Say ye unto your brethren, Ammi; and to your sisters, Ruhamah.
The Jerusalem Talmud
Rebbi Zeriqan and Rebbi Ammi in the name of Rebbi Simeon ben Laqish: The reason of Rebbi is (Ps. 119:62): “At midnight I get up to thank You for Your just laws.” And it is written (Ps. 119:148): “My eyes preceded night watches.” Rebbi Ḥizqiah said: Rebbi Zeriqan and Rebbi Abba, one explained the reason of Rebbi, the other the reason of Rebbi Nathan. He who explained the reason of Rebbi: “at midnight”. He who explained the reason of Rebbi Nathan (Jud. 7:19): “at the start of the middle watch.” How does Rebbi Nathan uphold the basis of Rebbi’s reason, “at midnight”? Sometimes “at midnight,” sometimes “my eyes preceded night watches.” How is that? When David had a state dinner, “at midnight.” When he ate by himself, “my eyes preceded night watches.” In no case did dawn come and found David asleep. That is what David said (Ps. 57:9): “Wake up, my honor, wake up, o harp and lute, I shall awake dawn.” My honor has to be awake because of the honor of my Creator. My honor counts for nothing before the honor of my Creator. I shall awake dawn, dawn will not awake me. His evil instinct was trying to seduce him and told him: David, usually dawn awakes kings and you say “I shall awake dawn!” Usually kings sleep until three hours into the day and you say “at midnight I get up!” But he answers, “for Your just laws.” What did David do? Rebbi Phineas in the name of Rebbi Eleazar ben Rebbi Menaḥem: He took a harp, put it on his headboard, got up at midnight and started playing on it so that his companions in the study of Torah should hear it. What were his companions in the study of Torah saying? When king David studies Torah, certainly we have to do it also! Rebbi Levi said: a lute was hanging in David’s window and in the night the North wind was blowing and moving it and it was playing by itself. This refers to what is written (2Kings 3:15): “It happened when the musical instrument was playing.” It does not say “when he played on the musical instrument” but “when the instrument was playing”; it was playing by itself.
There it was stated (Tamid Mishnah 5:1): “The official in charge told them: recite one benediction! and they recited one benediction.” What benediction did they recite? Rav Mattanah in the name of Samuel: that is the benediction for the Torah. “Then they recited the Ten Commandments and the three sections of Shema‘.” Rebbi Ammi in the name of Rebbi Simeon ben Laqish: that means that the benedictions are no obstacle. Rebbi Abba said: From here you cannot draw any inference because the Ten Commandments contain the essence of Shema‘. Rav Mattanah and Rebbi Samuel ben Naḥman both say that it would have been logical to require that the Ten Commandments should be recited every day. Why does one not recite them? Because of the arguments of the Christians, that they should not say that only these were given to Moses at Sinai.
It was stated: He who recites with the men of Maämad has not done his duty since they were too late. Rebbi Zeïra in the name of Rebbi Ammi: In the days of Rebbi Yoḥanan we went out for a fast-day and recited Shema‘ after three hours and he did not oppose us. Rebbi Yose and Rebbi Aḥa went out for a fast-day. The public came and recited Shema‘ after three hours. Rebbi Aḥa wanted to oppose them. Rebbi Yose said to him: Did they not recite at its due time, now they only recite it in order to stand in prayer after words of the Torah. He answered back: It is because of the uneducated, who should not say that the recitation was in its correct time.
We have stated: Only that one should not bow down too much. Rebbi Jeremiah said: On condition that one should not behave like that large lizard, but (Ps. 35:10) “All my bones should say, o Eternal, who is like You?” The word of Ḥanan bar Abba disagrees since Ḥanan bar Abba said to the colleagues: I shall tell you one of the good things that I saw Rav do and, when I told it before Samuel, he got up and kissed me on my mouth. At “praised are You”, he bows down. When he comes to mention Hashem, he straightens up. Samuel said: I shall give the reason (Ps. 35:10): “The Eternal straightens the bent ones.” Rebbi Ammi said: It is not reasonable, but (Mal. 2:5): “Before My Name he is low.” Rebbi Abun said: If it were written “at My Name he is low” then you would be right, but it is written “before My Name he is low”, before he mentions Hashem he is low.
Rebbi Samuel bar Nathan in the name of Rebbi Ḥama bar Ḥanina: It happened that one bowed down too much and Rebbi removed him. Rebbi Ammi said, Rebbi Yoḥanan did remove. Rebbi Ḥiyya bar Abba said, he did not remove but scold.
Rebbi Jeremiah asked before Rebbi Zeïra: If it was used as bath house in summer but not in the rainy season, what is the rule? Rebbi Jonah investigated: A pebble on the sea shore, what is the rule? Rebbi Ammi the physician said: Rebbi Jeremiah taught that one may pass it by pylyvs, but one does not trust this ruling.
“If he recited and made a mistake then he should return to the place of the mistake.” If he made a mistake between the first and second mention of “writing” he must return to the first “writing”. If he made a mistake and does not know where he made the mistake, he returns to the start, to any place that he is sure about. An explanation: Rebbi Ḥiyya, Rebbi Yasa, Rebbi Ammi were preparing the wedding canopy for Rebbi Eleazar. They heard the voice of Rebbi Joḥanan when he explained something new. They said: Who is going down to hear that from him? They said, let Rebbi Eleazar go down since he is very careful. He descended, ascended, and said to them: So says Rebbi Joḥanan, if he recited and found himself at למען one can be sure that he had the right intention.
HALAKHAH: Who stated that the mourner is forbidden to take a bath during the entire seven days? Rebbi Nathan. Something happened to Rebbi Ammi, he asked Rebbi Ḥiyya bar Abba who instructed him “all seven days following Rebbi Nathan”. Something happened to Rebbi Yose; he sent Rebbi Abba bar Cohen to Rebbi Aḥa; he said to him: Rebbi, did you not so teach us that something happened to Rebbi Ammi, he asked Resh Laqish who instructed him “all seven days following Rebbi Nathan”. He said to him, maybe these were two separate incidents, we say it in the name of Rebbi Ḥiyya bar Abba, you say it in the name of Resh Laqish. And also from the following: Something happened to Rebbi Ḥama, father of Rebbi Oshaya, he asked the rabbis and they forbade it.

