MISHNAH: The House of Shammai say, a man may send away his wife with an old bill of divorce, but the House of Hillel forbid it. And what is an old bill of divorce? If he was again alone with her after he wrote it for her.
HALAKHAH: “The House of Shammai say,” etc. Rav Jehudah in the name of Samuel: And any one of them if she was married should not leave, in order not to cause talk about her children.
We stated: “After he wrote it for her.” Some Tannaïm state “after he delivered it to her.” He who says “after he wrote it for her” supports the House of Shammai; he who says “after he delivered it to her” supports the House of Hillel.
MISHNAH: If he wrote a bill to divorce his wife and then changed his mind, the House of Shammai say, he disabled her from the priesthood. But the House of Hillel say, even if he handed her [the bill of divorce] and attached a condition, if the condition was not satisfied he did not disable her from the priesthood.
“A woman who engages in sex play with her son, the House of Shammai disqualify, the House of Hillel qualify.” Two women who mutually engage in sex play, the House of Shammai disqualify, the House of Hillel qualify.
“A woman who engages in sex play with her son, the House of Shammai disqualify, the House of Hillel qualify.” Two women who mutually engage in sex play, the House of Shammai disqualify, the House of Hillel qualify.
MISHNAH: If somebody divorced his wife but she stayed with him in a hostelry, the House of Shammai say that she does not need a second bill of divorce from him, but the House of Hillel say that she needs a second bill of divorce from him. When? If she was divorced after definitive marriage. But they agree that if she was divorced after preliminary marriage, she does not need a second bill of divorce from him since he was not intimate with her. If somebody married her based on a bald bill of divorce, she shall be divorced from both of them and all the indicated consequences apply to her.
HALAKHAH: “If somebody divorced his wife but she stayed with him,” etc. Rebbi Mana said, the House of Shammai are consistent and the House of Hillel are consistent. Since the House of Shammai say that “a man may send away his wife with an old bill of divorce,” they say that she does not need a second bill of divorce from him. Rebbi Yose ben Rebbi Abun said, the House of Shammai are consistent and the House of Hillel are consistent. Since the House of Shammai say that “a man shall not divorce his wife unless he found in her a matter of immorality,” thy say that she is dirty in his eyes and he is not suspected of having relations with her, therefore she does not need a second bill of divorce from him.. Since the House of Hillel say, “even if she spoiled his food”, they say that she is not dirty in his eyes, he is suspected of having relations with her, and she needs a second bill of divorce from him’.

Another argument: “Assume that he said to her, ‘you are permitted to every man except Mr. X;’ she went and married another and had children by him. Then her [second] husband died; she went and married Mr. X. Will not her children by her second husband become bastards?” His argument implies that divorce does not permit what the first husband had forbidden. Rebbi Shammai said, do we find that a woman was not originally forbidden to a man because of adultery and then retroactively became forbidden as adulterous? Rebbi Mana said to him, to what can you compare this? To one who told his wife, “this is your bill of divorce on condition that you sleep with Mr. X.” At the start, he is forbidden to have sexual relations with her. If he transgressed and slept with her, the divorce was retroactively validated.
MISHNAH: The House of Shammai say, a person should not divorce his wife unless he found her immoral, as it was said: “For he found with her a matter of nakedness.” But the House of Hillel say, even if she spoiled his dish, as it was said: “For he found with her a bad thing.” Rebbi Aqiba said, even if he found another more beautiful than her, as it was said: “It will be if she does not appear pleasing in his eyes, etc.”
HALAKHAH: Was it not stated in the name of the House of Shammai: Not only that the woman must leave because of incest; from where that she must leave if her head’s [hair] is loose, if the side seams of her dress are open, or her arms stripped bare? The verse says, “for he found in her a matter of nakedness.” How can the House of Shammai confirm this? Lest you say that one divorced because of immorality is forbidden, for anothercause she would be permitted. Rebbi Shila from Kefar-Tamarta said: The verse is difficult for the House of Shammai: “Her first husband, who had sent her away, cannot afterwards retake her.” Where do we hold? If to forbid her to him, is she not already forbidden to him? But we must hold, to burden him with a prohibition.

