KJV Apocrypha (Catholic Deuterocanon)

Wisdom of Solomon 17:2

For when unrighteous men thought to oppress the holy nation; they being shut up in their houses, the prisoners of darkness, and fettered with the bonds of a long night, lay [there] exiled from the eternal providence.

Kebra Nagast

Kebra Nagast 98:39

For the demons and the Christians became changed; the spiritual beings became reprobates, and through transgressing the commandment of their Lord they became exiled ones by the might of His Cross.

Kebra Nagast 98:40

And we have become spiritual beings through receiving His Body and Blood in the place of those spiritual beings who were exiled, and we have become beings worthy of praise who have believed in His Cross and in His holy Resurrection.

The Zohar (selections)

The Book of Concealed Mystery (Siphra Dtzenioutha) 1:22

The seventh (the millennium, and the seventh space, namely, the Kingdom), above that One which alone is powerful—(i.e., when the six degrees of the members denote mercies and judgments, the seventh degree tendeth alone to judgment and rigour). And the whole is desolate (that is, the Kingdom, MLKVTH, Malkuth, in the higher powers, is the antitype of the sanctuary, and like as this is destroyed, so also the Schechinah, or Kingdom, is itself exiled) for twelve hours (for the Hebrews include all this time of their exile in the space of one day). Like as it is written: “It was formless and void, &c.” (for from the word “it was formless,” down to “upon the faces of,” are twelve words in the Hebrew text of Genesis.)

The Mishnah

Mishnah Sheviit 10:8

One who returns a debt [after] the seventh year, the [creditor] must say to [the debtor]: “I remit it.” But [the debtor] should say: “Even so [I will repay it].” [The creditor] may then accept it from him, because it says: “And this is the word of the release” (Deuteronomy 15:2). Similarly, when [an accidental] killer has been exiled to a city of refuge, and the citizens want to honor him, he must say to them: “I am a murderer.” If they say: “Even so, [we want to honor you], then he may accept [the honor] from them, because it says: “And this is the word of the murderer” (Deuteronomy 19:4).

Mishnah Makkot 1:1

How do witnesses become liable [to punishment] as perjurers? [If they say:] “We testify that so and so [a priest] is a son of a woman who had [formerly] been divorced or a haluzah,” it is not said that each witness should himself be as if he was born of a divorcee or a haluzah; rather he receives forty [lashes]. [If they say]: “We testify that so and so is guilty of [a crime entailing] exile”, it is not said that each witness should himself be exiled; rather he receives forty [lashes]. [If they say:] “We testify that so and so divorced his wife and has not paid her kethubah” seeing that either today or tomorrow he [the husband] will pay her kethubah, the assessment should be made how much a man will be willing to pay [now] for the ownership of her kethubah, on the condition that if she should be widowed or divorced [he will take it over] but if she should die, her husband will inherit her [estate including the kethubah]. [If they say]: “We testify that so and so owes his friend one thousand zuz on the condition that he will pay him within thirty days”, while the debtor says “ten years”, the assessment should be made how much a man is willing to pay for the use of a thousand zuz, whether he pays them in thirty days or ten years.

Mishnah Makkot 2:6

Rabbi Yose bar Judah says: “Initially a slayer is sent in advance to [one of] the cities of refuge, whether he had slain in error or with intent and then the court sends and brings him out. Whoever was found guilty of a capital crime the court had executed, and whoever was found not guilty of a capital crime they acquitted. Whoever was found liable to banishment they restored to his place [of refuge] as it says, “And the congregation shall restore him to the city of refuge to which he fled” (Numbers 35:25). All the same are [the deaths of] the high priest who had been anointed with the anointing oil; or had worn many garments, or had retired from his office all make possible the return of the manslayer. Rabbi Judah says also the [death of the] priest who had been anointed for war makes possible the return of the manslayer. Therefore, mothers of high priests would provide food and clothing for them [who had been exiled] that they might not pray for their son’s death. If the high priest died at the conclusion of the trial, the slayer does not go into banishment. If he died before the trial was concluded and another high priest was appointed in his stead and the trial was then concluded, the slayer returns [home from refuge only] after the latter’s death.

The Jerusalem Talmud

Jerusalem Talmud Sheviit 6:2

HALAKHAH: It is written (Deut. 12:1): “These are the statutes and the rules of law which you will be required to follow in the Land.” In the Land you are required to follow them but not outside the Land. Still we say obligations depending on the Land apply only in the Land, but we might think that obligations not depending on the Land also should apply only in the Land. The verse says (Deut. 11:16–18) “Guard yourselves, lest your heart be seduced … And the Eternal’s rage be inflamed against you, etc. Put these words on your hearts, etc.” Even if you are exiled. (Deut. 11:18) “Put these words on your hearts and your persons.” You have to say, for example tefillin and the study of Torah. Just as tefillin and the study of Torah do not depend on the Land and apply both in the Land and outside the Land, so everything not depending on the Land applies both in the Land and outside the Land.