Rebbi Nehemiah the son of Rebbi Ḥiyya bar Abba said: My father did not walk under the arch of Caesarea. Rebbi Ammi, Rebbi Ḥizqiah, Rebbi Cohen and Rebbi Jacob bar Aḥa went walking on those streets of Sepphoris. They came to the arch and Rebbi Cohen left. They reached a place of purity and he returned to them. He asked them: “What were you discussing?” Rebbi Ḥizqiah said to Rebbi Jacob bar Aḥa: “Do not tell him anything!” We do not know whether it was because he was angry that he left since one defiles oneself for words of Torah or whether it was because he was haughty.
About a sick person who had intercourse, Rebbi Ammi said: If he caused it by himself, let him immerse himself and die; if it was forced upon him one does not bother him. Rebbi Ḥaggai in the name of Rebbi Abba bar Zavda: One does not bother him in any case. A sick person who does it habitually needs nine qab, a healthy person who does it habitually needs 40 sĕah. A sick person forced, one does not bother him. A healthy person forced needs nine qab.
It is stated: One removes himself from human excrement four cubits and from dog’s excrement four cubits, the latter when it is given on skins. Rebbi Jeremiah in the name of Rebbi Zeïra: One must remove hinself four cubits from a stinking carcass. Rebbi Avina said: Does not the Mishnah say all this : “How much does one have to remove himself from these and excrement? Four cubits.” Rebbi Ammi in the name of Rebbi Shammai: Explain it by steeping water of launderers. Rebbi Mani said to him: About steeping waters of launderers, we have stated: “neither with stinking water nor with steeping water.”
It is stated: One removes himself four cubits from a bad smell. Rebbi Ammi said, four cubits from the end of the bad smell. That means behind his back, but in front of him until he can no longer see it. Like that of Rebbi Lia and his colleagues who were sitting in front of a hostelry in the night. They said, may one say words of Torah? He said to them: If it were daytime, we would see what is before us. But like that it is forbidden.
Similarly, he who urinates should not pray until he walks four cubits. Rebbi Jacob bar Aḥa said: not only that he walks four cubits but even if he waits corresponding to a walk of four cubits. Rebbi Ammi said, if you say that he is forbidden until he removes himself four cubits, I say that maybe somebody else came and urinated there.
The word of Ḥanan bar Abba disagrees since Ḥanan bar Abba said to the colleagues: I shall tell you one of the good things that I saw Rav do and, when I told it before Samuel he got up and kissed me on my mouth. At “praised are You”, he bows down. When he comes to mention Hashem, he straightens up. Samuel said: I shall give the reason (Ps. 35:10): “The Lord straightens the bent ones.” Rebbi Ammi said: It is not reasonable, but (Mal. 2:5): “Before My Name he is low.” Rebbi Abun said: If it were written “at My Name he is low” then you would be right, but it is written “before My Name he is low”, before he mentions Hashem he is low.
Jeremiah the Scribe asked before Rebbi Jeremiah: What does one read if the day of the New Moon is a Sabbath? He said to him: One reads about the New Moon. Rebbi commanded his speaker Abdan: Proclaim before the congregation that he who wants to pray, should pray evening prayers as long as it is still daylight. Rebbi Ḥiyya bar Abba commanded his speaker: Proclaim before the congregation that he who wants to pray should pray evening prayers as long as it is still daylight. Rebbi Ḥanina said: Rebbi Ismael ben Rebbi Yose drew me to an inn and said to me: Here my father prayed Saturday (Friday night) prayers on Friday. Rebbi Ammi said: Rebbi Yoḥanan disagrees but he should not have disagreed since one adds from the profane to the holy time; in addition, donkey drivers come from Arab to Sepphoris and say, Rebbi Ḥanina ben Dosa already did consecrate the Sabbath in his town. But so it has been said, that Rebbi Ḥanina said: Rebbi Ismael ben Rebbi Yose drew me to an inn and said to me, here my father prayed Saturday night prayers on the Sabbath. But even with that he should not have disagreed, since Rebbi commanded his speaker Abdan: Proclaim before the congregation that he who wants to pray should pray evening prayers as long as it is still daylight. Rebbi Ḥiyya bar Abba commanded his speaker: Proclaim before the congregation that he who wants to pray should pray evening prayers as long as it is still daylight. In the house of Rebbi Yannaï they said: If a man went to bed, one does not bother him to get up. Rebbi Zeïra said, all the time that I followed this rule, I was afraid in the night. You have only what Rebbi commanded his speaker Abdan: Proclaim before the congregation that he who wants to pray should pray evening prayers as long as it is still daylight. Rebbi Ḥiyya bar Abba commanded etc.

Rav Ḥaggai came in the name of Rebbi Zeïra: Even if one did not eat from the same kind during the meal.
They said, Rebbi Joḥanan changed his mind about this. Rebbis Jonah and Yose said, he did not change his mind; additionally, Rebbi La said in the name of Rebbi Ammi: Ḥizqiah and Rebbi Joḥanan disagreed. Ḥizqiah said, a man may split his obligation for two animals. Rebbi Joḥanan said, nobody may split his obligation for two animals, but for each one he has to have two silver coins in his hand.
It was stated: “He who is trustworthy for purity is trustworthy for tithes.” Rebbi Yannai ben Rebbi Ismaël stated it and explained his reason: That means, if one is a guest of his, but for the public he is not trustworthy until he accepts it publicly. Rebbi Ammi in the name of Rebbi Yannai: Even I am not trustworthy until we accept it in public. Rebbi Zeïra, Rebbi Yasa, in the name of Rebbi Joḥanan: Even a ḥaver who sent to another ḥaver, the recipient must tithe. He answered him, what do you want from Rebbi Samuel ben Rav Isaac, because all he eats, he eats from the market.

Rebbi Abuna asked before Rebbi Ammi: Are Gentiles required to sanctify the Name? He said to him (Lev. 22:32): “I shall be sanctified in the midst of the Children of Israel.” Israel are required to sanctify the Name; the Gentiles are not required to sanctify the Name. Jewish greeting, “Peace upon you.”
Rebbi Ammi taught that one may not take out together with him.
Rebbi Ammi asked before Rebbi Joḥanan: Does our Mishnah go back to the time before they decreed about spontaneous growth? He said to him, where you there on the upper floor? Rebbi Ammi inferred that the prohibition of spontaneous growth is from the Torah.
