not need a second bill of divorce from him. One in the morning and one in the afternoon, that was a case and Rebbi Eleazar bar Thaddeus asked the Sages who said, this is not [testimony of] being alone. If she was alone together with him long enough for intercourse, one suspects her about intercourse but not about preliminary marriage. Rebbi Yose ben Rebbi Jehudah says, one also suspects her about preliminary marriage.” Rebbi Jeremiah explains the baraita: If she was alone together with him long enough for intercourse, one suspects her about immoral intercourse but not about preliminary marriage. If the time was not long enough for intercourse, one does not suspect anything. Rebbi Yose explains the baraita: If she was alone together with him long enough for intercourse, one suspects her about immoral intercourse but not about preliminary marriage by intercourse. The House of Shammai say, an agent may not testify as witness. But the House of Hillel say, an agent may testify as witness. How is that? If he sent two, in the opinion of the House of Shammai there is an agent and two witnesses. In the opinion of the House of Hillel, all three can be agents and all three can be witnesses. Rebbi Abun bar Ḥiyya said, the matter is reasonable if the preliminary marriage was executed by document. But if he executed the preliminary marriage by money, he became an interested party in his testimony. Rebbi Yose said, since the Torah made him trustworthy, even if he executed the preliminary marriage by money, he did not become an interested party in his testimony. Rebbi Abba said, there came a case before Rav who admitted the agent as witness. A person deposited his amphoras in another’s corral; [the latter] reneged. The case came before Rebbi Jeremiah who admitted the agent as witness and made him swear [by the testimony of] the porter.
HALAKHAH: “If one says, I preliminarily married off my daughter”, etc. About what is he trustworthy? Samuel says, he is trusted to give a bill of divorce. Assi said, he is trusted to marry. Rav Huna said in the name of Rav: He is trusted to marry. Rebbi Joḥanan said, he is trusted to marry but one does not infer anything for another case from this ruling. What means, one does not infer anything for another case from this ruling? I sold one of my fields but I do not remember to whom I sold it. If someone comes and says, I bought it, he is not trusted in any way. In preliminary marriage, the same holds true. “I betrothed one of my daughters but I do not remember to whom I betrothed her. If someone comes and says, I married her preliminarily,” he is not trusted in any way. The Mishnah disagrees with Rav: “If somebody brings a bill of divorce from overseas and says, it was written and signed in my presence, he shall not marry that woman.” There, she is considered by everybody to be a married woman. Here, she is considered to be a married woman only by two persons. One waits until these two come and say, this is the man who gave her qiddushin. The Mishnah disagrees with Samuel: “This one says, I married her preliminarily, and that one says, I married her preliminarily. Both of them give a bill of divorce, but if they agree, one gives a bill of divorce and the other one marries.” He explains this, if [the father] says, I did betrothe her to one of these two but I do not remember which one it was. Rebbi Ze‘ira, Rebbi Yasa, in the name of Rebbi Joḥanan: If one of them jumped the gun and married her, one does remove her from him. That is, if this one says, I married her preliminarily, and that one says, I married her preliminarily, and one of them jumped the gun and married her definitively. But if he said, I married her preliminarily and then married her definitively, and another one comes and says, I married her preliminarily, he is not trusted in any way. It was stated thus: If after the marriage another man comes and says, I married her preliminarily, he is not trusted in any way.
Rebbi Abba in the name of Rav Ḥisda: Three are trustworthy immediately: a midwife, a caravan, and the one who purifies her colleagues. A midwife: “The midwife took and wound a red string [around his hand] to indicate that this one was born first.” A caravan, as Rebbi Abba, the brother of Rebbi Jehudah bar Zavdi said in the name of Rav: As long as a baby lies in the public domain, either its father or its mother can testify about him. Once it was collected from the public domain, one needs two witnesses; its father and mother are like two witnesses. The one who purifies her colleagues, as we have stated there: “Three women sleep on one bed. If blood was found under one of them, all three are impure. If one of them checked herself out and found herself impure, she is impure and the other two are pure.” Rebbi Abba said, only within 24 hours.
If a bull of orphans and guardians went out and did damage, what is the rule? Rebbi Joḥanan said, [the damage is paid] from the orphan’s property. For if you say from the guardians’, nobody ever will agree to become a guardian. Rebbi Yose ben Ḥanina said, from the guardians’. Rebbi Yose ben Ḥanina follows Abba Shaul and Rebbi Joḥanan the rabbis, as it was stated there: “A guardian appointed by the orphans’ father shall be made to swear; if he was appointed by the court he shall not be made to swear,” for the court will check him out. “Abba Shaul says, it is the other way around,” a guardian appointed by the orphans’ father shall not be made to swear; it would be as if he would take a pledge from him. If he was appointed by the court he shall be made to swear, since a person will do much to be called trustworthy.
