The following is obvious: If somebody dedicated First Fruits not from the Seven Kinds it was not sanctified. Where is there a disagreement? About mountain dates and valley fruits. Rebbi Zeïra, Rebbi Assi in the name of Rebbi Eleazar: They were not sanctified. Rebbi Hila in the name of Rebbi Immi: Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree. Rebbi Joḥanan said they were not sanctified, Rebbi Simeon ben Laqish said they were sanctified. Rebbi Jonah said, the reason of Rebbi Simeon ben Laqish is that if somebody transgressed and gave heave from bad for good produce, his heave is heave. Rebbi Yose said, we have heard that bad produce is subject to tithes; did we hear that bad produce is subject to First Fruits? A baraita supports Rebbi Yose: “One does not bring [fruits] from Sepphoris and Bet Shean, and if he brought they are not sanctified.” Rebbi Zeïra said, but there it is stated: “Figs pierced on the branch and grapes dusted and smoked one does not bring. But one brings bat šeba figs and white grapes.” The latter are highest quality. What can you say? But Rebbi Abba Mari said, one should not say that one should not bring these because they are late.
Rebbi Zeriqan said, Rebbi Zeïra asked: Do they not refer to Abraham, Isaac, and Jacob? Were Abraham, Isaac, and Jacob their forefathers? Did not the Holy One, praise to Him, swear to the males but not to the females?
Rebbi Jacob bar Idi in the name of Rebbi Joshua ben Levi: It happened that a family in the South was in bad reputation. Rebbi sent Romanus to investigate them. He investigated and found that a grandmother had been converted at less than three years and a day of age, and he declared them fit for the priesthood. Rav Hoshaia said, he declared them fit following Rebbi Simeon. Rebbi Zeïra said, here it is everybody’s opinion since Rebbi Zeïra said in the name of Rav Ada bar Ahava, Rebbi Judan brings it in the name of Rebbi Abbahu in the name of Rebbi Joḥanan: The child of an adult is fit since it is a prohibition deduced from a positive commandment. (Lev. 21:13) “But he shall take a wife in her virginity.” Any prohibition deduced from a positive commandment is a positive commandment. Analogously, (Lev. 21:14) “only a virgin from amidst his people he shall take as wife,” not a proselyte. Is any prohibition deduced from a positive commandment a positive commandment? Rebbi Hoshaia objected: But the second generation of an Egyptian is a prohibition deduced from a positive commandment! Rebbi Hoshaia turned around and said, a positive commandment for Israel cannot be compared to a positive commandment for Cohanim. A positive commandment for Israel implies a prohibition for everybody. A positive commandment for Cohanim implies a prohibition for Cohanim but a permission for Levites and Israel.

“The agent”. Rebbi Yose, Rebbi Simeon ben Laqish in the name of Rebbi Joḥanan: When he gathered in order to send by a third person; but if he gathered to bring them himself he cannot send them by a third person. He did not finish this; Rebbi Jonah finished this. Rebbi Zeïra, Rebbi Ammi, Rebbi Simeon ben Laqish in the name of Rebbi Hoshaiah: When he gathered in order to send by a third person; but if he gathered to bring them himself he cannot send them by a third person since all First Fruits which could become permitted by making the declaration become permitted only by making the declaration. Rebbi Mana said, even though Rebbi Yose did not say that, he said something similar: Rebbi Zeïra said to Rebbi Assi, do you remember that when the statement of Rebbi Hoshaiah was formulated, Rebbi Yose ben Rebbi Ḥanina said that a Mishnah disagrees: “If he designated his First Fruits and then sold his field he brings but does not make the declaration”! We upheld this if he had prior intention to sell. But did we not state: “If the tree dried up or was cut down”; that also if earlier it already was almost dry. Does making the declaration prevent? Rebbi Samuel ben Rav Isaac said, where making the declaration is possible, making the declaration does not prevent. If he gathered to deliver them through a third person, would he be forbidden to deliver them through a third person because maybe he would change his mind to deliver them himself?

The colleagues in the name of Rebbi Joshua ben Levi: If he dedicated them before Tabernacles and Tabernacles passed, he brings and does not make the declaration. If he dedicated them before Ḥanukkah and Ḥanukkah passed, they will rot. After Ḥanukkah they do not become holy. Rebbi Zeïra will not accept this of the colleagues; Rebbi Zeïra is of the opinion that all First Fruits which could become permitted by making the declaration become permitted only by making the declaration. Do the colleagues not accept this? They accept it; if he dedicated before Tabernacles intending to bring them after Tabernacles. Did we not state: One may not bring First Fruits from the new crop for the old, nor from the old for the new. Where do we hold? If about produce which was one third ripe before New Year’s Day for produce which was not one third ripe before New Year’s Day, since it was not one third ripe before New Year’s Day it is obvious that it did not form roots before the ‘omer and will be forbidden until the coming ‘omer permits it. But we must deal with fruits [from trees] which budded before the fifteenth of Šebaṭ for fruits which budded after the fifteenth of Šebaṭ; because that would be from new for old. Therefore, from new for new one may bring. We thought to say that one speaks of the time after Ḥanukkah. Rebbi Ḥinena said, in its time.