Jerusalem Talmud Sheviit 6:3

If it is so, they should have been freed once they were exiled. It is written (Neh. 8:17): “All the congregation coming from captivity made Sukkot and sat in tabernacles … something nobody had done since the days of Joshua bin Nun.” Why Joshua? Rebbi Hillel, the son of Samuel ben Naḥmani: The verse damaged the reputation of the just person in his grave for the reputation of the just person in his time; it compares their coming in the days of Ezra to the coming in the days of Joshua. As at the coming in the days of Joshua they had been free and became obligated, also at the coming in the days of Ezra they had been free and became obligated. How did they become obligated? Rebbi Yose ben Ḥanina said, they became obligated by the words of the Torah; that is what is written (Deut. 30:5): “The Eternal, your God, will bring you to the Land that your fathers had inherited and you will inherit it.” Just as the inheritance of your fathers was by the words of the Torah, so your inheritance is by the words of the Torah. “He will be good to you and give increase to you more than to your forefathers.” Your fathers had been free and became obligated, also you had been free and became obligated. On your fathers was no yoke of government, but you even though there is on you the yoke of government. Your fathers did become obligated only after 14 years, seven they conquered and seven they distributed, but you became obligated immediately when you entered. Your fathers did become obligated only after they had acquired all, you become obligated for every single piece at the moment you acquire it.

Jerusalem Talmud Sheviit 10:23

Rebbi Ḥuna said, I asked before Rebbi Jacob ben Aḥa: Following him who says tithes [are from their words, it is understandable that Hillel instituted prozbol. But following him who says tithes] are from the Torah, does Hillel institute anything against the words of the Torah? Rebbi Yose said, from the moment that Israel was exiled to Babylonia, did they not become free from all commandments connected with the Land, but the remission of debts applies both in the Land and outside the Land from the words of the Torah [because it is an obligation of the person]? Rebbi Yose turned and said, (Deut. 15:2) “this is the word of the abandonment, remit” as long as abandonment is followed as a word of the Torah, remission of debts applies both in the Land and outside the Land from the words of the Torah, but when abandonment is followed as their word, remission of debts applies both in the Land and outside the Land from their word. There, they say that even one who holds that tithes are from the Torah will hold that the Sabbatical is from their word. As we have stated (Deut. 15:2): “this is the word of the remission, remit!” Rebbi says, these two remissions are the Sabbatical and the Jubilee. As long as the Jubilee is operative, the Sabbatical is from words of the Torah. If the Jubilees are abolished, the Sabbatical is operative from their words. When were the Jubilees abolished? (Lev. 25:10) “[All its] inhabitants.” In the time when its inhabitants lived on it, not when they went into exile. If they lived on it but intermingled, the tribe of Judah in Benjamin, and the tribe of Benjamin in Judah, I could think that the Jubilee is operative. The verse mentions its inhabitants, “All its inhabitants;” you find that when the tribes of Reuben, Gad, and half the tribe of Manasseh went into exile, the Jubilees were disestablished.

Jerusalem Talmud Sheviit 10:27

MISHNAH: A predated prozbol is valid, postdated it is invalid. Predated documents of indebtedness are invalid, postdated they are valid. If one person borrows from five, one writes a prozbol for each single [creditor]. If five persons borrow from one, he writes only one prozbol for all of them. One writes prozbol only on the basis of real estate. If he has none, [the other party] gives him the right to a minute area of their field. If he had a field mortgaged in town, one writes a prozbol on it. Rebbi Ḥuẓpit says, one writes for a man on his wife’s properties and for orphans on those of the guardians. A bee hive. Rebbi Eliezer says, it is like real estate: one may write a prozbol on it, it is not subject to impurity in its place, and somebody who takes honey from it on the Sabbath is guilty. But the Sages say, it is not like real estate, one may not write a prozbol on it, it is subject to impurity in its place, and somebody who takes honey from it on the Sabbath is not sanctionable. If somebody returns a debt in the Sabbatical, he [the lender] says to him: “I am remitting.” If he [the borrower] says “anyway”, he [the lender] should accept it, for it is said (Deut. 15:2): “This is the word of remission”. Similarly, a homicide exiled to a city of refuge whom the citizens of the town wanted to honor, should say to them: I am a homicide. If they tell him, anyway, he should accept it, for it is said (Deut. 19:4): “This is the word of a homicide.”

