Church Orders
Concerning the ordinance of the gift which is of the Apostles, according to the orthodox statement (lit. word). We have written concerning graces so far as God our Lord has granted to us of his own counsel. Formerly he gave grace (lit it) to man, while bringing near to him that which had gone astray in type; and now (he gave) the beloved Son who is in all the holy ones. Having come to the source of the proper tradition in the churches, we have attained that (men) should learn well what has been (received) until now; they handed them on and kept them as our ordinances: yet, though they knew that they were quite firm concerning that which had been found for them, now unawares they slipped away. And those indeed who knew not, (to them) the Holy Spirit is giving the perfection of grace. For them who believe rightly as they know, how seemly it is that they should hand on and keep those things which are established in the Church. Concerning the ordinance of baptism. Those who shall be baptised shall do thus (lit. thus it is). They shall come into the baptistery, and they shall give their names. And then first they shall examine their lives as to whether they are fit for baptism, and if they read the Scriptures, and also if they have learnt the psalm. And likewise there shall be sponsors for him who shall be baptised, and thus he who is sponsor shall know that he shall give account at the day of judgment for it And they shall cause therefore the prayer to follow after the examination, saying thus: [The prayer concerning those who gave their names] Lover of man and merciful author of blessing, merciful and whose habit is goodness, and the fountain of all blessing, thou who madest that which was not into that which was, with each one which was made thou gavest size and place: thou art able — remove it and take it away. Now, Lord, take away and remove this thy servant from wickedness into goodness. Grant that he may inherit the blessed sonship which is in the heavens, that he may then no longer be one born of flesh, but may abide truly in thine obedience: through thy only Son our Lord Jesus Christ, through whom to thee with him and with the Holy Spirit (be) glory and might now, etc. The prayer for those who gave their names. And again we beseech God the almighty, the Father of the Lord and our Saviour Jesus Christ, for those who gave their names, that he may open the ear of their heart and enlighten the eyes of their mind, and give to them the light of knowledge, he who has authority over mercy, the Lord our God And the deacon shall say: Pray ye for those who gave their names. And the bishop shall say: God the almighty, thou who calledst thy servants, who gave their names, from darkness into light, and from ignorance into the knowledge of the truth: blot out all the vestige of error from their thought; place thy law and thy commandment within their heart: and give to them knowledge which is seemly, impart to them, both men and women, the washing of regeneration for the forgiveness of sin; make them the temple of the Holy Spirit, through our Lord Christ, through whom to thee with him and with the Holy Spirit (be) glory and might now, etc. The prayer of consecration for those who bring the bread and water or oil to be blessed in the holy forty (days), after the examination of those who are to be baptised. God, my Lord Jesus Christ, lover of man, who alone hast made oblation. And thou knowest and to them indeed who are able thou speakest the greatness of the honour of the Father and of thy creation. Thou, the Mediator, the Chief Priest for every soul, and the healing for those who are suffering. Thou whose name is sanctified by the holy ones, may the power which enlightens thy name lighten upon the oil and water and bread, and make them to become safety and healing and purification for those who offered in faith, for thy name is restoration to us, and redemption, revelation, and sanctification. And to thee be glory and to thy holy Father now, etc. And he who comes to baptism shall learn the commandment as he receives (baptism): how seemly it is that he live carefully, as he to whom will be imparted the holy atonement of grace by eating. At early morning the bread and water shall be blessed, and he shall be anointed with the oil, until (the time) when shall be imparted that holy grace of baptism. When therefore he will come to baptism, he who will baptise him shall take him, and having turned him then to the west, with his right hand or both his hands outstretched, and his face opposite towards the east without fear — and if he was a full-grown man he shall speak: but for the children who cannot speak, and if it was a weak person, the believing father and believing mother shall speak, or relatives likewise (being) believing men and believing women. And he shall anathematise, being naked, in the water without fear, saying thus: [The first prayer for baptism, over the water] God, my Lord almighty, who madest heaven and earth and sea and all that is in them, who madest man in thine own form and likeness, who mingledst and unitedst the immortal with the mortal, who madest living man a combination of the two, and gavest to that which was made body a soul also, which thou causest to dwell within: iS stir this water and fill it up with thy Holy Spirit, that it may become water and Spirit for regeneration to those who are to be baptised: work a holy work and make them to become sons and daughters of thy holy name: wash them with water, and instruct them by the Holy Spirit, through the coming of our Lord Christ thy Son, through whom to thee with him be glory and might now and always and with the Holy Spirit for ever and ever. Amen. The prayer of the consecration of the water. Eternal iS God, who knowest what is secret, we pray and beseech thee, send thy Holy Spirit and his power upon this water and change it and sanctify it and bless it and set it against. all that opposes, cause it to be against all divination and potions, both those which are drunk, and those which are sprinkled, or (used) in any other way; cause it to be for healing and for life to him who shall receive of it in faith, and in the glory of thy only beloved Son, for to thee is glory and might with the Holy Spirit now, etc. The prayer for the holy waters of the Yurdanos, which are mingled with sweet scent. He therefore having come, changed our birth into the new (birth) which is by this water and Spirit of regeneration. And for this cause I call upon thee, my Lord, maker of all, who mingledst and unitedst mortal with immortal, having made living man a combination of the two, giving movement to the created body, and soul which thou causedst to dwell (in it): stir this water and fill it up with that which is of the Holy Spirit, that it may become water and also Spirit of regeneration to those who shall be baptised in it Cause, my Lord, that they may become little sons and daughters of the holy name; and purify them and wash them with water and instruct them with the Holy Spirit, through the coming of our Lord Christ with the Holy Spirit May it be to all who shall be baptised in it a washing of regeneration for cleansing from all sin. And prepare those whom the Holy Spirit chose, to come upon them; that (clothed) with incorruptible vesture they may rise at the resurrection of the dead; and may every evil spirit be removed from them, having been expelled according to thy holy infallible promise of our Lord Jesus Christ, through whom to thee with him and with the Holy Spirit (be) glory and might and greatness from before the age now and always and to generation of infinite generation, and to age of