What is the reason of the House of Shammai? People do not usually introduce seeds between trees. Does it turn out that the House of Shammai are like Rebbi Yose? Just as Rebbi Yose said that people do not usually introduce onions between vegetables, so the House of Shammai say that people do not usually introduce seeds between trees! It is reasonable to say that the House of Shammai will agree with Rebbi Yose but Rebbi Yose will not agree with the House of Shammai. The House of Shammai will agree with Rebbi Yose that people do not usually introduce onions between vegetables. Rebbi Yose will not agree with the House of Shammai because people usually introduce seeds between trees.
Two kinds, half moist and half dry, even Rebbi Aqiba will agree. But did we not state: “The Sages agree with Rebbi Aqiba that he who sows dill and mustard at three different places …” It is so: Either dill at three places or mustard at three places. Samuel says, because the first one does not wait for the last one. Rebbi Yasa in the name of Rebbi Joḥanan: Because they usually are being sown bed by bed. According to Samuel, he has to give from each stalk; according to Rebbi Joḥanan he has to give from each bed.
Rebbi Yose said, the Mishnah deals with an olive tree that can be shaken. Rebbi Yose said, not only one that can be shaken; since olive trees usually are first checked by shaking, none can be under the law of forgotten sheaves.
Does this not contradict Rebbi Joḥanan, since Rebbi Joḥanan said, if he passed it over and forgot it, it is forgotten. There is a difference, for a trellis is usually checked. And it does not even contradict Rebbi Hoshaia, for Rebbi Hoshaia said, when I was mashing olives with the great Rebbi Ḥiyya, he told me that any olive you can reach when stretching out your hand is not forgotten. There is a difference, since any single free-standing vine is a separate planting.
HALAKHAH: How far? Rebbi Ḥanina said, to a place where he usually goes and returns the same day. It happened that Rebbi trusted five brothers about five kor of wheat. Is that not impossible? A little here and a little there adds up to a kor.
It was stated: One does not sow ṭevel, one may not cover ṭevel, but one covers ṭevel with a Gentile. If one forgot and sowed ṭevel, he is free, for it is already lost if it is something that usually is not collected; but for something that usually is collected, he is fined to collect it before it sprouts. But if it sprouted, it turns into something that usually is not collected.

The colleagues in the name of Rebbi Eleazar: It is Rebbi Meïr’s, since Rebbi Meïr said, they permitted to sell demay only to the commissioned grain merchant. Rebbi Yose objected, does not the Mishnah disagree? “The following sell wholesale in large quantities, for example commissioners and grain merchants.” Hence, there must be others! Rebbi Yose said, this is not what Rebbi Eleazar referred to, but the following, as we have stated: “When is this statement operative, if he sells in his bakeshop or at the door of his bakeshop. But if he was selling in the bakery or in his bakeshop adjacent to the bakery, he must give all tithes on it.” The colleagues in the name of Rebbi Eleazar: It is Rebbi Meïr’s, since Rebbi Meïr said, they only permitted to the commissioned grain merchant to sell demay. Which (statement of) Rebbi Meïr? The one we have stated next: “Rebbi Meïr says, something which usually he measured wholesale and he measured retail, the retail is adjunct to the wholesale.” Rebbi Ḥiyya stated: “Something which usually is measured wholesale and he measured it retail, the retail is adjunct to the wholesale.” And so the bakery is retail but the bakeshop is wholesale, there the wholesale is adjunct to the retail.

MISHNAH: Rebbi Meïr says, something which usually is sold retail and he sold wholesale, the wholesale is adjunct to the retail; something which usually is sold wholesale and he sold retail, the retail is adjunct to the wholesale. What is wholesale? For dry produce, three qab, for liquids, the value of one denar. Rebbi Yose says, baskets of figs, baskets of grapes, and boxes of vegetables, all these if sold en bloc are free.

It was stated: “He who buys from the retail merchant and returns to buy a second time. If he recognizes that the amphora is the same, he tithes from one on the other.” But if he does not recognize it, he does not. That means, in the case of ’ydtyqrym’, but not in the case of vessels (used to draw wine) which usually are refilled one from the other.
“If he received a field to harvest for early ears, grapes to harvest for baskets of grapes, olives to harvest for baskets of olives, he delivers as is.” That means, if (he is paid) in the same kind; but from another field, or from that field but not from the same kind, he must tithe before he delivers. Rebbi Ḥiyya stated: “From the same field, whether it be the same kind or another kind, he separates heave and delivers. From another field, whether it be the same kind or another kind, he tithes and delivers.” The Mishnah follows Rabban Simeon ben Gamliel; what Rebbi Ḥiyya stated follows the Sages, and they disagree. We also may come and state that the Mishnah deals with some place where barley usually does not yield twice as much as wheat; what Rebbi Ḥiyya stated refers to a place where barley usually yields twice as much as wheat.

Rebbi Zeïra, Rebbi Simeon ben Laqish in the name of Rebbi Hoshaia: “If they produce greenery it should be plowed under:” all is permitted. “If they are green stalks, they should be broken:” the straw is permitted but the grains are forbidden. “If they produced grain it must be burned:” all is forbidden. Rebbi Joḥanan said, all is forbidden. What does our statement mean, “if they produce greenery it should be plowed under, if they are green stalks, they should be broken, if they produced grain it must be burned”? It parallels what we have stated there: “Orlah and kilaim of a vineyard. Anything that usually is buried should be buried. Anything that usually is burned should be burned.”

