The Jerusalem Talmud

Jerusalem Talmud Berakhot 1:88

Ben Zoma said: There will be a future time when Israel will no longer mention the Exodus. What is the reason? (Jer. 23:7–8) “Therefore, days will come, says the Eternal, that one no longer will say, by the Eternal Who brought the Children of Israel up from Egypt, but rather, by the Eternal Who raised and brought the descendants of the House of Israel from the Northern land …” They said to him, not that the Exodus will be eliminated but the Exodus will be additional to the Kingdoms. The Kingdoms will be principal and the Exodus additional. And similarly it was said (Gen. 35:10): :Your name shall not be called Jacob anymore, but Israel shall be your name.” Not that the name Jacob will be taken away but Jacob will be additional to Israel. Israel will be principal and Jacob additional. And so it says (Is. 43:18–19): “Do not remember the first things”; this means the Egyptians, “And what was earlier do not dwell on”; this means the Kingdoms, “Behold, I create something new, now it will grow”; this refers to Gog. They gave a simile: to what can this be compared? To someone who encountered a wolf and was saved from it. He started telling about the wolf when he encountered a lion and was saved from it. He forget about the wolf and started telling about the lion. After that, he encountered a snake and was saved from it. He forgot about both of them and started telling about the snake. So it is with Israel, the last troubles make them forget the earlier ones.

Jerusalem Talmud Berakhot 3:26

It is stated: The carriers may not wear sandals lest a shoelace of one of them break so he would be eliminated from the good deed.

Jerusalem Talmud Berakhot 3:70

Rebbi Benjamin ben Yephet in the name of Rebbi Yoḥanan: A minute amount of excrement can be eliminated by spit. Rebbi Zeïra and Rebbi Jacob bar Zavdi were sitting; they saw some excrement. Rebbi Jacob bar Zavdi got up and spat on it. Rebbi Zeïra said to him: From the sea to the pan!

Jerusalem Talmud Berakhot 4:61

If one was standing praying on the Sabbath; he forgot about the Sabbath and prayed for weekday. Rebbi Ḥuna said, Rav Naḥman bar Jacob and Rav Sheshet disagree, one says he cuts the benediction short and the other says, he finishes the benediction. All agree that he finishes “Gracious Giver of knowledge”. This follows Rebbi, since Rebbi said: I wonder why they eliminated “Gracious Giver of knowledge” on Sabbath; if there is no knowledge, from where comes prayer? Rebbi Isaac said: Knowledge is great because it is in the middle between two mentions of divine names as it is said (1Samuel 2:3): “Certainly, a God of knowledge is the Eternal”. Some want to understand from here (Prov.2:5): “Then you will understand the fear of the Eternal and the knowledge of God you will find.”

Jerusalem Talmud Berakhot 5:33

“And Havdalah in “He Who in His grace grants knowledge”, the words of the Sages. Rebbi Aqibah said: one says it as separate fourth benediction” Rebbi Jacob bar Aḥa in the name of Samuel: He says it as fourth benediction. Rebbi Yudan says, the text of the benediction and after that he says Havdalah. His version agrees with Rebbi, since Rebbi said: I wonder why they eliminated “He Who in His grace grants knowledge” on Sabbath; if there is no knowledge, where is prayer? And here, if there is no knowledge, where is Havdalah? Rebbi Isaac ben Eleazar said, he says Havdalah and afterwards adds the text of the benediction.

Jerusalem Talmud Peah 1:77

It turns out that Rebbi Aqiba is like the stores of Bene Ḥanun as it has been stated: Why were the stores of Bene Hanun destroyed three years before the destruction of the Temple? Because they eliminated produce from the duty of tithes since they were inferring (Deut. 14:22) “You should certainly give tithes,” that excludes the buyer, (Deut. 14:23) “You should eat,” that excludes the vendor.

Jerusalem Talmud Kilayim 4:8

Rebbi Judan asked: What if he made a fence inside a fence? He said, if there are three hand-breadths one may sow there, otherwise one may not sow there. Rebbi Jacob bar Idi in the name of Rebbi Simeon ben Laqish: If there was a place of twelve cubits there, the circumference would be eliminated. Rebbi Ḥizqiah said, only if it is twelve by twelve. Rebbi Mana said, even if it continuously narrows.