HALAKHAH: Rebbi Yose in the name of Rebbi Simeon ben Laqish; Rebbi Jonah, Rebbi Zeïra in the name of Rebbi Ḥanina: Sixteen mil in a circle around Sepphoris is the Land flowing with milk and honey. Rebbi Jonah said, if one measures as the crow flies, the outskirts of Beth Shean belong to it. If one measures as the crow flies, the valley of Genezareth belongs to it. One objected to Rebbi Jonah: (Ex. 3:17) “I said, I shall lift you from the deprivation of Egypt” (Ex. 3:8) “into a good and wide land, [to] a land flowing with milk and honey”! He said to them, which contains [stretches of] milk and honey.
Rebbi Zeïra, Rebbi Ḥiyya, in the name of Rebbi Joḥanan: The Mishnah speaks of hereditary tenant farmers. Rebbi Hila, Rebbi Assi, in the name of Rebbi Joḥanan: The Mishnah speaks of owners of sharecropping or tenant farming rights. They wanted to say, he who says the Mishnah speaks of owners of sharecropping or tenant farming rights, therefore not about simple sharecroppers or tenants. About a temporary sharecropper or tenant farmer; therefore a permanent sharecropper or tenant farmer might bring. Rebbi Abba, Rebbi Ḥiyya came in the name of Rebbi Joḥanan: Even a permanent sharecropper or tenant farmer cannot bring. Why? The Mishnah speaks of owners of sharecropping or tenant farming rights.
Cahana asked Rebbi Zeïra: A layman who ate heave? He said to him, it is a deadly sin. After he had prayed, he said to him (Lev. 22:3): “I am the Eternal” closed the statement. Rebbi Ḥiyya in the name of Rebbi Joḥanan: A layman who ate heave committed a deadly sin. A baraita supports Rebbi Joḥanan: “Those who eat heave intentionally, whether pure [person] eating pure [heave], or impure eating impure, or pure eating impure, or impure eating pure, have commited a deadly sin. Cohanim eating heave, pure [person] eating pure [heave] fulfills its commandment; pure eating impure [has violated] a positive commandment; impure eating pure or impure eating impure [has violated] a prohibition. What did you see to say that a pure [person] eating impure [heave has violated] a positive commandment? Rebbi Abba bar Mamal said, (Lev. 22:7) “Afterwards he shall eat of the hallowed [food]”, of what is pure but not of what is impure. Any prohibition which is implied by a positive commandment has the status of a positive commandment.
“They are the Cohen’s property.” Rebbi Abba, Rebbi Ḥiyya in the name of Rebbi Joḥanan (Num. 18: 8): “To you I gave it as mošḥâ.” As mošḥâ, for importance. As mošḥâ, for anointing. As mošḥâ, as fuel. I would say, both for impure and pure. Rebbi Abbahu in the name of Rebbi Joḥanan, (Deut. 26:14) “I did not burn any of it,” but one liquidates heave in impurity. Rebbi Zeïra in the name of Rebbi Eleazar: From where for Second Tithe proper which became impure that one may not use it as fuel? The verse says, “I did not burn any of it in impurity”. One may redeem it and you are saying this? One may only interpret it as referring to what was bought with Second Tithe money. Rebbi Jehudah said, but for First Fruits which became impure it is the opinion of everybody.
“This applies to heave and First Fruits but not to tithe.” There, we have stated: “One washes his hands for profane, tithe, and heave; but for sacrifices one immerses.” There, you say that tithe does not need washing and here you say, tithe needs washing! Those who say, tithe needs washing, the rabbis; he who says, tithe does not need washing, Rebbi Meїr. There, we have stated: “Anything needing immersion in water by rabbinic decree makes sacrifices impure and heave unusable but is permitted for profane food and tithe. But the Sages forbid for tithe.” Is that not explained by what Rebbi Samuel says in the name of Rebbi Zeïra, what means the Sages forbid for tithe? His body is disqualified from eating tithe. What is that? May you say tithe needs washing, if he wants to eat; may you say tithe does not need washing, if he wants to touch? No, wanting to touch is the same as wanting to eat. So it must be washing as discipline. But we have stated: “heave”! Is there washing as discipline for heave? But it is about profane food prepared by the rules of sacrifices. Is profane food prepared by the rules of sacrifices not profane? Explain it either following Rebbi Simeon ben Eleazar or following Rebbi Eleazar ben Rebbi Ẓadog. Either following Rebbi Simeon ben Eleazar as it was stated: Rebbi Simeon ben Eleazar says in the name of Rebbi Meїr: Hands are [impure] in the first degree for profane food, in the second for heave. Or following Rebbi Eleazar ben Rebbi Ẓadog as it was stated there: “Profane food prepared by the rules of sacrifices is profane. Rebbi Eleazar ben Rebbi Ẓadog says it is like heave, it may be impure in two degrees and invalidates a third.”
