And when Jacob saw that he was (so) evilly disposed towards him with his heart, and with all his soul as to slay him, and that he had come springing like the wild boar which comes upon the spear that pierces and kills it, and recoils not from it;
And every man who does any work thereon, or goes a journey, or tills (his) farm, whether in his house or any other place, and whoever lights a fire, or rides on any beast, or travels by ship on the sea, and whoever strikes or kills anything, or slaughters a beast or a bird, or whoever catches an animal or a bird or a fish, or whoever fasts or makes war on the Sabbaths:
NT Apocrypha/Pseudepigrapha
They saw a Samaritan carrying a lamb to Judea. He said to his disciples, "What do you think he's going to do with that lamb?" They said to him, "He's going to kill it and eat it." He said to them, "While it's living, he won't eat it, but only after he kills it and it becomes a corpse." They said, "He can't do it any other way." He said to them, "You, too, look for a resting place, so that you won't become a corpse and be eaten."
“(God) knows about desire and what the flesh needs. It’s not this (flesh) which desires the soul, because without the soul, the body doesn’t sin, just as the soul isn’t saved without the spirit. But if the soul is saved without evil, and the spirit is also saved, then the body becomes sinless. For it’s the spirit that raises the soul, but the body that kills it; that is, (the soul) kills itself.

OT Pseudepigrapha
Then God said unto Cain, "Whosoever shall find thee shall not kill thee;" because before this, God had been saying to Cain, "I shall forego seven punishments on him who kills Cain." For as to the word of God to Cain, "Where is thy brother?" God said it in mercy for him, to try and make him repent.
And in the word of God that said, "I will forego seven punishments on whomsoever kills Cain," God was not seeking to kill Cain with the sword, but He sought to make him die of fasting, and praying and weeping by hard rule, until the time that he was delivered from his sin.
But whoever kills beast without wounds, kills his own soul and defiles his own flesh.
But whoever kills beast without wounds, kills his own soul and defiles his own flesh.
HE who works the killing of a man's soul, kills his own soul, and kills his own body, and there is no cure for him for all time.
HE who works the killing of a man's soul, kills his own soul, and kills his own body, and there is no cure for him for all time.
Let us not fear him who thinketh he kills; for a great struggle and peril of the soul awaits in eternal torment those who transgress the ordinance of God.
Church Orders
If any one of the clergy strikes one in a quarrel, and kills him by that one stroke, let him be deprived, on account of his rashness; but if he be one of the laity, let him be suspended.
The Mishnah
In what ways is he like both men and women? One who strikes him or curses him is liable, as in the case of men and women; One who unwittingly kills him must go into exile, and if on purpose, then [the slayer] receives the death penalty, as in the case of men and women. His mother must [at his birth] bring an offering, as in the case of men and women. He may eat holy things that are eaten outside of the Temple; And he may inherit any inheritance, as in the case of men and women.
Cases concerning offenses punishable by death [are decided] by twenty three. A beast that has sexual relations with a woman or with a man is [judged] by twenty three, as it says, “You shall execute the woman and the beast” (Lev. 20:16) and it says, “You shall execute the beast”. The ox that is stoned [is judged] by twenty three, as it says, “The ox shall be stoned and also its owner shall be put to death” (Exodus 21:29), as is the death of the owner, so too is the death of the ox. The wolf, the lion, the bear, the leopard, the panther, or serpent [that have killed a human being] their death is [adjudicated] by twenty three. Rabbi Eliezer says: “Anyone who kills them before they come to court merits.” But Rabbi Akiva says: “Their death must be [adjudicated] by twenty three.