age. Amen. And then the priest shall go down into die water of the Yurdanos, taking hold o( the head of him who shall be baptised, and saying to him: I baptise thee in die name of the Father and the Son and die Holy Spirit, and at each of the names of the Holy Trinity, he who is baptised also saying Amen. And then having come up from the water, they who promise for him shall receive him, and he who was baptised shall find then a clean linen doth, that with it the water may be wiped off, and that he may be kept with great care. And if he who shall be baptised is weak, he shall stand up naked in the early morning as soon as one can see, and thus he who baptises shall pour water upon his head, saying: I baptise thee in the name of the Father and the Son and the Holy Spirit, and at each name of the Holy Trinity he pours forth once, and not afterwards as to alL' And after they have clothed him with the baptismal (robe), the Chief Priest shall make prayer for the men, and if not, the priest before the unction with the chrism of him who was thus sanctified. God, my Lord almighty, the Father of our Lord and our Saviour Jesus Christ, stretch out thy hand invisible upon the fruit of this olive with which thou anointedst the Priests and Prophets; and thou hast given power to it with thine own hand, that for those who shall be anointed therewith, it may be for healing and safety and benefit in all diseases and sicknesses, and for extermination of every Satanic adversary; make an unction by thine own grace, really for them to whom it is given, the Holy Spirit, through the name and through the power of our Lord Jesus Christ, through whom to thee with him and with the Holy Spirit (be) glory and might now, etc. And breathe on his face thrice. And they who stand by shall say: (We have them) with the Lord our God. And the bishop shall say: Let us give thanks to the Lord. And those shall say: Right and just, it is meet And then the Chief Priest, to whom alone it belongs to consecrate the chrism, having taken it, standing rightly, shall offer up the prayer and shall complete the invocation of the coming of the Holy Spirit, and say thus: Right it is and just. We praise thee and glorify thee and confess thee and worship thee and give thanks to thee for all the mercy which thou hast done for us and all thy benefit: when the world was gone astray thou savedst (it), having sent thine only Son, our Lord Jesus Christ, not to judge the world, but to save the world, and gather together our dispersion, that we may assemble, and confess thee the one true God who sentest our Lord Jesus Christ; through whom we offer this chrism which thou hast given to us for healing and for using in other necessities, that thou wilt be willing and wilt send the Holy Spirit upon it, through our Lord Jesus Christ; and that it may become an unction of holiness and seal of the Holy Spirit upon every person of those who receive the washing of regeneration and forgiveness, as far as thou hast given to them: and may it be to them redemption and sure grace and a holy seal of unction and communion of their nature with the Holy Spirit; and cause that they may be named (his) temple, through the name of our Lord and our Saviour Jesus Christ, through whom to thee with him and with the Holy Spirit (be) glory and might from before the age and unto the age, now, etc. The prayer of the holy oil, the oil with which he who is baptised is to be anointed on the place of anointing. My Lord, almighty, who wast to the Prophets God, and to the Apostles God, the Father of our Lord and our Saviour Jesus Christ, who from the beginning by the Prophets preachedst the coming of our Lord Christ, who sentest Yuhanes, the Prophet before his coming, give power to this holy oil and bless it for baptism, may it sanctify thy servants and handmaids and prepare them (lit. him) for thee, while they (lit. he) call upon thee; and cause it to destroy all poison and expel every evil and unclean spirit, and may all unclean lust remove away by this unction, through the name of thy only Son; and may it be sanctified by thine own grace, and be to all who are baptised oil of healing and safety and power for planting the good olive tree and for (bearing) fruit toward thee and to Christ, through the Holy Spirit, by the faith in the name of our Lord and our Saviour Jesus Christ, through whom to thee with him and with, etc. as And breathe into the oil thrice. Further (the prayer) for the laying hand upon the catechumens. God the almighty, the Father of the Lord and our Saviour Jesus Christ, to thee have humbled their heads thy servants the catechumens, and to thee they have subdued the hardness of heart and flesh, look down from thy worthy dwelling-place, bless them, male and female, and may thine ear hearken to them and hear their prayer. Give them to know the power of the word with which they are instructed as a sure utterance; and in due time impart to them, male and female, the washing of regeneration for the forgiveness of sin; make them the temple of the Holy Spirit through Christ: for to thee is glory and power and might, now, etc Concerning the oil of chrism for those who are baptised. And he who is sealed shall say: Amen. If it is a presbyter who baptises, let him take the chrism from the bishop, and anoint them after they have put on the baptismal (robe); and then he proceeds to pray, and having finished the prayer of the holy oil, they cause three little children to come near to him, and their elders likewise, and having turned them towards the west, first they shall anathematise Satan, saying thus: I anathematise thee, Satan, and all thy wicked angels and all thy work and all thy errors and all thy orders. And then turning himself again towards the east and stretching out his hands, he confesses God, saying: I believe in one God, the Father above all, almighty, and in the only Son, our Lord Jesus Christ, and in the Holy Spirit, and in the resurrection of the body, and in the holy assembly, the one Catholic Church. And then he shall say thrice: Amen. And he shall say thus stretching out his hands and humbling his head in fear, saying as he hears from him who baptises him thus, this. faith in the Trinity: I believe in thee, the Father of our Lord Jesus Christ, and in thine only Son Jesus Christ our Lord and our Saviour, and in the Holy Spirit, and in the resurrection of the body, and the holy, one. And if it was a man fully grown he shall speak: and concerning children who have no word or a dumb person or sick, the believing father and believing mother, or relatives knowing (them), being likewise believers, shall speak instead of that child or instead of him who has no word or instead of the sick, saying each of their names. And after the confession of faith he says thus: (The prayer) of the laying on of hand. My Lord almighty, the Father of our Lord and our Saviour Jesus Christ, to whom thy servants and handmaids have humbled themselves; and to thee they have subdued the hardness of heart and flesh, look down from the heaven thy sanctuary, stretch out thine invisible hand upon them. Lord of heaven and earth, who through thine only Son hast made known knowledge of thee in the earth, and hast prepared for them with a heavenly calling. And thus shall they be anointed with the holy oil on the place of unction, anoint his heart and his breast and on his back and on all his body, saying thus: May the unction of holy oil operate against every adversary and for the planting firmly of the faith in the good olive tree, the Catholic Church, and do good. And he who is anointed shall say: Amen. The prayer after the unction. Father of thine only Son Jesus Christ, the