There, we have stated: “ ‘Also I gave it,’ includes heave and heave of the tithe.” There, you say that heave needs declaration but here you say, heave does not need declaration. Rebbi Hila said, there they stated: Heave and First Fruits, both the one who gives and the one who takes need to declare. Rebbi Zeïra said, the rabbis there think, and the rabbis here say, if a person has only tithe, he declares; if a person has only heave, he does not declare. Rebbi Yose said, a Mishnah says so: “Rebbi Yose says, they have their cities of refuge.” Where do we hold? If about heave and tithe, they are his. But it must deal with heave. Rebbi Hila said, we [did] understand that if a person has only tithe, he declares; if a person has only First Fruits, he declares. We [now] understand that if a person has only heave, he declares.
Rebbi Zeïra asked: Do First Fruits of a grafted branch permit what is budding?
Is it obvious that it will be sacrificed as a well-being offering? Rebbi Ammi said, it will be sacrificed as a well-being offering. Rav said, one uses it to occupy the altar. Rebbi Zeïra asked: Does a private person who was lazy and did not come [with the group] bring a goat with its horns covered in silver?
Rebbi Zeïra said that Rebbi Aḥa interrupted [his studies] and got up since he considered the following statement: “The writers of Torah scrolls, tefillin and mezuzot do interrupt for the reading of the Šema‘ but they do not interrupt for prayer. Rebbi Ḥanania ben Aqabia says, just as they interrupt for the reading of the Šema‘ so they do interrupt for prayer, tefillin, and all other commandments of the Torah.”
They wanted to ordain Rebbi Zeïra but he did not want to take it upon himself. When he heard a Tanna stating: “For an ordained person, a bridegroom, a patriarch, the dignity deletes [his sins],” he accepted being ordained. An ordained person: (Lev. 19:32): “Before a white head you shall rise, give respect to an Elder, and fear your God, I am the Eternal.” What is written after that (v. 33): “If a proselyte lives in your land, you shall not trick him.” Just as all his sins are forgiven to the proselyte, so all sins are forgiven to one being ordained. The bridegroom: (Gen. 28:9) “Esaw went to Ismael and married Maḥalat bat Ismael.” But was her name Maḥalat, was it not Basemat? But all his sins were forgiven him. The president: (1S. 13:1) “Saul was one year old when he became king.” Was he one year old when he became king? But all his sins were forgiven him as to a baby of one year.
Rebbi Mana made light of those ordained for money. Rebbi Ammi read for them (Ex. 20:19): “Do not make for yourselves gods of silver or gods of gold.” Rebbi Yoshia said, their prayer shawl is like a donkey’s saddle cover. Rebbi Ashian said, if somebody is ordained for money, one does not get up before him and one does not address him as Rebbi; his prayer shawl is like a donkey’s saddle cover. Rebbi Zeïra and one of the rabbis were sitting together when a person ordained for money was passing by. One of the rabbis said to Rebbi Zeïra, let us behave like Tannaïm and not get up before him.

An old man stated before Rebbi Zeïra: He returns to “I am declaring today.” But can a person declare and repeat it? We support it: I already declared.
HALAKHAH: Mishnah: “They House of Shammai say, one sells to a Non-Jew,” etc. What means “a nearby destination”? It should be as Samuel said, for example as from Ḥuṭra to Nahardea; here it is the same. Some want to say, until he reaches his home. But some want to say, until he reaches his town. Rebbi Aqiba says, that he leaves the place of the door when the day becomes holy around him. Rebbi Joḥanan said, these are the words of Rebbi Yose: But Rebbi Aqiba comes to determine following the words of the House of Hillel. One does not give to a Gentile on condition that he leave. If he left, you do not have to interfere. One does not give to a dog on condition that he leave. If he left, you do not have to interfere.
The colleagues in the name of Rebbi Abba bar Zavda: Anything inside of the lips one heals on the Sabbath. Rebbi Ze‘ira objected, did we not state: “One whose teeth are aching may not sip vinegar,”? Is this not inside from the lips? [Rebbi Ze‘ira] did not say so, but Rebbi Ze‘ira in the name of Rebbi Abba bar Zavda: Anything inside a body cavity one heals on the Sabbath. Rebbi Ze‘ira, Rebbi Abba bar Zuṭra, Rebbi Ḥanina in the name of Rebbi: One treats the bone of the skull on the Sabbath. Rebbi Ḥiyya the Mede, Rebbi Jona, Rebbi Ze‘ira, Rebbi Abba bar Zuṭra, Rebbi Ḥanina in the name of Rebbi: One treats glands of the throat on the Sabbath. Rebbi Abbahu in the name of Rebbi Joḥanan: One treats an infected eye on the Sabbath. There, they say in the name of Rebbi Joḥanan: Tops of hands and feet are a danger. Rebbi Abbahu in the name of Rebbi Joḥanan: Red color is dangerous. Rebbi Abin said, one removes the sting of a scorpion on the Sabbath. Rav said, wine for exterior treatment of the eye is permitted, inside the eye it is forbidden. Samuel said, tasteless spittle is forbidden for the eye on the Sabbath From this you infer for lichen. The rabbis of Caesarea said, ranula is dangerous. Rebbi Ḥizqiah from Acco in the name of the rabbis of Caesarea: spider sickness is dangerous. Rebbi Samuel bar Rav Isaac: gangrene is dangerous. Rebbi Jeremiah said, one can put sour dough on it on Passover. A boil is permitted. Rebbi Yose said, the Mishnah says this: “A small needle to remove a thorn.” Otherwise, what is the difference between a thorn and a boil? Darkening of the eye, they asked Rebbi Jeremiah. He told them, is not Rebbi Abba available for you? They asked Rebbi Abba who permitted. He told them, also I am permitting it.

