From where that there is a clear commandment? Rebbi Eleazar in the name of Rebbi Simai: I did not give from it to the dead. Where do we hold? If not to bring a casket or shrouds for him, this is forbidden for the living, therefore certainly for the dead. What is permitted for the living but prohibited for the dead? I am saying that this is anointing.

Simeon, the son of the Nazir said in the name of Rebbi Isaac If a Sage’s pronouncement in matters of practice is mentioned in this world, the latter’s lips whisper with him in the grave for it is said, dripping from the lips of the sleeping ones. What good does that do to them? The son of the Nazir says, like one who drinks spiced wine; Rebbi Isaac said, like one who drinks old wine, even though he cannot taste it.

But baking, she should bake only what she needs.” For it is stated: “Rebbi Simeon ben Eleazar says, a woman may fill the entire oven with bread because the bread turns out well if the oven is filled.” Rav Ḥuna preached following Rebbi Simeon ben Eleazar. Rebbi Joḥanan preached to the Tiberians following that of Rebbi Simeon ben Eleazar. He preached this as practice but they took it as to act on. Some wanted to say that he preached to act on. They came and asked him and he preached as practice, and they preached again but we do not know whether as practice or to act on. Rebbi Abba bar Zavdi said, Rebbi Abbahu instructed following Rebbi Simeon ben Eleazar.
Rebbi Ḥanina bar Yaqqa in the name of Rav Jehudah: The roots of wheat split the earth to a depth of 50 cubits. The soft roots of a fig tree split rock. I, the Eternal, watch over it and water it in.” [It has been stated: Rebbi Simeon ben Eleazar says, the earth drinks only according to its hardness.]

It was stated: “On a Ninth of Av which falls on a Friday he eats even an egg and drinks even a cup full, in order not to enter the Sabbath being deprived, the words of Rebbi Jehudah. Rebbi Yose says, he fasts and finishes.” Rebbi Ze`ira in the name of Rav Jehudah, Rebbi Immi bar Ezechiel in the name of Rav: Practice follows him who says, he fasts and finishes. Why does he not say, practice follows Rebbi Yose? There are Tannaim who switch the names of the sages. Rebbi Ze`ira in the name of Rav Ḥuna: Even an individual who decided for himself to fast on a Friday fasts and finishes. As the following: Rebbi Bevai was sitting before Rebbi Yasa; he wanted to learn from him this matter. He said, let me go home a little bit. He said to him, it is afternoon. He answered, I am fasting. He said to him, I have lupines with me. He answered, and one finishes following Rebbi Yose.
Samuel said, if he entered without intending to use it as a short-cut he may use it as short-cut. It was stated: “One may not behave unbecomingly in synagogues and houses of study. One neither eats nor drinks in them, nor takes walks in them, nor sleeps in them, nor enters into them because of the sun in summer or because of the rain in winter, but one studies and preaches in them.” Rebbi Joshua ben Levi said, synagogues and houses of study are for the sages and their students. Rebbi Ḥiyya, Rebbi Yasa were received in the synagogue. Rebbi Immi commanded to the teachers, if a person comes to you who is dirtied by study, accept him and his donkey and his implements. Rebbi Berekhiah went to the synagogue of Bet-Shean. He saw a man washing his hands and feet from its pail. He told him, it is forbidden to you. On the next day this man saw him washing his hands and feet from its pail. He said to him, Rabbi, to you it is permitted and to me it is forbidden? He answered him, yes. He asked, why? He said to him, so says Rebbi Joshua ben Levi: synagogues and houses of study are for the sages and their students. These fore-courts, may one pass through them? Rebbi Abbahu passed through its fore-court. Is it permitted? Rebbi Zachariah the son-in-law of Rebbi Levi said, the teacher was intimidating and if Rebbi Abbahu had not passed through he would not have let go the children.
There, we have stated: “A staff which is full of impure fluids, when it touched the miqweh it is pure, the words of Rebbi Joshua. But the Sages are saying, only if he immerses it completely.” Rebbi Simeon ben Laqish said, where do they disagree? For easy impurity; but for severe impurity even Rebbi Joshua agrees. Rebbi Joḥanan said, they even disagree for severe impurity. A baraita disagrees with Rebbi Simeon ben Laqish: “As long as his feet are in the water, he may consider himself pure for any stage he chooses.” Explain it about one who ate impure food and drank impure drinks. Did not Rebbi Jacob bar Zavdi, Rebbi Abbahu say in the name of Rebbi Simeon ben Laqish, the body of one who ate impure food and drank impure drinks is pure without special intention? From the moment he intended elevated purity he (needs) [does not need] intention. A Mishnah disagrees with Rebbi Simeon ben Laqish: “A miqweh containing exactly 40 seah into two persons descended, [both are pure]. One after the other, the first one is pure, the second impure. Rebbi Jehudah says, if the feet of the first touched the water, the second one also is pure.” Still this is about one who ate impure food and drank impure drinks. A baraita disagrees with Rebbi Simeon ben Laqish: A woman in her period may rinse a radish in a cave and it is pure. If she lifted it in any way out of the water it is impure. And we have stated thereto: Rebbi Jehudah declares it pure in the name of Rebbi Joshua. And represents a menstruating woman not a severe impurity? This disagrees with Rebbi Simeon ben Laqish and it has no standing.

