Jerusalem Talmud Sheviit 2:31

It was stated: The Sages enumerated six cases for Egyptian bean. If one sowed it for seeds it is tithed for the past; if he sowed it as vegetable it is tithed for the future. If he sowed it for both seeds and vegetable, or if he sowed for seeds and then wanted it as vegetable, one may tithe from its seed on vegetable and from vegetable on seeds, on condition that it was one-third ripe before the New Year. But if it was only ripe one-third after the New Year, its seed is tithed for the past and its vegetable is tithed at the moment of its being plucked if it was collected before the New Year. But if some of it was collected after the New Year, both seed and vegetable are tithed for the future.

Jerusalem Talmud Sheviit 2:32

If he sowed it for seeds and then thought about it for vegetable, it follows his thought. If he sowed it as vegetable, the thought of seeds cannot take hold on it unless he withheld three morbiot. That is, if it was one-third ripe before the New Year, but if it was not one-third ripe before the New Year, even if he did not withhold three morbiot. If he sowed for seeds and all [plants] formed complete pods before the New Year, its seeds are tithed for the past year, its greens are tithed at the time of their harvest. If some [plants] had formed complete pods but some did not, that is the case of: “He collects it together with his threshing, it turns out that he tithes from his seeds for his vegetable and from his vegetable for his fruits”. Rebbi Eudaimon from Haifa stated: Even if not all [plants] formed complete pods before the New Year, its seeds are tithed for the past year, its greens are tithed at the time of their harvest. Rebbi Yose said, that is if it was one-third ripe for the intention of seeds. But if it was one-third ripe for the intention of vegetables, it is impossible to say that its seeds are tithed for the past year and its greens are tithed at the time of their harvest, since you say that “he collects it together with his threshing; it turns out that he tithes from his seeds for his vegetable and from his vegetable for his seeds”.

MISHNAH: Sterile onions and Egyptian beans from which water was withheld thirty days before the New Year are tithed for the past [year] and may be kept in the Sabbatical year; otherwise they are forbidden in the Sabbatical year and are tithed for the coming year. For those from a ba‘al field, if one withheld water for two periods, the words of Rebbi Meïr, but the Sages say three.

Jerusalem Talmud Sheviit 4:30

MISHNAH: When does one start to eat tree fruits in the Sabbatical year? Unripe figs when they started to be radiant one eats with his bread in the field; when they became large one takes them into his house and in this state in other years of the Sabbatical cycle they must be tithed. Jerusalem Talmud Sheviit 5:3

It was stated: “Rabban Simeon ben Gamliel says, a tree that buds before the fifteenth of Ševaṭ is tithed for the past [year]; after the fifteenth of Ševaṭ it is tithed for the coming [year].” It was stated: “Rebbi Neḥemiah said, when has this been said? For a tree producing two threshing floors a year. But trees making only one threshing floor per year, such as olive trees, date palms and carob trees, even if they budded before this day, belong to the future.” Rebbi Joḥanan said, people use to follow Rebbi Neḥemiah for carobs. Rebbi Simeon objected before Rebbi Joḥanan: Did we not state that “the Sabbatical of white figs is the second year since they produce after three years”? According to you, those ripened in the Sabbatical year should be Sabbatical! He accepted that. Rebbi Abun bar Cahana said, I wonder how Rebbi Simeon ben Laqish could bring this objection before Rebbi Joḥanan and he accepted it. Could he not object: I am speaking about carobs and you about white figs, I am speaking about custom and you about practice, I am speaking about Rebbi Neḥemiah and you about the rabbis! It follows that the rules are equal for carobs and white figs, custom and practice, Rebbi Neḥemiah and the rabbis.