HALAKHAH: Ḥizqiah said, the Mishnah speaks about distances from three to four hand-breadths. Less than three is close up, up to four one has to complete, four is easy for it. How far? Rebbi Jacob bar Idi in the name of Rebbi Simeon ben Laqish, up to four cubits. Rebbi Aḥa, Rebbi Ḥinena in the name of Rebbi Simeon ben Laqish, up to six cubits. Rebbi Mana said: I went to Caesarea and heard Rebbi Hoshiah bar Shammai in the name of Rebbi Isaac ben Eleazar: If there were two papyri, it is permitted. Rebbi Ḥinena said, a statement disagrees: If he usually oversteps, it is forbidden. It was stated thus: Rebbi Simeon ben Eleazar says, if he usually oversteps between lattices, it is treated as a single lattice.

Rebbi Yudan from Kappadokia asked before Rebbi Yose: There they say that tree seeds are called seeds but here you say that tree seeds are not called seeds. He said to him: There the verse excluded them since usually people do not call them “seeds,” but here the verse added (Lev. 11:37) “any sown seed that may be sown.”
MISHNAH: Birsīm, Burdesīm, and Dalmatian garb as well as pinon shoes one should not wear unless one checks them. Rebbi Yose says, those coming from the sea shore in maritime countries do not have to be checked because usually they are made from hemp. Padded shoes have no problem with kilaim.
It was stated: “One strings and spreads.” So is the baraita: One strings vines and spreads them on the poles. “At a place where one usually strings and spreads before Sukkot one strings and spreads before Sukkot; after Sukkot, one strings and spreads after Sukkot. Rebbi Simeon says, only higher than the notch.”
MISHNAH: One dirties saplings, ties them, clips them, builds them shelter, and waters them until the New Year. Rebbi Eleazar ben Rebbi Ẓadoq says, one may water the leaves in the Sabbatical year but not the stem. One rubs unripe figs and pricks them until the New Year. One may not rub or prick unripe figs entering the Sabbatical year, or those of the Sabbatical year leaving it. Rebbi Jehudah says, at a place where people usually rub them, one may not rub them because that is agricultural work, but in a place where one does not usually rub, he may do so. Rebbi Simeon permits it for a tree since one may work a tree.

HALAKHAH: “If somebody cuts down an olive tree,” etc. It was stated: “If somebody cuts reeds, Rebbi Jehudah says at a place where one is used to cut, he should tear out; at a place where one is used to tear out, he should cut. In any case, he should cut higher than a hand-breadth. If somebody cuts down for logs, he should not plane and cut in steps, cut in steps to create joints, but he should try to cut them straight.” It was stated: “Rabban Simeon ben Gamliel said, at a place where one usually planes, he should cut in steps, in steps he should plane and cut down at the ground, but he should not cut with an axe.”
“Unripe grapes when they contain fluid”, etc. What argument can you give for unripe grapes? Rebbi Abun said, because at that stage usually the owls eat it.
Does Rav follow the House of Shammai and Samuel the House of Hillel? Rav follows the House of Shammai and Samuel the House of Hillel. Rav follows the House of Shammai, but even if he would follow the thinking of the House of Hillel, people do not usually keep for thirty days. If he keeps it for thirty days would it not be an erroneous transaction? Samuel follows the House of Hillel, but even if he would follow the thinking of the House of Shammai, people do not usually slaughter ploughing cattle.

MISHNAH: Sabbatical produce should not be sold by measure, weight, or count. Figs may not be sold by count nor vegetables by weight. The House of Shammai say, not [vegetables] in bundles. But the House of Hillel say, anything usually stored in bundles in the house may be bundled on the market; for example leeks and milk bud.
If a butcher who is a Cohen gets hold of a first-born, may he cut it up into roasts and sell it on the market? Rebbi Jeremiah wanted to say it is permitted, analogous to “anything usually stored in bundles in the house may be bundled on the market”. Rebbi Mana said, that statement itself implies that it is forbidden, that he should not treat its body as merchandise.
They asked Rebbi Joḥanan: May Sabbatical produce become freed by redemption? He said to them, why not? Rebbi Eleazar said, Sabbatical produce cannot become freed by redemption, only by sale. A baraita supports one, a baraita supports the other. A baraita supports Rebbi Joḥanan: “Anybody who has money that is Sabbatical and he wants to redeem it by his dough may redeeem it.” A baraita supports Rebbi Eleazar: “If somebody has a tetradrachma of Sabbatical money and he wants to buy a garment goes to the grocer he usually deals with and says to him, give me fruits for this. He gives them to him. Then he says, these fruits are given to you as a gift and the grocer says, this tetradrachma is given to you as a gift. Then he goes and buys himself a garment.”
“Since nothing similar is growing wild on the fields.” And since nothing similar is growing wild on the fields should they be forbidden? Rebbi Ḥama bar Uqba in the name of Rebbi Yose bar Ḥanina said, because they usually grow layers. And because they usually grow layers should they be forbidden? Rebbi Samuel bar Rebbi Isaac said, for all other vegetables one can recognize whether they are new or old but here one should not go and bring from what is forbidden and say I brought from the layers.

“ A pound of cut figs which somebody pressed into the mouth of an amphora and does not remember where he pressed, into the mouth of a vase and does not remember where he pressed; Rebbi Eliezer says, if there are 100 pounds it may be lifted, otherwise it cannot be lifted; Rebbi Joshua says, if there are 100 mouths there it may be lifted, otherwise the mouths are forbidden and the sides are permitted, the words of Rebbi Jehudah. Rebbi Meїr says, Rebbi Eliezer says, if there are 100 mouths there it may be lifted, otherwise the mouths are forbidden and the sides are permitted; Rebbi Joshua says even if there are 300 mouths it cannot be lifted.” This means that they considered mouths as something that usually is counted. This supports Rebbi Joḥanan who said, it is a disagreement of Tannaїm. This supports him who says, the words of Rebbi Meїr that everything sanctifies. This supports him who says it is a disagreement of Tannaїm. This means that even one hundredth of a pumpkin forbids.
“Two boxes in two attics, two storage bins in one attic.” But not two storage bins in two attics. What is the difference between boxes and storage bins? Boxes are usually moved around, storage bins are not.
We understand that when pure it must be left to rot, but when impure to rot? In the opinion of Ḥizqiah, this is correct. In the opinion of Rebbi Joḥanan, should it not be burned? Rebbi Joḥanan is of the opinion of Rebbi Yose ben Ḥanina, maybe it is possible to find for them something to lift; but only if it is not usually mixed [with other food]. But if it usually is mixed, maybe something untoward will happen.