HALAKHAH: There are Tannaim who state, all is judged on New Year’s Day and judgment is passed for every item on New Year’s Day. There are Tannaim who state, all is judged on New Year’s Day and judgment is passed for every item on the Day of Atonement. There are Tannaim who state, all is judged on New Year’s Day and judgment is passed for every item on its proper time. There are Tannaim who state, every item is judged on its proper time and judgment is passed for every item on its proper time. Our Mishnah follows him who said, all is judged on New Year’s Day and judgment is passed for every item on its proper time, as we have stated: “and on Tabernacles they are judged about water.” The words of Rav imply that all is judged on New Year’s Day and judgment is passed for every item on New Year’s Day, since it is stated in the blowing prayer of Rav: “This is the day, the beginning of Your works, remembrance of the First Day, for it is a decree for Israel, a law for the God of Jacob. On it will be proclaimed for countries which one will be for war, and which one for peace, which one for famine, and which one for plenty. And creatures will be counted on it, to remember them for life or for death.” This does not follow Rebbi Yose, since Rebbi Yose said, an individual is judged every moment. What is the reason? You are counting him in the mornings; in moments You are examining him. You are counting him in the mornings, this refers to his provisions; in moments You are examining him, this refers to his food. The Elder Rebbi Isaac in the name of Rebbi: King and public are judged every day. What is the reason? To look after the right of His servant and of His people Israel; each day’s affairs on each day. Rebbi Levi said, He will judge the dry land in equity, will pass judgment over peoples in straightness. The Holy One, praise to Him, judges Israel during daytime when they are occupied earning merit, and the nations during the night, when they are resting from evil deeds. Samuel said, as He judges Israel so he judges the nations. How does Samuel confirm that He will pass judgment over peoples in straightness? He judges them according to the qualified among them; He remembers for them the deeds of Jethro, he remembers for them the deeds of Raḥab the prostitute.
HALAKHAH: “No sister-in-law should be a party to ḥalîṣah,” etc. How long is it until a pregnancy is recognized? Symmachos said in the name of Rebbi Meїr: After three months. Even though it is no proof, there is a hint: “It was after about three months.” Rebbi Yudan said, even for a phantom pregnancy, “we were pregnant, we were sick, as if we gave birth to wind,” “get pregnant with dry grass, give birth to straw.” Rebbi Ze‘ira, Rebbi Abba bar Zuṭra said, Rebbi Ḥanina in the name of the Great Rebbi Ḥiyya: Even most of the first, most of the last, and the middle one complete. Rav Assi said, a full 90 days. Samuel said, they in their fulness. A case came before the rabbis there; we do not know if thirteen of the first and seventeen of the last or seventeen of the first and thirteen of the last, and five complete ones in the middle; they wanted to touch the child because of a doubt of bastardy. Rav Naḥman bar Jacob told them, such a case came before Abba bar Abba and he declared it acceptable. Does Abba bar Abba disagree with his son Samuel? Rebbi Abba said, there is a difference between recognizing a pregnancy and giving birth. A pregnancy is recognized after full months, a birth can happen after fractional months. There, we have stated: “How long can labor be? Rebbi Meїr said, even 40 to 50 days. Rebbi Jehudah said, her month is sufficient. Rebbi Yose and Rebbi Simeon say, no labor is longer than two weeks”. “Rebbi Yose in the name of Rebbi Abba: This implies that a woman gives birth after fractional months. Since otherwise one should have stated “thirty days”. Rebbi Yose ben Rebbi Abun in the name of Rebbi Abba: This implies that a woman gives birth after full months. Since we have stated: “Her month is sufficient.”
Rebbi Mana said, I heard in the name of Samuel that there is no difference between recognizing a pregnancy and giving birth, but I do not remember from whom I heard this. Rebbi Abba bar Cohen said before Rebbi Yose, Rebbi Jeremiah said this. Rebbi Ḥizqyah said to him, Rebbi Jeremiah did not say this; Rebbi Yose was offended by him. He said to him: Even Joshua who was bound to Moses would not have said so, but you said so! He checked himself and said, it is true that he said that but as a person who quotes something and questions it; does Abba bar Abba disagree with his son Samuel? Rebbi Berekhiah in the name of Samuel: A woman gives birth only either after 271, 272, 273, or 274, days. Rebbi Mana said to him, from whom did the rabbi hear this? He said to him, from Rebbi Abba. The position of Rebbi Abba seems inverted. There, he says, there is a difference between recognizing a pregnancy and giving birth, and here, he says so? Rebbi Abba bar Zuṭra in the name of Samuel: {If with ה Rabba, with א Rava.} Everything which is “many” is 208.