Jerusalem Talmud Pesachim 4:12

If they were exiled from one place to another and wanted to change their ways? Would it be as Rebbi Abba said, the people of Mesha took it upon themselves not to travel on the ocean. They came, asked Rebbi, and said to him, our forefathers used not to travel by sea; what is our situation? He said to them, since your forefathers treated it as a prohibition, do not change the usage of your deceased ancestors. May a person not ask about his vow? There he asks when he made the vow, but here their ancestors made the vow. Then they should be permitted a fortiori. Rebbi Ḥanania said, it is not because of this but because of the following. Rebbi was the student of Rebbi Jehudah, and Rebbi Jehudah said, one is forbidden to travel by sea.

Jerusalem Talmud Shekalim 6:6

When the ark was hidden, there were hidden with it the flask of Manna, the bottle of anointing oil, Aaron’s staff with its almonds and flowers, and the chest which the Philistines returned as a reparation sacrifice for Israel’s God. Who hid it? Josiah hid it. When he saw that it was written: The Eternal will lead you and your king whom you will have put above you, to a people whom neither you nor your fathers had known, he started and hid it. That is what is written: He said to the Levites, who instruct all of Israel, the ones holy to the Eternal, put the Ark into the House that Salomon, son of David, King of Israel, built; you do not have to carry it on your shoulder.” He said, if it is exiled with you to Babylonia, you will never return it to its place. But now, serve the Eternal, your God, and his people Israel.

Jerusalem Talmud Taanit 1:17

Rebbi Simeon ben Yoḥay stated: Every place to which Israel was exiled, the Divine Presence was exiled with them. They were exiled to Egypt and the Divine Presence was exiled with them. What is the reason? Was I not revealed to your Father’s house when they were in Egypt, the house of Pharaoh? They were exiled to Babylon and the Divine Presence was exiled with them. What is the reason? On your behalf I was sent to Babylon. They were exiled to Media and the Divine Presence was exiled with them. What is the reason? I installed My throne in Elam, but Elam is nothing else but Media as you are saying, when I was in the Capital city of Susa which is in the province of Elam. They were exiled to Ionia and the Divine Presence was exiled with them. What is the reason? I shall awake your sons, Zion, over your sons, Ionia. They were exiled to Rome and the Divine Presence was exiled with them. What is the reason? He calls to me from Se`ir: watchman, what time is it in the night? Israel said to Isaiah: our teacher Isaiah, what will lead us out from this night? He told them, wait until it will be asked. After he asked, he returned to them and they asked him, watchman, what time is it in the night? He said to them, the watchman said, there comes morning and also night. They said to him, and also night? He told them, not as you understand it. But “morning” for the just ones, and “night” for the evildoers. “Morning” for Israel and “night” for the peoples of the world. They asked him, when? He said to them, any time you want, He wants: if you desire to ask, ask. They asked him, what obstructs? He told them, repentance: repent, come.

Jerusalem Talmud Taanit 2:2

HALAKHAH: “How is the order of the fast days,” etc. Rebbi Ḥiyya bar Abba said, why does one move to the town plaza? To say, we are considered as if exiled before You. Rebbi Joshua ben Levi said, because they prayed in privacy and were not answered; therefore they went public and were publicized. Rebbi Ḥiyya bar Abba said, why does one bring the Ark to the town plaza? To say that we had one precious vessel and our sins caused it to become debased. The Elder Rebbi Ḥuna of Sepphoris said, our forefathers covered it with gold and we covered it with ashes. Rebbi Jacob the Southerner said, why does one blow horns? To say, we are considered as if bellowing like animals before You. Rebbi Levi said, and why does one visit graves? To say, we are considered like dead before You. Rebbi Tanḥuma says, all of this is included. If we are guilty to die there are the dead, if exile there is exile, if hunger there is hunger.

Jerusalem Talmud Taanit 4:50

Rebbi Levi said, Yehoyariv, a person. Meron, a town. Mesarbei. He delivered His House to the enemies. Rebbi Berekhia said, [Yehoyariv], Yah quarrelled with His children since they rebelled and rejected Him. Yeda`ya Amoq Sipporim. Yah knew the deep counsel in their hearts and exiled them to Sepphoris.

