It is written: “Six years he shall work.” How much does he work? I could think that he leaves at the end of six [years]. The verse says, “and in the seventh he shall leave.” I could think that he leave at the end of seven [years]. The verse says, “six years he shall work.” How is that? He works the entire six and leaves at the start of the seventh. “And in the seventh he shall leave.” The seventh from the sale and not the Seventh of the world. Do you say, the seventh from the sale and not the Seventh of the world? Since it says, “six years he shall work,” this spells out six years. How can I confirm “and in the seventh he shall leave?” The seventh from the sale and not the Seventh of the world. Say it is the opposite. Rebbi Ze‘ira said in the name of Rav Huna: It is written: “and in the seventh,” “and in the seventh”. Rebbi Ḥuna said, if you say, in the Seventh of the world, what would the Jubilee free? Rebbi Joḥanan bar Marius said, this follows him who said that the Jubilee does not become part of a Sabbatical period. But following him who said that the Jubilee becomes part of a Sabbatical period, sometimes it falls in the middle of a Sabbatical period. The rabbis of Caesarea say, even following him who said that the Jubilee becomes part of a Sabbatical period, we could deduce from here that the Sabbatical year frees the slaves and the Jubilee the pierced ones.

As it was stated: “One may say to his worker: Here you have a denar, use it for food, here you have a denar, use it for drink, and not be worried about either the Sabbatical year, tithes, or wine for libations. But if he told him, go and buy yourself a loaf and I shall give you the money, go and buy yourself a reviït of wine and I shall give you the money, he has to worry because of the Sabbatical year, tithes, and wine used for libations.” Rebbi Ze‘ira said, the grocer becomes the agent of the employer to let the worker acquire. [Rebbi Hila said, the worker] acquired for the employer from the grocer and then acquires it himself.

MISHNAH: If somebody preliminarily marries a woman and her daughter or two sisters simultaneously, they are not preliminarily married. It happened to five women, among them two sisters, that a man collected a bag of figs from their own property in the Sabbatical year and said: All of you are preliminarily married to me by this bag, and one of them accepted for all of them. Then the Sages said, the sisters are not preliminarily married.
“If somebody gives money to another to buy produce with it for half the gain and one of them wants to age it, the other may hinder him. But if it was the eve of a Sabbatical year, the other may not hinder him because it was understood that it was bought for that purpose.”
MISHNAH: If one who contracts with another for a field for a Sabbatical cycle at 700 denars, the Sabbatical year is included. If he contracted for seven years at 700 denars, the Sabbatical is not included.

MISHNAH: A person hired for the day collects the entire night; a person hired for the night collects the entire day. A person hired for hours collects the entire day and the entire night. A person hired for a week, a month, a year, or a Sabbatical period, if he finishes during daytime, he collects the entire day; if he finishes at nighttime, he collects the entire night and the following day.
If he took a pledge and then returned it, by law he can collect from the property mortgaged to him. “But if he returns it, why does he take a pledge? Rebbi explained, for maybe there will be a Sabbatical year and annul [the debt]. Or maybe that one will die and leave the movables in the heir’s hand.”
Rebbi Perira brought before Rebbi Jehudah the Prince two radishes between New Year’s Day and the Fast. It was the year after a Sabbatical, and they were a camel’s load. He said to him, rabbi, are they not forbidden? Are they no aftergrowth? He said to him, they were sown after the end of the Sabbatical year. At that moment did Rebbi permit to buy vegetables immediately after the end of the Sabbatical year.

“One intercalates neither in a Sabbatical year nor the year following a Sabbatical; but if it was intercalated it is intercalated. When does one usually intercalate? The year preceding a Sabbatical.” Rebbi Zeˋira said in the name of Rebbi Abbahu, that is before Rebbi permitted to import produce from outside the Land into the Land. But since Rebbi permitted to import produce from outside the Land into the Land, there is no difference between a Sabbatical and the remaining years of the Sabbatical cycle.

MISHNAH: The following are disqualified: The dice-player, the lender on interest, participants in pigeon contests, dealers in sabbatical produce, and slaves. Rebbi Simeon said, earlier they were listing harvesters of sabbatical produce; but since the increase of oppressors they returned to list only dealers in sabbatical produce. Rebbi Jehudah said, when? If he has no profession but this; but if he has another profession, he is qualified.

“Dealers in sabbatical produce.” “Who is a dealer in sabbatical produce? One who sits idle all the years of a sabbatical cycle. As soon as the sabbatical year starts, be becomes active and trades in sabbatical produce. One does not accept them before another sabbatical year starts and he can be checked out that he repented in complete repentance.” It was stated: Rebbi Yose says, two sabbatical periods. “Rebbi Nehemiah says, repentance in money, not repentance in words; that he say to them, here are 200 denars, distribute them to the poor, for I earned them from forbidden produce.” They added shepherds, extortionists, and any who are suspect in money matters, that their testimony be invalid. Rebbi Abbahu said, only shepherds of small animals.