Rebbi Ammi asked before Rebbi Joḥanan: Does our Mishnah go back to the time before they decreed about spontaneous growth? He said to him, where you there on the upper floor? Rebbi Ammi inferred that the prohibition of spontaneous growth is from the Torah.
“All this has only been said for communal peace.” Rebbi Ḥiyya, Rebbi Ammi. One said: “Plough it well then I will rent it from you after the Sabbatical.” The other one said: “May you succed” For him who says plough it well, what means “one greets them”? “May you succed.” For him who says may you succed, what means “one greets them”? Jewish greeting, “Peace upon you.”
Rebbi Abbahu went up to Arbel and was received by Abba bar Benjamin. They came and asked him about these onions; he taught them the statement of Rebbi Zeïra “once the new growth is the majority it is permitted.” He saw them relying on him; then he said to them: I was referring only to those that are bent down Rebbi Jehudah bar Pazi said, I know beginning and end; when he heard that Rebbi Hila and Rebbi Ammi disagreed, he shrank from it.
“ Rebbi Meïr said to them: I am more restrictive with the proceeds than with the main [produce]. For one may light with Sabbatical oil but if one sold it and bought oil with it he may not light with it.” Rebbi Ammi in the name of Rebbi Joḥanan: If one exchanged oil for oil, both of them are forbidden. What can he do? Rebbi Ḥizqiah in the name of Rebbi Jeremiah: He barters both for profane [oil]. If he exchanged wine for oil; just as you say that he may not anoint with wine so he may not light with oil. If he exchanged leaves for sprouts, just as you say that leaves are subject to removal so sprouts are subject to removal. If he exchanged human food for animal feed, just as one may not make a wound dressing from human food so he may not make a wound dressing from animal feed. We also have stated: “One may sell human food and animal feed to buy human food with the proceeds, animal feed to buy animal feed and certainly human food (to buy animal feed).”
“One should not anoint with wine or vinegar, but with olive oil.” “If somebody has a headache or he has a scab, he may rub with oil but not with wine or vinegar.” One does not use Sabbatical oil as base for perfumes but one may buy sweet oil before the Sabbatical without worry. Rebbi Ammi thought, even from one who is suspect. Rebbi Assi told him, they said that only if one does not know whether he is suspect or not. But if it is clear that he is suspect, it is forbidden.
Ḥizqiah said, once he started with his storage it is as if removed. A case came before Rebbi Assi and he instructed following Ḥizqiah, not that I am agreeing with him but since we see that the rabbis do act following him. Rebbi Isaac bar Redifah had a case, he came before Rebbi Jeremiah who said to him, there are lions before you, why do you ask foxes? He went and asked Rebbi Joshia who said to him, look for three people who love you and declare it abandoned before them. The Kappadokians of Sepphoris asked Rebbi Ammi: Since we have nobody who loves us or even greets us, what should we do? He said to them, when you see that [the market is] clear from steps, bring it out to the market, declare it abandoned, and acquire it again.
Rebbi Jacob bar Aḥa, Rebbi Ammi, in the name of Rebbi Jehudah bar Pazi: If they sanctified it and afterwards the witnesses turned out to be perjured, it still is sanctified. Rebbi Abbahu in the name of Rebbi Joḥanan: He who swallows heave vinegar is whipped. Rebbi Abbahu in the name of Rebbi Joḥanan: He who chews a wheat grain of heave is whipped. It was stated: He who chews a wheat grain of heave pays the principal but not the fifth; Rebbi says, I am saying that he pays principal and fifth. Rebbi Jeremiah in the name of Rebbi Ammi: The Sages agree with Rebbi about him who swallows heave vinegar after such ṭevel, that he pays principal and fifth because vinegar refreshes the spirit.
If he [the Cohen] forgave and after that he [the Israel owner] ate, there is disagreement between Rebbi Joḥanan and Rebbi Simeon ben Laqish since they disagreed: If he robbed heave from his maternal grandfather, a Cohen, Rebbi Joḥanan said, he has to pay to the tribe, but Rebbi Simeon ben Laqish said, he pays to himself. Rebbi Jonah said, Rebbi Simeon ben Laqish answered Rebbi Joḥanan thus: According to you, who says he has to pay to the tribe, did we not state: “If he stole heave of the Sanctuary, he has to pay two fifths and the principal.” Should he not pay three? Rebbi Yasa in the name of Rebbi Joḥanan: The Torah said, it takes him out of his robbery. Rebbi Zeïra said to Rebbi Ammi: Two things you say in the name of Rebbi Joḥanan but you do not say why. Rebbi Joḥanan said, it takes him out of his robbery but you do not say why. It is so, “he shall give the holy food to the Cohen;” once he gave it, it stopped being his robbery. You say in the name of Rebbi Joḥanan, at the place of its slaughter should be its burning. You do not say why. Rebbi Eleazar in the name of Rebbi Hoshaia, Num. 19:5: “On its excrement shall be its burning.” How do you understand this? Rebbi Jeremiah in the name of Rebbi Ammi: At the place of its exit from life shall be its burning.

Rebbi Jeremiah in the name of Rebbi Ammi: At the place of its exit from life shall be its burning.
Rebbi Jacob bar Aḥa, Rebbi Ammi, Rebbi Eleazar: If he was entering and leaving it is permitted. The barrel of Bar Neṭoza became uncovered. He went and asked Rebbi Abba bar Mamai, who told him, it is permitted. Rebbi Jacob bar Aḥa, Rebbi Ammi, Rebbi Eleazar: If he was sleeping it is permitted. Rebbi Ḥanina and Rebbi Joshua ben Levi, one said, if he was sleeping it is permitted; the other said, it is forbidden. We do not know who said what. It is reasonable [to infer that] Rebbi Ḥanina said, if he was sleeping it is permitted, since Rebbi Eleazar everywhere relies on Rebbi Ḥanina.
Rebbi Ammi said, one has to be careful with what the creatures are careful. It is forbidden to put a coin into the mouth, or a dish under the bed, a bread in the arm pit, a knife in the middle of a radish, a knife into an etrog. Rebbi Yose ben Rebbi Abun said, all sweat that comes from a human is poison except the sweat of the face.
Zeir bar Ḥinena was captured at Safsufa. Rebbi Ammi and Rebbi Samuel went to negotiate for him. Queen Zenobia said to them, your Creator usually does wonders for you; put Him under pressure! There came a Saracen carrying a sabre. He said to them, with this sabre did Odenathus kill his brother. Zeїr bar Ḥinena was saved.