There, they say: A tree which buds before the New Year’s Day of the World is tithed for the past; after the New Year’s Day of the World it is tithed for the future. Rebbi Yudan bar Pedaiah objected before Rebbi Jonah: But carob trees form buds before New Year’s Day and are tithed for the future! Rebbi Assi said, if it was one-third ripe before the New Year’s Day of the World it is tithed for the past, after the New Year’s Day of the World it is tithed for the future. Rebbi Zeїra objected before Rebbi Assi: Some years are late and dates start to have sap after the New Year’s Day of the World but they are tithed for the past! Rebbi Zeїra said, Rebbi Assi did not say this on his own but following Rebbi Joḥanan, Rebbi Simeon ben Laqish. Rebbi Jacob bar Aḥa in the name of Samuel bar Abba: “If it was one-third ripe before the Fifteenth of Ševaṭ it is tithed for the past, after the Fifteenth of Ševaṭ for the future.” Rebbi Zeїra said, that is correct; for an etrog, did one not eliminate its budding but not its year; but here did one eliminate its year but not its budding?

Jerusalem Talmud Terumot 11:10

Rebbi Eliezer agrees that if he tithed the dates, their honey is permitted even in Spain. This implies that he tithes dates including honey proportional to the dates. “Rebbi Eliezer subjects date honey to tithes.” We have stated: “Rebbi Nathan says, not that Rebbi Eliezer subjects it to tithes but Rebbi Eliezer says he should not eat from the tithes until he also tithed the honey.” This implies that he tithes dates including honey proportional to honey and dates.

Jerusalem Talmud Maasrot 2:16

MISHNAH: Fruits from which he gave heave before they were completely processed, Rebbi Eliezer prohibits to eat snacks from them but the Sages permit it except for harvesting-baskets of figs. Rebbi Simeon permits from a harvesting-basket of figs from which heave was taken but the Sages forbid. If somebody says to another person, here take this as and give me five figs for it, he should not eat before he tithed, the words of Rebbi Meir. Rebbi Jehudah says, if he eats them singly he is free, if he takes them together he is obligated. Rebbi Jehudah said, there is a story that a rose garden was in Jerusalem whose figs were sold three or four for an as and nobody ever gave heave and tithes for them.

MISHNAH: If children hid figs for the Sabbath and he forgot to tithe them they may not be eaten after the Sabbath until they are tithed. A Sabbath basket the House of Shammai free but the House of Hillel obligate. Rebbi Jehudah says, also one who fills a harvesting basket to send to a friend may not eat from it unless he tithed. He who takes olives from the vat may dip them singly into salt and eat them, but if he salted them as a dish he is obligated. Rebbi Eliezer says, from a pure vat he is obligated but from an impure one he is free because he might put the leftovers back [into the vat]. One may drink from the winepress both warm or cold and is free, the words of Rebbi Meïr. Rebbi Eleazar ben Rebbi Ẓadoq declares him obligated. HALAKHAH: Rav Hamnuna said, if a child covered a harvesting basket for transport to the market, it became ṭevel; in any situation in which the intent of an adult has an effect, the action of a minor has an effect. Rebbi Zeïra asked: Since the intent of an adult does not have an effect until he opens on the market, the action of a minor should not have an effect until he opens on the market! The Mishnah disagrees with Rav Hamnuna: “If children hid figs for the Sabbath and he forgot to tithe them they may not be eaten after the Sabbath until they are tithed.” Rebbi Zeïra in the name of Rav Hamnuna: Explain if it they collected close to sundown when their action was proof of their intent!

If somebody rolls wheat grains he may blow away the chaff from his hand and eat but if he blew away and stored in the fold of his toga, he is obligated. If coriander is sown for its seed, its greenery is free. If it was sown as vegetable, seeds and greenery are obligated. Rebbi Eliezer said, dill is tithed seeds, vegetable, and perianths. Jerusalem Talmud Maasrot 4:23

It was stated: “Dill sown for its seeds is tithed for seeds but not vegetable. If sown as vegetable, it is tithed for seeds and vegetable but not perianths. If sown it for periants, it is tithed for seeds, vegetable, and perianths.” But we have stated: “Only cress and wild rocket are tithed for seeds and vegetable!” So is the Mishnah: The only things sown for seeds which are tithed for seeds and vegetable are cress and wild rocket.