If somebody improved [his field] today, what is the rule? Rebbi Jeremiah was of the opinion that when the reason disappeared, the ordinance is void. Rebbi Yose was of the opinion that even if the reason disappeared, the ordinance stands until another court abolishes it. Similarly, how does an owner acquire his own produce in a Sabbatical year? Rebbi Jeremiah wanted to say, from the moment he put it into his vessel. Rebbi Yose was of the opinion that even if he put it into his vessel he did not acquire, for he thinks that it is his but it is not his.
MISHNAH: They were investigating him in seven ways: In which Sabbatical period, in which year, in which month, which day of the month, which day, which hour, at which place? Rebbi Yose said, which day, which hour, which place, do you recognize him, and did you warn him? If one worshipped idols, what did he worship and how did he worship?
If He stated a general principle as a positive commandment but the detail as a prohibition, the word of Rebbi Eleazar is that this is a general principle followed by a detail. Rebbi Eleazar said, one whips for ploughing in the Sabbatical year. Rebbi Joḥanan said, one does not whip for ploughing in the Sabbatical year. What is Rebbi Eleazar’s reason? The Land shall keep a Sabbath for the Eternal, a general principle. Your field you shall not sow, your vineyard you shall not prune, detail. The sower and the pruner were included in the general case; why were they mentioned separately? To include with them; since the sower and the pruner are particular in that they perform work on the ground or on a tree, I have only what is work on the ground or on a tree. How does Rebbi Joḥanan treat this? They are two different things, and two different details for one general principle do divide. In Rebbi Eleazar’s opinion they do not divide. But he holds that because they do not divide, they are for making inferences. In Rebbi Joḥanan’s opinion, they are not for making inferences. There is a difference here because He stated a general principle as a positive commandment but the detail as prohibitions. No positive commandment allows inferences for a prohibition and no prohibition allows inferences for a positive commandment. In Rebbi Eleazar’s opinion a positive commandment allows inferences for a prohibition but no prohibition allows inferences for a positive commandment. In Rebbi Joḥanan’s opinion it is obvious that one may dig cisterns, ditches, and caves during it. In Rebbi Eleazar’s opinion, may one dig cisterns, ditches, and caves during it? Just as one cannot make inferences for prohibitions, so one should not be able to make inferences for permissions. Rebbi Abba from Carthage said, Rebbi Joḥanan’s reason is six years you shall sow your field, not in the Sabbatical; and six years you shall prune your vineyard, not in the Sabbatical. Any prohibition inferred from a positive commandment is a positive commandment; one violates a positive commandment. Rebbi Jeremiah said, one violates a positive commandment. Rebbi Yose said, there is not even a positive commandment. But is it not written that the Land shall rest as a repose for the Eternal? That is for the prohibition implied by it.
[I could think that] they should be giving lashes for the addition. Rebbi Joḥanan explains the baraita: I could think that one gives lashes for ploughing during the Sabbatical year, but Rebbi Eleazar explains the baraita: I could think that one gives lashes for the first two terms. Some Tannaïm state: Six years you shall sow your field, and six years you shall prune your vineyard; but some Tannaïm state: Your field you shall not sow, etc. He who says six years supports Rebbi Joḥanan; he who says your field you shall not sow supports Rebbi Eleazar.
MISHNAH: And if the opposing party was suspect of perjury, how? Equally oaths about testimony, or oaths about deposits, or even vain oaths, if one of them was a dice-player, a lender on interest, a participant in pigeon contests, or a dealer in sabbatical produce, the opposing party swears and collects. If both of them were suspect, the oath returns to its place, the words of Rebbi Yose. Rebbi Meїr says, they shall split.
Dealers in sabbatical produce, that is the sabbatical trader. “Who is a sabbatical trader? One who sits idle all the years of a sabbatical cycle. In the sabbatical year he becomes active and trades in sabbatical produce. One does not accept him before another sabbatical year starts and he can be checked out that he repented in complete repentance.” Rebbi Yose stated, two sabbatical periods. “Rebbi Nehemiah says, repentance in money, not repentance in words; that he say to them, here are 200 denars, distribute them to the poor, for I earned them from forbidden produce.” They added shepherds, extortionists, and any who are suspect in money matters, that their testimony be invalid. Rebbi Abbahu said, shepherds of small animals.