HALAKHAH: “A woman who was eating heave,” etc. It is acceptable, “your husband died.” “He divorced you?” The rabbis say, this follows the old Mishnah, according to which the betrothed daughter of an Israel eats heave and her father accepts her divorce document. Rebbi Eliezer says, you may even say following the later Mishnah; explain it that she said to him, bring my divorce document from place X and usually that should have taken him ten days to deliver to her but he found a galloping horse and brought it to her in five days. Rebbi Eliezer cannot follow Rebbi Eleazar, as we have stated: “Rebbi Eleazar forbids her immediately.” Does Rebbi Eleazar not agree that if she said, bring my divorce document from place X, that she may eat heave until the document arrives at that place? Rebbi Ḥaninah said, when she said to him, bring my divorce document from place X, it is as if she had said to him, it shall become a divorce document only after ten days. What she ate, she ate with permission.
Zeir bar Ḥinena was captured at Safsufa. Rebbi Ammi and Rebbi Samuel went to negotiate for him. Queen Zenobia said to them, your Creator usually does wonders for you; put Him under pressure! There came a Saracen carrying a sabre. He said to them, with this sabre did Odenathus kill his brother. Zeїr bar Ḥinena was saved.
Samuel said, if a pumpkin was punctured, all that grows in that depression is forbidden. The same holds for bunches of dates. “ Rebbi Yose said, Jonathan ben Ḥarasha from Genezareth asked Rabban Gamliel and the Sages at Jabneh: What is the status of punctured soft dates on their tree? They said to him, that entire date palm is forbidden.” Rebbi Yose said, that statement is needed if all [dates] are punctured; you should not say, since a snake does not usually do this, a cloud of birds rested on them and pecked at them. Rebbi Jonah in the name of Rebbi Simeon the Pious: Punctured soft dates on their tree are forbidden, but people behave as if they were permitted and they are not hurt.
If he gave much, even if he said, take and eat, it is as if he said, take and store. If he gave him anything that usually is not eaten raw, even if he said, take and eat, it is as if he said, take and store. If [the recipient] was an important personality who does not usually eat in public, if he said, take and eat, it is as if he said, take and store. If there were two people; to one he said, take and eat; to the other he said, take and store. The one to whom he said, take and eat, is free; the one to whom he said, take and store, is obligated. Rebbi Yose said, is that not a Mishnah (2:2): “They eat and are free but the owners of the gate or the store are obligated?” Rebbi Jonah said, it is everybody’s opinion; here for demay, there for certain.

“If somebody collected in order to send to a friend, it is free.” Rav said, he is forbidden to eat. Rebbi Shammai said before Rebbi Yose in the name of Rav Aḥa: Rav said this in case he brought it into a secure courtyard, following Rebbi Meїr. Rebbi Mana said, our Mishnah implies this: “If somebody bought standing produce, it is free.” Therefore, after it was cut it is obligated. Who is the person who holds that a sale induces ṭevel for produce not fully processed? Is this not Rebbi Meїr? Rebbi Ḥiyya in the name of Rebbi Joḥanan, it is from Rebbi Jehudah. It was stated so: “Rebbi Jehudah says in the name of Rebbi Eleazar ben Azariah, also he who sends to his friend olives from the press, young plants, and bundles of fenugreek, should not eat before he tithed since people usually send these things to their friends as ṭevel.” Rebbi Simeon ben Laqish said, even if a Fellow sent to a Fellow, he has to tithe. The colleagues asked, we can understand a vulgar who is suspect; is a Fellow suspect? Rebbi Yose said, is the vulgar not like a Fellow in matters of heave? It really is so: People usually send these things as ṭevel to their friends.

MISHNAH: If somebody buys a domestic animal for a well-being offering or a wild animal for meat of desire, the hide becomes profane even though it may be worth more than the meat. [If he buys] sealed wine jugs at a place where jugs usually are sold sealed, the pitcher becomes profane. The shells of walnuts and almonds become profane. Afterwine before it fermented cannot be bought with tithe money; after it fermented it may be bought with tithe money. If somebody buys a wild animal for a well-being offering or a domestic animal for meat of desire, the hide does not become profane. [If he buys] open wine jugs or sealed ones at a place where wine usually is sold from the barrel, the pitcher does not become profane. [If he buys] baskets of figs and baskets of grapes sold with the vessel, the price money of the vessel does not become profane.

