King James Version
And Abel, he also brought of the firstlings of his flock and of the fat thereof. And the LORD had respect unto Abel and to his offering:
And thou shalt take the Levites for me (I am the LORD) instead of all the firstborn among the children of Israel; and the cattle of the Levites instead of all the firstlings among the cattle of the children of Israel.
And thither ye shall bring your burnt offerings, and your sacrifices, and your tithes, and heave offerings of your hand, and your vows, and your freewill offerings, and the firstlings of your herds and of your flocks:
Thou mayest not eat within thy gates the tithe of thy corn, or of thy wine, or of thy oil, or the firstlings of thy herds or of thy flock, nor any of thy vows which thou vowest, nor thy freewill offerings, or heave offering of thine hand:
And thou shalt eat before the LORD thy God, in the place which he shall choose to place his name there, the tithe of thy corn, of thy wine, and of thine oil, and the firstlings of thy herds and of thy flocks; that thou mayest learn to fear the LORD thy God always.
Also the firstborn of our sons, and of our cattle, as it is written in the law, and the firstlings of our herds and of our flocks, to bring to the house of our God, unto the priests that minister in the house of our God:
Apostolic Fathers
For thus it is written: “And it came to pass after certain days, that Cain brought of the fruits of the earth a sacrifice unto God; and Abel also brought of the firstlings of his sheep, and of the fat thereof. And God had respect to Abel and to his offerings, but Cain and his sacrifices He did not regard. And Cain was deeply grieved, and his countenance fell. And God said to Cain, Why art thou grieved, and why is thy countenance fallen? If thou offerest rightly, but dost not divide rightly, hast thou not sinned? Be at peace: thine offering returns to thyself, and thou shalt again possess it. And Cain said to Abel his brother, Let us go into the field. And it came to pass, while they were in the field, that Cain rose up against Abel his brother, and slew him.” Ye see, brethren, how envy and jealousy led to the murder of a brother. Through envy, also, our father Jacob fled from the face of Esau his brother. Envy made Joseph be persecuted unto death, and to come into bondage. Envy compelled Moses to flee from the face of Pharaoh king of Egypt, when he heard these words from his fellow-countryman, “Who made thee a judge or a ruler over us? wilt thou kill me, as thou didst kill the Egyptian yesterday?” On account of envy, Aaron and Miriam had to make their abode without the camp. Envy brought down Dathan and Abiram alive to Hades, through the sedition which they excited against God’s servant Moses. Through envy, David underwent the hatred not only of foreigners, but was also persecuted by Saul king of Israel.
OT Pseudepigrapha
Firstlings of sheep and the fat thighs of lambs,
Sefer haYashar (Book of Jasher)
And it was at the expiration of a few years, that they brought an approximating offering to the Lord, and Cain brought from the fruit of the ground, and Abel brought from the firstlings of his flock from the fat thereof, and God turned and inclined to Abel and his offering, and a fire came down from the Lord from heaven and consumed it.
