HALAKHAH: “If one stole a lamb from the flock,” etc. Rebbi Joḥanan said, if the owners knew of the theft, they have to be notified of the return. If they did not know of the theft, they do not have to be notified of the return. Rebbi Simeon ben Laqish said, even if they did not know of the theft, they have to be notified of the return. Rebbi Eleazar said, if it was similar to the case of a ram, they do not have to be notified of the return. What means “similar to the case of a ram”? Some say, the shepherd’s staff. Some say, a pandura. Some say, the bell-wether.
HALAKHAH: “If somebody saw a find” etc. Rabbi Simeon ben Laqish said [in the name of] Abba Cohen bar Delaiah: A person acquires a find within four cubits from himself. Rebbi Joḥanan said, only if it fell into his hand. A Mishnah disagrees with Rebbi Simeon ben Laqish: “If he took some of the peah and threw it on the rest, he has nothing of it.” He answered: Explain it if the did not say that his four cubits should acquire it for him. But does it not say afterwards: “If he fell on it or spread his talith on it, one removes him from it?” That is the same, if he did not say that his four cubits should acquire it for him. But did not Rebbi Ḥiyya state: “If two were pushing one another because of a sheaf and another poor person came and grabbed it from before them, he is entitled to it.” It is the same; he did not say that his four cubits should acquire it for him. But did we not state: “If somebody saw a find and fell upon it when another person grabbed it, the one who grabbed it acquired it.” It is the same, he did not say that his four cubits should acquire it for him. But did we not state: “If it landed close to her it is a bill of divorce, close to him it is no bill of divorce, half and half she is divorced and not divorced.” Ḥizqiah said, the Mishnah speaks of the scribe’s fee. They objected: Is it not written: “I in my poverty did prepare”? How is that? If it was in his possession, he was rich. If it was not in his possession, how can a person dedicate what is not his? It must be that it was within four cubits from him. Rebbi Abin said, what means “in my poverty?” That there is no wealth before Him Who commanded and the world came into existence! Another explanation: he fasted and donated the price of his meal to Heaven.

HALAKHAH: “The find of his small son or daughter,” etc. Rebbi Joḥanan said, only if they are not dependent on their father. But if they are dependent on their father, their finds belong to the latter. Rebbi Simeon ben Laqish says, a person cannot acquire a find for another. Rebbi [Hila] said: Not that Rebbi Simeon had formulated thus, but he had a problem with what Rebbi Hoshaiah stated: If a person hires a worker for any work, the latter’s finds belong to the employer. Rebbi Simeon ben Laqish said, should the finds of a person who can resign at any moment belong to his employer?

HALAKHAH: “Silver acquires gold,” etc. This is a summary of the matter: Anything worth less that the other acquires the other. Rebbi Ḥiyya bar Ashi said, who stated this? Rebbi Simeon ben Rebbi. His father told him, change your opinion and state the following: “Gold acquires silver.” He told him, I do not change my opinion since when your faculties were unimpaired, you instructed me to state: “Silver acquires gold.” The word of Rebbi implies that gold is like produce. The Mishnah implies that silver is like produce. [Rebbi Ḥiyya’s baraita implies that gold is like produce, but his word implies that silver is like produce, as in the following:] The elder Rebbi Ḥiyya’s daughter lent denars to Rav. She came and asked her father, who told her: Take from him good and full weight denars. Do we learn from Rebbi Ḥiyya’s daughter? Rebbi Idi said, also Abba, Samuel’s father, asked before Rebbi: May one lend denars against denars? He answered him, it is permitted. Rebbi Jacob bar Aḥa said, also Rebbi Joḥanan and Rebbi Simeon ben Laqish both instruct: It is permitted to lend denars against denars. Qerat against qerat is permitted, lekan against lekan is forbidden.
Rebbi Simeon ben Laqish said, “or buying from your neighbor’s hand”, from you neighbor’s hand you need an act of acquisition; you do not need an act of acquisition from the Gentile’s hand. In Rebbi Simeon ben Laqish’s opinion, why does one deliver a person to “Him Who exacted retribution”? Rebbi Yose ben Rebbi Abun said, it follows the Tanna who stated: “Nobody dealing in words only may one deliver to “Him Who exacted retribution”.

It was stated: “Rabban Simeon ben Gamliel said, one invests in improving a field and does not worry about interest. How is this? One leased a field for ten kor of wheat and said to him, give me a tetradrachma and I shall give you twelve kor at threshing time, it is permitted.” Rebbi Joḥanan said, because the field may bring an extraordinary yield. Rebbi Simeon ben Laqish said, it is as if he increased the rent for the field. What is the difference between them? A store or a ship. According to him who said, because the field may bring an extraordinary yield, one invests in a store or a ship. According to him who said, it is as if he increased the rent for the field, one may not invest in a store or a ship. Rebbi Jacob bar Aḥa said, they disagree explicitly: Rebbi Joḥanan said, one invests in a store or a ship. Rebbi Simeon ben Laqish said, one may not invest in a store or a ship, nor in anything which is not invested in the object itself.

HALAKHAH: “One does not contract for produce,” etc. May one contract based on Saracens’ rates? Rebbi Joḥanan says, one may contract; Rebbi Simeon ben Laqish said, one may not contract. Rebbi Abun bar Ḥiyya asked before Rebbi Ze‘ira: Would it not be reasonable that Rebbi Simeon ben Laqish agree with Rebbi Joḥanan about rates of Saracens of Sepphoris, since that is uninterrupted? Rebbi Abun bar Cahana said, I am wondering about what the rabbis disagree? Whether contracting for produce, or contracting for money, or a loan on produce? Rebbi Jeremiah said, they disagree about a loan, but about (a hostelry) [a contract] everybody agrees that it is forbidden. Rebbi Yose said, they disagree about a contract, but about a loan everybody agrees that it is permitted. In the House of Rebbi Yannai they said, one contracts for cattle feed. Rebbi Yose ben Ḥanina said, also on honeycombs. Rebbi Joḥanan said, in all villages near Tiberias one contracts once the rate was established at Tiberias.

