HALAKHAH: Rav said: practice follows both of them for leniency. If it were not so, what could one say? An anonymous statement and Rebbi Yose, practice follows the anonymous. Rebbi Yose and Rebbi Yehudah, practice follows Rebbi Yose. So why does Rav have to say, practice follows both of them for leniency? Because he had heard Rebbi Ḥiyya formulating it in the name of Rebbi Meïr, he has to say that practice follows both of them for leniency.

HALAKHAH: It was stated: “The only difference between a flower pot without a hole and one with a hole regards preparation for impurity.” That is for Rebbi Simeon, but for the rabbis there are others: A flower pot with a hole sanctifies in a vineyard, one without a hole does not. He who plucks from a flower pot with a hole is guilty, from one without a hole he is free from punishment. A flower pot with a hole cannot prepare plants, one without a hole prepares. Rebbi Yose referred to it as anonymous statement, Rebbi Ḥanina quoted it in the name of Rebbi Samuel bar Rav Isaac: The Torah extended the purity of growing plants (Lev. 11:37): “If any of their cadavers falls on any sown seed apt to be sown, it is pure.”
HALAKHAH: There, we have stated: “The Cohanim are permitted in all cases to change the preparation of the food, to eat it broiled, cooked a long time, or plain; to add profane and heave spices, the words of Rebbi Simeon. Rebbi Meïr says, he should not add [heave spices], to cause heave to become unusable.” It turns out that the anonymous statement here becomes the minority opinion there. Is the anonymous statement here the minority opinion there? But the anonymous statement here is the opinion of Rebbi Meïr there and between Rebbi Meïr and Rebbi Simeon, practice follows Rebbi Simeon. Rebbi Assi said, I asked those of the House of Rebbi Yannai and they said, we used to cook small portions and eat. How is that? Practice follows Rebbi Meïr there for his is the anonymous opinion here.

It was stated: If someone ate impure heave, he has to pay in pure profane food, but if he paid in impure profane, he discharged his obligation. Rebbi Nathan says, Symmachos says, if inadvertently, what he did is done, intentionally, he did not do anything. There, we have stated: “One does not give heave from impure produce for pure.” It was stated in the name of Rebbi Yose, “if he gave heave from impure produce for pure, whether inadvertently or intentionally, what he did is done.” It turns out that the single opinion here is like the anonymous one there, and the single there like the anonymous here.

Rebbi Joḥanan said: The words of the first teacher imply that neither does the bottom need the top nor the top the bottom. The words of the last teacher, [the bottom] needs the top but not the top the bottom. Rebbi Eleazar said, that is Rebbi Meїr’s. He said to him, that you should not think to say it is an anonymous opinion and, against Rebbi Yose, practice follows the anonymous opinion. Therefore, one needs to say that this is Rebbi Meїr’s and between Rebbi Meїr and Rebbi Yose practice follows Rebbi Yose.