May the body of a Pharisee be considered like that of a sufferer from gonorrhea for heave? Rebbi Joḥanan asked, but did we not state, “somebody who let a vulgar watch his house, at times when he sees those who enter and those who leave, food, and drinks, and open clay vessels are impure. But couches and seats and clay vessels tightly wound closed are pure”? If you are saying, they considered the body of a Pharisee like that of a sufferer from gonorrhea for heave then even those tightly [wound] closed should be impure. Rebbi Jehudah bar Pazi said, explain it concerning a vulgar at a Pharisee’s, and you cannot infer anything. Rebbi Mana said, so said my teacher Rebbi Yose, all that we are considering here refers to heave. You may know that this is so, since we have stated there, “even moved, even tied, everything is impure.” Did they not say they are impure, not because moving? Did not Rebbi Joḥanan say, concerning heave there is neither separations, nor movings, nor [private domain, nor] vulgar. May heave itself be considered like a sufferer from gonorrhea in relation to sancta? Let us hear from the following. If one cuts a tube for sancta, he who cuts it and he who immerses it need immersion. One understands he who cuts. He who immerses? Could he not bind it with a (sit) [fiber] and immerse it? But explain it that he cut it in order to immerse it. May a sanctum itself be considered like a sufferer from gonorrhea in relation to the ashes of the Red Cow? Let us hear from the following. Two pitchers, one pure for sancta and one pure for heave, who touched one another are both pure. But does not a baraita disagree? They made that the person pure for the ashes of the Cow who moved spittle or semen of one pure for heave that it became impure. The same is pure for heave and pure for sancta.
There we have stated: “If he ate a fig cake with dirty hands, put his hand into his mouth to remove a pebble, …” Ḥizqiah said, one stated this only for a fig cake where he desires the fluid remaining on his finger, therefore not for anything else. Rebbi Joḥanan said, there is no difference, equally a fig cake where he desires the fluid remaining on his finger or anything other. The Mishnah disagrees with Ḥizqiah: “Touching by a person impure in the impurity of the dead who had food or drink in his mouth: if he put his head inside a pure stove he made it impure. If a pure person with food or drink in his mouth put his head inside the impure stove he became impure.” One understands drinks. From where was the food susceptible to impurity? Not from his saliva! Explain it either from a moist fig cake or as food which already outside were susceptible to impurity. The Mishnah disagrees with Rebbi Joḥanan: “One eats dry food with dirty hands with heave but not with sancta.” Explain it if he throws. If he throws then even for sancta. Maybe he will forget and touch. If maybe he will forget and touch then it should be forbidden also for heave. Eaters of heave are vigilant and he will not forget but eaters of sancta are not vigilant and he forgets.
All the time that his deceased is lying before him, he eats at his neighbor’s. If he has no neighbor, he eats in another room. If he has no other room, he makes a wall of separation and eats. If he is unable to make a wall of separation, he turns his face towards the wall and eats. He does not eat reclining; he does neither eat nor drink his fill. He eats neither meat nor drinks wine. One does not allow him to participate in a group to say Grace. If he recited Grace, one does not answer “amen” after him. If others recited Grace, he does not answer “amen”. That is on weekdays. But on the Sabbath, he does eat reclining; he eats meat and drinks wine, eats and drinks his fill. One lets him participate in a group to say Grace. If he recited Grace, one does answer “amen” after him. If others recited Grace, he answers “amen”. Rabban Simeon ben Gamliel said: Because you allowed all of these, oblige him for all other obligations of the Torah. If you permitted him temporary life, so much more eternal life. Rebbi Judah ben Pazi in the name of Rebbi Joshua ben Levi: Practice follows Rabban Simeon ben Gamliel. If he was handed over to the public, he may eat meat and drink wine. If he was handed over to the carriers it is as if he was handed to the public.

Rebbi Joḥanan was leaning on Rebbi Jacob bar Idi when Rebbi Eleazar saw him and hid himself before him. He said, these two things this Babylonian does to me: First, that he does not greet me, and second, that he does not teach the traditions in my name. He said to him, thus they behave among themselves; the younger one does not greet the older since they observe Boys see me and hide themselves, and old people rose and stood. As they were walking, he saw a Bet Midrash. He said to him: Here Rebbi Meïr sat and reported traditions in the name of Rebbi Ismael but he never reported traditions in the name of Rebbi Aqiba. He answered: Everybody knows that Rebbi Meïr was the student of Rebbi Aqiba. He retorted, everybody knows that Rebbi Eleazar is the student of Rebbi Joḥanan. May one pass by the water statue? He said to him, do you want to honor it? Pass it by and blind its eyes! He said to him, Rebbi Eleazar did well that he did not pass before you. He said to him: Rebbi Jacob bar Idi, you know how to pacify. But Rebbi Joḥanan required that traditions should be reported in his name. Also David begged for divine mercy in this respect, may I dwell in Your tent forever! Rebbi Phineas, Rebbi Jeremiah, in the name of Rebbi Joḥanan; Could David think of living forever? Like that bunch of grapes which drips by itself. Rebbi Ḥinena bar Pappus and Rebbi Simon, one said, like one who drinks spiced wine, the other said, like one who drinks old wine, even though he consumed it, its taste remains in his mouth.