“If he was the first to harvest, he may contract for the stack of sheaves,” etc. Rav said, if one processing stage was missing, one may contract; if several processing stages were missing, one may not contract. Rebbi Joḥanan and Rebbi Simeon ben Laqish both say, even if several processing stages were missing, one may contract. But the Mishnah disagrees with Rav: “If he was the first to harvest,” etc.
HALAKHAH: “He who leases a dwelling to another person,” etc. Rebbi Simeon ben Laqish said, if he puts him into it. Rebbi Joḥanan said, if he told him, a dwelling like this I shall lease to you. But if a person leasing a house wants to sell it? Rebbi Immi said, nobody thinks that this one should die of hunger. Rebbi Ze‘ira and Rebbi Hila both say, while certainly it is acquired by him, he has to tell him, let him dwell there until the time of his recall. There came a case before Rebbi Nisi and he did not accept this. Does he disagree? They said, his daughter was given as a pledge to a Roman [and he did not have the wherewhithal to redeem her and Rebbi Assi instructed to sell;] therefore he instructed following Rebbi Immi.
HALAKHAH: “If one contracts with another for a field,” etc. It was stated: “One contracts with another for a field; he sowed it a first year and it did not grow; one forces him to sow a second year. If the second time it did not grow, one cannot force him to sow a third year.” Rebbi Simeon ben Laqish said, that is, a field which had not been checked out. But if it had been checked out, one can force him to sow a third year.
“In his time the hireling swears and takes.” Rebbi Simeon ben Laqish said, if he said: I paid. But if he said, I shall pay tomorrow: if then he said, I paid, he cannot be believed. Rebbi Yose ben Ḥanina said, even the next day, if he said, I paid, he is believed.
“Rebbi Yose says, the lower one contributes the roofing and the upper one the roof covering,” etc. Rebbi Justus in the name of Rebbi Simeon ben Laqish:: The bottom dweller contributes the logs and the planks; the dweller on the upper floor contributes the roof covering. Which kind of roof covering? Rebbi Jacob bar Aḥa in the name of Rebbi Eleazar: heavy roof covering. Rebbi Abbahu in the name of Rebbi Eleazar: medium roof covering, since they only spoke about rinsing cups. But if he wanted to wash clothing, also Rebbi Abbahu in the name of Rebbi Eleazar will agree that the roof covering has to be heavy. Rebbi Ḥanina instructed those of Sepphoris that both of them should contribute the logs and the plates since they expect to bring up there their wine and their produce.
HALAKHAH: “Two vegetable gardens,” etc. What shall one do? Ephraim in the name of Rebbi Simeon ben Laqish said, they shall split. In the House of Rebbi Yannai they say, up to ten handbreadths. Rebbi Joḥanan said in the name of Rebbi Yannai: Only he shall not force himself.
Simeon bar Abba in the name of Rebbi Joḥanan: If someboldy is selling a house to another, when he delivered the key [the buyer] took possession. Rebbi Immi in the name of Rebbi Joḥanan: If somebody is selling a house to another, when [the buyer] stored produce there, he took possession. Rebbi Samuel bar Rav Isaac said, only produce usually stored. Rebbi Joḥanan in the name of Rebbi Yannai: If somebody is selling a cistern to another, when he handed over its pails [the buyer] took possession. Rebbi Joshua ben Levi in the name of Rebbi Simeon ben Laqish: If somebody sold a flock to another person, when [the seller] delivered the maškokît, [the buyer] took possession. What is maškokît? Some say, the shepherd’s staff. But some say, a pandura. And some say, the bell-wether. Rebbi Simeon ben Laqish in the name of Bar Qappara: If somebody is selling a burial chamber to another, when that one buried there one dead it is confirmation of claim for the entire chamber. When he buried three dead in three chambers, it is confirmation of claim for the entire burial cavern.
“Sharecroppers.” Rav Huna said, a permanent sharecropper, but a temporary sharecropper has a claim of undisturbed possession. Rebbi Joḥanan and Rebbi Simeon ben Laqish both teach that even a temporary sharecropper has no claim of undisturbed possession, for we may say that he is satisfied with him and let him have it. There, they say that a sharecropper has no claim of undisturbed possession but a sharecropper’s son has a claim of undisturbed possession; Rebbi Joḥanan and Rebbi Simeon ben Laqish say, neither a sharecropper nor a sharecropper’s son have a claim of undisturbed possession, for we may say that he was satisfied with his father and let the son have it. As Rebbi Joḥanan said, a sharecropper who engaged another sharecropper has no claim of undisturbed possession since it is common for sharecroppers to engage sub-sharecroppers.

HALAKHAH: “The drain pipe does not represent a right of possession.” Rebbi Simeon ben Laqish said, to lengthen and to widen it. Rebbi Joḥanan said, in all of that direction, as we have stated: the leader has a domain of four cubits. You have to say, in all this direction. Similarly, the drain tube does not represent a right of possession in all of this direction. It was stated thus: “The location of the drain tube does represent a right of possession, the location of its spout does not represent a right of possession.”
HALAKHAH: “One makes no hollow,” etc. If they collapsed and he wants to rebuild. Rebbi Joḥanan said, he gave up his rights. Rebbi Simeon ben Laqish said, he did not give up his rights. A Mishnah supports one, a baraita supports the other. A Mishnah supports Rebbi Joḥanan: “If a public road went through somebody’s field and he took it and gave them on the side. What he gave, he gave, but his own did not come to him.” A baraita supports Rebbi Simeon ben Laqish: “If somebody bought a courtyard and there are protrusions and balconies, if they collapsed he rebuilds them based on his right of possession.”

