Do the House of Shammai hold that “hands” are for profane food? Explain it either following Rebbi Simeon ben Eleazar or following Rebbi Eleazar, son of Rebbi Ẓadoq. Following Rebbi Simeon ben Eleazar as it has been stated: “Rebbi Simeon ben Eleazar said in the name of Rebbi Meïr, hands are primarily impure for profane food and secondarily for terumah.” Or following Rebbi Eleazar, son of Rebbi Ẓadoq, as we have stated there: “Profane food that was prepared under the rules of purity of sacrifices is still profane food. Rebbi Eleazar, the son of Rebbi Ẓadoq said, it is like terumah becoming impure in two stages and unusable in a third.”
MISHNAH: If gourds kept for seeds became hard before the New Year and unusable as food, one may keep them in the Sabbatical year; otherwise, it is forbidden to keep them in the Sabbatical year. Their buds are forbidden in the Sabbatical year. One may sprinkle with water on white dust, the words of Rebbi Simeon; Rebbi Eliezer ben Jacob forbids it. One may tear off rice in the Sabbatical year; the words of Rebbi Simeon are that one may not trim.
MISHNAH: One may not cook Sabbatical vegetables in heave oil because it should not be made unusable. Rebbi Simeon permits it. Always the last substitute is caught and the fruit remains forbidden.
HALAKHAH: There, we have stated: “The Cohanim are permitted in all cases to change the preparation of the food, to eat it broiled, cooked a long time, or plain; to add profane and heave spices, the words of Rebbi Simeon. Rebbi Meïr says, he should not add [heave spices], to cause heave to become unusable.” It turns out that the anonymous statement here becomes the minority opinion there. Is the anonymous statement here the minority opinion there? But the anonymous statement here is the opinion of Rebbi Meïr there and between Rebbi Meïr and Rebbi Simeon, practice follows Rebbi Simeon. Rebbi Assi said, I asked those of the House of Rebbi Yannai and they said, we used to cook small portions and eat. How is that? Practice follows Rebbi Meïr there for his is the anonymous opinion here.
If he said, what is below is heave, above all is profane, or what is below is all profane, above is heave, it depends on his opinion. Also for a miqweh it is the same: If he said, all water below is usable, above is unusable, or all water below is unusable, above is usable, it depends on his opinion.

It was stated: One does not use the complement of heave for payment of principal and fifth and for them one does not pay principal and fifth, it is not subject to ḥallah, and hands and the ṭevul yom do not make it unusable in the way they do not make profane unusable. Even Rebbi Simeon and Rebbi Yose agree with this.

Rebbi Joḥanan said, Rebbi Joshua and Rebbi Simeon both said the same thing. Rebbi Ilaї said: Rebbi Simeon in Bekhorot and Rebbi Joshua in Terumot, neither of them will agree with the other. Rebbi Abun bar Ḥiyya asked before Rebbi Zeїra: Is it not reasonable that Rebbi Simeon agrees with Rebbi Joshua but Rebbi Joshua will not agree with Rebbi Simeon? Did we not state: “Rebbi Eliezer and Rebbi Joshua agree that each batch should be burned separately.” Could one not burn the two together? He said to him, there [the heave] is pure; by Torah law the heave is still in existence; you are the person who decided to burn it. In any case, would it not become unusable by being left unattended? Did not Rebbi Joḥanan say, leaving unattended is from the Torah? The second amphora for Rebbi Meїr follows the Torah, coughing blood for Rebbi Simeon follows the Torah! He said to him, one still watches it so it should not come in contact with other pure [heave]. Rebbi Isaac, the son of Rebbi Ḥiyya the scribe: Think about it, if it was put on coals? He said to him, after if was put there. Rebbi Mana said to Rebbi Shammai: You who say that Rebbi Simeon agrees with Rebbi Joshua! Even Rebbi Joshua does not agree with Rebbi Joshua! He said to him, these are Tannaïm. There, Rebbi Meїr in the name of Rebbi Joshua, but here Rebbi Simeon in the name of Rebbi Joshua.
Rebbi Yose said, we teach all these words but a Mishnah supports Rebbi Zeïra: “He should not bring from wheat of Second Tithe but from money of Second Tithe.” What is the difference between wheat and money? It must be that when it was bought, the holiness of tithe left it. Rebbi Ḥinena asked before Rebbi Mana: Why should he not bring wheat, the heave to the Cohen and the rest for the owners, why does he not bring? He said to him, think of it, if the blood is spilled does the bread not become unusable?
HALAKHAH: It was stated: “That it should not become unusable.” What is “become unusable”? Rebbi Jonah said, it becomes unusable through a ṭevul-yom. You cannot eat it, for he is impure by the word of the Torah; you cannot for he is pure by the word of the Torah. That means, that it should not become unusable.