root which is not cut off, redeemer of the sold, cause not to remain any trace of the old state in those who are converted to thy faith; who are obeying thee. Cause that they may be in purity of soul, children of regeneration, those who share in thy grace; and impress upon them the living character, through thine only Son, through whom, etc And then the priest shall take him and go down into the Yurdanos and baptise him, and as he baptises him he shall look toward the east, (being) in the proper vestment And the clergy also standing in their orders, The presbyter shall first baptise the children, and further, the Chief Priest being down in the Yurdanos shall baptise, laying his hand upon him whom he baptises and saying thus: I baptise thee, N or M, in the name of the Father and the Son and the Holy Spirit. And he who is baptised shall say: Amen. And then after he has baptised he shall go forth to the Table as if for the Eucharist: and after they have prepared it (sc. the Table) for each, the bishops, presbyters, and deacons being present, the Chief Priest shall sanctify with the chrism, saying thus: The prayer of blessing and of laying hand on those who have been baptised, before the anointing with the chrism which has been sanctified, the bishop or the presbyter who baptised saying thus: Eternal God, almighty. Father of the Lord and our Saviour Jesus Christ, who hast regenerated us thy servants and thy handmaids by water and the Holy Spirit in the washing of regeneration which thou grantedst to them for the forgiveness of sin, send now upon them the Holy Spirit, the Comforter, that therefore he may impart to them an entering into thy heavenly kingdom, according to thy holy infallible promise, through our Lord and our Saviour Jesus Christ, through whom with him and with the Holy Spirit be glory and honour and might now, etc. And breathe thrice, and then anoint them with the holy chrism on the forehead and on his breast, saying to each one: The holy unction and the seal of the grace of the Holy Spirit. And he who is sealed shall say: Amen. And if it is a presbyter who baptises, let him take the chrism from the bishop and anoint them, after they have been clothed with the baptismal (robe). And then (comes) the order (lit. sequence) of the Presfora. The (prayer of) unction of oil which the Chief Priest consecrates for those who receive the washing, and for sick believers. God, my Lord, almighty, the Father of our Lord and our Saviour Jesus Christ, stretch out thine invisible hand upon the fruit of this olive with which thou anointedst the Priests and the Prophets; and thou hast given power with thy hand that it may become to those who shall be anointed with it for healing and benefit, and for every disease nd every sickness. Destroy every adversary, and make (it) the unction of thy grace for remission of sin to those to whom has been given the Holy Spirit, through the name and through the power of our Lord Jesus Christ, through whom to thee with him and with the Holy Spirit (be) glory and might from before the age now, etc. And breathe therefore thrice. Before the Presfora and after the departure of the catechumens there shall be prayer of three kinds, for peace one, for the congregation one, and for the Patriarch (papas) one. And then the deacon shall say with a loud voice: Those who are not admitted to communion depart And none of the catechumens shall stand here within. And further, the subdeacon shall open the doors; and further he shall say; Those who are not admitted to communion depart. And then further, the deacon shall say to the people: Kiss one another with a kiss of holiness. And then when they have severally given the salutation, the chief deacon shall say: Shut the doors, O subdeacons. This indeed as it was said at the prayer of the congregation. And if the bishop administers the baptism, or one ordained, he shall not say: There is not here a catechumen who is not one of the congregation, nor is there any adversary here. On the day alone on which they receive baptism, after the Presfora he shall offer the cup and the milk and honey with the bread and the cup of wine: and they shall bless (them) together, and those alone who receive for the first (time) shall receive of it And then the bishop shall say the thanksgiving of the milk: We give thanks to thee, God, almighty, the Father of our spirit, who hast begotten us again by water and the Spirit through Christ Jesus our Lord,: whom thou gavest. He instituted the holy washing (of baptism) for the forgiveness of sin to our race. Because we are thy flock which is in secret, born of the word, and we are nourished with the milk of nourishment of thy grace in the bosom of our holy mother by the voice of the consolations of the Holy Spirit And thou, O Lord, always hast given to us food and nourishment of thy sons, milking out the milk of life. According to the form and command of creation we offer to thee this milk and honey which flows from the holy Church, our mother, who caused us to grow by her breasts, which were sanctified by thee. O Lord, bless it with blessing and sanctify it with sanctifying, that it may become to them who partake of it incorruptible communion, nourishment and washing; let it be for instruction in thy fear and in soberness, and for measure of stature, because thine all honourable name has been glorified for ever and ever. Amen. And thou shalt give of his Body, and say: This is the Body of Christ. And he who receives shall say: Amen. And thou shalt give the cup, and say: This is the Blood of Christ And he who receives shall say: Amen and Amen. And afterwards thou shalt pray thus, having laid thy hand upon their head, and say: I bless thee, O Lord, because thou hast imparted to thy servants and thy handmaids the washing of regeneration for the forgiveness of sin, (and) that which is the grace of the Holy Spirit, the Body and Blood of Christ. We pray thee and we beseech thee, surround thy servants and thy handmaids with the power of thine Angels, and be to them protection by thy divinity, cause them to obtain the heavenly mystery, through our Lord Jesus Christ, through whom, etc. The ordinance of Baptism is finished.
The Writings of Origen
He next pours down upon us a heap of names, saying that he knows of the existence of certain Simonians who worship Helene, or Helenus, as their teacher, and are called Helenians. But it has escaped the notice of Celsus that the Simonians do not at all acknowledge Jesus to be the Son of God, but term Simon the “power” of God, regarding whom they relate certain marvellous stories, saying that he imagined that if he could become possessed of similar powers to those with which he believed Jesus to be endowed, he too would become as powerful among men as Jesus was amongst the multitude. But neither Celsus nor Simon could comprehend how Jesus, like a good husbandman of the word of God, was able to sow the greater part of Greece, and of barbarian lands, with His doctrine, and to fill these countries with words which transform the soul from all that is evil, and bring it back to the Creator of all things. Celsus knows, moreover, certain Marcellians, so called from Marcellina, and Harpocratians from Salome, and others who derive their name from Mariamne, and others again from Martha. We, however, who from a love of learning examine to the utmost of our ability not only the contents of Scripture, and the differences to which they give rise, but have also, from love to the truth, investigated as far as we could the opinions of philosophers, have never at any time met in with these sects. He makes mention also of the Marcionites, whose leader was Marcion.