The Book of the Bee
When Adam and Eve went forth from Paradise, they were both virgins. After thirty years Adam knew Eve his wife, and she conceived and bare Cain and Leboda his sister with him; and again she conceived and bare Abel and Kelemath his sister with him. When the youths had grown up, Adam said to Eve, “ Let Cain take to wife Kelemath who was born with Abel, and let Abel take Leboda who was born with Cain.” But Cain said to Eve his mother, “ I will take to wife my own sister, and let Abel take his;” for Leboda was beautiful. When Adam heard these words, he was very grieved, and said, “ It is a transgression of the […] Cain’s sister to Abel; but Cain desired his own sister more than Abel’s. Both (i. e. Kelemath and Leboda) were his sisters, but because of their birth at one time I have called them thus. Now Cain’s sister was exceedingly beautiful. The two brothers made an offering to God because of this matter. Abel, because he was a shepherd, offered up of the fat firstlings of his flock in great love, with a pure heart and a sincere mind. Cain, because he was a husbandman, made an offering of some of the refuse of the fruits of his husbandry with reluctance. He made an offering of ears of wheat that were smitten by blight; but some say of straw only. And the divine fire came down from heaven and consumed the offering of Abel, and it was accepted; while the offering of Cain was rejected. And Cain was angry with God, and envied his brother; and he persuaded his brother to come out into the plain, and slew him. Some say that he smashed his head with stones, and killed him; and others say that Satan appeared to him in the form of wild beasts that fight with one another and slay each other. [VI At any rate, he killed him, whether this way or that way. Then God said to Cain, ‘ Where is Abel thy brother?’ Cain said, ‘Am I forsooth my brother’s keeper?’ God said, ‘ Behold, the sound of the cry of thy brother Abel’s blood has come unto me; ’ and God cursed Cain, and made him a wanderer and a fugitive all the days of his life. From the day in which the blood of Abel was shed upon the ground, it did not again receive the blood of any animal until Noah came forth from the ark. Adam and Eve mourned for Abel one hundred years. In the two hundred and thirtieth year, Seth, the beautiful, was born in the likeness of Adam; and Adam and Eve were consoled by him. Cain and his descendants went down and dwelt in the plain, while Adam and his children, that is the sons of Seth, dwelt upon the top of the Mount of Eden. And the sons of Seth went down and saw the beauty of the daughters of Cain, and lay with them; and the earth was corrupted and polluted with lasciviousness; and Adam and Eve heard of it and conceived by them and brought forth mighty men, the sons of heroes, like towers. Hence early writers have erred and written, “ The angels came down from heaven, and had intercourse with mankind, and from them were born mighty men of renown.” But this is not true; they have said this because they did not understand. Now see, my brother readers, and know that this is neither in the nature of spiritual beings, nor in the nature of the impure and evil-doing demons who love adultery; for there are no males nor females among them, nor has there been even one added to their number since they fell. If the devils were able to have intercourse with women, they would not leave one single virgin undefiled in the whole human race.’ oIaAL/.a,.JIch-s&a,? mourned. Now Adam lived nine hundred and thirty years \ Some say that in the days of Seth the knowledge of books went forth in the earth; but the Church does not accept this. When Seth was two hundred and fifty years old, he begat Enos; and Seth lived nine hundred and thirteen years, and he died. Enos was two hundred and ninety years old when he begat Cainan; and Enos first called upon the name of the Lord. Some say that he first composed books upon the course of the stars and the signs of the Zodiac. Enos lived nine hundred and five years. Cainan was a hundred and forty years old when he begat Mahalaleel; and he lived nine hundred and ten years. Mahalaleel was one hundred and sixty-five years old when he begat Jared; and he lived eight hundred and ninety-five years. Jared was one hundred and sixty-two years old when he begat Enoch; and he lived nine hundred and sixty-two years. Enoch was one hundred and sixty-five years old when he begat Methuselah; and when he was three hundred and sixty-five years old, God removed him to the generation of life, that is to Paradise. Methuselah was one hundred ‘Seth became a leader to the children of his people, and he ruled them in purity and holiness. And because of their purity they received this name, which is better than all names, that they should be called the children of God. and they went up in place of that band of demons which fell from and eighty-seven years old when he begat Lamech; and he lived nine hundred and sixty-nine years. Lamech was a hundred and eighty-two years old when he begat Noah; and he lived seven hundred and seventy-seven years.
The Mishnah
These may be given to any priest: Devoted things (haramim); Firstlings; The redemption of the first born; The [lamb substituted as] ransom for the firstling of a donkey; The shoulder, the two cheeks and the maw; The first of the fleece; Oil [fit only] for burning; Consecrated food [which must be eaten] within the Temple; And bikkurim. Rabbi Judah prohibits bikkurim. Vetches of terumah: Rabbi Akiva permits, But the sages prohibit.