Rebbi Jacob bar Idi in the name of Rebbi Joshua ben Levi: It happened that a family in Rhodes was in bad reputation. Rebbi sent Rebbi Romanus to investigate them. He investigated and found that a grandmother had been converted at less than three years and a day of age, and he declared them fit for the priesthood. Rav Hoshaia said, he declared them fit following Rebbi Simeon. Rebbi Zeїra said, here it is everybody’s opinion since Rebbi Zeїra said in the name of Rav Ada bar Ahava, Rebbi Judan brings it in the name of Rebbi Abbahu in the name of Rebbi Joḥanan: The child of an adult is fit since it is a prohibition deduced from a positive commandment. (Lev. 21:13) “But he shall take a wife in her virginity,” which is a prohibition deduced from a positive commandment. Similarly, (Lev. 21:14) “only a virgin from among his people he shall take as wife,” not a proselyte. Any prohibition deduced from a positive commandment is a positive commandment. Rebbi Hoshaia objected: But the second generation of an Egyptian is under a prohibition deduced from a positive commandment! Rebbi Hoshaia turned around and said, a positive commandment for an Israel cannot be compared to a positive commandment for Cohanim. A positive commandment for an Israel implies a prohibition for everybody. A positive commandment for Cohanim implies a prohibition for Cohanim but a permission for Levites and Israel.

HALAKHAH: “On the same day, Rebbi Aqiba explained,” etc. Rebbi Yose ben Rebbi Abun said, Rav and Samuel. One said, Rebbi Aqiba referred to both heave and profane food, but the other referred to heave but not to profane food. But one does not know who said what. Since Rebbi Yose said in the name of Rebbi Jonah, they said, Rav in the name of the elder Rebbi Ḥiyya: The tertiary comes because of the reptile. This implies that he said that Rebbi Aqiba referred to both heave and profane food. A Mishnah disagrees with Rav: “If tithe food was prepared [for impurity] by a fluid and a ṭevul yom or unclean hands touched it, one may take from it the heave of the tithe in purity because it is tertiary, and the tertiary is pure for profane food.” He explains that it is a leniency about hands [whose impurity] is rabbinical. But did we not state: “A ṭevul yom”? Explain it by a ṭevul yom from [the impurity] of a broken field. Rebbi Zeïra said, you may even say a biblical tevul yom. There is a difference since it is written “pure, impure”. Pure for profane food during daytime and for heave when it gets dark. Rebbi Ḥaggai objected before Rebbi Yose: May we not say: Pure for touch and impure for eating? He answered him, vessels are mentioned in the paragraph! Can you say about vessels that they are pure for touch and impure for eating?
So far, if he abandoned it for a longer period of time. But if he abandoned only for a short time? Let us hear from the following: “If he abandoned his field, he may cancel his action during three days.” Rebbi Ze‘ira said, it says only “three days”. Therefore, after three days he may not cancel his action. Rebbi Simeon Dayana stated before Rebbi Ze‘ira: Even after three he may cancel his action. He said to him, since you say after three days, is it the same after three or after many? A baraita supports Rebbi Ze‘ira: “About when is this said? If he abandoned in an unspecified way. But if he said: My field shall be abandoned one day, one week, one month, one year, a sabbatical period, as long as nobody took it over, either he or another person, he may cancel. But after somebody acquired it, either he or somebody else, he cannot cancel.” This means that short or long periods are the same. It also means that they were not worried about dishonesty. This means that a person may abandon and reacquire. That obviously answers Rebbi Zeïra’s question, since Rebbi Zeira had said, are short and long times the same?
“This is the rule Rebbi Simeon declared in the name of Rebbi Joshua: For everything that may become permitted through some action, such as ṭevel, Second Tithe, donations to the Temple, and “new grain”, the Sages did not fix any limits, but a kind with its own is forbidden in the minutest amount, a kind with a different kind if it can be tasted. But for everything that cannot become permitted through any action, such as heave, ḥallah, orlah, and kilaim in a vineyard, the Sages did fix as limit both a kind with itself or with a different kind if it can be tasted.” How do you treat vows? As referring to something that can become permitted or to something that cannot become permitted? It seems reasonable that we treat them as referring to things that can become permitted, as we have stated there “for the Elder uproots the vow from the start.” They said, he only uproots for the future. Certainly a Mishnah treats it as referring to something that cannot become permitted, as we have stated there: “The growth from heave is heave; the growth from their growth is profane. But the growths from ṭevel, First Tithe, aftergrowth of the Sabbatical, heaves from outside the Land, dema‘, and First Fruits are profane as are growths from their growths. Growths from dedicated [seeds] and Second Tithe become profane; one redeems them corresponding to the time of sowing.” We have stated on this: When has this been said? Anything whose seeds disappear. But in produce whose seeds do not disappear, the growth from their growth is forbidden. There is a restriction on growth, as Rebbi Zeïra said in the name of Rebbi Jonathan: An onion of kilaim in a vineyard, taken out of the ground and replanted, stays forbidden even if it grows enormously because growth of something forbidden cannot neutralize the prohibition. But another Mishnah treats it as something that can become permitted, as we have stated there: “For if somebody vowed not to have a certain thing and it became mixed with something else, if it can be tasted it is forbidden.” This explains that it was mixed with another kind, following the rules of something that can become permitted.