Jerusalem Talmud Sheviit 1:3

If it is so, why was it said: One ploughs until the New Year? Rebbi Crispus in the name of Rebbi Joḥanan: Rabban Gamliel and his court abolished the prohibition of the first two terms. Rebbi Joḥanan asked: Did we not state: No court may annul the words of another court unless it is greater in wisdom and numbers? Rebbi Crispus in the name of Rebbi Joḥanan: If they wanted to plough, they may plough. Then it should have been eliminated from the Mishnah! Rebbi Crispus in the name of Rebbi Joḥanan: If they wanted to re-establish it, they may do so.

Jerusalem Talmud Sheviit 1:4

Rebbi Jonah objected: There is the chapter on the induction and the chapter on the generation of the deluge which will have no future use. Should they have been eliminated from what is studied? They are there to inform you. So here also to inform you. Rebbi Mana said, as we stated there: “If a person says, so is my tradition, one will say to him, you heard the opinion of Rebbi X.” And so, if somebody should say, I heard that it is forbidden to plough until the New Year, they will say to him, you heard the prohibition of the first two terms.

Jerusalem Talmud Maaser Sheni 5:53

MISHNAH: In the afternoon of the holiday they made the declaration. How was the declaration? (Deut. 26:13) “I removed the holy produce from the house,” is Second Tithe and fourth-year growth. “I gave it to the Levite,” is the Levite’s tithe. “Also I gave it,” includes heave and heave of the tithe. “To the sojourner, the orphan, and the widow,” is the tithe of the poor. “From the house,” is ḥallah. “Following Your entire Commandment which You commanded me;” therefore, if he gave Second Tithe before the First he cannot make the declaration. “I did not transgress Your Commandments,” I did not give from one kind for another, not from the harvested on the standing or from the standing on the harvested, not from new for old or from old for new. “And I did not forget,” to praise and mention Your Name over it. (Deut. 26:14) “I did not eat from it in my deep mourning;” therefore if he ate from it in deep mourning he cannot make the declaration. “I did not remove any of it in impurity;” therefore if he separtated it in impurity he cannot make the declaration. “I did not give from it to the dead,” I did not buy from it a casket or shrouds for a dead person nor did I give it to other deep mourners. “I listened to the voice of the Eternal, my God,” I brought it to the Selected House. “I did all You commanded me,” I enjoyed and gave joy to others with it. (Deut. 26:15) “Look down from Your Holy Abode, from Heaven,” we did what You decided for us, You also do what You promised us: “Look down from Your Holy Abode, from Heaven, and bless Your people Israel” with sons and daughters, “and the land You gave us,” with dew, winds, rain and young of the domestic animals, “that You had sworn to our forefathers, a Land flowing with milk and honey” to give taste to the fruits. Because of this, they said that Israel persons and Mamzerim may make the declaration but not proselytes and freed slaves who have no part in the Land. Rebbi Meïr says, also excluding Cohanim or Levites who did not receive any part of the Land. Rebbi Yose says, they have their cities with surroundings. The High Priest Joḥanan disestablished the declaration of tithes. He also eliminated the arousers and the hitters. Up to his days the hammer was hitting in Jerusalem and in his days nobody had to ask about demay.

Jerusalem Talmud Shabbat 10:15

“A living person on a bier is not liable even for the bier,” for the living carries himself. “A dead person on a bier is liable,” the opinion of everybody? Was it not stated, also bad smell in the most minute amount? Rebbi Ila said, also Rebbi Simeon agrees to this. Rebbi Simeon also agrees in cases of prohibitions of usufruct. Rebbi Yudan said, explain it if the corpse is a Gentile’s without bad smell and he takes it out for his dog. It was stated: For half the volume of an olive of a corpse and half the volume of an olive of a carcass and less than the volume of a lentil of a crawling animal one is liable, but Rebbi Simeon declares not liable. What is Rebbi Simeon’s reason? The impurity already is eliminated. What is the rabbis’ reason? Following Rebbi Yudan explain it if the corpse is a Gentile’s without bad smell and he takes it out for his dog.

Jerusalem Talmud Pesachim 2:1

MISHNAH: Any time one is permitted to eat one feeds it to domestic or wild animals or birds, or sells it to a Non-Jew, and one may have usufruct from it. If its time has passed one may not have usufruct from it, nor use it to heat an oven or a cooking stove. Rebbi Jehudah says, leavened matter may only be eliminated by burning. But the Sages say, he makes crumbs and scatters them in the wind or throws it into the Sea.

Jerusalem Talmud Pesachim 2:12

It was stated: Rebbi Jehudah says, leavened matter may only be eliminated by burning. It is an argument de minore ad majus. Since piggul and leftover, which are not under an injunction not to be seen and not to be found, only may be disposed of by burning, for leavened matter which is under an injunction not to be seen and not to be found, it is only logical that it only may be disposed by burning. They told Rebbi Jehudah, any argument de minore ad majus which you argue in the beginning as a restriction but it turns out in the end to be a leniency, is no argument de minore ad majus. It would imply that if he does not find fire he could sit and not dispose of it. The Torah said, eliminate sour dough from your houses.