It is written: “And the unwell in her menstruation and the sufferer from gonorrhea in his flow.” The earlier Elders used to say, “she shall be in her menstruation”, she shall not use kohl nor any make-up until she comes into water. Rebbi Aqiba said to them: Is that a reason? If you say so, she makes herself ugly and he starts thinking to divorce her. It turns out that the Elders follow the House of Shammai and Rebbi Aqiba the House of Hillel.
MISHNAH: A wife may be acquired in three ways; she regains her autonomy in two ways. She is acquired by money, or by a document, or by intercourse. By money, the House of Shammai say, by a denar or a denar’s value; but the House of Hillel say, by a peruṭa or a peruṭa’s value. How much is a peruṭa? One eighth of an Italic assarius. She regains her autonomy by a bill of divorce or by the husband’s death. A sister-in-law is acquired by intercourse; she regains her autonomy by ḥaliṣah or by the brother-in-law’s death.
There, we have stated: “A judicial oath, for a claim of two silver pieces and a judicial acknowlegdment of a peruṭah. The claim, the House of Shammai say, an obolus, but the House of Hillel say, two obols.” The argument of the House of Shammai seems inverted. There, they say, “silver” is a denar, but here, they say that “silver” is an obolus. The argument of the House of Hillel seems inverted. There, they say, “money” is a peruṭah, but here, they say that “money” is two obols. Rebbi Jacob bar Aḥa in the name of Rebbi Ḥanina: The house of Shammai learn from the initial sale of a Hebrew girl. Since her initial sale was by [at least] a denar, so her preliminary marriage is by [at least] a denar. The House of Hillel learn from the end of her diminution. Since the end of her diminution is a peruṭah, so her preliminary marriage is by a peruṭah. What is the reason of the House of Shammai? As it is said: “She leaves gratis, without silver.” Would we not know that it is without money? Why does the verse say, “without silver”? From there, that she is sold for more than silver. And what is more than silver? A denar. But maybe “silver” is a peruṭah, more than silver two peruṭot? The smallest silver coin is an obolus. So why is it not an obolus? Rebbi Abun in the name of Rebbi Judah bar Pazi: For if she wants to diminish, she diminishes every year by an obolus and leaves. Could she not diminish by a peruṭah? Rebbi Abun said, think of it. If she wanted to compute the diminution at the start of the sixth year, there would be a peruṭah left, and at the end of the sixth year, there would be a peruṭah left. But the start of the diminution must be an obolus, the end of the diminution a peruṭah. If there is only one peruṭah left, can she not pay the diminished amount and leave? Just as the last diminished amount is a peruṭah, so her preliminary marriage should be a peruṭah! What is the reason of the House of Hillel? Since her last diminished amount is a peruṭah, you know that her preliminary marriage is by a peruṭah.

The argument of the House of Hillel seems inverted. It is written: “If a person give to his neighbor money or vessels to watch over.” If to teach that the court will not act on less that a peruṭah’s worth, is it not already written: “To incur liability for it”? To exclude anything not worth a peruṭah. (Why does the verse say, “without silver”?) From there, that it should be more than silver. And what is more than silver? Two obols. But maybe “silver” is a peruṭah, more than silver two peruṭot? The smallest silver coin is an obolus. So why is it not an obolus? “Or vessels”; since “vessels” are two, also “money” is two. How do the House of Shammai interpret “or vessels”? As we have stated: Rebbi Nathan says, “or vessels”, to include all kinds of vessels. Samuel said, if he claimed from him two needles and he admitted to one, he is guilty. Rebbi Ḥinena said, only if they are worth two perutot, that the claim should be about a perutah’s worth and the confession about a perutah’s worth. This follows the House of Shammai who do not learn money’s worth from “vessels”. But following the House of Hillel who learn money’s worth from “vessels”, since “vessels” are two, also “money” is two. Similarly, since “money” means two obols, also “vessels” means two oboli’s worth.

“Even though the House of Shammai and the House of Hillel disagreed about co-wives, and sisters, and an old bill of divorce, and a woman doubtfully married, and someone who gives qiddushin in the value of a peruṭa, and someone who divorces his wife and spends the night with her in a hostelry, and a woman who receives qiddushin for at least a denar or the value of a denar, the House of Shammai did not refrain from marrying women from the House of Hillel or the House of Hillel from the House of Shammai but they behave truthfully and in peace, as it is said: ‘Love truth and peace.’ ” Bastardy is between them and you say so? How is that? If a first man gives her qiddushin for a peruṭa and a second [gives her afterwards)] for a denar, in the opinion of the House of Shammai she is betrothed to the second and her child by the first is a bastard. In the opinion of the House of Hillel she is betrothed to the first and her child by the second is a bastard. Rebbi Jacob bar Aḥa in the name of Rebbi Joḥanan: The House of Shammai concede to the House of Hillel as a restriction. In that case, the House of Shammai should marry women from the House of Hillel since they concede to them. But the House of Hillel should not marry women from the House of Shammai since they do not concede to them. Rebbi Joḥanan in the name of Rebbi Yannai: They all followed the same practice. If they followed the same practice, in this case we stated: “The House of Shammai sent and diminished it, since the House of Shammai say unless most of it is missing?” Rebbi Yose ben Rebbi Abun said, the House of Shammai acted before the question came before the House of Hillel. After a question came before the House of Hillel, the House of Shammai were not touching it. Rebbi Abba Mari said, that is correct. Did we not state: “They declared impure all purities from before”, but not in the future. Rebbi Yose ben Rebbi Abun said, Rav and Samuel disagreed. One said both acted according to valid practice; the other said, each party followed their own practice. Bastardy is between them and you say so? The Omnipresent watched and no case ever happened.

