The rapist, the seducer and the insane man neither disqualify [a woman from eating terumah] nor do they allow her to eat [terumah]. If they are unfit to enter into the assembly of Israel they do disqualify [a woman from eating terumah]. How is this so? If an Israelite had intercourse with the daughter of a priest she continues to eat terumah. If she becomes pregnant she may no longer eat terumah. [Even if] she becomes pregnant she may not eat. And if his father’s mother was the daughter of an Israelite married to a priest, she may not eat terumah; And if his mother’s mother was the daughter of an Israelite married to a priest, she may eat terumah; If the embryo was miscarried in her womb she may eat. If a priest had intercourse with the daughter of an Israelite, she may not eat terumah. If she gave birth may eat. A slave disqualifies a woman from eating terumah through intercourse but not as her offspring. If she was the daughter of a priest married to an Israelite she may eat terumah. If she was the daughter of a priest married to an Israelite she may not eat terumah. It is found that the power of the son is greater than that of the father. How is this so? If the daughter of an Israelite was married to a priest or the daughter of a priest was married to an Israelite, and she bore a son by him, and the son went and had intercourse with a slave-woman who bore a son by him, such a son is a slave; A mamzer disqualifies a woman from eating terumah and can allow her to eat terumah. How is this so? If the daughter of an Israelite was married to a priest or the daughter of a priest was married to an Israelite, and she bore a daughter by him, and the daughter went and married a slave or a Gentile who bore a son by him, such a son is a mamzer;
The seducer pays three forms [of compensation] and the rapist four. The seducer pays compensation for embarrassment and blemish and the fine; The rapist pays an additional [form of compensation] in that he pays for the pain. What [is the difference] between [the penalties of] a seducer and those of a rapist? The rapist pays compensation for the pain but the seducer does not pay compensation for the pain. The rapist pays immediately but the seducer [pays only] if he dismisses her. The rapist must “drink out of his pot” but the seducer may dismiss [the girl] if he wishes.

Cases concerning property [are decided] by three. Cases concerning robbery or personal injury, by three. Claims for full damages or half-damages, twofold restitution, or fourfold or fivefold restitution, by three. Claims against a rapist, a seducer and one who defames [a virgin are decided] by three, according to Rabbi Meir. The Sages say: “One who defames [a virgin is decided] by twenty-three, for there may arise from it a capital case.
The five selas of a first-born [are paid in] the standard of Tyrian maneh. As regards the thirty shekels of a slave and likewise the fifty shekels of the rapist and seducer and the one hundred shekels for one who spreads an evil name in all these cases the payment is in the holy shekel, in the standard of Tyrian maneh. All of these are redeemed with money or the equivalent of money with the exception of shekel payments.
The law of evaluation is sometimes lenient, and at others times strict. The law of the field of possession is sometimes lenient, and at others times strict. The law concerning a warned ox that has killed a slave is sometimes lenient, and at others times strict. The law of the rapist and the seducer and the defamer is sometimes lenient, and at others times strict. The law of evaluation is sometimes lenient, and at others times strict. How so? Whether one has evaluated the fairest in Israel, or the ugliest in Israel, he must pay fifty selas. But if he said: “Behold, his monetary worth is upon me,” he pays only as much as he is worth.
“The law of the rapist and seducer is sometimes lenient and sometimes strict.”How so? Whether he raped or seduced a girl from among the best of the priestly stock or the humblest in Israel, he must pay fifty selas. But compensation for shaming and for blemish is in accord with the [circumstances] of him who shames and of the one who suffers the shame.
The Jerusalem Talmud
MISHNAH: The rapist who sowed in a vineyard and it was taken from him, one cuts it even during a holiday. How much does he have to give to the workers? Up to one third. More than that he cuts normally, even after the holiday. When is the property called the rapist’s? From the moment it is sunk.