Jerusalem Talmud Pesachim 2:17

MISHNAH: A Non-Jew’s leavened matter which existed during Passover is permitted for usufruct but a Jew’s is forbidden for usufruct since it is said, it should not be seen in your possession. If a Non-Jew gave a loan to a Jew secured by leavened matter, after Passover it is permitted for usufruct but if a Jew gave a loan to a Non-Jew secured by leavened matter, after Passover it is forbidden for usufruct. Leavened matter on which debris fell is as if eliminated; Rabban Simeon ben Gamliel says, only one which cannot be dug out by a dog.

Jerusalem Talmud Pesachim 3:15

Rebbi Jeremiah in the name of Rebbi Zeˋira: Two volumes of half an olive in one house, the house does not combine them; in one vessel, the vessel does combine them. But did we not state, “less than this becomes insignificant”? One if plucked, one if connected. If he reduced it, did it become insignificant, or since it was to be eliminated it has to be completely eliminated? How much? They wanted to say, up to most of the trough. How is this? If he reduced most of the trough, the remainder becomes insignificant, or since it was to be eliminated it has to be completely eliminated? (There, Rebbi Jeremiah said in the name of Rebbi Zeˋira: Two volumes of half an olive in one house, the house does not combine them; in one vessel, the vessel does combine them; and here he says so?).

Jerusalem Talmud Pesachim 3:17

There, they are saying, tracta, Rebbi Isaac instructed that one may make one; two or three are forbidden unless one cleans his hands with water. It was stated: Bireh boxes have to be eliminated. Rebbi Yasa instructed that the surroundings of baking troughs have to be eliminated.

Jerusalem Talmud Pesachim 6:33

It was stated: The festival offering which comes with the Pesaḥ has to be eliminated with it. Come and see, a festival offering may be eaten for two days but the Pesaḥ only until midnight, and you are saying so? If it comes to the table with it. Dishes who come to the table with it have to be eliminated with it. Rebbi Yose said, this implies that he who ate soft cheese and wants to eat meat must eliminate the bread slices.

Jerusalem Talmud Pesachim 9:5

It is written: They started on the first of the first month, and on the eighth day …. Could they not have eliminated all idolatry from there in one day? Rebbi Idi said, because of Chaldean idols which were engraved in vermilion. It is written: With all his heart he prepared himself to seek the Eternal, the God of his forefathers. Rebbi Simon bar Zavdi and Rebbi Samuel bar Naḥman: One said, with all he did for the purity of the Temple, he did not fully establish the purity of the Temple. One said, with all the good works he did, he did not fully do his duty for the purity of the Temple.

Jerusalem Talmud Sukkah 5:39

“Bilgah always distributes in the South. Because of Miriam from Bilgah who apostasied and went to marry a general of the Greek government. She came and patted on the top of the altar and said to it, Λύκος, you destroyed Israel’s property and did not support them at the time of their distress. But some are saying that its time arrived to serve but it did not appear; so Yeshevav served in its stead in the High Priesthood.” Therefore Bilgah always is with the outgoing and Yeshevav withy the incoming. Should it not have been eliminated from its place? You cannot do this, as Rebbi Simon said in the name of Rebbi Joshua ben Levi: It is hard before the Omnipresent to eliminate the chain of descent from its place. Could they not be made twenty-three? You cannot do this, as it is written, these are the foundations of David and Samuel the Seer in their faithfulness. In their professionalism. It was a great feat of professionalism that no watch was taking and repeating in inheritance fields before the other could take. Rebbi Abbahu said, I computed it that no watch was taking and repeating in inheritance fields before the other could take.

Jerusalem Talmud Rosh Hashanah 3:30

HALAKHAH: Rebbi Yose ben Ḥanina said, it only said “somebody was passing by.” Therefore if he stood still, the presumption is that he listened purposefully. “If he put one shofar inside another shofar(,we shall say) [and blew], if one heard the sound of the inner one, he has fulfilled his obligation, if one heard the sound of the outer one, he has not fulfilled his obligation.” Rebbi Abinna asked, what if he turned it inside out? Let us hear from the following: “If he scratched it inside it is disqualified, outside it is qualified.” He only said, he scratched; therefore if he turned it inside out it is disqualified. What is the difference between the two? One eliminated the inner space, the other did not eliminate the inner space.

