Rebbi Yoḥanan in the name of Rebbi Simeon ben Yoḥai: “For example we, who are engaged in the study of Torah, we do not interrupt even for the recitation of Shema‘.” Rebbi Yoḥanan used to say about himself: “For example we, who are not engaged in the study of Torah, we do interrupt even for prayer.” This one follows his own opinion and that one follows his own opinion. Rebbi Yoḥanan follows his own opinion since Rebbi Yoḥanan says: “if only a man would pray the entire day. Why? Because prayer is never in vain!” Rebbi Simeon ben Yoḥai follows his own opinion since Rebbi Simeon ben Yoḥai said: “If I had stood at Mount Sinai at the moment that the Torah was given to Israel, I would have implored the All-Merciful that he should create two mouths for man; one for him to exert himself in Torah and the other one for his other needs.” But he changed his mind and said: “With one mouth already the world almost cannot exist because of its denunciations; if there were two how much more would there be? Rebbi Yose said before Rebbi Jeremiah: The position of Rebbi Yoḥanan is identical with that of Rebbi Ḥanina ben Aqabiah, as we have stated: “The scribes of Torah scrolls, Tefillin, and Mezuzot, do interrupt for the recitation of Shema‘ but do not interrupt for prayer. Rebbi Ḥanina ben Aqabiah said: just as they interrupt for Shema‘, so they interrupt for prayer, tefillin, and all other commandments of the Torah”. Would not Rebbi Simeon ben Yoḥai agree that one interrupts to make a sukkah or a lulav? Does not Rebbi Simeon ben Yoḥai make the distinction between one who studies in order to do and one who studies in order not to do? Because he who studies in order not to do would have been better off had he not been born. And did not Rebbi Yoḥanan say, he who studies in order not to do would have been better off if the afterbirth he was in was twisted around and he never would have entered the world? The reason of Rebbi Simeon ben Yoḥai is that this one is repeated study and that one is repeated study and he does not push aside one study for the other study. But did we not formulate: “He is like a man reading in the Torah.” Hence, at the right time it is preferred to Torah. One is like the other. Rebbi Yudan said that Rebbi Simeon ben Yoḥai, since he was permanently studying Torah, did not prefer Shema‘ to the study of Torah. Rebbi Abba Mari said, did we not formulate: “He who reads (Shema‘) after that did not lose, he is only like a man reading in the Torah”? Hence, at the right time it is like Mishnah. Rebbi Simeon ben Yoḥai follows his own opinion since Rebbi Simeon ben Yoḥai said: He who studies the written Torah does himself good that is not so good. But the rabbis equate the study of the Bible with that of the oral law.
Rebbi Ḥalaphta ben Shaül stated: Everybody bows down with the cantor for the benediction of thanksgiving. Rebbi Zeïra said: But only for the word modim. Rebbi Zeïra was attentive to the Qeroba to bow his head at the beginning and at the end. Rebbi Yose when he came up here saw them bowing down and whispering. He said to them: What is this whispering? He had not heard what Rebbi Ḥelbo, Rebbi Simeon said in the name of Rebbi Yoḥanan, in the name of Rebbi Jeremiah, Rebbi Ḥanina in the name of Rebbi Miasha, Rebbi Ḥiyya in the name of Rebbi Simai, and some say, the colleagues in the name of Rebbi Simai: We thank You, Master of all creatures, God of praises, eternal Rock, Life of the Universe, Creator, Who resurrects the dead, that You have made us alive, kept us, gave us merit, supported us, and brought us near to give thanks to Your name; praised be You, o Eternal, God of thanksgiving. Rebbi Abba bar Zavda in the name of Rav: We thank You since we are obliged to give thanks; may my lips sing, for I shall sing to You with my soul that You have redeemed; praised are You, o Eternal, God of thanksgiving. Rebbi Samuel bar Inia in the name of Rebbi Aḥa: Thanksgiving and praise to Your name, Yours is greatness, Yours is strength, Yours is glory! May it please You, o Eternal, our God and God of our fathers, that You may support us in our fall, straighten us up from our bent state, because You support the falling and straighten up the bent ones, You are full of mercy and nothing exists except You; praised are You, o Eternal, God of thanksgiving. Bar Qappara said: For You we fall down, for You we bend down, for You we prostrate ourselves, for You we kneel, to You every knee should fall down and every tongue swears. (1Chr. 29:11–13): Yours, o Eternal, is greatness, strength, glory, victory, and majesty, truly all that is in heaven and on earth; Yours, o Eternal, is the kingdom, and You lift Yourself over all as head. Riches and honor are before You, You rule over all; in Your hand is power and strength, it is in Your hand to make great and strengthen everything. And now, our God, we thank You and praise Your glorious name; with all our heart and soul we prostrate ourselves before You. (Ps. 35:10) My entire self shall say: O Eternal, who is like You, Who saves the destitute from one who is stronger than he is, the destitute and poor from the one who robs him. Praised are You, o Eternal, God of thanksgiving. Rebbi Yudan said: the rabbis used to say all of these. But some say, either one or the other.
There is Qiddush. There is a difference since if one was sitting and drinking when it still was day and the holy day came upon him, he does not say “Creator of the fruit of the vine.” But there is its final sentence? Rebbi Mana said, the type of benedictions is like that. Rebbi Yudan said: A short form starts with “Praised” and does not end with “Praised”, a long form starts with “Praised” and ends with “Praised”.
Rebbi Joshua ben Levi said, his name is Ẓemaḥ. Rebbi Yudan, the son of Rebbi Aivu, said his name is Menaḥem. Ḥanina the son of Rebbi Abbahu said: they have no disagreement since the numerical value of one is the numerical value of the other: Ẓemaḥ is equal to Menaḥem. Since Rebbi Yudan the son of Rebbi Aivu said, it happened to a Jew who was plowing in the valley of Arbel that his ox was bellowing. An Arab passed by and heard the bellowing of the ox. He said to him: Jew, Jew, unharness your ox, unharness your plow because the Temple was destroyed. The ox bellowed a second time. He said: Jew, Jew, harness your ox, fix your plow because King Messiah has been born. He said to him: What is his name? Menaḥem. He said to him: What is his father’s name? Ḥizqiah. He said to him: Where is he? He said to him: At the king’s palace in Bethlehem in Judea. He went and sold his ox and plow and made himself a vendor of baby linens. He went to towns and left towns until he came to that town. All the women bought from him but the mother of Menaḥem did not buy. He heard the women say: Menaḥem’s mother, Menaḥem’s mother, come and buy for your son! She said: I would rather strangle him like a hater of Israel because he was born on the day the Temple was destroyed. He said to her: I like him, because for him it was destroyed and for him it will be rebuilt. She said to him, I have no money. He said to her, that does not bother me, come and buy for him! If you have nothing with you today, I shall return another day and I will take it then. After some time he went up to that town and said to her: How is your baby doing? She said to him: After you had seen me there came storms and raised him and tore him from my hands. Rebbi Abun said: We do not need to learn from that Arab, is it not a full verse (Is. 10:35): “The Lebanon will fall through a noble one”? And the next verse is (11:1) “A sprout will come from the stem of Jesse.”

Rebbi Isaac the son of Rebbi Ḥiyya the Scribe suffered an accident. Rebbis Mana and Yudan went to him. There was good wine, they drank a lot and laughed. The next day they wanted to visit him again. He said to them: Rabbis, is that what a man does to his friend? Yesterday, the only thing that was missing for us was that we would get up and dance!
It is stated: One removes himself four cubits from excrement and urine of a toddler who can eat grain the volume of an olive, but if he cannot yet eat grain the volume of an olive one does not need to remove himself four cubits either from his excrement or from his urine. They asked before Rebbi Abbahu: Why does one separate himself from his excrement and urine? He said to them, because his thoughts are evil. They said to him: But is not he too young? He said to them, is it not written (Gen. 8:21): “For the inclination of man’s heart is evil from his youth?” Rebbi Yudan said, it is written “from his awakening”, from the moment that the awakes and enters the world.
When is Neïlah? The rabbis of Caesarea say: Rav and Rebbi Yoḥanan disagree. Rav said, when the gates of Heaven are locked. And Rebbi Yoḥanan said, when the gates of the Temple are locked. Rebbi Yudan Antordaya said: A Mishnah supports Rebbi Yoḥanan (Taäniot 4:1): “On three occasions do the Cohanim lift their hands four times in one day, mornings, Musaph, Minḥah, and at the locking of the gates: on fastdays, at support services, and on Yom Kippur. May you say that the gates of heaven are locked while it is still daytime?
What does one read? Rebbi Yose said, one reads blessings and curses. Rebbi Mana said to him: For example to tell them about the fast day? They are lying on their bellies and should not know that it is a fast day? He said to him: To tell you that one reads blessings and curses. Rebbi Yudan the Kappadokian said before Rebbi Yose in the name of Rebbi Yehudah ben Pazi: One reads about the New Moon. Rebbi Yose met Rebbi Yehudah ben Pazi. He asked him: Did you hear that from your father? He said to him: My father did not say so, except that at Eyn Ṭab, since they know for sure that it is the New Moon, they read about the New Moon. Hence, at all other places one reads blessings and curses.