Ben Antigonus brought up firstlings from Babylon, but they did not accept from him. Joseph the priest brought first fruits of wine and oil, but they did not accept from him. He also brought up his sons and members of his household to celebrate Pesah katan in Jerusalem, but they turned him back, so that the thing should not become firmly fixed as an obligation. Ariston brought his first fruits from Apamea and they accepted from him, because they said, one who buys [a field] in Syria is as one who buys [a field] in the outskirts of Jerusalem.
Israelites fulfill their obligation with vow-offerings, freewill-offerings and cattle tithe. And priests with sin-offerings and guilt-offerings, firstlings, the breast and the shoulder, but not with bird-offerings, and not with meal-offerings.
All negaim may be examined by a person, except his own. Rabbi Meir ruled: not even the negaim of his relatives. All vows may be released by a person, except his own. Rabbi Judah says: not even those vows of his wife that affect relationships between her and others. All firstlings may be examined by a person, except his own firstlings.

The sin-offerings of the congregation and their burnt-offerings, the sin-offering of an individual, the guilt-offering of a nazirite and the guilt-offering of a metzora are valid from the thirtieth day onwards, and also on the thirtieth day. If they were offered on the eighth day they are valid. Vow-offerings and freewill-offerings, firstlings and the tithe of cattle and the pesach are valid from the eighth day onwards, and also on the eighth day.
The Jerusalem Talmud
HALAKHAH: Rebbi Yose, Rebbi Jacob bar Zabdi in the name of Rebbi Abbahu, Rebbi Nehemiaḥ bar Uqban turned it in the name of Rebbi Joḥanan: If someone separated first fruits from a smoothed heap, it is free from the great terumah. Rebbi Ḥaggai said before Rebbi Yose: Does not the Mishnah say so: “Forever he gives peah and it is free from tithes until he smoothes.” Hence, if he smoothed he is obligated, but this does not apply to terumah? It should say that he also is obligated for first fruits even though he did not smooth yet! But he is the one who said this: “Why are they called firstlings? Because they are first before everything else.” And anything which precedes something else, the latter is obligated for it.
MISHNAH: They established a comprehensive principle for the Sabbatical: Everything that is food for humans or animals or material for dye and cannot be preserved in the ground is subject to the Sabbatical and its proceeds are subject to the Sabbatical; it is subject to removal and its proceeds are subject to removal. What are these? This is the leaf of wild arum, mint, endives, leeks, purslain and milk bud. Animal feed, thistles and thorns. Dyestuffs, the wild growth of isatis and safflower. These are subject to the Sabbatical and their proceeds are subject to the Sabbatical; both they and their proceeds are subject to removal. They established another principle for the Sabbatical: Everything that is food for humans or animals or dyestuff and is preserved in the ground is subject to the Sabbatical; its proceeds are subject to the Sabbatical; it is not subject to removal nor are its proceeds subject to removal. What are these? These are the root of wild arum, the root of mint, ceterach, ḥalbiẓin, and wild nard. Kinds of dyestuffs: madder and campeachy-wood. These and their proceeds are subject to the Sabbatical; these and their proceeds are not subject to removal. Rebbi Meïr says, their proceeds have to be removed before New Year’s Day. They said to him, they do not have to be removed, a fortiori their proceeds. Pomegranate skins and its peduncles, nut shells, and pits are subject to the Sabbatical and so are their proceeds. The dyer dyes for himself; he should not dye for payment because one does not treat the produce of the Sabbatical as merchandise, nor firstlings or heaves, carcasses, torn animals, abominations, and crawling things. One may not buy vegetables to sell them on the market but he may collect and his son sells for him. If he bought for himself and has leftovers, it is permitted to sell them. If somebody bought a first-born animal for his son’s wedding or for a holiday and now does not need it, he may sell it. Catchers of wild animals, birds, or fish who accidentally caught impure species may sell them. Rebbi Jehudah says, even one who incidentally has such an opportunity may take and sell them on condition that this not be his profession, but the Sages prohibit it.