HALAKHAH: “Both son and daughter are equal for the rules of inheritance,” etc. It is written: “Of anything which will be found with him,” etc. How could he inherit the expectancy like existing property? How? If his father died during his father’s father’s lifetime, he takes a double portion of his father’s estate but not a double portion of his grandfather’s estate. But if his father was a firstborn, just as he takes from his father’s estate so he takes from his grandfather’s estate. Rebbi Simeon ben Laqish in the name of Abba [Cohen] bar Delaiah: It was said “a rule of law” in the matter of a double portion just as it was said “a rule of law” in the matter of a single portion. Since for a single portion one considers the son as if he were alive to take his father’s single portion so for a double portion one considers the son as if he were alive to take his father’s double portion.
There, we have stated: “Rabban Simeon ben Gamliel said, if she dies, he should inherit from her since he made a condition contradicting what is written in the Torah.” Rav Jeremiah in the name of Rav: “Since he made a condition contradicting what is written in the Torah and anybody’s condition contradicting what is written in the Torah is invalid”? Conditions other than for money matters. But here we are dealing with a money matter! What is Rav’s reason? Because in the end he acquired it. Rebbi Joḥanan said, practice follows Rebbi Joḥanan ben Beroqa, for Rebbi Joḥanan said, if she sold or gave away, the rule should be that it is valid. Then why did they say that her sale is invalid? Lest she smuggle away her properties from her husband and say, they are mine. Rebbi Justinus had a case before the rabbis and they obligated him. He came before Rebbi Simeon ben Laqish who told him, enter your properties. Rebbi Jeremiah asked before Rebbi Ze‘ira: Did not Rav say, because in the end he acquired it. Did not Rebbi Joḥanan say, practice follows Rebbi Joḥanan ben Beroqa? Did not Rebbi Simeon ben Laqish say, go and enter your properties? Who are these rabbis? The rabbis of Rebbi Justinus.

It was stated: “Rebbi Simeon ben Gamiel says: A will invalidates a will, a gift does not invalidate a gift.” Rebbi Abba bar Ḥana: Rebbi Joḥanan and Rebbi Simeon ben Laqish both are saying that in any case where he can invalidate his will if he recuperates, he also can repeal his gift. As the following: Rebbi Onias’s sister wrote her property over to Rebbi Onias. She needed money and sold it to her husband. After she died, he came to protest against him. He asked him, why did you not claim it during her lifetime? He answered, I did not want to cause her pain. Nevertheless, Rebbi Immi removed it.
HALAKHAH: “Somebody who lent to another by a document,” etc. Rav Huna said, predating is invalid but the document is valid. But did we not state: “A predated prozbol is valid, postdated it is invalid”? That means, Rav Huna, Rebbi Eleazar, and Rebbi Simeon ben Yaqim. Rav Huna, quoted here. “Rebbi Eleazar said, it is valid even if there are no signatures of witnesses on it if only he delivered it in the presence of witnesses; and she can use it to collect from encumbered property. For the witnesses sign on the bill of divorce only for the public good.” How? If about those who denied their testimony, the denied testimony is as if nonexistent, and the document should be valid? If about those who did not deny their testimony, did not Rebbi Simeon ben Laqish say, that they considered witnesses who signed a document as if their testimony had been cross-examined in court? What about it: As one formulates, “I, X ben Y, am taking a loan from you, Z, and U is guarantor.”
Rav said, one has to mention the earlier date in the second document. But Samuel said, one does not have to mention the earlier date in the second document. Rav and Samuel, Rav parallels Rebbi Joḥanan and Samuel parallels Rebbi Simeon ben Laqish.
Samuel said, if two men acted as judges, their judgment stands, but they are called an insolent court. Rebbi Joḥanan and Rebbi Simeon ben Laqish both are instructing: Even if two men acted as judges, their judgment is no judgment. There, we have stated: “If he rendered judgment, acquitted the guilty and condemned the innocent, declared the pure impure or the impure pure, what he did is done but he has to pay from his own pocket.” Rebbi Abba in the name of Rebbi Abbahu: if they told him, we accept you as if you were two. What are we dealing with? If his error was that he judged them on his discretion, then what he did is done. If his error was that he judged them by Torah law, why should he pay from his own pocket? Rebbi Abba in the name of Rebbi Abbahu: if they told him, we accept you as if you were three on condition that you judge us by Torah law. He erred and judged them on his discretion. What he did is done, but since he erred and judged them on his discretion, he has to pay from his own pocket because he was presumptuous to judge alone by Torah law, as we have stated: “Do not judge sitting alone, for only One judges sitting alone.”
What is the seal of the Holy One, praise to Him? Rebbi Bevai in the name of Rebbi Reuben, “true.” What means “true”? Rebbi Abun said, that He is a Living Power and the King of this World. Rebbi Simeon ben Laqish said, א is the start of the alphabet, מ the middle, and ת the end. To say, I, the Eternal, am First, I did not receive anything from another. Besides Me there is no supreme power, for I have no co-owner. And with the last, I shall be, I shall not in the future turn it over to anybody else.
“Rebbi Jehudah ben Laqish said: If two people appeared before a judge, one decent and one agressive. Before he started to hear their arguments, he may tell them, I will not hear your case, lest the agressive one lose his case and become his enemy. After he started hearing their arguments, he may not tell them, I will not hear your case, for it is said, do not be afraid of anybody.
They preferred an old man to Rebbi Simeon ben Laqish for intercalation but had to remove him by the other door. He said, this is their reward. Did he not hear what Rebbi Crispus said in the name of Rebbi Joḥanan: It happened that the year was intercalated by three cow hands. One said, in Adar, early and late grain sprout together. One said, in Adar the ox will die naked and try to strip off his hide under the fig tree. One said, if in Adar the East wind blows, open your jaws and go towards it. And we see that this year nothing of these applies. They intercalated the year on their word. Rebbi Ḥelbo said, because the Court agreed with them. Rebbi Zeˋira said, but they all have to agree to the same reason. But since they all agree with one another it was that they all agreed as to the reason.
Why was Rebbi Simeon ben Laqish offended by this? He was worried about what Rebbi Eleazar said, since Rebbi Eleazar said: My hand will be against the prophets who see … vain things, in my people’s councilthey shall not be; that is [the secret of] intercalation; in the documents of the House of Israel they will not be inscribed; that is ordination; and to the earth of Israel they shall not come; that is the Land of Israel. When Rebbi Eleazar came here, he said, I have one. When they ordained him, he said, I have two. When he was asked to participate in the intercalation, he said, I have all three [with me].
Rebbi Eleazar said, if a High Priest sinned, one whips him but does not remove him from his elevated status. Rebbi Mana said, it is written: For the crown of his God’s ointment is on him, I am the Eternal; if one could compare it, just as I am in My Sanctity, so Aaron is in his sanctity. Rebbi Ḥanina the scribe, Rebbi Aḥa in the name of Rebbi Simeon ben Laqish: if a High Priest sinned, one whips him. If you would say by 23, his elevation would be his degradation. And Rebbi Simeon ben Laqish said, if a patriarch sinned, one whips him by a court of three [judges]. Does one return him? Rebbi Haggai said, by Moses, if one would return him, he would kill them. Rebbi Jehudah the Prince heard this and became angry. He sent Goths to catch Rebbi Simeon ben Laqish. They beat him. He fled to Magdala, some say to Kefar Ḥiṭṭim. The next day, Rebbi Joḥanan went to the assembly hall, when Rebbi Jehudah the Prince also went to the assembly hall. He said to him, why is the master not telling us words of instruction? He started clapping with one hand. He asked, does one clap with one? He answered him, no, but without ben Laqish there is nothing. He told him, I shall free him. He said to him, in Magdala. He told him, tomorrow I and you will go out to meet him. Rebbi Joḥanan sent to Rebbi Simeon ben Laqish, prepare for yourself some words of instruction since the Patriarch will go out to meet you. He went out to meet them and said, your example is similar to that of your Creator. For when the Merciful went to liberate Israel [from Egypt], He sent neither messenger nor angel but He went Himself, as is written: I shall pass through the Land of Egypt, He and all His Court. He asked him, why did you say these things? He told him, what are you thinking? That for fear of you I would refrain from the teachings of the Merciful? As Rebbi Samuel ben Rav Isaac said, No my sons, because the reputation is not good.