MISHNAH: The following have to swear without a claim: Partners, and sharecroppers, and trustees, and a wife trading in the house, and a family member. If he says, what do you claim from me? “I want you to swear to me,” he is liable. After partners or sharecroppers distributed, he cannot force them to swear. If an oath was rolled over to him for another cause, one may roll everything over to him. The Sabbatical year remits an oath.
Rebbi Samuel ben Rav Isaac said, watch it for it is otherwise. What do we say? Watch it, for it is not negligible. “Owner,” “owner.” Since the owner mentioned there is subject to annulment, so also here he is subject to annulment. The Sabbatical annuls things which are his hand’s loans and annuls the corresponding oaths; the Sabbatical does not annul things which are not his hand’s loans, nor does it annul the corresponding oaths. “For anything which the Sabbatical annuls it annuls the corresponding oath; anything which the Sabbatical does not annul it does not annul the corresponding oath.”

The haughtiness of Jeroboam damned him absolutely. Rebbi Yose ben Jacob said, Jeroboam became king at the end of a Sabbatical year. This refers to what is written, at the end of seven years, at the time of the Sabbatical year, on the festival of Tabernacles, when all of Israel comes to appear before the Eternal, your God, at the place which He shall choose, you shall read this Torah in the presence of all of Israel to their ears. He said, if I am asked to read, I have to stand. They will say, the local king has precedence. But if I am reading as second, it is a shame for me. If I do not read, it is a disgrace for me. And if I let them go, they will ascend and desert me. They will go to Rehabeam, Solomon’s son. This is what is written: If this people would go up to sacrifice in the Temple in Jerusalem will this people’s heart return to their master, to Rehabeam. What did he do? He made two golden calves and wrote on their hearts, “they will kill you.” He said, any king who will succeed me will look at them. Rebbi Ḥuna said, companions of ingenious conjurations. Anybody who joined with him he will make a coconspirator. Rebbi Ḥuna said, a slaughtering place deepened by seducers, for he deepened in crime. He said, anybody, I shall kill anybody who makes this public.

HALAKHAH: “All statues are prohibited,” etc. Rebbi Ḥiyya bar Abba said, because they are worshipped in the great fortification of Rome twice in a Sabbatical period. Then at a place where they are worshipped they should be forbidden, at a place where they are not worshipped they should be permitted. Rebbi Yose said, since they became forbidden at one place, their kind becomes forbidden anywhere.
Rebbi Ḥiyya and Rebbi Immi. One said, “plough it well; then I will rent it from you after the Sabbatical.” The other one said, “may you succeed.” For him who said, plough it well; then I will rent it from you after the Sabbatical, what means “one greets them”? “May you succeed.” But he who said that one says to a Gentile, may you succeed, what means that one greets Jews? “Peace be on you.”

Explanation. Rebbi Ḥanina bar Pappa and Rebbi Samuel bar Naḥman passed by one of the ploughmen in the Sabbatical. Rebbi Samuel bar Naḥman said to him, may you succeed. Rebbi Ḥanina bar Pappa said to him, did not Rebbi teach, the passers-by did not say, etc., that it is forbidden to say “may you succeed” to one who ploughs in the Sabbatical? He told him, you know how to read but you do not know how to make a homily. The passers-by did not say, these are the nations who pass out of the world because they did not say to Israel, the blessing of the Eternal is on you. What does Israel say to them? We bless you in the name of the Eternal. Israel says to them, all the good things and happy circumstances that come into the world because of us are not enough for you; you do not say, come and take from these blessings for yourselves, but you roll over us pro-rated contributions and fines, head taxes and annonae.

It was stated: “The wages of donkey drivers, carriers, and all those working with Sabbatical produce are sabbatical.” Rebbi Ze`ira said, this baraita deals with permitted produce. And what Rebbi Joḥanan taught those of the House of Rebbi Yannai that they should not accept in their hands wine as wages but money, he taught them following Rebbi Jehudah and Rebbi Neḥemiah. Rebbi Ilai said, this baraita deals with idolatrous produce. As Rebbi Abbahu said in the name of Rebbi Joḥanan, in matters of libation wine they fined him a fine.

HALAKHAH: Rebbi Abba bar Mamal, Rav Amram, Rab Mattanah in the name of Rav: If somebody makes a loan to another person stipulating that he won’t press for repayment, the Sabbatical will remit it. Did we not state: “If somebody slaughters a cow and divides it up on New Year’s Day”? And Rebbi Eleazar said, this follows Rebbi Jehudah. But can he require payment on New Year’s Day? As Rebbi Abba said in the name of Rebbi Zeˋira: Since he could not ask him for payment, it is as if he could not believe him. And since he could not believe him, it is as if he could not pay him. And here, because he could have given him but did not give, the first [debt] is turned into a loan.
Rebbi Yose ben Rebbi Abun in the name of Rav: If somebody gives a loan to a person on condition that the Sabbatical not remit it, the Sabbatical does not remit it, as we have stated: “to return them after ten years instead of returning them after thirty days”. Are there ten years without a Sabbatical? Rebbi Huna said, Rav Naḥman and Rav Sheshet disagreed. One of them said, if the loan was given on a pledge; but the other said, if he writes him a prozbul.