“But they may give free gifts to one another.” Our Mishnah is Rebbi Meїr’s since Rebbi Meїr says a gift is not like a sale. Rebbi Yose said, here it is everybody’s opinion, following what was stated: A person says to his neighbor [in Jerusalem]: What did you eat today? If that one says summer figs, he knows that it was firstling. Just as summer figs are sold cheaply, so firstlings are sold cheaply. If that one said manna, he knows that it was Second Tithe. Just as manna was given as a gift, so Second Tithe may be given as a gift. They objected: Everybody agrees that animal tithe cannot be sold; do you say it can be given as a gift? This also can be given as a gift. Rebbi Mana did not say so but was following Rebbi Jehudah since Rebbi Jehudah said He made it one’s property. They objected: Everybody agrees that animal tithe is not one’s property; do you say it can be given as a gift? This also can be given as a gift.
Rebbi Yose in the name of Rebbi Joḥanan: An animal of Second Tithe in Jerusalem following Rebbi Meїr is free from the rules of firstlings; following Rebbi Jehudah it is under the rules of firstlings. Rebbi Jeremiah asked before Rebbi Zeïra: If it gave birth to a firstling, must its sacred parts be brought onto the altar? Did not its sacred parts fall under the rules of Second Tithe and you would hide it from being eaten? He said to him, if somebody bought meat as meat of desire, would not [the holiness of] Second Tithe have fallen on its sacred parts, would you not hide it from being eaten? He said to him, when it was bought, the holiness of tithe left it. Rebbi Yose said, we were not saying so but the Torah did permit to buy from tithe money only well-being sacrifices exclusively. What is the difference between them? If it gave birth to a firstling and he dedicated it as well-being sacrifice. For him who says, the Torah did permit to buy from tithe money only well-being sacrifices exclusively, it is offered. For him who says, when it was bought, the holiness of tithe left it, and it is not offered.

It was stated: “One does not buy Sabbatical [produce] with tithe money.” Rebbi Yose said, that is a disagreement. Rebbi Jonah said, that is the opinion of everybody. The eaters of heave are careful. Rebbi Ḥananiah objected before Rebbi Mana: Did we not state: “If they were mingled with firstlings, Rebbi Simeon says, if it is a company of Cohanim they should be eaten.” And we have stated on that, they should be eaten following the more stringent rules. He said to him, eaters of the Pesaḥ sacrifice in its time are as careful as the eaters of heave. You should know that this is so since we have stated: “One roasts meat, onion, or egg only that they should be roasted”, but we have stated: “One lowers the Pesaḥ sacrifice into the oven at nightfall.”
MISHNAH: Jews were sharecroppers for Gentiles in Syria; Rebbi Eliezer obligates their produce for tithes and the Sabbatical but Rabban Gamliel exempts them. Rabban Gamliel says there are two ḥallot in Syria but Rebbi Eliezer says one ḥallah. They took the leniency of Rabban Gamliel and the leniency of Rebbi Eliezer but then returned to follow Rabban Gamliel in both cases. Rabban Gamliel says: There are three domains for ḥallah. The Land of Israel up to Akhzib, one ḥallah. From Akhzib to the Euphrates or Amanus, two ḥallot, one for the fire and one for the Cohen. The one for the fire has a measure, the one for the Cohen has no measure. From Euphrates or Amanus inside, two ḥallot, one for the fire and one for the Cohen. The one for the fire has no measure, the one for the Cohen has a measure but a ṭevul yom may eat it. Rebbi Yose says one does not need immersion. But it is forbidden to people suffering from genital flux, and to women during menstruation or after childbirth. It may be eaten at one table with a layman and may be given to any Cohen. The following may be given to any Cohen: ḥērem-dedications, firstlings, the redemption money for a [firstborn] son, the redemption value of a firstling donkey, foreleg, jawbone, and first stomach, the first shearing, oil to burn, Temple sacrifices, and First Fruits. Rebbi Jehudah forbids First Fruits. Heave vetch Rebbi Aqiba permits but the Sages forbid.