Jerusalem Talmud Taanit 4:61

It was stated: Rebbi Yose says, for 52 years no bird was flying in the Land of Israel. What is the reason? From the bird <of the sky> to the domesticated animal, they moved, they went away. Rebbi Ḥanina said, 40 years before Israel was exiled to Babylonia they planted date palms in Babylonia, so they should be ardent after sweets since this accustoms the tongue to Torah. Rebbi Ḥanina the son of Rebbi Abbahu said, 700 kinds of pure fish and 800 kinds of pure locusts and innumerable birds all were exiled with Israel to Babylonia; and when they returned, all of them returned, except the fish called turbot. How did fish migrate? Rebbi Ḥuna (bar Joseph) <in the name of rav joseph> said, they went into exile through the abyss end returned through the abyss.

Jerusalem Talmud Megillah 3:35

Rebbi Ḥiyya the son of Rebbi Ada from Jaffa in the name of Rebbi Ze`ira: One has to recite them in one breath together with “the ten sons of Haman.” Rebbi Yose ben Rebbi Abun said, one has to write ish at the top of the column and the at the end since so it (rises) [is compressed] and sinks like a plumb-line. Rav said, one has to say, Haman be cursed, his sons be cursed. Rebbi Phineas said, one has to say, Ḥarbona be remembered for good. Rebbi Berekhiah, Rebbi Jeremiah, Rebbi Ḥiyya in the name of Rebbi Joḥanan: When Rebbi Jonathan came to this verse, whom Nebuchadnezzar exiled, he used to say, Nebuchadnezzar, may his bones be pulverized; for all “Nebuchadnezzar” written in Jeremiah refer to the living, but here he was dead.

Jerusalem Talmud Megillah 4:39

HALAKHAH: There, we have stated, “A blind person is not exiled, the words of Rebbi Jehudah; Rebbi Meïr says, he is exiled.” And both of them explained the same verse, without seeing. Rebbi Jehudah says, to include the blind person. Rebbi Meïr says, excluding the blind person. And here we have stated, “a person who never saw light does not spread out the Shema`.” Therefore if he saw he spreads. Rebbi Ḥaggai asked before Rebbi Yose, is the argument of Rebbi Jehudah inverted? There he says, excluding, but here he says, to include. Rebbi Ḥanania the son of Rebbi Hillel said, the Mishnah is about one sitting in a dark house. So we are saying, “one sitting in a dark house may not spread the Shema`.” But here, without seeing, to include the blind person.

Jerusalem Talmud Yevamot 8:8

A slave may be a permanent sojourner. A sojourner is like a Gentile in every respect. Rebbi Samuel bar Ḥiyya bar Jehudah in the name of Rebbi Ḥanina: One keeps the sojourner for twelve months. If he changes his mind, that is fine; otherwise he is like a Gentile in all respects. Rebbi Samuel bar Ḥiyya bar Jehudah, Rebbi Ḥanina in the name of Rebbi: The sojourner has to accept on condition that he may eat cadaver meat. Rebbi Hila said, one would then say, the words are [interpreted] as they are written. What does it mean, the words are [interpreted] as they are written? Rebbi Yose ben Ḥanina said, “You shall not eat any cadaver; to the sojourner in your midst you shall give it that he eat it.” Some Tannaim state: One does not receive a sojourner unless he accepts all commandments written in the Torah. Some Tannaim state: One does not receive a sojourner unless he renounces his idolatry. Rebbi Abba in the name of Rebbi Ḥiyya bar Ashi: One does not receive a sojourner unless he renounces his idolatry as a Gentile. Rebbi Ze‘ira said, from their consensus: unless he renounces his idolatry as a Gentile. For if it were not so, what would we say? Since he is forbidden idolatry he cannot render profane. But are Gentiles not also forbidden idolatry and they do render profane? Rebbi Yose said, that you should not say, since he is equal to an Israel in three respects, do not oppress, do not cheat, and he is exiled like an Israel, that he has no power to render profane. Therefore, it was necessary to spell out that he renders idols profane like a Gentile. Who is the Tanna who includes “do not oppress”? He is Rebbi Yose ben Rebbi Jehudah, as it was stated: The sojourner is protected by the prohibition, the words of Rebbi Yose ben Rebbi Jehudah.

Jerusalem Talmud Sotah 8:9

When the ark was hidden, there were hidden with it the flask of Manna, the bottle of anointing oil, Aaron’s staff with its flowers and almonds, and the chest which the Philistines returned as a reparation sacrifice for Israel’s God. Who hid it? Josiah! When he saw that it was written: “The Eternal will lead you and your king whom you will have put above you, to a people whom neither you nor your fathers had known,” he started and hid it. That is what is written: “He said to the Levites, who instruct all of Israel, the ones holy to the Eternal, put the Ark into the House that Salomon, son of David, king of Israel, built; you do not have to carry it on your shoulder.” He said, if it is exiled with you to Babylonia, you will never return it to its place. But “ now, serve the Eternal, your God, and his people Israel.”

