The Jerusalem Talmud

Jerusalem Talmud Yevamot 1:6

Does Abba Shaul hold with Rebbi Aqiba? Since Rebbi Aqiba said, there exists a bastard from a sister-in-law! What Rebbi Aqiba said refers to a sister-in-law who whored. What Abba Shaul said refers to his sister-in-law. It comes like Rebbi Yose ben Ḥalaphta since Rebbi Yose ben Ḥalaphta contracted a levirate marriage with his brother’s wife. He ploughed five times and planted five saplings and had intercourse using a bedsheet. These are they: Rebbi Ismael ben Rebbi Yose, Rebbi Eleazar ben Rebbi Yose, Rebbi Menaḥem ben Rebbi Yose, and Rebbi Ḥalaphta ben Rebbi Yose, Rebbi Eudaimon ben Rebbi Yose.

Jerusalem Talmud Yevamot 3:6

It was stated: “Abba Shaul says, the House of Hillel made this easy.” Is that a criticism? It is a praise, since people were saying, what is the prohibition here? It was found stated in the name of Rebbi Simeon: “If they jumped the gun and married, they should keep them.” But that is only if they had intercourse at the same time. In the opinion of Abba Shaul it is permitted to have intercourse without asking. In the opinion of Rebbi Simeon only if he transgressed and had intercourse. If the first [brother] married and had intercourse, he tells the second also to have intercourse. If that one did not have intercourse, the first [brother] is forbidden to have intercourse a second time; maybe one of them will die and it turns out that he had intercourse with the sister of his sister-in-law. It was stated: If the second [brother] died, the first one had to divorce his wife with a bill of divorce and his brother’s wife by ḥalîṣah. Even if the second one died? Does this not follow Rebbi Simeon? But Rebbi Simeon frees the second [sister] from ḥalîṣah and levirate! Rebbi Ze‘ira said, I confirmed this: Any sister-in-law who was to be freed by ḥalîṣah will never be permitted without ḥalîṣah.

Jerusalem Talmud Sotah 1:53

It is written: “No man in Israel was beautiful like Absalom, to be very much praised.” I could think, in everything. The verse says, “from his foot sole to the top of his forehead”. It is written: “He had a son whose name was Saul, select and good, no one of the Children of Israel was better than he.” I could think, in everything. The verse says, “from his shoulder on he was higher than all the people.” But about Abner, what is written? “You should know that a leader and great man fell today in Israel.” Why was Abner killed? Rebbi Joshua ben Levi, Rebbi Simeon ben Laqish, and the rabbis. Rebbi Joshua ben Levi said, because he made fun of the lives of his squires as it is said (2Sam. 2:14): “Let the squires get up and play before us.” R. Simeon ben Laqish said, because he prefaced his name before that of David; that is what is written (2Sam. 3:12) “Abner sent messengers to David the underling, saying: Whose is the land?” He wrote: From Abner to David. The rabbis say, because he did not let Shaul make peace with David. That is what is written (1Sam. 24:5): “My father, see, but see the corner of your coat in my hand!” He said to him, what do you want from the prattling of this one, it was torn off by thorns. But when they came to the circle, he said to him (1Sam. 26:14): “Can you answer, Abner?” About the corner, you said it was torn off by a thorn; were spear and pitcher cut off by a thorn? But some say, because he had it in his power to intervene for Nob, the city of priests, and he did not intervene.

Jerusalem Talmud Ketubot 1:28

Did they disagree that a virgin who had sexual relations with an underage boy or with someone who is not a man is enabled for the priesthood? Rebbi Ḥalaphta ben Shaul said, she is enabled even for the High Priest.

Jerusalem Talmud Ketubot 2:7

“Rebbi Joḥanan ben Beroqa says, the distribution of roasted kernels also is proof.” Should one not worry that she was a virgin after final marriage? That means, for a virgin after final marriage one does not distribute roasted kernels. It was stated: Abba Shaul says, also if one brought before her an amphora of good news. Should one not worry that she was a virgin after final marriage? That means, in front of a virgin after final marriage one does not bring an amphora of good news.