Some of them are given to the people of the watch; some of them are given to any Cohen. Firstlings and First Fruits to the people of the watch; all others to any Cohen. Rebbi Jeremiah asked before Rebbi Zeïra, from where that ḥērem-dedications are for the people of the watch? He said to him: (Lev. 27:21) “Like the ḥērem-dedicated field it shall become the property of the Cohen.” From where that the property itself should be given to the people of the watch? Because it is written “it shall become the property of the Cohen.” (From where that ḥērem-dedications are for the people of the watch?) But is it not written: (Deut. 18:3) “He shall give to the Cohen foreleg, jawbone, and first stomach,” should it not be for the people of the watch? Rebbi Aḥa, Rebbi Abbahu in the name of Rebbi Joḥanan: (Lev. 27:28) “Every ḥērem-dedication shall be most holy to the Eternal.” Just as most holy sacrifices are for the people of the watch, so ḥērem-dedications are for the people of the watch!
24 gifts were given to Aaron and his sons, ten in the Temple, four in Jerusalem, and ten in the countryside. These are the ten in the Temple: Purification offering, reparation offering, public well-being offerings, purification offering of a bird, the reparation offering for suspected guilt, the log of oil of the skin-diseased, the two breads, the shew-bread, the remainders of cereal offerings, and the ‘omer. These are in Jerusalem: Firstlings, First Fruits, what was lifted from thanksgiving sacrifices and from the nazir’s ram, and the skins of sacrifices. These are in the countryside: Heave, Heave of the Tithe, ḥallah, foreleg, jawbone, and first stomach, the first shearing, robbery of the proselyte, redemption of the firstborn, redemption of the firstborn donkey, ḥērem-dedications, and fields of inheritance.
MISHNAH: Nittai from Tekoa brought ḥallot from Baithur but they did not accept from him. The people of Alexandria brought their ḥallot from Alexandria but they did not accept from them. The people from Hyena Mountain brought their First Fruits before Pentecost but they did not accept from them because of the verse in the Torah: (Ex. 23:16) “The pilgrimage holiday of harvest, the First Fruits of your work from sowing the field.” Ben-Atitas brought firstlings from Babylonia and they did not accept them. Joseph the Cohen brought his First Fruits as wine and oil and they did not accept them. He also brought his children and members of his household to make the second Passover in Jerusalem but they turned him back so as not to create a precedent for the future. Ariston brought his First Fruits from Apamea and they accepted them for they said, he who buys in Syria is like him who buys in the suburbs of Jerusalem.
The rabbis of Caesarea said, of those which they decided there were seven of those where they had a majority. The others are the following: A person being on the road when it gets dark gives his wallet to a Non-Jew. Similarly, the male sufferer from gonorrhea should not eat with a female sufferer from flux because of inducement to sin. All movables transmit impurity by the thickness of the yoke. How one harvests grapes on a broken field. One who puts vessels under the pipe. For six doubts one burns heave. Rebbi Yose ben Rebbi Abun said, also the growth of heave. The following they decided: the first ten and the remainder from what Rebbi Simeon ben Yoḥai stated: On that day they decided about their bread, and their cheeses, and their wine, and their vinegar, and their fish brine, and their muries, and their preserves, and their parboiled food, and their corned food, and on split grain, and on ground food, and on peeled barley, on their speech, and on their testimony, and on their gifts, on their sons, and on their daughters, and on their firstlings.