“When is the property called the rapist’s? From the moment it is sunk.” Rebbi Aḥa said: If the owners were forgotten but did not give up hope, the prohibition of the field is biblical. If the owners did give up hope but they were not forgotten, the prohibition of the field is rabbinic. But can real estate be robbed? Rebbi La said, even though real estate cannot be robbed, one can give up hope on real estate.
MISHNAH: The Sabbatical remits any loan, with or without a document. Store credit is not remitted; if it is transformed into a loan it is remitted. Rebbi Jehudah says, any preceding one is remitted. Wages of a hired hand are not remitted; if they are transformed into a loan they are remitted; Rebbi Yose says, for any work that stops in the Sabbatical they are remitted; if it does not stop they are not remitted. If somebody slaughters a cow and divides it up on New Year’s Day, if the month was long it is subject to remission, otherwise it is not subject to remission. The rapist, the seducer, the calumniator, and all court documents are not subject to remission. If somebody gives loans on pledge, or deposits his documents with the court, they are not subject to remission.
“The rapist, the seducer, the calumniator.” Rav Jehudah said, Rav [said]: This follows Rebbi Meïr, since Rebbi Meïr said, it depends on the one extending credit.
MISHNAH: The rapist, the seducer, and the insane do neither disable nor enable to eat, but if they are unable to marry in Israel they disable. How is that? If an Israel came upon the daughter of a Cohen, she may eat heave, if she became pregnant she may not eat. If the fetus was cut into pieces in her body she may eat. If a Cohen came upon the daughter of an Israel, she may not eat heave, if she became pregnant she may not eat, if she gave birth she may eat. It turns out that the son’s power is greater than the father’s.
HALAKHAH: “The rapist, the seducer,” etc. This means that rape does not disable an unmarried priestly woman.
HALAKHAH: “The ketubah of a virgin is 200 and that of a widow one mina,” etc. Huna in the name of Samuel: In the Temple šeqel. Rebbi Abba bar Bina said, circulating coin. A Mishnah supports Rebbi Abba bar Bina: “The five tetradrachmas of the firstborn are in Tyrian coinage, the 30 of the slave, the 50 of the rapist and the seducer, the 100 of the slanderer, are all computed in Temple šeqels in Tyrian coinage.” A woman’s ketubah is not stated with them. Rebbi Abin said, did they not learn the ketubah of a woman from the rapist and the seducer? Since the rapist and the seducer are mentioned, it is as if women’s ketubah was stated with them.

MISHNAH: The seducer pays for three things and the rapist for four. The seducer pays for shame, diminution of value, and fine. The rapist in addition pays for suffering; the seducer does not pay for suffering. The rapist pays immediately, the seducer only if he divorces her. The rapist drinks from his pot; the seducer may divorce if he wishes.