“The High Priest sacrifices while in deep sorrow but does not eat, the words of Rebbi Meïr; Rebbi Jehudah says, the entire day. Rebbi Simeon says, he completely finishes the service he is engaged in and then leaves.” Between Rebbi Meïr and Rebbi Simeon there is one [difference], between Rebbi Jehudah and Rebbi Simeon there is one [difference]. Between Rebbi Meïr and Rebbi Jehudah is entering. Rebbi Jacob ben Dositheos: interruption is between them. Rebbi Meïr says, if he was inside, he leaves; if he was outside, he did [not] enter. Rebbi Jehudah says, if he was inside, he enters; if he was outside, he did not enter. Rebbi Simeon says, he completely finishes the service he is engaged in and then leaves. Rebbi Yose ben Rebbi Abun in the name of Rav Huna: a baraita is from Rebbi Simeon ben Laqish: The Sanctuary he shall not leave, he may not leave with them, but he may leave after them. If they are unseen he can be seen; he leaves with them up to the city gate, the words of Rebbi Meïr; Rebbi Jehudah said, he does not leave the Temple since it is said: The Sanctuary he shall not leave. If he left, he may not return.”
And silver and gold he shall not add excessively, and it is written: The king made silver in Jerusalem to be like stones. Were they not stolen? Rebbi Yose ben Ḥanina said, they were stones of ten cubits and eight cubits. Rebbi Simeon ben Laqish stated: In Solomon’s times, even weights were not of silver but of gold. Why? Silver was not valuable in Solomon’s times.
Yose from Maon interpreted in the synagogue of Tiberias: Listen to this, you priests, why do you not study Torah? Did I not give you 24 gifts? They told him, they do not give us anything. And hearken, House of Israel, why do you not give the 24 gifts which I commanded you at Sinai? They told him, the king takes everything. Listen, king’s court, for yours are legal proceedings, for you I did say, these are the priests’ legal rights; in the future I shall sit in judgment over you, to stop them and to eliminate them from the world. Rebbi Jehudah the Prince heard this and became angry. He was afraid and fled. Rebbi Joḥanan and Rebbi Simeon ben Laqish went to appease him. They told him, Rabbi, he is a great man. He asked them, would it be possible that he could answer any question which I would ask him? They told him, yes. He asked him: What is that which is written: For their mother whored? Was our mother Sarah a whore? He answered, like daughter like mother, like mother like daughter, like generation like the prince, like the prince like the generation, like the altar like its priests. Cahana used to say, like the garden like its gardener. He told them, not only did he curse me once in my absence, but he cursed me three times in my presence! He asked him, what is that which is written: Anybody wanting to formulate a simile about you will state as follows: like mother like daughter; was our mother Leah a prostitute since it is written, Dinah went out? He told him, for it is written, Leah went out towards him. One identifies going out with going out.
HALAKHAH: “Each of them disqualifies the other’s judge,” etc. So is the Mishnah: Each of them disqualifies the other’s judge, but not his own. Rebbi Simeon ben Laqish said, they spoke about Syrian courts, but not about following Torah law. Rebbi Joḥanan said, even following Torah law. How was this said? Two people had a case in Antioch. One said to the other, I am accepting everything which Rebbi Joḥanan will decide. Rebbi Joḥanan heard it and said, he is not empowered to tear apart his opponent, but they shall hear their arguments there and if need be they should write and send the case before the rabbis. Rebbi Eleazar said, if one says in Tiberias, but the other said in Sepphoris, one listens to the one who says in Tiberias.
HALAKHAH: “Each of them disqualifies the other’s witnesses,” etc. Rebbi Simeon ben Laqish said, so is the Mishnah: “His witness,” but not his witnesses. But Rebbi Joḥanan said, even his witnesses, as it was stated: “One always adds judges until judgment is rendered, and the judges may change their opinions. After judgment is rendered they may no longer change their opinions.” Rebbi Joḥanan agrees, that if these were the only ones, he cannot disqualify them. Zeˋira said, he and a person from the street can team up to disqualify this testimony. Rebbi Ḥanina asked, does not one witness force an oath everywhere? Rebbi Zeˋira said, by disqualification one can only be disqualified by a court. A relative does not have to be disqualified by the court. Rava bar Binah said in the name of Rav: Three are like final judgment.
HALAKHAH: “I am accepting my father,” etc. If somebody said, I am accepting your father, if he accepted in the presence of two others, he may retract; in the presence of three, he may not retract. Samuel said, as long as he did not take from one and give to the other; but if he took from one and gave to the other, he may retract. Rebbi Joḥanan and Rebbi Simeon ben Laqish say even if he took from one and gave to the other, he may retract. “If he hit him with a mace that he should agree; if he accepted he may renege.”
Rav Ḥisda asked: If the third generation permitted the first generation’s wife? Is Phineas’s wife permitted to Moses? Rebbi Simeon ben Laqish said, one accepts the second and third generations with difficulty. Rebbi Joḥanan said, even with ease.
HALAKHAH: “When they have come to a decision,” etc. Rebbi Joḥanan said, one forces the one who finds guilty to write “not guilty.” Rebbi Simeon ben Laqish says, the one who finds guilty, writes “guilty”; the one who finds not guilty, writes “not guilty”. The Mishnah disagrees with Rebbi Simeon ben Laqish: “From where that afterwards, one may not say, I had found for you but my colleagues found you guilty.” What does Rebbi Joḥanan do with this? That nobody could say, I really wanted to justify X in his suit but they did not let me do it. What is Rebbi Simeon ben Laqish’s reason? That no other person should come, reason as he did, and say, also that one was there and he erred.