The Book of the Bee
So also the blessed Diodorus, who says in the ‘ Book of the Dispensation V ‘A lasting reward, which is worthy of the justice of the Giver, is laid up for the good, in return for their labours; and torment for sinners, but not everlasting, that the immortality which is prepared for them may not be worthless. They must however be tormented for a short time, as they deserve, in proportion to the measure of their iniquity and wickedness, according to the amount of the wickedness of their deeds. This they will have to bear, that they suffer for a short time; but immortal and unending happiness is prepared for them. If it be then that the rewards of good deeds are as great (in proportion to them) as the times of the immortality which are prepared for them are longer than the times of the limited contests which take place in this world, the torments for many and great sins must be very much less than the greatness of mercy. So then it is not for the good only that the grace of the resurrection from the dead is intended, but also for the wicked; for the grace of God greatly honours the good, but chastises the wicked sparingly/ Again he says: ‘God pours out the wages of reward beyond the measure of the labours (wrought), and in the abundance of His goodness He lessens and diminishes the penalty of those who are to be tormented, and in His mercy He shortens and reduces the length of the time. But even thus He does not punish the whole time according to (the length of) the time of folly, seeing that He requites them far less than they deserve, just as He does the good beyond the measure and period (of their deserts); for the reward is everlasting. It has not been revealed whether the goodness of God wishes to punish without ceasing the blameworthy who have been found guilty of evil deeds (or not), as we have already said before.
The Mishnah
If a man was standing saying the tefillah and he remembers that he is one who has had a seminal emission, he should not stop but he should abbreviate [the blessings]. If he went down to immerse, if he is able to come up and cover himself and recite the Shema before the rising of the sun, he should go up and cover himself and recite, but if not he should cover himself with the water and recite. He should not cover himself either with foul water or with steeping water until he pours fresh water into it. How far should he remove himself from it and from excrement? Four cubits.
One who pours from jar to jar and three drops drip, he may place in it hullin. But if he inclined the jar [on its side] in order to drain it, it is terumah. How much terumat maaser of demai must there be for him to take it to the priest? One eighth of an eighth [of a log].
If a stone is on the mouth of a cask [of wine], one tilts it to its side and it falls off. If it [the cask] is [standing] among [other] casks, he lifts it up, tilts it on its side, and it falls off. If money is lying on a cushion, one shakes the cushion, and it falls off. If snot is on it, one wipes it off with a rag; If it is on leather, one pours water over it until it disappears.
[The priest] takes an earthenware bowl and pours half a log of water into it from the laver. Rabbi Judah says: a quarter [of a log]. Just as [Rabbi Judah] reduces the amount of writing, so he reduces the quantity of water. [Then the priest] enters the temple and turns to his right and there was a place there [on the floor] that was a cubit by a cubit, and a marble tablet, to which a ring was attached. When he would lift this up, he would take some dust from beneath it which he puts [into the bowl] so that it would be seen on top of the water; as it is said, “And of the dust that is on the floor of the Tabernacle the priest shall take, and put it into the water” (Numbers 5:17).
As for the bullocks which were burnt and the goats which were burnt, their slaughtering is [done] at the north, and the reception of their blood is [done] at the north, and their blood requires sprinkling on the veil, and on the golden altar; [The omission of] a single one of these applications invalidates [the sacrifice]. He [the priest] pours the remainder of the blood on the western base of the altar; but if he did not pour it out, he did not invalidate [the sacrifice]. Both of these were burnt at the ash pit.
“Before time” applies both to [the animal] itself and to its owner. What is “before time” as applied to its owner? If a zav or a zavah, a woman after childbirth, or a metzora, offered their hatat or their asham outside [before the time in which they were obligated], they are exempt; [If they offered] their olah or their shelamims outside [before their time], they are liable. One who offers up flesh of a hatat, or flesh of an asham, or flesh of most holy sacrifices, or flesh of less holy sacrifices; or the remainder of the omer, or the two loaves, or the showbread, or the remainder of meal-offerings; Or if he pours [the oil on to the meal-offering], or mingles [it with flour], or breaks up [the meal-offering cakes], or salts [the meal-offering], or waves it, or presents it; or sets the table [with the showbread], or trims the lamps, or takes out the fistful, or receives the blood; [If he does any of these] outside, he is exempt. One is also not liable for any of these acts on account of not being a priest, or uncleanness, or lack of [priestly] vestments, or the non-washing of hands and feet.
One who puts the jar away in order that it shall not be broken, or if he inverted it in order to dry it, [If he did one of these things] so that he might draw more water with it, [the water he had already drawn] is valid; But if he intended to carry in it the ashes, it is invalid. One who cleared potsherds from a trough: If in order that it may hold more water, the water is valid; But if he intended that they should not hinder him when he pours out the water, it is invalid.
One who pours hot water into hot water, or cold water into cold water, or hot water [poured] into cold water remains clean; But from cold water into hot water, the [cold water] becomes unclean. Rabbi Shimon says: even in the case of hot water poured into hot water it becomes unclean if the strength of the heat of the lower [water] is greater than that of the upper [water].
If he poured water over one of his hands with a single rinsing his hand becomes clean. If over both his hands with a single rinsing: Rabbi Meir declares them to be unclean until he pours a minimum of a quarter of a log of water over them. If a loaf of terumah fell on the water the loaf is clean. Rabbi Yose declares it to be unclean.
The Jerusalem Talmud
Rebbi Joshua ben Levi said: They learned prayers from the patriarchs. Morning prayer from our father Abraham (Gen. 19:27): “Abraham got up early to the place where he had stood there in the presence of the Eternal.” Standing means praying, as it says (Ps. 106:30) “Phineas stood and prayed.” Minḥah prayers from our father Isaac. (Gen. 24:63) “Isaac went out to speak on the field.” Speaking means praying, as it says (Ps. 102:1) “A prayer of the deprived one when he faints and pours out his speech before the Eternal.” Evening prayer from our father Jacob. (Gen. 28:11) “He entreated at the Place.” Entreaty means prayer, as it is said (Jer. 27:18) “Please, let them entreat the Eternal of hosts.” And it says (Jer. 7:16): “Do not lift for them (your voice in) a cry and do not entreat me.”