It was stated: One does not mark flesh, for perhaps it will decompose. Rebbi Justus bar Shunem asked before Rebbi Mana: Will that not cause pure food to be retroactively made impure? He said to him, it is better that these should become unusable for a limited time than that [the earth] become unusable forever.

: Rebbi Yose ben Rebbi Ḥanina said, this is the opinion of Rebbi Eleazar ben Jehudah from Birtota, as we have stated there: “Rebbi Eleazar ben Jehudah from Birtota says in the name of Rebbi Joshua, he made everything unusable. But Rebbi Aqiba says in the latter’s name, he made unusable only the place where he touched.” Rebbi Simeon ben Laqish said, when do they disagree? When it was prepared for impurity and after that was kneaded, when fruit juices clearly do prepare. But if it was kneaded and after that only prepared, fruit juices are not clear to prepare. Rebbi Ḥiyya in the name of Rebbi Joḥanan: It is everybody’s opinion. Even though Rebbi Aqiba says there that fruit juices have no clear connection with impurity, he agrees here that fruit juices are clearly for ḥallah.

“This applies to heave and First Fruits but not to tithe.” There, we have stated: “One washes his hands for profane, tithe, and heave; but for sacrifices one immerses.” There, you say that tithe does not need washing and here you say, tithe needs washing! Those who say, tithe needs washing, the rabbis; he who says, tithe does not need washing, Rebbi Meїr. There, we have stated: “Anything needing immersion in water by rabbinic decree makes sacrifices impure and heave unusable but is permitted for profane food and tithe. But the Sages forbid for tithe.” Is that not explained by what Rebbi Samuel says in the name of Rebbi Zeïra, what means the Sages forbid for tithe? His body is disqualified from eating tithe. What is that? May you say tithe needs washing, if he wants to eat; may you say tithe does not need washing, if he wants to touch? No, wanting to touch is the same as wanting to eat. So it must be washing as discipline. But we have stated: “heave”! Is there washing as discipline for heave? But it is about profane food prepared by the rules of sacrifices. Is profane food prepared by the rules of sacrifices not profane? Explain it either following Rebbi Simeon ben Eleazar or following Rebbi Eleazar ben Rebbi Ẓadog. Either following Rebbi Simeon ben Eleazar as it was stated: Rebbi Simeon ben Eleazar says in the name of Rebbi Meїr: Hands are [impure] in the first degree for profane food, in the second for heave. Or following Rebbi Eleazar ben Rebbi Ẓadog as it was stated there: “Profane food prepared by the rules of sacrifices is profane. Rebbi Eleazar ben Rebbi Ẓadog says it is like heave, it may be impure in two degrees and invalidates a third.”
It was stated, eighteen things they decided, in eighteen they were a majority and in eighteen they were divided. The following they decided: About Gentiles’ bread, and about their cheeses, and about their oil, and about their daughters, and about their semen, and about their urine, and about the rules of a person with an emission, and about the rules of the land of Gentiles. There we have stated: “The following make heave unusable. One who eats food impure in the first degree, and one who eats food impure in the second degree, and one who drinks impure drinks, and one who comes with his head and most of his body in drawn water, and a pure person on whose head and most of his body fell three log drawn water, and a scroll, and hands, and the Ṭevul yom, and food and vessels which became impure by fluids.”
HALAKHAH: If he took it when it still was daylight he may return it when it still is daylight. If he took it after dark he may return it after dark. If he took it when it still was daylight and the day became holy for him? Rebbi Abba in the name of Rav Jehudah: If the groove was unusable it is forbidden, but from stove to stove it is permitted, from what Rebbi Eliezer said in the name of Rebbi Joshua: I was serving the Great Rebbi Ḥiyya and I brought him hot water from the lower to the upper apartment and returned it to the stove. Rebbi Jeremiah ben Rebbi Simeon said, even from a stove with little heat to a stove with much heat.
MISHNAH: Rebbi Joshua said, I have heard that the substitute of a Pesaḥ is sacrificed and that the substitute of a Pesaḥ is not sacrificed, and I cannot explain it. Rebbi Aqiba said, I shall explain it. The Pesaḥ which is found before the time of slaughtering the Pesaḥ shall graze until it becomes unusable, then be sold, and for the money one shall bring well-being offerings; the same holds for its substitute. After the time of slaughtering the Pesaḥ, it shall be brought as well-being offering; the same holds for its substitute.
If he dedicated his Pesaḥ, but it became lost, and he dedicated another in its stead. Before he could sacrifice the second, the first was found, and now both are at his disposal. There are Tannaim who state, it is meritorious to sacrifice the first; there are Tannaim who state, it is meritorious to sacrifice the second. Samuel stated as follows: He selects the better of the two, and the other one shall graze until it becomes unusable, then be sold, and he shall bring for its value well-being offerings on the Sixteenth. Rebbi Eleazar says, itself shall be brought as well-being offering on the Sixteenth. Rebbi comes with Rebbi Eleazar, and Samuel stated according to his system, as it was stated: “Rebbi says, no purification offering {dies} but one which was found after that the owner had been atoned, no money is thrown into the Dead Sea except which was found after the owner had been atoned.”
MISHNAH: If he dedicates a female as his Pesaḥ or a two year old male, it shall graze until it becomes unusable, then be sold, and the monies given for voluntary sacrifices. If he dedicates his Pesaḥ and dies, his son may not bring it after him as Pesaḥ but as well-being offering.
HALAKHAH: The Mishnah after propitiation, following {neither Rebbi nor Rebbi Simeon, as it was stated: “Before Passover it shall graze until it becomes unusable, then be sold, and he shall bring for its value a Pesaḥ. After Passover it shall be brought as well-being sacrifice. Rebbi Simeon says, before Passover it shall be sold without a defect, after Passover it shall be brought as well-being sacrifice.” Did we not understand that “the body of any {animal} due to be sacrificed as Pesaḥ is not offered as a well-being sacrifice”? Explain it if he dedicated coins.
MISHNAH: If a Pesaḥ was mingled with sacrifices, all of them shall graze until they become unusable, then be sold, and for the value of the best among them he shall bring one of each kind and lose the difference on his account. If it was mingled with firstlings, Rebbi Simeon says, if it is a company of priests, they shall eat.
It was stated: One does not mark flesh, for perhaps it will decompose. Rebbi Justus bar Shunem asked before Rebbi Mana: Will that not cause pure food to be retroactively made impure? He said to him, it is better that these should become unusable for a limited time than that {the earth} become unusable forever.