Jehudah ben Keni, Rebbi Ammi in the name of Rebbi Simeon ben Laqish: Because he reduces the number of drinkers.
Ada the nurse asked Rebbi Ammi: Since I am dipping wicks at a sick person’s? He said to him, it becomes insignificant in the wick. Rebbi Jehudah ben Pazi instructed those of Bar Neḥemiah in this way. Rebbi Immi took a wick, Rebbi Ila did not take a wick. Did Rebbi Ila not agree with Rebbi Immi? Rebbi Ila thought because of robbery; in addition, the nurse will spoil the consecrated food.
Rebbi Eleazar in the name of Rebbi Hoshaia: The Mishnah speaks of a harvesting basket of figs. In the House of Rebbi Yannai they said, even a branch. Rebbi Eleazar ben Antigonos in the name of Rebbi Eleazar ben Rebbi Yannai: Explain it for a fig tree reserved for the Sabbath. Example: Rebbi Ḥiyya, Rebbi Assi and Rebbi Ammi were sitting together when somebody passed by with a harvesting basket of figs. He said to him, [we want] to buy! He answered, the Sabbath basket is not for sale.
Menaḥem ben Maximus the brother of Jonathan Caiphas in the name of Rebbi Ammi: Flax may be bought from everybody during the Sabbatical. That is, if you do not know whether he is suspect or not. Therefore, if it is clear that he is suspect, it is forbidden. Zeugos, the relative of Rebbi Abba bar Zavda, in the name of Rebbi Abbahu: Vetch may be bought from anybody during the Sabbatical. Rebbi Yose said: Does our Mishnah say so? “The upper seed of arum, the seeds of leeks, seeds of egg plants, seeds of turnips and radishes, and other garden seeds which are not eaten.” We have stated on this: Seeds of indigo, seeds of madder, and seeds of vetch. That implies, not vetch itself. Maybe if you do not know whether he is suspect or not. Therefore, if it is clear that he is suspect, it is forbidden.
Come and look: If it is completely parboiled, the House of Shammai obligate, not completely parboiled, the House of Shammai exempt? Rebbi Assi in the name of Ḥizqiah, Rebbi Ḥiyya in the name of Rebbi Hoshaia: Two students stated this. Rebbi Ammi in the name of Rebbi Joḥanan: For this matter I went to the elder Rebbi Hoshaia to Caesarea and he said to me, two students stated this.
The Mishnah said: “if the shepherds eat from it.” Maybe sometimes the shepherds will not eat from it. Rebbi Joḥanan said, any he made into cracknels. We also have stated so: “Any he made into cracknels is obligated; if he made it connected it is free.” Rebbi Abba in the name of Samuel, Rebbi Ammi in the name of the elder Rebbi Ḥiyya, even if he formed it as rolls. But did we not state, “if the shepherds do not eat from it?” Explain it if he made it from the start [thinking] that the shepherds should not eat from it.
HALAKHAH: How is this? Less that four mil he should make it in purity, four mil he sould make single qabim, or four mil he should make it in purity, more than four mil he sould make single qabim? Let us hear from the following, since Rebbi Ḥiyya bar Abba said, for example Caesarea. Is Caesarea not four mil? That means, four mil he should make it in purity, more than four mil he sould make single qabim. Rebbi Ammi instructed in Kefar Sammai to make a large dough in impurity. Is that not less than four mil? Since a brook interrupts it is as if there were four mil. This teaching follows Rebbi Aqiba since Rebbi Aqiba says, he should make it in impurity and not make it single qabim. It was a large dough and it would have been easier for him to walk a distance than to make it single qabim.
Rebbi Jonah, Rebbi Ḥiyya in the name of Rebbi Joḥanan; Rebbi Ammi in the name of Rebbi Joḥanan: Only if they were biting. There are Tannaїm stating: The bag combines them together but not the oven, and there are Tannaїm stating: The oven combines them together but not the bag. Rebbi Joḥanan said, one follows Ḥilfai: If they bite in both places they are combined together, if they do not bite in both places they are not combined together. The Mishnah applies, e. g., to Babylonian bread.
There, we have stated: “If a proselyte became Jewish while he had a cow, if she was slaughtered before he became Jewish he is free, after he had become Jewish he is obligated. In case of doubt he is free because the burden of proof is on the claimant.” There you say in doubt he is free, here you say in doubt he is obligated. Rebbi Abba said, this was challenged before Rebbi Ammi and he said, who would tell me that he takes its value from the tribe! Rebbi Jacob bar Zavdi, Rebbi Ḥiyya in the name of Rebbi Eleazar, he takes its value from the tribe. Why can he not put aside there and take its value from the tribe? Rebbi Yose said, ḥallah which is ṭevel and a deadly sin he puts aside and does not take its value from the tribe since the burden of proof is on the claimant.
HALAKHAH: There, we have stated: “Libation wine is forbidden and makes forbidden in the most minute amount.” Ḥizqiah said, if somebody mixed a cup from forbidden and from permitted [wine], if the forbidden fell in last it makes it forbidden, permitted at the end makes it permitted. Rebbi Samuel ben Rav Isaac said, this follows Rebbi Eliezer, as Rebbi Eliezer said, I am going after the last one. Rebbi Jeremiah said, this is a stringency about libation wine. Rebbi Yose asked, if it were a stringency about libation wine, even if the permitted fell in last it should be forbidden! Rebbi Assi in the name of Rebbi Joḥanan: If somebody mixed a cup from forbidden and from permitted [wine], one considers the permitted as nonexistent; if the forbidden does impart taste it is forbidden, otherwise permitted. Rebbi Hoshaia said, only if the permitted fell in last. Rebbi Ammi in the name of Rebbi Joḥanan, it does not make any difference whether the forbidden fell in first and the permitted last or the permitted first and the forbidden last, even water and wine, even if it was mixed perfectly from permitted, one considers the permitted as nonexistent; if the forbidden does impart taste it is forbidden, otherwise permitted. Rebbi Zeïra said, that which you say and everybody stated, how can this be? Rebbi Yose ben Rebbi Abun, Rebbi Abbahu in the name of Rebbi Joḥanan, if a flask of libation wine fell into an amphora of wine and then it fell into a water cistern, one considers the permitted as nonexistent; if it can be tasted it is forbidden, otherwise permitted.