HALAKHAH: “Any time one produces a proof,” etc. Rebbi Oshaiah said, there, where it is possible to add, they continue to argue. But here it is impossible to add. Rebbi Joḥanan and Rebbi Simeon ben Laqish both teach that even here it is possible to add.
HALAKHAH: “Civil suits are decided on the same day,” etc. It was stated: A witness may not argue either for acquittal or conviction. From where this? A witness shall not argue about anybody on trial for his life. And from where that he himself may not argue either for acquittal or conviction? The verse says, one shall not argue about anybody on trial for his life. Rebbi Simeon ben Laqish said, sometimes a person sees himself set up by perjured witnesses and he speaks much lest he be put to death.
Could one not judge him on Fridays, pass sentence on the Sabbath, and execute him after the Sabbath? If you say so, it turns out that his judgment is delayed. Rebbi Simeon ben Laqish asked, could he not be judged on the Sabbath, have his sentence passed on the Sabbath, and be executed on the Sabbath? Temple service, which supersedes Sabbath prohibitions, is pushed aside by obligatory executions, since it is said, from My altar take him to be executed. Therefore the Sabbath, which is pushed aside by Temple service, logically should be pushed aside by obligatory executions. Rebbi La in the name of Rebbi Yannai: This implies that courts may not sit on the Sabbath; what is the reason? It is said here, in all your dwellings, and it is said there, these shall be for you legal procedures for your generations in all your dwellings. Since there the verse refers to courts, so also here the verse refers to courts.
Rebbi Ḥilqiah in the name of Rebbi Simon: Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed. One said, our procedures are like their procedures, and one said, our procedures are not like their procedures. He who said, our procedures are like their procedures, is understandable. He wo said, our procedures are not like their procedures, how does he understand Jehudah said, Memukhan said? They agreed with what Jehudah said, they agreed with what Memukhan said.
If nobody changes his opinion? Rebbi Joḥanan said, he is acquitted. Rebbi Simeon ben Laqish said, he is convicted. Rebbi Joḥanan said to him, is he not acquitted? Why do they have to continue to argue with one another? So the judgment should not be in question.
HALAKHAH: “If they found him innocent,” etc. It was stated: If a bull was led out to be stoned when its witnesses were found to be perjured, Rebbi Joḥanan said, the first to come acquires it; Rebbi Simeon ben Laqish said, it was a false declaration of ownerlessness. Similarly, if a slave was led out to be stoned when his owner dedicated him to the Temple, Rebbi Joḥanan said, he acquired himself; Rebbi Simeon ben Laqish said, it was false despair.

HALAKHAH: “The following are stoned,” etc. It is necessary in one forgetting, but in two forgettings? Since even for one woman, if he had relations with her several times in one forgetting, he is liable for each one. Rebbi Simeon ben Rebbi Hillel ben Pazi asked before Rebbi Hillel ben Pazi: The Mishnah refers to one woman who is forbidden under many names. But if there were many women, or many forgettings, is that in one forgetting? He told him, it is necessary to state for one forgetting, since they disagreed: He acts in one forgetting but she in five forgettings. Rebbi Joḥanan said, he brings one sacrifice but she brings five sacrifices. Rebbi Simeon ben Laqish said, since he brings [only] one sacrifice, she brings only one sacrifice; lest you say that many women, or many forgettings, be treated as one forgetting. Therefore, it is necessary to say, he is liable for each one.
Rebbi Simeon ben Laqish said, from here that in case the judges heard testimony while standing, their judgment is valid. You infer six statements from this. One infers the statement of Rebbi Samuel bar Rav Isaac, and one infers the statement of Rebbi Simeon ben Laqish. Also one infers that he who hears from one who heard has to rend, and one infers that if one witness testified, the second one says, I testify to the same, and the third says, I testify to the same. Also one infers that this is one of the tears which are not mended, and one infers that even when they know from the start that it is the Unique Name, they have to rend.

Does one rend his garment nowadays? Rebbi Yose, Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba, Rebbi Ḥisqiah, Rebbi Jeremiah in the name of Rebbi Joḥanan: When blasphemers proliferated, they stopped rending. Does one rend for substitute names today? Let us hear from the following: Rebbi Simeon ben Laqish was travelling on the highway. He met a Samaritan who was repeatedly blaspheming, and he was rending. He dismounted from the donkey and gave him a blow on his heart saying to him: Samaritan! Does your mother have garments to supply me with? [His word] This implies that one rends for substitute names and rends his garments at the present time.
Rebbi Samuel bar Naḥmani in the name of Rebbi Hoshaia: If one says to it, you are my god, there is disagreement between Rebbi and the Sages. If he (prostrated himself), what is the rule? Rebbi Joḥanan said, everybody agrees that if he lowered his body, he is guilty. What is the difference between raising and lowering his body, and raising and lowering his lips? Rebbi Joḥanan said, following disagreement. Rebbi Simeon ben Laqish said, following the distinction. Rebbi Zeˋira said, a verse supports Rebbi Simeon ben Laqish: One rule should be for you, for the one acting in error. This only refers to what represents an action. The one who embraces (and who prostrates himself), which are not action, from where?