After a question came before the House of Hillel, the House of Shammai were not touching it. Rebbi Abba Mari said, that is correct. In this matter, it was stated: “About anybody who wanted to take upon himself the stringencies both of the House of Shammai and the House of Hillel it was said: ‘The silly one walks in darkness’. The leniencies of both of them, he is called wicked. Either following the words of the House of Shammai in their leniencies and stringencies, or following the words of the House of Hillel in their leniencies and stringencies.” That is, before there came the disembodied voice. A Mishnah says that slaves follow the rules of real estate. A baraita states, the rules of movables. A baraita states, neither the rules of realestate nor the rules of movables. A Mishnah says that slaves follow the rules of real estate, as we have stated there: “Possession of houses, cisterns, ditches, and caves, bath houses, and dovecots, olive presses, and irrigated fields, and slaves.” A baraita states, slaves do not follow the rules of movables. As it is stated: What is possession of a slave? He tied his shoe for him, or untied his shoe, carried his things to the bath. Rebbi Simeon says, if he lifted him, that is possession. If he lifted his master, there is no stronger possession than this. A statement of the rabbis says that slaves follow the rules of movables. For Rebbi Yose said in the name of rabbis, there is no lien for a gift; one does not collect from slaves as from real estate. Rebbi Mana asked Rebbi Shammai, who are those rabbis? He told him, Rebbi Isaac and Rebbi Immi. A widow took a slave girl. The case came before Rebbi Isaac who said, what she took, she took. Rebbi Immi took her away, for she thought that she was hers but she was not hers. Not of real estate, as it was stated: Real estate and slaves; he took possession of the real estate. If you say that slaves follow the rules of real estate, when he took possession of the real estate he would have taken possession of the slaves, since Rebbi Yasa said in the name of Rebbi Joḥanan: If he had two fields, one in Judea and one in Galilee. If he took possession of the one in Judea with intention to take possession also of that in Galilee, or of the one in Galilee with intention to take possession also of that in Judea, he acquired. Not of movables. If you say that slaves follow the rules of movables, when he took possession of the movables he would have taken possessionof the slaves, since we did state there: “For property that is not guaranteed will cause guaranteed properties to be objects of swearing about them.”
The House of Shammai say, an agent may not testify as witness. But the House of Hillel say, an agent may testify as witness. How is that? If he sent two, in the opinion of the House of Shammai there is an agent and two witnesses. In the opinion of the House of Hillel, all three can be agents and all three can be witnesses. Rebbi Abun bar Ḥiyya said, the matter is reasonable if the preliminary marriage was executed by document. But if he executed the preliminary marriage by money, he became an interested party in his testimony. Rebbi Yose said, since the Torah made him trustworthy, even if he executed the preliminary marriage by money, he did not become an interested party in his testimony. Rebbi Abba said, there came a case before Rav who admitted the agent as witness. A person deposited his amphoras in another’s corral; [the latter] reneged. The case came before Rebbi Jeremiah who admitted the agent as witness and made him swear [by the testimony of] the porter.

It was stated: Three who invested together and suffered theft, absorb [the loss] in the same way. But was it not stated: If those [precious] stones were stolen, half for each one. Rebbi Shammai said, tetradrachmas are large and it is possible to subdivide exactly but stones are easy and it is impossible to know which part in it belongs to whom. Because of the doubt, each one takes proportional to his investment. What did you see to say that we deal with theft, maybe one deals only with what is left? Rebbi Yose ben Rebbi Abun said, even if you say that we deal with theft, would not equity be hurt? Think of it, if one invested 50 and the other 150. If 50 was stolen, would not the one with 50 not lose anything?
“One who robbed a beam and built it into a large building. The House of Shammai say, he has to tear down the entire building and return it. But the House of Hillel say, he has to pay its worth to support the penitents. If he went into another person’s ruined building and rebuilt it without permission, one estimates for him and his hand is disadvantaged. If he rebuilt it with permission, one estimates for him and his hand is advantaged. If he wanted to take his wood and stones, one does not listen to him.” Rebbi Jacob bar Aḥa in the name of Rebbi Joshua ben Levi: Because of the settlement in the Land of Israel. Rav Naḥman bar Isaac asked: If somebody temporarily entered another person’s ruin to put down his bundle, when he wanted to take it up again does one not listen to him? When he heard what Rebbi Jacob bar Aḥa had said, because of the settlement in the Land of Israel, he said: That is a statement. But if he built at a place unfit for building, or planted trees at a place unfit for planting, Rav said one estimates for him but one tricks him to permit entry both in summer and in winter. One said to him: Was that not already stated: “One estimates for him and his hand is disadvantaged?”
MISHNAH: If a person appropriates a deposit, the House of Shammai say, he shall be hit by less or more, but the House of Hillel say, [at the price] at the time of delivery; Rebbi Aqiba says, at the time of claim. If somebody intends to take the deposit, the House of Shammai hold him liable but the House of Hillel say, he is liable only from the moment he takes it. How is this? If he tilted the amphora and took a quartarius, and then it broke, he pays only for a quartarius. If he lifted it and took a quartarius, and then it broke, he pays for all.