Jerusalem Talmud Nedarim 6:15

MISHNAH: If somebody vows not to drink milk, he is permitted curd but Rebbi Yose forbids. But from curd, he is permitted milk. Abba Shaul says, if he vows not to have cheese, it is forbidden to him whether salted or unsalted.

Jerusalem Talmud Gittin 4:16

Rebbi Simon in the name of Rebbi Joshua ben Levi: Yossi ben Shaul said in the name of Rebbi: A person who had given up hope to recover his slave is not entitled to enslave him but has to write him a bill of manumission. Rebbi Joḥanan heard this and said, Rebbi Joshua ben Levi taught us that correctly. Did they not infer the rules of a bill of manumission from women? Just as a woman is not freed if [the husband] has given up hope, but she needs a bill of divorce from him, so a slave is not freed if [the master] has given up hope, but he needs a bill of manumission.

Jerusalem Talmud Gittin 4:19

If a convert died and Jews plundered his property, if there were slaves, either adult or underage, they gain their freedom. Abba Shaul said, the adults gain their freedom, the minors do not become free. Why? They are no longer property after their owner’s death. Then even adults? Rebbi Abba said, since adults are competent to acquire themselves, they gain their freedom. Minors, who are not competent to acquire for themselves, do not gain their freedom. Rebbi Joshua ben Levi said, practice follows Abba Shaul. The opinions of Rebbi Joshua ben Levi are contradictory. There, Rebbi Simon in the name of Rebbi Joshua ben Levi and Rebbi Yossi ben Shaul in the name of Rebbi said: A person who has given up hope to recover his slave is not entitled to enslave him. They said, what Rebbi Joshua said about enslaving, if he did not give, he did not give; perhaps practice would be to enslave him, therefore he has to write him a bill of manumission. And here, he says so! We heard that Rebbi Joḥanan said, Rebbi Joshua ben Levi taught us that correctly, perhaps practice follows Abba Shaul. The slave girl of Rabba bar Zuṭra ran away and he gave up hope to recover her. He went to ask Rebbi Ḥanina and Rebbi Joshua ben Levi. They said, he is not entitled to enslave her. How is it to write her a bill of manumission? They said to him, if you wrote, you did the right thing. Rebbi Ḥanina in the name of Rebbi Ismael ben Rebbi Yose: A slave who married as a free person in the presence of his master gained his freedom. Rebbi Joḥanan said, yesterday I was sitting and formulating: If somebody writes a document of preliminary marriage for his slave or a document of definitive marriage for his girl slave, Rebbi says, they acquired, but the Sages say, they did not acquire. The first Tanna follows Rebbi: he acquired.

Jerusalem Talmud Gittin 5:24

MISHNAH: If orphans rely on a property owner or if their father appointed a guardian for them; these are obligated to tithe their produce. A guardian appointed by the orphans’ father shall be made to swear; if he was appointed by the court he shall not be made to swear. Abba Shaul says, it is the other way around.

Jerusalem Talmud Gittin 5:27

A guardian appointed by the orphans’ father shall be made to swear, for usually he is not checked out. If he was appointed by the court he shall not be made to swear for usually he was checked out. Abba Shaul says, it is the other way around; a guardian appointed by the orphans’ father shall be made to swear, for he is like one who is paid; if he was appointed by the court he shall not be made to swear for for he can say to him, I am doing this as a favor to you. It turns out that Rebbi Joḥanan follows the rabbis and Rebbi Yose ben Ḥanina Abba Shaul. Does Rebbi Joḥanan follow the rabbis? Even if he holds with Abba Shaul, a person acts as a trustee in order to be declared trustworthy. Does Rebbi Yose ben Ḥanina [follow] Abba Shaul? Even if he holds with the rabbis, a person is apt to slip away from an oath but not from payments.