HALAKHAH: It was stated: “Ben Bag Bag says (Deut. 14:26): ‘You shall spend the money for anything you desire.’ It was stated: A person may buy a cow because of its hide, a sheep because of its fleece, and wine because of its pitcher.” Rebbi Zeïra said, that is, if the seller was a private person. But if the seller was a professional it is as if he sold this separately and that separately. Rebbi Zeïra said, the Mishnah said this: “In a place where wine jugs usually are sold sealed, the pitcher becomes profane.” Rebbi Mana said, from this [you conclude that] just as you say there, if the seller was a professional it is as if he sold this separately and that separately, so if the buyer was a professional it is as if he bought this separately and that separately.
MISHNAH: If what was bought with tithe money became impure, it should be redeemed. Rebbi Jehudah says, it should be buried. They said to Rebbi Jehudah, if original Second Tithe which became impure is redeemed, what was bought with tithe money and became impure certainly should be redeemed. He said to them, no! If you said about original Second Tithe, which can be redeemed when it is pure and far from the Place, can you say the same about what was bought with tithe money which cannot be redeemed when it is pure and far from the Place? If a deer bought with tithe money died, it should be buried in its hide. Rebbi Simeon says, it should be redeemed. If he bought it alive and slaughtered it, if it became impure it should be redeemed. Rebbi Yose said, it should be buried. If he bought it slaughtered and it became impure, he treats it following the rules of produce. If somebody lends flasks for Second Tithe, even if he closed the top with clay, tithe did not acquire it. If he filled them without saying anything, before he closed the top with clay, tithe did not acquire it; after he closed the top with clay, tithe acquired it. Before he closed the top with clay, one may lift by 101, after he closed the top with clay any one sanctifies. Before he closed the top with clay, he gives heave from one for all, after he closed the top with clay he has to give heave from each single one. The House of Shammai say, he opens and pours into a vat, but the House of Hillel say, he opens and does not have to pour. Where has this been said? At a place where usually one sells sealed, but at a place where usually one sells open, the flask did not become profane. However, if he is meticulous to sell by volume, the flask did become profane. Rebbi Simeon said, also if somebody says to another person, I am selling to you this amphora except its flask, the flask became profane.

Rebbi Joḥanan said, if somebody redeemed dedications for more than their worth, [the Temple] grabs everything. If somebody redeemed Second Tithe for more than its worth, it does not grab everything. What is the difference between dedications and Second Tithe? Rebbi Immi said, because a person usually adds to his dedications. Rebbi Zeïra asked before Rebbi Immi: If the person was checked and he said, that was not what I intended? He said to him, when he will be checked.
Rebbi Jonah asked, that is following him who said that it is not his property. But for him who says that it is his property, what is the difference between dedications and Second Tithe? Rebbi Yose said, the reason has already been explained, because a person usually adds to his dedications.
HALAKHAH: That you should not say, since people do not usually act like this, one has to say “profane”.
Were these exchanged? We have stated there: “If he prepared black ones and found white, white and found black, two and found three, they are forbidden, three and found two they are permitted.” Rebbi Jacob bar Aḥa in the name of Rebbi Assi, this is Rebbi’s, as we have stated: “Two hundred and he found a talent, a talent was taken, the word of Rebbi, but the Sages say, it is profane.” He turned around and said, this is everybody’s opinion since pigeon chicks usually start to fly. But did not Rebbi Ḥalaphta ben Shaul state: The same rule applies to pigeon chicks and to eggs. Therefore, it is Rebbi’s. There, he put it there and he found, here, his father put it there, did his father find it? Rebbi Abun bar Cohen said before Rebbi Yose in the name of Rebbi Aḥa: Rebbi Abba bar Zavda taught according to Rebbi for Second Tithe.
Rebbi Yose said, the word of Rebbi Abinna supports me, since Rebbi Abinna said, explain it following this baraita: “In a place where one does not usually work on the 14th, but not in a place where one is used to work on the 14th.” If it is cut; maybe also when it is standing? It was found stated: “In a place where people are used to work on cut produce, one may work even on standing grain.”
HALAKHAH: “Two women who each made,” etc. Rebbi Joḥanan said, usually for women, one does not mind, two do mind. They gave to one woman who minds the status of two women, to two women who do not mind the status of one woman. If she does not mind, why does she make it at two different places? Rebbi Jonah said, because she has not enough space to knead. The word of Rebbi Jonah implies that if she had enough space to knead but she makes it in two portions, she does mind. Clean and coarse [flour], she does mind. Rebbi Lazar said, they gave two different habits the status of two women. Samuel bar Abba asked, even if they come to agree?
Rebbi Jonah said, Rebbi Aqiba follows his own opinion since “Rebbi Aqiba says, all its processing is done in impurity”. Rebbi Yose said, even if you say that he changed his method; there is a difference because a person usually does not make his animal’s fodder impure.
It was stated: “Rabban Simeon ben Gamliel says, when has this been said? If he planted for fencing, logs, or wood, kinds appropriate for that use. If he planted an inappropriate kind it is obligated.” Rabban Simeon ben Gamliel said it correctly, what is the reason of the rabbis? Rebbi Zeïra said, if he changed the way it is usually planted: For wood tightly together, for logs cutting off branches, for a fence the location of the fence proves it.
It was stated: “A piece of the showbread which was mixed with a hundred pieces of profane [bread], or a piece of purification sacrifice mixed with a hundred profane pieces [of meat], should not be lifted. Rebbi Jehudah says they should be lifted.” What is the reason of Rebbi Jehudah? (Ez. 45:15) “One sheep from 200 from the drink of Israel,” from what is permitted to Israel. It is difficult! It is written 200 and Rebbi Jehudah says 100. It is written alive and Rebbi Jehudah says slaughtered. What is the difference between alive and slaughtered? Rebbi Ḥinena said, they considered live ones under the category of what usually is counted.
Rebbi Abbahu in the name of Rebbi Joḥanan, all forbidden [food] is estimated as if it were onion, as if it were leeks. That is, anything usually estimated as if it were onion, as if it were leeks. Anything which is not usually estimated as if it were onion, as if it were leeks, how do you estimate it? How do you estimate cumin?