The generation of the flood has no portion in the world to come, nor will they stand at the [last] judgment, as it says, “[And the Lord said,] my spirit will not always enter into judgment with man” (Genesis 6:3), [meaning] there will be neither judgment nor [my] spirit for them. The generation of the dispersion have no portion in the world to come, as it says, “So the Lord scattered them from there upon the face of all the earth” (Genesis 11:8): “So the lord scattered them”, refers to this world, “And from there the Lord scattered them” (Genesis 11:9), refers to the world to come. The men of Sodom have no portion in the world to come, as it says, “And the men of Sodom were wicked and great sinners before the Lord” (Genesis 13:1: “wicked” in this world, and “sinners” in the world to come; Yet will they stand at judgment. R. Nehemiah says: “Neither [the generation of the flood nor the men of Sodom] will stand at judgment, as it says, “Therefore the wicked shall not stand in judgment, nor sinners in the congregation of the righteous” (Psalms 1:5) “Therefore the wicked shall not stand in judgment”, refers to the generation of the flood; “nor sinners in the congregation of the righteous”, refers to the men of Sodom. They [the Sages] said to him: “They will not stand in the congregation of the righteous, but they will stand in the congregation of the wicked.” The spies have no portion in the world to come, as it says, “And those men that spread such calumnies about the land, died by the plague before the lord” (Numbers 14:37): “[they] died” in this world, “by the plague” in the world to come. The generation of the wilderness have no share in the world to come and will not stand at the [last] judgment, as it says, “In this wilderness they shall be consumed, and there they shall die” (Numbers 14:3, according to the words of Rabbi Akiba. Rabbi Eliezer says: “Concerning them it is said, ‘Bring in My devotees, who made a covenant with Me over sacrifice” (Psalms 50:5). The congregation of Korah is not destined to ascend [from the earth], as it says, “And the earth closed upon them” in this world, “and they perished from among the congregation” (Numbers 16:33) in the world to come, according to the words of Rabbi Akiba. Rabbi Eliezer says: “Concerning them it is said, ‘The Lord kills and makes alive: He brings down to Sheol, and brings up” (I Samuel 2:6). The ten tribes will not return [to the Land of Israel], for it is said, “And He cast them into another land, as is this day” (Deuteronomy 29:2: just as the day goes and does not return, so they too went and will not return: according to the words of Rabbi Akiba. Rabbi Eliezer says: “As is this day’, just as the day darkens and then becomes light again, so the ten tribes even as it went dark for them, so will it in the future become light for them.
The following go into banishment: one who kills in error. If [for instance] while he was pushing a roller [on the roof] and it fell down and killed somebody; If while he was lowering a cask it fell down and killed somebody; If while coming down a ladder he fell on somebody and killed him, he goes into banishment. But, if while he was pulling up the roller it fell back and killed somebody; If while he was raising a cask and the rope snapped and the cask fell and killed somebody; If while going up a ladder he fell down and killed somebody, he does not go into banishment. This is the general principle: [whenever the death was caused] in the course of a downward movement, he goes into banishment, but [if it was caused] not in the course of a downward movement, he does not go into banishment. If the iron slipped from its heft and killed [somebody]: Rabbi says, “He does not go into banishment.” And the Sages say: “He goes into banishment.” If it flew from the log being split: Rabbi says, “He goes into banishment.” And the Sages say: “He does not go into banishment.”
If the trial was concluded when there was no high priest [in office], or if one kills a high priest, or a high priest that kills, [in these cases the manslayer] can never come away from that place [of refuge]. He [the manslayer] may not go out to bear witness, neither for cases having to do with a religious observance, nor to bear witness in a monetary suit, nor to bear witness in a capital case. Even should [all] Israel need him, and even a general like Yoav the son of Zeruiah, he may never go out, as it is said, “to there he fled”: ‘there’ must be his abode, ‘there’ his death, ‘there’ his burial. Just as the city affords asylum so does its Sabbath boundary afford asylum. If a manslayer went beyond the boundary [of the city] and the blood avenger found him: Rabbi Yose the Galilean says: “For the avenger it is a matter of obligation [to kill him]; for everyone else, a matter of option.” Rabbi Akiba says: “It is a matter of option for the avenger, and anyone else [who kills him] is not liable for doing so.” If a tree was standing within the boundary and its boughs extended beyond [the boundary] or if it was standing outside of the boundary and its boughs extended within, it wholly follows [the position of] the boughs. If he slew [someone] in that city [of refuge] he is banished from one neighborhood to another neighborhood. And a Levite is banished from one city to another.

There are [laws] which apply to dedications for the altar which do not apply to dedications for repairs of the Temple, and there are [laws] which apply to dedications for the repairs of the Temple which do not apply to dedications for the altar. Dedications for the altar effect a substitute; They are subject to the laws of piggul, remnant and ritual uncleanness; Their offspring and milk are forbidden [even] after their redemption; If one kills them outside [the Temple] he is guilty; And wages are not paid from them to artisans, Which is not the case with dedications for temple repairs.