Jerusalem Talmud Gittin 4:13

Rav Huna said, I asked before Rebbi Jacob ben Aḥa: Following him who says tithes are from their words. But following him who says tithes are from the Torah, does Hillel institute anything against the words of the Torah? Rebbi Yose said, from the moment that Israel was exiled to Babylonia, did they not become free from all commandments connected with the Land, but the remission of debts applies both in the Land and outside the Land from the words of the Torah? Rebbi Yose turned and said, (Deut. 15:2) “this is the word of the abandonment, remit” as long as abandonment is followed in the Land as a word of the Torah, remission of debts applies both in the Land and outside the Land from the words of the Torah, but when abandonment is followed in the Land as their word, remission of debts applies both in the Land and outside the Land from their word. There, they say that even one who holds that tithes are from the Torah will hold that the Sabbatical is from their word. (Deut. 15:2): “This is the word of the remission, remit!” Rebbi says, two remissions are the Sabbatical and the Jubilee. As long as the Jubilee is operative, the Sabbatical is from words of the Torah. If the Jubilees are abolished, the Sabbatical is operative from their words. When were the Jubilees abolished? (Lev. 25:10) “For all its inhabitants.” In the time when they lived on it, not when they went from it into exile. If they lived on it but did (not) intermingle, the tribe of Judah in Benjamin, and the tribe of Benjamin in Judah, I could think that the Jubilee was operative. The verse mentions its inhabitants, “All its inhabitants;” you find that when the tribes of Reuben, Gad, and half the tribe of Manasseh went into exile, the Jubilees were disestablished.

Jerusalem Talmud Kiddushin 1:136

HALAKHAH: “Any commandment which does not refer to the Land,” etc. It is written (Deut. 12:1): “These are the statutes and the rules of law which you will be required to follow in the Land.” In the Land you are required to follow them but not outside the Land. Still we say obligations depending on the Land only apply in the Land, but we might think that obligations not depending on the Land also should only apply in the Land. The verse says (Deut. 11:16–18) “Be careful, lest your heart be seduced … and the Eternal’s rage be inflamed against you, etc. Put these words on your hearts,”. Even if you are exiled.

Jerusalem Talmud Sanhedrin 10:66

Rebbi Eleazar and Rebbi Jehudah. One said, they were exiles only when they were uncircumcised. The other said, they were exiled only when they were bastards. He who says uncircumcised, for circumcision and commandments. But he who says bastards, from their fathers. Rebbi Joḥanan said, Israel was exiled only after they formed 24 heretical sects. What is the reason? Son of man, I am sending you to the Children of Israel, to rebellious peoples who rebelled against Me. It is not written “to a rebellious people” but to rebellious peoples who rebelled against Me; they and their fathers have acted criminally against Me up to this day. Rebbi Berekhia and Rebbi Ḥelbo in the name of Rebbi Samuel bar Naḥman. Israel was exiled to three diasporas: one inside the river Sanbation, one to Daphne of Antiochia, and one on whom the Cloud descended and covered them. Just as they were exiled to three diasporas, so the tribes of Reuben, Gad, and half the tribe of Manasse were exiled into three diasporas. What is the reason? You went in the way of your sister and I gave her cup into your hand. So when they return, they will return from three diasporas. What is the reason? To tell the prisoners, leave, those who were exiled inside the river Sanbation; those in darkness, become visible, those upon whom the Cloud descended and covered them; on the roads they are grazing and on all plains is their pasturage, those who were exiled to Daphne of Antiochia.

MISHNAH: The following are exiled: the unintentional homicide. If he was rolling with the roller when it fell on somebody and killed him, or lowering an amphora when it fell on somebody and killed him, or was descending on a ladder when he fell on somebody and killed him, he is exiled. But if he was drawing the roller when it fell on somebody and killed him, or lifting an amphora when it fell on somebody and killed him, or was climbing a ladder when he fell on somebody and killed him, he is not exiled. This is the principle, by anything lowered, he is exiled, if it is not lowered, he is not exiled.

Rebbi Simeon says, there is a hater who is exiled and one who is not exiled. In any case where one can say that he killed intentionally, he is not exiled; unintentionally, he is exiled.

Jerusalem Talmud Makkot 2:12

HALAKHAH: “The father is exiled for the son,” etc. Rebbi Zeˋira said that Rebbi Shila bar Binah stated: Even though it be written, the redeemer of the blood himself shall kill the murderer, nevertheless if somebody smote his son, his second son does not become the redeemer of the blood to kill his father. But if a brother smote his brother, the second brother becomes the redeemer of the blood to kill his brother. Rebbi Eliezer ben Jacob stated: Even though it be written, the redeemer of the blood himself shall kill the murderer, nevertheless if somebody smote his son, his second son becomes the redeemer of the blood to kill his father. But if a brother smote his brother, the second brother does not become the redeemer of the blood to kill his brother. And from where even if he said, I cannot face him, the verse says, when he comes upon him he shall kill him.