“When they sanctified the year at Usha, on the first day Rebbi Ismael, the son of Rebbi Joḥanan ben Baroqa, led and recited following the opinion of Rebbi Joḥanan ben Nuri. Rabban Simeon ben Gamliel said, we did not follow this at Jabneh. On the second day, Rebbi Ḥananiah, the son of Rebbi Yose the Galilean led and recited following the opinion of Rebbi Aqiba. Rabban Simeon ben Gamliel said, this we did follow at Jabneh.” But does this not mean that they sanctified it on the first and the second day? Rebbi Zeїra in the name of Rav Ḥisda: That year was disorganized. What is “the first, the second”? Rebbi Abun in the name of Rav: The first year, the second year! But was it not stated: the first day, the second day?
They asked before Rebbi Zeїra: a Cohen to an Israel, Rebbi forbids. What does Rebbi Yose say? Rebbi Ḥizqiah in the name of Rebbi Aḥa said, so he responded to them: In the opinion of Rebbi Yose ben Rebbi Ḥanina, why is a Cohen to an Israel forbidden, not because it looks badly? Also Rebbi Joḥanan holds that from an Israel to an Israel it is forbidden because it looks badly. In addition, because of the following, as it was stated: “Cohanim and Levites who help at the threshing floor have no right either to heave or to tithe, and if the farmer gave, it is desecrated, as it is said (Lev. 22:15): ‘They should not desecrate the sanctified things of the Children of Israel,’ but they desecrate them! In addition, they said that their heave is no heave, their tithes are no tithes, their dedications are no dedications, and about them the verse says (Micha 3:11): ‘Their heads judge for bribes, [their priests are for hire].’ The Omnipresent brings over them three catastrophies; that is what is written (Micha 3:12): ‘Therefore, because of you Zion will be ploughed over as a field, Jerusalem will be desolate, and the Temple Mount a wooded hill.’
May a Cohen defile himself for the Patriarch? When Rebbi Judah the Prince died, Rebbi Yannai proclaimed and said: “There is no priesthood today.” When Rebbi Judah the Prince, grandson of Rebbi Judah the Prince, died, Rebbi Ḥiyya bar Abba did push Rebbi Zeïra in the Gufna synagogue of Sepphoris and defiled him. When Yehudinai, the sister of Rebbi Judah the Prince, died, Rebbi Ḥanina sent for Rebbi Mana but the latter did not come. He said to him, if one does not defile himself for them during their lifetime, so much less in their death. Rebbi Nassa said, in their death they treated them like a corpse of obligation.
May a (person) [Cohen] defile himself in honor of the public? It is stated: When there are two acceptable roads, one long and pure, the other one short and impure: If the public was walking on the long one, he goes on the long one; otherwise, he goes on the short one in honor of the public. That refers to impurity by their words; also for impurity that is from the words of the Torah? From what Rebbi Zeïra said, so great is the honor of the public that it temporarily pushes aside a prohibition, that means even impurity that is from the words of the Torah.
Rebbi Jonah, Rebbi Yose the Galilean, in the name of Rebbi Yose ben Ḥanina: One does not ask rulings on practice before the bier of a deceased. But Rebbi Yoḥanan asked Rebbi Yannai before the bier of Rebbi Simeon ben Yoẓadaq about him who dedicated his elevation sacrifice for the upkeep of the Sanctuary, and he answered him! Let us say when they were bringing him to the study hall. But Rebbi Jeremiah asked Rebbi Zeïra before the bier of (Rebbi Simeon and) Rebbi Samuel bar Rav Isaac! Let us say that he answered him when he was far away; when he was close he did not answer him.
Rebbi Zeïra bent down during a eulogy. They wanted to straighten him up and found that he tarried. They said to him, what is this? He said to them, because we will go there, following (Eccl. 7:2): “Let the one who is alive take it to heart.”