From where about marks? Rebbi Berekhiah, Rebbi Jacob the son of the daughter of Jacob, in the name of Rebbi Onias from Hauran. Rebbi Yose said it, Rebbi Jacob bar Aḥa in the name of Rebbi Onias from Hauran. Rebbi Ḥizqiah, Rebbi Uziel the son of Rebbi Onias from Hauran in the name of Rebbi Onias from Hauran: impure, impure, he shall call out; the impurity itself has to call out and say to you: go away! Rebbi Hila in the name of Rebbi Samuel bar Naḥman: The emissaries shall crisscross the land; if one sees a bone of a human he builds a sign near it A bone, from here that one makes signs for bones. A human, from here that one makes signs for spine and skull. He builds, from here that one makes signs on fixed stones. If you say on loose ones, it would move and make other places impure. Near it, on a place of purity. A sign, from here the marks. If one found a single marked stone, even though one should not keep it so, if somebody forms a tent over it he is impure; I say a marked corpse was under it. If there were two, he who forms a tent over any one of them is pure; between them he is impure. If between them was a ploughed strip they are single stones, between them the area is pure and around them impure. It was stated: “One does not mark flesh, for perhaps it will decompose.” Rebbi Justus bar Shunem asked before Rebbi Mana: Will that not cause pure food to be retroactively made impure? He said to him, it is better that these should become unusable for a limited time than that {the place} become unusable forever.

If somebody slaughtered with the intention of sprinkling [the victim’s] blood in idolatry or to burn its fat for idolatry, Rebbi Joḥanan said, the intention invalidates, Rebbi Simeon ben Laqish said, the intention does not invalidate. Rebbi Jacob bar Idi objected before Rebbi Simeon ben Laqish: Did we not state: “Rebbi Yose said, that is a matter of a conclusion de minore ad majus. Since in a case where thought makes sanctified food unusable, etc.,” and thought invalidates for piggul and leftover. He said to him, truly thought invalidates for piggul and leftover; but if somebody slaughtered with the intention of sprinkling [the victim’s] blood in idolatry or to burn its fat for idolatry, the intention does not invalidate. If he slaughtered and then the blood was sprinkled in an idolatrous rite and the fat was burned in an idolatrous rite, there was such a case in Caesarea and they pronounced neither prohibition nor permission. Rebbi Ḥanina in the name of Rav Ḥisda: This means that they were not apprehensive. If you say that they were apprehensive, they should have taught a prohibition. Rebbi Yose in the name of Rav Ḥisda: This means that they were apprehensive. If you say that they were not apprehensive, they should not have dealt with the case.
MISHNAH: If two men sent two identical bills of divorce which became mixed up, one delivers both to both women. Therefore, if one of them was lost, the second became unusable.
MISHNAH: If somebody deposits produce with another person, even if it is becoming unusable he should not touch it. Rabban Simeon ben Gamliel said, he shall sell it under the supervision of the court as returning lost property to its owner.