And what is the reason of the House of Shammai? “Any talk of criminality.” How do the House of Hillel explain “any talk of criminality’? I could think only if he acts alone, etc.
Rebbi Crispus asked: Does he check every year or only once every three years? Let us hear from the following: If somebody sells wine for a year, he has to warrant it until after Tabernacles. Rebbi Yudan said, explain it for those Galileans who only harvest after Tabernacles and you cannot deduce anything. That is what was said, “old from the preceding year, aged three years”, should we say because of the tasting? May one check one amphora on which all others depend [or] does he have to check every single one whether they would not turn into vinegar? Rebbi Shammai said, there are people who knock on the barrel at the top and know what is inside.
MISHNAH: If the house collapsed on him and his father, or on him and his heirs, or on him and one from whom he inherits, and a woman’s ketubah and documents of indebtedness were on him. The father’s heirs say that the son died first and then the father; the holders of the debt say that the father died first and then the son. Rebbi Huna handed a document to Rebbi Shammai. Ὸγδοή- was on an erasure, -κοντα was not on an erasure. Rebbi Ḥuna told Rebbi Shammai, find out what is the minimum with which -κοντα is used. He went out and said, τριάκοντα. After they left, he said, this one wanted to gain 30 and lost 20.

“From where that one adds another three, etc. It was stated: Rabban Simeon ben Gamliel said, in earlier times the ketubah of qualified women was signed only by priests, Levites, or Israel whose daughters were qualified to marry into the priesthood. Rebbi Yose said, in earlier times there was no disagreement in Israel but the Synhedrion of 71 members were sitting in the free-stone hall; two courts of three members each were sitting, one in the glacis and one on the Temple Mount; and a court of 23 was sitting in every town of the Land of Israel. If somebody had a question of religious practice, he went and asked it from the court in his town. If they had heard [the answer], they told him; otherwise he and their distinguished member went and asked a court in their neighborhood. If these had heard [the answer], they told him; otherwise he and their distinguished member went and asked from the court on the Temple Mount. If these had heard [the answer], they told him; otherwise he and their distinguished member went and asked from the court on the glacis. If these had heard [the answer], they told him; otherwise they together entered the High Court in the free-stone hall since from there instruction came accepted in all of Israel, as it is said: From this place which the Eternal will choose. Even though the Synhedrion in the free-stone hall had 71 members, those present never numbered less than 23. If one of them had to leave, he was looking around; if 23 others were present, he would leave, otherwise he would not leave. They were in session from the daily morning sacrifice to the daily evening sacrifice. On Sabbaths and holidays, they were sitting in the study hall on the Temple Mount. If a question of practice came up, if they had heard the answer, they told them; otherwise they prepared to vote. If a majority was for acquitting, they acquitted. If a majority was for a guilty verdict, they rendered a verdict of guilty. If a majority was for declaring pure, they declared pure. If a majority was for declaring impure, they declared impure. From the time that there were many students of Shammai and Hillel who did not study enough under their teachers, many disagreements arose and two doctrines developed. From there, they were sending to all towns in the Land of Israel; any time they found a person who was wise, meek, even-tempered, benevolent, pleasing, humble, good-hearted, with good intentions, and well endowed, they were placing him on the court of the Temple Mount, from there to the court on the glacis, and from there to the High Court in the free-stone hall.
Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and the other says, I saw two hairs on his side. If one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his side. Two are saying, we saw one hair on his back; and two are saying, we saw one hair on his belly. Rav Yose and Rav Hoshaia ben Rav Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe they were rubbed off. One says, two hairs on his back; and one says, two on his belly. Rebbi Abba said, everybody agrees that this is valid. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Yose said, this is in disagreement. Rebbi [Yose] said to Rebbi Ḥaggai, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mama said, Rebbi Ḥaggai was correct. If a document was signed by four seals, if one person verified the signature of two [witnesses], and another those of the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single hair needs two witnesses. Rebbi Ḥinena learns it (because of) [from the years of] squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth, fifth, and sixth years, is that worth anything? Does not every single year need two witnesses? And here, every single hair needs two witnesses.
There, we have stated: “If two groups of witnesses were testifying against a person, one group say that he vowed nazir twice, the others say that he vowed nazir five times. The House of Shammai say, the testimony is split and there is no nezirut there. But the House of Hillel say, five contains two; he should be a nazir twice.” Rav said, they differ in the overall testimony. But in detail, everybody agrees that the testimony is split. Rebbi Joḥanan said, they differ in counting. But in an overall testimony, everybody agrees that five contains two. What is overall and what is counting? Overall, this one says two, the other one says five. Counting, this one says one, two, the other one says three, four.
What is the reason of the House of Shammai? “Bring me my husband and I shall drink.” What is the reason of the House of Hillel? Since there is no husband to let her drink, the Torah returns her to a state of doubt, which induces another doubt, which remains a doubt.
It was stated: If an heir’s father held a partially paid promissory note, the son collects without swearing. In this the son’s power is greater than the father’s since the father can collect only by swearing. Rebbi Eleazar said, nevertheless he has to execute an heir’s oath, “that our father did not charge us, that our father did not tell us, that we did not find a document among our father’s documents stating that this note was paid.” Therefore, if there was a document, the note was paid. Rebbi Hoshaia asked, does the baraita follow the House of Shammai? For the House of Shammai say, “she collects her ketubah and does not drink.” Rebbi Yose said, there the reason of the House of Shammai is: bring my husband and I shall drink! But here, it would be in order that even his father would not have to swear. They instituted a rule that he has to swear. They instituted this for him, but not for his son. When he died, you put his son on the biblical rule.