Rebbi Ḥiyya bar Abba prayed: May it please You, o Eternal, our God and God of our fathers, that You may put into our hearts to do complete repentance before You so that we should not be ashamed before our forefathers in the World to Come. Rebbi Yudan ben Rebbi Ismael made it permanent that his Amora should say this after his explanations.
The seven of Sabbath, from where? Rebbi Isaac said, corresponding to the seven “voices” written in (Ps. 29) “Give to the Eternal, o sons of the mighty.” Rebbi Yudan Antoraya said, corresponding to the seven Divine Names in (Ps. 92) “Psalm, Song for the Sabbath Day.”
Rebbi Yose from Sidon in the name of Rebbi Yoḥanan: Before one’s prayer one says (Ps. 51:17) “Master, open my lips that my mouth may proclaim Your praise.” After one’s prayer, one says (Ps. 19:15): “May the sayings of my mouth be agreeable and the thoughts of my heart, before You, my Rock and my Redeemer.” Rebbi Yudan used to say both of them before his prayer.
It is stated: “One should pray neither out of conversation, nor out of jokes, nor out of frivolities, nor out of idle occupations, but out of words of Torah. Similarly, one should not take leave from one’s friend either out of conversation, or out of jokes, or out of frivolities, or out of idle occupations, but out of words of Torah, since we find that the earlier prophets were closing their words with expressions of praise and consolation.” Rebbi Eleazar said, except for Jeremiah who closed with words of reprobation. Rebbi Yoḥanan said to him, still he closed with words of consolation and said (Jer. 51:64) “So Babylon shall sink.” Because Jeremiah continued to prophesy about the Temple. One could think that he closed with the destruction of the Temple, but the verse states (Jer. 51:64) “So far the words of Jeremiah,” he finished with the downfall of its destroyers, he did not close with words of reprobation. But is it not written (Is. 66:24): “They will be a horror for all flesh?” That verse deals with Gentiles. But is it not written (Lament. 5:22): “But You much despised us”? (Lament. 5:21) “Make us return” replaces “But You much despised us”. Also Elijah did take leave from Elisha only out of words of Torah, (2Kings 2:11) “they walked talking.” What did they talk of? Rebbi Aḥawa the son of Rebbi Zeïra said, they discussed the recitation of Shema‘, (Deut. 6:7) “you should talk about them.” Rebbi Judah ben Pazi said, they were discussing Creation, (Ps. 33:6) “through the word of the Eternal the heavens were made.” Rebbi Yudan, the son of Rebbi Ayvu, said, they were occupied with the consolations of Jerusalem, as you say (Is. 40:2) “Speak to Jerusalem’s heart.” But the rabbis say, they were occupied with the Divine Chariot, as you say (2Kings 2:11) “behold, a chariot of fire and horses of fire, etc.”
Rebbi Simeon ben Laqish was thinking very hard about Torah. He overstepped the Sabbath boundary without noticing it, to confirm (Prov. 5:19): “In its love you will always err.” Rebbi Yudan ben Rebbi Ismael was thinking very hard about Torah. His toga slipped off from him and he did not notice it, to confirm: “In its love you will always err.” Rebbi Eleazar ben Rebbi Simeon was thinking very hard about Torah. His toga slipped off from him but a viper was caring for it. His students told him: Teacher, your toga has slipped off. He said to them, does this evil one not care for it?
“And Havdalah in “He Who in His grace grants knowledge”, the words of the Sages. Rebbi Aqibah said: one says it as separate fourth benediction” Rebbi Jacob bar Aḥa in the name of Samuel: He says it as fourth benediction. Rebbi Yudan says, the text of the benediction and after that he says Havdalah. His version agrees with Rebbi, since Rebbi said: I wonder why they eliminated “He Who in His grace grants knowledge” on Sabbath; if there is no knowledge, where is prayer? And here, if there is no knowledge, where is Havdalah? Rebbi Isaac ben Eleazar said, he says Havdalah and afterwards adds the text of the benediction.
Rebbi Zeriqan said: Rebbi Zeïra asked: He who took a lupine and was reciting the benediction over it when it fell from his hand, does he have to recite a second benediction? What is the difference between that and a water canal? They said, there he intended it from the start, but here he did not intend it from the start. Rebbi Ḥiyya stated: One recites the benediction on bread only when one breaks it. Rebbi Ḥiyya bar Abba said: This means that he who took a loaf and pronounced the benediction on it before it came to his hand, must recite a second benediction. Rebbi Tanḥum bar Yudan said, he must say “Praised be the Name of the Glory of His kingdom forever and ever,” in order not to utter the Name of Heaven in vain.
What is the difference between mugmar and wine? Everybody smells mugmar, each person tastes wine. Rebbi Zeïra in the name of Rav Jeremiah: One has to recite the benediction for mugmar as soon as the smoke rises. Rav Jeremiah wanted to examine Rebbi Zeïra. He said to him, which benediction does one recite on perfumed oil? He said, “He Who gave pleasant fragrance in perfumed oil.” He said to him, “He Who gave pleasant fragrance in spice wood.” Isaac bar Abba from Meḥasiah and Rav Ḥananel were sitting. One said, “Praise to Him Who gave pleasant fragrance in spice wood.” The other one said, “Praise to Him Who gave pleasant fragrance in the plants of the earth.” He who said “in the plants of the earth” objected to him who said “in spice wood”: are they wood? He answered him, is it not written (Jos. 2:6) “She hid them in the hemp of wood”, are these wood? They went to the Yeshivah of Rav and heard Rav Huna in the name of Rav: “He Who gave pleasant fragrance in spice wood.” Ganiva said, he who uses oil for dirt does not have to recite a benediction. Rebbi Yudan said, even if he collects it into his hand. Rebbi Ḥelbo, Rav Huna in the name of Rav: He who sprinkles olentia in his house does not have to recite a benediction. Rav Ḥisda said, on everything he recites “He Who gave pleasant fragrance in spice wood” except for musk on which he recites “He who gave pleasant fragrance in all kinds of spices.”
Rebbi Tanḥum bar Yudan said: The honor of the day takes precedence over the honor of the night. The Qiddush of the night takes precedence over the Qiddush of the day. What is the honor of the day? Rebbi Yosi in the name of Rebbi Jacob bar Aḥa, and Rebbi Eleazar bar Joseph in the name of Rav: “He Who created the fruit of the vine.”
They came back and asked him: What is that which is written (Jos. 24:19): “For He is a holy God.” He answered them, it is not written: “they”, but “He,” “He is a jealous God.” His students told him: Teacher, these you pushed away with a stick, what can you answer us? Rebbi Isaac said, He is holy in all kinds of holiness, as Rebbi Yudan said in the name of Rebbi Aḥa: The Holy One, praise to Him, is holy in all kinds of holiness. His speech is in holiness, His throning is in holiness, the baring of His arm is in holiness, God is awesome and majestic in holiness. His way is in holiness, (Ps. 77:14) “God, Your way is in holiness.” His walking is in holiness, (Ps. 68:25) “the course of my God, my King, in holiness.” His throning is in holiness, (Ps. 47:9) “God throned on His holy throne.” His speech is in holiness, (Ps. 60:8) “God spoke [in His holiness].” The baring of His arm is in holiness, (Is. 52:10) “The Eternal bared His holy arm.” He is awesome and glorious in holiness, (Ex. 15:11) “Who is like You, glorious in holiness!”
Rebbi Yudan in the name of Rebbi Isaac said it in four versions. Flesh and blood has a protector. When they tell him, your client was arrested, he will say: I will protect him. When they tell him, he is going before a court, he will say: I will protect him. When they tell him, he is taken to be hanged, where is he and where is his protector? But the Holy One, praise to Him, saved Moses from the sword of Pharao; that is what is written (Ex. 18:4): “He saved me from the sword of Pharao.” Rebbi Yannai said, it is written (Ex. 2:15): “Moses fled from before Pharao.” Is it possible for flesh and blood to flee from the government? But at the moment when Pharao arrested Moses, he sentenced him to have him beheaded. The sword slipped off the neck of Moses and broke. That is what is written (Songs 7:5): “Your neck is like the ivory tower,” that is Moses’s neck. Rebbi said, Rebbi Eviathar: Not only that, but He moved the sword from the neck of Moses on the neck of the executioner and killed him. That is what is written: “He saved me from the sword of Pharao.” He saved me, but killed the executioner. Rebbi Berekhiah quoted on this (Prov. 21:18) “The evil one is ransom for the just one.” Rebbi Abun quoted on this (Prov. 11:8): “The just will be extricated from distress, the evil one will take his place.” Bar Qappara stated: An angel came down and appeared to them in the shape of Moses. They arrested the angel and Moses fled. Rebbi Joshua ben Levi said: when Moses fled from before Pharao, all his troops became dumb, deaf, or blind. He asked the dumb, where is Moses? But they could not speak. He asked the deaf, they could not hear. He asked the blind, they could not see. That is what the Holy One, praise to Him, said to Moses (Ex. 4:11): “Who gave man a mouth, or who makes dumb?” There it upheld you and here you do not want to uphold. That is what is written (Deut. 4:8): “Who is like the Eternal, our ĕlōhīm, always when we call on Him!”