Some Tannaïm have stated: One should first pray and then ask for one’s personal needs. Some Tannaïm have stated: One should first ask for one’s personal needs and then pray. He who says, one should first pray and then ask for one’s personal needs (Ps. 102:1) “Prayer of the deprived one who wraps himself up” and afterwards “and before the Eternal he pours out his speech.” But he who says, one should first ask for one’s personal needs and then pray, (1Kings 8:28) “To listen to lamentation” and after that “and to prayer.” The opinion of the sages: Rebbi Zeïra in the name of Rav Ḥuna, the private person asks for his personal needs in “He Who hears prayer”.
HALAKHAH: Rebbi Yudan bar Pazi and Rebbi Ayvo bar Naggari were sitting and saying: We did state “after they conceded”; who conceded to whom? The House of Shammai to the House of Hillel or the House of Hillel to the House of Shammai? They said, let us go out and study. The went out and heard Rebbi Ḥizqiah, Rebbi Aḥa in the name of Rebbi Jehudah bar Ḥanina: We never find the House of Shammai conceding to the House of Hillel except in this matter. Rebbi Jonah in the name of Rebbi Abbai understood it from the following: “If someone pours from vessel to vessel and a ṭevul yom touches it, it should be lifted by 101.” If you say that the House of Hillel conceded to the House of Shammai that it cannot be lifted, who is the Tanna here, neither the House of Shammai nor the House of Hillel! Rebbi Ḥanina the son of Rebbi Hillel said, we might say that the House of Hillel stated that before they conceded. Rebbi Yose said, the Mishnah said so: “After they conceded, Rebbi Eliezer said it should be lifted and burned”, and is Rebbi Eliezer not a follower of Shammai? Rebbi Ḥinena said, the Mishnah said so, after they conceded one to another, the House of Shammai recused themselves and the others teach us. Rebbi Abin says, there is another answer, following what Rebbi Hoshaia stated: Since pure [heave], which for outsiders is forbidden as deadly sin, can be lifted, certainly also impure [heave] which is [prohibited] as positive commandment for Cohanim.
MISHNAH: The seeds of heave, as long as they are collected, are forbidden but if they are thrown away they are permitted. And so bones of sacrifices, as long as they are collected, are forbidden but if they are thrown away they are permitted. Coarse bran is permitted; fine bran of new grain is forbidden, of old it is permitted. One treats heave as one treats profane food. If one makes fine flour, one or two qab from a seah, he should not throw away the remainder but put it down in a hidden place. If someone removed heave wheat from a chest, one does not oblige him to sit down and pick out the last grains but he sweeps it as usual and then fills it with profane grain. Similarly, if someone empties an amphora of oil, one does not oblige him to sit down and clean it with his fingers but he treats it as he treats profane vessels. If one pours from pitcher to pitcher one lets drip three drops and then may fill it with profane [wine]. If he turned it and it accumulated, that is heave. How much should heave of the tithe of demay be that he is required to deliver it to a Cohen? An eighth of an eighth.
MISHNAH: He who makes after-wine and pours in a measured amount of water, if he found the same amount he is free. Rebbi Jehudah declares him obligated. If he found more than his measure he gives proportionally from another place. The holes of ants which were near an obligated heap overnight are obligated since it is obvious that they were dragging from what was processed all night. Baalbek garlic, Rikhpa onion, Cilician grits, and Egyptian lentils, Rebbi Meïr says also colocasia, Rebbi Yose says also qrṭnym are free from tithes and may be bought from everybody during the Sabbatical. The seed of the upper part of arum, the seeds of leeks, seeds of onions, seeds of turnips and radishes, and other garden seeds which are not eaten are free from tithes and may be bought from everybody during the Sabbatical and these may be eaten if their father was heave.
HALAKHAH: Rebbi Abbahu said, sometimes in the name of Rebbi Eleazar, sometimes in the name of Rebbi Yose ben Ḥanina: Only if it fermented. There, we have stated: “After-wine before it fermented cannot be bought with money of [Second] Tithe or make a miqweh invalid; after it fermented it may be bought with money of [Second] Tithe and does not make a miqweh invalid.” That Mishnah is Rebbi Jehudah’s since we stated: “He who makes after-wine and pours in a measured amount of water, if he found the same amount he is free. Rebbi Jehudah declares him obligated.” Rebbi Abbahu said, sometimes in the name of Rebbi Eleazar, sometimes in the name of Rebbi Yose ben Ḥanina: Only if it fermented. Rebbi Yose said, it is the opinion of everybody since even salt water may be bought with money of [Second] Tithe.
“Afterwine before it fermented cannot be bought with tithe money and invalidates a miqweh; after it fermented it may be bought with tithe money and does not invalidate a miqweh.” Our Mishnah follows Rebbi Jehudah as we have stated there: “If someone makes after-wine and pours in a measured amount of water, if he found the same amount he is free. Rebbi Jehudah declares him obligated.” Rebbi Abbahu said, sometimes in the name of Rebbi Eleazar, sometimes in the name of Rebbi Yose ben Ḥanina: Only if it fermented. Rebbi Yose said, it is the opinion of everybody since even salt water may be bought with tithe money.
If they are impure by the impurity of the dead, for no clay vessel becomes impure from its back. But if they are impure by the impurity of flux, since the impure from flux makes impure by carrying, this cannot be the case unless one [other person] pours. But if one [other] pours, even if they are impure by the impurity of flux.