From where the warning about the necromancer? Do not turn to the necromancers. From where extirpation? A person who would turn to necromancers and mediums, etc. Punishment from where? A man or woman, impersonating a necromancer or a medium, shall be put to death. Why is the medium not mentioned in Keritut? Rebbi Ḥizqiah in the name of Rebbi Simeon ben Laqish: Because they are taken together in one prohibition, do not turn to the necromancers, etc. Rebbi Yasa in the name of Rebbi Simeon ben Laqish: Because it is a prohibition implied by a positive commandment. Rebbi Zeˋira said before Rebbi Yasa: No person except you thought of stating the medium in this way in Keritut. He told him, because as the verse formulated it so the Mishnah formulates it, a necromancer or a medium.

“One who has sexual relations with a preliminarily married maiden.” Rebbi Yasa in the name of Rebbi Joḥanan, Rebbi Ḥiyya in the name of Rebbi Eleazar: This is Rebbi Meïr’s. But for the rabbis even if she is a minor. What is Rebbi Meïr’s reason? “Lad” is written defectively in the paragraph. How do the rabbis explain “a lad”? Rebbi Abbahu in the name of Rebbi Simeon ben Laqish: Once in the paragraph it is written a young woman; this teaches that in the entire paragraph she is an adult. Rebbi Meïr objected to the rabbis: In the matter of the calumniator, a lad is written and she is an adult since a minor is not stoned? What do the rabbis do with this? Rebbi Abin said, explain it that he came to her as a male. Rebbi Jacob bar Abba asked before Rav: What is the law of him who comes to a minor? He said to him, by stoning. What is the law of him who comes to an adult? He said to him, I am reading an adolescent, not an adult. Read an adolescent, not a minor! Do you not agree with me that she has the right to a fine? He answered, because he mistreated her, that includes a minor for a fine. Read because he mistreated her, that includes an adult for a fine! Rav said, even though Rebbi Jacob bar Abba won the logical argument, practice is that he who comes to a minor is [punished] by stoning but she is free. Rebbi Abun in the name of (Rebbi) Samuel. Why? He understood it from the following: The man who had lain with her alone shall die. Do we not know that the girl has not committed a capital crime? Why does the verse say, do not do anything to the girl; the girl has not committed a capital crime? That includes him who has sexual relations with a [preliminarily married] underage girl; he is stoned and she is free.
HALAKHAH: “The deviant and rebellious son,” etc. Rebbi Zeˋira, Rebbi Abbahu, Rebbi Yose ben Ḥanina in the name of Rebbi Simeon ben Laqish. It is written: If a man would concoct against his neighbor to kill him slyly. When does he become a man? When he concocts. When is he done cooking? When his palm expands. A simile: If the seed is fully cooked inside, the pot becomes black on the outside. Rebbi Zeˋira said that Rebbi Shila bar Bina stated: If a man have a son, not that the son be a father. From the moment that he may come to a woman and make her pregnant, he is a potential father, not a son. But the Torah said, a son, not a father. It parallels what Rebbi Yasa said in the name of Rebbi Sabbatai: The entire period of a “deviant and rebellious son” is only six months.
He is guilty only it he ate it rare. If he ate it raw, he is a dog. If he ate it cooked, he is a human. If he ate cartilage, what is the rule? What is the rule about soft sinews? Rebbi Joḥanan said, one subscribes to them; Rebbi Simeon ben Laqish said, one does not subscribe to them. Rebbi Jacob bar Aḥa in the name of Rebbi Zeˋira: Rebbi Joḥanan and Rebbi Simeon ben Laqish disagreed about what is stated there: “The following have their hides treated like their flesh.” Rebbi Joḥanan said, this was only said as prohibition and regarding impurity, but not for flogging. Rebbi Simeon ben Laqish said, Rebbi stated a complete Mishnah, not only for prohibition and regarding impurity. The reasoning of Rebbi Simeon ben Laqish seems inverted. There, he treats it as flesh, but here, he does not treat it as meat. Rebbi Judah bar Pazi said, there is a difference, since there one refers to skin which in the end will become hard. This emphasizes that the reasoning of Rebbi Simeon ben Laqish seems inverted! Since there, where in the end it will harden, he treats it as flesh, here where in the end it will not harden, not so much more? Rebbi Abbahu said, the reason of Rebbi Judah bar Pazi is: they shall eat the meat in that night, not sinews.

HALAKHAH: “If somebody injures another person,” etc. So is the Mishnah: “Rebbi Neḥemiah declares him not [criminally] liable but the Sages declare him [criminally] liable since it is not unsubstantiated.” The Sages say, two estimations have precedence over one estimation; Rebbi Neḥemiah says, the intermediate estimation has precedence over the two. What is Rebbi Neḥemiah’s reason? If he gets up and walks outside on his cane, the attacker is exonerated. Could you think that this one walks in the market and the other one is executed because of him? But even if he dies according to the first estimation, he cannot be prosecuted. What is the rabbi’s reason? If he does not die but is bedridden. Would we not know that even if he does not die that he will be bedridden? But if they did not estimate that he would die. If they did not estimate that he would die, that is what is written: If he gets up and walks outside on his cane, the attacker is exonerated. Therefore, if he does not get up, [the attacker] is [criminally] liable. But if they estimated that he would die? If they estimated that he would die, that is what is written: But he has to pay for his disability and the medical costs. Rebbi Hila in the name of Rebbi Simeon ben Laqish: It is an extraordinary decree of Scripture that he has to pay. Rebbi Abbahu in the name of Rebbi Yose ben Ḥanina: It was an erroneous estimation. What is the difference between them? “But he got better and only afterwards deteriorated and died; he is [criminally] liable. Rebbi Neḥemiah declares him not liable since it is not unsubstantiated.” For him who said, it is an extraordinary decree of Scripture that he has to pay; if he paid, he paid. If he did not pay, does he have to pay? For him who said, it was an erroneous estimation; if he did not pay, one does not order him to pay. If he paid, can he take it back? A baraita supports one and a baraita supports the other. A baraita supports Rebbi Yose bar Ḥanina: If they estimated that he would live but he died, from when does one count for him? From the moment he turns worse. This implies that the estimate was wrong. If you would say, it is an extraordinary decree of Scripture that he has to pay, he should pay from the first moment. A baraita supports Rebbi Simeon ben Laqish: If they estimated that he would die but he lived, from when does one count for him? From the moment he turns worse. Rebbi Yose said, it does not say here “from the moment he turns worse” but “from the moment he turns better.” That means, it is an extraordinary decree of Scripture that he has to pay. But if you say, it was an erroneous estimation, he has to pay until [the victim] dies.