Jerusalem Talmud Maasrot 5:3

“If somebody collected in order to send to a friend, it is free.” Rav said, he is forbidden to eat. Rebbi Shammai said before Rebbi Yose in the name of Rav Aḥa: Rav said this in case he brought it into a secure courtyard, following Rebbi Meїr. Rebbi Mana said, our Mishnah implies this: “If somebody bought standing produce, it is free.” Therefore, after it was cut it is obligated. Who is the person who holds that a sale induces ṭevel for produce not fully processed? Is this not Rebbi Meїr? Rebbi Ḥiyya in the name of Rebbi Joḥanan, it is from Rebbi Jehudah. It was stated so: “Rebbi Jehudah says in the name of Rebbi Eleazar ben Azariah, also he who sends to his friend olives from the press, young plants, and bundles of fenugreek, should not eat before he tithed since people usually send these things to their friends as ṭevel.” Rebbi Simeon ben Laqish said, even if a Fellow sent to a Fellow, he has to tithe. The colleagues asked, we can understand a vulgar who is suspect; is a Fellow suspect? Rebbi Yose said, is the vulgar not like a Fellow in matters of heave? It really is so: People usually send these things as ṭevel to their friends.

Jerusalem Talmud Maaser Sheni 5:35

It is written (Deut. 14:28): “At the end of three years you shall take out all tithe of your produce, in that year, and deposit it in your gates.” I could think that once in a Sabbatical cycle you have to distribute the tithes including the tithe of the poor. The verse says “at the end of three years,” once in three years and not once in seven; i. e., in the third and the seventh, twice in a Sabbatical cycle. Do I understand at New Year’s Day, that on New Year’s Day you have to distribute the tithes including the tithe of the poor? The verse says “at the end of three years.” “At the end” means at its conclusion you remove, you do not remove on New Year’s Day. If it is at the end of the year, I could understand that at the beginning of the fourth you have to remove the tithes including the tithe of the poor; the verse says (Deut. 26:12): “If you have finished tithing [all tithe of]78 your produce,” when you have tithed all your fruits. If it is when you have tithed all your fruits, could I understand even on Ḥanukkah? It says here, “at the end of;” it says further (Deut. 26:12): “At the end of seven years, on the fixed time of the Sabbatical year, on the festival of booths.” Since “at the end” there means at a fixed time, so here also at a fixed time. Since there “at the end” means the holiday of booths, does it here also mean the holiday of booths? The verse says “if you have finished tithing all tithe of your produce,” when you have finished tithing all of your fruits? On Passover of the fourth year.

Jerusalem Talmud Orlah 1:17

It was stated: “If a tree is partially planted in the Land and partially outside the Land, since it is partially planted in the Land it is as if completely planted in the Land, the words of Rebbi. Rabban Simeon ben Gamliel says, the part planted in the Land is obligated, the part planted outside the Land is free.” Rebbi Abbahu in the name of Rebbi Joḥanan: It is as if ṭevel and tithed are mixed together.

Jerusalem Talmud Bikkurim 2:39

Rebbi Joḥanan said, in the remaining years of the Sabbatical cycle you treat it as a vegetable but in the Sabbatical as a tree. How is that? From the fifth to the sixth, sixth. From the sixth to the Sabbatical, sixth. If it stayed from the fifth to the sixth to the Sabbatical, if he harvested it in the Sabbatical [it is tithed for the] sixth; if he harvested it in the sixth [it is tithed for the] fifth. If it stayed from the sixth to the Sabbatical to the eighth, if he harvested it in the eighth [it is tithed for the] eighth. “Our teachers took the problem up a second time and voted that for a citron the moment it is harvested determines its tithe and Sabbatical status.”

Jerusalem Talmud Shabbat 19:27

Samuel said, if he runs a fever [for one hour] one waits with him one month. May one feed him with milk-substitute from heave? May one rub him with heave oil? Let us hear from the following: “The uncircumcised and any impure persons may not eat heave; their wives and slaves may eat.” Rebbi Aḥa in the name of Rebbi Tanḥum bar Ḥiyya: The prepuce is counted only from the eighth day onward. It was stated so: For the entire thirty days it is forbidden to feed him with milk-substitute from heave and forbidden to rub him with heave oil. How do you treat the night of the eighth day? Since it was stated: In the night of the eighth day it enters the corral to be tithed, that means that the night of the eighth is treated like the eighth day. And it was stated so: All seven days long one is permitted to feed him with milk-substitute from heave and permitted to rub him with heave oil.