If he transgressed and sold one fines him. Just as one fines for practice so one fines for custom. From where that one fines for custom? A person sold his camel to an Aramean. The case came before Rebbi Simeon ben Laqish who fined him double to make him take back the camel. Rebbi Yose ben Rebbi Abun said, they fined the broker and called him son who brokers to an Aramean. Does Rebbi Simeon ben Laqish follow Rebbi Jehudah? As it was stated in the name of Rebbi Jehudah: “If somebody buys an animal from a Gentile and it gave birth to a firstling, he buys it up to its worth and gives half of its worth to a Cohen. If it was given to him as contractor, he has to pay for up to ten times its worth and gives all of its worth to the Cohen. But the Sages say, since the finger of the Gentile in involved it is no longer liable as firstling.” Rebbi Simeon ben Laqish follows Rebbi Jehudah and says more than Rebbi Jehudah. What Rebbi Jehudah said because of the practice of firstlings; but what Rebbi Simeon ben Laqish said because of practice regarding a large animal.
MISHNAH: If a Pesaḥ was mingled with sacrifices, all of them shall graze until they become unusable, then be sold, and for the value of the best among them he shall bring one of each kind and lose the difference on his account. If it was mingled with firstlings, Rebbi Simeon says, if it is a company of priests, they shall eat.
HALAKHAH: It was stated: “One does not buy Sabbatical [produce] with tithe money.” Rebbi Yose said, that is a disagreement. Rebbi Jonah said, that is the opinion of everybody. The eaters of heave are careful. Rebbi Ḥananiah objected before Rebbi Mana: Did we not state: “If they were mingled with firstlings, Rebbi Simeon says, if it is a company of Cohanim they should eat.” And we have stated on that, they should be eaten following the more stringent rules. You should know this since we have stated: “One roasts meat, onion, or egg only that they should be roasted“, but we have stated: “One lowers the Pesaḥ into the oven at nightfall.”
MISHNAH: The limbs of the daily sacrifice are deposited on the lower part of the ramp to the West, those of the musaf sacrifices on the lower part of the altar. Those of the days of the New Moon on the rim on the top of the altar. Sheqalim and First Fruits apply only if there is a Temple, but tithes of grain, and tithes of animals, and firstlings, apply whether there is a Temple or there is no Temple. If somebody dedicates sheqalim or First Fruits, they are sanctified. Rebbi Simeon says, even if somebody designates First Fruits as holy, they are not holy.
Rebbi Eleazar and Rebbi Yose ben Ḥanina. Rebbi Eleazar said, the Sons of Noah brought well-being offerings. Rebbi Yose ben Ḥanina said, the Sons of Noah brought elevation offerings. Rebbi Eleazar objected to Rebbi Yose ben Ḥanina: Is it not written, and Abel also brought from the firstlings of his sheep and of their excellence. What does Rebbi Yose ben Ḥanina do with this? From their luxurious ones. Rebbi Eleazar objected to Rebbi Yose ben Ḥanina: Is it not written, he sent the young men of Israel and they offered elevation offerings, etc.? What does Rebbi Yose ben Ḥanina do with this? Entire in their bodies, without stripping and partitioning. Rebbi Eleazar objected to Rebbi Yose ben Ḥanina: [Is it not written, Jethro, Moses’s in-law, took elevation and well-being offerings for God?] What does Rebbi Yose ben Ḥanina do with this? Following him who said that Jethro came after the giving of the Torah. Rebbi Ḥuna said, Jehudah the great one and Rebbi Yannai disagreed. One said, Jethro came before the giving of the Torah; but the other one said, Jethro came after the giving of the Torah. We did not know who said what. Let us hear from the following: Jethro, the priest of Midyan, Moses’s in-law, heard. What did he hear? Ḥizqiah said, he heard the parting of the Reed Sea. Rebbi Joshua said, he heard the parting of the Reed Sea. [Rebbi Levi said, he heard the war of Amaleq.] The Great Jehudah said, he heard the giving of the Torah. Therefore he must be the one who said, Jethro came after the giving of the Torah. Rebbi Abba and Rebbi Ḥiyya in the name of Rebbi Joḥanan, the following supports Rebbi Yose ben Ḥanina: Awake North, and come South. Awake North refers to the elevation sacrifice which is slaughtered in the North. What means “awake”? What was sleeping and awoke. And come South refers to well-being sacrifices which are slaughtered in the South. What means “come”? Something new. What does Rebbi Yose ben Ḥanina do with this? When the diasporas in the North awake and build the Temple in the South. Rebbi Abba the son of Rebbi Pappai, Rebbi Joshua from Sikhnin in the name of Rebbi Levi: also the following verse supports Rebbi Yose ben Ḥanina: This is the teaching about the elevation sacrifice. This is the elevation sacrifice which the Sons of Noah were sacrificing. When he comes to well-being sacrifice he says, this is the teaching about the well-being sacrifice. It is not written “which one brought” but shall bring from now on..