Jerusalem Talmud Makkot 2:14

MISHNAH: Where are they exiled to? To the cities of refuge. To the three in Transjordan and the three in the Land of Canaan, as it is said: Three cities you shall designate in Transjordan, etc. As long as those in the Land of Israel had not been selected, those in Transjordan were not receiving, as it is said, there shall be six cities of refuge, not until all six were receiving together. Roads were maintained from one to the other, as it is said: Maintain the road for yourselves, and divide the domain of your Land into three parts. One sends with them two scholars lest he kill him on the road, to argue with him. Rebbi Meïr says, he may argue for himself as it is said, this is the word of the homicide. Rebbi Yose ben Rebbi Jehudah says, at the start both the involuntary and the voluntary [homicide] go to the city of refuge; the court sends and brings them back from there. If one is found guilty by a death sentence, they execute him. If he is found not guilty in a capital case, he is freed. If he is found guilty to be exiled they return him to his place as it is said, the community shall return him to his city of refuge. Not only a [High Priest] anointed with the anointing oil, but also one wearing the many vestments, and one deposed from his office. Rebbi Jehudah says, also the one anointed for war returns the homicide. Therefore, the mothers of the [High] Priests support them with food and clothing, so they should not pray for the death of their sons. If sentence had been passed when the High Priest died, he is not exiled. If sentence had not yet been passed when the High Priest died, and sentence was passed after a successor had been appointed, he returns after the death of the second. If sentence was passed when there was no High Priest, or one who killed a High Priest, or a High Priest who killed, can never leave from there. He cannot leave from there, neither for a testimony of obligation, nor a testimony in a civil suit, nor a testimony in a criminal suit, not even if Israel needs him like Joab ben Ṣeruya, he cannot ever leave from there, as it is said there. There shall be his dwelling, there he shall die, there he shall be buried. Just as the city grants asylum, so does its domain grant asylum. If a murderer left the domain and was found by the avenger of the blood, Rebbi Yose the Galilean says, it is the obligation of the avenger of the blood and the right of everybody. Rebbi Aqiba says, it is the right of the avenger of the blood and nobody would be liable because of him. If a tree stands inside the domain but its crown is outside the domain, or the tree stands outside the domain but its crown is inside the domain, everything follows the crown. If somebody killed in one of these cities, he is exiled from quarter to quarter; but a Levite who killed is exiled from one city to another. Similarly, a homicide exiled to a city of refuge whom the citizens of the town wanted to honor, should say to them, I am a homicide. If they tell him, anyway, he should accept, for it is said, this is the word of a homicide.

HALAKHAH: “Where are they exiled to,” etc. “Three cities did Moses designate in Transjordan. When they came to the Land they designated another three. Neither of them were giving asylum until after they conquered and divided. After they conquered and divided, the Land became obligated for Sabbaticals and Jubilees and these and those were giving asylum. The three cities which they designated in the Land of Israel were parallel to the three cities which Moses had designated in Transjordan like two rows in a vineyard. Hebron in Judea parallels Beṣer in the desert. Sichem on Mount Ephraim parallels Ramot Gilead. Qedesh in Galilee parallels Golan in Bashan. (Before) [even though] they had designated Sichem on Mount Ephraim it could not give asylum; they designated Qiryat-Yearim in its place until they conquered Sichem. (Before) [even though] they had designated Qedesh in Galilee it could not give asylum; they designated Gamla in its place until they conquered Qedesh.”

Jerusalem Talmud Makkot 2:22

[“If sentence had been passed when the High Priest died, he is not exiled.”] It was stated: “Rebbi Eliezer ben Jacob says, ‘refuge, refuge’ was written at crossroads, so that the homicide might see what was written and continue.” Rebbi Abun said, a sign-post was directing them. Rebbi Phineas said, good and straightforward. Why is He good? Because He is straightforward. And why is He straightforward? Because He is good. Therefore, He teaches the way to the sinners. He instructs in the way of repentance. They asked Wisdom, what is the punishment of the sinner? She told them, evil will pursue sinners. They asked Prophecy, what is the punishment of the sinner? She told them, the sinning soul is the one which will die. They asked the Holy One, praise to Him, what is the punishment of the sinner? He said to them, let him repent and it will be atoned for him. That is what is written, therefore, He teaches the way to the sinners, the way to repentance. It is written: Like a bird to move, like a swallow to fly, so is a man moving from his place.