Rebbi Yasa in the name of Rebbi Joḥanan: In the future, the Holy One, praise to Him, will only deal with the tribe of Levi. What is the reason? “ The refiner will sit, the purifier of silver, and will refine them,” etc. Rebbi Ze‘ira said, like a man who only drinks from a clean cup. Rav Hoshaia said, because we are Levites, should we lose? Rebbi Ḥanina the son of Rebbi Abbahu said, also in the future, the Holy One, praise to Him, will deal with them charitably. What is the reason? “ They will be for the Eternal presenters of an offering in charity.”
It was stated in the name of Rebbi Meïr: Just as there are opinions in eating and drinking, so opinions are [varied] among men. There is a man, if a fly falls into his cup, he takes it out, throws it away and drinks. That is like a normal man who sees his wife talking to her neighbors and relatives. Or you have a man who if a fly flies over his cup, takes it, pours [the contents] out, and does not taste them. That is a bad human attitude because he thinks of divorcing her. Or you have a man who, if a fly sits on his cup, takes it and leaves [the cup] untouched. That is Pappos ben Jehudah who locked his wife in. They said to him, did your forefathers behave like this? Or you have a man who finds a dead fly in his cup, takes it, licks it, and drinks. That is the wicked one who sees that his wife is overbearing with her slaves and slave-girls, where he would be commanded to divorce her, as it is said: “She left his house and went and married another man.” The verse called him other because he is not of the class of the first who expelled his wife because of a sexual transgression and the other one stumbled over her. If Heaven gives him credit, he will divorce her; otherwise, at the end she will bury him as it is said, “or if the latter man dies.” That man deserves to die since he brought that woman into his house.

“And he writes”. I could think [one writes] with ink, or vermilion, or gum, or copper sulfate, the verse says, “he shall wipe off”. If he has to erase, I could think [one writes] with drinks or fruit juice; the verse says, “he shall write”. How is that? Writing that can be wiped off. What is this? This is ink without vitriol. But did we not state: If he wiped off from a Torah scroll it is valid. Explain it following the Tanna who stated: Rebbi Meïr said, all the time we were studying with Rebbi Ismael, we put no vitriol in the ink.
“The teaching about jealousies”. This is a teaching of the Temple. A woman does not drink and repeat. Rebbi Jehudah said, Neḥemiah the ditch-digger testified before Rebbi Aqiba that a woman drinks and repeats. Rebbi Aqiba said, I shall explain. From one husband a woman does not drink and repeat, from two husbands a woman drinks and repeats. But the Sages say she drinks and repeats whether from one husband or from two husbands. Korkemit shall prove it, who drank and repeated and did it a third time from one husband before Shemaia and Abtalyon.