MISHNAH: Israel fulfill their obligation with vows, and voluntary gifts and animal tithe, and the Cohanim with purification sacrifices, and reparation sacrifices, and breast and thigh, and firstlings, but not with birds or cereal sacrifices.
May one appoint Elders for selected topics? Let us hear from the following: Rebbi appointed Rav to invalidate vows and to see stains. After his death, he asked his son for {permission to judge} defects of firstlings. He said to him, I shall not add to what my father gave you. Rebbi Yose ben Rebbi Abun said, he gave him everything: To sit in judgment alone, to invalidate vows, to see stains, and to see outside blemishes. After his death, he asked his son for {permission to judge} hidden defects. He said to him, I shall not add to what my father gave you. Even though you say, one appoints Elders for selected topics, only if he is competent for everything. As the following: Rebbi Joshua ben Levi ordained all his students, but he was sorry about one who (had a defect in his) [had a running] eye and he could not ordain him; could he not have ordained him for selected topics? That implies (that one who is competent in one thing has to be competent in everything, even for one thing he is not competent) [one who is competent in everything is competent in one thing but one who is not competent in everything cannot be declared competent in one thing.]
If she was seen going to a secluded place by one witness in the morning and by one witness in the evening, it is to be treated like the following: “If she was together alone with him by the testimony of two witnesses, she needs a second bill of divorce from him; if there was a single witness she does not need a second bill of divorce from him. With one witness in the morning and one witness in the evening, such a case happened and Rebbi Eleazar ben Thaddeus asked the Sages, who told him that this is not being together alone.” If he declared his jealousy before one witness in the morning and before one witness in the evening; since he is a man and she is a woman, his declaration is nothing. Or is it to be treated like the following: “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥah says, even if they saw it one after the other.” Rebbi Jeremiah, Rebbi Samuel bar [Rav] Isaac in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥah with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah. The same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and the other says, I saw two hairs on his back. If one says, I saw one hair on her back and the other says, I saw one hair on her back, that is nothing; similarly on his back and on his back. If two say, we saw one hair on his back and two others say, we saw one hair on his belly? Rebbi Yose ben Rebbi Abun and Rebbi Hoshaia the son of Rebbi Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe they were rubbed off. Two say, we saw one hair on his back and two others say, we saw one hair on his belly. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Abba said, everybody agrees that this is valid. Rebbi Yudan said, this is in disagreement; Rebbi Yose said, this is in disagreement. Rebbi Yose said, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mana said, Rebbi Ḥaggai was correct. If a document was signed by four witnesses and it was disputed, if one person verified the signature of two [witnesses] and another that of the other two, is that worth anything? Does not every single signature need two witnesses? And here, every single hair needs two witnesses. Rebbi Ḥanania learns it from the years of squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another [witness] testified that he ate from it the fourth, fifth, and sixth, is that worth anything? Does not every single year need two witnesses? And here, ever single hair needs two witnesses.