Jerusalem Talmud Gittin 9:24

HALAKHAH: “If he wrote two bills of divorce side by side,” etc. “It is invalid if the witnesses are separated from the text by the width of two lines; less than that it is valid”. Simeon bar Abba in the name of Rebbi Joḥanan: An empty space of two lines in a text about one subject makes invalid in any case. Rebbi Samuel bar Rav Isaac said: The Mishnah says so: “One Hebrew- and one Greek-writing witness are under each of them, reaching from one column to the other, are all invalid.” Is not Hebrew combined with Greek one item? Rebbi Mana said, if he started at the end of the second line and ended at the fourth line, it is valid. “How far from the text should the witnesses sign? That they can be read with it, the words of Rebbi. Rebbi Simeon ben Eleazar says, one full line. Rebbi Dositheos ben Yannai says, the width of the witnesses’ handwriting.” What kind of writing does one use to estimate? Rebbi Yasa ben Rebbi Sabbatai says, the width of the witnesses’ handwriting. Rebbi Abbahu in the name of Rebbi Isaac ben Ḥaqula: Corresponding to לך ולך. Rebbi Jeremiah asked before Rebbi Ze‘ira: Does the signature of Yose ben Yannai have equal weight with the signature of Shaul ben Barukh? He said to him: For that it is needed, that the signature of Yose ben Yannai has equal weight with the signature of Shaul ben Barukh.

Jerusalem Talmud Kiddushin 4:17

MISHNAH: What is a silenced one? Anyone who knows his mother but not his father. But a foundling is one collected from the public domain who knows neither his father nor his mother. Abba Shaul called the silenced one “investigated one”.

Jerusalem Talmud Kiddushin 4:48

MISHNAH: One man should not be alone with two women but one woman may be alone with two men. Rebbi Simeon says, he may be alone with two women as long as his wife is with him; he can sleep with them in a hostelry because his wife will watch over him. A man can be alone with his mother or his daughter and sleep with them with their skins touching; once they grew up each one sleeps in his garment. And a bachelor shall not be a school teacher; a woman shall not be a school teacher. Rebbi Eliezer says, also a man without a wife shall not be a school teacher. Rebbi Jehudah says, a bachelor shall not be a shepherd and two bachelors shall not sleep under one cover, but the Sages permit. Anybody whose occupation is with women should never be alone with women. And a man should not teach his son a craft for women. Rebbi Meïr says that a man should try to teach his son a clean and easy trade and pray to Him to Whom riches and properties belong since there is no trade in which poverty and riches are not found, for neither poverty nor riches come from the trade. Rebbi Simeon ben Eleazar says, did you ever see a wild animal or a bird which had a trade? And they sustain themselves without pain. But they were created only to serve me and sustain themselves without pain, and I was created to serve my Maker, it should be logical that I should be able to sustain myself without pain; only I worsened my deeds and destroyed my sustenance. Abba Gorion from Sidon says in the name of Abba Shaul: A man should not teach his son to be a donkey driver, a camel driver, a hairdresser, a sailor, a potter, a shepherd, or a grocer, since their occupations are those of robbers. Rebbi Jehudah says in the latter’s name: Most donkey drivers are wicked, most camel drivers are in order, most sailors are pious; the best of physicians goes to hell, the qualified among the butchers is an associate of Amaleq.

Jerusalem Talmud Kiddushin 4:49

HALAKHAH: “One man should not be alone with two women,” etc. Rebbi Abun said, when has this been said? With decent men. But with profligates she should not be alone even with a hundred men. It was stated: A one day old child who died is for his father, his mother, and all his relatives like one fully grown. Not only if he died when one day old but even if he was alive when his head and most of his body were born. He is carried out at the bosom and buried by one woman and two men; Abba Shaul says even one man and two women. It is obvious that Rebbi Simeon will agree with Abba Shaul but Abba Shaul does not need to agree with Rebbi Simeon since there is no sexual desire in the cemetery.

Jerusalem Talmud Kiddushin 4:50

Rebbi Joḥanan in the name of Rebbi Simeon ben Ioḥai: “If your brother, your mother’s son, or your son, or your daughter incites you”. “Your mother in secret,” “your daughter in secret.” A man can be alone with his mother and live with her, with his daughter and live with her, with his sister and does not live with her, and sleep with them with their skins touching. Rebbi Ḥalaphta ben Shaul stated: The daughter with her father up to the age of three years and one day; the son with his mother up to the age of nine years and one day. If they get older, each one sleeps in his own clothing. It was stated: If two people sleep in the same bed, each one covers himself with his own garment and recites {the Šema‘}; if his son or daughter were small it is permitted. There, they say: A man with his wife is permitted. Rebbi Jacob bar Aḥa in the name of Rebbi Eleazar: A man with his wife is problematic.

