HALAKHAH: “If his brother left money,” etc. Rebbi Abbahu in the name of Rebbi Joḥanan: It is necessary, if the money was deposited with him, that you would not let him say, since I am the heir it is mine.
In earlier times, her ketubah was deposited with her family; then it was easy for him to divorce her. They then instituted that her ketubah had to be deposited with her husband; even so it was easy for him to divorce her. Then they instituted that a man should buy with his wife’s ketubah cups, plates, and bowls; that is what we did state: “He should not say to her ‘here your ketubah is lying on the table’ but all his properties are pledged for her ketubah.” Finally they instituted that a person should use his wife’s ketubah in business, then because he uses his wife’s ketubah in his business dealings he loses track of it and it becomes difficult for him to divorce her.

Rebbi Jeremiah asked: If he threw it to her in a courtyard which belongs to neither of them, what is the rule? Rebbi Aḥa in the name of Rebbi Ḥanina: That is a problem for the rabbis. Rebbi Abin said, it is a disagreement between Rav and the Elder Rebbi Ḥiyya, for Rebbi Samuel, Rebbi Ze‘ira, Rav Ḥiyya bar Ashi said in the name of Rav: Drawing close does not acquire in a courtyard which belongs to neither of them. But Rebbi Ḥiyya stated in disagreement: “Under which circumstances did they say that movables are acquired by drawing close? In the public domain or in a courtyard which belongs to neither of them. But in the buyer’s domain he acquired the moment he accepted it. In the seller’s domain he does not acquire unless either he lifts it up or moves it out of its prior owner’s domain. In a domain where it was deposited he does not acquire unless he either is explicitly empowered or he leases its place.”

The House of Shammai say, an agent may not testify as witness. But the House of Hillel say, an agent may testify as witness. How is that? If he sent two, in the opinion of the House of Shammai there is an agent and two witnesses. In the opinion of the House of Hillel, all three can be agents and all three can be witnesses. Rebbi Abun bar Ḥiyya said, the matter is reasonable if the preliminary marriage was executed by document. But if he executed the preliminary marriage by money, he became an interested party in his testimony. Rebbi Yose said, since the Torah made him trustworthy, even if he executed the preliminary marriage by money, he did not become an interested party in his testimony. Rebbi Abba said, there came a case before Rav who admitted the agent as witness. A person deposited his amphoras in another’s corral; [the latter] reneged. The case came before Rebbi Jeremiah who admitted the agent as witness and made him swear [by the testimony of] the porter.
Rebbi Abbahu in the name of Rebbi Joḥanan: The baraita if he said to her, by the deposit you are holding for me. But if he said, by everything which I deposited with you, she is not preliminarily married unless all of it is available. What is the difference between this and a loan? A loan was given to be spent; this was not given to be spent. But did we not state: “If she was eating right away she is not preliminarily married unless one of them was worth a peruṭah.” Then even if a peruṭah’ s worth was left, she should not be preliminarily married unless all of them were available! He explains that as earlier. If it refers to the earlier statement, did we not state: “If she was eating immediately she is not preliminarily married unless one of them was worth a peruṭah”? Rebbi Abun said, were we not of the opinion to say, who is the Tanna of Wawim? Rebbi Jehudah. Rebbi Joḥanan said: The words of Rebbi Jehudah imply comprehensive one sacrifice, in detail three sacrifices. Just as he says there, comprehensive one sacrifice, in detail three sacrifices, so he says here, comprehensive one preliminary marriage, in detail three preliminary marriages.
HALAKHAH: “He who sets fire to a stack of sheaves,” etc. Rebbi Abbahu in the name of Rebbi Joḥanan: The Sages agree with Rebbi Jehudah about threshing tools which usually are hidden there. The argument of Rebbi Jehudah seems inverted. There he says except what is hidden, but here he says including what is hidden? But does not Rebbi Jehudah simply explain “stack”? Why was “stack” written? That he has to pay for all that is in it. The argument of the rabbis seems inverted. There they say, including what is hidden; but here they say, except what is hidden? But did not Rebbi Abbahu say in the name of Rebbi Joḥanan: The Sages agree with Rebbi Joḥanan about threshing tools which usually are hidden there? Rebbi Hoshaia said, if there are no witnesses. But if there are witnesses, everybody agrees with Rebbi (Yose) as it was stated: “If it was a stack of wheat sheaves covered with barley or a stack of barley sheaves covered with wheat, he pays for a stack of barley.” As the following: A person deposited a tied sack with another person, when something happened. This one said, it was full of dross, but the other said, it was full of raw silk. [ ] He swears and collects.
Rebbi Joḥanan asked: Can one argue for him an argument which does not apply to him? Let us hear from the following: Bar Ziza’s sharecropper deposited a pound of gold with somebody. Bar Ziza and Bar Ziza’s sharecropper died; the case came before Rebbi Ismael ben Rebbi Yose. He said, does not everybody know that all Bar Ziza’s sharecrooper had was Bar Ziza’s property? It should be given to Bar Ziza’s sons. Bar Ziza had adult and underage sons. He said, the adult one should take half and when the underage ones grow up, they should receive half. Rebbi Ismael ben Rebbi Yose died; the case came before Rebbi Ḥiyya who said, that argument means nothing [since there are people who do not flout their wealth]; it should be given to the sharecropper’s sons. The trustee told him, I already disbursed half of it. He told him, what you gave, you gave by court order and what you will give, you will give by court order. May the sharecropper’s sons say to Bar Ziza’s sons, give us what you took? They can tell them, what was done was done by court order. May the underage ones say to the adult, let us share with you? May they tell them, we found a find? Rebbi Isaac said, the case between the adult and underaged ones is compared to one who gave a gift.
MISHNAH: He who says to another: I robbed you, or I took a loan from you, you deposited with me, but I do not known whether I returned it to you or did not return it, is liable to pay. But if he said to him: I do not know whether I robbed you, or I took a loan from you, or you deposited with me or did not deposit, he is not liable to pay.