There, we have stated: “Rebbi Eliezer says, heave is lifted at the rate of one in 100. Rebbi Joshua says by 100 and more.” There, [Rebbi] Ḥizqiah, Rebbi Abbahu said in the name of Rebbi Eleazar, everywhere where Rebbi taught a disagreement and returned to the problem later and taught it anonymously, practice follows the anonymous opinion. Since we have stated: “A seah of heave which fell into 100” and Rebbi Eleazar said, one cannot say “into 100” but “into 99.” As we have stated, Rebbi Eliezer and Rebbi Joshua.
Isaac bar Orion said, where do they disagree? If he did not pluck it off over the hole. But if he plucked it off over the hole also Rebbi Simeon will agree. Rebbi Jeremiah asked: If everything was in the Land but the hole outside the Land? It turns out that you may say what was questionable for Rebbi Jeremiah was obvious for Isaac bar Orion. These are it. But there are others! “A flower pot with a hole sanctifies in a vineyard, one without a hole does not sanctify.” “A flower pot with a hole cannot prepare plants, one without a hole prepares.” “He who plucks from a flower pot with a hole is liable, from one without a hole he is not liable.” Rebbi Yose referred to it as anonymous statement, Rebbi Ḥanania quoted it in the name of Rebbi Samuel bar Rav Isaac: The Torah extended the purity of growing plants: If any of their cadavers falls on any sown seed apt to be sown, etc.
HALAKHAH: What is a dragged bolt? Rebbi Joḥanan said, tied but not hanging. Rebbi Joḥanan said, Ḥilfai pulled me and showed me a bolt of the House of Rebbi tied but not hanging. Rebbi Joḥanan said, the single opinion here is parallel to the anonymous one there, and the anonymous there to the individual here. Rebbi Yose asked before Rebbi Jeremiah: how does one act in actuality? He said to him, since Rebbi Joḥanan said, Ḥilfai pulled me and showed me a bolt of the House of Rebbi tied but not hanging, this implies that one acts following Rebbi Jehudah . There came Rebbi Huna in the name of Rebbi Samuel, practice follows Rebbi Jehudah, except that it be tied to the door. Rebbi Yannai [the father-in-law of] Rebbi Immi said, only if it is tied to the door by something which can fasten it. Rebbi Eleazar’s bolt was tied with bast. If it was detached it is forbidden; loose? Rebbi Jacob bar Aḥa in the name of the rabbis, he supports it with his finger tips.

Rebbi Isaac and Rebbi Joshia, one like one of them, the other like the other. Rebbi Berekhiah preached following Ben Bathyra, the Mishnah says so: “she shall beat it and wet it with cold water.” The words of the rabbis disagree, but Rebbi Ḥizqiah, Rebbi Abbahu said in the name of Rebbi Eleazar: In every instance where Rebbi formulated a disagreement and later formulated it anonymously, practice follows the anonymous statement.
HALAKHAH: Simeon bar Abba said, there came a case before Rebbi Joḥanan and he instructed following Rebbi Yose. Rebbi Eleazar was sorry about this; he said, does one disregard the anonymous {Mishnah} and follow an isolated opinion? He found that Rebbi Ḥiyya stated this in the name of Rebbi Meïr. When he understood that Rebbi Ḥiyya stated this in the name of Rebbi Meïr., he said, the old man understands his chapters well. Rebbi Mana asked before Rebbi Yudan: Did not Rebbi Ḥizqiah, Rebbi Abbahu say in the name of Rebbi Eleazar, every place where Rebbi taught a disagreement and afterwards taught it anonymously, practice follows the anonymous statement. He said to him, and if not Rebbi, maybe somebody else. How is this? If it is found that Rebbi taught a disagreement and afterwards taught it anonymously, then practice follows the anonymous statement. In a case where Rebbi did not teach a disagreement but others taught it in disagreement and Rebbi taught it anonymously, certainly practice has to follow the anonymous text. There come Rebbi Ḥizqiah, Rebbi Jacob bar Aḥa, Rebbi Simeon bar Abba, in the name of Rebbi Eleazar, every place where Rebbi taught a disagreement and afterwards taught it anonymously, practice follows the anonymous statement. But if a disagreement is stated together with the anonymous opinion, practice does not follow the anonymous opinion. Rebbi Yose ben Rebbi Abun in the name of Rebbi Aḥa: that is if an individual disagrees with an individual. But in the case of an individual following the {anonymous} Sages, practice does not follow the anonymous text.