A girl one day old defiles due to menstruation. A girl ten days old defiles due to zivah. A boy one day old defiles due to zivah, and defiles due to scale disease and due to corpse uncleanness; He subjects [his deceased brother's widow] to yibbum [levirate marriage]; He exempts [his mother] from yibbum, He enables her to eat terumah And he disqualifies her from eating terumah; He inherits and transmits inheritance; He who kills him is guilty of murder, And he counts to his father, to his mother and to all his relatives as a fully grown man.
The Jerusalem Talmud
Why does one read these two sections every day? Rebbi Simon says because they mention lying down and getting up. Rebbi Levi said, because the Ten Commandments are contained in them. “I am the Eternal, your God.” - “Hear, o Israel, The Eternal, our God.” “You should not have any other gods before me.” - “The Eternal is One.” “Do not take the name of the Eternal, your God, in vain.” - “You must love the Eternal, your God.” He who loves the king will not swear in his name and lie. “Remember the Sabbath day to sanctify it.” - “So that you shall remember;” Rebbi said: that is the commandment of Sabbath which is as important as all other commandments of the Torah together, as it is written (Neh. 9:14): “You informed them about Your Sabbath, commandments, laws, and Torah you commanded them, …” to show that it is as important as the other commandments of the Torah. “Honor your father and mother” - “So that your days and the days of your children should increase.” “Do not murder” - “You will soon be lost.” He who kills will be killed. “Do not commit adultery” - “Do not stray after your hearts and after your eyes.” Rebbi Levi said: heart and eye are the two agents of sin. It is written (Prov. 23:26) “My son, give Me your heart; your eyes should watch My ways.” The Holy One, Praise to Him, says: If you give me your heart and eyes I know that you are mine. “Do not steal” - “You shall harvest your grain,” not your neighbor’s grain” “Do not testify against your neighbor as a false witness,” - “I am the Lord, your God.” And it is written (Jer. 10:10) “But the Lord is the God of truth.” What is truth? Rebbi Abun said: that (Jer. 10:10) “He is God of life and king of the world.” Rebbi Levi said: The Holy One, praise to Him, said, if you gave false testimony against your neighbor, I count that against you as if you gave testimony against Me that I did not create heaven and earth. “Do not covet your neighbor’s house” - “You shall write them on the doorposts of your house,” your house and not your neighbor’s house.
Rebbi Phineas gave on this subject two sermons, one in the name of Rebbi Zeïra, the other in the name of Rebbi Tanḥum bar Ḥanilai. Rebbi Phineas said in the name of Rebbi Zeïra, flesh and blood has a protector. If he bothers him too much, he will say: “There is X who will bother me.” But the Holy One, praise to Him, is not like that; He will receive you with all that you might bother him with. That is what is written (Ps. 55:23) “Throw on the Eternal your burden and He will provide for you!” Rebbi Phineas said in the name of Rebbi Tanḥum bar Ḥanilai, flesh and blood has a protector. Enemies come and grab him at the door of his protector’s courtyard. While he is crying and before someone could come out, the sword already passes over his neck and kills him. But the Holy One, praise to Him, saved Jehoshaphat from the sword of the Syrians as it is written (2Chr. 18:34): “Jehoshaphat cried, the Eternal helped him and God turned them away from him.” That shows that only the cutting off of the head was missing, but God deflected them from him.
Why is it called “triple?” Because it kills three: The one who says it, the one who accepts it, and the one calumniated. And in the days of Saul, four were killed: Doeg who said it, Saul who accepted it, Aḥimelekh who was calumniated, and Abner. Why was Abner killed? Rebbi Joshua ben Levi, Rebbi Simeon ben Laqish, and the rabbis. Rebbi Joshua ben Levi said, because he made fun of the lives of his squires as it is said (2Sam. 2:14): “Let the squires get up and play before us, and Joab said, let them get up.” R. Simeon ben Laqish, because he prefaced his name before that of David; that is what is written (2Sam. 3:12) “Abner sent messengers to David the underling, saying: Whose is the land?” He wrote: From Abner to David. The rabbis say, because he did not let Shaul make peace with David. That is what is written (1Sam. 24:5): “My father, see, but see the corner of your coat in my hand!” He said to him, what do you want from the prattling of this one, it was torn off by thorns. But when they came to the circle, he said to him (1Sam. 26:14): “Can you answer, Abner?” About the corner, you said it was torn off by a thorn; were spear and pitcher cut off by a thorn? But some say, because he had it in his power to intervene for Nob, the city of priests, and he did not intervene.