Jerusalem Talmud Eruvin 4:4

It only said, “if they brought him back.” Therefore, if he returned by himself, he is forbidden. Rebbi Aḥa said, this is Rebbi Neḥemiah’s. As it was stated: “Produce which came into the public domain and returned, if in error it may be eaten, if intentional it may not be eaten. Rebbi Neḥemiah says, whether in error or intentional it may not be eaten unless it was returned in error.” Rebbi Neḥemiah parallels Rebbi Meïr, as it was stated: “If somebody tithed or cooked on the Sabbath, if in error it may be eaten, if intentional it may not be eaten, the words of Rebbi Meïr.”

Jerusalem Talmud Pesachim 4:46

“They gave peah from vegetables.” “They only gave for beets and leeks since these are harvested once. Rebbi Yose said, also cabbage.” It happened that the son of Ben Meviyayin gave peah of vegetables to the poor. His father came and found them standing at the door of the garden plot. He told them, put down what is in your hands, they put down what was in their hands. He gave them double from what had been tithed. Not that he was a miser, but he was concerned about the words of the Sages. Once the rabbis needed contributions; they sent to him Rebbi Aqiba and another rabbi with him. When they came to enter at his place they heard the voice of a lad saying to him, what shall we buy for you today? He said, endives, not from today but from yesterday which are wilted and cheap. They left him and went away. After all people had (acquired merit) [contributed], they came to him. He said to them, why did you not come to me first, as you were used to? They told him, we already came but heard the voice of a lad saying to you, what shall we buy for you today? You said, endives, not from today but from yesterday which are wilted and cheap. He said, you know what was between me and the lad; do you know what is between me and my Creator? Nevertheless, go and tell her to give you a modius of denars. They went and told her. She said to them, what did he say to you, heaped or flat? They answered her, he said it vaguely. She told them, I am giving you heaped. If he said so, I filled it. If not, I shall account for the excess from my dowry. When her husband heard this, he doubled her ketubaḥ.

Jerusalem Talmud Shekalim 3:3

Rebbi Yudan said, that he should not come to do not tarry. Rebbi Yose said, anybody who is late with his ṭevel transgresses. There, we have stated: “Any born from the first of Tishre until the 29 of Elul combine; five before New Year’s day and five after New Year’s day do not combine. Five before the threshing floor and five after the threshing floor do combine.” Rebbi Yose said, this implies that the rules of animal tither are neither like those of germinating nor like those of a third. He answered, but did we not state, “Ben Azzai says, those born in Elul are to be tithed separately.” Not even if it was born up to the 29 of Elul? Could you say that Ben Azzai follows Rebbi Simeon? You have to say, he follows the rabbis. Just as you say following the rabbis, he leaves them for the next year and they will be tithed with the others of their year, so you have to say following ben Azzai, he leaves them for the next threshing floor and they will be tithed with those from Elul. Rebbi Huna said, this implies that the days of a firstling while he still is before its time are counted for its year. You count its year from the moment it is born.

If there were born in his flock five in Av, five in Elul, and five in Tishre, they do not combine. If there were born in his flock five in Av and five in Tishre, they combine. [This implies that Ben Azzai was colleague and student of Rebbi Aqiba] and Ben Azzai decides between his students. Rebbi Jeremiah, Rebbi Miasha in the name of Rebbi Samuel bar Rav Isaac: For so disagreed the fathers of the world. Who are the fathers of the world? Rebbi Abun in the name of Rebbi Samuel bar Rav Isaac understood it from the following: “Ben Azzai said to him, we are sorry about their disagreement, and you come to find us disagreement where they are concurring.” This implies that Ben Azzai was colleague and student of Rebbi Aqiba. If you are saying that he was his teacher, is there anybody who says to his teacher,] “you come to find us disagreement”, etc?