Rebbi Yudan in the name of Rebbi Isaac said in another version: Flesh and blood has a protector. When they tell him, your client was arrested, he will say: I will protect him. When they tell him, he is going before a court, he will say: I will protect him. When they tell him, he is being thrown into the water, where is he and where is his protector? But the Holy One, praise to Him, saved Jonah from inside the fish, since it says (Jonah 2:11): “The Eternal commanded the fish and it threw Jonah up.”
Rebbi Yudan in the name of Rebbi Isaac in another version. Flesh and blood has a protector. When they tell him, your client was arrested, he will say: I will protect him. When they tell him, he is going before a court, he will say: I will protect him. When they tell him, he is being thrown into fire, where is he and where is his protector? But the Holy One, praise to Him, saved Ḥananiah, Mishael, and Azariah from the fiery oven; this is what is written (Dan. 3:14): “Nebucadnezzar declared and said, praised be the God of Shadrakh, Meshakh, and Abed Nego, etc.”
Rebbi Yudan in the name of Rebbi Isaac said in another version: Flesh and blood has a protector, etc. until: he is being thrown to the wild beasts. But the Holy One, praise to Him, saved Daniel from the lions’ den. That is what is written (Dan. 6:23): “My God sent his angel who closed the mouth of the lions, etc.”
Rebbi Ḥuna said, in three places did the wind come out without measure and desired to destroy the entire world; once in the time of Jonah, once in the time of Elijah, and once in the time of Job. In the time of Jonah (Jonah 1:4): “The Eternal sent a strong wind.” In the time of Job (Job 1:19): “A great wind came across the desert.” In the time of Elijah, from where? (1K. 19: 19:11) “Lo, the Eternal passes, and a great, strong wind, shattering mountains.” Rebbi Yudan ben Shalom said, let us say that the one of Job was for him only, that of Jonah was for him only. You have only that of Elijah which was worldwide “Lo, the Eternal passes, etc. After that an earthquake and after the earthquake fire, but the Eternal was not in the fire.”
Rav Yehudah bar Ezechiel said, my father used to recite for rainfall: May Your Name be magnified, sanctified, praised, and elevated, our King, for every drop that You bring down to us, and you make them refrain one from the other. (Job 36:27) “For He reduces water drippings;” as one says (Lev. 27:18): “Your value will be reduced.” Rebbi Yudan said, not only that, but He brings them down in measure, as it is said (Job 28:25): “Water He determined by measure.” Rebbi Yose bar Jacob went to visit Rebbi Yudan from Migdal. While he was there, rain started to come down and he heard his (R. Yudan’s) voice saying: Thousands of thousands and myriads of myriads we are obliged to thank Your Name, our King, for every drop that You bring down to us, for You do good things for the guilty ones. He said to him: From where do you have this? He said to him: This is the benediction that Rebbi Simon recited for rainfall.

He said to him: From where do you have this? He said to him: This is the benediction that Rebbi Simon recited for rainfall.

But the sages say (Ps. 116:13): “I lift the cup of salvation, I call on the Name of the Eternal, trouble and sorrow I will find, but on the Name of the Eternal I shall call.” Whatever may happen to me, I shall call on the Name of the Eternal. Rebbi Yudan bar Pelaya said: This is what Job said (Job 1:21): “The Eternal gave, and the Eternal took, may the Name of the Eternal be praised!” When He gave, He gave in mercy; when He took, He took in mercy. In addition, when He gave, He did not consult anybody, but when He took, He consulted His Court. Rebbi Eleazar said, everwhere it says “and the Eternal” it means Him and His Court. The paradigm of this is (1K. 22:23): “And the Eternal spoke woe over you.”
The words of Rebbi Ḥiyya bar Abba disagree, for Rebbi Ḥiyya bar Abba said that Rebbi Yudan, son of Rebbi Simeon bar Ioḥai’s daughter, stated that Rebbi Simeon bar Ioḥai stated: Honoring father and mother is great because the Holy One, praise to Him, preferred it over His own honor. It is said (Ex. 20:12): “Honor your father and your mother,” and it is said (Prov. 3:9): “Honor the Eternal with your property.” When do you start to honor Him? When He was gracious to you! One gives gleanings, forgotten sheaves, and peah, one gives terumah, the First and Second Tithes and the tithe for the poor, ḥallah, one makes a sukkah, lulav, and shofar, tefillin and ẓiẓit, one feeds the poor and hungry and gives to drink to the thirsty. If you have the wherewhithal, you are obliged for all of these; if you have nothing, you are not obliged even for one of them. But when it comes to honoring father and mother, whether you own property or you do not own property, you must honor father and mother, even if you are a beggar at people’s doors.
HALAKHAH: “One may give peah from the head of the field and from its middle.” Rebbi Yose in the name of Rebbi Simeon bar Laqish: (Lev. 19:9) “And at your harvesting,” why does the verse have to say “to harvest”? Even if he has still more to harvest. Rebbi Jonah in the name of Rebbi Simeon bar Laqish: (Lev. 19:9) “And at your harvesting,” why does the verse have to say “to harvest”? One for the beginning and one for the end. Rebbi Yose in the name of Rebbi Joshua ben Levi: (Lev. 19:9) “And at your harvesting,” why does the verse have to say “to harvest”? One for sacred property and one for private persons. Rebbi Yudan asked, do not coins redeem sacred property only when it is cut; maybe when it is standing? Rebbi Ḥaninah said, you should not say that harvest of sacred property should be treated like harvest of a private person.
It was stated: One may sow vegetable seeds and tree seeds together. But he who sows with grape kernels is whipped 40 times. Rebbi Zeïra said, it is written (Deut. 22:9): “Do not sow your vineyard with two kinds;” the main produce of your vineyard you should not sow with two kinds. Rebbi Yudan from Kappadokia asked before Rebbi Yose: There they say that tree seeds are called seeds but here you say that tree seeds are not called seeds. He said to him: There the verse excluded them since usually people do not call them “seeds,” but here the verse added (Lev. 11:37) “any sown seed that may be sown.”
A butcher who is a Cohen. The colleagues in the name of Rebbi Joshua ben Levi: One frees him for one week. Rebbi Yose said, I went to the South and I heard Rebbi Hanan, the father of Rebbi Simeon in the name of Rebbi (Simeon) [Joshua] ben Levi: One frees him for one week. Rebbi Yudan compares it to the statement of Rebbi Joḥanan, they fined them. Rebbi Yose said to him, if it is because of a fine, even one week should not be free for him. A grocer who is a Cohen, Rebbi Yudan said, one frees him for one week. Rebbi Yose said, one does not free him for one week. According to Rebbi Yose, what is the difference between the grocer and the butcher? The grocer may cheat, the butcher cannot cheat.
Rebbi Joḥanan and Rebbi Yudan bar Rebbi Simeon. One said that if you kept what is oral tradition and kept what is written I will conclude a covenant with you, otherwise I shall not conclude a covenant with you. The other one said, if you watched all that is oral tradition and kept all that is written you will receive your reward, otherwise you will not receive any reward.
It was stated: (Lev. 19:9) “The gathering of your harvest,” not the gathering of your plucking. Rebbi Zeïra, Rebbi Ḥiyya in the name of Rebbi Joḥanan: He who collects ears for his dough in any quantity is free from peah. Rebbi Eleazar says, even with a sickle. Rebbi Yose said, only if he left some standing. Did we not state (Tosephta Peah 1:10): “If he had five vines and he harvested them and brought them into his house, he is free from fallen berries, from orlah, from the fourth year, but he is obligated for gleanings. Rebbi Yudan said, one for those which are fully ripe, one for those which are not fully ripe. Rebbi Yose said, you may even say that both deal with the case that they are fully ripe, or both deal with the case that they are not fully ripe. There if he wanted to eat them as grapes, here if he wanted to make them into wine, he may do so. This is informed from that and that is informed from this. This is informed from that, if he wants to eat them as rubbed ears [he may do so] even if he did not leave a remainder. That is informed from this, if he wants to drink them as wine [he may do so] only if he left a remainder.