MISHNAH: A preliminarily married woman or one who waits for her brother-in-law neither drinks nor collects her ketubah, since it is said: “.. who will deviate from under her husband,” which excludes a preliminarily married woman and one who waits for her brother-in-law. A widow [married to] a High Priest, a divorcee or one who received ḥalîṣah to a common priest, a female bastard or a Gibeoness to an Israel, or an Israel woman married to a bastard or a Gibeonite, neither drinks nor collects her ketubah.
There, we have stated: “A she-ram, an old woman, or a sterile one neither drinks nor collects her ketubah,” as it is said: “She will be declared innocent and bear seed,” [this refers to] one able to bear seed; it excludes one who is unable to bear seed. They objected, is there not the widow [married to] the High Priest, is she not able to bear seed? There is a difference, since it is written: “He may not desecrate his seed among his people.” There, we have stated: “A bastard disables and enables to eat. How is this?” And here he says so? Rebbi Tanḥuma said, there, “she has no issue” of any kind, but here one requires enabled seed, not disabled seed. Rebbi Yose ben Rebbi Abun said, the water only serves to permit her to her house; but about this one one tells him to divorce once she went to a secluded place.
MISHNAH: A woman pregnant by another man or nursing another man’s [child] may neither drink nor collect her ketubah, the words of Rebbi Meïr, but the Sages say, he may separate from her and take her back later. A she-ram, an old woman, or a sterile one, neither drinks nor collects her ketubah; Rebbi Eleazar says, he may marry another wife and be fruitful and multiply with her. All other women either drink or cannot collect their ketubah.
The Sages agree with Rebbi Eleazar that if he had [another] wife and children, she drinks and collects her ketubah. If he had [another] wife and children but they died between the declaration of jealousy and her secret rendez-vous, she already was eligible to drink. If he did not have [another] wife and children but they died between the declaration of jealousy and her secret rendez-vous, she already was barred from drinking.
MISHNAH: A Cohen’s wife drinks and is permitted to her husband; the wife of a eunuch drinks. One may declare one’s jealousy with respect to any incest-‘prohibited person, except for a minor and a non-man.
MISHNAH: A Cohen’s wife drinks and is permitted to her husband; the wife of a eunuch drinks. One may declare one’s jealousy with respect to any incest-‘prohibited person, except for a minor and a non-man.
HALAKHAH: “A Cohen’s wife drinks,” etc. Otherwise, what could we say? She drank and the water had no influence on her; she is pure! I could say, merit suspended for her. That is according to him who says that merit suspends and it is not recognizable. But following him who says that merit suspends and it is recognizable? Rebbi Isaac said, really we deal with the case that she drank and the water had no influence on her; that you should not say since the water has no influence on a rape victim, but only on a seduced woman, this one is a rape victim. But a rape victim in the priesthood is like a willing one for an Israel, therefore it is necessary to say that she is permitted to her house. From where that rape disables a married woman in the priesthood? Since in matters of crawling things, which are a trifling matter, He made forced [impurity] equal to intentional [impurity], in the weighty matter of the deviant not so much more? Rebbi Jacob bar Idi stated before Rebbi Jonathan: “If you deviated from under your husband and became defiled,” that excludes rape. How do you understand this? He said to him, just as “under your husband” is by consent, so “if you became defiled” is by consent. “She was not raped”, she is forbidden. Therefore, if she was raped, she is permitted. But there is a rape victim which is forbidden for an Israel. Who is that? That is one who started by consent and ended up raped. And there is one who is not a rape victim which is permitted to an Israel. Who is that? That is one who started as a rape victim and ended up consenting. Like that woman who came to Rebbi Joḥanan and said to him, I was raped. He said to her, but was it not sweet to you in the end? She said to him, if a person dips a finger into honey and puts it into his mouth on the Day of Atonement, does he not feel bad about it and at the end it is sweet? He accepted her.
Rebbi Abbahu in the name of Rebbi Mana: Why did they say that secondarily impure profane food defiles profane fluids? Because of the hands. Since hands, [whose impurity] is rabbinical, defile profane fluids, secondarily impure food, [whose impurity] is biblical, not so much more? Also, since hands, in a case of doubt whether they defiled, impart impurity, so also secondarily impure fluids, in a case of doubt whether they defiled, impart impurity. Rebbi Ḥanina objected before Rebbi Mana: Look, if somebody eats secondarily impure food and drinks secondarily impure fluids, in a case of doubt whether they defiled, they impart impurity. But secondarily impure foods by biblical standards, in a case of doubt whether they defiled, leave it pure! Rebbi Ḥanina said before Rebbi Mana: Do we not deal with heave? He said to him, even if you say that we deal with heave; is the one who argues “is impure”, “shall become impure” as word of the Torah not Rebbi Aqiba?
MISHNAH: The seducer pays for three things and the rapist for four. The seducer pays for shame, diminution of value, and fine. The rapist in addition pays for suffering; the seducer does not pay for suffering. The rapist pays immediately, the seducer only if he divorces her. The rapist drinks from his pot; the seducer may divorce if he wishes.
A private person who committed himself for a fast day, eats and drinks after nightfall. But if he said a public fast day, he eats and drinks only during daytime. If he made a vow to fast and it turned out to fall on Sabbath days or holidays, he is whipped but does not need permission from a Sage. If he made a vow to fast and it turned out to fall on days written in the Scroll of Fasts, Rebbi Ḥizqia and Rebbi Yudan in the name of Rebbi Ḥiyya bar Abba: One said, he fasts but does not finish, but the other one said, he is whipped but does not need permission from a Sage. That is, you say that before the scroll of fasts was abolished. But when the Scroll of Fasts was abolished, all this was abolished. Rebbi Ḥanania and Rebbi Joḥanan both say that the Scroll of Fasts was abolished. Rebbi Joshua ben Levi said, the Scroll of Fasts was abolished. Rebbi Joḥanan said, yesterday I was sitting and stating: “It happened that they decreed a fast day at Lod during Ḥanukka. Rebbi Eliezer went and had a haircut, Rebbi Joshua went and took a hot bath. Rebbi Joshua said to them, go and fast for what you fasted.” And you say, the Scroll of Fasts was abolished? Rebbi Abba said, even though you say that the Scroll of Fasts was abolished, Ḥanukka and Purim were not abolished. The acts of the rabbis imply that the Scroll of Fasts was abolished: Rebbi Jonathan fasted on the day before New Year’s Day. Rebbi Abin fasted on the day before Tabernacles. Rebbi Ze‘ira fasted 300 fast days, and some say 900 fast days and did not care about the Scroll of Fasts. Rebbi Jacob bar Aḥa told the scribes: If a woman comes to ask you, tell her that one may fast any day except Sabbaths, holidays, New Moons, the intermediary days of holidays, Ḥanukka, and Purim.