Why does he instruct here following the isolated opinion? Rebbi Samuel bar Ina in the name of Rebbi Aḥa: That is, if no disagreement is stated together with the anonymous opinion. But if a disagreement is stated together with the anonymous opinion, practice does not follow the anonymous opinion.
Simeon bar Abba said, there came a case before Rebbi Joḥanan and he instructed following Rebbi Yose. Rebbi Eleazar was sorry about this; he said, does one disregard the anonymous {Mishnah} and follow an isolated opinion? He found that Rebbi Ḥiyya stated this in the name of Rebbi Meïr. When he understood that Rebbi Ḥiyya stated this in the name of Rebbi Meïr, he said, the old man understands his chapters well. HALAKHAH: There, we have stated: “A white spot in the size of a grit and it spread in the size of a grit [and in the spread appeared a healthy spot or a white hair] but the original disappeared. Rebbi Aqiba declares him impure, but the Sages are saying, it should be seen as a new case.” Therefore, Rebbi Aqiba declares him impure absolutely. But the rabbis are saying, it should be seen as a new case as absolutely {impure}. What is the difference between them? Rebbi Joḥanan said, holiday eve is between them. Rebbi Aqiba says that this is the former case and you do not deal with him neither to alleviate nor to restrict. But the rabbis are saying that this is a new case and you free him from the first one. And this is “not to restrict” that you should not deal with the second case neither to alleviate nor to restrict. Rebbi Yose in the name of Rebbi Aḥa, it turns out that the single opinion here parallels the anonymous opinion there and the single opinion there parallels the anonymous opinion here. The single opinion here parallels the anonymous opinion there: Rebbi Aqiba says that this is the former case and you do not deal with him neither to alleviate nor to restrict. And the single opinion there parallels the anonymous opinion here: The rabbis are saying that this is a new case and you free him from the first one. And we have stated here, “Rebbi Meïr says, one inspects skin-disease to alleviate but not to restrict” Rebbi Yose ben Rebbi Abun in the name of Rebbi Aḥa: Either following the single opinion here or the rabbis here the rabbis there agree to alleviate but not to restrict. There, if the original disappeared, but here, if the indications {of impurity} disappeared and the original remains. “Rebbi said, the opinion of Rebbi Yose is reasonable for one in quarantine and the opinion of Rebbi Meïr if he is absolutely {impure}.” Rebbi Ze`ira said, they disagree about the holiday itself. Rebbi Aqiba says that this is the former case; could he enter the Temple courtyard? But the rabbis are saying, this is a new case; could he not enter the Temple courtyard? Therefore, Rebbi Aqiba declares him impure absolutely. But the rabbis are saying, it should be seen as a new case to become absolute. What is between them? (It will be sweet for him to hear a temporary release from the mouth of the Cohen.) Samuel said, they disagree about expansion. Rebbi Aqiba says that this is the former case and the expansion of impurity is pure. But the rabbis are saying that this is a new case and the expansion of purity is impure. One said in Samuel’s name, expansion and treatment-resistant scabies is between them. Rebbi Aqiba says that this is the former case and the expansion of impurity is pure. But the rabbis are saying that this is a new case and the expansion of purity is impure. Because it is another case. Therefore otherwise it would be pure. It parallels what Rebbi Simeon ben Laqish said when they differed, if it developed treatment-resistant scabies, Rebbi Joḥanan said pure, Rebbi Simeon ben Laqish said impure.

Rebbi Meїr is suspicious about bills of divorce. Rebbi Jehudah is suspicious about a child. Rebbi Yose is suspicious about bills of divorce and a child. Could you say that Rebbi Meїr is not suspicious about bills of divorce, as we have stated: “Those that had received qiddushin can be married.” Rebbi Ze‘ira in the name of Rebbi Gedula: The one who repudiates does not have to wait three months; the one who leaves by a bill of divorce needs to wait three months. This supports Rebbi Me‘ir since Rebbi Meїr is suspicious about bills of divorce. Rebbi Abba in the name of Rebbi Abba bar Jeremiah: A woman who has been raped does not have to wait three months. This supports Rebbi Yose, since Rebbi Yose is suspicious about bills of divorce and a child. It was stated: The proselyte, the captive, and the slave woman who were redeemed, or converted, or freed, have to wait three months, the words of Rebbi Judah. Rebbi Yose says, they do not have to wait. Their blood, Rebbi Jehudah says, makes impure 24 hours retroactively; Rebbi Yose says, from its moment onwards. Rebbi said, the words of Rebbi Judah are reasonable for the blood, and the words of Rebbi Yose for the child. Rebbi Ḥanina ben Rebbi Abbahu said, my father had a case and he asked Rebbi Ḥiyya, Rebbi Yasa, and Rebbi Immi, and they instructed him following Rebbi Yose for the child. For if it were not so, what could we say? Between Rebbi Jehudah and Rebbi Yose, practice does not follow Rebbi Yose? But because Rebbi said, “they are reasonable”. Did not Rebbi Abba say in the name of Rebbi Ze‘ira, every time Rebbi taught “they are reasonable”, the disagreement is unresolved except in the case of the fig cake where each party to the controversy accepts the opposition’s argument. Rebbi Yose said, I stated a difficulty before Rebbi Ḥanina ben Rebbi Abbahu: Even if it is certain that they had sex? He said to him, is a normal Gentile not like one who had sex? Simeon bar Abba said, there came a case before Rebbi Joḥanan and he instructed following Rebbi Yose. Rebbi Eleazar was sorry about this; he said, one disregards the anonymous [Mishnah] and follows an isolated opinion! He found that Rebbi Ḥiyya stated it in the name of Rebbi Meїr. He understood that following Rebbi Simeon, he found that Rebbi Ḥiyya stated it in the name of Rebbi Meїr. He said, the old man certainly understands the chapters about bills of divorce.