If a convert died and Jews plundered his property, if there were slaves, either adult or underage, they gain their freedom. Abba Shaul said, the adults gain their freedom, the minors do not become free. Why? They are no longer property after their owner’s death. Then even adults? Rebbi Abba said, since adults are competent to acquire themselves, they gain their freedom. Minors, who are not competent to acquire for themselves, do not gain their freedom. Rebbi Joshua ben Levi said, practice follows Abba Shaul. The opinions of Rebbi Joshua ben Levi are contradictory. There, Rebbi Simon in the name of Rebbi Joshua ben Levi and Rebbi Yossi ben Shaul in the name of Rebbi said: A person who has given up hope to recover his slave is not entitled to enslave him. They said, what Rebbi Joshua said about enslaving, if he did not give, he did not give; perhaps practice would be to enslave him, therefore he has to write him a bill of manumission. And here, he says so! We heard that Rebbi Joḥanan said, Rebbi Joshua ben Levi taught us that correctly, perhaps practice follows Abba Shaul. The slave girl of Rabba bar Zuṭra ran away and he gave up hope to recover her. He went to ask Rebbi Ḥanina and Rebbi Joshua ben Levi. They said, he is not entitled to enslave her. How is it to write her a bill of manumission? They said to him, if you wrote, you did the right thing. Rebbi Ḥanina in the name of Rebbi Ismael ben Rebbi Yose: A slave who married as a free person in the presence of his master gained his freedom. Rebbi Joḥanan said, yesterday I was sitting and formulating: If somebody writes a document of preliminary marriage for his slave or a document of definitive marriage for his girl slave, Rebbi says, they acquired, but the Sages say, they did not acquire. The first Tanna follows Rebbi: he acquired.
HALAKHAH: “A woman may lend to her neighbor,” etc. Rebbi Zeïra asked before Rebbi Mana: Does our Mishnah deal with the implicit case, rather than the explicit? He said to him, is the implicit case not explicit? He said to him, I can say a coarse sieve to count coins, a sieve to sift sand, grindstones to grind spices, a stove to put in flax bundles.
Rebbi Ḥaggai said before Rebbi Yose: Is not this disagreement the same as that disagreement, as we have stated there: “If a man was talking with a woman about her bill of divorce or her preliminary marriage and gave her the bill of divorce or [some valuable for] preliminary marriage and did not spell it out, Rebbi Yose says it is sufficient; Rebbi Jehudah says he has to be explicit.” Then Rebbi follows Rebbi Yose and Rebbi Nathan Rebbi Jehudah. He said to him, what do you have in your hand, did not Rebbi Zeïra, Ḥiyya bar Abin, Abba bar Taḥlifa, say in the name of Rebbi Hoshaia, when do they differ? [If they thought about] other things but if he still was on the same subject, it is a bill of divorce. But here, even if they are still on the same subject there is disagreement.
Rebbi Zeïra objected before Rebbi Yasa: But did we not state: The same applies to marriage? He answered him, divorce documents and marriage contracts have the same rules. But did we not state: The same applies to debt? He said to him, because if he said to him: Throw it into the sea and your debt will be forgiven, it would be forgiven. But if that is true, even if it fell down close to the debtor, the debtor should have the benefit! But we have stated, if it falls down close to the debtor, the debtor is still obligated. For he said to him, throw it so that it will enter my domain, but it did not yet enter his domain. Rebbi Abbahu said, all those objections that Rebbi Zeïra raised before Rebbi Yasa, Rebbi Simeon ben Laqish raised before Rebbi Joḥanan. Did he accept them from him? He solved them with those same solutions.

It is obvious that a slave may accept a gift by one third party to another, by a third party to his master, [but] not from his master to himself. From a third party to himself is in dispute between Rebbi Meïr and the Sages. If one said: Here [I am giving] you this money on condition that your master have no power over it, the slave acquired it and with him his master, the words of Rebbi Meïr. But the Sages say, the slave acquired it [but not] his master. What is the problem? From his master to a third party. Since the slave may receive from a third party for his master, may he receive from his master for a third party? Let us hear from the following: “If somebody borrowed a cow and [the lender] sent her to him through his slave, his son, or his agent.” Does this not mean that the slave is able to transfer rights from his master to a third party? Rebbi Eleazar said, explain it for a Hebrew slave. Rebbi Joḥanan said, you have to explain if for a Canaanite slave; explain it that he said, open [the gate] for her and she will come by herself, as we have stated: “If he led her, drew her to himself, called her and she followed him, he is responsible as a borrower.” Rebbi Zeïra understood it from here: “But he cannot make them acquire through his underage son or daughter or his Canaanite male or female slave, because their hand is not like his hand.” Does this not imply that a slave is not able to transfer rights from his master to another person? Explain it following Rebbi Meïr since Rebbi Meïr makes the hand of the slave the hand of his master. But did we not state “his wife”? Rebbi Meïr holds that the hand of the wife is the hand of her husband! Rebbi Ḥananiah said in the name of Rebbi Phineas, explain it following the Tanna who stated: “His wife cannot redeem Second Tithe for him. Rebbi Simeon ben Eleazar says in the name of Rebbi Meïr, his wife can redeem Second Tithe for him.” For that Tanna, Rebbi Meïr makes the hand of the slave the hand of his master but not the hand of the wife the hand of her husband!
Rebbi Mana said: The millers are correct when they say that each and every person has in his chest that which is appropriate for him. Rebbi Tarphon’s mother said so and they answered her appropriately, Rebbi Ismael’s mother said so and they answered her appropriately. Rebbi Zeïra was sorry and said, if only I had father or mother that I could honor them and inherit paradise. When he heard these two instructions, he said: Praise to the All-Merciful that I have neither father nor mother. I could not have done as Rebbi Tarphon did and I could not accept what Rebbi Ismael accepted. Rebbi Abun said, I am free from honoring father and mother. They said, his father died when his mother was pregnant and she died in giving birth.