MISHNAH: Rebbi Jehudah says, if one said ‘a qônām that I shall not taste wine until Passover has come’, he is forbidden only until the night of Passover since he intended only until the time everybody drinks wine. If one said, “a qônām that I shall not taste meat until the fast,’ he is forbidden only until the evening before the fast since he intended only until the time everybody eats meat. His son Rebbi Yose said, if one said ‘a qônām that I shall not taste garlic until the Sabbath,’ he is forbidden only until Friday evening, since he intended only until the time everybody eats garlic. If one says to his friend: A qônām that I shall not have any usufruct from you if you do not come and take for your children a kor of wheat and two amphoras of wine, he can undo his vow without referring to a Sage by saying, you did that only to honor me, that is my honor. Similarly, if one says to his friend: A qônām that you shall not have any usufruct from me if you do not come and give to my child a kor of wheat and two amphoras of wine. Rebbi Meïr says, he is forbidden until he gives, but the Sages say, this one also can undo his vow without referring to a Sage by saying, it is as if I received it.
MISHNAH: Three kinds are forbidden for the nazir: Impurity, shaving, and anything coming from the vine. Everything coming from the vine is added together. He is only guilty when he eats grapes in the volume of an olive; according to the early Mishnah if he drinks a quartarius of wine. Rebbi Aqiba says, even if he dipped his bread in wine for a total volume of an olive, he is guilty.
“According to the early Mishnah if he drinks a quartarius of wine.” They did explain “liquor”. Since “liquor” mentioned there means a quartarius, so “liquor” mentioned here also means a quartarius. They changed to say “he shall not eat, he shall not drink.” Since eating is defined by an olive’s size so drinking is by an olive’s size.
HALAKHAH: Who is doubtfully definitely [suffering]? Two who came to him. He declared one of them definitively affected but before he could declare the second one definitively affected, they were changed for him. That is a doubtfully definitely [suffering person]. This is the one about whom Rebbi Ḥiyya stated: A nazir, in doubt whether impure or pure, but certainly he was a nazir. A sufferer from skin disease, in doubt whether impure or pure, but certainly he was a sufferer from skin disease. He eats from sacrificial meat after 60 days, drinks wine and defiles himself for the dead after 120 days. How is that? One said to him, you are an impure nazir, go count seven [days]. He sprinkled, repeated, shaved, and brought. He then counted seven [days] and wanted to shave. One said to him, impure nazir, go count seven [days] and continue for 30. He counted 30 [days] and wanted to shave. One said to him, you are a pure nazir, does not a pure nazir shave on kinds of blood? He brings an elevation offering and shaves on it, a bird purification offering and stipulates, saying: “If I was impure, the purification offering is my obligation and the elevation offering is voluntary. If I was pure, the elevation offering is my obligation and the purification offering is in doubt.” He shaves his head, his beard, and his eyebrows in the way the sufferer from skin disease shaves.
“If he was doubtfully impure and certainly definitely [suffering from skin disease], he eats from sacrificial meat after 60 days, drinks wine and defiles himself for the dead after 120 days. If he was certainly impure and doubtfully definitely [suffering from skin disease], he eats from sacrificial meat after 20 days, drinks wine and defiles himself for the dead after 44 days. If he was certainly impure and certainly definitely [suffering from skin disease], he eats from sacrificial meat after eight days, drinks wine and defiles himself for the dead after 44 days.”