Jerusalem Talmud Yevamot 2:6

Both the rabbis and Rebbi Simeon agree to the following. According to the rabbis, the aspect which “bespeaking” acquires is forbidden in the co-wife, the aspect which “bespeaking” does not acquire is permitted in the co-wife; therefore, the latter has to have ḥalîṣah but not levirate. According to Rebbi Simeon, if “bespeaking” acquires, both are permitted. If “bespeaking” does not acquire, the first one is forbidden but the second one permitted. Out of doubt, she has to have ḥalîṣah but not levirate. What is the difference between them? If he slept with the second one. In the opinion of the rabbis, an incestuous intercourse because he had “bespoken”. Therefore, if he had not “bespoken” she may have levirate and there is no candidacy at all. Rebbi Ḥaggai said, I explained that following what Rebbi Jacob bar Aḥa said in the name of Rebbi Eleazar: If a woman waiting for her levir died, her mother is permitted to him. He had in her an interest of candidacy. When she died, the candidacy was eliminated. And here, when he died, the candidacy was eliminated.

Jerusalem Talmud Yevamot 4:27

HALAKHAH: “He who performs ḥalîṣah with his sister-in-law,” etc. Because he performed ḥalîṣah with her. Therefore, if he did not perform ḥalîṣah with her but she died, her mother is permitted to him. That is what Rebbi Jacob bar Aḥa said in the name of Rebbi Eleazar: If a woman waiting for her levir died, her mother is permitted to him. He had in her an interest of candidacy. When she died, the candidacy was eliminated. And here, when he died, the candidacy was eliminated. Rebbi Abun understood it from what follows: “And her sister as long as she is alive, but the brothers are permitted.” Is her sister’s position relative to the brothers not as if she herself had died?

Jerusalem Talmud Nedarim 6:30

Jerusalem Talmud Kiddushin 3:6

Rebbi Abbahu in the name of Rebbi Joḥanan: “This shall be an elevation sacrifice for thirty days,” it is an elevation sacrifice for thirty days; after thirty days it automatically becomes profane. What is its status regarding larceny? Rebbi Joḥanan said, the larceny is clear. Rebbi Ze‘ira, Rebbi Hila both say, the larceny is in doubt. “You are preliminarily married to me for thirty days,” she is preliminarily married. What is the difference between dedication and woman? We find that a dedication can be eliminated without redemption but we do not find that a woman could leave without a divorce document. Where do we find that a dedication can be eliminated without redemption? Following Rebbi Simeon, since Rebbi Simeon says, “they enter without paying.” Rebbi Yose ben Rebbi Abun said, explain it according to everybody regarding a bought field. “This is your bill of divorce for thirty days”: it is no bill of divorce. Rebbi Isaac ben R. Eleazar said, when do you say that she is preliminarily married? If he effectuated the preliminary marriage by money. But if he effectuated the preliminary marriage by a document, since marriage documents were inferred from divorce documents and in the case of a divorce she is not divorced, so in the case of a preliminary marriage she is not preliminarily married.

Jerusalem Talmud Sanhedrin 1:59

One said, with all the good works he did, he did not fully do his duty for the purity of the Temple. Jerusalem Talmud Shevuot 5:2

HALAKHAH: “An oath about a deposit,” etc. It was stated: Is an oath in his own formulation of an oath of testimony like an imprecation; in his own words is an oath about a deposit like an imprecation? Rebbi Yose said, since it is written “a person, a person”, everything is here and everything is there. Rebbi Mana said, an imprecation made in court is the topic of disagreement between Rebbi Meїr and the Sages. He lied to his fellow man, if his confession was eliminated by the oath. It excludes one who lied to one of partners; it excludes one who lied where there are witnesses and a document. Rebbi Yose said, this implies that if two people took a loan from one person, even if they did not write “we are responsible and warrantors for one another”, they are responsible and warrantors for one another; but one does not act on this. If two made a joint deposit and one came to retrieve his property, one does not listen to him. Should he not be treated as denying his part and be liable? If one made a deposit with two people. If one denied it, he is liable. If the other denied it, he is liable. If the deposit was worth one peruṭa, does this not result in each of them bringing a sacrifice for half a peruṭa? What here? If one would swear, and swear, and swear, would he not bring a sacrifice for half a peruṭa? There, each oath refers to a peruṭa’s worth. Here no oath refers to a peruṭa’s worth.