Rebbi Zeïra said, but only if the person does not revert. What is the reason? It does not say “The triple thread will never snap” but rather “The triple thread will not quickly snap.” If you work on it, it will split. Rebbi Ḥuna said in the name of Rebbi Abbahu: There is no forgetting before the Holy One, praise to Him, but for Israel He becomes forgetful. What is the reason? It is written “He forgets sin.” And so David says: “You forgot Your people’s sin, You covered up all their misdeeds, Selah.”
They asked before Rebbi Zeïra: a Cohen to an Israel, Rebbi forbids. What does Rebbi Yose say? He did not respond. The colleagues in the name of Rebbi Abba bar Zavda: Anything inside of the lips one heals on the Sabbath. Rebbi Ze‘ira objected, did we not state: “A person having a tooth ache should not suck vinegar with them”? Is this not inside from the lips? Rebbi Ze‘ira did not say so, but Rebbi Ze‘ira in the name of Rebbi Abba bar Zavda: Anything inside a body cavity one heals on the Sabbath. Samuel said, tasteless spit is forbidden for the eye on the Sabbath From this you infer for lichen. The rabbis of Caesarea said, ranula is dangerous. Rebbi Ḥizqiah (said) [from Acco] in the name of the rabbis of Caesarea: spider sickness is dangerous. They asked Rebbi Abba who permitted it to them. He told them, also I am permitting it.

How long is it until a pregnancy is recognized? Symmachos said in the name of Rebbi Meïr: After three months. Even though it is no proof, there is a hint: “It was after about three months, etc.” Rebbi Yudan said, even for a phantom pregnancy, “we were pregnant, we were sick, as if we gave birth to wind,” “get pregnant with dry grass, give birth to straw”, etc. Rebbi Ze‘ira, Rebbi Abba bar Zuṭra said, Rebbi Ḥanina in the name of the Great Rebbi Ḥiyya: Even most of the first, most of the last, and the middle one complete. Assi said, a full 90 days. Rebbi Meïr said, even 40 to 50 days. Rebbi Jehudah said, her month is sufficient. Rebbi Yose and Rebbi Simeon say, no labor lasts longer than two weeks.” Rebbi Yose in the name of Rebbi Abba: This implies that a woman gives birth after fractional months. Since otherwise one should have stated “thirty days”. Rebbi Yose ben Rebbi Abun in the name of Samuel: This implies that a woman gives birth after full months.
Rebbi Berekhiah in the name of Samuel: A woman gives birth only either after 271, 272, 273, or 274 days. Rebbi Mana said to him, from whom did the rabbi hear this? He said to him, from Rebbi Abba. The position of Rebbi Abba seems inverted. There, he says, there is a difference between recognizing a pregnancy and giving birth, and here, he says so? Rebbi Abba bar Zuṭra in the name of Samuel: Everything which is “many” is 273.
The Babylonian Talmud
Who dreams of an ass may hope for salvation ; as it is said, "Behold thy king cometh unto thee: he is triumphant and victorious, lowly, and riding upon an ass" (Zech. ix. 9). Who dreams of a cat in a place where the word for it is Shunnara, a beautiful song [shirah naah] will be composed in his honour ; [but where the word for it is] Shinnara, a change for the worse [shinnui ra'] is in store for him. Who dreams of grapes, if they are white, both in their season and out of season, they are a good omen ; if they are black, in their season they are a good omen, but out of season a bad omen. Who dreams of a white horse, whether standing still or galloping, it is a good omen for him ; if it is roan, should it be standing still, it is a good omen; should it be galloping, it is a bad omen.
'Abbayi and Raba used to wear shoes without soles. Maremar and Mar Zuṭra used to transfer the right shoe to the left foot and the left shoe to the right foot. The scholars of the school of R. 'Ashi, however, wore their shoes in the usual way, agreeing with Samuel, who said, there are no public fasts in Babylonia except the Ninth of Ab.
"My heritage is become unto Me as a lion in the forest; she has uttered her voice against Me; therefore have I hated her" (Jerem., 12. 8). Said R. Zuṭra b. Tobiah in the name of Rab or, as some report, said R. 'Aḥa in the name of R. Eleazar: This verse applies to an unworthy person, who goes before the ark as a messenger of the congregation.
Fasts should not be decreed so as to begin on a Thursday, etc. No fasts should be enjoined upon the community on the days of New Moon, Hanukkah and Purim, but if the fasts began, etc. What constitutes a beginning? R. Aḥa said, three fasts, R. Jose said, even one fast. R. Judah said in the name of Rab, this view (that one should not fast to the end of the day) is the view of R. Meir, who offered it in the name of Rabban Gamaliel, but the other Sages say, one must fast to the end of the day. Mar Zuṭra lectured in the name of R. Huna that the law is, one must fast to the end of the day.