Jerusalem Talmud Kiddushin 4:54

New paragraph. Abba Orion from Sidon says in the name of Abba Shaul: Most donkey drivers are wicked, most camel drivers are in order, most sailors are pious, most bastards are intelligent, most slaves are beautiful, most children of reputed parents are bashful, most sons look like their mother’s brothers. The qualified physicians go to hell, the qualified among the butchers is an associate of Amaleq. Rebbi Simeon ben Ioḥai stated: Kill the best of Gentiles, smash the head of the best of snakes; the best qualified among women is a sorceress. Blessed is he who does the will of the Omnipresent.

Jerusalem Talmud Bava Kamma 4:20

If a bull of orphans and guardians went out and did damage, what is the rule? Rebbi Joḥanan said, [the damage is paid] from the orphan’s property. For if you say from the guardians’, nobody ever will agree to become a guardian. Rebbi Yose ben Ḥanina said, from the guardians’. Rebbi Yose ben Ḥanina follows Abba Shaul and Rebbi Joḥanan the rabbis, as it was stated there: “A guardian appointed by the orphans’ father shall be made to swear; if he was appointed by the court he shall not be made to swear,” for the court will check him out. “Abba Shaul says, it is the other way around,” a guardian appointed by the orphans’ father shall not be made to swear; it would be as if he would take a pledge from him. If he was appointed by the court he shall be made to swear, since a person will do much to be called trustworthy.

Jerusalem Talmud Bava Metzia 4:24

MISHNAH: Just as there is cheating in trade so there is cheating by words. One should not say to another: how much for this object, if he is not interested in buying. If somebody was a repentant sinner, one should not say to him: remember your earlier deeds. If somebody was the son of a proselyte, one may not say to him: remember the deeds of your forefathers, for it is written: “A sojourner you may neither cheat nor oppress, for you were sojourners in the Land of Egypt.” One does not mix produce, not even new with new; no need to say new with old. In truth they permitted to mix strong wine with weak since it improves it. One does not mix wine lees with wine but one delivers the lees with the wine. If water became mixed with somebody’s wine, he should not sell it in the store unless he declares it, and not to a trader for that one would only use it to trick people; at a place where they usually put water into the wine they may do so. The trader may buy from five threshing floors and put into one chest, wine from five wine presses and put into one barrel, on condition that he not intend to mix. Rebbi Jehudah says, a store owner should not distribute roasted kernels and nuts to children because he induces them to come to him, but the Sages permit. He should not reduce the price, but the Sages say, may he be remembered as a benefactor. He should not clean the groats following Abba Shaul, but the Sages permit it. However, they agree that he may not clean the upper layer of the chest since that gives a dishonest impression. One may not put makeup on humans, animals, or vessels.

Jerusalem Talmud Bava Metzia 6:18

MISHNAH: All artisans are paid trustees, but in any case where he said, take what is yours and bring money, he becomes an unpaid trustee. Watch over what is mine and I shall watch over what is yours, paid trustee. Watch over what is mine, and he said, put it down before you, an unpaid trustee. He who gives a loan on a pledge is a paid trustee; Rebbi Jehudah said, if he lent money, he is an unpaid trustee, if produce, a paid trustee. Abba Shaul said, a person is authorized to rent out a poor person’s pledge to continuously slice off [from the loan] because he is like a person who returns lost property.

Jerusalem Talmud Bava Batra 2:20

MISHNAH: One distances a tree from a town by 25 cubits; but carob tree or sycamore by 50 cubits; Abba Shaul says, every non-fruit tree by 50 cubits. If the town existed before the tree, one cuts it down and does not pay for it; if the tree existed before the town, one cuts it down and pays for it. If there is a doubt which one existed before the other, one cuts it down but does not pay. One distances a threshing floor 50 cubits from the town. A person shall not make a threshing floor on his property unless he owns 50 cubits in each direction. He distances it from another’s orchards or ploughed field so that he will not cause damage.