Rebbi Jacob bar Aḥa in the name of Rebbi Yasa: The one who stands before the Ark on New Year’s holiday does not have to mention the New Moon. Rebbi Aḥa bar Pappus said, it was stated thus: “The one who stands before the Ark on New Year’s holiday in the morning, the House of Shammai say, he prays eight [benedictions], but the House of Hillel say seven. For musaf, the House of Shammai say ten, but the House of Hillel say nine.” Should he not say eleven? Rebbi Yose said, where do they disagree? In a matter which needs a separate benediction. But here even on a weekday he simply includes it. So he should mention it in “Service”. Rebbi Yose asked, since the two he-goats of New Year’s day come because of the New Moon, why do you say that he does not have to mention the New Moon? Rebbi Yose ben Rebbi Bun said, does Rebbi Abba bar Mamal not ask correctly? As it was stated: “The two lambs of Pentecost and the two he-goats of New Year’s Day.” If the first atoned, what does the second atone for? For impurity that happened between them. Is that not Rebbi Simeon’s? And Rebbi Simeon splits atoning. But if both of them were for the New Moon? Rebbi Abba Mari said, you cannot do that, since it is written, in addition to the elevation offering of the month. In addition, from what we have stated, “twelve for the twelve months of the year.” A patrician stood before the Ark and did not mention the New Moon; they praised him. Rav Hoshaia asked: think of it, if they slaughtered both of them simultaneously? What impurity happened between them? Rebbi Bun said, if all of Israel are proper, would they not bring what the Torah prescribed for them?