(Ps. 120:4) “The arrows of a hero are sharpened over hot broom coals.” All weapons kill at their place but this kills at a distance. All other charcoal that is extinguished on the outside, is also extinguished on the inside, but these, even though they are extinguished on the outside, are still burning on the inside. It happened to one that he put down burning charcoal on Sukkot and came and found them still burning on Pesaḥ.
Rebbi Samuel ben Naḥman said: One says to the snake, why when you move does your tongue flow? It said to them, that caused it for me. What profit do you have from biting? A lion tears up and eats, a wolf tears up and eats; you, what profit do you have from biting? It said to them (Eccl. 10:11): “If the snake would bite without a whisper,” I would not bite unless it was said to me from heaven: bite! Why do you bite one limb and all limbs feel it? It said to them: Why do you ask me? Ask the master of the tongue who speaks here and kills in Rome, speaks in Rome and kills in Syria. Why are you found among fences? It said to them, I broke the fence of the world

Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba: All poisons cause scab but the poison of a snake kills. Rebbi Jeremiah asked Rebbi Zeïra. As the master of the ruling, could he have asked?
Mishnah “He should not check his garments for lice nor read by candlelight,” etc. Even on weekdays it is forbidden since it is not decent. It was stated: One who checks his garments takes and throws away; only he should not rub. Abba Shaul says, he may rub and throw away, only he should not kill. Ḥizqiah said, one who kills a louse is like one who kills a camel. Samuel broke off its hands and feet and gave if to the children. Rebbi Yose ben Rebbi Abun put it in a flask. Rebbi Simeon ben Ḥalafta said, did we not understand this from the purple snail? Does the purple snail have sinews and bones? But was it not stated: Any which has neither sinews nor bones does not live more than six months? For Rebbi Yose ben Rebbi Abun said in the name of Rav Zevid, the Holy One, praise to Him, turns around His world once in seven years. Qamqama turns into Ḥu-Rav-Padah. Ḥar-Efer turns into Šer. The head louse turns into a scorpion and the one of garments into a lizard. A horse worm turns into a wasp, that of cattle into a bee. A male hyena turns into a female, a field rat turns into a wild boar. The spine of a fish turns into a centipede, of a human into a snake. When? If he does not bow down with his entire spine.

“Ben Bathyra permits horses.” Rebbi Jehudah said this only about a male horse because it kills [its owner] in war. Some say, because it runs after a female, and some say, because it stands still to urinate. What is between them? A gelding. He who says because it runs after a female, [this one] does not run after a female. He who says because it stands still to urinate, this one also stands still to urinate. Rebbi Aḥa in the name of Rebbi Tanḥum bar Ḥiyya: If it gets old he binds it to the grindstone. Rebbi Yose ben Rebbi Abun in the name of Rebbi Ḥuna: Ben Bathyra and Rebbi Nathan both said the same, as it was stated: “If he carried domestic animals, wild animals, or birds, whether alive or dead, he is liable. Rebbi Nathan says, dead he is liable, alive he is not liable.” The rabbis hold that he is liable for a purification sacrifice and they answer him so? They answer following his own argument. Following your argument, since you are saying because of rabbinic Sabbath prohibition, also we hold that if it gets old he binds it to the grindstone. Rebbi says, I am saying that it is forbidden for two reasons, as a weapon and as a large animal. It was stated so: A large wild animal is like a large domestic animal. Who stated this? Rebbi. The words of the Sages: Rebbi Bisna, Ḥanin bar Abba in the name of Rav: A wild animal is like a small domestic animal.
“And they spread out the cloth.” That is all simile. Rebbi Ismael stated: That is one of three verses in the Torah which have been written as simile. “If he gets up and walks outside on his support, the one who hit him is not prosecuted.” Could anybody think that one walks in the market and the other is executed because of him? But what is “on his support”, in his health. “If the sun shone on him, he has blood.” Does the sun shine only on him? But just as the sun is particular that it brings peace to the entire world, so also this one, if one knows that [the other] is at peace with him and he kills him, he is guilty.