And Rebbi Jeremiah said in the name of Rebbi Simeon ben Laqish, who is the Tanna of the leavened matter of Samaritans? Rebbi Eliezer! And Rebbi Yose said to Rebbi Ḥanina Eyntanaya: Do you remember that you and Rebbi Jeremiah said in the name of Rebbi Simeon ben Laqish, who is the Tanna of the leavened matter of Samaritans? Rebbi Eliezer! But we do not say so, since Rebbi Hila said in the name of Rebbi Simeon ben Laqish, they treated leavened matter of Samaritans following Rebbi Eliezer. In addition from the following: Rebbi Ḥanina said, my father Rebbi Abbahu had a case; he sent to Rebbi Ḥiyya, Rebbi Assi, and Rebbi Ammi, and they instructed him according to Rebbi Eliezer. Would they instruct according to an isolated opinion? But it is that they treated leavened matter of Samaritans following Rebbi Eliezer.
Rebbi Yose ben Rebbi Abun said in the name of Rebbi Joḥanan, Rebbi Assi in the name of Rebbi Joḥanan: Mixed firstling wool becomes insignificant in a plurality. Rebbi Ḥiyya the Sepphorean brought before Rebbi Ammi a pound in eight but the latter refused to rule since had not Rebbi Assi said, is that not a Mishnah? “If somebody weaves the length of a sîṭ of firstling’s wool in a cloth, the cloth must be burned”? He said to him, if you had objected there it would have been correct.
It was stated: If he provined with permission, he brings and makes the declaration. Rebbi Yose in the name of Rebbi Ammi: Only if the permission was permanent, not temporary. Rebbi Jonah in the name of Rebbi Ammi: Even temporary. The force of Rebbi Jonah comes from the following: “If somebody digs a cistern, a ditch, or a cave, he may cut down as he works and the wood is his.” Is the wood not as if temporary? What does Rebbi Yose do with this? Roots always regrow; since roots do regrow it is as if permanent. Rebbi Mana said, the statement of Rebbi Joḥanan supports my father, as Rebbi Joḥanan said in all cases they judged by the rules of robbers. In our case, if he gave permission to provine even temporarily, the proviner is not a robber.
It was stated: If he provined with permission, he brings and makes the declaration. Rebbi Yose in the name of Rebbi Ammi: Only if the permission was permanent, not temporary. In the opinion of Rebbi Jehudah, what is the difference between him who plants on his own property and provines into the public domain and him who plants on his own and provines into his own and a public road is in between? Rebbi Ammi said, Rebbi Jehudah holds with Rebbi Eliezer, as we have stated there: “One may not make a cavity under the public domain, cisterns, ditches, or caverns. Rebbi Eliezer permits it if a truck loaded with stones can pass over it.” As Rebbi Eliezer said there, under the public domain, it is his, so Rebbi Jehudah said here, under the public domain, it is his. Rebbi Samuel ben Rav Isaac asked, if it follows Rebbi Eliezer, he should bring and make the declaration. Rebbi Yose said, Rebbi Samuel ben Rav Isaac thought that Rebbi Eliezer permits to do that and it remains his permanent property, but Rebbi Eliezer permits to do that but anybody quick to acquire does acquire it.
So far about a robbery when the owners did not give up hope. Even about a robbery when the owners did give up hope? They thought to say that we can hear it from the following: “This applies to heave and tithe but not to First Fruits.” For what is this needed? Not for a robbery when the owners did not give up hope, but for a robbery when the owners did give up hope? Even for heave he did not do anything, as we stated: “A strongman, a thief, or a robber, as long as the owners pursue them, their heave is no heave, his tithes no tithes, and their dedications no dedications. If the owners do not pursue them, their heave is heave, their tithes are tithes, and their dedications dedications.” Rebbi Yose in the name of Rebbi Joḥanan: Neither of them can give heave. Rebbi Ammi in the name of Rebbi Joḥanan: Even if the owners declare heave, it is no heave. Rebbi Yose said, so far we deal with a robbery when the owners did not give up hope. Then why did we state: “This applies to heave and tithe but not to First Fruits”? It is possible for fruits to be usable without First Fruits. It is impossible for fruits to be usable without heave and tithes! But a robbery when the owners did give up hope remains a question.
“Oil olives” that is agory. Rebbi Ammi in the name of Rebbi Joḥanan, that is the Avaritic. Why is it called agory? Because it stores its oil inside. Do all other olives lose their oil? Rebbi Ḥanina said, all other olives will leach their oil if rains fall on them but this one stores its oil inside.
“The agent”. Rebbi Yose, Rebbi Simeon ben Laqish in the name of Rebbi Joḥanan: When he gathered in order to send by a third person; but if he gathered to bring them himself he cannot send them by a third person. He did not finish this; Rebbi Jonah finished this. Rebbi Zeïra, Rebbi Ammi, Rebbi Simeon ben Laqish in the name of Rebbi Hoshaiah: When he gathered in order to send by a third person; but if he gathered to bring them himself he cannot send them by a third person since all First Fruits which could become permitted by making the declaration become permitted only by making the declaration. Rebbi Mana said, even though Rebbi Yose did not say that, he said something similar: Rebbi Zeïra said to Rebbi Assi, do you remember that when the statement of Rebbi Hoshaiah was formulated, Rebbi Yose ben Rebbi Ḥanina said that a Mishnah disagrees: “If he designated his First Fruits and then sold his field he brings but does not make the declaration”! We upheld this if he had prior intention to sell. But did we not state: “If the tree dried up or was cut down”; that also if earlier it already was almost dry. Does making the declaration prevent? Rebbi Samuel ben Rav Isaac said, where making the declaration is possible, making the declaration does not prevent. If he gathered to deliver them through a third person, would he be forbidden to deliver them through a third person because maybe he would change his mind to deliver them himself?
Rebbi Joḥanan’s argument seems inverted. There, Rebbi Joshua ben Levi said, it was quoted for the horns of a cadaver. He said to him, did the teacher not teach: “I saw” the size of two beans? Should he have said here also, “their growths”? In addition, from the following (Deut.12:17): “You may not eat your grain’s tithe in your gates.” About which tithe has this been said? About pure second tithe which entered Jerusalem and left. Also from the following which Rebbi Simeon stated. It was stated in the name of Rebbi Simeon: “Tithe is special in that tithe forbids its money, mixtures, and vessels; the doubt of an admixture forbids in the most minute amount and one may not use it for lighting.” He should say, the same holds for growth! Rebbi Hila said, he who says growth is permitted, Rebbi Simeon. Those who say growth is forbidden, the rabbis. They said to him, did we not state: “Growths from dedicated [seeds] and Second Tithe are profane; one redeems them corresponding to the time of sowing.” Why does he have to redeem? Not because of their inherent sanctity? Here also they should require walls because of their inherent sanctity! Rebbi Jeremiah, Rebbi Ammi, in the name of Rebbi Simeon ben Laqish: When one says the growth is forbidden, the prohibition of walls. When one says the growth is permitted, the permission for unauthorized persons. “These rules apply to tithe and First Fruits but not to heave.”