It was stated: “For thirty days he will not come.” What means “for thirty days he will not come”? Samuel said, if somebody gives a loan to a person without specifying details, he has no right to ask for payment until after 30 days. Rebbi Jehudah came and explained: The Sabbatical year, the remitting year, is close. Is not the Sabbatical year the remitting year? Why does the verse say, the Sabbatical year, the remitting year, is close? Lest you say, I am not permitted to ask for payment until after 30 days; after 30 days the debt will be remitted and I will not collect. Therefore, it must say, the Sabbatical year, the remitting year, is close. Did not Rebbi Abba bar Mamal, Rav Amram, Rav Mattanah say in the name of Rav: If somebody makes a loan to another person stipulating that he will not press for repayment, the Sabbatical will remit it? Did not Rebbi Abba bar Mamal, Rav Amram, Rav Mattanah say in the name of Rav: If somebody makes a loan to another person stipulating that he will not press for repayment, the Sabbatical will remit it? It was found stated by Rebbi Ismael: The Sabbatical year, the remitting year, is close. Is not the Sabbatical year the remitting year? Why does the verse say, the Sabbatical year, the remitting year, is close? Lest you say, the entire six years his vineyard is available, his field is available but after six years the debt is remitted and I cannot collect. Therefore, it must say, the Sabbatical year, the remitting year, is close.
MISHNAH: If somebody escaped after sentence was passed, if he is returned to the same court, his case is not reopened. Anywhere two [people] will come forward and say, we testify against this man that he was condemned in court X on the testimony of Y and Z, he shall be executed. Criminal courts apply in the Land and outside the Land. A criminal court which hands out a death sentence once in a Sabbatical period is called terrorist. Rebbi Eleazar ben Azariah said, once in seventy years. Rebbi Tarphon and Rebbi Aqiba say, if we had been members of a criminal court, nobody ever would have been condemned to death there. Rabban Simeon ben Gamliel said, they would have increased the number of murderers in Israel.
MISHNAH: One might plough a single furrow and be liable because of it for eight prohibitions. If one ploughs with an ox and a donkey which had been sanctified for kilaim in a vineyard, in a Sabbatical year, on a holiday, he is a Cohen and a nazir at an impure place. Onias ben Ḥakhinai said, also if he wore kilaim. They told him, this is not of the same category. He told them, neither is the nazir of the same category.
The Babylonian Talmud
One who purchases a lulav from his fellow in the sabbatical year, [the latter] should give him the etrog as a gift, since one is not permitted to purchase it in the sabbatical year.

Because one must not give money for Sabbatical Year produce to an am haaretz. As it has been taught: One must not give money to an am haaretz for Sabbatical Year produce, more than he needs for three meals. And if he handed [him] over [more] he should say, "This money shall be redeemed for [the ordinary] fruit which I have in my house"

and [the purchaser] eats the produce [as though it has] the sanctity of the Sabbatical Year.
R. Sheshet objected: And [if one buys] from what is ownerless, [may he buy] three meals and no more? But there is a contradiction: Rue, asparagus, fenugreek, coriander of the mountains, water-parsley and meadow-eruca are always exempt from tithe and may be bought from anyone in the Sabbatical Year, since the like of these is not guarded.
But behold both R. Gamaliel and R. Eliezer agree that as regards the Sabbatical Year the etrog's status is determined by the time of its blossoming, as we have learned, The etrog is like a tree in three respects, and like a vegetable in one.
He holds the opinion as this (the following) Tanna, as it has been taught: R. Yose stated: Avtulmos testified in the name of five elders that the tithing of the etrog depends upon [the time of its] picking. But our Rabbis voted in Usha and said [that this applies] both to tithing and the Sabbatical Year.
But who mentioned the Sabbatical Year? There is something missing in the text, and so it should be read: The tithing of the etrog depends upon [the time of its] picking, and its subjection to the laws of the Sabbatical Year depends on [the time of its] blossoming. But our Rabbis voted in Usha and said that ... the etrog is dependent on the time of its picking as regards both tithing and the Sabbatical Year.

The reason then for the [permission to purchase a] lulav is that it is [the product of] the sixth year which entered the seventh, but if it were of the Sabbatical Year it would have been sacred? But why? ... Is it not just wood, and wood does not possess the sanctity of the Sabbatical Year, as it has been taught: ... Leaves of reeds and leaves of the vine which have been heaped up to store them upon a field: if they were gathered for [animal] food, they possess the sanctity of the Sabbatical Year, but if they were gathered for firewood, they do have not the sanctity of the Sabbatical Year.