HALAKHAH: “A bull which was rubbing itself against a wall,” etc. “A man who kills any human soul,” to include a hit which is potentially deadly. Some Tannaïm state, even if it is not deadly. Rebbi La said, even if it is deadly but a third person came and killed, the killer is guilty. “And it killed a man or a woman,” just as a man lets his sons inherit his injury claims, so a woman lets her sons inherit her injury claims. But does not a man inherit from his wife? Rebbi Simeon ben Laqish said, so did Rebbi Hoshaiah, the father of the Mishnah, explain: One teaches here about weregilt which is due after death.
Alexander the Macedonian went to the king of Cassia. He saw that he had much gold, much silver. He told him, I do not need your gold nor your silver; I came only so see your practice, how you are dealing, how you are judging. While he was still discussing with him, there came a man having a dispute with another, for he bought (a plot, entered it) [a garbage heap, dug in it] and found a treasure trove of denars. The buyer said, I bought a garbage heap, I did not buy a treasure. The seller said, I sold a garbage heap and all it contains. While they still were arguing with one another, the king asked one of them, do you have a male son? He answered, yes. He asked the other one, do you have a female daughter? He answered, yes. He told them, marry them to each other and the treasure should belong to both. He started to laugh. He asked him, why are you laughing? Did I not judge correctly? He asked him, if the case came before you, how would you have judged? He told him, one kills both of them and the treasure falls to the king. He told him, do you love gold so much? He made him a meal and brought before him golden meat, golden chicken. He asked him, can I eat gold? He told him, the spirit of this person should be wiped out. You cannot eat gold, why do you love gold so much? He asked him, does the sun shine upon you? He answered, yes. Does rain fall on you? He answered, yes. He asked him, do you have small animals? He answered, yes. The spirit of this person should be wiped out; you live only by the merit of the small animals, as it is written: “Man and animal You are saving, o Eternal!”
Rebbi Joḥanan said, anybody who cannot argue for the crawling animal to make it pure a hundred times cannot start arguing for acquittal. How does one argue about a crawling animal? Rebbi Joḥanan said, since a snake which kills is pure, a rat which does not kill logically should be pure. Since a rat which does not kill is impure, a snake which kills logically should be impure. Rebbi Phineas objected: Is there not the scorpion which kills and is pure? It was found that a Tanna said, snake and scorpion both follow the same rules.

It is written: If the thief was found in a tunnel, was smitten, and died, there is no blood-guilt. Rebbi Ḥiyya stated: In the tunnel there is no blood-guilt, outside the tunnel there is blood guilt. Rebbi Simeon ben Ioḥai stated: Even outside the tunnel there is no blood-guilt, for a person’s property is beloved by him like his own soul. He sees him, that he comes to take his money away from him, stands up against him and kills him. Rav Huna said, if he took a wallet, turned to leave and went, if then one stood up against him and killed him the killer will not be killed. What is Rav Huna’s reason? For his temper is hot. Rav said, I would kill anybody who would come against me, except Ḥanania ben Shila, of whom I know that he would come only to take his meal from me. Rebbi Isaac said, if he has the temerity to do something like that, he cannot be Ḥanania ben Shila.
They and everything that belonged to them descended alive into the pit. Rebbi Berekhiah in the name of Rebbi Ḥelbo, even their names flew away from their papyrus rolls. Rebbi Yose ben Ḥanina said, even one of their needles that was in the hand of an Israel as a loan was swallowed up with them, for it is written: They and everything that belonged to them descended alive into the pit. Who prayed for them? Rebbi Samuel bar Naḥman said, Moses prayed for them, Reuben shall live and not die. Rebbi Joshua ben Levi said, Hannah prayed for them. This is Rebbi Joshua ben Levi’s opinion, as Rebbi Joshua ben Levi said in the name of Rebbi Yose: Koraḥ’s (opinion) [band] was continuously sinking until Hannah stood up and said, the Eternal kills and brings to life, He sends down into the pit and lifts.
And denied the Resurrection of the Dead. You find that at the time when Elisha came to resurrect the Shunamite’s son, he told him: Take my support staff in your hand and go, and if you meet a man do not greet him, or if a person greets you do not answer him. But he did not do that, but when a person met him and asked, from where and to where, Geḥazi? He told him, I am going to resurrect the dead. This one would tell him, only the Holy One, praise to Him, can resurrect the dead, as it is written: The Eternal kills and gives life, brings down to the pit and lifts up. He went there and did not do anything. He returned to him and said to him, I know that if he really were dead, he would not wake up through you.