Rebbi Yudan said, did not Rebbi Abbahu say in the name of Rebbi Eleazar, they taught this about sweeteners? Since sweeteners usually are estimated as if they were onion or leeks, one estimates them as if they were onion or leeks. All other forbidden [foods], since they are not usually estimated as if they were onion or leeks one estimates in their kinds. Cumin one estimates by its kind.

Does one not count other pomegranates? But Badan pomegranates one usually counts because they are preferred; other pomegranates one does not usually count because they are not preferred.

HALAKHAH: Mishnah: “A tailor should not leave with his needle close to sundown lest he forget and leave,” etc. It was stated: “A tailor should not leave with a needle in his garment, nor a scribe with the pen behind his ear, nor a dyer with a sample behind his ear, nor a money-changer with a denar behind his ear. If one of these left they are not liable, the words of Rebbi Meïr. Rebbi Jehudah says, a craftsman in the ways of his craft is liable, therefore everybody else may leave with one of these.”The argument of Rebbi Meïr seems inverted, as we have stated there: “If she left she is liable, the words of Rebbi Meïr,” and here he says so? Rebbi Mana said it without attribution, Rebbi Abun in the name of Rebbi Joḥanan: There women usually do it, but here only children leave with this. The argument of the rabbis seems inverted, as we have stated there: “But the Sages declare not liable with a plate of make-up or a flask of perfume.” Therefore with a needle with ear she is liable. Is that a craftsman who is liable in the way of his craft? Rebbi Yose ben Abun said, explain it for a woman hairdresser.
The House of Shammai put a question to the House of Hillel which they could not answer. “The House of Shammai said to the House of Hillel, do you not agree with us that one does not roast meat, or onions, or an egg, unless they be completely roasted when it is still daylight? They did not find an answer.” Rebbi Zeˋira said, if I would not put my head between the lions I could give a reason. There, onion, meat, or egg, usually are flipped; here, what can you say? Rebbi Yudan said, if they were roasted like Ben Derosai’s food. They forbade something which usually is flipped unless it be completely roasted as long as it is still day. Rebbi Mana said, it is not reasonable that it should be permitted. For they can say to them, how can you respond to us with something which ordinarily is completely roasted when it still is day about something which ordinarily cannot be completely soaked when it still is day?

“One does not put bread dough into the oven.” Rebbi Jacob bar Aḥa in the name of Rebbi Assi: Women are more careful with bread than with dishes. What is the difference between bread and dish? A dish one usually eats hot, bread one usually does not eat hot. There, they say, hot bread is accompanied by fever. A wasp, cold; a scorpion, hot. He who switches is in danger.

Rebbi Levi said, at three places the Satan usually accuses: one who is on the road alone, one who sleeps in a dark house alone, and one who sets sail on the ocean. Rebbi Isaac bar Marion said, if it had not been written, so says the Eternal Who makes a path in the Sea, if a person would set out on it he would die. But the rabbis say, Who makes a path in the Sea, from Pentecost to Tabernacles, and in great waters a trail, from Tabernacles to Ḥanukkah. Rebbi Yose ben Rebbi Tanḥum from Kefar Agin (a case) was in Essia. He wanted to set sail between Tabernacles and Ḥanukkah. A matron saw him and said to him, now one sets sail? His father appeared to him, but he had no burial; he listened to neither and travelled by sea. Rebbi Cohen the brother of Rebbi Ḥiyya bar Abba was a sailor. He came to sail between Tabernacles and Ḥanukkah. He said to his brother, pray for me. He answered him yes, I prayed for you, but if you see the public praying for rain do not trust my prayer. Since you bound your lulav, bind your feet.
HALAKHAH: Why did they decree about a nailed shoe? Some say, because they saw the tips and had miscarriages. But some say, they heard its sound and had miscarriages. And some say, they were stampeding and killing one another. What is the difference between them? הדוסטא. Accordig to him who said, because they saw the tips and had miscarriages, it is permitted. But according to him who said, they heard its sound and had miscarriages or they were stampeding and killing one another, it is forbidden. But did they not decree this in an emergency? When the emergency passed it should have been permitted. There never rose a court which undid it. Then even on a weekday! People do not usually have two pairs of shoes, one for weekdays and one for the Sabbath. It was stated: If one put a patch under it it is permitted. Rebbi Yudan bar Ismael’s feet were scratched and they did this for him.
One may go out on Friday towards nightfall with phylacteries, but one may not go out on Friday towards nightfall with nailed shoes. What is the difference between them? These one usually takes off, those one does not usually take off.