Rebbi Jeremiah, Rebbi Ammi, in the name of Rebbi Joḥanan. Rebbi Simon in the name of Rebbi Joshua ben Levi: Everybody agrees that its New Year is the 15th of Šebaṭ. Rebbi Joḥanan asked Rebbi Jonathan: According to years or according to seasons? He said to him, according to years and even in an intercalary year.
Is it obvious that it will be sacrificed as a well-being offering? Rebbi Ammi said, it will be sacrificed as a well-being offering. Rav said, one uses it to occupy the altar. Rebbi Zeïra asked: Does a private person who was lazy and did not come [with the group] bring a goat with its horns covered in silver?
Rebbi Mana made light of those ordained for money. Rebbi Ammi read for them (Ex. 20:19): “Do not make for yourselves gods of silver or gods of gold.” Rebbi Yoshia said, their prayer shawl is like a donkey’s saddle cover. Rebbi Ashian said, if somebody is ordained for money, one does not get up before him and one does not address him as Rebbi; his prayer shawl is like a donkey’s saddle cover. Rebbi Zeïra and one of the rabbis were sitting together when a person ordained for money was passing by. One of the rabbis said to Rebbi Zeïra, let us behave like Tannaïm and not get up before him.
Rebbi Ammi asked Rebbi Simeon: Did you hear that one ordains Elders outside the Land? He answered, I heard that one does not ordain Elders outside the Land. Rebbi Levi said, is that not an explicit verse (Ez. 36:17): “Son of man, the House of Israel are dwelling on their Land;” that all your academies shall only be on your Land. The rabbis of Caesarea say, one may ordain Elders outside the Land on condition they return. Rebbi Isaac bar Naḥman was in Gaza and they ordained him on condition he return. Rebbi Zemina was in Tyre and they ordained him on condition he return. Also Rebbi Jonah was on the list but he refused to be ordained as long as his teacher was not ordained. They ordained his teacher. Rebbi Ḥama said, Jehudah ben Titus was in Rome and they ordained him on condition he return.
Rebbi Abba, Ammi bar Ezechiel in the name of Rav. If a city is built on the banks of a river, if between it and the river are four hand-breadths one measures from the wall, three one measures from the outer bank of the river unless the river be [wide] more than 70 and remainder. Where do we hold? If it descends ten hand-breadths in three [cubits] one measures from the outer bank of the river, if in four [cubits] one measures from the wall. So where we hold is between three and four.
The House of Rebbi Yannai are saying, even a peg to hang his shoes on. Rebbi Abba bar Ḥinena said, even a metal plate, even a table. Rav said, but only what may be moved on the Sabbath. Rebbi Abba said, it happened that a person had a chicken coop inside another person’s house, where he could enter without asking for permission. The case came before Rav who said, since he is obligated to give them water it is as if it could be moved on the Sabbath. Rebbi Jacob in the name of Samuel: The students of Rebbi Joḥanan ascended to Akhbara and relied on the statement of Rebbi Yannai. Ḥizqiah does not say so but: Rebbi Ḥiyya, Rebbi Assi, and Rebbi Ammi ascended to Akhbara and heard from the House of Rebbi Yannai that practice follows Rebbi Jehudah.
Rebbi Joḥanan said: “One silver obolus and two silver coins are words of the Torah.” Rebbi Yasa stated before Rebbi Joḥanan: The appearance is with anything; the Sages only said: “One silver obolus, two silver coins.” He said to him: Is there anything like that? Rebbi Jonah said, are not all measures determined by the Sages? They said: The volume of an olive from a corpse, the volume of an olive from a cadaver, the volume of a lentil from a dead reptile. The question here is only what Rebbi Hoshaia stated: They should not be seen before Me empty-handed, with anything; the Sages only said: “A silver obolus, two silver coins.” The difficulty is that this is support for the opinion that it is based on words of the Torah. He said that only the Sages instituted: “one silver obolus, two silver coins.” Rebbi Yose ben Rebbi Abun said: Rebbi Joḥanan follows his own opinion and Rebbi Hoshaia follows his own opinion. Rebbi Joḥanan follows his own opinion since Rebbi Joḥanan said that all measures are practice taught by Moses at Sinai; he says that “one obolus and two silver coins are the word of the Torah.” Rebbi Hoshaia follows his own opinion; Rebbi Hoshaia is the one who said: he who eats forbidden food in the present time has to study the quantities; maybe a new court will arise and change the measures for him; then he will know what measure he ate. Therefore he is the one who said, the appearance is with anything; the Sages only said: “one silver obolus, two silver coins.” They said, Rebbi Joḥanan changed his mind about this. Rebbis Jonah and Jonathan said, he did not change his mind; additionally, Rebbi La said in the name of Rebbi Ammi: Ḥizqiah and Rebbi Joḥanan disagreed. Ḥizqiah said, a man may split his obligation for two animals. Rebbi Joḥanan said, nobody may split his obligation for two animals, but for each one he has to have two silver coins in his hand. Rebbi Simeon ben Laqish in the name of Ḥizqiah: A person adjoins an animal to an animal but no person may adjoin money to money. Rebbi Joḥanan said, a person may adjoin money to money but no person may adjoin animals to an animal. What may be done? There were before him ten animals, he sacrificed five of them on the first holiday. May the remainder push aside the last holiday? Rebbi Crispus said, Rebbi Joḥanan and Rebbi Simeon ben Laqish disagree. One said, they push; the other one said, they do not push. We do not know who said what. Rebbi Ze`ira said, we may explain the words of the rabbis by their own words. Rebbi Joḥanan said: a person may adjoin coins to coins but not animals to an animal; he must say, they push. But Rebbi Simeon ben Laqish said, a person adjoins an animal to an animal but no person may adjoin money to money; he must say, they do not push. Simeon bar Abba came in the name of Rebbi Joḥanan: He adds and pushes the holiday further until he says: I do not intend to add further.