HALAKHAH: “He who says to another: I robbed you,” etc. Rebbi Joḥanan said, if he wants to clear himself before Heaven. I robbed you, or I took a loan from you, you deposited with me; did I return it to you? The other party says, I do not know. Rebbi Jeremiah wanted to say, he is required to make good as a matter of law. Rebbi Yose wanted to say, still it is to become clear before Heaven. I took from the wallet and gave to you, and the other party says, I do not know. Rav Huna said, one tells him: You do not know but the other party knows.
MISHNAH: If one deposited an animal or vessels with another and they were stolen or lost: If the other paid and did not want to swear although they said that the unpaid trustee swears and is absolved, in case the thief was found, he pays double restitution; if he slaughtered or sold it, he pays quadruple or quintuple restitution. To whom does he pay? To the person with whom it was deposited. If the other had sworn and did not pay, in case the thief was found, he pays double restitution; if he slaughtered or sold it, he pays quadruple or quintuple restitution. To whom does he pay? To the owner of the deposit.

To the owner of the deposit.
HALAKHAH: “If one deposited an animal or vessels with another,” etc. From where does he bring this? “If the stolen object be found in his hand.” Do we not know that if the thief is found that he has to pay double? Why does the verse say, “double he shall pay”? If the verse is not needed for the case, use it for the following subject. Rebbi [ ] went to the “term” of Rebbi Yudan and asked this question before him. He answered, refer to what is stated afterwards: “If the other had sworn and did not pay, in case the thief was found, he pays double restitution; if he had slaughtered or sold it, he pays quadruple or quintuple restitution. To whom does he pay? To the owner of the deposit.” Should he not pay to the person with whom it was deposited? Rebbi Nasa in the name of Rebbi Jonah: “Alive, double he shall pay.” To the place where the capital goes, there the double fine goes. Rebbi Joḥanan and Rebbi Eleazar; Rebbi Nasa adds in the name of Rebbi Yose ben Ḥanina: Not only when he paid, but even when he stated his willingness to pay it is as if he had paid.

MISHNAH: If one says to two people, I robbed a mina from one of you but I do not know who it was or, the father of one of you deposited a mina with me but I do not know who it is, has to pay a mina to each of them since he himself confessed. If two people deposited with a third party, one a mina and one 200 [zuz]. Each of them says, the 200 are mine. He shall give each of them a mina and the remainder shall be deposited until Elijah comes. Similarly two vessels, one worth a mina, the other worth 1’000 zuz. Each of them says, the valuable one is mine. He shall give the small vessel to one of them, from the value of the large one he shall give the value of the small one to the other and the remainder shall be deposited until Elijah comes. Rebbi Yose said, if that be so, what did the trickster lose? But everything shall be deposited until Elijah comes.

HALAKHAH: If somebody deposits produce with another person,” etc. Rebbi Abbahu said, if you would say that he should not touch them even if they are going to spoil, he will invent situations. Rebbi Abba bar Jacob in the name of Rebbi Joḥanan, Rebbi Abbahu in the name of Rebbi Joḥanan: Practice follows Rabban Simeon ben Gamliel. For example, Rebbi Joḥanan from Ḥaqoq deposited with the Elder Rebbi Ḥiyya a saddle bag full of leavened material. He came to ask Rebbi, who said it should be sold under the surpervision of the court when it would have to be destroyed. A person deposited with Rabbi Ḥiyya bar Ashi an amphora full of kutaḥ. He came to ask Rav, who said it should be sold under the surpervision of the court when otherwise it would have to be destroyed.

A Jew may borrow from a Gentile, and a Gentile from a Jew, and a Jew can become his guarantor without any worries about interest. If a Jew appointed a Gentile as guardian or steward, it is permitted to borrow from him on interest. But if a Gentile appointed a Jew as guardian or steward, it is prohibited to borrow from him on interest. It is forbidden to borrow on interest a Gentile’s money deposited with a Jew; it is permitted to borrow on interest a Jew’s money deposited with a Gentile. This is the principle: Anything which the Jew has to warrant is forbidden, what the Gentile has to warrant is permitted.