HALAKHAH: “If a murderer was mixed up with others,” etc. Rebbi Joḥanan said, the Mishnah deals with a murderer mixed up with innocent people. Rebbi Simeon ben Laqish said, the Mishnah deals with a murderer being tried mixed up with a murderer who already was convicted. Samuel said, the Mishnah deals with a bull mixed up with other bulls. If the Mishnah referred to a bull mixed up with other bulls, would we state about them that “one keeps them in jail”?
Rebbi Simeon ben Laqish said, three [persons] were untrue to their prophetic insights because of ponaria, viz., the following: Moses, Elijah, and Micha. Moses said, if an everyman’s death these should die, etc. Elijah said, hear me, o Eternal, hear me, so this people will know, otherwise You would have turned their hearts backwards. Micha said, if you would return in peace, the Eternal did not speak through me.
Masters of assembly. “Assembly” only means the Synhedrion, as you say: Assemble for Me seventy men from the Elders of Israel. Another explanation, masters of assembly, it was said in an assembly. Rebbi Simeon ben Laqish said, if somebody told me that Chronicles was to be found in Babylonia, I would go and fetch it from there. But now, if all our rabbis came together, they could not bring it from there.
HALAKHAH: Slaying you shall slay the inhabitants of that town by the sword, etc. Rebbi Simeon says, its domesticated animal, not first born or tithes found there; its booty, not Temple money or Second Tithe found there. Rebbi Yose ben Ḥanina asked: What is the status of hair of its just women? Let us hear from the following: Rebbi Simeon says, its domesticated animal, not first born or tithes found there; its booty, not Temple money or Second Tithe found there. The sancta of a seduced town, Rebbi Joḥanan said, one cannot commit larceny with them; Rebbi Simeon ben Laqish said, one can commit larceny with them. Rebbi Joḥanan objected to Rebbi Simeon ben Laqish: According to your opinion that one can commit larceny with them, should one not state that “six purification offerings are left to die”? He answered, because in this case even an elevation offering dies. Rebbi Hila in the name of Rebbi Simeon ben Laqish: One can commit larceny with them because of sancta of an apostate. Should they not be sacrificed? Because of the sacrifice of an evildoer is an abomination. Rebbi Uqba said, also in the following they disagree: If a bull was led out to be stoned when its witnesses were found to be perjured, Rebbi Joḥanan said, the first to come acquires it; Rebbi Simeon ben Laqish said, it was false despair. Similarly, if a slave was led out to be executed when its witnesses were found to be perjured, Rebbi Joḥanan said, he acquired himself; Rebbi Simeon ben Laqish said, it was false despair.

Rebbi Jehudah ben Pazi said. not only to the bridal chamber but also to a house containing the bridal chamber. The following is problematic: Dining room and bedroom, bridal chamber and bedroom; if she entered the dining room, for which consequence? Rebbi Joḥanan said, to inherit from her. Rebbi Simeon ben Laqish said, to dissolve her vows. Rebbi Zeˋira said, even though Rebbi Simeon ben Laqish said, to dissolve her vows, he agrees that he cannot actually dissolve them before she enters the bridal chamber. Rebbi Huna said, a verse supports Rebbi Simeon ben Laqish: to whore in her father’s house. This excludes the case where the father’s agents handed her over to the husband’s agents, that she could not be stoned, but is strangled.

HALAKHAH: “If there is no knowledge at the start,” etc. What can you see to say? Does the one inside suspend and the one outside atone, or the one outside suspend and the one inside atone, or both of them suspend, or both of them atone? What about it? Rebbi Jacob bar Aḥa said, I saw something. Rebbi Simeon ben Laqish was asking before Rebbi Joḥanan and asked him, what are the differences in atoning? I do not know what he answered him. Rebbi Ze`ira said to him, maybe it is the following: How did you understand to explain it? About an impure person who ate pure [meat], or a pure person who ate impure [meat]? The verse says: his impurity is on him. Impurity of the body, not impurity of the meat. Or both of them atone? What about it? He should over it confess sins, these are intentional sins, their crimes, these are rebellions, their mistakes, these are unintentional sins. Then He said, he will atone. Rebbi Immi said in the name of Rebbi Simeon ben Laqish, the he-goat will carry all their sins, he grabbed intentional sins and left out unintentional sins, to indicate that just as intentional sins do not carry the obligation of a sacrifice, so those unintentional sins which do not carry the obligation of a sacrifice. And why did they come here? Rebbi Ila in the name of Rebbi Yasa, for suspension. Would it be understood to suspend for those who eat abominations and crawling things? Rebbi Samuel in the name of Rebbi Ze`ira: Their mistakes, their mistakes. Since their mistakes mentioned there are those which carry the obligation of a sacrifice, also their mistakes mentioned here are those which carry the obligation of a sacrifice. This excludes intentional sins which do not carry the obligation of a sacrifice. What is left out by the he-goat brought inside the Day of Atonement suspends. What did it leave out? If there is no knowledge at the start but there is knowledge at the end.