“Rebbi Simeon forbids for heave of the tithe and permits for ḥallah.” Then Rebbi Jehudah forbids for ḥallah. Does it not become ṭevel at his place? But perhaps he borrows impure sour dough to make his bread-dough. Even so, does it not become ṭevel at his place? But perhaps he borrows an impure loaf to fill up his oven. If he borrows an impure loaf to fill up his oven, must he then not tithe every single loaf? That is for Rebbi Joḥanan, since Rebbi Joḥanan said, there if he works in purity, here if he works in impurity. But for Rebbi Eleazar, who says that in both cases if he works in purity? Rebbi Yudan, the father of Rebbi Mattaniah said, we refer to one who works in impurity and it becomes ṭevel at his place, and Rebbi Jehudah also agrees. We have stated accordingly: “Rebbi Jehudah and Rebbi Simeon forbid for heave of the tithe and permit for ḥallah.” Hence, Rebbi Jehudah forbids for heave of the tithe and permits for ḥallah; Rebbi Simeon forbids for heave of the tithe and permits for ḥallah. What is the difference between them? In the opinion of Rebbi Jehudah, one may not separate from today’s for yesterday’s or from yesterday’s for today’s, but one may separate from one oven batch on another oven batch. In the opinion of Rebbi Simeon, even from one oven batch on another one may not separate.
“ If a Cohen sold a field to an Israel on condition that the tithes should be his, the tithes are his. If he dies, his sons have no right to the tithes. ‘For me and my sons, for me and my heirs,’ his sons have the tithes, his heirs have the tithes.” Rebbi Yudan bar Shalom asked before Rebbi Yose: So far only for heirs whose claim is from the Torah? Even for heirs whose claim is not from the Torah!
There, we have stated: “If a peruṭah of Temple property fell into somebody’s wallet, or if somebody said, a peruṭah in this wallet shall be Temple property,” it was stated that “with the first coin he committed probable larceny, with the second one certain larceny, the words of Rebbi Aqiba. But the Sages say, with any of them he committed probable larceny, except that with the last one he committed certain larceny.” Rebbi Yudan, the father of Rebbi Mattania said, that is, if there were ten coins. But if there were only two, with the first coin he committed probable larceny, with the second one certain larceny. Rebbi Simeon ben Laqish asked before Rebbi Joḥanan: What is the difference between him who says “in the wallet” and him who says “from the wallet?” Rebbi Simeon ben Laqish said, even if he spent the entire wallet he would not have committed larceny; just as you say ‘that he drank ṭevel retroactively,’ here also ‘retroactively he spent profane money.’ But here it depends on the act of separation. Rebbi Jonah said, in both cases it depends on the act of separation; it is as if he said, this wallet should not be freed from a peruṭah of Temple property. Rebbi Simeon ben Laqish’s argument is inverted. There, he says that one commits larceny with a peruṭah corresponding to the computation of three log. And here, he says so? After he asked, he returned and gave the simple answer.
HALAKHAH: Rebbi Yudan bar Menasheh said: The opinion of the Sages is that one takes a small piece from the pericarp of a green melon and plants it and it grows to a water melon. One takes a small piece from the pericarp of a water melon and plants it and it grows to a sweet melon. Rebbi Jehudah says, it in itself is kilaim. One takes a small piece from the pericarp of a water melon and a small piece from the pericarp of an apple and puts them into one cavity where they unite and become kilaim. Therefore it is called “apple melon” in the Greek language.
It was stated in the name of Rebbi Eleazar: “The Gentile may sow and wear kilaim, but he may not mate his animals as kilaim or graft his tree kilaim.” Why? Because about these, it is written “by their kinds.” But is it not also written for grasses “by their kinds?” It is not written for the commandment, only at the realization. If this is so, why was Earth cursed? Rebbi Judan bar Shalom said, because it transgressed the orders of the Holy One, praise to Him! (Gen. 1:11) “The earth should produce lawns, grasses producing seed,” but it produced only (Gen. 1:12) “lawns, grasses producing seed by their kinds.” Rebbi Phineas said, it enjoyed the commandment and added shade trees. In the opinion of Rebbi Yudan bar Shalom, Earth was justly cursed. In the opinion of Rebbi Phineas, why was Earth cursed? Like a man who said: The breastnipples should be cursed that this one suckled from. This follows Rebbi Nathan: Three stood in judgment and four went out cursed, (Gen. 3:17) “Earth is cursed because of you.”
It was stated: “One does not graft olives on the stem of a date palm because that would be tree on tree.” Rebbi Yudan asked, does that not disagree with Rebbi Levi? “(Ps. 128:3) ‘Your wife be like a fruitful vine on the sides of your house, your sons like saplings of olive trees around your table.’ Just as olive trees are not subject to grafting, thus in your sons shall not be found any flaws.” But here it follows that there are flaws in them. There is a difference here, because in the end it will sweeten its fruit. Similar to that, Rebbi Simeon, the son of Rebbi, used to water his peach tree with cooked wine in order to sweeten its fruit.
HALAKHAH: Rebbi Zeïra, Rebbi Eleazar, in the name of Rebbi Ḥiyya the Elder: He makes it two by two cubits, but decreases continuously to an arbitrarily small distance. Rebbi Jonah said, that is, if it is subdivided into garden beds, but if all is one bed, it does not apply. This parallels what Rebbi Yannai said: I may sow my field with fifty kinds, twenty-five here and twenty-five there; this is in two rows. If that is so, would it be permitted even between himself and his neighbor? Or in a dry spot? Then it parallels what Rebbi Simeon ben Laqish said in the name of Ḥizqiah: A vertex from a dry spot is permitted! Rebbi said, he starts with an area of bet rova‘ and narrows it down to three furrows of the ploughshare. Does Rebbi not accept that between grains one needs a bet rova‘? That is for a square field, here for a garden bed. Do the rabbis not recognize garden beds? Rebbi Yudan said, the minimal distance for Rebbi is the maximal distance for the rabbis.
There, we have stated: “All tied-up water skins are pure except those of Arabs. Rebbi Meïr says, temporarily tied ones are pure, permanently tied ones are impure. Rebbi Yose says, all tied ones are pure.” Some Tannaïm state it inverted. Rebbi Jacob bar Aḥa in the name of Rebbi Yasa: Like our Mishnah. Rebbi Yudan said, the indicator of Kelim is Kilaim, for if it were not so, what would be the difference between permanent and temporary tie? In the House of Rebbi Yannai they said: A permanent tie must be cut, a temporary tie does not have to be cut.
“How long are they called saplings, etc.” What means “until they become profane”? Until they are redeemed or until they become profane by themselves. Rebbi Abba bar Jacob in the name of Rebbi Joḥanan: The Mishnah means “until they become profane by themselves.” Rebbi Yudan said, a baraita supports Rebbi Joshua: “ Rebbi says, when they said five, six, or seven years old, for vines five years old, for figs six years old, for olives seven years old.” But do we not see the growth of the fig tree come with fruits? Rebbi Yudan said, according to Rebbi we throw it on its width.
It was stated: “Rebbi Yose ben Kippar said in the name of Rebbi Eleazar ben Shammua‘ that the House of Shammai say, one waters the leaves and it trickles down to the root, but the House of Hillel say, one waters both on the leaves and on the root.” In the House of Rebbi Yannai one watered with a basket. Rebbi Yaakov bar Zavdi said: Rebbi Isaac ben Tevele watered with a basket. Rebbi Ḥiyya bar Abba: Rebbi Yudan bar Guria watered with a basket and hoed. Did he intend to work the land? In the days of Rebbi Ḥiyya bar Abba they watered date palms with new brooms and dried branches
There, they say: A tree which buds before the New Year’s Day of the World is tithed for the past; after the New Year’s Day of the World it is tithed for the future. Rebbi Yudan bar Pedaiah objected before Rebbi Jonah: But carob trees form buds before New Year’s Day and are tithed for the future! He had not heard what Rebbi Ḥinena bar Pappos said, for carob trees the forming of clusters is [counted as] their forming buds.
Rebbi Ḥuna went to Tyre and forbade them a kind of irrigation. Rebbi Yose heard this and said, this is correct, is this not about [plants] connected to the ground? But did we not state (Mishnah Mo‘ed Qaṭan 1:1): “One irrigates a field in intensive agriculture both during the intermediate days of a holiday and during the Sabbatical year?” Rebbi Yudan said, only for the vegetables there. Rebbi Mana said, then it should also be permitted to plough for them!
If somebody established a lien for another person on his field and then went and sold it; Rebbi Aḥa said, it is temporarily sold. Rebbi Yose said, even temporarily it is not sold. The strength of Rebbi Yose is from the following: He may induce his ox to flee; he cannot induce his field to flee. Think about it, if [the field] was sold to a violent person! Rebbi Yudan, the father of Rebbi Mattaniah, said: Violent persons are apt to fall.
Rebbi Yudan said, there, if he said I did such and such, here, if he says do such and such. Rebbi Benjamin ben Levi inquired: If he has understanding for the past, he should have understanding for the future; ifhe has no understanding for the past, he would not have understanding for the future! Rebbi Eudaimon said, here we deal with a mute; there is no agency for a mute. Rebbi Yose ben Rebbi Abun said, we deal with a sane person. Why is there no divorce? Because I say, he was occupied with his documents. We also stated so: “When was this said? When he explained it in his regular state. But if he was paralyzed by sickness, once is enough.”