Jerusalem Talmud Makkot 3:11

MISHNAH: How does one flog him? One binds both his hands on both sides of a pillar. The beadle grabs his clothing. If it tore, it tore; if it unravelled, it unravelled, until he uncovers his heart. A stone is put behind him on which the beadle stands with a strip of calf’s leather in his hand, folded one into two and two into four, and two strips go up and down in it. The handle is one hand-breadth long; its width is one hand-breadth, and it reaches to his belly. He flogs him one third on his front and two thirds on his back. He flogs him neither standing nor sitting but bending down as it is written, the judge shall make him fall and flog him on his front etc. The person who flogs, flogs with one hand with full force. The reader reads if you will not observe to fulfill all the words of this Torah etc.; the Eternal will your flogging exemplary, etc. and returns to the beginning of the verse. If he died under his hand, he is not liable. If he added a single strip and he died, he is exiled because of him. If he dirtied himself whether by feces or by urine, he is no longer liable. Rebbi Jehudah says, a man by feces, a woman by urine.

The Babylonian Talmud

Babylonian Talmud Berakhot 1:44

R. Isaac b. Samuel said in the name of Rab: The night is divided into three watches, and at each watch the Holy One, blessed be He, sits enthroned, roars like a lion and exclaims, "Alas for My children, for whose iniquities I destroyed My house, burnt My Temple, and exiled them among the nations of the world ! "

Babylonian Talmud Berakhot 1:47

Then he said to me, "My son, what sound didst thou hear in that ruin ?" I answered, "I heard a Bat Kol moaning like a dove, crying, 'Alas for My children for whose iniquities I destroyed My house, burnt My Temple, and exiled them among the nations ! '" He said to me, "By thy life and the life of thy head, not only at this hour does it so cry, but thrice daily it exclaims thus. Moreover, whenever the Children of Israel enter their Synagogues and Houses of Study and respond 'Let His great Name be blessed,' the Holy One, blessed be He, shakes His head and exclaims, 'Happy the King Who is so praised in His house ! Alas for the Father Who has banished His children ! And alas for the children who have been banished from their Father's table ! '"

Babylonian Talmud Berakhot 9:174

R. Shela flogged a certain man who had had intercourse with a gentile woman ; so he went and laid a charge against him before the king, saying, "There is a certain Jew who judges without the king's consent." The king sent an official for him [to appear]. When R. Shela came he was asked, "For what reason didst thou flog this person?" He replied, "Because he had intercourse with a she-ass." They said to him, "Hast thou witnesses?" He answered, "Yes." Elijah came in human guise and gave evidence. They said to him, "In that case, his punishment is death." He said to them, "From the day we were exiled from our land, we have no power to inflict the death-sentence ; but you do with him as you please."

Babylonian Talmud Ta'anit 1:128

R. Johanan said: The day of rain is as important as that of the gathering of the exiled (Israelites), for it is said (Ps., 126.4): "Turn our captivity, O Lord, as the streams in the dry land," the word 'afiḳim (streams) meaning rain, as it is said (Ps. 18.16): "And the channels of water appeared." R. Johanan further said: Great is the day of rain, for then even armies must stop fighting, as it is said (Ps. 65.11): "Watering her ridges abundantly, settling down the furrows thereof." R. Johanan further said: Rain is withheld only on account of those who subscribe to charity in public and refuse to pay, for it is said (Prov., 25.14): "As vapours and wind without rain, so is he that boasteth himself of a false gift." R. Johanan further said: What is the meaning of the verse (Deut., 14.22):

Babylonian Talmud Ta'anit 2:16

Why did they go out for these ceremonies to the open place of the town? Said R. Ḥiyya b. 'Abba: Because they wished to say thereby: We have cried privately and were not answered, now let us humiliate ourselves publicly. Resh Laḳish said, they meant to say: We have exiled ourselves from our synagogues, and exile atones for sin. Does it make any practical difference what reason we adopt? The difference arises with regard to a case where the community leave one synagogue and enter another.