Or like the following. “One accepts the witnesses’ testimony only if they saw it together. Rebbi Joshua ben Qorḥa says, even if they saw it one after the other.” Rebbi Jeremiah, Rebbi Samuel ben Rav Isaac in the name of Rav Isaac who said in the name of Rav: The Sages agree with Rebbi Joshua ben Qorḥa with regard to witnesses of firstlings and witnesses of squatters’ rights. Rebbi Abba in the name of Rebbi Jeremiah: the same holds for testimony regarding signs. In that case, it is obvious if one says, I saw two hairs on his back and one says, I saw one hair on his back and the other says, I saw one hair on his belly, that is nothing; so much more his back and his back. Two are saying, we saw one hair on his back; and one is saying, I saw one hair on his belly. Rebbi Yose ben Rebbi Bun and Rebbi Hoshaia ben Rebbi Shammai, one said, it is invalid, but the other said, it is valid. He who says it is invalid considers him as one who testifies to half a sign. He who says it is valid? I say, maybe it was rubbed off. One says, I saw two hairs on his back; and one says, I saw two on his belly. Rebbi Abba said, everybody agrees that this is valid. Rebbi Ḥaggai said, everybody agrees that this is invalid [testimony]. Rebbi Yose says, this is in disagreement. Rebbi Yudan said, this is in disagreement. Rebbi Yose said to Rebbi Ḥaggai, does not Rebbi Yudan follow my opinion? He answered, I am disagreeing with his teacher, so much more with him. Rebbi Mana said, Rebbi Ḥaggai was correct. If a document was signed by four seals, if one person (permitted) two, and another (questioned) the other two, and the document was attacked, is that worth anything? Does not every single signature need two witnesses? And here, every single sign needs two witnesses. Rebbi Ḥanina learns it from the years of squatting rights. If one [witness] testified that he ate from the property the first, second, and third years and another testified that he ate it the fourth and fifth years, is that worth anything? Does not every single year need two witnesses? And here, every single sign needs two witnesses.
HALAKHAH: “A judicial oath,” etc. The claim, the House of Shammai say, an obolos, but the House of Hillel say, two oboloi. The argument of the House of Shammai seems inverted. There, they say, “silver” is a denar, but here, they say that “silver” is an obolos. The argument of the House of Hillel seems inverted. There, they say that “money” is a peruṭah but here, they say that “money” is two oboloi. As it is said, she leaves gratis, without silver. Would we not know that it is without money? Why does the verse say, without silver? From there, that she is sold for more than silver. And what is more than silver? A denar. But maybe “silver” is a peruṭah, more than silver two peruṭot. The smallest silver coin is an obolos. So why is it not an obolos? Rebbi Abun in the name of Rebbi Judah bar Pazi: For if she wants to diminish, she diminishes every year by an obolos and leaves. Could she not diminish by a peruṭah? Rebbi Abun said, think of it. If she wanted to compute the diminution at the start of the sixth year, there would be a peruṭah left. But the start of the diminution must be an obolos, the end of the diminution a peruṭah. Think of it, if there is only one peruṭah’s worth left, can she not pay the diminished amount and leave? Just as the last diminished amount is a peruṭah, so her preliminary marriage is by a peruṭah.

The argument of the House of Hillel seems inverted. If a person give to his neighbor, etc. If to teach that the court will not act on less than a peruṭah’s worth, is it not already written, to incur liability for it? Following what Rebbi Nathan stated, or vessels, including clay vessels. Samuel said, if he claimed from him two needles and he admitted to one, he is liable. Rebbi Ḥinena said, only if they are worth two peruṭot, that the claim should be about a peruṭah’s worth and the confession about a peruṭah’s worth. This follows the House of Shammai who do not learn money’s worth from “vessels”. But following the House of Hillel who learn money’s worth from “vessels”, since vessels are two, also “money” is two. Similarly, since “money” means two oboloi, also “vessels” means two oboloi’s worth.

That is to say, only if he did not introduce them. But if he introduced them, the householder has no liability, following what Rebbi Jehudah bar Shalom said: One did introduce the porters to the food merchants. They came, but they sent them away without giving them anything. The case came before Rebbi Shammai. Since if the food merchants had said that they took, would at the end not these and those collect? Therefore, they shall collect immediately.
HALAKHAH: “There are four kinds of keepers,” etc. Rebbi Joḥanan said, there are four kinds of keepers and they become liable only through acquisition. Rebbi Jacob bar Aḥa in the name of Rebbi Eleazar: Also in matters of robbery they become liable only through acquisition. Rebbi Yose ben Rebbi Bun said, a baraita said so: “one who contracts with another for a field,” etc. Rebbi Ḥananiah said, Rebbi Abun, also in theft cases they become liable only through acquisition. Rebbi Ḥananiah in the name of Rebbi Phineas, our Mishnah said so: “If he was pulling it to lead it out but it died on the owner’s property, he is not liable. If he lifted it or had it led outside the owner’s property when it died, he is liable.” If he lifted it inside the owner’s property it is as if he had taken it out of the entire property of the owner. If he was pulling it and it left, only after it left the entire property of the owner. Rebbi Abbahu in the name of Rebbi Joḥanan: If it was standing at his feeding trough. Rebbi Abun bar Ḥiyya asked: If it was standing at his feeding trough then even if he did not pull it! But we must deal with the case that it was standing in the public domain. Does Rebbi Abun bar Ḥiyya follow the House of Shammai, since the House of Shammai say, “he shall be hit by less or more”? How do we hold? If it was standing in the public domain and he intended to rustle it when it died, according to everybody he became liable by that intention. If he did not start to pull it, according to everybody he is not liable. But we most hold that it was standing at a feeding trough on his property. What is the reason of the House of Shammai? Any word of criminality. How do the House of Hillel explain the reason of the House of Shammai? “Criminality,” any word of criminality. Explain it if he appropriated it through an agent.