Rebbi Aḥa, Rebbi Ḥinena in the name of Rav Cahana: Following the opinion that someone who cannot give heave cannot dedicate to the Temple. Why did he not say: following the opinion that he can give heave, he can dedicate to the Temple? Because of Rebbi Jehudah, for Rebbi Jehudah says he can give heave but cannot dedicate. But Rebbi Joḥanan says, even following the opinion that he cannot give heave, he can dedicate. What can he dedicate? Holocaust and well-being offerings. He cannot bring a sin sacrifice for fat because he is not obligated to a sin sacrifice for fat. He cannot bring a sin sacrifice for blood because he is not obligated to a sin sacrifice for blood. May he bring a sacrifice relating to gonorrhea and skin disease? Since it is obligatory can’t he bring it, or since he becomes impure by these can he bring it? If it is obvious for you that he brings, can he become an agent for these? Since he may become impure by these, may he become an agent, or since he cannot become an agent for anything else, can’t he become an agent for these? Rebbi Yudan objected: His produce is ṭevel from the Torah but he cannot free his ṭevel by Torah law! So here, even though he may become impure by them, he cannot become an agent. May he bring First Fruits following Rebbi Jehudah who says thatFirst Fruits have the status of territorial consecrated things? He may not bring following the rabbis who say they have the status of things consecrated to the Temple. May he bring a sacrifice of pilgrimage? Since it is obligatory can’t he bring it, or since he may change its name to well-being offering, may he bring it? May he bring a Passover sacrifice? Since it is obligatory can’t he bring it, or since Rebbi Simeon ben Laqish said in the name of Rebbi Yudan the Prince, a person may bring a Passover sacrifice any day of the year when he changes its name to well-being offering, may he bring it? May he bring tithes of animals? If Rebbi Meїr is of the opinion (Num. 18:28): “From all your tithes,” that all tithes were bracketed together, then since he cannot bring tithes of grain he cannot bring tithes of animals. May he make substitutions? If Rebbi Meїr is of the opinion that all tithes were bracketed together, then since he cannot bring tithes of grain he cannot bring tithes of animals; since he cannot bring tithes of animals he cannot make substitutions. One may hold with Rebbi Simeon, since Rebbi Simeon says that tithes of animals teach you for all sacrifices about substitutions. That means, since he cannot bring tithes of grain he cannot bring tithes of animals; since he cannot bring tithes of animals he cannot make substitutions; since he cannot make substitutions for these he cannot make substitutions for any sacrifices. Is one guilty sacrificing for him outside the Temple? Cahana said, one cannot be guilty sacrificing for him outside the Temple. Rebbi Joḥanan and Rebbi Simeon ben Laqish say, one is guilty. The statement of Cahana disagrees since Rebbi Jehudah frees his ṭevel as biblical law. We can say he [Cahana] is following him who says they accepted tithes voluntarily.
The statement of Cahana disagrees since Rebbi Jehudah frees his ṭevel as biblical law. We can say he [Cahana] is following him who says they accepted tithes voluntarily.
HALAKHAH: “If somebody separates parts of heave or tithes,” etc. Our Mishnah [is said] in case he separated and it is his intention to separate more. Rebbi Samuel in the name of Rebbi Zeїra, our Mishnah [is said] if he did not say anything. Rebbi Mana said before Rebbi Yudan: Do they disagree? He said to him, if he did not say anything, it is as if it were his intention to separate more.
There, we have stated: “One makes a fire with bread and oil of heave.” Ḥizqiah said, they taught only bread and oil, therefore nothing else. Rebbi Joḥanan said, there is no difference between bread, oil, and any other thing. Rebbi Yudan from Kappadokia asked, are wheat grains like bread and olives like oil? Rebbi Samuel bar Naḥman said in the name of Rebbi Joḥanan, may the bones of him who uses bread and oil of heave to make a fire be burned. Rebbi Samuel bar Naḥman asked before Rebbi Joḥanan: May one make a fire? He said to him, make a fire! Anything given to your tribe was given to you, as Rebbi Abba bar Ḥiyya said in the name of Rebbi Joḥanan (Num. 18:8): “For excellence”. For excellence for greatness, for excellence for rubbing in, for excellence for lighting.
HALAKHAH: Rebbi Yudan bar Pazi and Rebbi Ayvo bar Naggari were sitting and saying: We did state “after they conceded”; who conceded to whom? The House of Shammai to the House of Hillel or the House of Hillel to the House of Shammai? They said, let us go out and study. The went out and heard Rebbi Ḥizqiah, Rebbi Aḥa in the name of Rebbi Jehudah bar Ḥanina: We never find the House of Shammai conceding to the House of Hillel except in this matter. Rebbi Jonah in the name of Rebbi Abbai understood it from the following: “If someone pours from vessel to vessel and a ṭevul yom touches it, it should be lifted by 101.” If you say that the House of Hillel conceded to the House of Shammai that it cannot be lifted, who is the Tanna here, neither the House of Shammai nor the House of Hillel! Rebbi Ḥanina the son of Rebbi Hillel said, we might say that the House of Hillel stated that before they conceded. Rebbi Yose said, the Mishnah said so: “After they conceded, Rebbi Eliezer said it should be lifted and burned”, and is Rebbi Eliezer not a follower of Shammai? Rebbi Ḥinena said, the Mishnah said so, after they conceded one to another, the House of Shammai recused themselves and the others teach us. Rebbi Abin says, there is another answer, following what Rebbi Hoshaia stated: Since pure [heave], which for outsiders is forbidden as deadly sin, can be lifted, certainly also impure [heave] which is [prohibited] as positive commandment for Cohanim.
Rebbi Ḥinena said before Rebbi Mana: If Rebbi Simeon ben Laqish thought the entire Mishnaiot were Rebbi Meïr’s, he would call them “the words of Meïr.” But is it not written (Lev. 22:14): “If a person ate consecrated food in error, etc.”? But Rebbi Simeon ben Laqish must hold that the fifth is a sacrifice. But even if he holds that the fifth is a sacrifice, can the principal be a sacrifice? Rebbi Yudan bar Shalom said, the Mishnah declares that the principal is a fine, as we have stated: “He does not pay in heave but in totally profane food which is turned into heave.” If he had to pay from what he ate, it would be fine. And it was stated: “If he ate impure heave, he has to pay in pure profane food, but if he paid in impure profane, he discharged his obligation.” Does he not owe him the price of wood? That shows that the principal is a fine and since the principal is a fine, the fifth also is a fine. But Rebbi Simeon ben Laqish follows his own opinion. Just as Rebbi Simeon ben Laqish said, there, everybody was under the obligation of (Ex. 20:16) “Do not become a false witness against your neighbor”, but this one was treated separately, (Deut. 19:19) “do to him what he intended to do to his brother”, to force him to pay; also here, everybody was under the obligation of (Lev. 22:10) “no outsider shall eat holy [food],” but this one was treated separately, (Lev. 22:14) “if somebody should eat holy [food] in error,” to force him to pay.
Rebbi Yudan, the son of Rebbi Yose ben Ḥanina’s sister, in the name of Rebbi Yose ben Ḥanina: Less than that he puts in his fire. Rebbi Yannai in the name of Rebbi Jehudah: “Solid food corresponding to a cooked easy egg. That means that the volume of an egg is valid in impurity, but pure the minutest amount must be delivered. If it is demay; but if it is certain it must be delivered impure or pure, much or little.”
“Grain when it is in smooth piles.” Rebbi Ḥanania in the name of Rebbi Joḥanan: When he straightens his heap. But did not Rebbi Jacob ben Sisin state: “When does he start to give heave from his threshing floor? When he removes the pitchfork.” Here, when he intends to smoothe, there if he did not intend to smoothe. It was stated: “He sifts part and gives heave from the sifted part for what is not sifted.” Rebbi Ila said, for this is the way of householders to bring it into their houses. What is the reason? (Is. 30:24) “The bulls and young donkeys which work the soil will eat sour mix.” If he sifted [grain] dedicated to the Temple and then redeemed it; since he was able to eat from it as a snack and now he cannot eat, it is as if he did it with the permission of the Temple and he is obligated. Rebbi Ḥinena objected: Did we not state, “if he took out and cleaned what was dedicated to the Temple, he is free?” Rebbi Yudan said, there it is not impossible for him not to preserve or not to cook a long time. But here it is impossible for him not to smooth it, as Rebbi Ila said, the bulls and young donkeys, etc.