Babylonian Talmud Megillah 1:430

And the king said to the wise men. Who are the wise men? The rabbis. “Who knew the times”: that is, who knew how to intercalate years and fix new moons. He said to them: Try her for me. They said [to themselves]: What shall we do? If we tell him o put her to death, tomorrow he will become sober again and he will require her from us. Shall we tell him to let her go? She disrespected royalty. So they said to him: From the day when the Temple was destroyed and we were exiled from our land, counsel has been taken from us and we do not know how to judge capital cases. Go to Ammon and Moab who have remained in their places like wine that has settled on its lees. They spoke to him thus

Babylonian Talmud Megillah 4:132

It was taught: R. Shimon b. Yohai said: Come and see how beloved are Israel to God—... every place to which they were exiled the Shekhinah (God’s Divine Presence) went with them. They were exiled to Egypt and the Shekhinah was with them, as it says, “Did I reveal myself to the house of your father when they were in Egypt” (II Samuel 2:27). They were exiled to Babylon, and the Shekhinah was with them, as it says, “For your sake I was sent to Babylon” (Isaiah 43:14). And when they will be redeemed in the future, the Shekhinah will be with them, as it says, “Then the Lord your God will return [with] your captivity” (Deuteronomy 30:3). It does not say here veheshiv [and He shall bring back] but veshav [and he shall return]. This teaches us that the Holy One, blessed be He, will return with them from the places of exile.

Babylonian Talmud Makkot 1:10

R' Yochanan says A fortiori, if the one that intentionally acted is not exiled then the one that did not act [i.e. he spoke], even though he did it intentionally, should not be exiled.

R' Yochanan says A fortiori, if the one that intentionally acted is not exiled then the one that did not act [i.e. he spoke], even though he did it intentionally, should not be exiled.

That should be proof. The one that intentionally acted is not exiled because we do not give atonement. The accidental murderer we exile for the sake of atonement. Rather we follow R' Lakish

Babylonian Talmud Makkot 2:1

Mishnah: These are the exiles: One who kills someone accidentally. One was rolling with a roofer and it fell on him [a passerby] and killed him; one who was pulling up a barrel and it fell on him and killed him; one who was descending a ladder and it fell on him and killed him—[in all these cases] behold he is exiled. However, if he was pulling with a roofer and it fell on him [a passerby] and killed him; or he was lowering a barrel and the rope broke and it [the barrel] fell on him and killed him;

He challenged him "This is the general rule: anything that is within a downward movement, [that person] is sent to exile. Anything not in a downward movement [that person who initiated the act] is not exiled." And what does this "anything not in a downward movement include?" Does it not include this case?! [where the rung is downward and you are moving up, where, according to this general rule, that person would not be culpable for the rung falling]. But according to your reasoning, [the rule that] anything that is in the way of descent includes what?!

Babylonian Talmud Makkot 2:18

Mishnah: If the iron axe head slipped from its handle and it killed someone, Rebi says he isn't exiled, and the Sages say that he is exiled. If [a wood chip] from the tree broke off [and that wood chip killed someone], Rebi says he is exiled, and the Sages say that he isn't exiled.

Mishnah: The one who throws a stone into the public domain and killed [someone], behold, he is exiled. Rabbi Eliezer ben Yaakov says: If, from when the stone left his hand, another person stuck out their head and received [the stone and was killed], behold, he is exempt [from exile].

Babylonian Talmud Makkot 2:26

The one who threw a stone into his courtyard and he killed [someone], if there was permission for the victim to enter there, [the thrower] is exiled. And if [the victim does] not [have permission], he is not exiled. As it was said: “When a person comes upon his friend in a forest” (Deuteronomy 19:5). Just as in a forest it is permitted for the perpetrator and the victim to enter there [because it is public space], so too [the same rules apply in] any [place where it is] permitted for the perpetrator and the victim to enter there, except the courtyard [in which] the owner has not given permission to the victim (or the perpetrator) to enter there.

Babylonian Talmud Makkot 2:34

The one who throws the stone, etc. One of the rabbis said to Rava: From what [basis are we stating the case] that he is cutting wood because it is optional? Perhaps he is cutting wood because [it is for a] sukkah or cutting wood [for the altar] (which would be a requirement and not an option), and even this, Scripture said, he should be exiled [for doing something required]?! He (Rava) said to him: since he found it cut and he does not cut [it himself], it is not a mitzvah, also now [regarding cutting wood] is not a mitzvah.

Mishnah: A father is exiled because of [killing accidentally] his son and the son is exiled by way of [killing accidentally] his father. Any person is exiled by way [killing accidentally] an Israelite and an Israelite is exiled by way of [killing accidentally] them except for a foreign resident. A foreign resident is only sent to exile for a [killing a fellow] foreign resident.

Gemara: "The father is exiled for his son." But didn't you say (in an earlier Mishnah) that a father who strikes his son is not exiled? But he was learned (which is why he would be exiled, since it was not a hit of a Mitzvah). But you said, even when he is learned, it actually is a Mitzvah that he is doing [so he would not be exiled]. [Here, we're talking about when the father is a carpenter and his son] is a carpenter's apprentice [so he is just teaching him a trade—and he would not be exiled].