MISHNAH: One writes with anything, with ink, with vermilion, with gum, and with copper sulfate, and anything that leaves a record. One does not write with drinks, or fruit juice, or anything not permanent. One writes on anything, on a leaf of the olive tree, on a cow’s horn if one delivers the cow to her, on a slave’s hand if one delivers the slave to her. Rebbi Yose the Galilean says, one does not write on anything living nor on food.
Rebbi Yasa in the name of Rebbi Joḥanan: In the future, the Holy One, praise to Him, will only deal with the tribe of Levi. MISHNAH: The one who leads astray is a commoner who leads a commoner astray, by saying to him: There is something to worship at place X; it eats such and such, drinks such and such; it gives such and such benefits, can do such and such evil. For no capital crime in the Torah may one use entrapment, except for this one. If he said it to two persons, they become his witnesses, bring him to court, and stone him. If he said this to a single person, he should tell him, I have friends who also want this. If he was sly and did not talk in their presence, one sets a trap behind a wall; he tells him, repeat what you told me alone; then he tells him, how can we abandon our God in Heaven and worship wood and stones? If he repents, it is good; if he says, it is our duty, or so it is good for us, those who stand behind the wall bring him to court and stone him. He says, I shall worship, I shall go and worship, let us go and worship; I shall sacrifice, I shall go and sacrifice, let us go and sacrifice; I shall burn incense, I shall go and burn incense, let us go and burn incense; I shall pour libations, I shall go and pour libations, let us go and pour libations; I shall prostrate myself, I shall go and prostrate myself, let us go and prostrate ourselves. The seducer is one who says, let us go and profess a strange worship.
MISHNAH: When is he guilty? From the moment he eats a fourfold portion of meat and drinks half a log of wine. Rebbi Yose says, a mina of meat and a log of wine. If he ate in a company of obligation, or at the lengthening of a month, or ate Second Tithe in Jerusalem, or ate torn or carcass meat, abominations and crawling things, i. e., if he ate anything which either is an obligation or anything forbidden, or ate any food but not meat, or drank any drink but not wine, he does not turn into a deviant and rebellious son unless he ate meat and drank wine, since it is said: gorging and drinking to excess. Even if it is not proof, there is a hint in what is said: Do not be among those who drink wine excessively, nor with those who are gorging themselves on meat.
The colleagues asked before Rebbi Samuel ben Naḥman: He was a priest of idol worship and lived so long? He said to them, because he was grudging to his idol. How was he grudging to his idol? If a man came to sacrifice an ox, a sheep, or a goat to the idol and told him: Make it favorably inclined towards me, he would say, what use does it have for you? It never eats, nor drinks, nor does good or evil. He said to him, what should we do? He said to him, go, make, and bring me a wooden vessel full of fine flour and put on it ten eggs, then I shall make it favorably inclined towards you. After he left, he would eat it. One day, a son of pashas came and he said that to him. He said to him, if it is of no use, what are you doing here? He answered him, because of my livelihood.
A pious person happened to be insistent in the matter of uncovered [drinks]; he was smitten with a fever. They saw him preaching on the Day of Atonement with a flask of water in his hand.
Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba: All poisons cause scab but the poison of a snake kills. Rebbi Ḥiyya said, one is not asked about uncovered [drinks]. Rebbi Jeremiah asked before Rebbi Ze`ira; as master of the ruling he asked him.
What means “burns it”? He slurps it. Rebbi Simeon ben Laqish said, in a dirty cup. This implies that one who drinks from a dirty cup neither benefits nor commits larceny.
If somebody worshipped an egg Ḥizqiah said, he did not make it forbidden; Rebbi Joḥanan said, he made it forbidden. Rebbi Zeˋira said, they disagree about an egg. The colleagues say, they disagree about pebbles in a river bed. Rebbi Huna said, a verse supports what the colleagues say:Your part is with river pebbles; these are your destiny. The strength of Ḥizqiah is from the following: “Then why is an Ashera forbidden? Because it was held by human hand, and anything held by human hand is forbidden.” Everybody agrees that wheat is forbidden; as Rebbi Ḥanina bar Yasa said in the name of Rav Jehudah: The roots of wheat split the earth to a depth of 50 cubits; the soft roots of a fig tree split rock. Then what do the roots of the carob and the roots of the sycamore? Rebbi Ḥanina said, once every thirty days the abyss wells up and drenches them. What is the reason? I, the Eternal, am watching over it and water it in moments. It was stated: Rebbi Simeon ben Eleazar says, this teaches that the earth drinks only according to its hardness.
MISHNAH: If a nazir was drinking wine a whole day long, he is liable only once. If one told him, do not drink, do not drink, if then he drinks he is liable for every single occasion. If he was defiling himself with corpses a whole day long, he is liable only once. If one told him, do not defile yourself, do not defile yourself, if then he defiles himself he is liable for every single occasion. If he was shaving a whole day long, he is liable only once. If one told him, do not shave, do not shave, if then he shaves he is liable for every single occasion. If he was dressed in kilaim a whole day long, he is liable only once. If one told him, do not dress, do not dress, and he took off and put on, he is liable for every single occasion.
It was stated: For the 24 hours which were stated, one suspends but one does not burn. Rebbi Ze‘ira enjoyed this [because] he found stated: “A woman who detects a stain makes impure retroactively. What does she make impure? Food, and drinks, and seats, and beds; her count is in disorder, and she makes her sex partner impure retroactively. A woman who detects blood makes impure retroactively. What does she make impure? Food, and drinks, and seats, and beds; her count is not in disorder, and she does not make her sex partner impure retroactively. Rebbi Aqiba says, she makes her sex partner impure retroactively. In both cases, one suspends but one does not burn.” There, they say: For the 24 hours which were stated, her bed is like her touch. How? Like one who sleeps with a menstruating woman who does not make impure by moving and does not make clay vessels impure. It was found stated: He makes clay vessels impure by moving. For the 24 hours which were stated, what is the status of what she touches in the public domain? Let us hear from the following: Pregnant and nursing women are pure for their husbands, as is a woman with a regular period. And all other women are pure for sexual relations but impure in their touch. That means, what she certainly touched in the public domain is impure.

“And like mixed wine.” Abba bar Ḥana in the name of Rebbi Joḥanan: As one sees a cup of mixed wine from the outside. They wanted to say, in a Tiberian cup. Rebbi Eudaimon from Sepphoris said before Rebbi Mana: As in a small phial whose walls do not cast a shadow. Samuel said, anybody who has no experience in seeing kinds of pure blood should not judge kinds of impure blood. Rav said, only if he is competent about them and their names. The words of Rebbi Joḥanan say so: I know all kinds of pure blood and of impure blood. The pure is the most red; the impure is like earth water. “If he has no experience,” therefore, if he has experience he can judge it. In addition, from what we have stated: clear but not turbid. Rebbi Ḥanina used it turbid. They said before Rebbi Joḥanan: Rebbi Ḥanina uses it turbid, but you said, not turbid. He said to them, Rebbi Ḥanina drinks old [wine], Rebbi Joḥanan does not drink old [wine], Rebbi Ḥanina drinks oldest [wine]. Rebbi Hoshaiah said: Since Rebbi Hoshaiah’s eye is full of happenings, even turbid is not disqualified for him. Rebbi Shammai in the name of Rebbi Aḥa: Rebbi Ḥanina estimated with a lump of earth. Rebbi Abun, Rebbi Shammai in the name of Rebbi Aḥa: Since we know that Rebbi Ḥanina is competent, do we follow his precedents? Rebbi Ḥanina was living in Sepphoris, they brought cases before him and he decided on the basis of three precedents. Rebbi Joḥanan and Rebbi Simeon ben Laqish were there but he did not invite them to sit with him. They said, the old man is a Sage since his irons are sharp! Once he invited them to sit with him. They said, for what reason do you take notice of us this time? He said, so should come over me if I had not heard every single case from Rebbi in theory as many times as there are hairs on my head, and in a practical way three times; but the present case did come before Rebbi only twice. Therefore, I adjoined you with me.