HALAKHAH: “The seducer pays three,” etc. This does not follow Rebbi Simeon, since Rebbi Simeon freed the rapist from paying for suffering. To what can you compare this? To one who cuts somebody’s wart when that one would have cut it himself in the future. To what can you compare this? To one who cuts somebody’s trees when that one would have cut them himself in the future. They said to him, you cannot compare one who is deflowered by rape to one who is deflowered by consent; you cannot compare one who is deflowered on a dungheap to one who is deflowered in the bridal chamber! How does Rebbi Simeon interpret ’’because he mistreated her”? They said in the name of Rav Ḥisda, explain it that he raped her on thorns.
Rebbi Eleazar asked: Do the daughters of the rape victim have the rights given by the ketubah stipulations? It is clear to me that the rape victim has no [ketubah] of the male children, and that the seduced victim has no [ketubah] of the male children. If you say that he questions in both cases, we could ask, do the daughters of the rape victim and the daughters of the seduced girl have the rights given by the ketubah stipulations? That is a problem following the rabbis, but it is obvious following Rebbi Yose ben Rebbi Jehudah; as it was stated: Rebbi Yose ben Rebbi Jehudah says, the rapist gives a mina as ketubah.
HALAKHAH: “How does he drink from his pot,” etc. Rebbi Jeremiah, Rebbi Ḥiyya, in the name of Rebbi Simeon ben Laqish: It should not have said “she shall be his wife” for the calumniator; it is superfluous since she already is his! Why does the verse say, “she shall be his wife”? You should infer from this by an equal cut. One has to infer from “she shall be his wife”, “she shall be his”. Since “she shall be his” which is said there means a wife appropriate for him, so “she shall be his” which is said here means a wife appropriate for him. Then since “she shall be his” which is said there means a wife appropriate for him and he pays the fine, so “she shall be his” which is said here means a wife appropriate for him and he pays the fine. Rebbi Ze‘ira, Ulla [ben] Ismael, in the name of Rebbi Eleazar: It should not have said “she shall be his wife” for the calumniator; it is superfluous since she already is his! Why does the verse say, “she shall be his wife”? You should infer from this by an equal cut. One has to infer from “she shall be his wife”, “she shall be his”. Since “she shall be” which is said there means that if he divorced her one tells him to take her back, so “she shall be his” which is said here means that if he divorced her one tells him to take her back. Rebbi Ḥiyya stated: “In the cases of both the rapist and the calumniator who divorced, one forces them to take back. If they were Cohanim they absorb the forty.”
MISHNAH: About an orphan girl who had been preliminarily married and was divorced, Rebbi Eleazar says that the rapist has to pay but the seducer does not.
HALAKHAH: “About an orphan girl who had been preliminarily married and was divorced,” etc. Rebbi Joḥanan said, it turns out that Rebbi Eleazar follows the opinion of his teacher Rebbi Aqiba. Just as Rebbi Aqiba said that she can collect the fine and it belongs to her, so Rebbi Eleazar said that she can collect the fine and it belongs to her. Then also for a seduced one? Rebbi Jeremiah said in the name of Rebbi Eleazar, explain it that she remitted it to him. Can anybody remit anthing that does not belong to him? Explain it for an orphan; as it was stated in the House of Rebbi thus: The orphan, Rebbi Eleazar said that the rapist has to pay her but the seducer does not. Can anybody remit something which is not in his possession? Let us hear from the following, as Rebbi Abun bar Ḥiyya said in the name of Rebbi Ze‘ura: The fine is not due from the first moment on. As we have stated there: “If she came to court before her father died, [the payments due] belong to her father and if the father died they belong to the brothers.” If you say that the fine is due from the first moment, it would belong to the brothers from the first moment! Rebbi Abba in the name of Rav Ḥisda: The Mishnah deals with shame and diminution of value. As Rebbi Mana said, how is it? The rapist is obligated for everything and the seducer is free from everything. Rebbi Abin said, [Rebbi] Shammai asked: What does it mean that the rapist has to pay but the seducer does not? The rapist has to pay everything but the seducer is free [from paying] for shame and diminution of value but is obligated for the fine. That is Rebbi Aqiba’s. Or, the rapist is free [from paying] for shame and diminution of value but is obligated for the fine but the seducer is free from everything? That is Rebbi Yose the Galilean’s.

“Payments for suffering for the victim of an attack.” The rape victim. This does not follow Rebbi Simeon since Rebbi Simeon frees the rapist from paying for suffering.
Rebbi Abun bar Ḥiyya asked before Rebbi Ze‘ira: If the father brought witnesses to prove the perjury of the husband’s witnesses; but the father’s witnesses were proven perjurers, is he flogged and pays 100 tetradrachmas by the judgment of three and the witnesses are stoned by the judgment of 23? He said to him, if the father’s witnesses are not proven perjurers, is not the husband flogged and pays 100 tetradrachmas by the judgment of three and the witnesses are stoned by the judgment of 23? Rebbi Ze‘ira is of the opinion that there are two different proceedings. Rebbi Jeremiah in the name of Rebbi Abbahu: There is only one proceeding. A baraita disagrees with Rebbi Abbahu: “To the town’s Elders”, that is a court of three members; “to the gate”, that is a court of 23. He explains it following Rebbi Meïr, since Rebbi Meïr says that he is flogged and pays. There, we have stated: “The seducer, the rapist, and the calumniator [are judged] by three [judges], the words of Rebbi Meïr; but the Sages say, the calumniator by 23 since it is a potential capital case.” Rebbi Mana said, they disagree about the preliminarily married adolescent. Rebbi Meïr says, she loses her ketubah in a court of three and is stoned by a court of 23; but the Sages say, at the same place which sentences her to be stoned she loses her ketubah. But in the case of the calumniator, everybody agrees that by the court in which the witnesses are stoned, the husband is flogged and pays 100 tetradrachmas. Rebbi Yose ben Rebbi Abun said to him, would they differ where it was not stated? But they differ about the calumniator! Rebbi Meïr says, he is flogged and pays 100 tetradrachmas by the judgment of three and the witnesses are stoned by the judgment of 23; but the rabbis say, by the court in which the witnesses are stoned, the husband is flogged and pays 100 tetradrachmas. Rebbi Yasa in the name of Rebbi Mana; Rebbi Tanḥum, Rebbi Abbahu in the name of Rebbi Joḥanan: Real estate cannot be bought for less than a peruṭah. What is the reason? “Fields will be bought by money.” This disagrees with what Rebbi Ḥanina said: Any šeqalim mentioned in the Torah are tetradrachmas, in the Prophets pounds, and in the Hagiographs centenarii. Rebbi Jehudah bar Pazi said, except for the šeqalim paid to Ephron, which were centenarii. What is the reason? “For full money he shall give it to me.” There is no comparison since here it is written “money” but there “šeqalim”. They objected, is there not the rapist, for whom “money” is written and you say “šeqalim”?