MISHNAH: The generation of the desert has no part in the World to Come, as it is said: in this desert they shall be terminated and there they will die, the words of Rebbi Aqiba. Rebbi Eliezer says, about them it says, assemble for Me My lovely ones, who sealed My Covenant by a sacrifice. The band of Korah will not be resurrected in the future, as it is said the earth covered them; they were lost from among the congregation, the words of Rebbi Aqiba. Rebbi Eliezer says, about them it says, the Eternal kills and brings to life, He sends down into the pit and raises up.
Who prayed for them? Rebbi Samuel bar Naḥman said, Moses prayed for them, Reuben shall live and not die. Rebbi Joshua ben Levi said, Hannah prayed for them. This follows Rebbi Joshua ben Levi, as Rebbi Joshua ben Levi said: Korah’s band was continuously sinking until Hannah stood up and said, the Eternal kills and brings to life, He sends down into the pit and lifts up.
“Ben Bathyra permits horses.” Ben Bathyra said this only about a male horse because it kills its owner in war. Some say, because it runs after females, and some say, because it stands still to urinate. What is between them? A gelding. He who says because it runs after females, it does not run. He who says because it stands still to urinate, this one also stands still to urinate. [Rebbi Aḥa in the name of] Rebbi Tanḥum bar Ḥiyya: If it gets old he binds it to the grindstone. Rebbi Yose ben Rebbi Abun in the name of Rebbi Huna: Ben Bathyra and Rebbi Nathan both said the same, as it was stated: “If he carried out domestic animals, wild animals, or birds, whether alive or dead, he is liable. It was stated so: A large wild animal is like a (small) [large] domestic animal. Who stated this? Rebbi. The words of the Sages: Rebbi Bisna, Rebbi Ḥanan bar Abba in the name of Rav: A wild animal is like a (large) [small] domestic animal.
Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba: All poisons cause scab but the poison of a snake kills. Rebbi Ḥiyya said, one is not asked about uncovered [drinks]. Rebbi Jeremiah asked before Rebbi Ze`ira; as master of the ruling he asked him.
“They added to this the sword, the crown, and the ring.” The sword with which he kills, the crown with which he crowns himself, the ring with which he seals.
The Babylonian Talmud
He put it on his shoulder and brought it to the House of Study. He said to them, "See, my sons, it is not the lizard that kills but sin that kills."

Our Rabbis have taught : A small salted fish sometimes kills on the seventh, the seventeenth and twenty-seventh, and some say the twenty-third day. This applies only to the case where it has been roasted but not roasted [thoroughly] ; but if it has been well-roasted, there is no objection. And when it has been well-roasted, it only applies to the case where one does not drink beer after it ; but if he drinks beer after it, there is no objection.
R. Jochanan, when he came upon this passage, wept, "For God shall bring every work into judgment concerning every hidden thing" (Eccles. xii. 14). A slave, whose master punishes sins of error as though they were sins of presumption—is there any help for him? What is the meaning of "concerning every hidden thing"? Rab said, This means the man who kills a louse in the presence of his neighbour, so that he is disgusted at it. But Samuel said, This means the man who spits in the presence of his neighbour, so that he is disgusted. What is the meaning of "whether it be good or whether it be evil"? The men of the house of R. Jannai say, This is he that gives a coin to a poor man publicly. For this story is told of R. Jannai himself. He saw a man who gave a coin to a poor man publicly. He said to him, It had been better that thou hadst not given it to him now, for thou hast given it to him and hast put him to shame. The men of the house of R. Shila say, This is he that gives alms to a woman secretly, because he brings her into suspicion. Rabba said, This is he that sends home to his wife meat that is not bled on the eve of the sabbath. But lo, on the other hand, Rabba himself sent such home. Ah, but it was a different matter as regards the daughter of R. Chasda, for he was certain about her, as being a woman of experience.
We don't make them a son of a divorcee or a son of a Levirite marriage, as we said before and we don't exile them to a city of refuge as we said before, and we don't make them pay compensation (regarding a violent ox that kills) [because] the compensation is an atonement, and false witnesses do not need atoning.