HALAKHAH: “If one writes his properties over to others,” etc. Rebbi Abba bar Mamal said, about one who writes his properties over to others while neglecting his children, the verse says: “their sins were on their bones.” As the following: A person deposited his properties with Rebbi Abba bar Mamal and told him, if my sons will be useful give them half and keep half. His sons came and took half. Later they came to appeal against him. He told them, your father said only: If my sons will be useful give them half and keep half. Now you are badly educated, return to me what I gave to you.
MISHNAH: If somebody paid off part of his debt, deposited his bond with a third party, and told him, if I have not paid him by date x, return the bond to him. If the time has passed while he did not pay, Rebbi Yose says, he shall return it; Rebbi Jehudah says, he shall not return it. If somebody’s bond became illegible, he presents witnesses about it to the court and they confirm for him: The bond of Mr. X, son of Mr. Y, dated from day Z became illegible; U and V were his witnesses.
May one claim extraordinary things? One may, following what Rebbi Joḥanan said, a person may be rich on the market place and poor in his house; rich in his house and poor in the market place. There is one who poses as richand has nothing, poses as poor and has great wealth. Rebbi Abba told: Bar Ziza’s sharecropper deposited a pound of gold with somebody. Bar Ziza and Bar Ziza’s sharecropper died; the case came before Rebbi Ismael ben Rebbi Yose. Would one not say that all that Bar Ziza’s sharecropper had was Bar Ziza’s property? Rebbi Assi, Rebbi Joḥanan in the name of Ben Bathyra: If libation wine fell into a cistern, it should be sold entirely to a Gentile except the value of the libation wine contained in it. Rebbi Assi in the name of Rebbi Joḥanan: Undetermined wine of a Gentile is forbidden but does not make impure. If he deposited it with him it is forbidden for drinking but permitted for usufruct. Rebbi Ze‘ira asked before Rebbi Yasa, how? If he segregated it? He told him, if he deposited it. Rebbi Abbahu came in the name of Rebbi Joḥanan: There are three kinds of wine. If he saw the Gentile pouring a libation, it is certainly pagan worship and induces severe impurity like a reptile.Gentiles’ undetermined wine is forbidden but does not cause impurity. If he deposited with him with one seal it is forbidden to drink and permitted for usufruct. Rebbi Jeremiah said before Rebbi Ze‘ira: See what he said! He only said with a seal. Therefore without a seal it is forbidden for drinking and usufruct. Rebbi Eleazar instructed: if it was segregated; Rebbi Ze‘ira enjoyed it.

If he deposited with him with a seal. Rebbi Ḥananiah and Rebbi Mana, one says, prohibited, and one says, permitted. Where do they disagree? For usufruct. But for drinking it is forbidden.
If she checked and deposited it in a glass box, Rebbi Ḥiyya said, a stain; Rebbi said, an episode of bleeding. Rebbi Ḥiyya objected to Rebbi: Do you not give her the possibility of an explanation? Rebbi Abun bar Ḥiyya said, Rebbi’s reason is that a box is safe from crawling things, it is not safe from lice. Up to the size of a broken bean she explains it; if it is larger, by what can it be explained?
The Babylonian Talmud
'Abba the Bleeder received every day a greeting from the heavenly academy while 'Abbayi received one every Friday, and Raba every year on the eve of the Day of Atonement. 'Abbayi felt discouraged on account of the greater distinction of 'Abba the Bleeder. 'Abbayi was therefore told, "Thou canst not perform deeds like those of 'Abba the Bleeder!" What were the deeds of 'Abba the Bleeder? When he performed the operation (of bleeding), he had a separate place for men and another for women. He had a garment ready in which there were numerous slits, and when a woman came, he made her put it on, so that he should not have to look upon her bare body. Outside of his office he had a place (box) where his fees were to be deposited. Whoever had money could put it in, but those who had none could come in without feeling embarrassed. When he saw a person who was in no position to pay, he would offer him some money, saying to him: "Go, strengthen thyself." One day 'Abbayi sent a pair of scholars to him to find out the truth about him. When they came to his house, he gave them to eat and to drink and laid cushions before them to sleep on.
The collectors of charity funds used to hide themselves whenever they saw Eleazar of the village of Bartota, because he was in the habit of giving them everything he happened to possess. One day he was going to the market in order to buy a wedding outfit for his daughter, when the collectors espied him and tried to hide themselves. Eleazar, however, followed them and said: "I adjure you to tell me for what purpose you are collecting?" "For a marriage between an orphaned boy and an orphaned girl," they replied. "By the Service of the Temple! they have precedence over my daughter," exclaimed he, and putting together all that he had, he gave it to them, except one zuz that remained in his possession. For this he bought wheat and deposited it in the granary. Thereupon his wife inquired of her daughter what her father had brought her. "All that he brought he took up to the granary," the daughter replied. The wife then went up to the granary and found it full of wheat, to the extent that it came through the door hinges. When Eleazar returned from the Bet ha-Midrash, she said to him, "Come and see what thy Friend (God) has done for thee!" Said he: "By the service of the Temple! This wheat shall be sacred property and thy share in it shall not be more than that of any among the poor of Israel."