Rebbi Jeremiah and Rebbi Ammi asked: What is the difference between her and one who had sex with a finger? Is the one who had sex with a finger not disabled for priesthood? Rebbi Haggai said, explain it that there was no penetration. Rebbi Haggai wanted to change his mind; Rebbi Abba said to him, do not change your mind. Why did Rebbi Haggai want to change his mind? Because of the verse: “But he shall marry a wife in her virginities,” only if she is a virgin in both respects. Similarly, “a virgin and no man had known her.” A virgin, with respect to penetration. No man had known her, without penetration. Rebbi Isaac ben Eleazar said, [no man] ever had wanted to touch her hand, for it was said: “The staff of evil shall not rest on the just’s lot.” Why did Rebbi Haggai want to change his mind? He could explain it by “touching”. Why does (Rav Yosef) [Rebbi Yasa] not explain it by “touching”? Rebbi Mana said, because it presented a problem for him: Rebbi Yasa asked: What is the legal status of “touching” with a male? “Touching” with an animal? When Rebbi Jeremiah heard that of Rebbi Haggai, he said, that was not Rebbi Ammi’s problem.

Rebbi Ze‘ira asked Rav Naḥman bar Jacob and Rav Ammi bar Pappai, who is the Tanna of “a tenth of the estate”? Rebbi Ze‘ura said to him in the name of Rav Jeremiah: A tenth of the estate following Rebbi. They asked before Rebbi: If there were ten daughters. Then if the first one took a tenth of the estate, the second took a tenth of the estate, the third, the fourth, the fifth, and so on up to the tenth, there is nothing left for the son! He said to them: The first one takes a tenth of the estate and leaves; the second takes a tenth of the remainder, the third from what then is left, the fourth of what then is left, up to the tenth from what then is left. It turns out that the daughters take two thirds less a little, and the son takes one third plus a little.
”If they died, others should inherit.” Did not Rebbi Abbahu say in the name of Rebbi Joḥanan: A person can transfer property rights in any language except with an expression of inheritance? One does not have here “they shall inherit” but “they shall take”. Rebbi Ze‘ira asked before Rebbi Mana: Do they not differ here in matters of a gift? If somebody signed over all his property to two persons at the same time; to one he wrote in the language of gift but to the other in the language of inheritance. Rebbi Eleazar said, since the one acquired in the language of gift, the other one acquired in the language of inheritance. Rebbi Joḥanan said, it seems that one did acquire in the language of gift but the other did not acquire in the language of inheritance Rebbi Phineas said, there came a case before Rebbi Jeremiah: Practice follows Rebbi Eleazar since Rebbi Eleazar stated a docrine but Rebbi Joḥanan said only “it seems”. Rebbi Samuel said, but did not Rebbi Meïr say that and it does not seem reasonable; is that nothing? Did not Rebbi Joḥanan say in the name of Rebbi Assi: Carded firstling wool becomes insignificant in a plurality. Rebbi Ḥiyya the Sepphorean brought before Rebbi Ammi a pound in eight but the latter refused to rule since had not Rebbi Assi said, is that not a Mishnah? “If somebody weaves the length of a sîṭ of firstling’s wool in a cloth, the cloth must be burned, of hair of a nazir or firstling donkey in sackcloth, the sackcloth must be burned”? The following Mishnah disagrees with Rebbi Joḥanan: “If he wrote any expression of gift either at the start, or in the middle, or at the end, his instructions are valid.” There, to one person in an expression of gift and to one an expression of inheritance. But here to each one both in the language of gift and the language of inheritance Rebbi Ḥaggai asked before Rebbi Yose: But does he not prejudice the rights of others? He said to him, if there are no brothers. But does he not prejudice the rights of his paternal uncles? Rebbi Ḥanania the son of Rebbi Hillel: A person prefers the good of his house over his relatives.
“And all defects which disqualify a priest disqualify a woman. They added to them for women mouth odor, sweat odor, and a hairless mole.” Rebbi Ammi bar Uqba in the name of Rebbi Yose ben Ḥanina: They taught this about the skin of the face. But did we not state: “When was this said? For hidden defects, but he has no claim about visible defects,” and this is of the visible defects! Explain it if she hid it under her headgear. It was stated: “A mole with hairs is a defect, whether it be large or small, whether it be on the body or on the face. Without a hair it is a defect on the face but not on the body. When has this been said? If it is small. But if it is large, it is a defect whether it be on the body or on the face. How big is large? Rabban Simeon ben Gamliel says, up to an Italic as.” Rebbi Eleazar bar Ḥanina said, for example such a Gordianic denar his measure is half an ubiquitous gold piece. Rebbi Radifa, Rebbi Jonah: Rebbi Jeremiah asked: A bald woman with a row of hair going from one ear to the other? They wanted to understand it from the following: “They added to them for women mouth odor, sweat odor, and a hairless mole.” They did not mention baldness. They wanted to conclude that it is not a defect. There came Rebbi Samuel the son of Rebbi Yose ben Rebbi Abun: Rebbi Nasa said, it is a defect. It is listed only if it is ugly for both sexes. But something which is beautiful in one sex but ugly in the other, like a bald pate, even though it is a defect it was not listed. You should know that this is so because a beard is beautiful for a man and a defect for a woman, and we did not state: In addition, for a woman a beard. There are breasts which are beautyiful for a woman and a defect for men, and we did not state: In addtion, for a man women’s breasts.
Rebbi Nihumi the son of Rebbi Ḥiyya bar Abba said: My father did not walk under the arch of Caesarea. Rebbi Ammi walked. Rebbi Ḥizqiah, Rebbi Cohen and Rebbi Jacob bar Aḥa went walking in the streets of Caesarea.
Rebbi Ḥiyya, Rebbi Ammi. One said: “Plough it well then, I will rent it from you after the Sabbatical.” The other one said: “May you succeed” For him who says, plough it well, then I will rent it from you after the Sabbatical, what means “one greets them” in a Jewish way? “May you succeed.” For him who says to the Gentile “may you succeed”? Explanation: Rebbi Ḥinena bar Pappa and Rebbi Samuel bar Naḥman passed by one of the ploughmen in the Sabbatical. Rebbi Samuel bar Naḥman said to him, are you not Jewish? Rebbi Ḥinena bar Pappa said to him, did not Rebbi teach us (Ps. 129:8): “The passers-by did not say, the blessing of the Eternal be on you,” these are the nations of the world who pass out of the world, they did not say to Israel “the blessing of the Eternal is on you.” What does Israel say to them, “we bless you in the Name of the Eternal.” All blessings that come into the world because of us are not enough for you; not only do you not say, come and take from these blessings for yourselves, but you roll over us pro-rated contributions and fines, head taxes and annonae.