Rebbi Ḥiyya bar Abba in the name of Rebbi Joḥanan: At first they were saying, one curdles neither with the stomach content of the carcass nor with the stomach contents of the Gentile. They changed to say, one curdles with the stomach content of the carcass but not with the stomach contents of the Gentile. Rebbi Abba bar Zavda, Rebbi Samuel bar Rav Isaac asked: Does this negate the declaration of Rebbi Eliezer, since Rebbi Eliezer said, the thoughts of the Non-Jew are about pagan worship? Rebbi (Assi) [Yasa] came in the name of Rebbi Joḥanan: Originally, they said, one does curdle [neither] with carcass stomach contents nor with Gentile’s stomach contents. They changed to say, one does curdle with carcass stomach contents and with Gentile’s stomach contents. The language of a baraita supports Rebbi Ḥiyya bar Abba: Stomach contents of a Gentile or a carcass is forbidden following the original teaching. (The stomach contents of a torn animal which suckled from a qualified one are permitted following the later teaching; the stomach contents of a qualified animal which suckled from a torn one are forbidden following the later teaching.) [The stomach contents of a qualified animal which suckled from a torn one are forbidden following the former teaching, and the stomach contents of a torn animal which suckled from a qualified one are permitted following the later teaching.] And even if the House of Shammai would argue like the House of Hillel in the first teaching, an egg is a growth of its body; the contents of the stomach come from the outside. It parallels what Rebbi Yose ben Rebbi Abun said in the name of Rebbi Joḥanan: It happened to the son[s] of (Rebbi) Jehudah ben Shamua that wolves tore more than 300 of their flock. The case came before the Sages who permitted their stomach contents. They said, an egg is a growth of its body; the contents of the stomach come from the outside.
MISHNAH: Shammai says, every woman’s timing is exact; Hillel says, from checking to checking, even if that is a long time. But the Sages say following neither of them but for checking to checking to be reduced by 24 hours, and from 24 hours to be reduced by checking. Every woman with a regular period follows her exact timing; and if one has intercourse with cloths, this counts as checking and is reduced by 24 hours and by checking.
HALAKHAH: “Shammai says, every woman’s timing is exact,” etc. What means, “their timing is exact”? They do not retroactively impart impurity to food prepared in purity. “But the Sages say following neither of them,” not following Shammai who imposed no restriction, and not like Hillel who went overboard. “But for checking to checking it is reduced by 24 hours, and from 24 hours is reduced by checking.” How is checking to checking reduced by 24 hours? If she checked herself on Tuesday and saw blood on Thursday, [her food] is impure only from the same time on Wednesday. How is 24 hours reduced by checking? If she checked herself out in the morning and saw in the afternoon, it is impure only starting from the morning.

There, we have stated: “A [dead] crawling animal found in a dead-end alley causes impurity retroactively. Rebbi Immi asked, does this Mishnah not disagree with Shammai? Rebbi Yose said, this is true, it does not follow Shammai, but even Hillel it does not follow. Does Hillel not agree that a dead-end alley which was swept or inundated by a rainstorm is pure? Shammai says, since this woman regularly urinates, she is like a dead-end alley which was swept or inundated by a rainstorm and is pure.

MISHNAH: All women are presumed pure for their husbands. The wives of men coming from a trip are presumed pure. The House of Shammai say, she needs two cloths for each intercourse or she should have sex by candle light. The House of Hillel say, two cloths for entire night suffice.
“The House of Shammai say, she needs two cloths for each intercourse or she should have sex by candle light.” But was it not stated: The person who engages in sex by light is blameworthy? So is the Mishnah: She may have sex and [then] check by candle light. Rebbi Ze‘ira, Rav Ḥiyya bar Ashi in the name of Rav: If she had intercourse using a cloth, she is forbidden to her house. Rebbi Ze‘ira said, if her proof exists, she is permitted; if there is no proof, not so much more? Rebbi Yose said, there, you can determine the facts; here, you cannot determine the facts.
MISHNAH: Five kinds of blood are impure from a woman: Red, black, like saffron stigma, and like earth water, and like mixed wine. The Hause of Shammai say, also like fenugreek water and like roast beef juice, but the House of Hillel declare these pure. The green Aqabia ben Mahalalel declares impure but the Sages declare it pure. Rebbi Meïr said, if it does not cause impurity as a stain, it causes impurity as a body fluid. Rebbi Yose says, neither one nor the other.
“The Hause of Shammai say, also like fenugreek water and like roast beef juice.” That makes seven. They are similar to earth water. Rebbi Yose in the name of Rav, the colleagues in the name of Rebbi Joḥanan: Rebbi Meïr did not declare impure, only Aqabia mentioned it. Then it also should bring impurity like fenugreek water and like roast beef juice which were mentioned by the House of Shammai! These are similar to earth water. Pure blood prepares for impurity, impure blood does not prepare.