As the following: Rebbi Joshua ben Levi ordained all his students, but he was sorry about one who had a defect in his eye and he could not ordain him; so he ordained him for selected topics. That implies that one who is competent in one thing has to be competent in everything, and one who is not competent in everything cannot be declared competent in one thing.
Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and the other says, I saw two hairs on his side. If one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his side. Two are saying, we saw one hair on his back; and two are saying, we saw one hair on his belly. Rav Yose and Rav Hoshaia ben Rav Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe they were rubbed off. One says, two hairs on his back; and one says, two on his belly. Rebbi Abba said, everybody agrees that this is valid. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Yose said, this is in disagreement. Rebbi [Yose] said to Rebbi Ḥaggai, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mama said, Rebbi Ḥaggai was correct. If a document was signed by four seals, if one person verified the signature of two [witnesses], and another those of the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single hair needs two witnesses. Rebbi Ḥinena learns it (because of) [from the years of] squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth, fifth, and sixth years, is that worth anything? Does not every single year need two witnesses? And here, every single hair needs two witnesses.
Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah, Rebbi Samuel ben Rav Isaac in the name of Rav Isaac who said in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his back. Rebbi Yose ben Rebbi Bun and Rebbi Hoshaia ben Rebbi Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. If a document was signed by four seals, if one person (permitted) two, and another (questioned) the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single sign needs two witnesses. Rebbi Ḥanina learns it from the years of squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth and fifth years, is that worth anything? Does not every single year need two witnesses? And here, every single sign needs two witnesses.
If he transgressed and sold one fines him. Just as one fines for practice so one fines for custom. From where that one fines for custom? A person sold his camel to an Aramean. The case came before Rebbi Simeon ben Laqish who fined him double to make him take back the camel. Rebbi Yose ben Rebbi Abun said, they fined the broker and called him son who brokers to Arameans. Does Rebbi Simeon ben Laqish follow Rebbi Jehudah? As it was stated in the name of Rebbi Jehuda: “If somebody buys an animal from a Gentile and it gave birth to a firstling, he buys it up to its worth and gives half of its worth to a Cohen. If it was given to him as contractor, he has to pay for up to ten times its worth and gives all of its worth to the Cohen. But the Sages say, since the finger of the Gentile in involved it is no longer liable as firstling.” Rebbi Simeon ben Laqish is more than Rebbi Jehudah. What Rebbi Jehudah said because of the practice of firstlings; but what Rebbi Simeon ben Laqish said because of practice regarding a large animal.
Rebbi Joḥanan said, this follows Rebbi Simeon, since Rebbi Simeon said, the child was dissolved before it came out. Rebbi Joḥanan said, Rebbi Simeon agrees that he causes his mother the days of birth. Then the house should be impure? Rebbi Abun bar Ḥiyya said, explain it if it came out partially dissolved. Rebbi Simeon said to the Sages: Do you not agree with me that if the basin is carried from the inner to an outer room it is pure? They said to him, because it becomes scrambled. He said to them, this one is already scrambled. What is the rule about vessels which were there at the time of delivery? Let us hear from the following which we stated there: “Rebbi Eliezer ben Jacob says, if a cow brought forth a cake of blood, that should be buried and she is freed from the rule of firstlings.” It was stated on this: It does not bring impurity by being carried. Rebbi Joḥanan said, Rebbi Simeon and Rebbi Eliezer ben Jacob said the same thing. This implies that vessels which were there at the time of delivery are pure.
The Babylonian Talmud
On the last day of the festival we read, “All the firstlings” [but first we read] the commandments and statutes [which precede it], and then “all the firstlings” (Deuteronomy 15:19-16:17) and for haftarah, “And when Solomon had finished” (I Kings 8:54-9:1). On the next day we read, “And this is the blessing” (Deuteronomy 33:1-34:12), and for haftarah, “And Solomon stood” (I Kings 8:23-53).