“Garden seeds less than the volume of a dried fig; Rebbi Jehudah ben Bathyra said, five.” What is Rebbi Jehudah ben Bathyra’s reason? Because this is what one usually sows in a garden bed.
HALAKHAH: “The eight kinds of vermin,” etc. Rebbi Zeriqan in the name of Rebbi Immi: Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed. One said, this is everybody’s opinion; the other said, it is in dispute. We do not know who said what. Rebbi Zeˋira said, let us explain the rabbis’ words from their own words, since we have stated there: “these are the ones whose skins are like their flesh, human skin and domesticated pigskin. Rebbi Yose says, also wild pigskin.” Rebbi Joḥanan said, they taught this only regarding prohibition and impurity. But with regard to flogging it is hide and one may not flog for it because of carcass meat. Rebbi Simeon ben Laqish said, Rebbi taught a complete Mishnah, whether for prohibition, or for flogging, or for impurity. A baraita supports one, and a baraita supports the other. A baraita supports Rebbi Joḥanan: “The eight kinds of vermin have hides. Rebbi Joḥanan ben Nuri said, therefore I am saying that the eight kinds of vermin have hides.” A baraita supports Rebbi Simeon ben Laqish. He who injures vermin, for those who have hides he is liable, for those who have no hides he is not liable. Rebbi Joḥanan ben Nuri said, therefore I am saying that all kinds of vermin have hides. Rebbi Yose ben Rebbi Abun in the name of Rav: It is hide and one may not flog for it because of carcass meat. This follows what Rebbi Joḥanan said, “he who caught crickets, flies, ḥagazin, mosquitoes is liable, but Rebbi Jehudah declares not liable, for so did Rebbi Jehudah say, one is liable only for something which usually is hunted. One who catches locusts in dew is not liable, in dry time is liable. Eleazar ben Aḥbai says, even in heat one is not liable if it forms clusters. One who catches a lame, blind, sick, young deer is not liable, for a sleeping one he is liable,” for it closes one and opens one.
MISHNAH: One whose teeth are aching may not sip vinegar, but he may dip as usual and if he is healed, he is healed. One whose hips are aching may not rub in oil and vinegar, but he may rub in oil, except for rose oil. Princes may rub rose oil on their injuries because they usually do this also on a weekday. Rebbi Simeon says, all of Israel are princes.
HALAKHAH: “If one had two children,” etc. Rebbi Joḥanan said, it is Rebbi Meïr’s who said, for something where there is a commandment performed one is not liable, but if no commandment is performed whether he is liable is disputed. Rebbi Simeon says, where there is a commandment performed one is liable, but if no commandment is performed whether he is not liable is disputed. Rebbi Yose in the name of Rebbi Joḥanan: The word of Rebbi Meïr is, on condition that it be a sheep without blemish, a yearling, and a well-being sacrifice fit to be changed into a Passover sacrifice. One understands from this three consequences. One understands something which is not a fixed number. And which is not usually exchanged. And doing something which fulfills a commandment. What means “something which is not a fixed number”? Rebbi Jeremiah wanted to say that the Torah did not specify how many Passover sacrifices should push the Sabbath aside in any given year. Rebbi Yose wanted to say, where you cannot determine the amount. When Rebbi Yose came to these [“children in doubt” he used to say, Rebbi Jeremiah tought us correctly. Could you say that you cannot determine the amount? But the Torah did not] specify how many Passover sacrifices should push the Sabbath aside in any given year. Rav Ḥisda said, one may explain the words of Rebbi Simeon if a group was there which did not slaughter. Rebbi Zeˋira said, the word of Rebbi Yannai implies that he forgot and circumcised the one for the Sabbath on Friday. It he circumcised him in the morning, Rebbi Zeˋira said that Rebbi Yannai was of the opinion that he is not liable. Rebbi Abba said, he is liable. In relation to what did Rebbi Yannai say it? He comes to tell you in which cases can there be a switching of children. In Rebbi Zeˋira’s opinion following Rebbi Yannai Rav followed Rebbi Meïr. Rebbi Mana said before Rebbi Yose, what Rav Ḥisda said follows Rebbi Simeon, and what Rebbi Zeˋira said follows Rebbi Meïr. Can one object anything between Rebbi Meïr and Rebbi Simeon? Do we find a difference between Rebbi Meïr and Rebbi Simeon about the remainder? How do you treat the babies in doubt? Like something which is a fixed amount or something which is not a fixed amount? If you are treating it like something which is a fixed amount … only if there remains another baby to circumcise. Rebbi Yose said, the words of the rabbis make the case like something which is not a fixed amount: only if there remains another baby to circumcise. Come and see: If he anticipated his time he is not liable, if he delayed his time he is liable? Rav Huna said, the Mishnah is the other way around, as it was stated: Rebbi Simeon said, Rebbi Eliezer and Rebbi Joshua did not disagree about one which was to be circumcised after the Sabbath if he circumcised him on the Sabbath that he is liable, but one who was to be circumcised before the Sabbath if he circumcised him on the Sabbath where Rebbi Eliezer makes him liable for a purification sacrifice and Rebbi Joshua declares him not liable. Rebbi Yose ben Rebbi Abun said, because of this objection it was difficult for Rebbi Yannai, only if he forgot and circumcised the one of the Sabbath on Friday. Rebbi Ada bar Ahavah said, these are the words of Rebbi Meïr and Rebbi Simeon, but the words of Rebbi Yose [are]: Even if no commandment is performed he is not liable since he erred on behalf of a commandment.
A wine cellar needs checking, an oil cellar does not need checking. What is the difference between wine and oil? Wine has no staying power, oil has staying power. Storage, whether of wine or oil, does not need checking. What is a cellar? Anything used with bread in the courtyard. There exists a cellar which is like storage and storage which is like a cellar. A cellar in which he is ashamed to eat is like storage; storage where he is not ashamed to eat is like a cellar. There is a courtyard which is like an alley and an alley which is like a courtyard. A courtyard which is used by the public is like an alley, and an alley which is not used by the public is like a courtyard. But should one not be afraid that animal drivers introduce leavened matter into it? Animal drivers usually do not introduce leavened matter into it but sweets since they help in checking the quality of the wine.
“And what he leaves he should deposit at a guarded place so that he would not be obligated to repeat checking.” What does he do? He covers it with a vessel. If he covered it with a vessel but did not find it. I am saying that a hand took it. If he did not cover it with a vessel and did not find it, this house needs checking. Or the other houses would not need checking? Let us hear from the following: “If the volume of an olive from a cadaver was lost in a house; it was searched but not found. The house is pure; if it will be found, the house is retroactively impure.” This can teach about that and that can teach about this. This can teach about that, there is no difference between “was lost” and “what he leaves”. And that can teach about this, only this house needs to be checked. Following Rebbi Jehudah even this house should not need to be checked, as we may hear from the following: “Rebbi Jehudah said, it happened that the slave girl of a discharged veteran at Rimmon threw a still birth into a cistern. A Cohen came and looked to know what she had thrown down. The case came before the Sages and they declared him pure for moles and martens usually drag it away.” It runs after flesh, it does not run after bread. And even if you are saying that it runs after flesh and bread, it drags away flesh and eats it; it drags away bread and stores it. The rabbis of Caesarea in the name of Rebbi Abbahu: One does not suspect that a mole dragged it, but following Rebbi Jehudah one suspects it.
Rebbi Ḥiyya bar Abba in the name of Rebbi Yohanan: One says “Creator of the fruit of the tree” on marinated olives. Rebbi Benjamin bar Jephet in the name of Rebbi Yohanan: One says “By Whose word everything was created” on water-cooked vegetables. Rebbi Samuel bar Rav Isaac said: a Mishnah supports Rebbi Benjamin bar Yephet: “but not marinated or cooked in water or cooked in broth”; if they were recognizable in their state one could fulfill his duty with them on Passover. Rebbi Zeˋira said, who understands well what Rebbi Yohanan said, Rebbi Ḥiyya bar Abba or Rebbi Benjamin? Not Rebbi Ḥiyya bar Abba? And in addition from the fact that we see great rabbis going to a mourner’s meal, eat lupines and recite on them “Creator of the fruit of the earth;” Are not lupines certainly cooked? If you wish, you may say there is a difference, since the Torah said bitter herbs, and cooked lupines have lost their bitterness. Rebbi Yose ben Rebbi Abun said, they have no disagreement. Since olives usually are eaten fresh, they are recognizable in their state even if they are marinated. Vegetables are changed once they are cooked.
MISHNAH: In a place where usually one eats roast meat in the Passover nights one eats; in a place where one does not usually eat one does not eat. In a place where one is used to ignite a candle in the night of the Day of Atonement one ignites, in a place where one is used not to ignite one does not ignite. One ignites in synagogues, and in houses of study, and in dark passages, and near sick persons.