The Babylonian Talmud
What is Rabbi's reason [for declaring there are four watches] ? R. Zerika stated that R. Ammi said in the name of R. Joshua b. Levi : One verse states, "At midnight I will rise to give thanks unto Thee because of Thy righteous ordinances" (Ps. cxix. 62) and another verse states, "Mine eyes forestalled the night-watches" (ibid. 5:148). How is this? There must be four watches in the night.
R. Zerika also stated that R. Ammi said in the name of R. Joshua b. Levi : In the presence of the dead, we should only speak of matters relating to the dead.
R. Ammi and R. Assi both say : [The man who needs help from his fellow-creatures] is as though he were sentenced to two penalties, viz., fire and water; as it is said, "Thou hast caused men to ride over our heads, we went through fire and water" (ibid. lxvi. 12).
That agrees with what R. Hiyya b. Ammi said in the name of 'Ulla : Since the day the Temple was destroyed, there is left to the Holy One, blessed be He, in His Universe the four cubits of Halakah alone.
And Abbai said ; At first I used to study at home and pray in Synagogue, but after hearing the statement of R. Hiyya b. Ammi in the name of 'Ulla — "Since the day the Temple was destroyed, there is left to the Holy One, blessed be He, in His Universe the four cubits of Halakah alone" I only pray where I study.
R. Ammi and R. Assi, although there were thirteen Synagogues in Tiberias, used to pray only between the pillars where they studied.
R. Hiyya b. Ammi said in the name of 'Ulla : Greater is he who enjoys the fruit of his labour than the fearer of Heaven ; for with regard to the fearer of Heaven it is written, "Happy is the man that feareth the Lord" (ibid. cxii. 1), but with regard to him who enjoys the fruit of his labour it is written, "When thou eatest the labour of thy hands, happy shalt thou be, and it shall be well with thee" (ibid, cxxviii. 2) — "happy shalt thou be" in this world, "and it shall be well with thee" in the world to come. It is not written, "and it shall be well with thee" about the fearer of Heaven.
R. Hiyya b. Ammi also said in the name of 'Ulla : A man should always reside in the same place as his teacher, for so long as Shimei the son of Gera lived, Solomon did not marry the daughter of Pharaoh.
Rab Huna b. Judah stated that R. Menahem said in the name of R. Ammi : What means that which is written, "They that forsake the Lord shall be consumed" (Is. i. 28)? This refers to one who leaves a Scroll of the Law [unrolled] and goes out [from the Synagogue].
Rab Huna b. Judah stated that R. Menahem said in the name of R. Ammi : A man should always finish his Parashah with the congregation, twice the Hebrew text and once the Targum —
"They let them have what they asked" (Exod. xii. 36). R. Ammi said : This teaches that they let them have what they asked against their will. Some explain : Against the will of the Egyptians; but others explain ; Against the will of the Israelites.
"And they despoiled Egypt" (Exod. xii. 36). R. Ammi said : This teaches that they made it like a fort without provisions, R. Simeon b. Lakish said : They made it like a pond without fish.
"I am that I am" (ibid. iii. 14). R. Ammi said: The Holy One, blessed be He, spake to Moses, "Go, say to the Israelites, I was with you in this servitude, and I will be with you in the servitude of the kingdoms."
But R. Zerika stated that R. Ammi said in the name of R. Simeon b. Lakish : It is "Who formest light." When Rab Isaac b. Joseph came [from Palestine], he said : The statement of R. Zerika was not explicitly made but was inferred ; for what R. Zerika stated that R. Ammi said in the name of R. Simeon b. Lakish was : This teaches that the benedictions do not invalidate one another.

[He asked of him] Ashyan, a Tanna of the school of R. Ammi, asked R. Ammi : May one who is undergoing a fast taste anything? If he has taken upon himself [to abstain from] eating and drinking, it comes under the heading of neither ; or is it that he has taken upon himself [to abstain from] any kind of gratification, and [tasting] is to be so regarded?

If he has taken upon himself [to abstain from] eating and drinking, it comes under the heading of neither ; or is it that he has taken upon himself [to abstain from] any kind of gratification, and [tasting] is to be so regarded?
R. Ammi and R. Assi tasted up to a fourth [of a log].
R. Ammi and R. Assi were once decorating the bridal-chamber for R.Eleazar. He said to them, "In the meanwhile I will go and listen to the teaching in the House of Study, and will come back and report it to you." He went and found a Tanna expounding in the presence of R. Johanan:
As the Rabbis departed from the school of R. Ammi (another version: R. Hannina's school), they said to him: Mayest thou see thy world in thy life-time, and may thine end be in the life of the world to come and thy hope throughout the generations. May thy heart meditate in understanding, thy mouth speak wisdom, thy tongue abound in joyful songs, thine eyelids set thy glance straight before thee, thine eyes be illumined with the light of the Torah, thy countenance shine like the splendour of the firmament, thy lips utter knowledge, thy reins exult with up-rightness, and thy feet run to hear the words of the Ancient of days.
Rab 'Awira expounded (sometimes he said it in the name of R. Ammi and sometimes in the name of R. Assi) : The ministering angels spake before the Holy One, blessed be He, "Lord of the universe ! It is written of Thee in Thy Torah, 'Who regardeth not persons nor taketh reward' (Deut. x. 17); but dost Thou not regard the person of Israel, for it is written, 'The Lord lift up His countenance upon thee' (Num. vi. 26)?" He replied to them, "And should I not regard the person of Israel, for whom I wrote in the Torah, 'And thou shalt eat and be satisfied and bless the Lord thy God' (Deut. viii. 10), but they are strict with themselves [and bless] even with a quantity of food equal in size to an olive or an egg?"
[This last-mentioned] supports the teaching of R. Joshua b. Levi : It is forbidden to pass in front of those who are saying the Tefillah. But it is not so, seeing that R. Assi and R. Ammi did so pass ! It was beyond a distance of four cubits that R. Ammi and R. Assi passed.