Jerusalem Talmud Avodah Zarah 4:23

Rebbi Joḥanan said, a stele is a monolith, an altar has many stones. Ḥizqiah said, a stele is annulled once it is damaged; of an altar one has to damage each single stone. A baraita of Ḥizqiah disagrees with him: If you tore down the altar, leave it alone; if you broke the stele, leave it alone . Rebbi Ze`ira, Rebbi Isaac bar Naḥman in the name of Rebbi Hoshaia; Rebbi Ḥiyya (Rebbi) Abba, Rebbi Eleazar in the name of Rav Hoshaia: When He turns all stones of the altar like smashed pieces of chalk, persecute them until you eliminated its egg from the world. But here, if you broke a stele, leave it alone; if you tore down an altar, leave it alone.

Jerusalem Talmud Avodah Zarah 4:29

MISHNAH: The Elders were asked in Rome, if He does not approve of idol worship, why does He not eliminate it? They answered, if they would worship something which the world does not need, He would eliminate it. But they worship sun and moon, stars and planets, mountains and hills. Should He destroy His world because of the stupid? They told them, if it is so, He should eliminate things which are not needed in the world, and keep things necessary for the world. They answered, then we would strengthen the worshippers of the latter who would say, you should know that these are divinities since those were eliminated and these were not eliminated.

Jerusalem Talmud Horayot 1:21

But would you not have eliminated the entire notion of one who watches a day for the next day? If they said, the night is permitted but the day is forbidden. Would you not have eliminated the entire notion of bending? Samuel bar Abba said, if they said, one cubit is permitted but two are forbidden. Would you not have eliminated the entire notion of prostrating? If they said, it is permitted to prostrate oneself but forbidden to sink down. Would you not have eliminated the entire notion of taking out? Rebbi Samuel ben Rav Isaac said, if they said, one dried fig is permitted but two dried figs are forbidden. This follows him who said that bringing in and taking out are the same. But for him who said that bringing in and taking out are two notions, would you not have eliminated the entire notion of bringing in? Rebbi Yose said, not that they said that it was permitted to eat fat; they knew that it is forbidden to eat fat, but the Torah gave permission to the Court to instruct. Rebbi Abun bar Ḥiyya asked, the [amount of] an olive today and of two olives tomorrow? What about a prophet and seducer? I could think that if they said to you, do not put on phylacteries today, put them on tomorrow, that you should listen to them. The verse says, to walk in them, in all of them, not only in part of them; you would have eliminated the notion of that entire day. You can say that this is not elimination of the entire subject. And here it is not elimination of the entire subject. Rebbi Mana understood it from the following; Samuel bar Abba said, if they said, one cubit is permitted but two are forbidden. You can say that this is not elimination of the entire subject. And here it is not elimination of the entire subject.

And here it is not elimination of the entire subject. Rebbi Mana understood it from the following; Samuel bar Abba said, if they said, one cubit is permitted but two are forbidden. You can say that this is not elimination of the entire subject. And here it is not elimination of the entire subject.

The Babylonian Talmud

Babylonian Talmud Ta'anit 4:37

Why is it that the recital of the Hallel (which took place in the Temple during the morning prayer) eliminates the corresponding morning prayer of the Ma'amad, while the Musaf prayer does not eliminate the corresponding Musaf prayer of the Ma'amad? "What!" replied R. 'Ashi, "is it possible that the Musaf prayer which eliminates even a non-corresponding service of the Ma'amad (that of Minḥah) should not eliminate the corresponding Musaf service of the Ma'amad?" Said Mar Ḳashshisha: What I meant to say is this: Let the Musaf prayer eliminate only a Ma'amad service that corresponds to it (the Musaf but not the Minḥah). R. Jose actually agrees with this opinion of yours, replied R. 'Ashi, for we find in a Baraita: R. Jose said, on all days on which a Musaf service is held a Ma'amad service is likewise held. Now, to which Ma'amad service does he refer? To that of Shaḥarit? This (the retention of the Ma'amad's Shaḥarit service on days which have the Musaf prayer) is admitted also by the first authority of the Mishnah (R. 'Aḳiba)! Or does he refer to the Ma'amad service during the Musaf prayer? Does not the Musaf eliminate even its own Ma'amad service? Or does he refer to the Ma'amad's Minḥah service? That service is eliminated by the wood offering! No other alternative, then, is possible than to say that he refers to the Ma'amad's Ne'ilah service, which proves that the Musaf eliminates only that Ma'amad service which is simultaneous (and hence conflicts) with it (namely the Ma'amad's Musaf), but none of the services which are not simultaneous with it (as those of Minḥah and Ne'ilah). It stands proved.