HALAKHAH: “Rebbi Meïr says, any work which one started before the Fourteenth he may finish on the Fourteenth,” but only what is needed on the holiday. “But he may not start one on the Fourteenth,” even something needed for the holiday. “But the Sages say, three trades are working on Passover Eve, the tailors,” since a non-professional may sew normally on the intermediate days of the holiday. “The barbers,” since nezirim and lepers shave on the holiday. “The laundrymen,” since usually people who ascend from impurity to purity launder on the holiday. “Rebbi Yose ben Rebbi Jehudah says, also the cobblers,” since the pilgrims are used to repair their boots and sandals on the holiday. But the rabbis say, they were rich and made the pilgrimage on animals.
Does this not contradict Rebbi Joḥanan, since Rebbi Joḥanan said, if he passed over it and forgot it, it is forgotten. There is a difference, since every single freestanding vine is a separate planting.
HALAKHAH: Rebbi Jacob bar Aḥa in the name of Rebbi Yasa. Power was given to Moses’s voice and his voice went through the entire land of Egypt, a distance of 40 days of travel. What did he say? From place X to place Y one group, from place Z to place U one group. You should not be astonished. If about dust, which does not usually move, it is said, it will bedust in the entire land of Egypt, voice which usually is moving, not so much more? Rebbi Levi said, just as power was given to Moses’s voice, so power was given to Pharao’s voice, [and his voice went through the entire land of Egypt, a distance of forty days of travel.] What did he say? Get up, leave from the midst of my people. In the past you were servants of Pharao, from now on you are servants of the Eternal. At that moment, they were saying, Hallelujah, give praise, servants of the Eternal, but not servants of Pharao.