Rav Huna said that in the days of Rebbi Eleazar ben Azariah they tried to include them. Rebbi Abbahu inverts the wording: In the days of Rebbi Eleazar they said, who could purify the altar’s part? That implies that Joshua excluded them. He excluded them only as disqualified for marriage. If you would say, disqualified (because of sins) then the rapist of a Gibeonite girl should not have to pay the fine, but we have stated: The rapist of a Gibeonite girl has to pay the fine.” Rebbi Eleazar said, he cursed them as a snake, as it is said: “But now you are cursed.” And it is written: “The people of Israel said to the Ḥiwwite.” But were they Ḥiwwites? They acted like the snake which said, I know that the Holy One, praise to Him, did say “because on the day you eat from it, you will die a death.” I shall go and trick them so that they eat and will be punished and I shall inherit the earth for myself. So these people acted; they said, we know that the Holy One, praise to Him, said to Israel: “You shall certainly ban them, the Hittite, the Emorite, and the Perizite, as the Eternal, your God, has commanded you” And it is written: “You shall not conclude a covenant with them.” We shall go and trick them that they conclude a covenant with us. As you take it, if they kill us, they violate their oath. If they let us live, they violated the [divine] decision. In any case, they will be punished and we shall inherit the Land.

Rebbi Meïr says, she loses her ketubah in a court of three and is stoned in a court of 23; but the Sages say, at the same place which sentences her to be stoned she loses her ketubah. But in the case of the preliminarily married adolescent female, everybody agrees that at the same place which sentences her to be stoned she loses her ketubah. It turns out that Rebbi Mana follows Rebbi Ze‘ira and Rebbi Yose ben Rebbi Abun follows Rebbi Abbahu.
HALAKHAH: “You raped or seduced my daughter,” etc. Rebbi Ze`ira, Rebbi Yasa in the name of Rebbi Joḥanan: The words of Rebbi Simeon [imply that] the main claim is for the fine, which is not so for the words of the Sages. Rebbi Illa said, the words of Rebbi Simeon if he claims the fine, shame and diminution; the words of the Sages if he claims shame, diminution, and fine. The rabbis say, the words of Rebbi Simeon if he advances three claims; the words of the Sages if he advances one claim. Rebbi Ze`ira asked before Rebbi Yasa, did you hear explicitly from Rebbi Joḥanan, or from his word? Rebbi Yasa said, for he is of the rabbis’ opinion. Rebbi Mana said, even if he is of Rebbi Illa’s opinion, the words of Rebbi Simeon if he advances one claim; the words of the Sages if he advances three claims. “Not only matters for which he has to pay the capital, from where double payment, quadruple and quintuple payment, the rapist, and the seducer, and the calumniator? The verse says, everything about which one would swear falsely.” Is the calumniator’s not a fine? Rebbi Jeremiah says, this is Rebbi Simeon’s who said, all depends on the collection.
The Babylonian Talmud
So rather, what is the reason that [Rebbi Yochanon] retracted [his veiw]? Because he found [his veiw point] problematic with the case of a rapist [Ohneis] For it was taught in a barasiah An Ohneis who divorced his wife [in violation of the Torah's commandment], If he is a Yisroel [i.e. a non-Kohen] he takes her back and does not receive malkus. If he is a Kohen, he receives malkus and doesn't take her back.