MISHNAH: If what was bought with tithe money became impure, it should be redeemed. Rebbi Jehudah says, it should be buried. They said to Rebbi Jehudah, if original Second Tithe which became impure is redeemed, what was bought with tithe money and became impure certainly should be redeemed. He said to them, no! If you said about original Second Tithe, which can be redeemed when it is pure and far from the Place, can you say the same about what was bought with tithe money which cannot be redeemed when it is pure and far from the Place? If a deer bought with tithe money died, it should be buried in its hide. Rebbi Simeon says, it should be redeemed. If he bought it alive and slaughtered it, if it became impure it should be redeemed. Rebbi Yose said, it should be buried. If he bought it slaughtered and it became impure, he treats it following the rules of produce. If somebody lends flasks for Second Tithe, even if he closed the top with clay, tithe did not acquire it. If he filled them without saying anything, before he closed the top with clay, tithe did not acquire it; after he closed the top with clay, tithe acquired it. Before he closed the top with clay, one may lift by 101, after he closed the top with clay any one sanctifies. Before he closed the top with clay, he gives heave from one for all, after he closed the top with clay he has to give heave from each single one. The House of Shammai say, he opens and pours into a vat, but the House of Hillel say, he opens and does not have to pour. Where has this been said? At a place where usually one sells sealed, but at a place where usually one sells open, the flask did not become profane. However, if he is meticulous to sell by volume, the flask did become profane. Rebbi Simeon said, also if somebody says to another person, I am selling to you this amphora except its flask, the flask became profane.
He shall write, not engrave. And he shall write, not dropping points. He shall write, not pouring. He shall write, not engrave; some Tannaïm state, he even may engrave. Rab Ḥisda said, he who says not to engrave, if the writing stands out as on a denar. He who says even to engrave, as on a writing tablet. And he shall write, not dropping points; Rebbi Yudan ben Rebbi Shalom and Rebbi Mattaniah: One said, if he did not connect the points; the other said, even if he connected the points. And he shall write, not pouring. Rebbi Ḥiyya bar Abba said, those Orientals are very sophisticated. If one of them wants to write a secret letter to another, he writes with juice of gall-nuts. The recipient pours ink without gall over it, which is absorbed at the place of writing. If one did that on the Sabbath, what? Rebbi Joḥanan and Rebbi Simeon ben Laqish both said, only if he wrote ink on ink and vermilion on vermilion. But if he wrote ink on vermilion or vermilion on ink, he is liable. Rebbi Isaac bar Mesharshia in the name of the rabbis there: He is liable twice, for erasing and for writing.
MISHNAH: An amphora covered by a stone: one tilts it and the stone falls down. If it was between amphoras one lifts it, tilts it and the stone falls down. Coins on a pillow: one shakes the pillow and they fall down. If chicken droppings were on it, one cleans it with a rag. If it was of leather, one pours water on it until it disappears.
It was stated: Rebbi Ḥanania ben Aqabia says, if a balcony protrudes over the sea, one opens the floor covering, lowers down, and fills. Rebbi Jacob bar Aḥa in the name of Rebbi Yasa: Only if the hole is four hand-breadths long, and only if it is four hand-breadths wide, and if the walls are ten hand-breadths high. There they are saying, even if the partitions are not ten hand-breadths high it is made like a funnel. Rebbi Idi said before Rebbi Ḥiyya: One is permitted to fill but forbidden to pour out. He said to him, when we will ordain Sages, we shall ordain you with them. Rebbi Mana said, he shouted at him. Rebbi Yose ben Rebbi Bun said, did he not say to him that one is permitted to fill, since he fills inside his partition, but forbidden to pour out, for he pours outside of his partition?
Rebbi Simeion ben Laqish in the name of Levi from Sokho: If he pours from vessel to vessel. For if it were otherwise, would Rebbi Jehudah follow his own opinion, as Rebbi Jehudah said, fluid to wet?
“Water used by a baker has to be poured out because it makes leavened.” There are Tannaim who state, he pours it into a depression. There are Tannaim who state, he pours it into a declivity. Rebbi Yose said, he who said, he pours it into a depression, if the depression was large. He who said, he pours it into a declivity, if the declivity was consierable. Rebbi Phineas said to him in the name of Rebbi Ila: So was he discussing it: If he soaked wheat or barley grains in water, if they became leavened, they are forbidden; if they did not become leavened, they are permitted. Rebbi Yose said, if he soaked barley in water, if they split they are forbidden. If he soaked them in vinegar they are permitted since the vinegar contracts them.

HALAKHAH: From where that one who slaughters the Pesaḥ on leavened matter transgresses a prohibition? The verse says, do not slaughter on leavened matter the blood of My sacrifice. I have not only the slaughterer, from where the one who pours the blood? The verse says, not on leavened matter the blood. Rebbi Samuel bar Rav Isaac said, since he becomes guilty for pouring, this implies that the Pesaḥ be qualified. Rebbi Yose said, explain it that leavened matter came to him between slaughter and pouring or that one person was slaughtering and another pouring.
MISHNAH: The Israel slaughters and the Cohen receives; he hands it to his colleague and the colleague to his colleague; he accepts the full [cup] and returns the empty one. The Cohen standing next to the altar pours it in one pouring in the direction of the foundations.
MISHNAH: If the meat became impure while the fat is unchanged, he does not pour the blood. If the fat became impure while the meat is unchanged, he pours the blood. With sacrifices it is not so, but even if the meat became impure while the fat is unchanged, he pours the blood.
MISHNAH: If the meat became impure while the fat is unchanged, he does not pour the blood. If the fat became impure while the meat is unchanged, he pours the blood. With sacrifices it is not so, but even if the meat became impure while the fat is unchanged, he pours the blood.
The following is obvious: If the meat became impure but the parts are unchanged, one pours the blood for [the parts. If the parts became impure and the meat is unchanged, one pours the blood for] the meat. If the meat became impure and the parts were lost, Rebbi Shammai said, is the (existing) [fistful] not as if the meat became impure and the parts were lost? You are saying that he takes the fistful; also here he pours. Rebbi [Mana] said, explain it following Rebbi Eliezer, since Rebbi Eliezer says, even if there is no remainder there is a fistful.

Rebbi Joḥanan said, if he dedicated a Pesaḥ before he converted and then converted, before he was manumitted and then was manumitted, before he grew two pubic hairs and then grew two pubic hairs, has to subscribe to another Pesaḥ. Rebbi Yudan said, all doubts follow Rebbi Nathan, except for him who pours the blood of his purification offering or the blood of his reparation offering when there is a doubt whether he poured during nighttime or poured during daytime, where there is a doubt of atonement, and every doubt of atonement atones.