The colleagues in the name of Rebbi Joḥanan: So did Rebbi Jehudah disprove Rebbi Meїr[’s argument]: Do you not concede to me that one who gives to his son is free? What is the difference between gathering and giving to his son or gathering and giving to another person? Rebbi Yudan asked: What did you see to say ‘if he gathers and delivers,’ can we not say ‘if he gathers and eats’? Rebbi Mana said, there cannot be “if he gathers and eats”, only “if he gathers and delivers,” because of that rose garden. Can you say the rose garden [is a case of] gathering and eating? No, gathering and delivering! There also, he gathers and delivers because he would say to him, if you enter you will damage its roses! A baraita disagrees with Rebbi Mana’s argument: “ ‘I am selling you the vineyard’, this is a valid sale even if there are no vines since he sells him [the real estate] by description. ‘I am selling you the orchard’, this is a valid sale even if there are no trees since he sells him [the real estate] by description.’ ”
If he pickled or cooked without the owners’ knowledge, there is a difference between Rebbi Joḥanan and Rebbi Simeon ben Laqish since these differ: If somebody made a heap [of somebody’s grain] without the latter’s knowledge, Rebbi Joḥanan said, it is ṭevel, Rebbi Simeon ben Laqish said, it is not ṭevel. Rebbi Yudan said, there it is impossible for him not to make a heap, here it is possible for him not to pickle.
Who is the Tanna of “one does not sell it”? Rebbi Meїr! But for Rebbi Jehudah it should be logical that it be permitted to be sold, by an argument a minore ad majus: If it is permitted to sell heave which is forbidden to lay people, since Second Tithe is permitted to lay people, one should certainly be permitted to sell it. No, if you assert this for heave which does not need an enclosure, what can you imply for Second Tithe which needs an enclosure? First Fruits shall prove it which need an enclosure and one may sell them! No, if you assert this for First Fruits which do not implicate their monetary substitute, what can you imply for Second Heave which implicates its monetary substitute! The Sabbatical shall prove it which implicates its monetary substitute and it is permitted to sell it! Rebbi Yudan said, from this? The sale of Sabbatical produce is its redemption.
Rebbi Jeremiah said, who is the Tanna of “one does not sell it”? Rebbi Meїr! But for Rebbi Jehudah it should be logical that it be permitted to be sold, by an argument a minore ad majus: If it is permitted to sell Sabbatical produce with which one may not liquidate one’s debts, it is logical that it should be permitted to sell Second Tithe since with it one may liquidate one’s debts. We find that one may liquidate one’s debts with Second Tithe, following what we stated: “If he took from him tithe worth one tetradrachma and did not come to exchange it until it was worth two.” Rebbi Yose said, there is a difference since from the start the value of Second Tithe was due. If he had owed before, it would be an argument. Rebbi Yudan said, a Mishnah said that it is forbidden to sell it, as we stated there: “If intentional, he married, if in error, he did not marry.” If you say that he may sell it, he should be able to use it for marriage but anything he may not sell he may not use for marriage. But did we not state: “One does not buy slaves, real estate, and unclean animals from Sabbatical money. If he bought them, he has to eat their worth.” Rebbi Yose said, this means that it is forbidden to acquire a wife with Sabbatical money. Otherwise, what is the difference between one who acquires a wife and one who acquires a slave girl? Rebbi Yose in the name of Rebbi Zeïra, Rebbi Yudan in the name of Rebbi Ila, everybody agrees because of these arguments. Rebbi Yose in the name of Rebbi Aḥa, everybody agrees that all should need the enclosures.

Rebbi Yose in the name of Rebbi Aḥa, everybody agrees that all should need the enclosures.
Rebbi Yudan asked: If somebody said to a woman, draw this animal tithe to you from me and be preliminarily married to me by it after slaughtering. Since it is in his hand to slaughter, is she immediately preliminarily married or only after slaughtering?
Rebbi Yose in the name of Samuel: The buy is acquired. Rebbi Yose ben Ḥanina: Expiation. Rebbi Hila said, since we stated “he has to eat their worth”, that means it was sanctified. Rebbi Yose said, since he took it up, the buy was acquired; from there on it is one buy. Rebbi Yudan said, he has to dedicate it again; he means that maybe it was sanctified when it was not sanctified.
Rebbi Yudan asked: Second tithe oil that became rancid? Rebbi Mana said, when it became rancid, its holiness burst from it. Why did he have to ask? Sabbatical [oil] even if rancid remains in its holiness.
Rebbi Joshua ben Levi says: One does add a fifth only for the first dedication. Rebbi Eleazar said, this is what has been stated (Lev. 27:27): “If it is an impure animal, he shall redeem it for its value;” just as an impure animal is special in that it is a first dedication so for anything which is a first dedication he has to add a fifth. Rebbi Samuel bar Ḥiyya bar Jehudah in the name of Rebbi Ḥanina: If well-being sacrificial animals bought with tithe money developed a blemish and one redeemed them, he adds a fifth. Rebbi Samuel bar Ḥiyya bar Jehudah in the name of Rebbi Ḥanina: If well-being sacrificial animals bought with Passover money developed a blemish and one redeemed them, he adds a fifth. Rebbi Yudan said, one is needed and one is not needed. Rebbi Mana said, Passover is needed, well-being sacrifices are not needed. You should not say that since the Pesaḥ sacrifice is changed into well-being sacrifices it is like one dedication, he would not add a fifth.
Rebbi Naḥman bar Jacob showed a basket of palm leaves to a carpenter and redeemed following his opinion. Rebbi Yannai showed a quarter [qab] wheat to a wheat dealer and redeemed following his opinion. Rebbi Simon showed produce to Rebbi Ḥilqiah who asked him, by their true value? He answered, yes. Rebbi Ḥilqiah said in the name of Rebbi Simon, one does not redeem Second Tithe following the opinion of imbeciles. Rebbi Phineas showed produce to a grits-maker who asked him, by their true value? He said to him, so said Rebbi Ḥilqiah in the name of Rebbi Simon, one does not redeem following the opinion of imbeciles. Rebbi Shammai said, how much a person wants [to pay] on a clear noontime at the summer solstice when the bath master takes up his bunches, he brings coins and redeems. Rebbi Jeremiah said, as much as a person wants Friday afternoon from women braiders when he passes by, he brings coins and redeems. Rebbi Yudan bar Gadya said, Rebbi Jacob bar Abun left it lying until it got moldy and redeemed it immediately after the Sabbath.
How do we hold? If she is an adult, she acquired [her freedom] by the signs [of puberty]; if she is a minor, may a minor acquire? Rebbi Yudan bar Shalom said before Rebbi Yose, explain it following him who said, a minor may give heave. He said to him, even following him who said, a minor may give heave, may a minor acquire? Following the opinion of the rabbis there it is acceptable since there, they say in the name of Rav Naḥman bar Jacob: One to whom one gives a nut and he throws it away, a pebble and he keeps it, what is found in his hand is as if found on a garbage heap; a nut and he keeps it, a pebble and he throws it away, what is robbed from him is robbed because of communal peace; a nut or a pebble he takes, hides them, and produces them later, what is robbed from him is total robbery. He can acquire for himself but not for others. Rav Huna said, just as he can acquire for himself so he can acquire for others. Everybody agrees that his gift is not a gift since it is written (Ex. 22:6): “If a man give.” The gift of a man is a gift, but the gift of a minor is no gift, the words of the Sages. Rebbi Jehudah bar Pazi in the name of Rebbi Joḥanan, Rebbi Jacob bar Aḥa in the name of Rebbi Joḥanan, robbing from him is not total robbery unless he grew two pubic hairs. Rebbi Abbahu in the name of Rebbi Joḥanan, that is, to recover from him by a law suit, but to have to bring a sacrifice for [a false] oath only if he grew two pubic hairs. But following the rabbis here, Rebbi Yose asked that even for himself he should not be able to acquire since it is written (Ex. 22:6): “To his neighbor”, until he be like his neighbor. Rebbi Yose ben Rebbi Abun in the name of Samuel ben Rav Isaac explained it by the method of small children. As we have stated there: “For school children, their buying is buying and their selling selling, for movables.” But did we not state: “He cannot make them acquire through his minor son or daughter or his Canaanite male or female slave, because their hand is like his hand.” The rabbis of Caesarea say, here a minor with knowledge, there a minor without knowledge.
The House of Shammai say, if it is certain 11 and for demay 10. Bar Qappara stated, both for demay and for certain 11. Rebbi Yudan ben Rebbi Shalom taught what Bar Qappara had stated. The House of Shammai follows Rebbi Eliezer, since Rebbi Eliezer said, he who is trustworthy for the Second is trustworthy for the First. Rebbi Yose said, everybody agrees, they made it like additions to First Fruits. Just as additions to First Fruits are eaten in purity and are free from demay, so this is eaten as Second Tithe and is free from the First. Rebbi Ḥananiah confirmed in the name of Rebbi Issi: it is Rebbi Eliezer’s.
Is one guilty for bread from it because of new grain? Rebbi Yudan said, it is written (Lev. 23:14): “Bread, parched or fresh grain you should not eat.” Anything for whose parched grain you would be guilty because of new grain you are guilty for bread because of new grain; but anything for whose parched grain you would not be guilty because of new grain you are not guilty for bread because of new grain.
Was is left? Rav Huna said, if you say that oats are a kind of spelt, they combine with wheat; foxtail is a kind of barley which does not combine with wheat! “Rebbi Joḥanan ben Nuri said, the remaining kinds all combine with one another.” There are Tannaїm who state: “All kinds combine with one another.” In the opinion of that outside Tanna, what is the difference between bitten and mixed? Rebbi Yudan, the father of Rebbi Mattaniah said, when he split and then added; it is obligated when biting, exempt when mixed.