Mishnah: These are the exiles: One who kills someone accidentally. One was rolling with a roofer and it fell on him [a passerby] and killed him; one who was pulling up a barrel and it fell on him and killed him; one who was descending a ladder and it fell on him and killed him—[in all these cases] behold he is exiled. However, if he was pulling with a roofer and it fell on him [a passerby] and killed him; or he was lowering a barrel and the rope broke and it [the barrel] fell on him and killed him;
Gemara: From where is it derived [that downward motion that kills someone is punished by exile]? Shmuel said that the verse said: “And he cast it upon him, and he died” (Numbers 35:23) [meaning] until it falls in the way of falling.
“Without awareness” (Deuteronomy 19:4) excludes intentionality. Intentionality is obvious! He is liable for death!? Rabbah said: This excludes [when] he intends to kill an animal and kills a person, [when he intends to kill] a Cutite and kills a Jew, [when he intends to kill] a stillbirth and kills a viable infant.

Ravina challenged Rava (all the cases to follow are where the person is in pursuit of a Mitzvah so they would not be punished with exile): This excludes the case of a father who strikes his son (and kills him inadvertently), and the teacher who rebukes his student (and inadvertently kills him) and the court agent (who inadvertently killed). So, why (is this a mitzvah to hit one's son, etc?). Let us say that since he was already learned (the son), it's not actually a Mitzvah to strike him (again) so here too, it is also not a Mitzvah. (Rava:) There, despite the fact that he's already learned, it is still a Mitzvah to hit him, as it is stated, "rebuke your son and he will bring you rest."

For the Rabbis who say beheading is more severe than strangulation: one who inadvertently kills his father, this is inadvertent sin [that would be punished, if done intentionally, with] beheading, so such an inadvertent sin would be given atonement [through exile—so this is the opinion of our Mishnah].
"Everyone gets exiled for killing an Israelite accidentally, and vice versa] except through [killing accidentally] a foreign resident." Therefore, a foreign resident is [considered] an idol worshiper! But read the end [of the Mishnah]! "A foreign resident is exiled on account of [killing accidentally] a foreign resident [which would imply that they aren't like idol worshipers as they actually get exiled]! Rav Kahanah said: This is not a difficulty. Here [where the punishment is exile] is where a foreign resident kills a foreign resident, and here [where he does not get exile] is where a foreign resident kills an Israelite.

the Holy Blessed One arranged one marketplace. The one who killed intentionally sits beneath the ladder, and the one who killed accidentally is descending the ladder, and he falls on him and kills him [the murderer]. That one who killed intentionally is killed, and that one who killed accidentally is exiled."
Rav Huna said: "A murderer that is exiled to a city of refuge, and the blood avenger finds him and kills him—he is exempt." He [Rav Huna] thinks "And for him there is no death penalty" (Deuteronomy 19:6)—about the blood avenger it is written. [Pay close attention to this verse and you will see that it's actually ambiguous, though at first it seems obvious what it means].
It was taught [in a Mishnah]: "They handed him [the manslayer] over to two students of the Sages lest he [the blood avenger] kill him on the road, and they will speak to him." Is it not so that they are warning him that if he kills [the manslayer] he would be liable for the death penalty?
What is the reason of Rebbi Yossi Hagalili? [He would say,] does [the Torah] write, "If" he kills? And Rebbi Akiva? [He would say,] Does [the Torah] write, he "shall" kill?
Mar Zutra bar Tuvia says in the name of Rav, If a murderer leaves the boundrary and the Goel Hadam finds him and kills him, he [the Goel Hadam] is executed. Who is this in accordance with? It isn't like Rebbi Yossi Hagalili nor like Rebbi Akiva?
But according to the one who teaches Bitlo v'lo Bitlo, then while [a way to nullify the remedial commandment] can be found regarding Shiloach Haken [i.e. sending away the mother bird, for example where he kills the mother bird], but with regards to Oneiss how can you find a case of Bitlo v'lo Bitlo?
If he kills her [thus nullifying his ability to perform the remedy of remarrying her], the [he would be exempt based of the principle of] Kim Leih B'dirabah Me'neih [that anyone liable to the death penalty is exempt from all else.] Rav Shimi miChuznah proposed in a case where he accepted on her behalf Kidushin from another man. Rav asked If she had appointed him as her agent, then is he the one nullifying it? And if she had not appointed him as her agent then is anything even coming from his actions? They would be meaningless!