MISHNAH: All seven days he pours the blood, and burns the incense, and cleans the lights, and brings head and feet to the altar. On any other day, if he wants to sacrifice he sacrifices since the High Priest is first in line to sacrifice his part and to take his part.
MISHNAH: The second lottery: Who slaughters, who pours, who removes the ashes from the interior altar, who cleans the candelabrum, and who brings the parts to the ramp: head and leg, the two front legs, spine and leg, breast and fat, two side pieces, and the intestines, and the fine flour, and the pan-baked breads, and the wine. Thirteen Cohanim won here. Ben Azzai said before Rebbi Aqiba in the name of Rebbi Joshua, it was brought in the way of its walking.
MISHNAH: The incense in the morning was brought between blood and limbs; in the evening it was brought between limbs and libations. If the High Priest was old or asthenic, one heats water for him and pours into the cold water to mitigate its coldness.
MISHNAH: On all of them he gives from bottom to top except the one he is standing in front of, where he gives from top to bottom. He sprinkles on the surface of the altar seven times. The rest of the blood he poured on the Western base of the outer altar; those of the outer altar one pours on the southern base. This and that combine in the water canal and leave towards the Kidron valley where it is sold to gardeners as fertilizer; one commits larceny with it.
MISHNAH: A person suffering from boulimy one feeds even impure food until his eyes light up. One does not feed the cover of a rabid dog’s liver to a person bitten by a rabid dog, but Rebbi Matthew ben Ḥarash permits it. In addition, Rebbi Matthew ben Ḥarash said, if somebody suffers from throat ache, one pours him medicine into it since it is an uncertainty of a danger to life, since any uncertainty of a danger to life pushes the Šabbath aside. If a wall collapsed over somebody, it is uncertain whether he is there or not, whether he is alive or dead, whether he is a Gentile or a Jew, one digs him out. If one finds him alive, one digs him out, if dead one shall leave him.
Rebbi Yudan bar Pazi and Rebbi Ayvo bar Naggari were sitting and saying: We did state “after they conceded“; who conceded to whom? The House of Shammai to the House of Hillel or the House of Hillel to the House of Shammai? They said, let us go out and study. The went out and heard Rebbi Ḥizqiah, Rebbi Aḥa in the name of Rebbi Jehudah ben Levi. We never find the House of (Hillel) [Shammai] conceding to the House of (Shammai) [Hillel] except in this matter. Rebbi Ḥunah in the name of Rav Abbaia: The Mishnah says so. “If someone pours from vessel to vessel and a ṭevul yom touches it, it should be lifted by 101.” If you say that the House of Hillel conceded to the House of Shammai that it cannot be lifted, who is the Tanna here, neither the House of Shammai nor the House of Hillel! Rebbi Idi said, we might say that the House of Hillel stated this before they conceded. Rebbi Yose said, the Mishnah said so: “After they conceded, Rebbi Eliezer said it should be lifted and burned,” and is Rebbi Eliezer not a follower of Shammai? Rebbi Ḥinena said, the Mishnah said so, after they conceded one to another that it should be lifted, the House of Shammai recused themselves and the others agree with us. Rebbi Abun says, there is another answer, following what Rebbi Hoshaia stated: Since pure {heave}, which for outsiders is forbidden as deadly sin, can be lifted, certainly also impure {heave} which is {prohibited} as positive commandment for Cohanim.
There, we have stated: “Rebbi Eleazar says, also one who pours a libation of water on Tabernacles outside of the Temple is liable.” Rebbi Joḥanan said, the entire system of Rebbi Eleazar is the system of his teacher Rebbi Aqiba. Just as Rebbi Aqiba said, the water libation is a word from the Torah, so Rebbi Eleazar is saying, the water libation is a word from the Torah. There are Tannaim who state in the name of Rebbi Eleazar, it is necessary that the filling be for the holiday; there are Tannaim who state in the name of Rebbi Eleazar, it is not necessary that the filling be for the holiday. He who said, it is necessary that the filling be for the holiday, Rebbi Eleazar following Rebbi Aqiba; he who said, it is not necessary that the filling be for the holiday, Rebbi Eleazar following the rabbis. This you cannot say since Rebbi Joḥanan said, the entire system of Rebbi Eleazar is the system of his teacher Rebbi Aqiba. Just as Rebbi Aqiba said, the water libation is a word from the Torah, so Rebbi Eleazar is saying, the water libation is a word from the Torah. What is the difference between them? Rebbi Ze`ira said, only if he poured three log inside and three log outside. There are Tannaim who state, there is prescribed measure; there are Tannaim who state, there is no prescribed measure. He who said that there is prescribed measure, not liable; he who said there is no prescribed measure, liable.
It was stated: “One puts a vessel under a leak on the Sabbath. If it was filled, one pours out and repeats without hesitation.” Rebbi Ḥanania said, they made this like rivers and sources coming from outside the Sabbath domain, as it was stated: from rivers and sources coming from outside the Sabbath domain one fills on the Sabbath and it is not necessary to say on a holiday.
Rebbi Samuel bar Naḥman in the name of Rebbi Joḥanan: Where do they disagree? About a wine barrel. But about an oil barrel everybody agrees that he does not finish. What does he do? Rebbi Ḥiyya stated, he pours it out. Bar Qappara stated, he breaks it. However Rebbi Ḥalaphta ben Shaul stated, he leaves it for the next holiday.
“The one whose urethra is cut off, anyone whose penis is cut, but he is qualified if there is a thread’s [breath] left of the corona,” etc. Rebbi Yose in the name of Rebbi Ḥanina: Of the upper side of the corona. Rebbi Ḥiyya in the name of Rebbi Ḥanina: Of the lower side of the corona. Rebbi Joshua ben Levi said, of the lower side of the corona. There, they said, if it has the shape of a drainpipe, he is qualified. Rebbi Hila in the name of Rebbi Joḥanan, if it has the shape of a writing reed, he is qualified, of an inverted writing reed, he is disqualified. If it is punctured, from the inside he is disqualified, from the outside he is qualified. Rebbi Abba in the name of Rav Jehudah, “inside” [means] from the corona towards the body; “outside” [means] from the corona away from the body. If it is punctured, he is disqualified; if it became blocked, he is qualified. If [the urethra] is punctured, he is disqualified, because it pours out; if it became blocked, he is qualified because he can be fertile. That is a disqualification which can revert to a qualification. The only difference between one injured in his lower parts and one whose testicles are injured are medical rules since an injured testicle may heal, an injured urethra does not heal. What can he do? Rebbi Jacob bar Aḥa in the name of Rav Jehudah: He brings ants, lets them bite, and cuts them off.