Rebbi Yose said, even three years old it will not have the thickness of a tenter’s needle. Rebbi Yudan said, a baraita supports Rebbi Yose: “Rebbi says, when they said five, six, or seven years old, for vines five years old, for figs six years old, for olives seven years old.” But do we not see the growth of the fig tree come with fruits? Rebbi Yudan said, according to Rebbi Tryphon we throw it on its width.

Rebbi Abbahu in the name of Rebbi Joḥanan and Rav Ḥisda, both say: they differ in the uninformed case. What are we dealing with? If it is certain that it lives off the old tree, everybody agrees it is permitted. If it is certain that it lives off the young tree, everybody agrees it is forbidden. We must be dealing with the uninformed case. How could one know? Rebbi Vivian in the name of Rebbi Ḥanina: If the leaves are turned towards the young tree one may be sure that it lives from the old one; if the leaves are turned towards the old tree one may be sure that it lives from the young one. Rebbi Yudan bar Ḥanin said, a sign: He who eats from his neighbor’s is ashamed to look at him. Rebbi Yudan, the father of Rebbi Mattaniah said, explain it if the leaves have fallen off.

“A sunk branch which became separated.” Rebbi Yudan said, not only a sunk branch but even a tree; as Rebbi Assi said in the name of Rebbi Joḥanan, if an onion which one uprooted and replanted grows roots he has to tithe for everything. Rebbi Ḥiyya in the name of Rebbi Joḥanan, if an onion which one uprooted and replanted grows roots he has to tithe for everything, but you should not say it applies to here also.
It was stated: Pomegranates of Bedan in case of doubt can be lifted, if certain cannot be lifted. It is the same on the ground. A doubt on the ground can be lifted, but the ground cannot lift. How is this? If a sapling of ‘orlah or vineyard kilaim became mixed with [other] saplings, (even) a case of doubt on the ground can be lifted, but the ground cannot lift. Rebbi Yudan asked: Is it the same for a cadaver? Rebbi Yudan turned around and said, a cadaver has no lifting, the ground has a lifting.

An ‘orlah walnut which one planted, and similarly, an egg of idol worship which turned into a chick. Rebbi Ḥaggai in the name of Rebbi Josia: Ḥizqiah and Cahana differ. Cahana said it is permitted, Ḥizqiah said it is forbidden. In the opinion of Ḥizqiah it should be impossible for an egg of idol worship to become a chick. What is this about? If someone squashed it, there is no chick. If he brought it inside the lattice enclosure, come and look: If he worshipped it it is not forbidden; because he brought it inside the grating should it be forbidden? Rebbi Yudan the father of Rebbi Mattaniah said, explain it if he used it to fence in the idol.
Rebbi Yudan said, did not Rebbi Abbahu say in the name of Rebbi Eleazar, they taught this about sweeteners? Since sweeteners usually are estimated as if they were onion or leeks, one estimates them as if they were onion or leeks. All other forbidden [foods], since they are not usually estimated as if they were onion or leeks one estimates in their kinds. Cumin one estimates by its kind.
HALAKHAH: What is a doubtful case of ‘orlah? An ‘orlah vineyard and grapes are sold on the outside; in the Land of Israel it is forbidden, in Syria permitted. Rebbi Yudan said, in that doubtful case also it is forbidden in Syria. What is a doubtful case in Syria? A vineyard planted with vegetables, a vegetable field next to it, and vegetables are sold on the outside; in the Land of Israel it is forbidden, in Syria permitted. “Rebbi Jehudah said, that also is forbidden in Syria. Which doubtful case is permitted in Syria? If a vineyard is planted with vegetables, a field of vegetables is nearby, and vegetables are sold on the outside, in the Land of Israel it is forbidden, in Syria permitted.”
“Outside the Land he goes, he harvests on condition that he not harvest with his own hands.” Rebbi Yudan said, that also should be equal to the first, “he turns in and buys on condition he not see him harvesting.”
Rebbi Yudan said, Rebbi Yose compares domains to eating slices. For if one ate the volume of half an olive during the time needed to eat one slice and another volume of half an olive in the time needed to eat another slice, is he not free from liability? If one ate several volumes of olives during several times needed to eat a slice in one period of forgetting, he is liable only once.
There, we have stated: “Rebbi Meïr says, if it was a Sabbath and he carried it out. They told him, it is not the category.” Because this one is liable because of walking and that one is liable because of putting down. Who is “they said to him”? Rebbi Yose! The argument of Rebbi Yose is inverted. There, he does not consider the person walking equal to one who was putting down but here he is considering the person walking equal to one who was putting down! Rebbi Yudan said, explain it that he was laying on the threshold partially inside, his mouth outside, when he stretched out his hand, took it, and ate it. Then he did not walk.
Rebbi Joḥanan asked: If he was standing in the public domain, threw, and then caught it, what? Is that not a Mishnah, “if another person caught it, a dog caught it, or it was burned, he is not liable”? Rebbi Samuel in the name of Rebbi Zeˋira: So it is if he snatches; therefore if he caught it he is liable. What is the difference between its coming to rest on the ground to coming to rest in his arm? There, why is he liable? There he threw and another one received it but here he threw, he received it. Should it be obvious for him that he is not liable? Would he not be liable because of his mouth if he threw with his right hand and received with his left? Is his mouth not like another person? Here, his left hand should be like another person. Rebbi Yudan said, it is obvious to Rebbi Joḥanan that he is liable if he threw with his right hand and received with his left. What was his problem? If he threw with his right and and received with his right hand. The rabbis of Caesarea, Rebbi Shammai in the name of Rebbi Aḥa: He is in doubt whether he is liable even if he threw with his right hand and received with his left. If you want to say “his mouth”, his mouth is like another person since he ate it; but is here his hand like another person? Rebbi Mana asked, if this be so, then even if he exported the volume of a dried fig in both hands he should be not liable because of one action executed by two persons! Rebbi Ḥiyya bar Ada said to him, is that when he did it? But was it not stated: An individual who acted is liable, two or three who acted are not liable.
Rebbi Joḥanan said in the name of Rebbi Simeon ben Yoḥai: “For example we, who are engaged in the study of Torah, do not interrupt even for the recitation of the Shemaˋ.” Rebbi Joḥanan used to say about himself: “For example we, who are not engaged in the study of Torah, do interrupt even for prayer.”This one follows his own opinion and that one follows his own opinion. Rebbi Joḥanan follows his own opinion since Rebbi Joḥanan said, if only a man prayed the entire day. Why? Because prayer is never in vain.Rebbi Simeon ben Yoḥai follows his own opinion since Rebbi Simeon ben Yoḥai said, if I had stood at Mount Sinai at the moment that the Torah was given to Israel, I would have implored the All-Merciful that He should create two mouths for a man; one for him to exert himself in Torah, and the other one for his needs. But he changed and said, with one mouth already the world almost cannot exist because of the denunciations; if there were two how much more would there be?Rebbi Yose said before Rebbi Jeremiah: The position of Rebbi Joḥanan is identical with that of Rebbi Ḥananiah ben Aqiba, as we have stated: “The scribes of Torah scrolls, Tefillin, and Mezuzot, do interrupt for the recitation of Shemaˋ but do not interrupt for prayer. Rebbi Ḥananiah ben Aqiba said, just as they interrupt for Shemaˋ, so they interrupt for prayer, Tefillin, and all other commandments of the Torah.”Would not Rebbi Simeon ben Yoḥai agree that one interrupts to make a Sukkah or a lulav? Does not Rebbi Simeon ben Yoḥai make the distinction between one who studies to do and one who studies in order not to do? Because he who studies in order not to do would have been better off had he not been born. And did not Rebbi Joḥanan say, he who studies in order not to do would have been better off if the placenta he was in was twisted around and he never would have entered the world? The reason of Rebbi Simeon ben Yoḥai is that this one is repeated study and that one is repeated study and one does not push aside one study for the other study. But did we not state: “He who reads after that did not lose, he is like a man reading in the Torah”? Hence, at the right time it is preferred to Torah. Rebbi Yudan said that Rebbi Simeon ben Yoḥai, since he was enjoying studying Torah, did not prefer Shemaˋ to the study of Torah. Rebbi Abba Mari said, did we not state: “He is only like a man studying Torah.” Hence, at the right time it is like Mishnah. Rebbi Simeon ben Yoḥai follows his own opinion since Rebbi Simeon ben Yoḥai said, he who studies the written Torah does himself good that is not so good. But the rabbis equate the study of the Bible with that of the oral law.