And here, you say so? He said to him, if not Rebbi, maybe somebody else said it? Since when Rebbi taught a disagreement and afterwards taught it anonymously, practice follows the anonymous [text]. It must be that Rebbi did not find a disagreement in the Mishnah; but if others taught it in disagreement and Rebbi taught it anonymously, certainly practice follows the anonymous [text]. There come Rebbi Ḥizqiah, Rebbi Jacob bar Abba and Rebbi Simeon bar Abba, in the name of Rebbi Eleazar: Even if others taught a disagreement but Rebbi taught it anonymously, practice follows the anonymous [text]. Why does he agree here with a dissenting opinion? Rebbi Samuel ben Inaya in the name of Rebbi Aḥa. That means, if no diagreement is stated together with the anonymous [text], but if a disagreement is stated together with the anonymous [text], practice does not follow the anonymous [opinion]. Rebbi Joḥanan said, everywhere one taught anonymous Mishnaiot, it follows the rabbis unless one’s teacher explains it [differently]. Rebbi Simeon ben Laqish says, all anonymous Mishnaiot follow Rebbi Meїr unless one’s teacher explains it [differently]. Rebbi Ze‘ira said before Rebbi Yasa, not that Rebbi Simeon ben Laqish disagrees, only he saw that most anonymous Mishnaiot follow Rebbi Meїr. Rebbi Ze‘ira asked before Rebbi Mana: What kind of teacher? The teacher of the baraita or the teacher of study? Does not the story of Rebbi Eleazar imply, the teacher of the baraita? “Following Rebbi Simeon, he found that Rebbi Ḥiyya stated it in the name of Rebbi Meїr. He said, the old man certainly understands his chapters.” We have to say that he received instruction from the teacher of the baraita when he understood that Rebbi Ḥiyya stated it in the name of Rebbi Meїr.

HALAKHAH: “If somebody declared his jealousy and she went to a secluded place,” etc. Rebbi Joḥanan in the name of Rebbi Yannai: This entire chapter [deals with the case that] he warned her and said to her, do not be at a secluded place with man X, after he declared his jealousy and she went to a secluded place. Rebbi Simeon ben Laqish said, even if she did not go to a secluded place. Rebbi Ze‘ira said before Rebbi Yasa: Not that Rebbi Simeon ben Laqish disagrees, only he is lenient about witnesses to the hiding. We have stated a disagreement. Some state it anonymously. Rebbi Ze‘ira said before Rebbi Mana: Rebbi Joshua does not disagree with what Rebbi Eliezer said, only that we have stated: “Rebbi Joshua says, only if she is the subject of talk of women carding by moonlight.” Rebbi Abba Mari asked: There, Rebbi Ḥizqiah, Rebbi Abbahu said in the name of Rebbi Eleazar, everywhere where Rebbi taught a disagreement and returned to the problem later and taught it anonymously, practice follows the anonymous opinion. And here he says so?
The Babylonian Talmud
It was reported: R. Ḥiyya b. 'Ashi said in the name of Rab, the law is in accordance with R. Jose, but Samuel said, it is in accordance with R. Meir. Did Samuel say so? Is it not stated in a Baraita: R. Simeon b. Gamaliel said: Why is the word behon (בהון = on them) used (in the Scroll of Fasts) twice in succession? In order to indicate that the prohibition applies only to the days specified, but not to the days immediately preceding or following them—to which Samuel remarked that the law is in accordance with R. Simeon b. Gamaliel! Answer: Originally Samuel was of the opinion that there was no authority as lenient in the matter as was R. Meir, and therefore he said that the law is in accordance with R. Meir, but when he heard of the view of R. Simeon b. Gamaliel, who is still more lenient, he said, the law is in accordance with R. Simeon b. Gamaliel. Bali, too, said in the name of R. Ḥiyya b. 'Abba, who had it from R. Johanan: The law is in accordance with R. Jose, whereupon R. Ḥiyya b. Abba said to Bali, I must inform you that when R. Johanan said the law is in accordance with R. Jose, he referred only to those days on which the Scroll of Fasts forbids fasting (but not mourning). Did R. Johanan say so? Did he not say, the law always follows the anonymous opinion of a Mishnah? Now, we read in an anonymous Mishnah: Although it has been decided that under certain circumstances the Megillah of Esther should be read several days before, instead of after, Purim,