The Babylonian Talmud
Surely it is on the tenth that we fast ! But the intention is to tell thee that whoever eats and drinks on the ninth, the Scriptures ascribe it to him as though he fasted on the ninth and tenth.
There are some who declare that R. Isaac stated that R. Johanan said in the name of R. Eliezer b. Jacob : Whoever eats and drinks and afterwards offers his prayers, concerning him the Scriptures say, "Thou hast cast Me behind thy back" (I Kings xiv. 9). Read not geweka "thy back," but geeka "thy pride." The Holy One, blessed be He, says, "After this person has exalted himself, he receives upon himself the kingdom of Heaven."
It was stated above : "Rab Judah said in the name of Samuel, and similarly said R. Isaac in the name of R. Johanan : Over olive-oil we pronounce the benediction '...Who createst the fruit of the tree'." How is this meant? Should I say that he drinks it as a beverage, it does him harm; for there is a teaching : He who drinks the oil of an offering repays its value but not a fifth in addition ; but he who anoints himself with the oil of an offering repays its value plus a fifth!

But [perhaps it is here meant that] he eats it together with bread. If so, the bread is the principal food and the oil is only accessory ; and we have the Mishnaic teaching : This is the general rule : In the case of a food which is the principal thing and together with it something accessory, the benediction is to be uttered over the former, and there is no necessity for a benediction over the latter ! But [perhaps what is meant is] he drinks it with elaiogaron. (Rabbah b, Samuel said : Elaiogaron is the juice of beets ; oxygaron is the juice
MISHNAH If one ate grapes, figs or pomegranates, he says after them the three benedictions. These are the words of Rabban Gamaliel ; but the Sages declare : One benediction which is an abstract of three. R. 'Akiba says : Even if one eats [nothing but] boiled vegetables and makes a meal of it, he pronounces thereover the three benedictions. If one drinks water to slake his thirst, he says the benediction "...By Whose word all things exist "; R. Tarphon says : "...Who createst many living beings and their wants."
Our Rabbis have taught : A small salted fish sometimes kills on the seventh, the seventeenth and twenty-seventh, and some say the twenty-third day. This applies only to the case where it has been roasted but not roasted [thoroughly] ; but if it has been well-roasted, there is no objection. And when it has been well-roasted, it only applies to the case where one does not drink beer after it ; but if he drinks beer after it, there is no objection.
If one drinks water to slake his thirst, etc. What does this intend to exclude ? Rab Iddi b. Abin said : To exclude him whom
Our Rabbis have taught : Six things are said of the asparagus-beverage : One should only drink it undiluted and full; one receives it with the right hand but drinks it [holding it] with the left ; one must not talk after drinking it ; one must not stop in the course of drinking ; one must only return the cup to him who handed it to him ; he should expectorate after drinking it ; and one must not support it except with its own kind.
Rab Assi said : One must not speak over the cup of benediction. Rab Assi also said : We may not say the benediction over a cup of ill-luck. What means "a cup of ill-luck"? Rab Nahman b. Isaac said : A second cup. There is a teaching to the same effect : He who drinks [cups of wine] of an even number should not say Grace ; because it is said, "Prepare to meet thy God, O Israel" (Amos iv. 12); but such an one is not fitly prepared.
Do Bet Shammai hold that the Grace after meals requires a cup of wine ? For our Mishnah teaches : If wine is brought to them after the food and there is only sufficient for one cup, Bet Shammai declare : He says the benediction over the wine and then over the food. Is it not to be supposed that he says the benediction [over the wine] and then drinks it ? No ; he says the benediction and leaves it [undrunk for the Grace].
But R. Hiyya has taught : Bet Shammai declare : He says the benediction over the wine and drinks it, and after that says Grace ! Nay, there are two Tannaim who differ as to the teaching of Bet Shammai.
GEMARA. Our rabbis taught, All seven days, one should make the Sukkah his permanent residence and his house his temporary residence. How so? If he had beautiful vessels, he brings them up into the Sukkah, beautiful coverings, he brings them up into the Sukkah. He eats and drinks and spends his leisure time in the Sukkah. From where do we know this? As our rabbis have taught: You shall dwell" in the same manner as you ordinarily dwell. From here they said, "All seven days one should make his Sukkah his permanent dwelling, and his house his temporary dwelling." How so? If he had beautiful vessels, he brings them up into the Sukkah, beautiful coverings, he brings them up into the Sukkah. He eats and drinks and spends his leisure time in the Sukkah.; he should study in the Sukkah.