Rebbi Joḥanan said, it is Rebbi Meïr’s, since Rebbi Meïr said, for something where there is a commandment performed one is not liable, but if no commandment is performed whether he is liable is disputed. Rebbi Simeon says, where there is a commandment performed one is liable, but if no commandment is performed whether he is not liable is disputed. Rebbi Levi said, because usually slaves eat while standing, and here one is forced to eat lying on couches, to proclaim that they went from slavery to freedom. Rebbi Simon in the name of Rebbi Joshua ben Levi: This olive-sized bit with which a person fulfills his obligation on Passover he must eat lying down. Rebbi Yose asked before Rebbi Simon, even a slave before his master, even a woman before her husband? He said to him, great personality, that is all I heard.
“Or where the sunshine is larger than the shade is disqualified;” therefore half and half is qualified. “A wilted sukkah whose shade is more than its sunshine is qualified.” Here you are saying it is qualified, there you are saying it is disqualified. The rabbis of Caesarea, Rebbi Isaac bar Naḥman in the name of Rebbi Hoshaia: It is different for a tree which usually is spreading.
Rebbi Berekhia, Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba: Levi bar Sisi explained in Nahardea: They saw the God of Israel and below His feet like the work of a brick of sapphire, and like the true sky in purity. That is, before they were freed. But after they were freed, (it was not its way to be put) [where usually the brick is put] there it is put. Rebbi Berekhia said, it is not written here the work, but like the work, it and all its tools, (it and the basket and the rake.) [it and all its merchandise. Rebbi Miasha said, in Babylonia it is written, like the looks of sapphire stone, but in Egypt it is written, like the work of] a brick of sapphire. To teach you that just as the stone is harder than the brick, so the servitude of Babylonia was harder than the servitude of Egypt. Bar Qappara stated, before Israel was rescued from Egypt it was traced in the sky; after they were rescued it was no longer seen in the sky. What is the reason? and like the true sky in purity, the sky if it is empty of clouds.
Rebbi Ḥananiah the colleague of the rabbis asked, does the Holy One, praise to Him, not see what is going to be? He did not hear what Rebbi Simon said in the name of Rebbi Joshua ben Levi: The Holy One, praise to Him, only judges a person according to his present state. What is the reason: Do not fear, for God heard the lad’s voice as he is there. Rebbi Levi said, it is written, rakes will not stand before Him. Why? You hated all evil-doers. Rebbi Issachar from Kefar-Mendi preached: For He knows lying people, he saw wickedness, would He not understand? <He will watch over you, bring peace into your virtuous home.> Rebbi Joshua ben Levi said, it is not written, “if you were pure and straight”, but if you are pure and straight. Rebbi Ḥiyya bar Abba said, the strong of loins and the bellwether; the king, there is no standing with him. Usually every one tried to win over the other’s strength, but the Holy One, praise to Him, is not so but the King, there is no standing with him, He does not insist on His standing. [For] not eternally He will fight, He will not fight to be victorious.
Rebbi Eleazar said, παρά βασιλέως ‘ο νόμος ʼάγραφος. Usually in the world a king of flesh and blood decides a decision. If he desires it, he keeps it. If he desires it, others keep it. But the Holy One, praise to Him, is not so but if He decides a decision He keeps it first. What is the reason? They have to keep My watch, I am the Eternal, I am He Who keeps the commandments of the Torah first. Rebbi Simon said, it is written, before white hairs you have to stand, and honor the presence of an elderly person, and to fear your God, I am the Eternal. I am He Who first stood before an elderly person. Rebbi Simon said, it is written: for who is a great people which has just laws and ordinances, etc. <For who is this great people that has God close to it.> Rebbi Ḥama ben Rebbi Ḥanina and Rebbi Hoshaia. One said, is there a people like this people? Usually in the world a person who knows that he will stand in trial dresses in black, wears black headdress, and lets his beard grow, since he does not know how his trial will end. But Israel are not so, but they wear white, wear white headdress, cut their beard, eat, and drink, and are happy. They know that the Holy One, praise to Him, will perform wonders for them. But the other one said, is there a people like this people? Usually in the world if the ruler says, the trial is today, but the robber says, tomorrow is the trial, whom does one listen to, not the ruler? But the Holy One, praise to Him, is not like this. If the Court said, today is New Year’s Day, the Holy One, praise to Him, says to the angels of service, put up the dais, [summon defenders, summon accusers, for My children said that today is New Year’s Day.] If the Court took counsel to transfer it to the next day, the Holy One, praise to Him, says to the angels of service, remove the dais, remove the defenders, remove the accusers, for My children took counsel to transfer to tomorrow. What is the reason? Certainly, it is a rule for Israel, a law of the God of Jacob. If it is not a rule for Israel, so to speak it is not a law for the God of Jacob. Rebbi Crispus in the name of Rebbi Joḥanan: In the past, the festive times of the Eternal, from then and onwards which You shall declare. Rebbi Ila said, if you declare them they are My festive times, otherwise they are not My festive times. Rebbi Simon said, it is written, great things You did, You, Eternal my God, Your wonders and intentions regarding us. In the past, great things You did; from then onwards, Your wonders and intentions regarding us. Rebbi <Joshua ben> Levi said, a parable of a king who had a watch; when his son came of age, he handed it to him. Rebbi Yose ben Ḥanina said, a parable of a king who had a watch-box; when his son came of age, he handed it to him. Rebbi Aḥa said, a parable of a king who had a ring; when his son came of age, he handed it to him. Rebbi Ḥiyya bar Abba said, a parable of a carpenter who had carpenter’s tools; when his son came of age, he handed them to him. Rebbi Isaac said, a parable of a king who had treasures; when his son came of age, he handed them to him. But the rabbis say, a parable of a healer who had a box of medicines; when his son came of age, he handed it to him.

“And on New Year’s Day all in the world pass before Him like bene maron”. Rebbi Aḥa said, like those led into the corral. But the rabbis are saying, like (in a legion.) What is the reason?, Who creates together their hearts, Who understands all their deeds. Rebbi Levi said, He Who created together their hearts already understood all their deeds. Rebbi Eleazar said, usually in the world what is easier for the potter, to make a hundred flasks or to look at them? Not to look at them? Rebbi Berekhiah said, their creator wants that their hearts be alone to him. Rebbi Abun said, the One Who is unique in His world already understood all their deeds.
HALAKHAH: [5]: The Mishnah is Rebbi’s, as it was stated: “200 and he found a mina, (the mina was taken away) [a mina was deposited and a mina taken away], the words of Rebbi. But the Sages are saying, it is profane.” There, we have stated: “If somebody said to his son, ‘Second Tithe is in that corner’ but he found it in another corner, that is profane.” Rebbi Jacob bar Aḥa in the name of Rebbi Assi, this is Rebbi’s, as we have stated: “Two hundred and he found a talent, a talent was taken, the word of Rebbi, but the Sages say, it is profane.” He turned around and said, this is everybody’s opinion since pigeon chicks usually start to fly. But did not Rebbi Ḥalaphta ben Shaul state, the same rule applies to pigeon chicks and to eggs? Therefore, it is Rebbi’s. There, his father put it there and he found, here, his he put it there and he found it. Rebbi Abba bar Cohen said before Rebbi Yose in the name of Rebbi Aḥa: Rebbi Abba bar Zavda instructed according to Rebbi for Second Tithe.
HALAKHAH: Abba bar Rav Huna said, [this is] if he did not make an eruv tavshilin for himself. But if he made an eruv tavshilin for himself it is permitted. What is the difference between a dish and hot water? From a dish one usually eats, from hot water one usually does not drink.