Jerusalem Talmud Bava Batra 2:29

MISHNAH: If a tree overhangs another’s field, he may cut it in the height of the plough’s ox-goad; carob tree and sycamore along the plumb line. Over an irrigated field along the plumb line. Abba Shaul says, every non-fruit-bearing tree along the plumb line. If a tree overhangs the public domain, one has to cut it so that a camel with a rider on it may pass; Rebbi Jehudah says, loaded with flax or bundles of vine cuttings. Rebbi Simeon says, any tree [must be cut] along the plumb line because of impurity.

Jerusalem Talmud Sanhedrin 1:87

“Abba Shaul says, two subdivisions were there, the lower and the upper, whose sanctification was not complete. The lower one was dedicated with a full ceremony, but the upper one only when they came from the diaspora, without a king and without Urim and Tummim. Therefore, in the lower one the vulgar eat family sacrifices and Second Tithe; Fellows eat there family sacrifices but not Second Tithe. In the upper one, the vulgar eat family sacrifices but not Second Tithe; Fellows eat there family sacrifices and Second Tithe. Why did they not sanctify it? Because it was the vulnerable spot of Jerusalem; it could be conquered from there.”

Jerusalem Talmud Sanhedrin 10:1

MISHNAH: All of Israel have a part in the World to Come. But the following have no part in the World to Come: One who says that the resurrection of the dead is not biblical, or that the Torah is not from Heaven, or the Epicurean. Rebbi Aqiba says, also one who reads outside books, or who whispers over a wound and says, any sickness that I put on Egypt I shall not put on you, for I am the Eternal, your Healer. Abba Shaul said, also one who pronounces the Name by its letters.

Jerusalem Talmud Sanhedrin 10:26

Abba Shaul said, also one who pronounces the Name by its letters. Rebbi Mana said, for example, those swearing Samaritans. Rebbi Jacob bar Aḥa said, it is written as yod he but read as alef dalet.

Jerusalem Talmud Avodah Zarah 2:32

Rebbi Yose ben Shaul understands it from the following occurrence. It happened that a woman loved to do good deeds but her husband hated good deeds. There came a poor man and she gave him to eat. While he was eating she noticed her husband; she made him climb and hid him in the upper floor. She returned to her husband who ate and fell asleep. There came a snake and ate from what was before him; her husband awoke from his sleep and wanted to eat. The one in the upper floor started to talk. That means if he was sleeping it is permitted. It was used to it. But is it not forbidden because of being alone? For they committed adultery, blood is on their hands. Since he is not suspected of one he is not suspected of the other.

Jerusalem Talmud Makkot 2:8

MISHNAH: If he threw the stone into his own courtyard and it killed, if the person damaged had the right to enter there, he is exiled, but if not, he is not exiled, as it is said, if somebody goes with another to a forest. Since the forest is a place where the person injured and the one causing the injury both may enter, this excludes a private courtyard where the person injured and the one causing the injury may not enter together. Abba Shaul says, since cutting down trees is a voluntary act, this excludes a father who hits his son, a teacher who disciplines his student, and the court bailiff.

Jerusalem Talmud Makkot 2:25

[Just as the city grants asylum, so does its domain grants asylum.] “Three cities did Moses designate in Transjordan. When they came to the Land they designated another three. In the future there will be another three, as it is said three, three, three. This makes nine. Abba Shaul says, three. Three of three times three makes nine. Additional makes twelve. Rebbi Nehorai says, three, three, three make nine. Additional makes twelve. To these three makes fifteen.” It is written: Six cities of refuge there shall be for you, that all six of them give asylum simultaneously. And you say so? It follows what Rebbi Samuel [ben Aina] said in the name of Rebbi Aḥa: Five things was the last Temple missing which were in the first Temple, as it is written: Go to the mountain, bring wood, etc., up to I may be honored. It is written I shall be honored, without the letter he. These are the five things which the last Temple was missing which were in the first Temple. They are: The fire, the Ark, Urim and Tummim, anointing oil, and the Holy Spirit.