And who permitted it? Rebbi and his court permitted it. At three places is Rebbi Jehudah the Prince called “our teachers,” in divorce documents, oil, and a sole. They should have called him “a permissive court”, for any court which permits three [previously forbidden] things is called “permissive court.” Rebbi Yudan ben Rebbi Ismael said, his court disagreed with him about bills of divorce.Rebbi Joḥanan asked: Did we not state, “for no court may invalidate the words of another court unless it be greater in wisdom and numbers”? And Rebbi and his court permit what Daniel and his companions forbade? Rebbi Joḥanan follows his own opinion, for Rebbi Joḥanan said in the name of Rebbi Eleazar ben Rebbi Ṣadoq, I have a tradition that any restrictive edict passed by a court which is not accepted by the majority of the public is not an edict. They checked and found in the matter of the edict about oil and did not find that a majority of the public followed it.
The House of Shammai put a question to the House of Hillel which they could not answer. “The House of Shammai said to the House of Hillel, do you not agree with us that one does not roast meat, or onions, or an egg, unless they be completely roasted when it is still daylight? They did not find an answer.” Rebbi Zeˋira said, if I would not put my head between the lions I could give a reason. There, onion, meat, or egg, usually are flipped; here, what can you say? Rebbi Yudan said, if they were roasted like Ben Derosai’s food. They forbade something which usually is flipped unless it be completely roasted as long as it is still day. Rebbi Mana said, it is not reasonable that it should be permitted. For they can say to them, how can you respond to us with something which ordinarily is completely roasted when it still is day about something which ordinarily cannot be completely soaked when it still is day?
HALAKHAH: Mishnah: “One does not give hides to the tannery worker,” etc. How long? It should come like what Rebbi Joḥanan said in the name of Rebbi Onias, the time needed to walk four miles. And here, if he gave his clothing to the Gentile fuller and found him treating them on the Sabbath, it is forbidden. Rebbi Yudan said, he should tell him not to do it. Rebbi Yudan, the father of Rebbi Mattaniah said, that is, for goodwill. But for a fee, he looks after his work.

If one set a fire and extinguished with the same blowing he is liable twice. Rebbi Eudaimon the brother of Rebbi Yose said, this implies that if he blew at vessels and broke them, he pays full damages. He who stirs coals under a pot on the Sabbath is liable. Rebbi Simeon ben Eleazar in the name of Rebbi Simeon ben Rebbi Ṣadoq, he is liable twice, once that he extinguished the upper layer and once that he set fire to the lower layer. But he who stirs coals to warm himself in front of them on the Sabbath is not liable. Rebbi Jacob bar Aḥa said, it is a disagreement; according to him who said that he is liable only once. But according to him who said that he is twice liable he is liable. For Rebbi Abbahu said in the name of Rebbi Joḥanan, he is not twice liable but he is considered as if twice liable. Rebbi Yudan said, there he does not want that they be set on fire and he does not want that they be extinguished. But here he wants that they be set on fire and he wants that they be extinguished.
Rebbi Mana cursed women who spread out their dresses over the airspace of the oven. Rebbi Yudan ben Rebbi Ismael with difficulty instructed to clean out the oven, laid there three stones and put on them; only that the neighboring women should not know of this. Rebbi Yose said, for the Sabbath you go by the heat; for impurity you go after the closure.
HALAKHAH: Why did they decree about a nailed shoe? Some say, because they saw the tips and had miscarriages. But some say, they heard its sound and had miscarriages. And some say, they were stampeding and killing one another. What is the difference between them? הדוסטא. Accordig to him who said, because they saw the tips and had miscarriages, it is permitted. But according to him who said, they heard its sound and had miscarriages or they were stampeding and killing one another, it is forbidden. But did they not decree this in an emergency? When the emergency passed it should have been permitted. There never rose a court which undid it. Then even on a weekday! People do not usually have two pairs of shoes, one for weekdays and one for the Sabbath. It was stated: If one put a patch under it it is permitted. Rebbi Yudan bar Ismael’s feet were scratched and they did this for him.
One does not recite a verse over a wound on the Sabbath; the one which one recites about mandrakes is forbidden. Come and recite this verse for my son who is afraid, put on him a scroll, put on him phylacteries, so he will go to sleep, is forbidden. But did we not state, they used to recite the Song of the Afflicted in Jerusalem? Rebbi Yudan said, one means after he was hurt, the other before he was hurt. What is the Song of the Afflicted? Eternal, how many are my oppressors, and the entire Psalm. Sitting in the shelter of the Most High up to: Truly, You, Eternal, are my refuge, the Most High you put as your help.
In general by extirpation, the separate case by extirpation; the word of Rebbi Joḥanan implies that it is “general case and detail”, as Rebbi Abbahu said in the name of Rebbi Joḥanan, since anybody who would perform any of these abomination s, they will be extirpated. Was not his sister included in the general class and was mentioned separately of the general class to divide from the general class. Rebbi Eleazar objected, is it not written, the nakedness of your mother’s sister and your father’s sister you shall not uncover, for he would touch his relative? He told him, this was mentioned separately for a reason, to judge by “touching”. He said to him, is it not written, a man who would lie with an unwell woman, uncover her nakedness and touch her source? He told him, this was mentioned separately for a reason, to judge the one “touching” as finishing. That you should not say, since he is liable for her [already] for impurity we should not consider for him “touching” as finishing. Therefore it was necessary to mention (that he is liable for each single one.) He said to him, is it not written, a man who would sleep with his aunt, his uncle’s nakedness he uncovered? He told him, this was mentioned separately to judge by childlessness. But is it not written, a man who would marry his brother’s wife, she is separated? He told him, this was mentioned separately to judge by childlessness, as Rebbi Yudan said, where it is written childless they shall be, they will be without children, childless they shall die, they bury their children.
“And who selects.” Rebbi Yudan said, one picks out pebbles the entire day and does not incur liability, and one takes the volume of a dried fig and immediately incurs liability. How is this? If he was sitting on top of a heap of grain and picks out pebbles the entire day, he does not incur liability; if he took in his hand the volume of a dried fig and picked out he is liable.
There exists a baraita which says, idols are like a menstruating woman and its appurtenances are like a menstruating woman. Also there exists a baraita which says, idols are like a menstruating woman and its appurtenances are like crawling animals. The one who says, idols are like a menstruating woman and its appurtenances are like a menstruating woman, is understandable. But concerning the one who says, idols are like a menstruating woman and its appurtenances are like crawling animals, is it not called “unwell” only for its appurtenances? You will defile the coating of your silver gods and the clothing of your molten gold. Explain it if they were engraved on its body. Rebbi Jacob of Kefar Ḥanan said, explain it if one worships the ephod itself, similar to what is written, Gideon turned it into an ephod. Our Mishnah follows him who said, idols are like a menstruating woman and its appurtenances are like a menstruating woman. But did we not state: “its stones, its wood, and its dust make impure like a crawling animal”? Explain it if he worshipped the house itself and then built it up. But did we not state “there are three houses”? Explain it if he worshipped the house itself and then renovated it, as Rebbi Abba, Rab Huna said in the name of Rav: One who worships a house makes it forbidden. Rebbi Zeˋira, Rebbi Abbahu in the name of Rebbi Joḥanan: If somebody dedicates a house one does commit larceny with it. Rebbi Zeˋira said, about this the rabbis disagree. For him who says that he forbade it one may commit larceny with it, but for him who says that he does not forbid it, one does not commit larceny with it? Rebbi Ḥaggai objected before Rebbi Yose, does not a Mishnah disagree with Rav? “A trough in a rock: one does not fill from it.” Because he excavated it and after that combined it. Then not if he fixed it and after that excavated it. Is this house not as if he excavated it and after that combined it? What does Rav do with it? He explains that the hewing of stones is the completion of work on them. Does this not disagree with Rebbi Joḥanan, since Rebbi Joḥanan said, an idol which was broken is forbidden. And so we are thinking to say if in the future he cannot restore it in its entirety it is permitted according to everybody. But did we not state, “there are three kinds of stones”? Explain it that he worshipped every single stone and then builds with them. Even with Rebbi Simeon ben Laqish this does not disagree, as Rebbi Simeon ben Laqish said, an idol which was broken is permitted. And so we are thinking to say if in the future he can restore it in its entirety it is forbidden according to everybody, and Rebbi Yudan, the father of Rebbi Mattaniah, said, if they remain in their place is this not as if in the future he can restore it in its entirety? And these remain at their place. Rebbi Abba in the name of Rav, one who worships a house makes it forbidden, a tree he does not make forbidden. But did we not state, “there are three kinds of Ashera”? Explain it that he worshipped a vine and then planted it.
It is written, let us go and argue, says the Eternal, etc. It was stated, Rebbi Eliezer said, If your sins were like years, etc., like the years from Heaven to Earth, they will be snow white; more than that, they shall be like wool. Rebbi Joshua said, if your sins were like years, like the years of the patriarchs, they will be snow white; more than that, they shall be like wool. Rebbi Yudan bar Pazi said, If your sins were like years they will be snow white, the first time, if they were like purple they shall be like wool, the second time. But the rabbis said, If the sins of a person are like his years, they will be snow white; more than that, they shall be like wool. Rebbi Yudan Antordiyya said, at a time when a person’s sins are light, they will be snow white; at a time when they are serious, they shall be like wool.