There, we have stated: “Rebbi Meïr says, on the first of Elul is the New Year for animal tithes. Ben Azzai says, those born in Elul are to be tithed separately.” Rebbi Ḥuna said, The reason of Rebbi Meïr: Up to that point they finish to give birth from the old ones; after that they start to give birth from the new ones. Jerusalem Talmud Rosh Hashanah 1:16

There, we have stated: “Any born from the first of Tishre until the 29 of Elul combine; five before New Year’s day and five after New Year’s day do not combine. Five before the threshing floor and five after the threshing floor do combine.” “Then why did they say, there are three threshing floors for animal tithe? Because up to the time of the threshing floor one is permitted to sell or slaughter. From the time of the threshing floor he may not slaughter, but if he slaughtered he is not liable.” Rebbi Yose said, this implies that the rules of animal tithe are neither like those of germinating nor like those of a third. If you would say like germinating, it should state, all whose pregnancy starts from the 29th of Elul. If you would say like a third, it should state, up to the 22nd. Rebbi Shammai in the name of Rebbi Abun bar Ḥiyya: Like the third, they made it following Rebbi Simeon, since Rebbi Simeon said, {an animal} before its time enters the corral to be tithed. Rebbi Mana met Rebbi Shammai; he asked him, did you say that? But did we not state, “Ben Azzai says, those born in Elul are to be tithed separately.” Not even if it was born up to the 29th of Elul? Could you say that Ben Azzai follows Rebbi Simeon? You have to say, he follows the rabbis. Just as you say following the rabbis, he leaves them for the next year and they will be tithed with the others of their year, so you have to say following ben Azzai, he leaves them for the next threshing floor and they will be tithed with those from Elul. Rebbi Huna said, this implies that the days of a firstling while he still is before its time are counted for its year. Rebbi Mana said, my father Rebbi Jonah understood this from the following: Any male firstling which isborn to your cattle and small cattle dedicate to the Eternal, your God.. How is this? You count its year from the moment it is born.

Jerusalem Talmud Yevamot 8:16

There, we have stated: “One does not circumcise a sick baby until he gets well.” Samuel said, even if he runs a fever for one hour one waits with him up to one month. May one feed him with milk-substitute from heave? May one rub him with heave oil? Let us hear from the following: “The uncircumcised and any impure persons may not eat heave; their wives and slaves may eat.” Rebbi Aḥa in the name of Rebbi Tanḥum: The prepuce is counted only from the eighth day onward. It was stated so: All seven days long one is permitted to feed him with milk-substitute from heave and permitted to rub him with heave oil.

Jerusalem Talmud Ketubot 7:17

MISHNAH: The following leave without ketubah: Any one violating the laws of Moses or Jews. What is the law of Moses? She feeds him what is not tithed, or makes him sleep with her when she is menstruating, or does not cut ḥallah, or makes vows which she does not keep. And what is the law of Jews: She leaves home with her hair in disorder, or spins in public, or speaks with everybody. Abba Saul says, also one who curses his parents in his presence. Rebbi Tarphon says, also the big-voiced. What is the big-voiced? Any who speaks inside her house and her neighbors hear her voice.

Jerusalem Talmud Ketubot 7:18

HALAKHAH: “The following leave without ketubah,” etc. “What is the big-voiced,” etc. And all with witnesses. “X tithed, X saw the stains, X cut her ḥallah, X permitted her vow.” They checked and found it was not so.

Jerusalem Talmud Ketubot 7:19

“She feeds him what is not tithed, or makes him sleep with her when she is menstruating, or does not cut ḥallah, or makes vows which she does not keep.” We understand all these because he is involved. “She makes vows which she does not keep,” what is his interest in this? He can say, I cannot live with a vowing wife because she buries her children. It was stated in the name of Rebbi Yudan: Children die for the sin of vows, as it is written: “For vain [vows] I smote your children.

The Babylonian Talmud

Babylonian Talmud Sukkah 3:142

1) An etrog which is stolen or withered is invalid. 2) One from an asherah or a condemned city is invalid. 3) Of orlah or of unclean terumah—it is invalid. 4) Of clean terumah, he should not take it, but if he did take it, it is valid. 5) Of demai (doubtfully-tithed): a) Bet Shammai says it invalid, b) And Bet Hillel says it valid. 6) Of second tithe, it should not be taken [even] in Jerusalem, but if he took it, it is valid.