“And like mixed wine.” Abba bar Ḥana in the name of Rebbi Joḥanan: As one sees a cup of mixed wine from the outside. They wanted to say, in a Tiberian cup. Rebbi Eudaimon from Sepphoris said before Rebbi Mana: As in a small phial whose walls do not cast a shadow. Samuel said, anybody who has no experience in seeing kinds of pure blood should not judge kinds of impure blood. Rav said, only if he is competent about them and their names. The words of Rebbi Joḥanan say so: I know all kinds of pure blood and of impure blood. The pure is the most red; the impure is like earth water. “If he has no experience,” therefore, if he has experience he can judge it. In addition, from what we have stated: clear but not turbid. Rebbi Ḥanina used it turbid. They said before Rebbi Joḥanan: Rebbi Ḥanina uses it turbid, but you said, not turbid. He said to them, Rebbi Ḥanina drinks old [wine], Rebbi Joḥanan does not drink old [wine], Rebbi Ḥanina drinks oldest [wine]. Rebbi Hoshaiah said: Since Rebbi Hoshaiah’s eye is full of happenings, even turbid is not disqualified for him. Rebbi Shammai in the name of Rebbi Aḥa: Rebbi Ḥanina estimated with a lump of earth. Rebbi Abun, Rebbi Shammai in the name of Rebbi Aḥa: Since we know that Rebbi Ḥanina is competent, do we follow his precedents? Rebbi Ḥanina was living in Sepphoris, they brought cases before him and he decided on the basis of three precedents. Rebbi Joḥanan and Rebbi Simeon ben Laqish were there but he did not invite them to sit with him. They said, the old man is a Sage since his irons are sharp! Once he invited them to sit with him. They said, for what reason do you take notice of us this time? He said, so should come over me if I had not heard every single case from Rebbi in theory as many times as there are hairs on my head, and in a practical way three times; but the present case did come before Rebbi only twice. Therefore, I adjoined you with me.

The Babylonian Talmud
MISHNAH III Bet Shammai say : In the evening a man should recline and read [the Shema'], and in the morning he should stand up [to read it] ; as it is said, "When thou liest down and when thou risest up" (Deut. vi. 7).
R. Tarphon said : I was once journeying by the way and I reclined to read [the Shema'], according to the view of Bet Shammai, and I placed myself in danger on account of robbers.
GEMARA It is all very well that Bet Hillel explain their reasons and the reason of Bet Shammai ; but why do not Bet Shammai agree with Bet Hillel?
GEMARA It is all very well that Bet Hillel explain their reasons and the reason of Bet Shammai ; but why do not Bet Shammai agree with Bet Hillel?
Bet Shammai would tell thee : In that case, the text should read, "In the morning and at even" ; what means "When thou liest down and when thou risest up" ? At the time of lying down, there should be actual lying down [to read the Shema'], and at the time of rising up, there should be actual rising up.
What, then, do Bet Shammai make of the phrase "and when thou walkest by the way"?
And Bet Shammai?
He replied, "I have acted according to the teaching of Bet Hillel, and thou according to the teaching of Bet Shammai. Not only that, [I sat up] lest the disciples see this and fix the Halakah for future generations."
Shouldest thou say, "Bet Hillel also hold [that the Shema' may be read] in a reclining position!" that is so, but only when one was reclining from the first ; but in thy case, since hitherto thou has been sitting up and now thou reclinest, they will say, "We have to infer that [our teachers] agree with the opinion of Bet Shammai," and there is a fear, that the disciples seeing this, will fix the Halakah accordingly for future generations.
Rab Ezekiel taught : If a man acted in accordance with the view of Bet Shammai, he has done [rightly] ; if in accordance with the view of Bet Hillel, he has done [rightly].
Rab Joseph said : If he acted in accordance with the view of Bet Shammai, he has done nothing at all. For there is a Mishnaic teaching : If the head and greater part of a man's body be in a Sukkah and his table inside his house, Bet Shammai pronounce it invalid, but Bet Hillel declare it valid.

Bet Hillel said to Bet Shammai, "It once happened that the Elders of Bet Shammai and the Elders of Bet Hillel went to visit R. Johanan b. ha-Horanit and they found him with his head and the greater part of his body in the Sukkah and his table inside his house, but they said nothing to him."