Jerusalem Talmud Niddah 3:17

It was stated: “Abba Shaul said, a human is created from his navel; from there is spreads its roots in all directions. It was stated: One sees his two eyes like two fly-blows, his two nose holes like two fly-blows, his mouth opened like a barley grain. One sees his two hands like two fly-blows, his navel like a fly-blow, his genital like a fly blow and if she is female, her genital spanned like a barley grain.” It was stated: Rebbi Jonathan says, one sees his two arms like two threads of crimson wool and his other limbs like compressed unformed material; he has not yet developed hands and feet. On that it is explained in the Bible: “My unformed body was seen by Your eyes, in Your ledger they are all written down, the days bundled before one of them was.”

Jerusalem Talmud Niddah 3:24

Rebbi Yose ben Shaul asked before Rebbi: Can one refer a placenta to something which is not a child? He said to him, one does not refer a placenta to anything which is not a child. If it came out attached to it, what then? He said to him, one does not discuss anything impossible. Rebbi Ḥanin stated from Samuel: One does not refer a placenta to something which is not a child, if [nevertheless] it came out attached to something else, one refers to it. Samuel asked the students of Rav: Can one refer a placenta to stillbirths? They said to him, one refers a placenta to a child and one [does not] refer(s) a placenta to stillbirths. Samuel praised them because they follow the argument [of their teacher]. Rebbi Ḥanin stated from Samuel: One refers a placenta to a child but one does not refer a placenta to stillbirths since it does not separate until it [was completed]. Rebbi Ze‘ira in the name of the rabbis: What you say, that one refers a placenta to a child, is because a pregnant woman does not become pregnant. Why does one not refer it to stillbirth, can a woman not have a stillbirth followed by a stillbirth? I say that she was pregnant with twins when the placenta of one amnion was crushed by the amnion of the other placenta. Rebbi Ze‘ira, Rav Jehudah in the name of Rav: One refers a placenta to a child for up to three days, and no child remains after another child for three days. Rebbi Ze‘ira said, he who said this also said the other, but they disagree with one another! Rebbi Abba said, Rav Jehudah explained it following Rav: You say that one refers a placenta to a child for up to three days if the child was born first, and you say that no child remains after another child for three days if the sole appeared first. Rebbi Mana said, is that correct? The active ones come out first. Rebbi Yose ben Rebbi Abun said, if [the womb] opened for the large, it opened for the small; if it opened for the small it did not open for the large.

The Babylonian Talmud

Babylonian Talmud Sukkah 3:121

Abba Shaul says: "willows" [in the plural means] two, one for the lulav and one for the Temple.

Babylonian Talmud Sukkah 4:39

According to whom? If you will say, According to Abba Shaul, did he not say: It is written, “willows of the brook” implying two, one referring to the [aravah in the] lulav and the other to [the aravah for use in] the Temple? If you will say it is according to the rabbis, did they not have it as an accepted tradition, since R. Assi said in the name of R. Yohanan who said it in the name of R. Nehunya of the Valley of Beth Hovartan: The laws of the ten plants, the aravah and water libation were given to Moses upon Mount Sinai.

Babylonian Talmud Sukkah 5:65

And this shall be peace: when the Assyrian shall come into our land, and when he shall tread in our palaces, then shall we raise up against him seven shepherds and eight princes among men” (Micah 5:4). Who are the “seven shepherds”? — David in the middle, Adam, Seth and Methuselah on his right, and Abraham, Jacob and Moses on his left. And who are the “eight princes among men”? — Yishai, Shaul, Shmuel, Amos, Zephaniah, Zedekiah, the Messiah, and Elijah.

Babylonian Talmud Sukkah 5:157

Rav could say to you: This is a tannaitic dispute; for it has been taught, “Here is matzah for you, here is leavened bread for you.” Abba Shaul says: [They said,] “Here is leavened bread for you, here is matzah.

Babylonian Talmud Makkot 2:27

Abba Shaul says: Just as cutting wood is optional [for someone and therefore he should not be punished], so too, anything that is optional [should not receive punishment] except the father who strikes his son, the teacher who rebukes his student [through beating], and the messenger of the court [who gives punishments through lashings].