Now, we read in an anonymous Mishnah: Although it has been decided that under certain circumstances the Megillah of Esther should be read several days before, instead of after, Purim,
mourning and fasting during these days is allowed. Now, which of these days is here meant? If you say that the Mishnah refers to those people who under ordinary circumstances would have to read the Megillah on the fifteenth of Adar but, as it happens, read it on the fourteenth, the question must be asked, is it true that in this event mourning and fasting are allowed on the fourteenth? Is it not written in the Scroll of Fasts that the fourteenth and fifteenth must be celebrated as Purim days, on which mourning is forbidden—, a rule on which Raba commented, saying that their listing in the Scroll was needed only for the purpose of emphasizing that whatever was prohibited on the one day should be prohibited also on the other? If, however, you say that the Mishnah refers to those who would have to read the Megillah on the fourteenth, but for given reasons are to read it on the thirteenth, you, then, face the difficulty that the thirteenth is Nicanor Day (on which fasting is likewise forbidden); if, finally, you say that the Mishnah refers to those who would have to read the Megillah on the fourteenth but, as it happens, have to read it on the twelfth, you face again the difficulty that the twelfth is Trajan's Day (on which, too, fasting is forbidden). You will therefore have to say that the Mishnah refers to those that would have to read the Megillah on the fourteenth but happen to be compelled to read it on the eleventh, and it is thus with reference to this day that the anonymous Mishnah teaches that mourning and fasting thereon are allowed! No, the Mishnah, no doubt, refers to those who would ordinarily have to read the Megillah on the fourteenth but who by reason of circumstances are permitted to read it on the twelfth, and as to your objection that the twelfth is Trajan's Day, the festive character of that day was later abolished, as is instanced by R. Naḥman who ordered a public fast on the twelfth, and when the Rabbis objected thereto, pointing out that it was Trajan's Day, he replied that Trajan's Day had been abolished, because on that day Shemaiah and Ahijah were executed. But ought not fasting on that day be prohibited on the ground that it precedes Nicanor Day? Said R. 'Ashi, if Trajan Day itself was abolished, should we declare it a holiday because it comes before Nicanor Day?
Rabbah b. Bar Hanah said in the name of R. Yohanan: This [rule stated in the Mishnah] is the ruling of R. Akiva the anonymous sage who draws the distinction between “time”, “their time” and “their times”, but according to the Sages the Megillah is to be read only on the proper day.
There are those who say: Rabbah b. Bar Hanah said in the name of R. Yohanan: This rule follows the ruling of R. Akiva the anonymous authority, but the Sages held that in these days since people reckon from it, we read it only on the proper day.
GEMARA. Townspeople who sold the town square. Rabbah b. Bar Hanah said in the name of R. Johanan: This is the view of R. Menahem b. Yose the anonymous author, but the sages that there is no sanctity in the town square.