It was stated in the name of Rebbi Meïr: Just as there are opinions in eating and drinking, so opinions are [varied] among men. There is a man, if a fly falls into his cup, he takes it out, throws it away and drinks. That is like a normal man who sees his wife talking to her neighbors and relatives. Or you have a man who if a fly flies over his cup, takes it, pours [the contents] out, and does not taste them. That is a bad human attitude because he thinks of divorcing her. Or you have a man who, if a fly sits on his cup, takes it and leaves [the cup] untouched. That is Pappos ben Jehudah who locked his wife in. They said to him, did your forefathers behave like this? Or you have a man who finds a dead fly in his cup, takes it, licks it, and drinks. That is the wicked one who sees that his wife is overbearing with her slaves and slave-girls, where he would be commanded to divorce her, as it is said: “She left his house and went and married another man.” The verse called him other because he is not of the class of the first who expelled his wife because of a sexual transgression and the other one stumbled over her. If Heaven gives him credit, he will divorce her; otherwise, at the end she will bury him as it is said, “or if the latter man dies.” That man deserves to die since he brought that woman into his house.
HALAKHAH: “One writes with anything,” etc. “He shall write”, not engrave. “He shall write”, not dropping points. “He shall write”, not pouring. “He shall write”, not engrave; some Tannaïm state, he even may engrave. Rav Ḥisda said, he who says not to engrave, if the writing stands out as on a denar. He who says even to engrave, as on a writing tablet. “He shall write”, not dropping points; Rebbi Yudan bar Shalom and Rebbi Mattaniah: One said, if he did not connect the points; the other said, even if he connected the points. “He shall write”, not pouring. Rebbi Ḥiyya bar Abba said, those Orientals are very sophisticated. If one of them wants to write a secret letter to another, he writes with juice of gall-nuts. The recipient pours ink without gall over it, which is absorbed at the place of the writing. If one did that on the Sabbath, what? There, we have stated: “Writing on top of writing is not prosecutable.” Rebbi Joḥanan and Rebbi Simeon ben Laqish both said, only if he wrote ink on ink or vermilion on vermilion. But if he wrote ink on vermilion or vermilion on ink, he is guilty. Rebbi Isaac bar Mesharshia in the name of the rabbis from there: He is doubly guilty, once for erasing and once for writing.
MISHNAH: He who pours out water in the public domain is liable for the damage if another person is hurt because of this. He who puts away a thorn, or glass, or who fences his fence with thorns, or [owns] a fence which collapsed into the public domain, is liable for the damage if other persons are hurt because of this.
HALAKHAH: “He who pours out water in the public domain,” etc. Rav Huna said, when he was falling to the ground. But if his garments were dirtied, one is liable. Rav said, even if his garments were dirtied, he is not liable. The word of Rav implies one is not liable for ‘pit’ damages of vessels.
MISHNAH: If somebody sells his wine to a Non-Jew, in case he fixed the price before that one measured, the proceeds are permitted; if that one measured before he fixed the price, the proceeds are forbidden. If he took the funnel and measured into a Non-Jew’s vessel, then took it and measured into the vessel of a Jew, if it is contaminated with wine it is forbidden. If somebody pours from a vessel to another, what is poured from is permitted, what is poured into is forbidden.
The following is obvious: If the Jew holds the funnel and the Gentile pours, everybody agrees that is it forbidden. If the Gentile holds the funnel and the Jew pours, Rebbi Assi forbids and Rebbi Immi permits. If the Gentile holds the opening of the wineskin and the Jew pours, Rebbi Jeremiah in the name of Rebbi Ze`ira: this is the disagreement. Rebbi Mana asked before Rebbi Yose, which disagreement? He told him, the disasgreement between Rebbi Assi and Rebbi Immi. If the Jew holds the wineskin and the Gentile pours, they wanted to say that according to everybody it is permitted. Rebbi Samuel: In itself it implies that it is forbidden. For sometimes the Jew will loosen his grip and then the entire pouring is done by the Gentile. If somebody lets down a wineskin from top to bottom this is not pouring from vessel to vessel.

“Like earth water, from the valley of Bet Kerem on which water was poured.” Rebbi Ḥanina and Rebbi Jonathan both say one pours the water on a piece of cloth.

'Abahu further said: The first rainfall is satisfactory if there is enough of it to enter the ground to the depth of a handbreadth; the second is satisfactory when the soil is fit to be used for sealing the mouth of a cask. R. Ḥisda said: If there is rainfall enough to make the soil fit to be used for sealing the mouth of a cask, the verse in Deuteronomy (11.17): "He will shut up (the heavens)," etc., has no application. R. Ḥisda further said: If rain fell before the reading of the verse just mentioned in the Shema', the verse in question no longer has application. Said 'Abbayi, this applies to the Shema' read in the evening, but if rain falls before the reading of the Shema' in the morning, the verse in question still has application, for R. Samuel, son of R. Isaac, said (Berakot, 59a): Those morning clouds have no real value, as it is written (Hos., 6.4): "Your goodness is as a morning cloud, and as the dew that early passeth away." Said R. Papa to 'Abbayi: But do not people say: "If there is rain at the opening of the doors (in the morning)—lay down thy bag, O ass-driver, and sleep"? That is no contradiction, for the proverb refers to a case when the rain pours down from a heavy cloud, while R. Samuel refers to a case when the rain comes from a light cloud.
R Elazar further said in the name of R. Hanina: Come and observe that the way of the Holy One, blessed be He, is not like the way of flesh and blood — The way of flesh and blood is that a man places a pot on the fire and then pours water into it, but God first puts in the water and then sets the pot, to fulfil what is written, “At the sound of his giving a multitude of waters in the heavens” (Jeremiah 10:13).