HALAKHAH: “They said to him, did not the teacher use to say,” etc. Rebbi Yose the Southerner said before Rebbi Jonah: Would it not have been necessary to state, if it is so then those of the Days of the New Moon could be brought on the Day of Atonement since one increases holiness but one does not diminish; but those of the Day of Atonement cannot be brought on the Days of the New Moon since one does not diminish holiness. Rebbi Eleazar in the name of Rebbi Bun explained it by another explanation: if it is so then those of the Day of Atonement could be brought on the Days of the New Moon, for included in their atoning is the atoning of the Days of the New Moon, but those of the days of the New Moon cannot be brought on the Day of Atonement, for they atone only their atonement. For if anybody ate five olive-sized pieces of fat and dedicated four sacrifices, being of the impression that he had dedicated five, did he atone? Or if he ate four olive sized pieces of fat, dedicated five sacrifices, being of the impression that he had dedicated four, not so much more? And so “Rebbi Simeon used to say, thirty-two rams are brought for the public every year. Thirty one outside, they are eaten. One inside which is not eaten. And the scapegoat. Twelve for the twelve months of the year. Eight on Tabernacles, seven on Passover, two on Pentecost, one for the day and one for the bread. One on New Year’s Day and one on the Day of Atonement.” When Moses heard this he said, it follows that anybody for whom the doubt of a transgression arises should bring all these sacrifices! Rebbi Tanḥuma in the name of Rebbi Simeon ben Laqish: When the Holy One, praise to Him, said to Moses, he shall confess on it etc., he started and said, A Song of confession, inspired by he shall confess on it.
HALAKHAH: “The kinds of awareness of impurity,” etc. Rebbi Jeremiah asked: It is obvious about the last awareness, until he knows that he is liable to bring a sacrifice for it. Is the same true for the first awareness? Let us hear from the following: Two paths, one impure and one pure. He walked on one of them, entered the Sanctuary, left, sprinkled repeatedly, immersed himself, walked on the second one, and entered the Sanctuary; he is liable and he knows that he is liable to bring a sacrifice for it. Rebbi Simeon ben Laqish said, this is Rebbi Ismael’s who said that he is liable for forgetting impurity and forgetting the Sanctuary. Rebbi Abun bar Ḥiyya said, we thought that one could say that Rebbi Simeon ben Laqish said this if he was certain that he was impure, he had forgotten the impurity and entered the Sanctuary. But not if it was in doubt whether he was impure or pure, he was oblivious of the Sanctuary and entered the Sanctuary. Since Rebbi Simeon ben Laqish said, this is Rebbi Ismael’s who said that he is liable for forgetting impurity and forgetting the Sanctuary: this implies even if it was in doubt whether he was impure or pure. Rebbi Joḥanan said, it is everybody’s opinion since a doubt of awareness is awareness. Since at a time when he does not know whether he was impure or pure you say it is certain knowledge, if he knows for certain that he is impure but does not know whether he is liable for a sacrifice then certainly this should be awareness.

In Rebbi Simeon ben Laqish’s opinion, if one became impure but it was for him in doubt, would this be for him like forgetting, which makes him liable? Each of them keeps to his opinion, as they disagreed:
One ate five times the volume of an olive; he separately realized a doubt about each one. Afterwards it became known to him as a certainty. Rebbi Simeon ben Laqish said, the knowledge about his doubt determines his kind of sacrifices. Rebbi Joḥanan said, the knowledge about his doubt does not determine his kind of sacrifices. Rebbi Yose bar Abun in the name of Rebbi Samuel bar Rav Isaac: Rebbi Simeon ben Laqish agrees that for the Anointed Priest the knowledge about his doubt does not determine his kind of purification sacrifice. What is the reason? Like purification offering, like reparation offering. The knowledge about his doubt determines the transgression for one who brings a suspended reparation offering. The knowledge about his doubt does not determine the transgression for one who does not bring a suspended reparation offering.

The argument of Rebbi Simeon ben Laqish seems to be inverted. There he says, the knowledge about his doubt determines his kind of transgression. But here he says, the knowledge about his doubt does not determine his kind of transgression. There, his reparation offering determines it. Here what do you have?
Rebbi Joḥanan said: In any case of doubt in the public domain, the doubt has to be resolved as pure, but one does not allow to act. But did we not state: “Any case of doubt which was declared pure for heave is pure for sprinkling water, and in any case where it remains unresolved for heave the sprinkling water is poured out.” There is nothing unresolved for the sprinkling water; either it is genuinely pure or genuinely impure. Rebbi Ze`ira said, the Mishnah deals with a situation not caused by a sacrifice; what Rebbi Joḥanan said refers to a situation caused by a sacrifice. Everybody agrees that if the person transgresses and acted, it is pure. The arguments of Rebbi Joḥanan are inverted. There, he says, if he transgresses and acted, it is impure. But here he said, if he transgresses and acted, it is pure. There in a private domain, here in the public domain. But you could even say, there and here in the public domain. The arguments of Rebbi Simeon ben Laqish are inverted, the arguments of Rebbi Joḥanan are inverted, since they disagreed: A nazir became impure by a grave in the abyss, Rebbi Simeon ben Laqish said, the nazir does not shave, but Rebbi Joḥanan said, the nazir has to shave. That is since Rebbi Joḥanan said, a doubt of awareness is awareness, even if the first was because of a crawling animal and the second by a corpse. The first before he converted and the second after he converted. The first before he grew two pubic hairs, the second after he grew them.

Does not the blasphemer have to bring a sacrifice? The colleagues in the name of Rebbi Simeon ben Laqish: They answered him according to his argument. Following your argument, since you say that the blasphemer does not act, where do we find that somebody talks and brings a sacrifice that this one talks and brings a sacrifice? Rebbi Abba from Carthage asked, is not Rebbi Simeon ben Laqish’s argument inverted? There he said, for Rebbi Aqiba the blasphemer does not act. But here he says, the blasphemer is acting in the opinion of Rebbi Aqiba. Rebbi La in the name of Rebbi Simeon ben Laqish: Two Tannaïm following the opinion of Rebbi Aqiba.