We read in a Baraita ('Erubin, 45b): R. Eliezer said, the whole universe drinks from the ocean, as it is said (Gen., 2.6): "There went up a mist from the earth, and watered the whole face of the ground." Said R. Joshua to R. Eliezer, is not the water of the ocean salty?! Said R. Eliezer, it gets sweetened in the clouds. R. Joshua said, the whole universe drinks from the waters above (the firmament), as it is said (Deut., 11.11): "A land that drinketh water as the rain of heaven cometh down." How then can one explain the verse: "There went up a mist from the earth"? This verse teaches that the clouds rise and soar upward, where they open their mouths like a leathern bottle and receive the rain water, as it is said (Job, 36.27): "They distil rain from His vapour." They (the clouds) are perforated like a sieve and distil water to the ground, as it is said (II Samuel, 22.12): "Gathering of waters, thick clouds of the skies." Between each drop of rain there is no more space than the breadth of a hair, which is to impress upon us the truth that the day of rain is as miraculous a phenomenon as the day on which heaven and earth were created, for it is said (Job, 5.9): "Who doeth great things and unsearchable, marvellous things without number," and further on (ib., 5.10): "Who giveth rain upon the earth, and sendeth waters upon the fields," and elsewhere (Is., 40.28): "Hast thou not known? hast thou not heard that the everlasting God, the Lord, the Creator of the ends of the earth, fainteth not, neither is weary? His discernment is past searching out."

It was told of Nahum of Gamzo that he was blind in both eyes, stumped in both hands, crippled in both legs, that his whole body was covered with sores and his bed stood in four basins of water to prevent ants climbing up (the legs of the bed). Once he was lying in a ruinous house and his disciples desired to remove him, but he said to them: "Remove first the furniture and then remove my bed, for you can be sure that as long as I am in the house, the house will not fall in." They removed the furniture and then the bed, and immediately after the house fell in. His disciples then asked him: "Master! Since thou art so wholly righteous, why did all this come upon thee?" "I caused it myself", he replied. "Once I was going to the house of my father-in-law and had with me a load carried by three asses, one part consisting of food, another of drinks and the third of all sorts of delicacies. Suddenly there appeared before me a man, who said to me: 'Master, give me something to eat.' I said to him, 'Wait until I alight from the ass.' After I had alighted, I turned around and found that the man was dead. I then threw myself upon him and said: 'My eyes that had no pity upon thine eyes shall become blind; my hands that had no pity upon thy hands shall become stumped; and my feet that had no pity upon thy feet shall become crippled.' But even then my mind was not set at rest until I said: 'May my body become covered with sores.'" Said they to him: "Woe unto us that we must see thee in such a condition!" Nahum, however, replied: "Woe would it be to me if you did not see me in this condition."
We read in a Mishnah (Pesaḥim, 54b): Wherever it is customary to work on the ninth of Ab, one may do so, but if it is the custom of the place not to work, one must refrain from work; scholars must abstain from work in whatever place they may happen to be; Rabban Simeon b. Gamaliel said: Everybody should in this respect always conduct himself as if he were a scholar. We further read in a Baraita: Rabban Simeon b. Gamaliel said, one should always conduct himself as a scholar (and abstain from work), so that he may be more conscious of his fast; Rabban Gamaliel said, he who eats and drinks on the ninth of Ab, is as if he ate on the Day of Atonement; R. 'Aḳiba said, he who works on the ninth of Ab will never see a sign of blessing (success); the other Sages said, he who eats and drinks on the ninth of Ab, will not live to see the rejoicing of Jerusalem, for it is said (Is., 66. 10): "Rejoice ye with Jerusalem, and be glad with her, all ye that love her; rejoice for joy with her, all ye that mourn for her"—that is to say, all those who mourn for her will witness her rejoicing, while those who do not mourn for her, will not witness her rejoicing; moreover, of him who eats meat and drinks wine on the ninth of Ab, Scripture says (Ezek., 32. 27): "And their iniquities are upon their bones."

On the seventh day, where the king’s heart was merry with wine. Was then his heart not merry with wine until then? — Rava said: The seventh day was Shabbat, when Israel eats and drinks. They begin with words of Torah and with words of thanksgiving [to God]. But the nations of the world when they eat and drink only begin with words of frivolity.
“Their laws are diverse from those of every other people”: they do not eat of our food, nor do they marry our women nor give us theirs in marriage. “Neither keep they the king’s laws”, since they evade taxes the whole year by saying today is Shabbat, today is Pesah. “Therefore it does not profit the king to suffer them”, because they eat and drink and despise the throne. For if a fly falls into the cup of one of them, he throws it out and drinks the wine, but if my lord the king were to touch his cup, he would dash it on the ground and not drink from it.
Rav Achai says, One who holds back his bodily functions transgresses the verses (Leviticus 20, 25) "Do not makes yourself abominable" Rav Bivi bar Abaye said, A person who drinks from a bloodletter's tube transgresses the prohibition of "do not make yourself abominable".
